		<section id="H06349383C0FB4761A090F7E85079D37B" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Prison Abuse Remedies Act of
			 2009</short-title></quote>.</text>
		</section><section id="HF6D03054D7EE455C8C5BA29BB9EA326C"><enum>2.</enum><header>Showing of
			 physical injury not mandatory for claims</header>
			<subsection id="H9530AB44999B4A2FB88F0D58202DC582"><enum>(a)</enum><header>Civil rights of
			 institutionalized persons act</header><text>Section 7 of the Civil Rights of
			 Institutionalized Persons Act (42 U.S.C. 1997e) is amended by striking
			 subsection (e).</text>
			</subsection><subsection id="HCF53E0A77EDA42B49795F797E18E54DD"><enum>(b)</enum><header>Title
			 28</header><text>Section 1346(b) of title 28, United States Code, is amended by
			 striking paragraph (2).</text>
			</subsection></section><section id="H1CE0A391AAFC4693A5C290839E9FA94B"><enum>3.</enum><header>Staying of
			 nonfrivolous civil actions to permit resolution through administrative
			 processes</header><text display-inline="no-display-inline">Subsection (a) of
			 section 7 of the Civil Rights of Institutionalized Persons Act (42 U.S.C.
			 1997e(a)) is amended to read as follows:</text>
			<quoted-block display-inline="no-display-inline" id="H7E6C59D3192344598796032D5FC2ED9D" style="OLC">
				<subsection id="H6AE4990788E043C399D1E120DFEEEC25"><enum>(a)</enum><header>Administrative
				remedies</header>
					<paragraph id="HAE5B268C84D5477DAFB97615E79A0C47"><enum>(1)</enum><header>Presentation</header><text display-inline="yes-display-inline">No claim with respect to prison conditions
				under section 1979 of the Revised statutes (42 U.S.C. 1983), or any other
				Federal law, by a prisoner confined in any jail, prison, or other correctional
				facility shall be adjudicated except under section 1915A(b) of title 28, United
				States Code, until the claim has been presented for consideration to officials
				of the facility in which the claim arose. Such presentation satisfies the
				requirement of this paragraph if it provides prison officials of the facility
				in which the claim arose with reasonable notice of the prisoner's claim, and if
				it occurs within the generally applicable limitations period for filing
				suit.</text>
					</paragraph><paragraph id="H492F597D94C9447A80EDE2589B79D00A"><enum>(2)</enum><header>Stay</header><text display-inline="yes-display-inline">If a claim included in a complaint has not
				been presented as required by paragraph (1), and the court does not dismiss the
				claim under section 1915A(b) of title 28, United States Code, the court shall
				stay the action for a period not to exceed 90 days and shall direct prison
				officials to consider the relevant claim or claims through such administrative
				process as they deem appropriate. However, the court shall not stay the action
				if the court determines that the prisoner is in danger of immediate
				harm.</text>
					</paragraph><paragraph id="HFA3142B2AC2247A4BA397479C6DF7CB9"><enum>(3)</enum><header>Proceeding</header><text>Upon
				the expiration of the stay under paragraph (2), the court shall proceed with
				the action except to the extent the court is notified by the parties that it
				has been
				resolved.</text>
					</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section id="HC4ED14E5848B40939C8407106240AFA9"><enum>4.</enum><header>Exemption of
			 juveniles from Prison Litigation Reform Act</header>
			<subsection id="H6E45976E2153434FACB993812576FF22"><enum>(a)</enum><header>Title
			 18</header>
				<paragraph id="HDF69B0FCB15441568EB8E3C1AF302AAA"><enum>(1)</enum><header>Juvenile
			 proceedings</header><text>Section 3626(g) of title 18, United States Code, is
			 amended—</text>
					<subparagraph id="H063E27592C664E3E9CD03F0B73645459"><enum>(A)</enum><text>in paragraph (3)
			 by striking <quote>or adjudicated delinquent for,</quote>; and</text>
					</subparagraph><subparagraph id="H4EA54C880FB54A1A82A3C9B3DA3D6009"><enum>(B)</enum><text>so that paragraph
			 (5) reads as follows:</text>
						<quoted-block display-inline="no-display-inline" id="H22D19244CD0A4307BF471AE29BBA49D0" style="OLC">
							<paragraph id="H82F0E4F7CF7C4E7F9D0BED3238368A0E"><enum>(5)</enum><text>the term
				<term>prison</term> means any Federal, State, or local facility that
				incarcerates or detains
				prisoners;</text>
							</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
					</subparagraph></paragraph><paragraph id="H427D03F5DBC34242B7F28D8A2616F714"><enum>(2)</enum><header>Adult
			 convictions</header><text>Section 3626 of title 18, United States Code, is
			 amended by adding at the end the following:</text>
					<quoted-block display-inline="no-display-inline" id="HC0CE46419C154AF1A45C8368D3F8FE9A" style="USC">
						<subsection id="H7C96BCDFCCA148F395F4B9D40DD2537A"><enum>(h)</enum><header>Exclusion of
				child prisoners</header><text display-inline="yes-display-inline">This section
				does not apply with respect to a prisoner who has not attained the age of 18
				years.</text>
						</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="HF320D60CBE4642799E18E586F0DC7DCA"><enum>(b)</enum><header>Civil Rights of
			 Institutionalized Persons Act</header>
				<paragraph id="HB477931F76DD420B8E9DA75C8AD87924"><enum>(1)</enum><text>Section 7(h) of
			 the Civil Rights of Institutionalized Persons Act (42 U.S.C. 1997e(h)), is
			 amended by striking <quote>or adjudicated delinquent for,</quote>.</text>
				</paragraph><paragraph id="H4B2F0DC7A6484C1480D6437C39F8F746"><enum>(2)</enum><text>Section 7 of the
			 Civil Rights of Institutionalized Persons Act (42 U.S.C. 1997e) is amended by
			 adding at the end the following:</text>
					<quoted-block display-inline="no-display-inline" id="HB4610A6D3E2C4C6F8F8207BDC478429D" style="OLC">
						<subsection id="HFACA334AB6E4442096F18F59B715C2B1"><enum>(i)</enum><header>Exclusion of
				child prisoners</header><text display-inline="yes-display-inline">This section
				does not apply with respect to a prisoner who has not attained the age of 18
				years.</text>
						</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="HBAF51FCEF1A5401BA7B99D59C6193D33"><enum>(c)</enum><header>Title
			 28</header><text>Title 28, United States Code, is amended—</text>
				<paragraph id="H7F6F888CE1D84075B87CCC464A2DEF5F"><enum>(1)</enum><text display-inline="yes-display-inline">in section 1915(h)—</text>
					<subparagraph id="H57CDF7C4B71946899E93A111BAC7C9F5"><enum>(A)</enum><text>by inserting
			 <quote>who has attained the age of 18 years</quote> after <quote>means any
			 person</quote>; and</text>
					</subparagraph><subparagraph id="H9CB178C50D0343EA901F8A36A88789A8"><enum>(B)</enum><text>by striking
			 <quote>or adjudicated delinquent for,</quote>; and</text>
					</subparagraph></paragraph><paragraph id="H4EF8A8989C7F4F7D8E1A28904DF46DEC"><enum>(2)</enum><text display-inline="yes-display-inline">in section 1915A(c)—</text>
					<subparagraph id="H87603502402942EB890CE094AD33E92E"><enum>(A)</enum><text>by inserting
			 <quote>who has attained the age of 18 years</quote> after <quote>means any
			 person</quote>; and</text>
					</subparagraph><subparagraph id="H9FF160D2DB4846608F3F5A3E6758C89C"><enum>(B)</enum><text>by striking
			 <quote>or adjudicated delinquent for,</quote>.</text>
					</subparagraph></paragraph></subsection></section><section id="HC411E62F12E043A8870EE5D36AD98DAF"><enum>5.</enum><header>Modification of
			 ban on multiple in forma pauperis claims</header><text display-inline="no-display-inline">Section 1915(g) of title 28, United States
			 Code, is amended—</text>
			<paragraph id="H78697E372A534AF28D649E63190D0003"><enum>(1)</enum><text>by inserting
			 <quote>within the preceding 5 years</quote> after <quote>3 or more
			 occasions</quote>; and</text>
			</paragraph><paragraph id="H07C3D612558C462B9221B5772816EF66"><enum>(2)</enum><text>by striking
			 <quote>, malicious, or fails to state a claim upon which relief may be
			 granted</quote> and inserting <quote>or malicious</quote> .</text>
			</paragraph></section><section id="HF393EA1F96634C63BEDB4794316521F1"><enum>6.</enum><header>Filing Fees in
			 Forma Pauperis</header><text display-inline="no-display-inline">Section
			 1915(b)(1) of title 28, United States Code, is amended—</text>
			<paragraph id="H90920FBC67374619BCE682DC93B0FD41"><enum>(1)</enum><text>by striking
			 <quote>or files an appeal</quote>; and</text>
			</paragraph><paragraph id="H693D735414524838949745C477B51615"><enum>(2)</enum><text>by inserting
			 <quote>and the action is dismissed at initial screening pursuant to subsection
			 (e)(2) of this section, section 1915A of this title, or section 7(c)(1) of the
			 Civil Rights of Institutionalized Persons Act (42 U.S.C. 1997e(c)(1)),</quote>
			 after <quote>in forma pauperis,</quote>.</text>
			</paragraph></section><section id="HAE9EC7B1F90B4DF8B72ABED2EE43447C"><enum>7.</enum><header>Technical
			 amendment to resolve ambiguity</header><text display-inline="no-display-inline">Section 1915(a)1) of title 28, United States
			 Code, is amended by striking <quote>that includes a statement of all assets
			 such prisoner possesses</quote> and inserting <quote>(including a statement of
			 assets such person possesses)</quote>.</text>
		</section><section id="H41120789A21543A989D01D4721FD7FDB"><enum>8.</enum><header>Encouragement of
			 appropriate settlement of prisoner litigation</header><text display-inline="no-display-inline">Section 3626(c)(1) of title 18, United
			 States Code, is amended, by striking the period at the end and inserting
			 <quote>, except that the violation of a Federal right may be alleged by
			 plaintiff rather than proven or stipulated.</quote>.</text>
		</section><section id="HA44FE21C94AC45A79A760C2BFC5E7131"><enum>9.</enum><header>Judicial
			 discretion in crafting prison abuse remedies</header><text display-inline="no-display-inline">Section 3626 of title 18, United States
			 Code, is amended—</text>
			<paragraph id="H95481C2507534BBAB2D4BE11F86F0960"><enum>(1)</enum><text>in subsection
			 (a)(2) by striking the final sentence;</text>
			</paragraph><paragraph id="H234BF1882FFE4797A373830677053916"><enum>(2)</enum><text>in subsection
			 (b)(1)(A), by inserting <quote>if that party demonstrates that it has
			 eliminated the violation of the Federal right that gave rise to the prospective
			 relief and that the violation is reasonably unlikely to recur</quote> after
			 <quote>intervener</quote>;</text>
			</paragraph><paragraph id="HFEDD2B2076F14B4790CA3F8DF0967DF7"><enum>(3)</enum><text>in subsection
			 (b)(1)(B), by adding at the end the following: <quote>Nothing in this section
			 shall prevent the court from extending any of the time periods set out in
			 subsection (A), if the court finds, at the time of granting or approval of the
			 prospective relief, that correction of the violation will take longer than
			 those time periods.</quote>; and</text>
			</paragraph><paragraph id="HC8799227F84D46E6B621438558A1BBF1"><enum>(4)</enum><text>in subsection (e)
			 by striking paragraphs (2), (3), and (4).</text>
			</paragraph></section><section id="H680AF04F5A32427E952BAC0D98F95578"><enum>10.</enum><header>Effective
			 date</header><text display-inline="no-display-inline">The amendments made by
			 this Act shall apply to all cases currently pending in Federal court and any
			 such cases filed on or after the date of enactment of this Act.</text>
