		<official-title>To require the Secretary of the Treasury to establish a
		  revolving loan fund program for certain businesses to facilitate increased
		  lending in the United States.</official-title>

		<section id="HED4AC427319F437980AF3F8C96FAD06" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Main Street Survival Act</short-title></quote>.</text>
		</section><section id="H4A760728154E42ED8B1B67DBE352DF81"><enum>2.</enum><header>Findings; Sense
			 of Congress</header>
			<subsection id="HFAA37161374D4DDB93B69F25F6E60045"><enum>(a)</enum><header>Findings</header><text display-inline="yes-display-inline">The Congress finds the following:</text>
				<paragraph id="H759562710FB34EA0802B29C812EACFE"><enum>(1)</enum><text>Despite the
			 infusion of hundreds of billions of dollars to provide liquidity to capital
			 markets, many qualified and creditworthy small and medium-sized businesses
			 continue to face severely constricted credit markets.</text>
				</paragraph><paragraph id="H1E49C949F7FE427CA30612E417CC672"><enum>(2)</enum><text>Banks of all sizes
			 have significantly decreased lending in, and in some cases withdrawn completely
			 from, the small and medium-sized business credit market.</text>
				</paragraph><paragraph id="HE475AA6737944439B54D49D8904B8655"><enum>(3)</enum><text>Available and
			 affordable credit is critical for the survival of the small and medium-sized
			 businesses that form the backbone of the economy of the United States.</text>
				</paragraph></subsection><subsection id="H57910ED7C40E4915838646658B4E17F3"><enum>(b)</enum><header>Sense of the
			 Congress on lending to small and medium-sized businesses</header><text>It is
			 the sense of the Congress that the President, acting through the Secretary of
			 the Treasury, should encourage financial institutions that have received
			 Federal financial support to maintain historic levels of lending to small and
			 medium-sized businesses.</text>
			</subsection></section><section id="H6C28D128C6B8439DBA6D68DEB9A75573"><enum>3.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act—</text>
			<paragraph id="H0CD9C56C22674FE08748825035B5129"><enum>(1)</enum><text>the term
			 <term>revolving loan fund</term> means the revolving loan fund established
			 under section 4(b); and</text>
			</paragraph><paragraph id="HC2775439605B4840943C2465205755F5"><enum>(2)</enum><text display-inline="yes-display-inline">the term <term>Secretary</term> means the
			 Secretary of the Treasury.</text>
			</paragraph></section><section id="H789161986188400EA36B481E89217062"><enum>4.</enum><header>Main street
			 revolving loan fund program</header>
			<subsection id="H06D34D1D831D4418B5E1457BD5EDA238"><enum>(a)</enum><header>Establishment</header><text display-inline="yes-display-inline">The Secretary shall establish the Main
			 Street Revolving Loan Fund Program (hereinafter in this Act referred to as the
			 <quote>program</quote>) to provide temporary loans to businesses that meet the
			 size requirement under paragraph (1) of subsection (c).</text>
			</subsection><subsection display-inline="no-display-inline" id="H1D88955EF4E745A7BAA2B175374B8CA4"><enum>(b)</enum><header>Revolving loan
			 fund</header>
				<paragraph id="HE743547CC84442ACBB6C40A351E256AC"><enum>(1)</enum><header>In
			 general</header><text>There is established in the Treasury a revolving loan
			 fund for the program.</text>
				</paragraph><paragraph id="H02572B5060214B818F9F8204F4DFD709"><enum>(2)</enum><header>Initial
			 transfer</header><text display-inline="yes-display-inline">From dividends paid
			 by financial institutions that have received financial assistance provided
			 under title I of the Emergency Economic Stabilization Act of 2008 (Public Law
			 110–343; 12 U.S.C. 5211 et seq.), the Secretary shall transfer and credit
			 $1,000,000,000 to the revolving loan fund.</text>
				</paragraph><paragraph id="H58F30EFBE38A49F9BCAFA8E4EDF03165"><enum>(3)</enum><header>Expenditures</header><text>The
			 Secretary shall use the amounts in the revolving loan fund to carry out the
			 program.</text>
				</paragraph><paragraph display-inline="no-display-inline" id="HE993C9224DC04A2783B38418A8D4DEED"><enum>(4)</enum><header>Deposits</header><text>The
			 Secretary shall deposit amounts received as payment on loans provided under the
			 program into the revolving loan fund.</text>
				</paragraph></subsection><subsection id="H3C9B91410BED47EE984106E71033043D"><enum>(c)</enum><header>Eligibility</header>
				<paragraph id="H6A86908B697C4AF4B42296143F8C1C74"><enum>(1)</enum><header>Size
			 requirement</header><text display-inline="yes-display-inline">To qualify for a
			 loan under the program, a business shall have less than 1,000 full-time
			 equivalent employees at the time of submission of an application under
			 subsection (d).</text>
				</paragraph><paragraph id="H5A1455FF54624637B43E858212DF914D"><enum>(2)</enum><header>Considerations</header><text display-inline="yes-display-inline">The Secretary, through regulations, shall
			 develop criteria to evaluate and select businesses for participation in the
			 program, taking into consideration—</text>
					<subparagraph id="H132467A35BAA4686B06C3C31F9D5C622"><enum>(A)</enum><text>the likelihood
			 that the business concerned will be forced to lay off employees in the absence
			 of obtaining a loan under such program; and</text>
					</subparagraph><subparagraph id="HDB5C622BE2E94A1DB5A6003C7CFDDE7B"><enum>(B)</enum><text>the ability of
			 such businesses to repay the loan.</text>
					</subparagraph></paragraph><paragraph id="H5572D418F78C4B92AA7786EB14F763CC"><enum>(3)</enum><header>Availability</header><text>The
			 criteria developed under paragraph (2) shall be made available on the official
			 public Web site of the Department of the Treasury.</text>
				</paragraph></subsection><subsection id="HCDD7C611D73E41128D1B64ABD97171EF"><enum>(d)</enum><header>Application</header><text display-inline="yes-display-inline">A business desiring a loan under the
			 program shall submit an application to the Secretary at such time, in such
			 manner, and accompanied by such information as the Secretary may
			 require.</text>
			</subsection></section><section id="HBCABEA585A6C4499B9F9C9001160FB8"><enum>5.</enum><header>Terms</header>
			<subsection id="HE359E1D311B5465CA37802F566BB0024"><enum>(a)</enum><header>Use of
			 funds</header><text display-inline="yes-display-inline">A business receiving a
			 loan under the program may use the funds to finance the cost of operations,
			 including—</text>
				<paragraph id="H96B8E503B7E64F3EB79F89BBCBB61104"><enum>(1)</enum><text>purchasing and
			 operating equipment;</text>
				</paragraph><paragraph id="HB1ACFFD04F784067B66F711B68BFA7B5"><enum>(2)</enum><text>paying salaries,
			 wages, and building expenses; and</text>
				</paragraph><paragraph id="H5E92AEB642DD4A65952D114535679054"><enum>(3)</enum><text>purchasing
			 inventory or making improvements to enhance productivity.</text>
				</paragraph></subsection><subsection id="H2B0499D6227E410E9EBC61BAF241C623"><enum>(b)</enum><header>Prohibited
			 use</header><text display-inline="yes-display-inline">A loan provided under the
			 program may not be used to significantly expand operations.</text>
			</subsection><subsection display-inline="no-display-inline" id="H8E16501A8F1E4975942F8779E45598E6"><enum>(c)</enum><header>Repayment
			 period</header><text display-inline="yes-display-inline">A loan provided under
			 the program shall be made for a period not to exceed 9 months.</text>
			</subsection><subsection id="H56A3666AD52B4366B504FDE495C1EDFD"><enum>(d)</enum><header>Maximum loan
			 amount</header><text display-inline="yes-display-inline">Under the program, the
			 Secretary may provide not more than a total of $1,000,000 in loans to a
			 particular business in any fiscal year.</text>
			</subsection></section><section id="H000B99455E494E869180B319B04E6612"><enum>6.</enum><header>Administrative
			 costs</header><text display-inline="no-display-inline">Not more than $1,000,000
			 may be used for administrative costs in any fiscal year to carry out the
			 program.</text>
		</section><section id="H20B4B1E523074085A3C8A3001D2F3534"><enum>7.</enum><header>Report</header>
			<subsection id="H0C15F021600E43D1A631AAE9EB9C39A8"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">The Secretary shall
			 make available on the official public Web site of the Department of the
			 Treasury, and submit to Congress—</text>
				<paragraph id="H7C6003A2B1254D2DBF91DA6BF5C965C7"><enum>(1)</enum><text display-inline="yes-display-inline">within 1 year after the date of enactment
			 of this Act and each year thereafter in which a loan has been made under the
			 program, an annual report; and</text>
				</paragraph><paragraph id="H4A876771F2EE4EBA80E6A6FD5B579032"><enum>(2)</enum><text>within 90 days
			 after the end of the 9-month period following the issuance of the final loan
			 under the program, a final report.</text>
				</paragraph></subsection><subsection id="HCBC2DE7847C2417FB2DFC73FEBFEAE4F"><enum>(b)</enum><header>Details</header><text>Each
			 report shall provide details on loans provided under the program and the
			 effectiveness of such program in providing stability for, and otherwise
			 supporting, businesses.</text>
			</subsection></section><section id="H627D83CDA4064C128597E12EFAD14260"><enum>8.</enum><header>Regulations</header><text display-inline="no-display-inline">The Secretary may prescribe regulations
			 necessary to carry out this Act.</text>
		</section><section id="H5A84F3B274514448B5261272BD1EC649"><enum>9.</enum><header>Sunset</header><text display-inline="no-display-inline">An application for a loan under the program
			 may not be accepted after the date which is 3 years after the date of enactment
			 of this Act.</text>
