		<official-title>To amend title 18, United States Code, to award credit
		  toward the service of a sentence to prisoners who participate in designated
		  educational, vocational, treatment, assigned work, or other developmental
		  programs, and for other purposes.</official-title>

		<section display-inline="no-display-inline" id="H1CD09AB924614C2F90E50007837C1E09" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Literacy, Education, and
			 Rehabilitation Act</short-title></quote>.</text>
		</section><section id="HBF2FA68C9A044D2C86F35FB7F100FD2"><enum>2.</enum><header>Credit for
			 participation in educational, vocational, treatment, assigned work, or other
			 developmental programs</header>
			<subsection id="H57326A0063FD438881BD072EA7000017"><enum>(a)</enum><header>In
			 general</header><text>Section 3624 of title 18, United States Code, is
			 amended—</text>
				<paragraph id="HD8D81DA40AE143B69F4B2448C3473646"><enum>(1)</enum><text>in subsection (a),
			 by striking <quote>as provided in subsection (b)</quote>;</text>
				</paragraph><paragraph display-inline="no-display-inline" id="H1D6F22C156024E0BB4E1D2DB6DCF6F00"><enum>(2)</enum><text>by redesignating
			 subsections (c), (d), (e), and (f), as subsections (d), (e), (f), and (g);
			 and</text>
				</paragraph><paragraph id="HAFD33A8E2D8C4F0BA88F3628D8502B3D"><enum>(3)</enum><text>by inserting after
			 subsection (b) the following new subsection:</text>
					<quoted-block display-inline="no-display-inline" id="HD66C86DE8F2B470A90A69B4BCFB69357" style="USC">
						<subsection id="H44CA90FEB35D4280AE649CC7CE9EE885"><enum>(c)</enum><header>Credit toward
				service of sentence for satisfactory participation in a designated
				program</header>
							<paragraph id="H9CA0D261983B4F0BABE899AA6B5D9900"><enum>(1)</enum><header>In
				general</header><text>Subject to paragraphs (2) and (3), a prisoner serving a
				term of imprisonment of more than 1 year may receive credit toward the service
				of the prisoner’s sentence, in addition to any other credit received, beyond
				the time already served, of up to 60 days at the end of each year of the
				court-imposed sentence, beginning at the end of the first year of such
				sentence. Credit for the last year or portion of a year of the term of
				imprisonment shall be prorated and credited within the last 6 weeks of the
				sentence.</text>
							</paragraph><paragraph id="H739541FD59F34DE2B0E877D76C591B17"><enum>(2)</enum><header>Satisfactory
				participation in designated program</header><text>A prisoner shall be awarded
				credit under paragraph (1) if the Director of the Bureau of Prisons determines
				that the prisoner has earned, or is making satisfactory progress toward
				earning, a certificate of completion in a designated program, has
				satisfactorily participated in a designated program, or has taught or conducted
				a designated program.</text>
							</paragraph><paragraph id="H1EB9C983AAB540E293F786167CF29BB1"><enum>(3)</enum><header>Number of days
				of credit awarded</header>
								<subparagraph id="H943EBBDF98CD4104B1F3A56D9DE10824"><enum>(A)</enum><header>In
				general</header><text>The Director of the Bureau of Prisons shall determine and
				establish a policy setting forth the rate of the number of days of credit which
				a prisoner may be awarded under this subsection with respect to any designated
				program.</text>
								</subparagraph><subparagraph id="H7CDE9735D83D46D094584D9F8925E0D9"><enum>(B)</enum><header>Specific
				considerations</header><text>In determining the number of days of credit a
				prisoner may be awarded with respect to a designated program, the Director of
				the Bureau of Prisons shall consider—</text>
									<clause id="H63C5AB7FD39B42CFB437AB07512C329E"><enum>(i)</enum><text>the level of
				difficulty of the program;</text>
									</clause><clause id="HAEAC361F0B90473F921FF6A42C005D80"><enum>(ii)</enum><text>the time required
				by the program;</text>
									</clause><clause id="HBD3E2BF4B3EA488B007D5E28D9F74034"><enum>(iii)</enum><text>the level of
				responsibility expected of the prisoner with respect to the program;</text>
									</clause><clause id="HE0B42DEC4536436CB1126DA7C1CF500"><enum>(iv)</enum><text>the rehabilitative
				benefits the program provides the prisoner; and</text>
									</clause><clause id="H462C8898880B4BA8B1717B6F1E42641C"><enum>(v)</enum><text>the benefits the
				program provides the Bureau of Prisons.</text>
									</clause></subparagraph><subparagraph id="H86F4C83EA1E84010AEA0CB07AEEDA915"><enum>(C)</enum><header>Availability to
				prisoners</header><text>The Director of the Bureau of Prisons shall make the
				policy applicable to credit awarded under this subsection available for each
				prisoner to review prior to that prisoner’s participation in any designated
				program.</text>
								</subparagraph></paragraph><paragraph id="HE2EE3B6ED5944905815E1E044C89AEED"><enum>(4)</enum><header>Eligibility</header><text>Any
				person sentenced to a term of imprisonment under custody of the Attorney
				General, whether sentenced or convicted prior to or after November 1, 1987,
				shall be eligible for the credits described in this subsection.</text>
							</paragraph><paragraph id="H19D64BF177EC4F7CA77D7450B000D339"><enum>(5)</enum><header>Designated
				program</header><text>The term <term>designated program</term> means a program
				which has been designated by the Director of the Bureau of Prisons as a program
				which benefits either prisoners or the Bureau of Prisons, including—</text>
								<subparagraph id="H084936AD68B948B181007200DCF7F875"><enum>(A)</enum><text>educational and
				vocational programs, such as courses and programs through which a prisoner may
				earn a high school diploma or an equivalent degree or certification through an
				accredited vocational training program, college, or university;</text>
								</subparagraph><subparagraph id="H8800C649A34C498BA5CE6DBE4090C341"><enum>(B)</enum><text>treatment
				programs, such as interventional rehabilitation programs, including mental
				health and drug abuse programs; and</text>
								</subparagraph><subparagraph id="H7885336979D44A0D8099003E96E1E598"><enum>(C)</enum><text>assigned work and
				developmental
				programs.</text>
								</subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="HD64AF85106C642C391DC2600DF29FE2C"><enum>(b)</enum><header>Prisoners
			 transferred from foreign countries to the custody of the Attorney
			 General</header>
				<paragraph id="H1481F58CA68B4F52B7E72FDCBBC5421"><enum>(1)</enum><header>In
			 general</header><text>The second sentence of section 4105(c)(1) of title 18,
			 United States Code, is amended by inserting <quote>and for participation in
			 designated programs under section 3624(c)</quote> after <quote>satisfactory
			 behavior</quote>.</text>
				</paragraph><paragraph id="HD0D0BBD4799B412CB164C15FF021BDA"><enum>(2)</enum><header>Conforming
			 amendments</header><text>Section 4105(c) of title 18, United States Code, is
			 amended—</text>
					<subparagraph id="H2DFD90E96DBA49F7BE93C577386C89BC"><enum>(A)</enum><text>by striking
			 <quote>at the rate provided in section 3624(b)</quote> each place it appears
			 and inserting <quote>at the rates provided in sections 3624(b) and (c)</quote>;
			 and</text>
					</subparagraph><subparagraph id="H8EDF8651450748E9B9510012EAA606B4"><enum>(B)</enum><text>in paragraph (3),
			 by striking <quote>section 3624(b)</quote> and inserting <quote>sections
			 3624(b) and (c)</quote>.</text>
					</subparagraph></paragraph></subsection><subsection id="H23077E1B84EE4F339BC2D652B8D5D2D7"><enum>(c)</enum><header>Conforming
			 amendments</header>
				<paragraph id="HFFC45602B8B4494185BCA26B61B8C035"><enum>(1)</enum><header>Title
			 18</header><text>Section 3603(6) of title 18, United States Code, is amended by
			 striking <quote>3624(c)</quote> and inserting <quote>3624(d)</quote>.</text>
				</paragraph><paragraph id="HCBF291F9127C43DF9831AD48F037E62C"><enum>(2)</enum><header>Title
			 28</header><text>Section 994(a)(2)(F) of title 28, United States Code, is
			 amended by striking <quote>3624(c)</quote> and inserting
			 <quote>3624(d)</quote>.</text>
				</paragraph></subsection></section><section id="H89B47075E02B48C5B7E95E11C608AD08" section-type="subsequent-section"><enum>3.</enum><header>Good time
			 credit</header>
			<subsection id="H5032FC5E5BF9469D83DFC09CBFA93848"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Section 3624(b)(1) of
			 title 18, United States Code, is amended by striking <quote>, beyond the time
			 served, of up to 54 days at the end of each year of the prisoner’s term of
			 imprisonment, beginning at the end of the first year of the term,</quote> and
			 inserting <quote>of up to 54 days for each year of the prisoner’s sentence
			 imposed by the court,</quote>.</text>
			</subsection><subsection id="H57F2995C2AAF4F31956F602B9579C9DD"><enum>(b)</enum><header>Restoration of
			 credit</header><text>Section 3624(b)(1) is amended by striking the sentence
			 beginning <quote>Credit that has not been earned</quote> and inserting
			 <quote>The Bureau may subsequently restore any or all credit previously denied,
			 based on the prisoner’s maintaining good behavior as determined by the
			 Bureau.</quote>.</text>
			</subsection><subsection id="HAD1A167DD1C941E09778DE3C1AD51A14"><enum>(c)</enum><header>Applicability</header><text>The
			 amendments made by this section apply with respect to each prison sentence that
			 has not been completed before the effective date of this Act, except any
			 sentence imposed before November 1, 1987.</text>
			</subsection></section><section id="H55425C844B38495F95E7A4B4318200AB"><enum>4.</enum><header>Effective
			 date</header><text display-inline="no-display-inline">This Act and the
			 amendments made by this Act shall take effect upon the expiration of the 90-day
			 period beginning on the date of the enactment of this Act.</text>
