		<section id="H8D869C78F3B246E38A725CFF419EA79F" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Enhancing Livability for All Americans Act of
			 2009</short-title></quote>.</text>
		</section><section id="HF106A57254C7446AB4AED5F7EB519B57"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds the following:</text>
			<paragraph id="HA039CF996E984006ADEBAE939F88084F"><enum>(1)</enum><text display-inline="yes-display-inline">Since the creation of the Interstate
			 System, United States surface transportation has been defined by the use of
			 personal motor vehicles.</text>
			</paragraph><paragraph id="H3587DAE28EBD4EEFB78E41CC4A0130FA"><enum>(2)</enum><text display-inline="yes-display-inline">The focus on automobiles has afforded the
			 people of the United States increased mobility and interconnectivity, but has
			 also resulted in increased congestion, higher greenhouse gas emissions, and a
			 reduced focus on other modes of surface transportation.</text>
			</paragraph><paragraph id="HC5F4670C51EF45BA880CF108A2578B93"><enum>(3)</enum><text display-inline="yes-display-inline">Between 1955 and 2005, vehicle miles
			 traveled in the United States increased fivefold, bringing with it an
			 escalation in traffic congestion.</text>
			</paragraph><paragraph id="H0C9923F7B9DA4E4FB5DF3A7B796490CD"><enum>(4)</enum><text display-inline="yes-display-inline">Each year, Americans spend 4,200,000,000
			 hours in traffic congestion, burning 2,900,000,000 gallons of fuel.</text>
			</paragraph><paragraph id="HFB264A1317A54322AC01F2A9C3245F03"><enum>(5)</enum><text display-inline="yes-display-inline">Wasted time and fuel result in a
			 $78,000,000,000 annual congestion tax, creating a financial drain on
			 individuals and the economy as a whole.</text>
			</paragraph><paragraph id="H5ADF17AE66D94DD2AAA43C245DE78358"><enum>(6)</enum><text display-inline="yes-display-inline">The transportation sector accounts for 22
			 percent of the greenhouse gases emitted annually in the United States, with 60
			 percent of the emissions coming from personal motor vehicle use.</text>
			</paragraph><paragraph id="HE33040D2FF8B41858C6D6897058042D3"><enum>(7)</enum><text display-inline="yes-display-inline">Transportation costs account for
			 approximately 18 percent of an average household’s expenditures.</text>
			</paragraph><paragraph id="HC442CE612A164D3EB4B83033AFC9B5EC"><enum>(8)</enum><text display-inline="yes-display-inline">Over reliance on automobiles can have
			 adverse impacts on public health, both through lessened physical activity and
			 from increased pollutants.</text>
			</paragraph><paragraph id="H9D1BE9A4C80442AEB9773165F51AA7CA"><enum>(9)</enum><text display-inline="yes-display-inline">In order to reduce the financial,
			 environmental, and quality of life impacts of traffic congestion and to create
			 modal choice for all users, the United States transportation system must
			 include alternate modes of transportation to complement personal motor vehicle
			 travel, including public transit, walking, and bicycling.</text>
			</paragraph><paragraph id="HD92859815F344263AE485283DF755BFB"><enum>(10)</enum><text display-inline="yes-display-inline">Public transit, walking, and bicycling are
			 sustainable modes of transportation that result in 5,600,000,000 gallons of
			 fuel savings and reduce carbon dioxide emissions by 49,000,000 metric tons each
			 year.</text>
			</paragraph><paragraph id="HEA4E918A6D1C4B17A46B4E664754CEEA"><enum>(11)</enum><text display-inline="yes-display-inline">Sustainable modes of transportation can
			 provide affordable transportation choices and have the ability to reduce the
			 transportation cost burden.</text>
			</paragraph><paragraph id="H61E3F6BE17CF468CAF6E312D546F296B"><enum>(12)</enum><text display-inline="yes-display-inline">Bicyclists and pedestrians are intended
			 users of the surface transportation system, except where prohibited by law, and
			 it is the policy of the Federal Government to encourage maximum accessibility
			 and safety with respect to the surface transportation system for bicyclists and
			 pedestrians as intended users when designing and constructing surface
			 transportation facilities.</text>
			</paragraph><paragraph id="H6879C0373ACE44B2A18565CB9C7D0685"><enum>(13)</enum><text display-inline="yes-display-inline">In order to provide access to sustainable
			 modes of transportation, land use and planning decisions must include
			 consideration of transportation options.</text>
			</paragraph><paragraph id="H81452BFC5BFF47C0B9CF6B6558A7E49D"><enum>(14)</enum><text display-inline="yes-display-inline">A modally balanced surface transportation
			 system will benefit all users through improved accessibility, mobility, and
			 quality of life.</text>
			</paragraph><paragraph id="H9AAF69FC33A14A4897ED144EA8A6CAAB"><enum>(15)</enum><text display-inline="yes-display-inline">Increasing the availability and use of
			 sustainable modes of transportation and the development of livable communities
			 are priorities of the United States.</text>
			</paragraph></section><section id="H50F86FA9AD4E420CB635A44F7B7096C1"><enum>3.</enum><header>Office of
			 Livability</header>
			<subsection id="HABC3437A73514A6790CD10956219C94F"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Chapter 3 of title
			 23, United States Code, is amended by adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="H75224E97EE5344BE8F7C6C846F436B9C" style="USC">
					<section id="HC406CAD04B54454BA6309F4FB88DA7CE"><enum>330.</enum><header>Office of
				Livability</header>
						<subsection id="H35C97F4C2FDF49038F89E988FC164275"><enum>(a)</enum><header>Establishment</header><text display-inline="yes-display-inline">The Secretary shall establish within the
				Office of the Secretary an office to be known as the <quote>Office of
				Livability</quote> (in this section referred to as the <quote>Office</quote>)
				to—</text>
							<paragraph id="H24C461DFBDD84E42A0EE4776F5D1C0FC"><enum>(1)</enum><text>provide funding,
				leadership, and support for transportation projects, planning, and policies at
				all levels of government that enhance livability; and</text>
							</paragraph><paragraph id="HCD44C5AB435046A2BD121446D92ACB5A"><enum>(2)</enum><text display-inline="yes-display-inline">work to create and maintain a safe,
				reliable, integrated, and accessible transportation network that improves the
				economic and social well-being of the people of the United States by enhancing
				choices for transportation users that—</text>
								<subparagraph id="H48600E269E444BED8EF9B10CCC91931D"><enum>(A)</enum><text>provide easy
				access to employment opportunities and other destinations; and</text>
								</subparagraph><subparagraph id="HE1008277648C492496F31E415253201A"><enum>(B)</enum><text>promote positive
				effects on the surrounding community and environment.</text>
								</subparagraph></paragraph></subsection><subsection id="HB3FF656B1F4B473CBBE1565A28629252"><enum>(b)</enum><header>Director</header>
							<paragraph id="H5E9F6BE39E024A76AC3C524CA720978F"><enum>(1)</enum><header>In
				general</header><text>The Office shall be headed by a director who shall be
				known as the “Director of the Office of Livability” (in this section referred
				to as the <quote>Director</quote>) and who shall be appointed by the Secretary.</text>
							</paragraph><paragraph id="H85D785AA5F174972B6E4E151CC50DEF7"><enum>(2)</enum><header>Duties</header><text>The
				duties of the Director shall be to—</text>
								<subparagraph id="HB679BB61DA27490A820AE00DDFE24B97"><enum>(A)</enum><text>manage the
				programs of the Office;</text>
								</subparagraph><subparagraph id="H0F0CABCEC5994D58A5244E6F553776C4"><enum>(B)</enum><text>provide leadership
				within the Department of Transportation and throughout the United States with
				respect to Federal livability transportation policies; and</text>
								</subparagraph><subparagraph id="HB97F72871FA84404BEEC116F0317F6B4"><enum>(C)</enum><text>work
				collaboratively to ensure the expeditious and successful implementation of the
				projects and programs of other offices within the Department of Transportation
				relating to livability.</text>
								</subparagraph></paragraph></subsection><subsection id="HCD0217755A1F46DFB421F2BC33B0EFD8"><enum>(c)</enum><header>Grant
				programs</header><text>The Director shall establish and carry out the grant
				programs established under this section by—</text>
							<paragraph id="HF69E92348A994FB297AC81F4533EF4B5"><enum>(1)</enum><text>developing
				applications and criteria for the programs;</text>
							</paragraph><paragraph id="H91519215A07143879432AFA8075B5E31"><enum>(2)</enum><text display-inline="yes-display-inline">issuing regulations with respect to the
				programs;</text>
							</paragraph><paragraph id="HD73E195135C347AFB3B0B1CB29C7154C"><enum>(3)</enum><text display-inline="yes-display-inline">selecting the recipients of grants under
				the programs;</text>
							</paragraph><paragraph id="H02C5B2DCEDC54A3AAD9C43DDD6E84506"><enum>(4)</enum><text display-inline="yes-display-inline">creating performance measures for
				recipients of grants under the programs;</text>
							</paragraph><paragraph id="HD8A4E822E9E9476888D7EFBDECA1D5F0"><enum>(5)</enum><text display-inline="yes-display-inline">monitoring and evaluating the performance
				of recipients of grants under the programs;</text>
							</paragraph><paragraph id="HDF117C2E69394522804A3AB1DBBB0F7D"><enum>(6)</enum><text display-inline="yes-display-inline">developing technical assistance and other
				guidance to assist potential applicants, applicants, and recipients of grants
				under the programs; and</text>
							</paragraph><paragraph id="H7EE949BB1A3249809969FD8072FCF443"><enum>(7)</enum><text display-inline="yes-display-inline">carrying out other activities with respect
				to the programs determined necessary by the Director.</text>
							</paragraph></subsection><subsection id="HE324292B08D84C988E3C0483B2C8ED35"><enum>(d)</enum><header>Grant program
				for projects</header>
							<paragraph id="H10894D83667448409487054E000D03DE"><enum>(1)</enum><header>Establishment</header><text display-inline="yes-display-inline">The Director shall establish and carry out
				a grant program (in this subsection referred to as the <quote>program</quote>)
				to award grants on a competitive basis to eligible entities specified in
				paragraph (2) to assist capital investments in surface transportation projects
				that have a significant impact on a region, metropolitan area, community, or
				neighborhood.</text>
							</paragraph><paragraph id="HF04DF8816E0147A386C3C29BD32E21F2"><enum>(2)</enum><header>Eligible
				entities</header><text>For purposes of paragraph (1), the following are
				eligible entities:</text>
								<subparagraph id="H42F2276BCF2849F9A443D31222C0819B"><enum>(A)</enum><text display-inline="yes-display-inline">A State government.</text>
								</subparagraph><subparagraph id="H2CBCD6987C744CA2A53BEC25705D9B48"><enum>(B)</enum><text>A local
				government.</text>
								</subparagraph><subparagraph id="HDF5E97132F39429D9C5C6F9560B65D81"><enum>(C)</enum><text>The government of
				a territory of the United States.</text>
								</subparagraph><subparagraph id="H4030438E1FA84602B235068C170E1C95"><enum>(D)</enum><text>The government of
				an Indian tribe.</text>
								</subparagraph><subparagraph id="H3E67C98EDE8D45C193257E72E498D24B"><enum>(E)</enum><text>A transit
				agency.</text>
								</subparagraph><subparagraph id="H598A99C90317408681AD2F4545130AB4"><enum>(F)</enum><text>A port
				authority.</text>
								</subparagraph><subparagraph id="HB13E8C7D86DB44EDBFCBC84BD8052902"><enum>(G)</enum><text>A metropolitan
				planning organization.</text>
								</subparagraph><subparagraph id="HB2571743115F463795DE6F02AC9F5DB9"><enum>(H)</enum><text>Any other
				political subdivision of a State or local government.</text>
								</subparagraph><subparagraph id="H9004110E7F8D43F581A714BF4A7E934E"><enum>(I)</enum><text>A multimodal or
				multi-State entity composed of entities specified in subparagraphs (A) through
				(H).</text>
								</subparagraph></paragraph><paragraph id="H2191CE8F80C6446DA098F0D832396423"><enum>(3)</enum><header>Eligibility and
				priority of projects</header>
								<subparagraph id="H81C741F55AA34543BC3A42127F08074C"><enum>(A)</enum><header>Eligibility</header><text display-inline="yes-display-inline">A grant under the program shall be used for
				a transportation project that enhances livability. To be eligible for a grant
				under the program, an applicant must demonstrate the following:</text>
									<clause id="H80891048AF294DA6BFB1B2E049B4FAF8"><enum>(i)</enum><text display-inline="yes-display-inline">The proposed project of the applicant will
				take place in a community with a transportation system characterized by, in the
				determination of the Director, a majority of the following:</text>
										<subclause id="H80DE24B314E640FCA678AB9973607079"><enum>(I)</enum><text display-inline="yes-display-inline">Poor accessibility with respect to job
				centers, schools, and other urban areas in the region.</text>
										</subclause><subclause id="H5EBB904C7DEA4D239E00ABA5F0C52E1F"><enum>(II)</enum><text display-inline="yes-display-inline">Limited transportation options for
				residents, particularly for individuals living in high-poverty areas, the
				elderly, and individuals with a disability.</text>
										</subclause><subclause id="H37E1BC99DC92464186358FF9709502BF"><enum>(III)</enum><text display-inline="yes-display-inline">Limited access and safety with respect to
				all transportation modes, including bicycling and walking, and an overall
				record of poor transportation safety.</text>
										</subclause><subclause id="HE961CE23B13844B280CA8D2E7C65A808"><enum>(IV)</enum><text display-inline="yes-display-inline">Limited connectivity among existing
				transportation modes.</text>
										</subclause><subclause id="HD55B3108BB0642F58C86F508C272FA9E"><enum>(V)</enum><text display-inline="yes-display-inline">Significant congestion.</text>
										</subclause><subclause id="H870A1A7E82474E2D9802CC1994F2B245"><enum>(VI)</enum><text display-inline="yes-display-inline">Significant urban sprawl characterized by
				low population density.</text>
										</subclause><subclause id="H690473F5E19D466DA71BBB9BD5413A64"><enum>(VII)</enum><text display-inline="yes-display-inline">Poor air and water quality.</text>
										</subclause><subclause id="HD6388F9E1A8B438C8D238BFE018662EB"><enum>(VIII)</enum><text display-inline="yes-display-inline">Limited green space and greenways.</text>
										</subclause><subclause id="HB7D85083D3A94CE4B105020F94E446F5"><enum>(IX)</enum><text display-inline="yes-display-inline">An excessive average vehicle miles traveled
				per resident.</text>
										</subclause></clause><clause id="H8E8DC14AD82745808CDF3110B748FC94"><enum>(ii)</enum><text display-inline="yes-display-inline">The applicant has established performance
				measures to evaluate the effectiveness of the proposed project.</text>
									</clause><clause id="H9E50E2CCE4F34AC99051D63A7B2B2969"><enum>(iii)</enum><text display-inline="yes-display-inline">The applicant will utilize context
				sensitive solutions and public involvement in project development to ensure
				that the project reflects community and environmental values.</text>
									</clause><clause id="H067CF99309F24E60B282089738EA7611"><enum>(iv)</enum><text display-inline="yes-display-inline">There is a commitment to implementation of
				the proposed project on the part of key local political leadership and
				stakeholder groups, including metropolitan planning organizations.</text>
									</clause><clause id="H80603DA4BDBC4585B57C885AAD46ED1E"><enum>(v)</enum><text display-inline="yes-display-inline">The proposed project is able to begin
				implementation not later than one year after the date on which grant amounts
				are received.</text>
									</clause></subparagraph><subparagraph id="HB817797E99564874B5A89FB7180550BB"><enum>(B)</enum><header>Priorities</header><text display-inline="yes-display-inline">The Director shall give priority in
				awarding grants under the program to transportation projects that include at
				least two or more of the following:</text>
									<clause id="H51E889DC71F547E8B2D04486A7E5524D"><enum>(i)</enum><text display-inline="yes-display-inline">Provision of an increased number of
				transportation options, including bicycling and walking, to improve access to
				housing, jobs, businesses, services, and social activities, particularly for
				low-income individuals and populations without access to a motor
				vehicle.</text>
									</clause><clause id="HE5BF98A06ACC42FCA5C4F6D1B572800D"><enum>(ii)</enum><text display-inline="yes-display-inline">Design of streets and transit and rail
				stations to enable safe and equitable access for all users.</text>
									</clause><clause id="HEA5E09064F3549A987F7F31D2828DEF7"><enum>(iii)</enum><text display-inline="yes-display-inline">Improvement of the safety of a
				transportation system, facility, or network.</text>
									</clause><clause id="HB46D9FF2769441E0993B5ECEB1257626"><enum>(iv)</enum><text display-inline="yes-display-inline">Reduction of greenhouse gas and criteria
				pollutant emissions, enhancement of wildlife habitat, or an increase in green
				spaces.</text>
									</clause><clause id="H2DCD3464AD0849269AF8E96B355D3514"><enum>(v)</enum><text display-inline="yes-display-inline">Reduction of exposure to criteria
				pollutants and other public health risks, particularly for low-income and
				at-risk communities.</text>
									</clause><clause id="H09F1FEDF1AA6418C8D73DC1F98A186AE"><enum>(vi)</enum><text display-inline="yes-display-inline">Use of innovative land use strategies to
				better coordinate transportation, housing, and development.</text>
									</clause><clause id="HEC074F2EA6D74043BDDCE7DF36A27931"><enum>(vii)</enum><text display-inline="yes-display-inline">Strong collaboration among a broad range of
				participants or the integration of transportation projects with other public
				service efforts.</text>
									</clause><clause id="H10FF45A907434DCABF0739D81FDD8AC8"><enum>(viii)</enum><text display-inline="yes-display-inline">Revitalization of main streets and
				downtowns by making transportation improvements that encourage greater use of
				such areas.</text>
									</clause><clause id="HC07E9C2063F943008CF5E961527E380D"><enum>(ix)</enum><text display-inline="yes-display-inline">Support for community in-fill,
				transit-oriented development, or neighborhood revitalization activities.</text>
									</clause><clause id="HDEEC5047726B42D8BBB9945ABFBA561D"><enum>(x)</enum><text display-inline="yes-display-inline">Support for goals or projects included in a
				long range transportation plan.</text>
									</clause></subparagraph></paragraph><paragraph id="H48AEE252CD7940BDB1021399B250DBC9"><enum>(4)</enum><header>Size
				diversity</header><text display-inline="yes-display-inline">In awarding grants
				under the program, the Director shall award—</text>
								<subparagraph id="H9B5BB49FAAE8490E9C82648B9C0CEC93"><enum>(A)</enum><text display-inline="yes-display-inline">at least 25 percent of the amount available
				for grants under the program to projects located in communities with a
				population of not more than 200,000 individuals (which may include amounts
				awarded pursuant to subparagraph (B)); and</text>
								</subparagraph><subparagraph id="H853CDFB2801A45F89143E850C206FC35"><enum>(B)</enum><text display-inline="yes-display-inline">at least 10 percent of the amount available
				for grants under the program to projects located in communities with a
				population of not more than 50,000 individuals.</text>
								</subparagraph></paragraph><paragraph id="HF55883B2FD0B427192BD2CEA84388190"><enum>(5)</enum><header>Availability of
				amounts</header><text>Amounts made available to a recipient of a grant under
				the program shall remain available for the 3 fiscal years beginning after the
				fiscal year in which amounts are provided. Amounts unobligated by the recipient
				at the end of such period shall be redistributed by the Director to other
				eligible entities under the program.</text>
							</paragraph><paragraph id="HC29E38B2539F459689C6B534EB0FA355"><enum>(6)</enum><header>Annual
				report</header><text>As a condition of receiving a grant under the program, the
				recipient of the grant shall submit to the Director, each fiscal year in which
				the grant amounts are received, a report that, at a minimum—</text>
								<subparagraph id="H1C33C09D99F942A09D3BC30F17D8DEB0"><enum>(A)</enum><text>lists and
				describes the projects and activities carried out by the recipient during the
				fiscal year; and</text>
								</subparagraph><subparagraph id="H60225399A8534120BC862E501DB8FEE7"><enum>(B)</enum><text>describes and
				analyzes the impact of the projects and activities with respect to the
				objectives of programs and activities under this section.</text>
								</subparagraph></paragraph></subsection><subsection id="HED8AE87DACEB4A0CA6DC07586F3D5845"><enum>(e)</enum><header>Grant program
				for innovative planning</header>
							<paragraph id="H0D7CE9B71132455F94E398B2955C6E8F"><enum>(1)</enum><header>Establishment</header><text display-inline="yes-display-inline">The Director shall establish and carry out
				a grant program (in this subsection referred to as the <quote>program</quote>)
				to award grants on a competitive basis to eligible entities specified in
				paragraph (2) to assist communities in developing strategic growth plans that
				provide a vision and goals for development with respect to at least a 20-year
				period and that integrate long-term transportation and land use
				planning.</text>
							</paragraph><paragraph id="HD12ABA38CE59411BB9A75FC5ED9ECBBF"><enum>(2)</enum><header>Eligible
				entities</header><text display-inline="yes-display-inline">For purposes of
				paragraph (1), the following are eligible entities:</text>
								<subparagraph id="H88196578DA484E7B87C78FDDE36A7EE7"><enum>(A)</enum><text display-inline="yes-display-inline">A State government.</text>
								</subparagraph><subparagraph id="H958985F00C1443AAA68AE7D1C554518F"><enum>(B)</enum><text>A regional
				planning organization.</text>
								</subparagraph><subparagraph id="H4CA782952FC641E59E49DB4A0A3CC144"><enum>(C)</enum><text>A metropolitan
				planning organization.</text>
								</subparagraph><subparagraph id="HCA43473B445240D79D20D312E6792065"><enum>(D)</enum><text>A local
				government.</text>
								</subparagraph></paragraph><paragraph id="H80F90D6261C045DABB404DFCD4E64F9C"><enum>(3)</enum><header>Priority for
				grants</header><text display-inline="yes-display-inline">The Director shall
				give priority in awarding grants under the program to applicants that
				demonstrate the following:</text>
								<subparagraph id="HA358A3D8647E485CAC3DC044829F3D5C"><enum>(A)</enum><text display-inline="yes-display-inline">The proposed strategic growth plan of the
				applicant is for a community with a transportation system characterized by, in
				the determination of the Director, a majority of the following:</text>
									<clause id="H628C8EBBF5B24DC3BDBAA8483863A33D"><enum>(i)</enum><text display-inline="yes-display-inline">Poor accessibility with respect to job
				centers, schools, and other urban areas in the region.</text>
									</clause><clause id="HA4E7F5FEDD784DF6ADDEC467C04E9120"><enum>(ii)</enum><text display-inline="yes-display-inline">Limited transportation options for
				residents, particularly for individuals living in high-poverty areas, the
				elderly, and individuals with a disability.</text>
									</clause><clause id="HF225837B3700459892A3B9A801B61385"><enum>(iii)</enum><text display-inline="yes-display-inline">Limited access and safety with respect to
				all transportation modes, including bicycling and walking, and an overall
				record of poor transportation safety.</text>
									</clause><clause id="HE59ED2DA3ECD4663A901893B57776667"><enum>(iv)</enum><text display-inline="yes-display-inline">Limited connectivity among existing
				transportation modes.</text>

				water quality.</text>
									</clause><clause id="HBB05FD0DBD9F42B4A3CDD2BA4094F6AE"><enum>(viii)</enum><text>Limited green
				space and greenways.</text>
									</clause><clause id="H9F0D500F377F4508A43A828B42042F10"><enum>(ix)</enum><text>An excessive
				average vehicle miles traveled per resident.</text>
									</clause></subparagraph><subparagraph id="H983412C8E5FA4A0BB67F43FCB47C4D99"><enum>(B)</enum><text display-inline="yes-display-inline">Multijurisdictional partnerships and
				engagement with local jurisdictions, transit agencies and service providers,
				and housing and land use entities.</text>
								</subparagraph><subparagraph id="H9F2DF0B0F8134500B7C033057D95CDE0"><enum>(C)</enum><text>The ability to
				complete a strategic growth plan in an effective and timely manner.</text>
								</subparagraph><subparagraph id="H943887E91A8D4C6CADFCC54FF0777D9F"><enum>(D)</enum><text display-inline="yes-display-inline">The ability to incorporate the strategic
				growth plan into a long range transportation plan.</text>
								</subparagraph></paragraph><paragraph id="HECD048E8C65B48DDB6A7E6A50CF0A0E9"><enum>(4)</enum><header>Requirements on
				strategic growth plans</header><text display-inline="yes-display-inline">A
				strategic growth plan for which a grant is awarded under the program shall
				develop a vision and goals for enhancing livability. The recipient of a grant
				under the program shall coordinate with local jurisdictions, transit agencies
				and service providers, and housing and land use entities and shall develop a
				strategic growth plan that—</text>
								<subparagraph id="H58D3979FA7734CCFA72E3BC7BCE095DF"><enum>(A)</enum><text>furthers the
				creation of livable communities;</text>
								</subparagraph><subparagraph id="HF743C8F6A52A4DA3BDC032AD9A785DE9"><enum>(B)</enum><text>incorporates the
				development of feasible steps for implementing the plan, including
				interjurisdictional agreements that provide for cooperative and coordinated
				approaches to achieving plan goals;</text>
								</subparagraph><subparagraph id="HFA389FDE7EE746FDA8A49B708AF7652A"><enum>(C)</enum><text display-inline="yes-display-inline">assesses projected regional population
				growth or loss and other demographic changes, including by creating 2 to 4
				alternative growth scenarios;</text>
								</subparagraph><subparagraph id="H71E61BE64E7E49AC9EC5CFD08846D58F"><enum>(D)</enum><text display-inline="yes-display-inline">assesses how regional population growth or
				loss and other demographic changes may impact the need for housing, community
				development, and transportation, including public transportation, in the
				region;</text>
								</subparagraph><subparagraph id="H9EDAF08EFC05462F96E10A3F41834002"><enum>(E)</enum><text display-inline="yes-display-inline">assesses existing transportation corridors
				and includes strategies for maintaining the corridors and for enhancing
				development along the corridors;</text>
								</subparagraph><subparagraph id="HBCE445967F654DD6AB385C4EBE14C74F"><enum>(F)</enum><text display-inline="yes-display-inline">assesses the accessibility of job centers
				in the region with respect to public transportation facilities and housing,
				including affordable and public housing;</text>
								</subparagraph><subparagraph id="H22460157FF754E2ABC1740D133A12A7A"><enum>(G)</enum><text>assesses
				transportation options in the region, including—</text>
									<clause id="H83E3F49BAF6640859F577A75087ADD30"><enum>(i)</enum><text display-inline="yes-display-inline">public transportation options, including
				intercity and high-speed rail;</text>
									</clause><clause id="HA037F3D6A71146A9A3E708AA0994F4D4"><enum>(ii)</enum><text>options for
				individuals with low incomes, individuals living in high-poverty areas, the
				elderly, and individuals with a disability; and</text>
									</clause><clause id="HBA88EA0DF7654E4D9E2B680EA1D8B9C2"><enum>(iii)</enum><text display-inline="yes-display-inline">any obstacles to providing access to
				locations that offer employment opportunities, including those in other urban
				areas in the region;</text>
									</clause></subparagraph><subparagraph id="H571BE86419494752AB2E3A161D7DB399"><enum>(H)</enum><text display-inline="yes-display-inline">assesses the daily vehicle miles traveled
				in the region and the opportunities for reducing growth in daily vehicle miles
				traveled and traffic congestion in the region;</text>
								</subparagraph><subparagraph id="H94D2AA707FA141F5AB368F8540FBD0CD"><enum>(I)</enum><text>assesses the
				environmental and public health needs of the region and incorporates strategies
				for reducing greenhouse gas emissions, improving air and water quality, and
				remediating brownfield sites;</text>
								</subparagraph><subparagraph id="HBFA135E919A24932A60E7CC4720DD58D"><enum>(J)</enum><text>includes
				strategies for adding new capacity for public transportation and increasing
				ridership on public transportation;</text>
								</subparagraph><subparagraph id="H33814D0B34304458847340F696E3B086"><enum>(K)</enum><text display-inline="yes-display-inline">includes strategies for supporting the
				development of location-efficient and transit-oriented development;</text>
								</subparagraph><subparagraph id="H3A61CBDC870240BBACB65EAE2CB235E7"><enum>(L)</enum><text display-inline="yes-display-inline">includes strategies for revitalizing
				communities, neighborhoods, and commercial centers by supporting existing
				infrastructure;</text>
								</subparagraph><subparagraph id="H6CE0FD4B232B4EBC9D0E8233B941D33D"><enum>(M)</enum><text display-inline="yes-display-inline">includes strategies for coordinating the
				provision of transportation services to individuals with low incomes, the
				elderly, and individuals with a disability;</text>
								</subparagraph><subparagraph id="H21B3E11C74164D2AA114D92FE8857510"><enum>(N)</enum><text display-inline="yes-display-inline">includes strategies for reducing the costs
				of housing and transportation, particularly for low-income households;
				and</text>
								</subparagraph><subparagraph id="H0F0ACA3B7BC648D3B7A8D49EA7C874A6"><enum>(O)</enum><text display-inline="yes-display-inline">assesses public lands and waters and
				includes strategies for maintaining or enhancing the amount of public lands and
				waters.</text>
								</subparagraph></paragraph><paragraph id="HE31A8C43D6D7474A818066CC199F5B6E"><enum>(5)</enum><header>Size
				diversity</header><text display-inline="yes-display-inline">In awarding grants
				under the program, the Director shall award—</text>
								<subparagraph id="H5241F2D9FD514DDB965BB0215A31F975"><enum>(A)</enum><text display-inline="yes-display-inline">at least 25 percent of the amount available
				for grants under the program to plans for communities with a population of not
				more than 200,000 individuals (which may include amounts awarded pursuant to
				subparagraph (B)); and</text>
								</subparagraph><subparagraph id="H569D42E97409408BAA94242B9FD7CB86"><enum>(B)</enum><text display-inline="yes-display-inline">at least 10 percent of the amount available
				for grants under the program to plans for communities with a population of not
				more than 50,000 individuals.</text>
								</subparagraph></paragraph><paragraph id="H8C8EDF4F6D244AD3B18D306C55F37FBC"><enum>(6)</enum><header>Availability of
				amounts</header><text display-inline="yes-display-inline">Amounts made
				available to a recipient of a grant under the program shall remain available
				for the 3 fiscal years beginning after the fiscal year in which amounts are
				provided. Amounts unobligated by the recipient at the end of such period shall
				be redistributed by the Director to other eligible entities under the
				program.</text>
							</paragraph><paragraph id="HFCA4FE1D1E4C4807A7E8C64BC8288258"><enum>(7)</enum><header>Maximum grant
				amounts</header><text display-inline="yes-display-inline">The Director shall
				establish the maximum amount of a grant under the program for each of the
				following:</text>
								<subparagraph id="H275B9945886D4302B7DC74C51A715A21"><enum>(A)</enum><text>Recipients
				developing a strategic growth plan for a community with a population of not
				more than 50,000 individuals.</text>
								</subparagraph><subparagraph id="H7C31BEB790D141979DDC7246CFAF0BBC"><enum>(B)</enum><text display-inline="yes-display-inline">Recipients developing a strategic growth
				plan for a community with a population of more than 50,000 individuals and not
				more than 200,000 individuals.</text>
								</subparagraph><subparagraph id="HC5BFAC1A1B6A406E9A3BECB9D615B24C"><enum>(C)</enum><text display-inline="yes-display-inline">Recipients developing a strategic growth
				plan for a community with a population of more than 200,000 individuals and not
				more than 1,000,000 individuals.</text>
								</subparagraph><subparagraph id="H1A52C73780A047C8A2DB268A2EC37755"><enum>(D)</enum><text display-inline="yes-display-inline">Recipients developing a strategic growth
				plan for a community with a population of more than 1,000,000 individuals and
				not more than 3,000,000 individuals.</text>
								</subparagraph><subparagraph id="H7A77676D84BF450691A1DC90B98D2289"><enum>(E)</enum><text display-inline="yes-display-inline">Recipients developing a strategic growth
				plan for a community with a population of more than 3,000,000
				individuals.</text>
								</subparagraph></paragraph><paragraph id="HC2CFA596388E4DABAA7BEC70855E47B1"><enum>(8)</enum><header>Annual
				report</header><text display-inline="yes-display-inline">As a condition of
				receiving a grant under the program, the recipient of the grant shall submit to
				the Director, each fiscal year in which the grant amounts are received, a
				report that, at a minimum—</text>
								<subparagraph id="HF7739BDAAF8D4A91B4130000AC3E1562"><enum>(A)</enum><text>lists and
				describes the projects and activities carried out by the recipient during the
				fiscal year;</text>
								</subparagraph><subparagraph id="H4AA222BFC53A4A7BB4DAD4135BB04DB9"><enum>(B)</enum><text>describes and
				analyzes the impact of the projects and activities with respect to the
				objectives of programs and activities under this section;</text>
								</subparagraph><subparagraph id="H7108E18DEB7F4859895DC3E7842E4ED5"><enum>(C)</enum><text display-inline="yes-display-inline">includes a set of performance measures to
				evaluate the strategic growth plan of the recipient, including measures with
				respect to the evaluation of economic development, quality of life,
				transportation costs, public health and safety, equitable access to
				transportation options, energy efficiency, greenhouse gas emission reductions
				and other environmental impacts, and transportation system conditions and
				connectivity; and</text>
								</subparagraph><subparagraph id="HBEC166F1EFE74438A12C58E6D507BE59"><enum>(D)</enum><text display-inline="yes-display-inline">describes innovative planning and public
				participation methods developed and implemented, including for engaging
				regional employers, public health and housing providers, and transportation
				users, including individuals with low incomes, the elderly, and individuals
				with a disability;</text>
								</subparagraph></paragraph></subsection><subsection id="HCAD1329D7C814F3482B31B768C55EFF7"><enum>(f)</enum><header>Development of
				statistical and analytical capabilities</header><text display-inline="yes-display-inline">The Director shall develop statistical and
				analytical capabilities, in conjunction, when appropriate, with other entities
				in the executive branch (including the Environmental Protection Agency and the
				Department of Housing and Urban Development) and with other entities within the
				Department of Transportation (including other offices within the Federal
				Highway Administration, the Federal Transit Administration, the Federal
				Railroad Administration, the National Highway Traffic Safety Administration,
				and the Bureau of Transportation Statistics) to ascertain, and shall determine,
				the following using the best available research methodologies:</text>
							<paragraph id="H46B14093F1FD4A3ABBADE32E9970A8A4"><enum>(1)</enum><text>The percentage of
				trips taken throughout the United States each year using each of the following
				modes of transportation:</text>
								<subparagraph id="H7F3D881459374390827370EA88EF3587"><enum>(A)</enum><text>Motor vehicle
				travel.</text>
								</subparagraph><subparagraph id="H57A9CC2759FA48589AF994096722BACB"><enum>(B)</enum><text>Public transit,
				including ferries.</text>
								</subparagraph><subparagraph id="HD7764EC766264519BC60B60A75FF659B"><enum>(C)</enum><text>Walking.</text>
								</subparagraph><subparagraph id="H1289117C0685434181CCBF871A4D2326"><enum>(D)</enum><text>Bicycling.</text>
								</subparagraph><subparagraph id="H08069E1AFB884F9B899870C3E4C554DE"><enum>(E)</enum><text display-inline="yes-display-inline">Intercity rail and bus travel.</text>
								</subparagraph></paragraph><paragraph id="HBCDFA162726B40E591DB895DB3877B8E"><enum>(2)</enum><text>The economic,
				public health, and environmental benefits derived due to the percentage of
				trips taken annually using sustainable modes of transportation.</text>
							</paragraph><paragraph id="HE9DE92AEA8CB4FB892606CF7DF39B5DD"><enum>(3)</enum><text>Benefits that may
				be achieved with an increase in the percentage of trips taken annually using
				sustainable modes of transportation.</text>
							</paragraph><paragraph id="H44EEBFDF43804DCBA8610D1F338BB4B1"><enum>(4)</enum><text>An affordability
				index that illustrates the transportation and housing costs associated with
				living in specific locations.</text>
							</paragraph><paragraph id="H355AC5AF02C542C788569A84E07742E3"><enum>(5)</enum><text display-inline="yes-display-inline">Any other information relating to the
				status and expansion of sustainable modes of transportation and livable
				communities that the Director determines is necessary.</text>
							</paragraph></subsection><subsection id="H06794A285BB64408B734377973620B42"><enum>(g)</enum><header>Executive branch
				coordination</header><text display-inline="yes-display-inline">The Director
				shall work collaboratively with other executive branch agencies, including the
				Department of Housing and Urban Development, the Environmental Protection
				Agency, the Department of the Interior, and the Department of Health and Human
				Services, to exchange information, carry out joint planning and research, and
				conduct other activities that promote the development of livable communities,
				increase transportation choices, and improve the environment, public health,
				and quality of life.</text>
						</subsection><subsection id="H9B8885FAC08A41CE8C98843A27D39DC0"><enum>(h)</enum><header>Collaboration</header>
							<paragraph id="H81873D0DC2D944EBA99E6DF65D706522"><enum>(1)</enum><header>In
				general</header><text display-inline="yes-display-inline">The Director shall
				work collaboratively to ensure the expeditious and successful implementation of
				projects and programs that pertain to livability in offices of the Federal
				Highway Administration, Federal Transit Administration, Federal Railroad
				Administration, and all other operating administrations within the Department
				of Transportation. Projects and programs that pertain to livability include the
				following:</text>
								<subparagraph id="H921CCE15A8E245D585FAAAF7BC187907"><enum>(A)</enum><text>The nonmotorized
				transportation pilot program under section 1807 of SAFETEA–LU (23 U.S.C. 217
				note; 119 Stat. 1460).</text>
								</subparagraph><subparagraph id="H7DBE47950685438B88ADE4DA151EDF9A"><enum>(B)</enum><text>Transportation
				enhancements under section 133.</text>
								</subparagraph><subparagraph id="H6B8C4C972E6E47988FF98AF3C0B339C8"><enum>(C)</enum><text>The recreational
				trails program under section 206.</text>
								</subparagraph><subparagraph id="HE5EFE3E071984A27BA9C393DE59FAB7A"><enum>(D)</enum><text>The national
				scenic byways program under section 162.</text>
								</subparagraph><subparagraph id="H13B0A274D2D44734BA42052CD877C710"><enum>(E)</enum><text display-inline="yes-display-inline">Other programs of the Department of
				Transportation identified by the Secretary as contributing significantly to
				improved livability.</text>
								</subparagraph></paragraph><paragraph id="H116CC48336DF4EE6AFF2B5307DF48467"><enum>(2)</enum><header>Effect on
				location of programs</header><text display-inline="yes-display-inline">Programs
				specified under paragraph (1) shall remain in the modal location in effect
				before the date of enactment of this section. A program relating to livability
				established after the date of enactment of this section may be situated in any
				modal location in the Department of Transportation, at the discretion of the
				Secretary, unless otherwise mandated by Act of Congress.</text>
							</paragraph></subsection><subsection id="H08E7EEA9F0134698B11AFCD8AC93B862"><enum>(i)</enum><header>Development and
				dissemination of best practices</header>
							<paragraph id="H1F69328DE4BE4604A064E128849DA300"><enum>(1)</enum><header>In
				general</header><text display-inline="yes-display-inline">The Office shall act
				as a leadership resource to develop and disseminate information on best
				practices and provide technical assistance or other training to States,
				regional and local governmental entities, and Indian tribes relating to, at a
				minimum, the following:</text>
								<subparagraph display-inline="no-display-inline" id="H601D8297FA194CB8B8B168965C9B2BFB"><enum>(A)</enum><text>Promotion of the
				integration of land use planning and transit-oriented development to support
				the creation of livable communities.</text>
								</subparagraph><subparagraph id="H1C9A173A0FE44CAFA48F2D7E69AFED5C"><enum>(B)</enum><text>Fostering
				multimodal transportation systems and effective multimodal connections.</text>
								</subparagraph><subparagraph display-inline="no-display-inline" id="H70034840B6C64A1D8262C006FE3A265B"><enum>(C)</enum><text>The expeditious
				delivery of nonmotorized transportation projects.</text>
								</subparagraph><subparagraph display-inline="no-display-inline" id="HE8F65DED06C541D68722C7ECFCA0A51B"><enum>(D)</enum><text>Innovative design
				of nonmotorized transportation facilities.</text>
								</subparagraph><subparagraph display-inline="no-display-inline" id="HD21F17B01CBE416AB6ECCB0E4B617D5A"><enum>(E)</enum><text>Adoption and
				implementation of comprehensive street design policies and principles and
				practical design standards.</text>
								</subparagraph><subparagraph id="H48AEDCA46E9C4BA4BAE2877CCC740F54"><enum>(F)</enum><text>Reduction of
				greenhouse gas emissions and other criteria pollutants.</text>
								</subparagraph><subparagraph display-inline="no-display-inline" id="HBCB7B78D63B64129AF40279F96606A5E"><enum>(G)</enum><text>Projects,
				programs, and activities that support the achievement of the national mode
				share targets developed under paragraph (2).</text>
								</subparagraph></paragraph><paragraph id="H841698F283414139A2006A85FE3C19F0"><enum>(2)</enum><header>Mode share
				targets</header><text>The Director shall develop quantifiable national mode
				share targets for sustainable modes of transportation, develop a timeline for
				achievement of the targets, and support projects, programs, and activities
				within the Department of Transportation and throughout the United States in
				support of the targets.</text>
							</paragraph></subsection><subsection id="HD2BA8A6F17C7418287610D2A6497AC85"><enum>(j)</enum><header>Comprehensive
				street design policies and principles and practical design
				standards</header><text>The Director shall encourage the adoption and
				implementation by States, regional and local governmental entities, and Indian
				tribes of comprehensive street design policies and principles and practical
				design standards through—</text>
							<paragraph display-inline="no-display-inline" id="HEDE34ECDAC5743C683D77F58B462FCB5"><enum>(1)</enum><text>the development
				and dissemination of information on best practices under subsection (i);</text>
							</paragraph><paragraph id="H1BE399C776904C5F9E8E372DA4E956A8"><enum>(2)</enum><text display-inline="yes-display-inline">the provision of technical assistance or
				other training under subsection (i); and</text>
							</paragraph><paragraph id="H8C8E3299752E4C3B9B01682BE0709B57"><enum>(3)</enum><text display-inline="yes-display-inline">the creation or compilation of model
				comprehensive street design policies and principles and practical design
				standards and the dissemination of information relating to such models to
				States, metropolitan planning organizations, and other appropriate governmental
				entities.</text>
							</paragraph></subsection><subsection id="HA6B567A63D704C96B452EC7A4AD309E8"><enum>(k)</enum><header>Livability,
				sustainability, and planning</header><text display-inline="yes-display-inline">The Director shall compile information and
				provide technical assistance, training, and information concerning best
				practices to States and metropolitan planning organizations to assist such
				entities in achieving compliance with livability and sustainability
				requirements and performance targets.</text>
						</subsection><subsection id="HDEFBA892B83F4237AC1D7BB1749B0F45"><enum>(l)</enum><header>Funding</header>
							<paragraph id="HE667B534A84F4293BE964D2F4F9AC5C6"><enum>(1)</enum><header>In
				general</header><text>There is authorized to be appropriated out of the Highway
				Trust Fund (other than the Mass Transit Account) to carry out this section
				$750,000,000 for each of fiscal years 2011 through 2015.</text>
							</paragraph><paragraph id="HA3719DC3D4584B7383FB46E23D84269A"><enum>(2)</enum><header>Contract
				authority</header><text>Funds made available to carry out this section shall be
				available for obligation and administered in the same manner as if the funds
				were apportioned under chapter
				1.</text>
							</paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
