		<official-title display="yes">To prevent and reduce the use of physical
		  restraint and seclusion in schools, and for other purposes.</official-title>

		<section commented="no" display-inline="no-display-inline" id="H62C465EE8AB74A10920DB95437358130" section-type="section-one"><enum>1.</enum><header display-inline="yes-display-inline">Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote>Keeping
			 All Students Safe Act</quote>.</text>
		</section><section commented="no" display-inline="no-display-inline" id="HA81A71D5FE934D8F9248451ED63E2550" section-type="subsequent-section"><enum>2.</enum><header display-inline="yes-display-inline">Findings</header><text display-inline="no-display-inline">Congress finds the following:</text>
			<paragraph commented="no" display-inline="no-display-inline" id="H3ABC1C9871544DE7870B7742BD5AAD7D"><enum>(1)</enum><text display-inline="yes-display-inline">Physical restraint and seclusion have
			 resulted in physical injury, psychological trauma, and death to children in
			 public and private schools. National research shows students have been
			 subjected to physical restraint and seclusion in schools as a means of
			 discipline, to force compliance, or as a substitute for appropriate educational
			 support.</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HF915AE5F79474096A4BF5BA32A801D43"><enum>(2)</enum><text display-inline="yes-display-inline">Behavioral interventions for children must
			 promote the right of all children to be treated with dignity. All children have
			 the right to be free from physical or mental abuse, aversive behavioral
			 interventions that compromise health and safety, and any physical restraint or
			 seclusion imposed solely for purposes of discipline or convenience.</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H0149A0671D6643FDAB660D70F1FCE037"><enum>(3)</enum><text display-inline="yes-display-inline">Safe, effective, evidence-based strategies
			 are available to support children who display challenging behaviors in school
			 settings. Staff training focused on the dangers of physical restraint and
			 seclusion as well as training in evidence-based positive behavior supports,
			 de-escalation techniques, and physical restraint and seclusion prevention, can
			 reduce the incidence of injury, trauma, and death.</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H3BEABBBF82AD42CCA04B8ADDFE94122A"><enum>(4)</enum><text display-inline="yes-display-inline">School personnel have the right to work in
			 a safe environment and should be provided training and support to prevent
			 injury and trauma to themselves and others.</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H6A058EDD3E0D42129C9B6CA0CDFC62B0"><enum>(5)</enum><text display-inline="yes-display-inline">Despite the widely recognized risks of
			 physical restraint and seclusion, a substantial disparity exists among many
			 States and localities with regard to the protection and oversight of the rights
			 of children and school personnel to a safe learning environment.</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H8341C3B644884108BFF89EF2987FF5AF"><enum>(6)</enum><text display-inline="yes-display-inline">Children are subjected to physical
			 restraint and seclusion at higher rates than adults. Physical restraint which
			 restricts breathing or causes other body trauma, as well as seclusion in the
			 absence of continuous face-to-face monitoring, have resulted in the deaths of
			 children in schools.</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HACB24095320E418DB07429721ED5BBD6"><enum>(7)</enum><text display-inline="yes-display-inline">Children are protected from inappropriate
			 physical restraint and seclusion in other settings, such as hospitals, health
			 facilities, and non-medical community-based facilities. Similar protections are
			 needed in schools, yet such protections must acknowledge the differences of the
			 school environment.</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HE1F0B8755D4F4C40BFEE1E95C3FD7CA1"><enum>(8)</enum><text display-inline="yes-display-inline">Research confirms that physical restraint
			 and seclusion are not therapeutic, nor are these practices effective means to
			 calm or teach children, and may have an opposite effect while simultaneously
			 decreasing a child’s ability to learn.</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HC8D1BE5BB07B4661ABB6A0639517AE87"><enum>(9)</enum><text display-inline="yes-display-inline">The effective implementation of school-wide
			 positive behavior supports is linked to greater academic achievement,
			 significantly fewer disciplinary problems, increased instruction time, and
			 staff perception of a safer teaching environment.</text>
			</paragraph></section><section commented="no" display-inline="no-display-inline" id="H15EABB26C0054D899C6D224F1D66DF3D" section-type="subsequent-section"><enum>3.</enum><header display-inline="yes-display-inline">Purposes</header><text display-inline="no-display-inline">The purposes of this Act are to—</text>
			<paragraph commented="no" display-inline="no-display-inline" id="H05EA098008E64BEC950BCF62364DF9F3"><enum>(1)</enum><text display-inline="yes-display-inline">prevent and reduce the use of physical
			 restraint and seclusion in schools;</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H2B31812BDB124A10A9A767E6E458E10F"><enum>(2)</enum><text display-inline="yes-display-inline">ensure the safety of all students and
			 school personnel in schools and promote a positive school culture and
			 climate;</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HC02419CDA4A04EA2A0074F7FFE8974A7"><enum>(3)</enum><text display-inline="yes-display-inline">protect students from—</text>
				<subparagraph commented="no" display-inline="no-display-inline" id="H773EE8E66EC94160B70EB3FE8887EAAB"><enum>(A)</enum><text display-inline="yes-display-inline">physical or mental abuse;</text>
				</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H1CCD16E7B6B34F868A2BFE21B26CB51F"><enum>(B)</enum><text display-inline="yes-display-inline">aversive behavioral interventions that
			 compromise health and safety; and</text>
				</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H20C0B75770D14FF4AA307D377251EA22"><enum>(C)</enum><text display-inline="yes-display-inline">any physical restraint or seclusion imposed
			 solely for purposes of discipline or convenience;</text>
				</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H3C9429B300F04B7B9CC6F08925D2AB95"><enum>(4)</enum><text display-inline="yes-display-inline">ensure that physical restraint and
			 seclusion are imposed in school only when a student’s behavior poses an
			 imminent danger of physical injury to the student, school personnel, or others;
			 and</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H606DA48695E54C898936516EEA5332D7"><enum>(5)</enum><text display-inline="yes-display-inline">assist States, local educational agencies,
			 and schools in—</text>
				<subparagraph commented="no" display-inline="no-display-inline" id="H3EA78A1331894045B0C5EEA23F5D8F8B"><enum>(A)</enum><text display-inline="yes-display-inline">establishing policies and procedures to
			 keep all students, including students with the most complex and intensive
			 behavioral needs, and school personnel safe;</text>
				</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H8C72E124F9FD4768AC9308D6004A9417"><enum>(B)</enum><text display-inline="yes-display-inline">providing school personnel with the
			 necessary tools, training, and support to ensure the safety of all students and
			 school personnel;</text>
				</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HC766717C51C54941BA52E1BB365D7168"><enum>(C)</enum><text display-inline="yes-display-inline">collecting and analyzing data on physical
			 restraint and seclusion in schools; and</text>
				</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HC142EB30F8594F19A66333CC935EBAFF"><enum>(D)</enum><text display-inline="yes-display-inline">identifying and implementing effective
			 evidence-based models to prevent and reduce physical restraint and seclusion in
			 schools.</text>
				</subparagraph></paragraph></section><section commented="no" display-inline="no-display-inline" id="HA9DA212A61A940C6B80C2C6A58FBD9D5" section-type="subsequent-section"><enum>4.</enum><header display-inline="yes-display-inline">Definitions</header><text display-inline="no-display-inline">In this Act:</text>
			<paragraph commented="no" display-inline="no-display-inline" id="HA4AC60D9E9E642C683192B845F3057E7"><enum>(1)</enum><header display-inline="yes-display-inline">Chemical restraint</header><text display-inline="yes-display-inline">The term <term>chemical restraint</term>
			 means a drug or medication used on a student to control behavior or restrict
			 freedom of movement that is not—</text>
				<subparagraph commented="no" display-inline="no-display-inline" id="HBBF38ED117FB4F0D820F015F1018EBA6"><enum>(A)</enum><text display-inline="yes-display-inline">prescribed by a licensed physician, or
			 other qualified health professional acting under the scope of the
			 professional’s authority under State law, for the standard treatment of a
			 student’s medical or psychiatric condition; and</text>
				</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HE05AC78B8460490287C01DDAD72F6112"><enum>(B)</enum><text display-inline="yes-display-inline">administered as prescribed by the licensed
			 physician or other qualified health professional acting under the scope of the
			 professional’s authority under State law.</text>
				</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H4F81834FBDF9425F83795FA486B29618"><enum>(2)</enum><header display-inline="yes-display-inline">Educational service agency</header><text display-inline="yes-display-inline">The term <term>educational service
			 agency</term> has the meaning given such term in section 9101(17) of the
			 Elementary and Secondary Education Act of 1965 (20 U.S.C. 7801(17)).</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H157916496CCF4BBAAD85FD9B3AB6CF5C"><enum>(3)</enum><header display-inline="yes-display-inline">Elementary school</header><text display-inline="yes-display-inline">The term <term>elementary school</term> has
			 the meaning given the term in section 9101(18) of the Elementary and Secondary
			 Education Act of 1965 (20 U.S.C. 7801(18)).</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H5FAAF30F532F4E048BA4B7DBE2589312"><enum>(4)</enum><header display-inline="yes-display-inline">Local educational agency</header><text display-inline="yes-display-inline">The term <term>local educational
			 agency</term> has the meaning given the term in section 9101(26) of the
			 Elementary and Secondary Education Act of 1965 (20 U.S.C. 7801(26)).</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H017ED11D7B004B76908869A2E4F7A208"><enum>(5)</enum><header display-inline="yes-display-inline">Mechanical restraint</header><text display-inline="yes-display-inline">The term <term>mechanical restraint</term>
			 has the meaning given the term in section 595(d)(1) of the Public Health
			 Service Act (42 U.S.C. 290jj(d)(1)), except that the meaning shall be applied
			 by substituting <quote>student’s</quote> for <quote>resident’s</quote>.</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HDC743487D2354E42AD3C6499CFEA0115"><enum>(6)</enum><header display-inline="yes-display-inline">Parent</header><text display-inline="yes-display-inline">The term <term>parent</term> has the
			 meaning given the term in section 9101(31) of the Elementary and Secondary
			 Education Act of 1965 (20 U.S.C. 7801(31)).</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H26E38745BFC14129AA5B2DAB82738FAC"><enum>(7)</enum><header display-inline="yes-display-inline">Physical escort</header><text display-inline="yes-display-inline">The term <term>physical escort</term> has
			 the meaning given the term in section 595(d)(2) of the Public Health Service
			 Act (42 U.S.C. 290jj(d)(2)), except that the meaning shall be applied by
			 substituting <quote>student</quote> for <quote>resident</quote>.</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H574A3E1FBB3748429B6B483F60830117"><enum>(8)</enum><header display-inline="yes-display-inline">Physical restraint</header><text display-inline="yes-display-inline">The term <term>physical restraint</term>
			 has the meaning given the term in section 595(d)(3) of the Public Health
			 Service Act (42 U.S.C. 290jj(d)(3)).</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HFA59C21768824DBE957E77AB2CC4A4B7"><enum>(9)</enum><header display-inline="yes-display-inline">Positive behavior supports</header><text display-inline="yes-display-inline">The term <term>positive behavior
			 supports</term> means a systematic approach to embed evidence-based practices
			 and data-driven decisionmaking to improve school climate and culture, including
			 a range of systemic and individualized strategies to reinforce desired
			 behaviors and diminish reoccurrence of problem behaviors, in order to achieve
			 improved academic and social outcomes and increase learning for all students,
			 including those with the most complex and intensive behavioral needs.</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HAF86609FF00E4295AB882AEFF03E7B48"><enum>(10)</enum><header display-inline="yes-display-inline">Protection and advocacy
			 system</header><text display-inline="yes-display-inline">The term
			 <term>protection and advocacy system</term> means a protection and advocacy
			 system established under section 143 of the Developmental Disabilities
			 Assistance and Bill of Rights Act of 2000 (42 U.S.C. 15043).</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H01BA237C06D947BEB94138E40D8851A6"><enum>(11)</enum><header display-inline="yes-display-inline">School</header><text display-inline="yes-display-inline">The term <term>school</term> means an
			 entity—</text>
				<subparagraph commented="no" display-inline="no-display-inline" id="H42D4656E0C6044FA83695F360C9D45B5"><enum>(A)</enum><text display-inline="yes-display-inline">that—</text>
					<clause commented="no" display-inline="no-display-inline" id="H9A234A35A55D4CE88AA483654E70998A"><enum>(i)</enum><text display-inline="yes-display-inline">is a public or private—</text>
						<subclause commented="no" display-inline="no-display-inline" id="H68B5B43000BF4633996F80E55CE59427"><enum>(I)</enum><text display-inline="yes-display-inline">day or residential elementary school or
			 secondary school; or</text>
						</subclause><subclause commented="no" display-inline="no-display-inline" id="HC005C70F6C87493BBA7E4449E4D53180"><enum>(II)</enum><text display-inline="yes-display-inline">early childhood, elementary school, or
			 secondary school program that is under the jurisdiction of a school, local
			 educational agency, educational service agency, or other educational
			 institution or program; and</text>
						</subclause></clause><clause commented="no" display-inline="no-display-inline" id="H4C4D0F6B42F24A14BB8AA9469FF38024"><enum>(ii)</enum><text display-inline="yes-display-inline">receives, or serves students who receive,
			 support in any form from any program supported, in whole or in part, with funds
			 appropriated to the Department of Education; or</text>
					</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HC4370DCEBD57402BAA4DFC2A6ADAF154"><enum>(B)</enum><text display-inline="yes-display-inline">that is a school funded or operated by the
			 Department of the Interior.</text>
				</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H5FAE5A653D894A7EAF4BF552D4F48774"><enum>(12)</enum><header display-inline="yes-display-inline">School personnel</header><text display-inline="yes-display-inline">The term <term>school personnel</term> has
			 the meaning—</text>
				<subparagraph commented="no" display-inline="no-display-inline" id="H07710633DB2E470B8416F1DA786D23E1"><enum>(A)</enum><text display-inline="yes-display-inline">given the term in section 4151(10) of the
			 Elementary and Secondary Education Act of 1965 (20 U.S.C. 7161(10)); and</text>
				</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H64622F04B17E4F1EBEDE06D5570206A6"><enum>(B)</enum><text display-inline="yes-display-inline">given the term <term>school resource
			 officer</term> in section 4151(11) of the Elementary and Secondary Education
			 Act of 1965 (20 U.S.C. 7161(11)).</text>
				</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HE18FEC80185B4540A931BC04B0C6398A"><enum>(13)</enum><header display-inline="yes-display-inline">Secondary School</header><text display-inline="yes-display-inline">The term <quote>secondary school</quote>
			 has the meaning given the term in section 9101(38) of the Elementary and
			 Secondary Education Act of 1965 (20 U.S.C. 7801(38)).</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H257E01DDFAB84EBD9B90310FB0B3F46F"><enum>(14)</enum><header display-inline="yes-display-inline">Seclusion</header><text display-inline="yes-display-inline">The term <term>seclusion</term> has the
			 meaning given the term in section 595(d)(4) of the Public Health Service Act
			 (42 U.S.C. 290jj(d)(4)).</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H2CC962C0C4DC4D01BA7E3269E3667FF2"><enum>(15)</enum><header display-inline="yes-display-inline">Secretary</header><text display-inline="yes-display-inline">The term <term>Secretary</term> means the
			 Secretary of Education.</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HA28CFDB4EAC44393B744AE276BF2224D"><enum>(16)</enum><header display-inline="yes-display-inline">State-approved crisis intervention training
			 program</header><text display-inline="yes-display-inline">The term
			 <term>State-approved crisis intervention training program</term> means a
			 training program approved by a State and the Secretary that, at a minimum,
			 provides—</text>
				<subparagraph commented="no" display-inline="no-display-inline" id="H08C37CEA328A4032AB2D59AF0257ADDF"><enum>(A)</enum><text display-inline="yes-display-inline">training in evidence-based techniques shown
			 to be effective in the prevention of physical restraint and seclusion;</text>
				</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H20C837D4D459429CB39B611063FEA065"><enum>(B)</enum><text display-inline="yes-display-inline">training in evidence-based techniques shown
			 to be effective in keeping both school personnel and students safe when
			 imposing physical restraint or seclusion;</text>
				</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H36E1CF83B07F4E74A62B8A011DE1EA39"><enum>(C)</enum><text display-inline="yes-display-inline">evidence-based skills training related to
			 positive behavior supports, safe physical escort, conflict prevention,
			 understanding antecedents, de-escalation, and conflict management;</text>
				</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HC55E2043BCAE448EADC5AB3D55F43165"><enum>(D)</enum><text display-inline="yes-display-inline">training in first aid and cardiopulmonary
			 resuscitation;</text>
				</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H0633396DE88B4BB2BE288528DFC64159"><enum>(E)</enum><text display-inline="yes-display-inline">information describing State policies and
			 procedures that meet the minimum standards established by regulations
			 promulgated pursuant to
			 <internal-xref idref="H0A9B0F1C3523409B9234F4FC03235527" legis-path="5.(a)">section 5(a)</internal-xref>; and</text>
				</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HEA8398A4065647B496910F7CB4C64A1E"><enum>(F)</enum><text display-inline="yes-display-inline">certification for school personnel in the
			 techniques and skills described in subparagraphs (A) through (D), which shall
			 be required to be renewed on a periodic basis.</text>
				</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H84C009C0503C42D8B0D915CED1DA6D26"><enum>(17)</enum><header display-inline="yes-display-inline">State</header><text display-inline="yes-display-inline">The term <term>State</term> has the meaning
			 given the term in section 9101 of the Elementary and Secondary Education Act of
			 1965 (20 U.S.C. 7801).</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H146B47EB00454B7585326AFEF71D389F"><enum>(18)</enum><header display-inline="yes-display-inline">State educational agency</header><text display-inline="yes-display-inline">The term <term>State educational
			 agency</term> has the meaning given the term in section 9101(41) of the
			 Elementary and Secondary Education Act of 1965 (20 U.S.C. 7801(41)).</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HA4105032480643FCADE1EBB51CB92773"><enum>(19)</enum><header display-inline="yes-display-inline">Student</header><text display-inline="yes-display-inline">The term <term>student</term> means a
			 student enrolled in a school defined in
			 <internal-xref idref="HFDD86421764847B890B893C9A5A80DD6" legis-path="">section
			 11</internal-xref>, except that in the case of a private school or private
			 program, such term means a student enrolled in such school or program who
			 receives support in any form from any program supported, in whole or in part,
			 with funds appropriated to the Department of Education.</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H4D44B214F40E4DA1B894584B05B66A25"><enum>(20)</enum><header display-inline="yes-display-inline">Time out</header><text display-inline="yes-display-inline">The term <term>time out</term> has the
			 meaning given the term in section 595(d)(5) of the Public Health Service Act
			 (42 U.S.C. 290jj(d)(5)), except that the meaning shall be applied by
			 substituting <quote>student</quote> for <quote>resident</quote>.</text>
			</paragraph></section><section commented="no" display-inline="no-display-inline" id="H12816668CE6B4C59824B2CE05C1D62CF" section-type="subsequent-section"><enum>5.</enum><header display-inline="yes-display-inline">Minimum Standards; Rule of
			 construction</header>
			<subsection commented="no" display-inline="no-display-inline" id="H0A9B0F1C3523409B9234F4FC03235527"><enum>(a)</enum><header display-inline="yes-display-inline">Minimum standards</header><text display-inline="yes-display-inline">Not later than 180 days after the date of
			 the enactment of this Act, in order to protect each student from physical or
			 mental abuse, aversive behavioral interventions that compromise student health
			 and safety, or any physical restraint or seclusion imposed solely for purposes
			 of discipline or convenience or in a manner otherwise inconsistent with this
			 Act, the Secretary shall promulgate regulations establishing the following
			 minimum standards:</text>
				<paragraph commented="no" display-inline="no-display-inline" id="HC5C12092095C4E51B4BD3EBC1EBB2321"><enum>(1)</enum><text display-inline="yes-display-inline">School personnel shall be prohibited from
			 imposing on any student the following:</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="HA5DFDCB8BC1C437693B2B2F0687D6345"><enum>(A)</enum><text display-inline="yes-display-inline">Mechanical restraints.</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HDF3795629179444AA352D77782D1E436"><enum>(B)</enum><text display-inline="yes-display-inline">Chemical restraints.</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HCB42C0BFFF184ECBA42FB1B7C7B84F45"><enum>(C)</enum><text display-inline="yes-display-inline">Physical restraint or physical escort that
			 restricts breathing.</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HC7608B7BA3E0473CBA2BEF5591D8288E"><enum>(D)</enum><text display-inline="yes-display-inline">Aversive behavioral interventions that
			 compromise health and safety.</text>
					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H4728BDC0E64A4C90AEB4950F63751645"><enum>(2)</enum><text display-inline="yes-display-inline">School personnel shall be prohibited from
			 imposing physical restraint or seclusion on a student unless—</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="HA110E8E160874D18B53E7D9A0D01BA5A"><enum>(A)</enum><text display-inline="yes-display-inline">the student’s behavior poses an imminent
			 danger of physical injury to the student, school personnel, or others;</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HC2248CC382DB4EB984A8F0C8654AD3D0"><enum>(B)</enum><text display-inline="yes-display-inline">less restrictive interventions would be
			 ineffective in stopping such imminent danger of physical injury;</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HB446B5E2ABB54A1B9DBD615D383CBF9D"><enum>(C)</enum><text display-inline="yes-display-inline">such physical restraint or seclusion is
			 imposed by school personnel who—</text>
						<clause commented="no" display-inline="no-display-inline" id="H9B350FF3771F4D8ABEF20F84C50FD563"><enum>(i)</enum><text display-inline="yes-display-inline">continuously monitor the student
			 face-to-face; or</text>
						</clause><clause commented="no" display-inline="no-display-inline" id="H46BDDC82ADFD41FD96E9DB8EA7604FFF"><enum>(ii)</enum><text display-inline="yes-display-inline">if school personnel safety is significantly
			 compromised by such face-to-face monitoring, are in continuous direct visual
			 contact with the student;</text>
						</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H3A627370F1844E50B4A14A2930C009E5"><enum>(D)</enum><text display-inline="yes-display-inline">such physical restraint or seclusion is
			 imposed by—</text>
						<clause commented="no" display-inline="no-display-inline" id="HACF23BE42A0C4B1AAF9A0FD16A3B15A9"><enum>(i)</enum><text display-inline="yes-display-inline">school personnel trained and certified by a
			 State-approved crisis intervention training program (as defined in section
			 4(16)); or</text>
						</clause><clause commented="no" display-inline="no-display-inline" id="H54FCFB0FB24744BE87B5E7C6C6F5C0B9"><enum>(ii)</enum><text display-inline="yes-display-inline">other school personnel in the case of a
			 rare and clearly unavoidable emergency circumstance when school personnel
			 trained and certified as described in clause (i) are not immediately available
			 due to the unforeseeable nature of the emergency circumstance; and</text>
						</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HC132C135674349A982609FB9905AFB39"><enum>(E)</enum><text display-inline="yes-display-inline">such physical restraint or seclusion end
			 immediately upon the cessation of the conditions described in subparagraphs (A)
			 and (B).</text>
					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H2FD055822014478085EBE429F1575E13"><enum>(3)</enum><text display-inline="yes-display-inline">States, in consultation with local
			 educational agencies and private school officials, shall ensure that a
			 sufficient number of personnel are trained and certified by a State-approved
			 crisis intervention training program (as defined in section 4(16)) to meet the
			 needs of the specific student population in each school.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HA511EF8F561448EA9D9C5F8A5DB0FDBA"><enum>(4)</enum><text display-inline="yes-display-inline">The use of physical restraint or seclusion
			 as a planned intervention shall not be written into a student’s education plan,
			 individual safety plan, behavioral plan, or individualized education program
			 (as defined in section 602 of the Individuals with Disabilities Education Act
			 (20 U.S.C. 1401)). Local educational agencies or schools may establish policies
			 and procedures for use of physical restraint or seclusion in school safety or
			 crisis plans, provided that such school plans are not specific to any
			 individual student.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H53A589F01CFA461EB9D7C05C639659DE"><enum>(5)</enum><text display-inline="yes-display-inline">Schools shall establish procedures to be
			 followed after each incident involving the imposition of physical restraint or
			 seclusion upon a student, including—</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="H763F396660D8403191DE29A88A9C7D97"><enum>(A)</enum><text display-inline="yes-display-inline">procedures to provide to the parent of the
			 student, with respect to each such incident—</text>
						<clause commented="no" display-inline="no-display-inline" id="H4C3B834298164AF59F009CF325E80F7E"><enum>(i)</enum><text display-inline="yes-display-inline">an immediate verbal or electronic
			 communication on the same day as each such incident; and</text>
						</clause><clause commented="no" display-inline="no-display-inline" id="H085C9C6D9B414FBA8B91CEC05383CCF0"><enum>(ii)</enum><text display-inline="yes-display-inline">within 24 hours of each such incident,
			 written notification; and</text>
						</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H3EE0024CFAFA4B9D9885186B96E2B3C5"><enum>(B)</enum><text display-inline="yes-display-inline">any other procedures the Secretary
			 determines appropriate.</text>
					</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H75792691C1854916B3F14040CFAB433E"><enum>(b)</enum><header display-inline="yes-display-inline">Secretary of the Interior</header><text display-inline="yes-display-inline">The Secretary of the Interior shall ensure
			 that schools operated or funded by the Department of the Interior comply with
			 the regulations promulgated by the Secretary under
			 <internal-xref idref="H0A9B0F1C3523409B9234F4FC03235527" legis-path="5.(a)">subsection (a)</internal-xref>.</text>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="H606495000F3D47048FC1B8B648766262"><enum>(c)</enum><header display-inline="yes-display-inline">Rule of construction</header><text display-inline="yes-display-inline">Nothing in this section shall be construed
			 to authorize the Secretary to promulgate regulations prohibiting the use
			 of—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="H498C94653B9948C697BFDCBBFA8BEC9F"><enum>(1)</enum><text display-inline="yes-display-inline">time out (as defined in section 4(20));
			 or</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H353483BF9F5B4AD4B3DA6B395960D322"><enum>(2)</enum><text display-inline="yes-display-inline">devices implemented by trained school
			 personnel, or utilized by a student, for the specific and approved therapeutic
			 or safety purposes for which such devices were designed and, if applicable,
			 prescribed, including—</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="HCC50520C2F944B489F8456D2FE3C5558"><enum>(A)</enum><text display-inline="yes-display-inline">restraints for medical
			 immobilization;</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HA9B431C6D53F4F58B096F4323EB4CADE"><enum>(B)</enum><text display-inline="yes-display-inline">adaptive devices or mechanical supports
			 used to achieve proper body position, balance, or alignment to allow greater
			 freedom of mobility than would be possible without the use of such devices or
			 mechanical supports; or</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HFB7DB10B3220450D8B22E06A6F772D1A"><enum>(C)</enum><text display-inline="yes-display-inline">vehicle safety restraints when used as
			 intended during the transport of a student in a moving vehicle; or</text>
					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HDD6AA238B1CB4E08B61AC61951971B36"><enum>(3)</enum><text display-inline="yes-display-inline">handcuffs by school resource officers (as
			 such term is defined in section 4151(11) of the Elementary and Secondary
			 Education Act of 1965 (20 U.S.C. 7161(11)))—</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="H9DA3E680ACCC4540B85AB40351041350"><enum>(A)</enum><text display-inline="yes-display-inline">in the—</text>
						<clause commented="no" display-inline="no-display-inline" id="HC046515A0CD946A889D64B24542D9AA4"><enum>(i)</enum><text display-inline="yes-display-inline">case when a student’s behavior poses an
			 imminent danger of physical injury to the student, school personnel, or others;
			 or</text>
						</clause><clause commented="no" display-inline="no-display-inline" id="HDBFB98E1EA5E4C45BCDDC8F6EC9A57E6"><enum>(ii)</enum><text display-inline="yes-display-inline">lawful exercise of law enforcement duties;
			 and</text>
						</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HF903F0F84E804AFEAEC56C3A1A207EBA"><enum>(B)</enum><text display-inline="yes-display-inline">less restrictive interventions would be
			 ineffective.</text>
					</subparagraph></paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="H24C5457DF60A454BBA03829C6A243B7D" section-type="subsequent-section"><enum>6.</enum><header display-inline="yes-display-inline">State Plan and Report Requirements and
			 Enforcement</header>
			<subsection commented="no" display-inline="no-display-inline" id="HE5D0FD42E7B84D049F2741F07C411CDE"><enum>(a)</enum><header display-inline="yes-display-inline">State plan</header><text display-inline="yes-display-inline">Not later than 2 years after the Secretary
			 promulgates regulations pursuant to section 5(a), and each year thereafter,
			 each State educational agency shall submit to the Secretary a State plan that
			 provides—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="HBDA7F659EEE743078EB65FFBB4A3DAF2"><enum>(1)</enum><text display-inline="yes-display-inline">assurances to the Secretary that the State
			 has in effect—</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="H1433CC591AE440E2A6850CD53B1A22C7"><enum>(A)</enum><text display-inline="yes-display-inline">State policies and procedures that meet the
			 minimum standards, including the standards with respect to State-approved
			 crisis intervention training programs, established by regulations promulgated
			 pursuant to
			 <internal-xref idref="H0A9B0F1C3523409B9234F4FC03235527" legis-path="5.(a)">section 5(a)</internal-xref>; and</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H7C8603B2FFC246D082C2FEBED5FE1755"><enum>(B)</enum><text display-inline="yes-display-inline">a State mechanism to effectively monitor
			 and enforce the minimum standards;</text>
					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H11D4FED666824711A074B0990567E28E"><enum>(2)</enum><text display-inline="yes-display-inline">a description of the State policies and
			 procedures, including a description of the State-approved crisis intervention
			 training programs in such State; and</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HA91D0661612F452288A23CE21489BD26"><enum>(3)</enum><text display-inline="yes-display-inline">a description of the State plans to ensure
			 school personnel and parents, including private school personnel and parents,
			 are aware of the State policies and procedures.</text>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="HD2AC914E22B8472985E9BC841E1C13E0"><enum>(b)</enum><header display-inline="yes-display-inline">Reporting</header>
				<paragraph commented="no" display-inline="no-display-inline" id="H969C104C69FE43FAB59B4F17DE64ABBB"><enum>(1)</enum><header display-inline="yes-display-inline">Reporting requirements</header><text display-inline="yes-display-inline">Not later than 2 years after the date the
			 Secretary promulgates regulations pursuant to section 5(a), and each year
			 thereafter, each State educational agency shall (in compliance with the
			 requirements of section 444 of the General Education Provisions Act (commonly
			 known as the <quote>Family Educational Rights and Privacy Act of 1974</quote>)
			 (20 U.S.C. 1232g)) prepare and submit to the Secretary, and make available to
			 the public, a report with respect to each local educational agency, and each
			 school not under the jurisdiction of a local educational agency, located in the
			 same State as such State educational agency that includes the information
			 described in paragraph (2).</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H69A589DB17794A75A1511AC9C274DC3C"><enum>(2)</enum><header display-inline="yes-display-inline">Information requirements</header>
					<subparagraph commented="no" display-inline="no-display-inline" id="HF385B96760574A2C9DC81C865D07CC3B"><enum>(A)</enum><header display-inline="yes-display-inline">General Information
			 Requirements</header><text display-inline="yes-display-inline">The report
			 described in paragraph (1) shall include information on—</text>
						<clause commented="no" display-inline="no-display-inline" id="H4B9744B33F8B4315A4F10E76BF91AE72"><enum>(i)</enum><text display-inline="yes-display-inline">the total number of incidents in the
			 preceding full-academic year in which physical restraint was imposed upon a
			 student; and</text>
						</clause><clause commented="no" display-inline="no-display-inline" id="H7D735E4B86A4494785E7096331B34B12"><enum>(ii)</enum><text display-inline="yes-display-inline">the total number of incidents in the
			 preceding full-academic year in which seclusion was imposed upon a
			 student.</text>
						</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H98BC8655DF4347D8BB7751F0DE75A958"><enum>(B)</enum><header display-inline="yes-display-inline">Disaggregation</header>
						<clause commented="no" display-inline="no-display-inline" id="H8206F8E55E4A472D834EF9C7ADB84C60"><enum>(i)</enum><header display-inline="yes-display-inline">General Disaggregation
			 Requirements</header><text display-inline="yes-display-inline">The information
			 described in subparagraph (A) shall be disaggregated by—</text>
							<subclause commented="no" display-inline="no-display-inline" id="HEC1C7955957046A587A2EB3BFEB675F9"><enum>(I)</enum><text display-inline="yes-display-inline">the total number of incidents in which
			 physical restraint or seclusion was imposed upon a student—</text>
								<item commented="no" display-inline="no-display-inline" id="H1769D42C4EB84E69A63B4D05CD148059"><enum>(aa)</enum><text display-inline="yes-display-inline">that resulted in injury;</text>
								</item><item commented="no" display-inline="no-display-inline" id="H96C7659222E9464C99F9AE84E5142AC4"><enum>(bb)</enum><text display-inline="yes-display-inline">that resulted in death; and</text>
								</item><item commented="no" display-inline="no-display-inline" id="H8BBF74C116624AFEAA7A2F6BBEA3B882"><enum>(cc)</enum><text display-inline="yes-display-inline">in which the school personnel imposing
			 physical restraint or seclusion were not trained and certified as described in
			 section 5(a)(2)(D)(i); and</text>
								</item></subclause><subclause commented="no" display-inline="no-display-inline" id="H212FBCC5662548C7B2CC42A42F02F87C"><enum>(II)</enum><text display-inline="yes-display-inline">the demographic characteristics of all
			 students upon whom physical restraint or seclusion was imposed,
			 including—</text>
								<item commented="no" display-inline="no-display-inline" id="H03CB7CA57A4E429D9B2C04FF27EE997E"><enum>(aa)</enum><text display-inline="yes-display-inline">the categories identified in section
			 1111(h)(1)(C)(i) of the Elementary and Secondary Education Act of 1965 (20
			 U.S.C. 6311(h)(1)(C)(i));</text>
								</item><item commented="no" display-inline="no-display-inline" id="H0EF2C911B8D041DFAFEBB62E71B5F44F"><enum>(bb)</enum><text display-inline="yes-display-inline">age; and</text>
								</item><item commented="no" display-inline="no-display-inline" id="H70E7CF8835444B74B7047BD3CDF0AA87"><enum>(cc)</enum><text display-inline="yes-display-inline">disability status (which has the meaning
			 given the term <term>individual with a disability</term> in section 7(20) of
			 the Rehabilitation Act of 1973 (29 U.S.C. 705(20))).</text>
								</item></subclause></clause><clause commented="no" display-inline="no-display-inline" id="HD49A83546F9C4565B1BD082A57E1E3E3"><enum>(ii)</enum><header display-inline="yes-display-inline">Unduplicated count; Exception</header><text display-inline="yes-display-inline">The disaggregation required under clause
			 (i) shall—</text>
							<subclause commented="no" display-inline="no-display-inline" id="H831FD17E57754765B92ABB87371B22CD"><enum>(I)</enum><text display-inline="yes-display-inline">be carried out in a manner to ensure an
			 unduplicated count of the—</text>
								<item commented="no" display-inline="no-display-inline" id="HC706591E724740E8863EDA7DB1BD0756"><enum>(aa)</enum><text display-inline="yes-display-inline">total number of incidents in the preceding
			 full-academic year in which physical restraint was imposed upon a student;
			 and</text>
								</item><item commented="no" display-inline="no-display-inline" id="HE00D4CE3C1084A37B563A01C93A29F50"><enum>(bb)</enum><text display-inline="yes-display-inline">total number of incidents in the preceding
			 full-academic year in which seclusion was imposed upon a student; and</text>
								</item></subclause><subclause commented="no" display-inline="no-display-inline" id="H04FE3871ECF2444FA4B66FFF5C998085"><enum>(II)</enum><text display-inline="yes-display-inline">not be required in a case in which the
			 number of students in a category would reveal personally identifiable
			 information about an individual student.</text>
							</subclause></clause></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H300640C936DB48A5A02D38D583A0ECAB"><enum>(c)</enum><header display-inline="yes-display-inline">Enforcement</header>
				<paragraph commented="no" display-inline="no-display-inline" id="H1EDC9DD13017431997F3D45A7915E6E0"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header>
					<subparagraph commented="no" display-inline="no-display-inline" id="H2F7B08BB07514192A7A731566BF0F791"><enum>(A)</enum><header display-inline="yes-display-inline">Use of remedies</header><text display-inline="yes-display-inline">If a State educational agency fails to
			 comply with
			 <internal-xref idref="HE5D0FD42E7B84D049F2741F07C411CDE" legis-path="102.(a)">subsection (a)</internal-xref> or (b), the Secretary
			 shall—</text>
						<clause commented="no" display-inline="no-display-inline" id="H2749236320B54628866EF3DAC1DC8FBE"><enum>(i)</enum><text display-inline="yes-display-inline">withhold, in whole or in part, further
			 payments under an applicable program (as such term is defined in section 400(c)
			 of the General Education Provisions Act (20 U.S.C. 1221)) in accordance with
			 section 455 of such Act (20 U.S.C. 1234d);</text>
						</clause><clause commented="no" display-inline="no-display-inline" id="H23B9B375923D493C84E0312E156C5EB8"><enum>(ii)</enum><text display-inline="yes-display-inline">require a State educational agency to
			 submit, and implement, within 1 year of such failure to comply, a corrective
			 plan of action, which may include redirection of funds received under an
			 applicable program; or</text>
						</clause><clause commented="no" display-inline="no-display-inline" id="H8CBB8A3A9C2B4B5F9EF811130EBDD197"><enum>(iii)</enum><text display-inline="yes-display-inline">issue a complaint to compel compliance of
			 the State educational agency through a cease and desist order, in the same
			 manner the Secretary is authorized to take such action under section 456 of the
			 General Education Provisions Act (20 U.S.C. 1234e).</text>
						</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HF5B368F475DE420CA026F53336EA7CE2"><enum>(B)</enum><header display-inline="yes-display-inline">Cessation of Withholding of
			 Funds</header><text display-inline="yes-display-inline">Whenever the Secretary
			 determines (whether by certification or other appropriate evidence) that a
			 State educational agency who is subject to the withholding of payments under
			 subparagraph (A)(i) has cured the failure providing the basis for the
			 withholding of payments, the Secretary shall cease the withholding of payments
			 with respect to the State educational agency under such subparagraph.</text>
					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HF84FF30694A44502953B03E96E7D9FDD"><enum>(2)</enum><header display-inline="yes-display-inline">Rule of construction</header><text display-inline="yes-display-inline">Nothing in this subsection shall be
			 construed to limit the Secretary’s authority under the General Education
			 Provisions Act (20 U.S.C. 1221 et seq.).</text>
				</paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="HCF8E019378D1469CA20DED3A6BECE0D9" section-type="subsequent-section"><enum>7.</enum><header display-inline="yes-display-inline">Grant authority</header>
			<subsection commented="no" display-inline="no-display-inline" id="H179142CEE5D54003938D0BC60C5C2230"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">From the amount appropriated under
			 <internal-xref idref="H6A9449567EBA4CC6A3F9F1316D87D2E3" legis-path="107.">section 12</internal-xref>, the Secretary may award grants to
			 State educational agencies to assist the agencies in—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="H4BC1C88AF105427981DB6893C53A79AE"><enum>(1)</enum><text display-inline="yes-display-inline">establishing, implementing, and enforcing
			 the policies and procedures to meet the minimum standards established by
			 regulations promulgated by the Secretary pursuant to
			 <internal-xref idref="HA9DA212A61A940C6B80C2C6A58FBD9D5" legis-path="4.">section 5(a)</internal-xref>;</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H379FE76C1AEA47B18D33DB5FD537E4A3"><enum>(2)</enum><text display-inline="yes-display-inline">improving State and local capacity to
			 collect and analyze data related to physical restraint and seclusion;
			 and</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H07E8BC3F369A4B38B71820B653859783"><enum>(3)</enum><text display-inline="yes-display-inline">improving school climate and culture by
			 implementing school-wide positive behavior support approaches.</text>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="HEFFD7EAB595F48F0989E31DCE31D58D4"><enum>(b)</enum><header display-inline="yes-display-inline">Duration of grant</header><text display-inline="yes-display-inline">A grant under this section shall be awarded
			 to a State educational agency for a 3-year period.</text>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="H9DEE0935D62E4CF4BA771D53FA3592DE"><enum>(c)</enum><header display-inline="yes-display-inline">Application</header><text display-inline="yes-display-inline">Each State educational agency desiring a
			 grant under this section shall submit an application to the Secretary at such
			 time, in such manner, and accompanied by such information as the Secretary may
			 require, including information on how the State educational agency will target
			 resources to schools and local educational agencies in need of assistance
			 related to preventing and reducing physical restraint and seclusion.</text>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="H554B2F234DAC4F0B95DE39A395978D02"><enum>(d)</enum><header display-inline="yes-display-inline">Authority to make subgrants</header>
				<paragraph commented="no" display-inline="no-display-inline" id="H20A9E83C25024E8DA28148BB2DB218D6"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">A State educational agency receiving a
			 grant under this section may use such grant funds to award subgrants, on a
			 competitive basis, to local educational agencies.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HAFAC6615434B404EBA432DF90E23DD07"><enum>(2)</enum><header display-inline="yes-display-inline">Application</header><text display-inline="yes-display-inline">A local educational agency desiring to
			 receive a subgrant under this section shall submit an application to the
			 applicable State educational agency at such time, in such manner, and
			 containing such information as the State educational agency may require.</text>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H983C8C8693CA40EBB61AC07F37D313DB"><enum>(e)</enum><header display-inline="yes-display-inline">Private school participation</header>
				<paragraph commented="no" display-inline="no-display-inline" id="HA7E7130A69384638A85ED4D0BE71BCB6"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">A local educational agency receiving
			 subgrant funds under this section shall, after timely and meaningful
			 consultation with appropriate private school officials, ensure that private
			 school personnel can participate, on an equitable basis, in activities
			 supported by grant or subgrant funds.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H1C6A5F67DBF64629BB5A364CB0B6BCE7"><enum>(2)</enum><header display-inline="yes-display-inline">Public Control of Funds</header><text display-inline="yes-display-inline">The control of funds provided under this
			 section, and title to materials, equipment, and property purchased with such
			 funds, shall be in a public agency, and a public agency shall administer such
			 funds, materials, equipment, and property.</text>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="HCAE674CAE5A943A3913FEC7E136CABDB"><enum>(f)</enum><header display-inline="yes-display-inline">Required activities</header><text display-inline="yes-display-inline">A State educational agency receiving a
			 grant, or a local educational agency receiving a subgrant, under this section
			 shall use such grant or subgrant funds to carry out the following:</text>
				<paragraph commented="no" display-inline="no-display-inline" id="H2E9B170181F542F3A87F12827C3EA763"><enum>(1)</enum><text display-inline="yes-display-inline">Researching, developing, implementing, and
			 evaluating strategies, policies, and procedures to prevent and reduce physical
			 restraint and seclusion in schools, consistent with the minimum standards
			 established by regulations promulgated by the Secretary pursuant to
			 <internal-xref idref="HA9DA212A61A940C6B80C2C6A58FBD9D5" legis-path="4.">section 5(a)</internal-xref>.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H97F019CE8514488B8798F3DA0C693B15"><enum>(2)</enum><text display-inline="yes-display-inline">Providing professional development,
			 training, and certification for school personnel to meet such standards.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H9039349E2D214EE880EC45C6CF8093C5"><enum>(3)</enum><text display-inline="yes-display-inline">Carrying out the reporting requirements
			 under
			 <internal-xref idref="HD2AC914E22B8472985E9BC841E1C13E0" legis-path="6.(b)">section 6(b)</internal-xref> and analyzing the information
			 included in a report prepared under such section to identify student, school
			 personnel, and school needs related to use of physical restraint and
			 seclusion.</text>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H29BE88F558934A9CB7535733D9EBC2CB"><enum>(g)</enum><header display-inline="yes-display-inline">Additional Authorized
			 activities</header><text display-inline="yes-display-inline">In addition to the
			 required activities described in
			 <internal-xref idref="HCAE674CAE5A943A3913FEC7E136CABDB" legis-path="7.(f)">subsection (f)</internal-xref>, a State educational agency
			 receiving a grant, or a local educational agency receiving a subgrant, under
			 this section may use such grant or subgrant funds for one or more of the
			 following:</text>
				<paragraph commented="no" display-inline="no-display-inline" id="H16D1CEDCD962453AB22DE2EDD58B6031"><enum>(1)</enum><text display-inline="yes-display-inline">Developing and implementing high-quality
			 professional development and training programs to implement evidence-based
			 systematic approaches to school-wide positive behavior supports, including
			 improving coaching, facilitation, and training capacity for administrators,
			 teachers, specialized instructional support personnel, and other staff.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H3E4C2D163951403396357CD6CF80616D"><enum>(2)</enum><text display-inline="yes-display-inline">Providing technical assistance to develop
			 and implement evidence-based systematic approaches to school-wide positive
			 behavior supports, including technical assistance for data-driven
			 decision-making related to behavioral supports and interventions in the
			 classroom.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H5331DF7AABF546CD8F727C289A077ECA"><enum>(3)</enum><text display-inline="yes-display-inline">Researching, evaluating, and disseminating
			 high-quality evidence-based programs and activities that implement school-wide
			 positive behavior supports with fidelity.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H7DF93E399B054A22A196CA60C83BBC7C"><enum>(4)</enum><text display-inline="yes-display-inline">Supporting other local positive behavior
			 support implementation activities consistent with this subsection.</text>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H31773A8FA3EA401C9CE56DE31F3CB8F1"><enum>(h)</enum><header display-inline="yes-display-inline">Evaluation and report</header><text display-inline="yes-display-inline">Each State educational agency receiving a
			 grant under this section shall, at the end of the 3-year grant period for such
			 grant<italic></italic>—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="H84B4B050127946FD88F9C7977EFE8AC7"><enum>(1)</enum><text display-inline="yes-display-inline">evaluate the State’s progress toward the
			 prevention and reduction of physical restraint and seclusion in the schools
			 located in the State, consistent with the minimum standards established by
			 regulations promulgated by the Secretary pursuant to
			 <internal-xref idref="H0A9B0F1C3523409B9234F4FC03235527" legis-path="5.(a)">section 5(a)</internal-xref>; and</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H50934F0E683B46D3B24CA96DFE6C9576"><enum>(2)</enum><text display-inline="yes-display-inline">submit to the Secretary a report on such
			 progress.</text>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H8E5CEEDB5D0E46DFB6E442166EAE2700"><enum>(i)</enum><header display-inline="yes-display-inline">Department of the Interior</header><text display-inline="yes-display-inline">From the amount appropriated under
			 <internal-xref idref="H6A9449567EBA4CC6A3F9F1316D87D2E3" legis-path="12.">section 12</internal-xref>, the Secretary may allocate funds
			 to the Secretary of the Interior for activities under this section with respect
			 to schools operated or funded by the Department of the Interior, under such
			 terms as the Secretary of Education may prescribe.</text>
			</subsection></section><section commented="no" display-inline="no-display-inline" id="H37325E87A9834D01A04A90BCBBFE4216" section-type="subsequent-section"><enum>8.</enum><header display-inline="yes-display-inline">National assessment</header>
			<subsection commented="no" display-inline="no-display-inline" id="H27BA070D7CCF4065924B0128DB615B34"><enum>(a)</enum><header display-inline="yes-display-inline">National Assessment</header><text display-inline="yes-display-inline">The Secretary shall carry out a national
			 assessment to determine the effectiveness of this Act, which shall
			 include—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="HD012E530F1C14753B3F9378108DFAE3E"><enum>(1)</enum><text display-inline="yes-display-inline">analyzing data related to physical
			 restraint and seclusion incidents;</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H837DC799CDB548E781F4BA4EA5A5671C"><enum>(2)</enum><text display-inline="yes-display-inline">analyzing the effectiveness of Federal,
			 State, and local efforts to prevent and reduce the number of physical restraint
			 and seclusion incidents in schools;</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H18470778B89740609AC72DF545898104"><enum>(3)</enum><text display-inline="yes-display-inline">identifying the types of programs and
			 services that have demonstrated the greatest effectiveness in preventing and
			 reducing the number of physical restraint and seclusion incidents in schools;
			 and</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H0CA951F61D804A9DAF074A33792310E1"><enum>(4)</enum><text display-inline="yes-display-inline">identifying evidence-based personnel
			 training models with demonstrated success in preventing and reducing the number
			 of physical restraint and seclusion incidents in schools, including models that
			 emphasize positive behavior supports and de-escalation techniques over physical
			 intervention.</text>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="HEADE9A902228423ABB8E2D7A147CEC45"><enum>(b)</enum><header display-inline="yes-display-inline">Report</header><text display-inline="yes-display-inline">The Secretary shall submit to the Committee
			 on Education and Labor of the House of Representatives and the Committee on
			 Health, Education, Labor, and Pensions of the Senate—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="H4C4A7C8AC45F46D58D1B0FCB5D1ADC98"><enum>(1)</enum><text display-inline="yes-display-inline">an interim report that summarizes the
			 preliminary findings of the assessment described in
			 <internal-xref idref="H27BA070D7CCF4065924B0128DB615B34" legis-path="104.(a)">subsection (a)</internal-xref> not later than 3 years
			 after the date of enactment of this Act; and</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H9B6B72AC737B46099EEF6EF790EEF320"><enum>(2)</enum><text display-inline="yes-display-inline">a final report of the findings of the
			 assessment not later than 5 years after the date of the enactment of this
			 Act.</text>
				</paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="H26116735E53E4E10B837B76AD9DC79BF" section-type="subsequent-section"><enum>9.</enum><header display-inline="yes-display-inline">Protection and Advocacy
			 Systems</header><text display-inline="no-display-inline">Protection and
			 Advocacy Systems shall have the authority provided under section 143 of the
			 Developmental Disabilities Assistance and Bill of Rights Act of 2000 (42 U.S.C.
			 15043) to investigate, monitor, and enforce protections provided for students
			 under this Act.</text>
		</section><section commented="no" display-inline="no-display-inline" id="H63A55ADA04EA424E86266A375A4A4FC9" section-type="subsequent-section"><enum>10.</enum><header display-inline="yes-display-inline">Head Start Programs</header>
			<subsection commented="no" display-inline="no-display-inline" id="H080E4780F3C349D6AA64603681578A15"><enum>(a)</enum><header display-inline="yes-display-inline">Regulations</header><text display-inline="yes-display-inline">The Secretary of Health and Human Services,
			 in consultation with the Secretary, shall promulgate regulations with respect
			 to Head Start agencies administering Head Start programs under the Head Start
			 Act (42 U.S.C. 9801 et seq.) that establish requirements consistent
			 with—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="HA9929D16441C4D70A89080F939871D0C"><enum>(1)</enum><text display-inline="yes-display-inline">the requirements established by regulations
			 promulgated pursuant to section 5(a); and</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H03AEA1D660564ADA8B0956B3475D3717"><enum>(2)</enum><text display-inline="yes-display-inline">the reporting and enforcement requirements
			 described in subsections (b) and (c) of section 6.</text>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="HF2F99BD5356449B89AE5087EE82D02DC"><enum>(b)</enum><header display-inline="yes-display-inline">Grant authority</header><text display-inline="yes-display-inline">From the amount appropriated under
			 <internal-xref idref="H6A9449567EBA4CC6A3F9F1316D87D2E3" legis-path="12.">section 12</internal-xref>, the Secretary may allocate funds
			 to the Secretary of Health and Human Services to assist the Head Start agencies
			 in establishing, implementing, and enforcing policies and procedures to meet
			 the requirements established by regulations promulgated pursuant to subsection
			 (a).</text>
			</subsection></section><section commented="no" display-inline="no-display-inline" id="H3A6F1278B37E4BE282D684A155E4A3FF" section-type="subsequent-section"><enum>11.</enum><header display-inline="yes-display-inline">Limitation of Authority</header>
			<subsection commented="no" display-inline="no-display-inline" id="H77F92C7DF4D1429BB13C413B2A8DD5AF"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Nothing in this Act shall be construed to
			 restrict or limit, or allow the Secretary to restrict or limit, any other
			 rights or remedies otherwise available to students or parents under Federal or
			 State law or regulation.</text>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="HB668EEC13A9C4FD3A4E79053B705E795"><enum>(b)</enum><header display-inline="yes-display-inline">Applicability</header>
				<paragraph commented="no" display-inline="no-display-inline" id="HABFDFB4FE4D74E5891B7C12AAF67F4BD"><enum>(1)</enum><header display-inline="yes-display-inline">Private schools</header><text display-inline="yes-display-inline">Nothing in this Act shall be construed to
			 affect any private school that does not receive, or does not serve students who
			 receive, support in any form from any program supported, in whole or in part,
			 with funds appropriated to the Department of Education.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H41155167706A405AA09074EF458FFAF6"><enum>(2)</enum><header display-inline="yes-display-inline">Home schools</header><text display-inline="yes-display-inline">Nothing in this Act shall be construed
			 to—</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="H2A261033F43940CBAC715D962F17AE49"><enum>(A)</enum><text display-inline="yes-display-inline">affect a home school, whether or not a home
			 school is treated as a private school or home school under State law; or</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H1781A4B7BFC64F01969A5897CE978324"><enum>(B)</enum><text display-inline="yes-display-inline">consider parents who are schooling a child
			 at home as school personnel.</text>
					</subparagraph></paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="H6A9449567EBA4CC6A3F9F1316D87D2E3" section-type="subsequent-section"><enum>12.</enum><header display-inline="yes-display-inline">Authorization of
			 appropriations</header><text display-inline="no-display-inline">There are
			 authorized to be appropriated such sums as may be necessary to carry out this
			 Act for fiscal year 2011 and each of the 4 succeeding fiscal years.</text>
		</section><section commented="no" display-inline="no-display-inline" id="H32F36AEAB9114DA8AD06F4646A23635C" section-type="subsequent-section"><enum>13.</enum><header display-inline="yes-display-inline">Presumption of Congress relating to
			 competitive procedures</header>
			<subsection commented="no" display-inline="no-display-inline" id="H17D4EDDB46FF440786A90DEBCB2BC18D"><enum>(a)</enum><header display-inline="yes-display-inline">Presumption</header><text display-inline="yes-display-inline">It is the presumption of Congress that
			 grants awarded under this Act will be awarded using competitive procedures
			 based on merit.</text>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="HBD0EAAC5A5AB464F97A02A23B4B1141F"><enum>(b)</enum><header display-inline="yes-display-inline">Report to Congress</header><text display-inline="yes-display-inline">If grants are awarded under this Act using
			 procedures other than competitive procedures, the Secretary shall submit to
			 Congress a report explaining why competitive procedures were not used.</text>
			</subsection></section><section commented="no" display-inline="no-display-inline" id="H11391F76F46B41D38F35F0FFE07DD734" section-type="subsequent-section"><enum>14.</enum><header display-inline="yes-display-inline">Prohibition on earmarks</header><text display-inline="no-display-inline">None of the funds appropriated to carry out
			 this Act may be used for a congressional earmark as defined in clause 9e, of
			 Rule XXI of the rules of the House of Representatives of the 111th
			 Congress.</text>
