		  commemoration of President James Monroe, and for other
		  purposes.</official-title>

		<section id="H9B1998D8BF364DDBAC401193B4406398" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>James Monroe Commemorative Coin
			 Act</short-title></quote>.</text>
		</section><section id="H50A2E09A395D4A6990DA9AA966C9EC6A"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">The Congress hereby finds as follows:</text>
			<paragraph id="H5B85BC990868463483ABFDCF4E2B6329"><enum>(1)</enum><text display-inline="yes-display-inline">James Monroe was the only United States
			 President besides George Washington to have actively served in the regular
			 military during the Revolutionary War.</text>
			</paragraph><paragraph id="H7380EF2981B341969716969AA8AE14A8"><enum>(2)</enum><text display-inline="yes-display-inline">James Monroe—</text>
				<subparagraph id="HAB72C9C03B424C6A8BB74A68E870A207"><enum>(A)</enum><text>participated in
			 the Battles of Harlem Heights and White Plains;</text>
				</subparagraph><subparagraph id="H26A8BBB81CC04AD98765B18AC931987E"><enum>(B)</enum><text>crossed the
			 Delaware River in advance of George Washington;</text>
				</subparagraph><subparagraph id="HEB808F9E55334ECCA25116F6438F67C9"><enum>(C)</enum><text>was seriously
			 wounded at the Battle of Trenton and cited for conspicuous gallantry;</text>
				</subparagraph><subparagraph id="H1E254E2823D44BE2A6B0D6BC2B505413"><enum>(D)</enum><text>wintered with the
			 Continental Army at Valley Forge; and</text>
				</subparagraph><subparagraph id="HE66BD27F4D7545E69EEABDC93045D1D5"><enum>(E)</enum><text>subsequently
			 participated in the Battles of Brandywine, Germantown and Monmouth.</text>
				</subparagraph></paragraph><paragraph id="HBD6EB0697F394CF6A37625B5DCF18ED7"><enum>(3)</enum><text>James Monroe
			 served at the State level in the Virginia House of Delegates and served 4 times
			 as the Governor of Virginia.</text>
			</paragraph><paragraph id="H5E70C18BE1DC4F9AB4F08FBF2DBC5DB4"><enum>(4)</enum><text>James Monroe
			 served at the national level as a member of the Continental Congress, United
			 States Senator, Minister to France (negotiating the Louisiana Purchase),
			 Minister to Spain, Minister to England, Secretary of War, and Secretary of
			 State (he was the only person to ever hold those 2 posts simultaneously,
			 defending the Nation during the War of 1812), and finally as President of the
			 United States from 1817–1825.</text>
			</paragraph><paragraph id="H26321A3C0C40447AB12670768A9B1596"><enum>(5)</enum><text>James Monroe's
			 accomplishments as President included the purchase of Florida, limiting the
			 expansion of slavery, the admission of Maine and Missouri as States, and the
			 promulgation of principles that became known as the <quote>Monroe
			 Doctrine</quote> on December 2, 1823, expanding the concept of hemispheric
			 independence beyond the United States—truly making him one of the most
			 important figures in our Nation's history.</text>
			</paragraph><paragraph id="HC827CA5D6F7E4CCB8E7D89C375484ACA"><enum>(6)</enum><text display-inline="yes-display-inline">The bicentennial of the election of James
			 Monroe as President will occur in 2016, an election which ushered in what has
			 been known since as the <quote>Era of Good Feelings</quote>.</text>
			</paragraph></section><section id="H0F993A95CAA042728F1C575D90CE0973"><enum>3.</enum><header>Coin
			 specifications</header>
			<subsection commented="no" display-inline="no-display-inline" id="HE925206ED06A4106B16BB190A0D893B7"><enum>(a)</enum><header>Denominations</header><text display-inline="yes-display-inline">In commemoration of the bicentennial of the
			 election of James Monroe to the first of 2 terms as President of the United
			 States of America, the Secretary of the Treasury (hereafter in this Act
			 referred to as the “Secretary”) shall mint and issue the following
			 coins:</text>
				<paragraph commented="no" display-inline="no-display-inline" id="H107E78622CC54354929E980509714F88"><enum>(1)</enum><header>$50 gold
			 coins</header><text display-inline="yes-display-inline">Not more than 20,000
			 $50 gold coins which shall—</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="HFFD0B802405C40FE823305CB39DC7D89"><enum>(A)</enum><text display-inline="yes-display-inline">weigh 33.931 grams;</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H2CE735F991384240BC2B8F258BD23F50"><enum>(B)</enum><text display-inline="yes-display-inline">have a diameter of 32.7 millimeters;
			 and</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H9955C1FBA7B446D98E912BA89238864C"><enum>(C)</enum><text display-inline="yes-display-inline">contain 1 troy ounce of fine gold.</text>
					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H3FF0FD07083F40E4BDBA11E99478809B"><enum>(2)</enum><header>$1 silver
			 coins</header><text display-inline="yes-display-inline">Not more than 275,000
			 $1 coins which shall—</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="H7761FBAA79A94C24913286D44D2F3FC8"><enum>(A)</enum><text display-inline="yes-display-inline">weigh 26.73 grams;</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H0479637A212245718B493500D5944539"><enum>(B)</enum><text display-inline="yes-display-inline">have a diameter of 1.500 inches; and</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H589E8497943446DA916846C7B0317C70"><enum>(C)</enum><text display-inline="yes-display-inline">contain 90 percent silver and 10 percent
			 copper.</text>
					</subparagraph></paragraph><paragraph display-inline="no-display-inline" id="H01964D8DC1DF48BB9863FF6BE654C27D"><enum>(3)</enum><header>Half dollar clad
			 coins</header><text display-inline="yes-display-inline">Not more than 500,000
			 half dollar coins, which shall—</text>
					<subparagraph id="H815F4064DB464182A1DD5B8CD6DA5EC2"><enum>(A)</enum><text>weigh 11.34
			 grams;</text>
					</subparagraph><subparagraph id="H747EEA0F44C64C23A48F0AA74D4F49DA"><enum>(B)</enum><text>have a diameter of
			 1.205 inches; and</text>
					</subparagraph><subparagraph id="H34551E39EAB0494B9AA76AAB3E0C42D6"><enum>(C)</enum><text>be minted to the
			 specifications for half dollar coins, contained in section 5112(b) of title 31,
			 United States Code.</text>
					</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H9A24898AC3564D73868C191DCBE0C5C4"><enum>(b)</enum><header>Legal
			 tender</header><text display-inline="yes-display-inline">The coins minted under
			 this Act shall be legal tender, as provided in section 5103 of title 31, United
			 States Code.</text>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="H8E376F26012340828612CC2234E62DB5"><enum>(c)</enum><header>Numismatic
			 items</header><text display-inline="yes-display-inline">For purposes of section
			 5134 of title 31, United States Code, all coins minted under this Act shall be
			 considered to be numismatic items.</text>
			</subsection></section><section display-inline="no-display-inline" id="HACA6F700E358475B9503DDADD867D3E6" section-type="subsequent-section"><enum>4.</enum><header>Design of
			 coins</header>
			<subsection id="H587C9D6B89974197BA7A1E0DBFDB0BC1"><enum>(a)</enum><header>Design
			 requirements</header>
				<paragraph id="HFBF60F422AFC4F29A1D6627DDD6CDA33"><enum>(1)</enum><header>In
			 general</header><text display-inline="yes-display-inline">The design of the
			 coins minted under this Act shall be emblematic of President James Monroe and
			 his immeasurable contributions to the United States.</text>
				</paragraph><paragraph id="H8C23A9D8BD35458DACBAC154D4BBEB91"><enum>(2)</enum><header>Obverse</header><text display-inline="yes-display-inline">The obverse of the coins minted under this
			 Act shall bear the side profile image of President James Monroe based upon
			 Rembrandt Peale's 1830 portrait which the James Monroe Memorial Foundation
			 donated to The Commonwealth of Virginia in 1964.</text>
				</paragraph><paragraph id="H8D21AC8BC3464FD882DCC43A87641E30"><enum>(3)</enum><header>Reverse</header><text display-inline="yes-display-inline">The reverse of the coins minted under this
			 Act shall bear the image of the Monroe birthplace as drawn by the Colonial
			 Williamsburg Foundation based on the 1830 drawing published as an
			 etching.</text>
				</paragraph><paragraph id="H3F05483F1F294B739157AA2186F51C37"><enum>(4)</enum><header>Designations and
			 inscriptions</header><text>On each coin minted under this Act, there shall
			 be—</text>
					<subparagraph id="H44C9B62069E747679F9B1BB001945D50"><enum>(A)</enum><text>a designation of
			 the value of the coin;</text>
					</subparagraph><subparagraph id="HC7ED80428F644DBDA1892973F0376435"><enum>(B)</enum><text>an inscription of
			 the year <quote>2016</quote>; and</text>
					</subparagraph><subparagraph id="HC70723E2CD364B219822DF2E35C35489"><enum>(C)</enum><text>inscriptions of
			 the words <quote>Liberty</quote>, <quote>In God We Trust</quote>, <quote>United
			 States of America</quote>, and <quote>E Pluribus Unum</quote>.</text>
					</subparagraph></paragraph></subsection><subsection id="H3B134CA1FD3348E08AC55FCA18D6CD41"><enum>(b)</enum><header>Selection</header><text>The
			 design for the coins minted under this Act shall—</text>
				<paragraph id="H3E6A7943DCBA4CD7877F866DD1BFE723"><enum>(1)</enum><text display-inline="yes-display-inline">be selected by the Secretary, after
			 consultation with the James Monroe Memorial Foundation and the Commission of
			 Fine Arts; and</text>
				</paragraph><paragraph id="H474E4250E10E49D2BEC8286A6A5CD5C4"><enum>(2)</enum><text>be reviewed by the
			 Citizens Coinage Advisory Committee.</text>
				</paragraph></subsection></section><section id="H1F2CE2B53AAD4C05A53F80C8F543FBEE"><enum>5.</enum><header>Issuance of
			 coins</header>
			<subsection id="H8C43D6DCB8A040B7A3095C93034489AA"><enum>(a)</enum><header>Quality of
			 coins</header><text>Coins minted under this Act shall be issued in uncirculated
			 and proof qualities.</text>
			</subsection><subsection id="H09EAAB8435C6486385ED19061DC9DE56"><enum>(b)</enum><header>Mint
			 facilities</header><text>For each of the 3 coins minted under this Act, at
			 least 1 facility of the United States Mint shall be used to strike proof
			 quality coins, while at least 1 other such facility shall be used to strike the
			 uncirculated quality coins.</text>
			</subsection><subsection id="H65A5C71877EC44A0B3055AB1D89E9E2A"><enum>(c)</enum><header>Period for
			 issuance</header><text>The Secretary may issue coins minted under this Act only
			 during the 1-year period beginning on January 1, 2016.</text>
			</subsection></section><section id="HA89AB89057854BAA9305F0C683CE1F6B"><enum>6.</enum><header>Sale of
			 coins</header>
			<subsection id="HF14B34C001A441B2A029F0AC0A39CEC6"><enum>(a)</enum><header>Sale
			 price</header><text>The coins issued under this Act shall be sold by the
			 Secretary at a price equal to the sum of—</text>
				<paragraph id="H9120B7FD391641BBB57288BC5C01C6AB"><enum>(1)</enum><text>the face value of
			 the coins;</text>
				</paragraph><paragraph id="H6FE6F1CBCC2844F9A1A5A5A07C3A89A2"><enum>(2)</enum><text>the surcharge
			 provided in section 7(a) with respect to such coins; and</text>
				</paragraph><paragraph id="H5E2C7EB9DB4A459BA880CAC1D11F2B39"><enum>(3)</enum><text>the cost of
			 designing and issuing the coins (including labor, materials, dies, use of
			 machinery, overhead expenses, marketing, and shipping).</text>
				</paragraph></subsection><subsection id="H043BFF2140A6417889EE90E1488996E9"><enum>(b)</enum><header>Bulk
			 sales</header><text>The Secretary shall make bulk sales of the coins issued
			 under this Act at a reasonable discount.</text>
			</subsection><subsection id="H4041271929AA4C2B93628B119CC8FF08"><enum>(c)</enum><header>Prepaid
			 orders</header>
				<paragraph id="HBF896316907A4A5795D88B256824F582"><enum>(1)</enum><header>In
			 general</header><text>The Secretary shall accept prepaid orders for the coins
			 minted under this Act before the issuance of such coins.</text>
				</paragraph><paragraph id="HB4385477E477484598A4BA8D5A3A2D7E"><enum>(2)</enum><header>Discount</header><text>Sale
			 prices with respect to prepaid orders under paragraph (1) shall be at a
			 reasonable discount.</text>
				</paragraph></subsection></section><section id="HC9D4B38B926E4A5F8B48AEE179400696"><enum>7.</enum><header>Surcharges</header>
			<subsection id="H864B031E61EF4C73B3E2E88104C63337"><enum>(a)</enum><header>In
			 general</header><text>All sales of coins minted under this Act shall include a
			 surcharge as follows:</text>
				<paragraph id="HDEE7179A9C634D72B3EFD655B9C4F0B0"><enum>(1)</enum><text>A
			 surcharge of $35 per coin for the $5 coin.</text>
				</paragraph><paragraph id="H3FB5F80BF05242438DBCD65E9F140293"><enum>(2)</enum><text>A
			 surcharge of $10 per coin for the $1 coin.</text>
				</paragraph><paragraph id="H88D1BA6C63234AB5A7C3F2BE830990D6"><enum>(3)</enum><text>A
			 surcharge of $5 per coin for the half dollar coin.</text>
				</paragraph></subsection><subsection id="H89827A374D404744BA357A1E10DA57DD"><enum>(b)</enum><header>Distribution</header><text display-inline="yes-display-inline">Subject to section 5134(f) of title 31,
			 United States Code, all surcharges received by the Secretary from the sale of
			 coins issued under this Act shall be promptly paid by the Secretary to the
			 James Monroe Memorial Foundation for use for the following purposes:</text>
				<paragraph id="HAD975C40D61E4ADB92A3EED40599B597"><enum>(1)</enum><text>Development of the
			 reconstructed birthplace of the 5th President, associated farm buildings, and a
			 visitor and education center at the James Monroe Birthplace in Westmoreland
			 County, Virginia.</text>
				</paragraph><paragraph id="H971AE279A8D84605AEE9A9C3491F5112"><enum>(2)</enum><text>Continuing support
			 of that facilities described in paragraph (1), including the acquisition of
			 land originally owned by the Monroe Family.</text>
				</paragraph><paragraph id="H778551CEC353400BB028A6E7D680B604"><enum>(3)</enum><text>Supporting
			 education programs about President James Monroe, the Monroe Doctrine, including
			 an online library.</text>
				</paragraph><paragraph id="H2BAF90255FCD446FA0165C0A42F659F8"><enum>(4)</enum><text>Collecting and
			 preserving artifacts and historical items related to President Monroe, the
			 Monroe Doctrine, and his era which was known as <quote>The Era of Good
			 Feelings</quote>.</text>
				</paragraph></subsection><subsection id="H46D7C12E0B604D1882DB4792A50D9553"><enum>(c)</enum><header>Audits</header><text display-inline="yes-display-inline">The James Monroe Memorial Foundation shall
			 be subject to the audit requirements of section 5134(f)(2) of title 31, United
			 States Code, with regard to the amounts received by such Foundation under
			 subsection (b).</text>
			</subsection><subsection id="H1F97CE8E3226452AB146BD0375FCB025"><enum>(d)</enum><header>Limitation</header><text>Notwithstanding
			 subsection (a), no surcharge may be included with respect to the issuance under
			 this Act of any coin during a calendar year if, as of the time of such
			 issuance, the issuance of such coin would result in the number of commemorative
			 coin programs issued during such year to exceed the annual 2 commemorative coin
			 program issuance limitation under section 5112(m)(1) of title 31, United States
			 Code (as in effect on the date of the enactment of this Act). The Secretary of
			 the Treasury may issue guidance to carry out this subsection.</text>
