			 title</header><text>This Act may be cited as the <quote><short-title>Beauty Mountain and Agua Tibia Wilderness Act of
			 2009</short-title></quote>.</text>

			</subsection></section><title id="H8232DCDF63B2483C8FA933A151A5893F"><enum>I</enum><header>Designation and
			 expansion of wilderness areas</header>
			<section id="H2208115BF95546A8BBE6697979A65B7A"><enum>101.</enum><header>Definition of
			 Secretary</header><text display-inline="no-display-inline">In this title, the
			 term <term>Secretary</term> means—</text>
				<paragraph id="HC59B7E54461E421B8E4C480F51D5472D"><enum>(1)</enum><text>with respect to
			 land under the jurisdiction of the Secretary of Agriculture, the Secretary of
			 Agriculture; and</text>
				</paragraph><paragraph id="H563215C41E3D41BC918D81F1DA15F1A6"><enum>(2)</enum><text>with respect to
			 land under the jurisdiction of the Secretary of the Interior, the Secretary of
			 the Interior.</text>
				</paragraph></section><section id="HB12E7B92FDFE4B7AB8495B36C7CCAE34"><enum>102.</enum><header>Designation of
			 wilderness, Cleveland National Forest and Bureau of Land Management land in San
			 Diego County, California</header>
				<subsection id="HCF5B789A4D004081B3924633851AC40E"><enum>(a)</enum><header>Agua tibia
			 wilderness additions</header><text>In accordance with the Wilderness Act (16
			 U.S.C. 1131 et seq.), certain land in the Cleveland National Forest comprising
			 approximately 7,796 acres, as generally depicted on the map titled <quote>Agua
			 Tibia Proposed Wilderness Additions</quote>, and dated May 18, 2009, is
			 designated as wilderness and is incorporated in, and shall be deemed to be a
			 part of, the Agua Tibia Wilderness.</text>
				</subsection><subsection id="HAF0D8765303A4EFCB74BA6FEEB024269"><enum>(b)</enum><header>Beauty mountain
			 wilderness</header><text>In accordance with the Wilderness Act (16 U.S.C. 1131
			 et seq.), certain land administered by the Bureau of Land Management in San
			 Diego County, California, comprising approximately 13,635 acres, as generally
			 depicted on the map titled <quote>Beauty Mountain Wilderness Additions</quote>,
			 and dated December 11, 2009, is designated as wilderness and is incorporated
			 in, and shall be deemed to be a part of, the Beauty Mountain Wilderness.</text>
				</subsection><subsection id="HB4D25B67A641465C8B776495CDC6865D"><enum>(c)</enum><header>Maps and
			 descriptions</header>
					<paragraph id="HA1F875EDF66845C180CFE0EB940B63F7"><enum>(1)</enum><header>In
			 general</header><text>As soon as practicable after the date of the enactment of
			 this Act, the Secretary shall file a map and legal description of each
			 wilderness area and wilderness addition designated by this section with the
			 Committee on Natural Resources of the House of Representatives and the
			 Committee on Energy and Natural Resources of the Senate.</text>
					</paragraph><paragraph id="H2DE1D5D88D904BD788189C3743093D61"><enum>(2)</enum><header>Force of
			 law</header><text>A map and legal description filed under paragraph (1) shall
			 have the same force and effect as if included in this title, except that the
			 Secretary may correct errors in the map and legal description.</text>
					</paragraph><paragraph id="H9C9C6D4767D94AE8AE369C1BC6EC776A"><enum>(3)</enum><header>Public
			 availability</header><text>Each map and legal description filed under paragraph
			 (1) shall be filed and made available for public inspection in the appropriate
			 office of the Secretary.</text>
					</paragraph></subsection><subsection id="H0C9668EF8817422589656DAD7CA1EBF1"><enum>(d)</enum><header>Utility
			 facilities and corridors</header><text>Nothing in this section or the
			 Wilderness Act shall be construed to prohibit construction, operation, and
			 maintenance, using standard industry practices, of utility facilities located,
			 on the day before the date of the enactment of this Act, outside of the
			 wilderness areas and wilderness additions designated by this section.</text>
				</subsection></section><section id="H2C29587241DC4D9697C1CAD2B9133D95"><enum>103.</enum><header>Administration
			 of wilderness</header>
				<subsection id="H297F4DE2D7E24D889EF4F04A17DDA233"><enum>(a)</enum><header>Management</header><text>Subject
			 to valid existing rights, the land designated as wilderness or as a wilderness
			 addition by this title shall be administered by the Secretary in accordance
			 with the Wilderness Act (16 U.S.C. 1131 et seq.), except that—</text>
					<paragraph id="H1726A326A8144DBC945FDA477C402B07"><enum>(1)</enum><text>any reference in
			 that Act to the effective date of that Act shall be deemed to be a reference to
			 the date of the enactment of this Act; and</text>
					</paragraph><paragraph id="H17E3FBDB0C384F919CAF22658B4300D1"><enum>(2)</enum><text>any reference in
			 that Act to the Secretary of Agriculture shall be deemed to be a reference to
			 the Secretary that has jurisdiction over the land.</text>
					</paragraph></subsection><subsection id="H5726A7DDDEAB4ECC82129D0B1DBBED77"><enum>(b)</enum><header>Incorporation of
			 acquired land and interests</header><text>Any land within the boundaries of a
			 wilderness area or wilderness addition designated by this title that is
			 acquired by the United States shall—</text>
					<paragraph id="HBBC94F4D510548A3A1F5B9249834424E"><enum>(1)</enum><text>become part of the
			 wilderness area in which the land is located; and</text>
					</paragraph><paragraph id="H6C29C5CDC7474B58B5A011402A024119"><enum>(2)</enum><text>be managed in
			 accordance with this title, the Wilderness Act (16 U.S.C. 1131 et seq.), and
			 any other applicable law.</text>
					</paragraph></subsection><subsection id="H6716B0217D564948AFE923CC7B6568CF"><enum>(c)</enum><header>Withdrawal</header><text>Subject
			 to valid rights in existence on the date of enactment of this Act, the land
			 designated as wilderness or wilderness addition by this title is withdrawn from
			 all forms of—</text>
					<paragraph id="H599890E22A3B4786AEF9DFBAFD5CDB6D"><enum>(1)</enum><text>entry,
			 appropriation, or disposal under the public land laws;</text>
					</paragraph><paragraph id="H8AF56B5430BD42D0B0D94D843420CF85"><enum>(2)</enum><text>location, entry,
			 and patent under the mining laws; and</text>
					</paragraph><paragraph id="HAA89D67D67E6463C8EFCB3333F633F00"><enum>(3)</enum><text>disposition under
			 all laws pertaining to mineral and geothermal leasing or mineral
			 materials.</text>
					</paragraph></subsection><subsection id="H114F939E81B747649F6E575AC7403CF5"><enum>(d)</enum><header>Fire management
			 and related activities</header>
					<paragraph id="H68C1C7BAE33445B2ACCFA3E8E570AD29"><enum>(1)</enum><header>In
			 general</header><text>The Secretary may take such measures in a wilderness area
			 or wilderness addition designated by this Act as are necessary for the control
			 and prevention of fire, insects, and diseases in accordance with section
			 4(d)(1) of the Wilderness Act (16 U.S.C. 1133(d)(1)) and House Report 98–40 of
			 the 98th Congress.</text>
					</paragraph><paragraph id="H45F33E1A16F7430481CBC5BB35ED2DC4"><enum>(2)</enum><header>Funding
			 priorities</header><text>Nothing in this section limits funding for fire and
			 fuels management in the wilderness areas and additions designated by this
			 section.</text>
					</paragraph><paragraph id="H97FF147C089B4335990C664C40FA0BB9"><enum>(3)</enum><header>Revision and
			 development of local fire management plans</header><text display-inline="yes-display-inline">As soon as practicable after the date of
			 the enactment of this Act, the Secretary shall amend the local fire management
			 plan that applies to the Agua Tibia Wilderness and prepare a local fire
			 management plan for the Beauty Mountain Wilderness.</text>
					</paragraph><paragraph id="H1156FE268E874A05A626F7A014F34BE6"><enum>(4)</enum><header>Administration</header><text display-inline="yes-display-inline">Consistent with paragraph (1) and other
			 applicable Federal law, to ensure a timely and efficient response to fire
			 emergencies in the wilderness areas and additions designated by this section,
			 the Secretary shall—</text>
						<subparagraph id="HCFB8630064A9464D892309E79259AAEB"><enum>(A)</enum><text>not later than 1
			 year after the date of enactment of this Act, establish agency approval
			 procedures (including appropriate delegations of authority to the Forest
			 Supervisor, District Manager, or other agency officials) for responding to fire
			 emergencies; and</text>
						</subparagraph><subparagraph id="HA303A1D77AF84059A256F0AE3AB9FC0E"><enum>(B)</enum><text>enter into
			 agreements with appropriate State or local firefighting agencies.</text>
						</subparagraph></paragraph></subsection><subsection id="HFD8D2599769F4702B154C8CE437B5E17"><enum>(e)</enum><header>Grazing</header><text>Grazing
			 of livestock in a wilderness area or wilderness addition designated by this
			 title shall be administered in accordance with the provisions of section
			 4(d)(4) of the Wilderness Act (16 U.S.C. 1133(d)(4)) and the guidelines set
			 forth in House Report 96–617 to accompany H.R. 5487 of the 96th
			 Congress.</text>
				</subsection><subsection id="H17EA509AB73C4C5791BD5F8D436C1D97"><enum>(f)</enum><header>Military
			 activities</header><text>Nothing in this section precludes—</text>
					<paragraph id="HC7C5A41467FC4A3A86B6D01F50CB4CA6"><enum>(1)</enum><text>low-level
			 overflights of military aircraft over the wilderness areas or wilderness
			 additions designated by this section;</text>
					</paragraph><paragraph id="HBBCE6983286C41E0BCABFAF0D6DCF84E"><enum>(2)</enum><text>the designation of
			 new units of special airspace over the wilderness areas or wilderness additions
			 designated by this section; or</text>
					</paragraph><paragraph id="H0CDA0B2A506A4B43AFE21B6BFE98778E"><enum>(3)</enum><text>the use or
			 establishment of military flight training routes over wilderness areas or
			 wilderness additions designated by this section.</text>
					</paragraph></subsection></section></title><title id="HB9EE5F94E8564D1AB56C61CBC7BC2726"><enum>II</enum><header>Location and
			 nature of appropriate recreation facilities</header>
			<section id="H8F5CA6DDEC6A4D4983650262CB5F8858"><enum>201.</enum><header>Recreational
			 facilities</header>
				<subsection id="H05FD74AF3AA74FBFAC618DF0F87D53AA"><enum>(a)</enum><header>Construction of
			 facilities</header><text display-inline="yes-display-inline">Consistent with
			 applicable law and the applicable donation agreements between the Bureau of
			 Land Management and The Conservation Fund, the Bureau of Land Management shall
			 construct facilities as follows:</text>
					<paragraph id="HF22703AF04674A329A40A86B49CF4EBB"><enum>(1)</enum><header>Location of
			 recreational facilities</header><text>Recreational facilities shall be located
			 outside of the Beauty Mountain Wilderness in sections 13 and 14 and the
			 southeast 1/4 of the northeast 1/4, and the northeast 1/4 of the southeast 1/4
			 of section 8, Township 9 South, Range 3 East, San Bernardino Base and Meridian
			 to support recreational activities on public lands.</text>
					</paragraph><paragraph id="H813655833C204D7FBE28F1589F7060E2"><enum>(2)</enum><header>Parking
			 area</header><text>A parking area shall be constructed in the northwest 1/4
			 section of the southwest 1/4 of section 33, Township 9 South, Range 3 East, San
			 Bernardino Base and Meridian.</text>
					</paragraph></subsection><subsection id="H7B6AFA1914B049E4A969DA5A122DCD49"><enum>(b)</enum><header>Appropriate
			 recreational facilities</header><text>Consistent with the applicable donation
			 agreement between the Bureau of Land Management and The Conservation Fund,
			 recreational facilities located on the parcel described in subsection (a) shall
			 include a campground, parking area, corrals, water supply, restrooms, and other
			 appropriate facilities.</text>
				</subsection></section></title></legis-body>
