<official-title>To amend the Internal Revenue Code of 1986 to modify the exception from the 10 percent penalty for early withdrawals from governmental plans for Federal and State qualified public safety employees.</official-title>

<section id="HBE152D990F41410F950816C88CC5B0CD" section-type="section-one"><enum>1.</enum><header>Modification of exception from 10 percent early withdrawal penalty for Federal and State public safety employees</header> 
<subsection id="H888DE0A4711E45C48C8C9863130872E4"><enum>(a)</enum><header>Repeal of restriction to defined benefit plans</header><text display-inline="yes-display-inline">Subparagraph (A) of section 72(t)(10)(A) of the Internal Revenue Code of 1986 is amended by striking <quote>which is a defined benefit plan</quote>.</text></subsection> 
<subsection id="H2376190475414540AD792A91E3C43DFC"><enum>(b)</enum><header>Inclusion of Federal employees</header><text>Subparagraph (B) of section 72(t)(10) of such Code is amended to read as follows:</text>
<quoted-block style="OLC" id="H216271671C0E46CEBAA328B024B871E4" display-inline="no-display-inline">
<subparagraph id="H3977D91291634BFB823776A23AE14825"><enum>(B)</enum><header>Qualified public safety employee</header><text display-inline="yes-display-inline">For purposes of this paragraph, the term <quote>qualified public safety employee</quote> means any employee of the Government of the United States, a State or political subdivision of a State, or any agency or instrumentality of any of the foregoing who provides police protection, firefighting services, or emergency medical services for any area within the jurisdiction of the Government of the United States, or such State or political subdivision, as the case may be.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block> </subsection> 
<subsection id="H70206AA3B23947C5BBBD8FAC54436DC0"><enum>(c)</enum><header>Application to annuities commencing before the Pension Protection Act of 2006</header><text>Paragraph (10) of section 72(t) is amended by adding at the end the following new subparagraph:</text> 
<quoted-block display-inline="no-display-inline" id="HE381AE12C7B847B2B2DE619C3DCB8941" style="OLC"> 
<subparagraph id="HFB5275972FCC4C6C9EEAF0FCAEDB0BAE"><enum>(C)</enum><header>Transitional rule for annuities</header><text display-inline="yes-display-inline">Paragraph (4) shall not apply to any modification to a series of substantially equal periodic payments which are made with respect to a qualified public safety employee if such series of payments commenced—</text> 
<clause id="HD00D30672679467B822731412C85DEC9"><enum>(i)</enum><text>before the date of the enactment of the Pension Protection Act of 2006, and</text> </clause> 
<clause id="HD63940D7214E4FE084CF03220E1FD034"><enum>(ii)</enum><text>after such qualified public safety employee’s separation from service after attainment of age 50.</text> </clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block> </subsection> 
<subsection id="H27CAB7AAE17841B6ABEA6C217A73B2B5"><enum>(d)</enum><header>Effective dates</header> 
<paragraph id="H3DE7C7481167492CAE616B7587E619FE"><enum>(1)</enum><header>In general</header><text>The amendments made by subsections (a) and (b) shall apply to distributions made after the date of the enactment of the Pension Protection Act of 2006.</text> </paragraph> 
<paragraph id="H21EE68832B5A4F1FAE0AC74AF68E0627"><enum>(2)</enum><header>Transitional rule for annuities</header><text>The amendment made by subsection (c) shall apply to modifications made after the date of the enactment of the Pension Protection Act of 2006.</text> </paragraph></subsection></section>
