		<official-title>To amend title 38, United States Code, to expand the
		  types of approved programs of education for purposes of Post-9/11 Educational
		  Assistance Program of the Department of Veterans Affairs.</official-title>

		<section id="H2514E627AF12499BB33BE6989A41BC7C" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Post-9/11 GI Education Fairness Act of
			 2009</short-title></quote>.</text>
		</section><section id="H8B19C5D2666440D49749D91700CDC58F"><enum>2.</enum><header>Purpose</header><text display-inline="no-display-inline">The purpose of this Act is to expand the
			 Post-9/11 Educational Assistance Program administered by the Secretary of
			 Veterans Affairs to cover the following types of programs of education:</text>
			<paragraph id="HD034FFC5D1C64700BA428BEE8568A50A"><enum>(1)</enum><text display-inline="yes-display-inline">National tests for admission to or course
			 credit at institutions of higher learning.</text>
			</paragraph><paragraph id="H2806CDBA45ED4586B02D6C49800A7DD4"><enum>(2)</enum><text>Programs of
			 apprenticeship or other on-job training for individuals who are not on active
			 duty.</text>
			</paragraph><paragraph id="HAA96E1A28CAC41D9A2C2370857B669FE"><enum>(3)</enum><text>Cooperative
			 programs.</text>
			</paragraph><paragraph id="H3F0A77109D574398807F30710AA70AC6"><enum>(4)</enum><text>Training at
			 non-college-degree institutions.</text>
			</paragraph><paragraph id="H8A856B2109AA4E678FA0509E3BA0AE02"><enum>(5)</enum><text>Correspondence
			 training.</text>
			</paragraph><paragraph id="HCCBFF967B4E24CD89DE7602CDBDAB54E"><enum>(6)</enum><text>Entrepreneurship
			 training.</text>
			</paragraph><paragraph id="H965208E62FA94ED7954A7A38AAE41064"><enum>(7)</enum><text>Courses required
			 to receive financial assistance from the Small Business Administration.</text>
			</paragraph><paragraph id="HC2DBAC617B2C445A9B5A368BB7A7E01F"><enum>(8)</enum><text>Flight training
			 offered by entities other than institutions of higher learning.</text>
			</paragraph></section><section id="HBD8E6035E8B34DDC9E825D25DF485E6F"><enum>3.</enum><header>Expansion of
			 approved programs of education for purposes of Post-9/11 Educational Assistance
			 Program of the Department of Veterans Affairs</header>
			<subsection id="H9545051132A8486B856408C28900F47B"><enum>(a)</enum><header>Inclusion of
			 programs offered at all educational institutions</header><text display-inline="yes-display-inline">Subsection (b) of section 3313 is amended
			 by striking <quote>is offered by an institution of higher learning (as that
			 term is defined in section 3452(f)) and</quote>.</text>
			</subsection><subsection id="H1BCA7204625A435F9B48BCE2C1FDB6B1"><enum>(b)</enum><header>Flight
			 training</header><text>Such section is further amended by adding at the end the
			 following new subsection:</text>
				<quoted-block display-inline="no-display-inline" id="H9843F2CB3B1A4167888BB87DA6AF6F97" style="USC">
					<subsection id="H6F999459BC2E4CA1A2D0F21A524AA594"><enum>(i)</enum><header>Flight
				training</header><text display-inline="yes-display-inline">The Secretary may
				approve the pursuit of flight training (in addition to a course of flight
				training that may be approved under section 3680A(b) of this title) by an
				individual entitled to basic educational assistance under this chapter
				if—</text>
						<paragraph id="H7EDD843B890C494A8C35DD1284F84C67"><enum>(1)</enum><text>such training is
				generally accepted as necessary for the attainment of a recognized vocational
				objective in the field of aviation;</text>
						</paragraph><paragraph id="HEC060A07BEAE4A89AA6E8B488D6D6827"><enum>(2)</enum><text>the individual
				possesses a valid private pilot certificate and meets, on the day the
				individual begins a course of flight training, the medical requirements
				necessary for a commercial pilot certificate; and</text>
						</paragraph><paragraph id="H3903492B141F411AB7C260FE15036AB8"><enum>(3)</enum><text>the flight school
				courses meet Federal Aviation Administration standards for such courses and are
				approved by the Federal Aviation Administration and the State approving
				agency.</text>
						</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="HE504BED949A241C5B508FB8DB3ADACFE"><enum>(c)</enum><header>Effective
			 date</header><text>The amendments made by this Act shall apply with respect to
			 educational assistance provided for months beginning after the date of the
			 enactment of this Act.</text>
