<section id="H6D3F99C2EC834EADA974DB4C353653AC" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote>Equality for Women Farmers Act</quote>.</text> </section>
<section id="H39E8423F892249BBAB9245DF59F8FE71"><enum>2.</enum><header>Resolution of certain discrimination claims against the Department of Agriculture</header> 
<subsection id="HDDE7469314B54BC184EE6F7918B727B2"><enum>(a)</enum><header>Notice to potential claimants</header> 
<paragraph id="HB013CF8D039740A4A055B7E3855E0952"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Within 120 days after the date of the enactment of this Act, the Secretary shall attempt to notify each person who may be an eligible claimant of the opportunity, during the 3-year period that begins with such date of enactment, to submit a claim under this section for damages resulting from discrimination described in section 6(4).</text> </paragraph>
<paragraph id="HEE0D040255F0472EBCFE9701A90D6F6A"><enum>(2)</enum><header>Methods</header><text>The Secretary shall provide the notice—</text> 
<subparagraph id="H5B802579189E49B193551BFCA70C9B24"><enum>(A)</enum><text display-inline="yes-display-inline">by United States mail and electronic mail, to each such person whose address can be determined from the records of the Department or records provided by counsel for eligible claimants; and</text> </subparagraph>
<subparagraph id="H97A359BA52844962B41E479869608291"><enum>(B)</enum><text display-inline="yes-display-inline">by posting in public places, such as local Farm Service Agency offices and on the website of the Department, in a manner designated to reach all such persons.</text> </subparagraph></paragraph></subsection>
<subsection id="H7BBEC4E435084B35BA8435C158267F35"><enum>(b)</enum><header>Submission of claims</header><text>A person desiring to submit a claim under this section shall file with the Special Master a sworn statement that contains the following:</text> 
<paragraph display-inline="no-display-inline" id="HA2504EFDE291415EA5C7A4A3E7AD38C8"><enum>(1)</enum><text>The full name of the person.</text> </paragraph>
<paragraph id="H11038EF7BCDC4865B5648EED911042B5"><enum>(2)</enum><text>The mailing address of the person.</text> </paragraph>
<paragraph id="H01D70095E9834202B24DFB8A23AF9760"><enum>(3)</enum><text>To the best of the person’s ability, each date in the claims period on which the person requested from, or submitted to, the Department an application for a farm loan, farm loan servicing, or a disaster loan.</text> </paragraph>
<paragraph id="HF3C9C7EDEC38443893D3512A98094CCF"><enum>(4)</enum><text>With respect to each such request or submission—</text> 
<subparagraph id="HCCE2CECEDF2D4EFC993DD2F8B19BDBE3"><enum>(A)</enum><text>the identity of the office of the Department to which the request or submission was originally made;</text> </subparagraph>
<subparagraph id="H585482A85B2D4AD38B1215BFEC0BF89C"><enum>(B)</enum><text display-inline="yes-display-inline">the type of loan or loan servicing sought, including a copy of any document submitted;</text> </subparagraph>
<subparagraph id="H71D622AF553F430D99F19DED3D2335F1"><enum>(C)</enum><text>the amount of damages suffered by the person as a result of the failure of the Department to provide, act on, or approve (in whole or in part) the application; and</text> </subparagraph>
<subparagraph id="H47497D1B2B4F4EA98A9F47B24A991D48"><enum>(D)</enum><text>a claim for compensation for the damages.</text> </subparagraph></paragraph></subsection>
<subsection id="HD4746ABCD34144FEB2AE2AB79C131643"><enum>(c)</enum><header>Processing of claims</header> 
<paragraph id="HCD3E56FDAFCD4BDCBAE51EC1F96CA235"><enum>(1)</enum><header>Personnel</header> 
<subparagraph id="HFBF8FEB1E7AA45B594677454FCFA3E4D"><enum>(A)</enum><header>FMCS appointees</header> 
<clause id="H6785E826974744DF96AF76E1C1B9D21B"><enum>(i)</enum><header>Special master</header><text>Within 60 days after the date of the enactment of this Act, the Federal Mediation and Conciliation Service (in this subparagraph referred to as the <quote>FMCS</quote>) shall appoint a Special Master to process, review, and adjudicate claims under this section.</text> </clause>
<clause id="H5334ED9F0236490BB8A532E4D5AE8382"><enum>(ii)</enum><header>Assistant special masters</header><text>At the request of the Special Master, the FMCS shall designate assistant special masters, as necessary, to assist the Special Master in processing, reviewing, and adjudicating claims under this section.</text> </clause>
<clause id="H1A94506046F34B4580479AB9E7D5DDCE"><enum>(iii)</enum><header>Compensation</header><text display-inline="yes-display-inline">From funds made available to carry out this section, the Special Master and any assistant special masters designated under this paragraph shall be paid on an hourly basis, consistent with the payment processes and procedures of the FMCS, for services provided under this section.</text> </clause></subparagraph>
<subparagraph id="HE0EE0833AB664D20882727A4A939F022"><enum>(B)</enum><header>Departmental employees</header><text>On request of the Special Master, the Secretary may detail employees of the Office of Civil Rights of the Department to assist persons who request assistance in submitting claims under this section.</text> </subparagraph></paragraph>
<paragraph id="HCA8910761D9D45C0954AC1C90EC04E12"><enum>(2)</enum><header>Procedure for review of claims</header> 
<subparagraph id="HD7FC16158E4E415180464D8B77F2E781"><enum>(A)</enum><header>Deadline for claims submission</header><text>An award under this section may not be made with respect to a claim submitted after the 3-year period that begins with the date of the enactment of this section.</text> </subparagraph>
<subparagraph id="H548ECA90CEAA493BB984DD0CC97E71F5"><enum>(B)</enum><header>Expeditious claims review</header><text>The Special Master shall process, review, and adjudicate claims under this section as expeditiously as possible.</text> </subparagraph>
<subparagraph id="H41EE023D9AFE497CBD579E40560356C0"><enum>(C)</enum><header>Evidentiary rules</header> 
<clause id="H0EDB6ABABC6F43B29360B3411BDABE6F"><enum>(i)</enum><header>In general</header><text>The Special Master may permit a claimant to present evidence and testimony to substantiate a claim under this section.</text> </clause>
<clause id="HAAC7F48ADBF34DA08A97D41D80BD5455"><enum>(ii)</enum><header>Inapplicability of certain rules</header><text>The Federal Rules of Civil Procedure, the Federal Rules of Evidence, section 554 of title 5, United States Code, and the legal standards and precedents otherwise required to state a legally cognizable prima facie discrimination case in the courts of the United States shall not apply to a claim under this section.</text> </clause></subparagraph>
<subparagraph id="HB54A9B221F484460A96B7F1CD2855962"><enum>(D)</enum><header>Publication of claims procedures</header><text display-inline="yes-display-inline">Within 90 days after the date of the enactment of this Act, the Special Master shall cause to have published in the Federal Register the procedures and criteria to be used in reviewing and adjudicating claims under this section.</text> </subparagraph>
<subparagraph id="HFE87D46EAB8141968975C33E8F34E0C7"><enum>(E)</enum><header>Implementation of procedures and criteria</header><text>The procedures and criteria shall be established and implemented so as to effectuate the remedial purpose of giving each claimant the opportunity to obtain full relief for past discrimination.</text> </subparagraph></paragraph></subsection>
<subsection id="H522E42F6CFCE4C1294101C64A4D85D1A"><enum>(d)</enum><header>Adjudication of claim of gender discrimination in denial, or failure To provide notice of action on, an application for a farm loan, farm loan servicing, or a disaster loan</header><text display-inline="yes-display-inline">The Special Master shall award $5,000 to an eligible claimant who has submitted a claim under this section, for each calendar year in the claims period with respect to which—</text> 
<paragraph id="HFB6ED5519A454E8DBA507710FD371402"><enum>(1)</enum><text>the claim includes an allegation that the Secretary denied a request from the claimant for an application for a farm loan, farm loan servicing, or a disaster loan, or failed to notify the claimant of any action taken by the Department on such an application submitted by the claimant, on the basis of the gender of the claimant; and</text> </paragraph>
<paragraph id="H31628407921443C58FF457F75F0CD353"><enum>(2)</enum><text>the Secretary fails to prove by a preponderance of the evidence that the allegation is false.</text> </paragraph></subsection>
<subsection id="H352275C9037848C0A7C24D57B4E9EAE1"><enum>(e)</enum><header>Adjudication of claim of gender discrimination in denial of farm loan, farm loan servicing, or disaster loan</header> 
<paragraph id="H1E328CA1221C4157B99B2C234E1A19EC"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">In addition to any amount awarded under subsection (d), the Special Master shall award an amount determined in accordance with paragraph (2) of this subsection to an eligible claimant who has submitted a claim under this section in which there is an allegation that the Secretary denied an application by the claimant for a farm loan, farm loan servicing, or a disaster loan on the basis of gender of the claimant, if the Special Master finds that the discrimination occurred.</text> </paragraph>
<paragraph id="HB5F7ABC3932D4D3F939C1ED37E519C8B"><enum>(2)</enum><header>Determination of award amount</header><text display-inline="yes-display-inline">In determining the amount to award a claimant under paragraph (1), the Special Master shall presume that the amount to be awarded is $109,000, and shall increase or decrease the amount, as appropriate, based on factors to be determined by the Special Master, including—</text> 
<subparagraph id="H5E30005F8B3540A8BEF91421EB0A6443"><enum>(A)</enum><text>the duration of ownership or operation of a farm by the claimant;</text> </subparagraph>
<subparagraph id="H0DDB7D5D991242AB9C0DACEF1498A26C"><enum>(B)</enum><text>the type of farming operation of the claimant;</text> </subparagraph>
<subparagraph id="HF8DE0469F98849C58F4600F912E62C1F"><enum>(C)</enum><text>the past production by the claimant of agricultural products;</text> </subparagraph>
<subparagraph id="HD396A6FA26794936A419B926211ECA2D"><enum>(D)</enum><text>the availability of contemporaneously created documents and witness testimony concerning the allegations of discrimination made by the claimant;</text> </subparagraph>
<subparagraph id="HF5CD1C7E81734C288BC4494322E9BFBC"><enum>(E)</enum><text>the inappropriateness of the conduct of employees of the Department with regard to the claimant; and</text> </subparagraph>
<subparagraph id="HDF34250743344204B374A66E84B81EC7"><enum>(F)</enum><text>the damages suffered by the claimant.</text> </subparagraph></paragraph></subsection>
<subsection id="H9B26C912C18146DC9FC94C4C57152EAC"><enum>(f)</enum><header>Attorney’s fees</header> 
<paragraph id="H63F4E647BB934DFFAA24F1E329153369"><enum>(1)</enum><header>Counsel for plaintiffs and class members in Love v. Vilsack</header><text>Within 120 days after the date of the enactment of this Act, counsel of record for the plaintiffs and putative class members at the time of the filing of the complaints in Love v. Vilsack, C.A. No. 1:00–CV–02502 (U.S. District Court for the District of Columbia) may present to the Special Master a petition for reasonable compensation for all services the counsel have provided to the plaintiffs and putative class members from calendar year 2000 through the date the petition is presented, which shall be determined by the Special Master in accord with the legal precedents of the United States Court of Appeals for the District of Columbia Circuit pertaining to awards of attorneys’ fees for the litigation of actions where a favorable result is obtained for the common benefit of a class.</text> </paragraph>
<paragraph id="HE977FF93F19D464186B8C66676350827"><enum>(2)</enum><header>Other counsel</header><text display-inline="yes-display-inline">The Special Master may, in accordance with procedures and guidelines established by the Special Master, award fees to counsel who represent a claimant in a proceeding under this section, not exceeding $10,000 per claimaint, for services the counsel have provided to the claimant in connection with the proceeding, regardless of whether the claimant receives an award under this section.</text> </paragraph></subsection>
<subsection id="HAB8ED38F6AB74348A38BEF48F0207119"><enum>(g)</enum><header>Finality of determinations</header><text>An adjudication of a claim under this section shall be final and not reviewable by any court.</text> </subsection>
<subsection id="H930419F0E7754D309BAFD9A9C16C2824"><enum>(h)</enum><header>Acceptance of award constitutes satisfaction of all claims of discrimination during the claims period</header><text display-inline="yes-display-inline">A claimant who accepts an award under this section may not bring or pursue an action in any Federal or State court, or an administrative proceeding, for damages based on any claim of discrimination by the Department on the basis of gender in the issuance or review of an application for a farm loan, farm loan servicing, or a disaster loan during the claims period.</text> </subsection>
<subsection id="H680B11EF26F140DDA68DD868851A0247"><enum>(i)</enum><header>Award exempt from federal taxation</header><text>An award under this section shall be exempt from taxation under the Internal Revenue Code of 1986.</text> </subsection>
<subsection id="H043C3D2B74BF4755AC8AFDC13AC6C954"><enum>(j)</enum><header>Reports to the Congress</header><text>On each anniversary of the date of the enactment of this Act, the Special Master shall submit to the Committees on Agriculture and on Appropriations of the House of Representatives and the Committees on Agriculture, Nutrition, and Forestry and on Appropriations of the Senate a report (with a copy to the Department) regarding—</text> 
<paragraph id="H0C153BD936F44A3A8AD7822017A050B1"><enum>(1)</enum><text>the number of claims made under this section;</text> </paragraph>
<paragraph id="H24F0B87533AD4CEB9133181E096EAFF0"><enum>(2)</enum><text>the number of the claims that have been adjudicated under this section; and</text> </paragraph>
<paragraph id="H4A78F491F9D6473EB9A5689472589629"><enum>(3)</enum><text>the total of the amounts awarded under this section.</text> </paragraph></subsection>
<subsection id="HD3863A618BD74605938A41F0A75C59E1"><enum>(k)</enum><header>Appropriation</header><text>Out of any funds in the Treasury of the United States not otherwise appropriated, there are appropriated $4,500,000,000, without fiscal year limitation, for payment by the Special Master to carry out this section.</text> </subsection>
<subsection id="H4352FC4FCEC24A4E92DCB6D062B3FE90"><enum>(l)</enum><header>Definitions</header><text>In this section:</text> 
<paragraph id="HF119D056C3E346638BF40E2634D3410A"><enum>(1)</enum><header>Damages</header><text display-inline="yes-display-inline">The term <term>damages</term> includes economic loss.</text> </paragraph>
<paragraph id="HC82C740C535446518E22E7D5FDCE4DBC"><enum>(2)</enum><header>Special master</header><text>The term <term>Special Master</term> means the Special Master appointed under subsection (c)(1)(A)(i).</text> </paragraph></subsection></section>
<section id="H99ABCC01CDBA465AB38B9D67D9F54C26"><enum>3.</enum><header>Remedial measures</header> 
<subsection id="H9523594B319D46EF81C03EC00C277CD4"><enum>(a)</enum><header>Limitation on foreclosures</header><text display-inline="yes-display-inline">During the 3-year period that begins with the date of the enactment of this Act, the Secretary may not initiate foreclosure on collateral or secured property, assist any creditor or any State in connection with a foreclosure on collateral or secured property, or expend any money relating to foreclosure or sale of collateral or secured property, of an eligible claimaint.</text> </subsection>
<subsection commented="no" id="H77B05E46B6184DB2955EF4751624512F"><enum>(b)</enum><header>Processing of applications for farm loan, farm loan servicing, or disaster benefit</header> 
<paragraph id="H9C3512E9D8024F5586A85154671F65A7"><enum>(1)</enum><header>Eligibility determinations</header><text display-inline="yes-display-inline">The Secretary shall approve an application for a farm loan, farm loan servicing, or a disaster benefit submitted by an eligible claimant in the 3-year period that begins with the date of the enactment of this Act, unless the Secretary establishes, by clear and convincing evidence, that the eligible claimaint does not satisfy the published, objective eligibility criteria for the farm loan, farm loan servicing, or disaster loan, as the case may be.</text> </paragraph>
<paragraph id="HF01D9F1FCFB84968BDB6656A2A7670E7"><enum>(2)</enum><header>Deadline to provide notice of reasons for denial; effect of failure comply with deadline</header><text display-inline="yes-display-inline">Within 30 days after the Secretary denies an application submitted pursuant to paragraph (1), the Secretary shall provide the applicant with the documentation on the basis of which the application was denied. If the Secretary fails to comply with the preceding sentence, the application is deemed approved.</text> </paragraph>
<paragraph commented="no" id="H91546A0B2CA54B3D9EC28388D899EAD8"><enum>(3)</enum><header>Opportunity of applicant to submit additional documentation</header><text display-inline="yes-display-inline">Within 20 days after the Secretary complies with the 1st sentence of paragraph (2), the applicant may provide the Secretary with additional information in support of the application.</text> </paragraph>
<paragraph id="HA48A2E8D121F429C8B6DD5FD3CF1E9FE"><enum>(4)</enum><header>Reconsideration of application</header><text display-inline="yes-display-inline">Within 20 days after the earlier of the date the Secretary receives the additional information, the Secretary shall reconsider the application on the basis of the additional information.</text> </paragraph>
<paragraph id="HC5B9A2E897574140A3A430BB319292BB"><enum>(5)</enum><header>Action on reconsidered application</header><text>The Secretary shall approve an application submitted pursuant to paragraph (1) with respect to which the applicant has provided additional information, unless the Secretary concludes by clear and convincing evidence that the applicant is ineligible for the farm loan, farm servicing, or disaster loan involved, based on the published, objective eligibility criteria for the farm loan, farm servicing, or disaster loan, as the case may be.</text> </paragraph>
<paragraph id="H8415DA24F720411AA77179764514522E"><enum>(6)</enum><header>Notice of denial of reconsidered application</header><text>Within 30 days after an application is denied pursuant to paragraph (5), the Secretary shall provide the applicant with written notice of the denial, including the specific reason for the denial.</text> </paragraph></subsection>
<subsection id="H200322FB977E400EBE9391C0D37907BA"><enum>(c)</enum><header>Other remedial measures</header><text>The Secretary shall—</text> 
<paragraph id="H52FFBE406DC7425B8BF691F05AE2E13E"><enum>(1)</enum><text>install and maintain recordkeeping systems that document each contact between a farmer and the Department;</text> </paragraph>
<paragraph id="HD2C585DDAC394A95AA2D1A7E0965EBFD"><enum>(2)</enum><text>establish community-based outreach programs to assist socially disadvantaged farmers in applying for farm loan and farm loan servicing programs;</text> </paragraph>
<paragraph id="HCE7175788067424ABB8B3C819255BE01"><enum>(3)</enum><text>implement an effective method to achieve transparency in the administration of the loan and loan servicing programs of the Department to facilitate evaluation of whether the fundamental reforms are expeditiously and effectively implemented; and</text> </paragraph>
<paragraph id="H13123111CC824F80972B879BCA197F04"><enum>(4)</enum><text>establish an efficient and effective system for processing discrimination complaints of socially disadvantaged farmers.</text> </paragraph></subsection>
<subsection id="HEB318B588D0743FABE91BBD5D951BBDD"><enum>(d)</enum><header>Report on implementation of remedial measures</header><text>Within 6 months after the date of the enactment of this Act, the Secretary shall submit to the Congress a report on the status of implementation of the remedial measures described in subsections (b) and (c).</text> </subsection></section>
<section commented="no" id="H07EF94FAFB164B299C5B6ACAFA41550F"><enum>4.</enum><header>GAO audit</header> 
<subsection id="H5B5BF1D1B6EF41749708FC07C307ED02"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Comptroller General shall conduct an audit of the administration of farm loan and benefit programs by the Farm Service Agency, to—</text> 
<paragraph commented="no" id="H7CAA63AB562341F4898BE3B028F541E6"><enum>(1)</enum><text>identify data that must be collected to determine whether the Department is providing equal access to all programs;</text> </paragraph>
<paragraph commented="no" id="H550D3F96141C4B4EA98BD936832179BD"><enum>(2)</enum><text>determine whether the technology used by the Department is adequate to collect and store the data, and—</text> 
<subparagraph commented="no" id="H2A1B57349D56492584C8181751ACE811"><enum>(A)</enum><text>if the technology is adequate for such purpose, shall determine the reasons why the technology is not being used properly; or</text> </subparagraph>
<subparagraph commented="no" id="HF4AE619728E84333A3977AEE98609C47"><enum>(B)</enum><text>if the technology is not adequate for such purpose, shall identify the technology necessary to adequately collect and store the data.</text> </subparagraph></paragraph></subsection>
<subsection id="HF173BF187DC6462EB00A2481769DA114"><enum>(b)</enum><header>Report to the Congress</header><text>Within 1 year after the date of the enactment of this Act, the Comptroller General shall submit to the Committees on Agriculture and on Appropriations of the House of representatives and the Committees on Agriculture, Nutrition, and Forestry, and on Appropriations of the Senate a report on the findings of the audit conducted under subsection (a).</text> </subsection></section>
<section id="H0C2388A4D05C4B49A94E7FE514272014" section-type="subsequent-section"><enum>5.</enum><header>Annual reports on denial of requests for applications for farm loans, loan servicing, or disaster benefits, or of applications therefor</header> 
<subsection id="HC1245AAF44D241CDB1C8EA7A9F87248F"><enum>(a)</enum><header>In general</header><text>Not later than March 1 of each year, the Secretary shall submit to the Congress a report which summarizes the following information on each person whose request for an application for a farm loan, farm loan servicing, or a disaster loan, or whose application for a farm loan, farm loan servicing, or a disaster loan, was denied in the 12-month period covered by the report:</text> 
<paragraph id="HBBEDC7E9825A46ACA1A627010BC81BB2"><enum>(1)</enum><text>The gender of the person.</text> </paragraph>
<paragraph id="H6CECA06367B54A1EADC4605B2E3DA9F4"><enum>(2)</enum><text>The race of the person.</text> </paragraph>
<paragraph id="H8CC35FB5418C4B00B03420F26069E365"><enum>(3)</enum><text>The national origin of the person.</text> </paragraph>
<paragraph id="H16C391AED852460B900C2784F2A3E40A"><enum>(4)</enum><text>Whether the person is an Indian or a member of an Indian tribe.</text> </paragraph>
<paragraph id="HED19E47EC90C4827A8ECFA1E3EAF62F2"><enum>(5)</enum><text>The amount of time that elapsed from the date the request or application was made to the date of the denial.</text> </paragraph>
<paragraph id="H274C6A28D5D54A93959923E21AA193AD"><enum>(6)</enum><text>The location of the office that denied the request or application.</text> </paragraph>
<paragraph id="HC196B384C9E9410B89F52BB59EC4E341"><enum>(7)</enum><text>All information taken into account in the denial.</text> </paragraph></subsection>
<subsection id="HFB0B1717667141D4AF0CC50B05C523CA"><enum>(b)</enum><header>No personally identifiable information</header><text>The report shall not contain any information that identifies any person referred to in subsection (a).</text> </subsection>
<subsection id="HEFF2B93F16AE4F219EDC5913B0633A5E"><enum>(c)</enum><header>Definitions of Indian and member of an Indian tribe</header><text display-inline="yes-display-inline">In this section, the terms <term>Indian</term> and <term>member of an Indian tribe</term> shall have the same meanings given the terms, respectively, in paragraphs (1) and (2) of section 2 of the Tribally Controlled College or University Assistance Act of 1978.</text> </subsection></section>
<section id="H23C891955F54456BA5404AB65A648EB5"><enum>6.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text> 
<paragraph id="HA9F5F26D0F964FA0AEB62E71CFEAC870"><enum>(1)</enum><header>Claims period</header><text display-inline="yes-display-inline">The term <term>claims period</term> means the period that began on January 1, 1981, and ended on the date of the enactment of this Act.</text> </paragraph>
<paragraph id="H1B5A2F4C5326466FA0F06FEDF2141EF9"><enum>(2)</enum><header>Department</header><text>The term <term>Department</term> means the Department of Agriculture.</text> </paragraph>
<paragraph id="HBAFF382EBA0041ABA7CA0FAE1133C91F"><enum>(3)</enum><header>Disaster loan</header><text>The term <term>disaster loan</term> means a loan under subtitle C of the Consolidated Farm and Rural Development Act.</text> </paragraph>
<paragraph display-inline="no-display-inline" id="HEB8A208D6A9E4196A3440C40A752C503"><enum>(4)</enum><header>Eligible claimant</header><text display-inline="yes-display-inline">The term <term>eligible claimant</term> means any person who claims that she was discriminated against, on the basis of gender, in the issuance or review of an application for a farm loan, farm loan servicing, or a disaster loan, during the claims period.</text> </paragraph>
<paragraph id="H2B91A5F08C8E4779868A69FFD8B0A78A"><enum>(5)</enum><header>Farm</header><text>The term <term>farm</term> includes a ranch.</text> </paragraph>
<paragraph display-inline="no-display-inline" id="HD60C3F759A624819964117509A966218"><enum>(6)</enum><header>Farm loan</header><text display-inline="yes-display-inline">The term <term>farm loan</term> means a loan under subtitle A or B of the Consolidated Farm and Rural Development Act.</text> </paragraph>
<paragraph id="HB88E207B55294436A6CFC28018F5EB74"><enum>(7)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of Agriculture.</text> </paragraph>
<paragraph id="HE377A0C66BB247A38193F66720CDAE27"><enum>(8)</enum><header>Socially disadvantaged farmer</header><text>The term <term>socially disadvantaged farmer</term> has the meaning given the term <term>socially disadvantaged farmer or rancher</term> in section 355(e)(2) of the Consolidated Farm and Rural Development Act.</text> </paragraph></section>
