		<official-title>To amend the Internal Revenue Code of 1986 to protect
		  children’s health by denying any deduction for advertising and marketing
		  directed at children to promote the consumption of food at fast food
		  restaurants or of food of poor nutritional quality.</official-title>

		<section id="H0B690D2DA50A42F3979B6A6A4D6D0573" section-type="section-one"><enum>1.</enum><header>Denial of deduction for
			 advertising directed at children to promote the consumption of food at fast
			 food restaurants or of food of poor nutritional quality</header>
			<subsection id="HC6D3B0EE104943C78E75AFB499E5875F"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Part IX of subchapter
			 B of chapter 1 of the Internal Revenue Code of 1986 (relating to items not
			 deductible) is amended by adding at the end the following new section:</text>
				<quoted-block display-inline="no-display-inline" id="H4AAC83D9593442BFABCBD297ACC794BB" style="OLC">
					<section id="HA0DBEB0DC1A0410DBD63F97F60CA07B6"><enum>280I.</enum><header>Denial of
				deduction for advertising directed at children to promote the consumption of
				food at fast food restaurants or of food of poor nutritional quality</header>
						<subsection id="H10BC44EFBE584A159DCF10EA1D671CCC"><enum>(a)</enum><header>In
				general</header><text>No deduction shall be allowed under this chapter with
				respect to—</text>
							<paragraph id="HAEE62B7DA3F34E5A940C4CEB8ECA653C"><enum>(1)</enum><text display-inline="yes-display-inline">any advertisement primarily directed at
				children for purposes of promoting the consumption by children of food from any
				fast food restaurant or of any food of poor nutritional quality, and</text>
							</paragraph><paragraph id="H46D9884386164BEBA495ED2A206BAB95"><enum>(2)</enum><text display-inline="yes-display-inline">any of the following which are incurred or
				provided primarily for purposes described in paragraph (1):</text>
								<subparagraph id="HA33D2FB7A72D488E8E04207387C43FD4"><enum>(A)</enum><text>Travel expenses
				(including meals and lodging).</text>
								</subparagraph><subparagraph id="H90979E548E7241DBAB6279C4A202DD9C"><enum>(B)</enum><text display-inline="yes-display-inline">Goods or services of a type generally
				considered to constitute entertainment, amusement, or recreation or the use of
				a facility in connection with providing such goods and services.</text>
								</subparagraph><subparagraph id="HBEB48FE0B33748049ED22FB1A391792B"><enum>(C)</enum><text>Gifts.</text>
								</subparagraph><subparagraph id="HD099AE7151D449679E04DB460A697745"><enum>(D)</enum><text>Other promotion
				expenses.</text>
								</subparagraph></paragraph></subsection><subsection id="H173E554A7DD246B3BBF0A682FEE2BEB8"><enum>(b)</enum><header>Food of poor
				nutritional quality</header><text display-inline="yes-display-inline">For
				purposes of this section, the term <quote>food of poor nutritional
				quality</quote> means food that is determined by the Secretary (in consultation
				with the Secretary of Health and Human Services and the Federal Trade
				Commission) to provide calories primarily through fats or added sugars and to
				have minimal amounts of vitamins and minerals.</text>
						</subsection><subsection id="H244EEBC6F25444F9BD3A0842ECA3F23D"><enum>(c)</enum><header>Regulations</header><text display-inline="yes-display-inline">The Secretary shall (in consultation with
				the Secretary of Health and Human Services and the Federal Trade Commission)
				prescribe such regulations as may be necessary to carry out the purposes of
				this
				section.</text>
						</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H8BF208FA1BF546A69C2576B54CCC3FC6"><enum>(b)</enum><header>Clerical
			 amendment</header><text>The table of sections for such part IX is amended by
			 adding at the end the following new item:</text>

					<toc-entry level="section"><quote>Sec. 280I. Denial of deduction for
				advertising directed at children to promote the consumption of food at fast
				food restaurants or of food of poor nutritional quality.</quote>.</toc-entry>
				</toc>
			</subsection><subsection display-inline="no-display-inline" id="HED15D045B1EE4454B94D3430FA9DC374"><enum>(c)</enum><header>Effective
			 date</header><text>The amendments made by this section shall apply to amounts
			 paid or incurred after the date of the enactment of this Act in taxable years
			 ending after such date.</text>
