		<section id="H82EFEF069B7544A188CDD36947EF2B63" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Health Care Reality Check Act</short-title></quote>.</text>
		</section><section id="H0464C002E9634A3F9810D84767246A60"><enum>2.</enum><header>Limiting access
			 of Members of Congress to Government-administered health care benefits so long
			 as comprehensive health reform legislation has not become law</header>
			<subsection id="H30FFE943B80C439FBDAE3E97257586FD"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Effective for months
			 beginning after the date of the enactment of this Act, no Member of or delegate
			 to the United States House of Representatives and no Member of the United
			 States Senate shall be eligible for any Government-administered health care
			 benefit until the first day of the first month following the date on which
			 comprehensive health reform legislation is signed into law.</text>
			</subsection><subsection id="H21C745FC8911431F9F605EBEC057A0B6"><enum>(b)</enum><header>Definitions</header><text>In
			 this section:</text>
				<paragraph id="HEACF4FD965E744F385994B65038F8426"><enum>(1)</enum><header>Government-administered
			 health care benefit</header><text display-inline="yes-display-inline">The term
			 <term>Government-administered health care benefit</term> includes health care
			 benefits or services under or through any of the following:</text>
					<subparagraph id="H7A4F0B35B1E3403DB2EC48A1573563F9"><enum>(A)</enum><header>FEHBP</header><text>Chapter
			 89 of title 5, United States Code (relating to the Federal Employees Health
			 Benefits Program or FEHBP).</text>
					</subparagraph><subparagraph id="H681C6C24F2C04C138DB5B15DA9F2EC2A"><enum>(B)</enum><header>Medicare</header><text>The
			 Medicare program under title XVIII of the Social Security Act.</text>
					</subparagraph><subparagraph id="HCEC0F13AFA65447C83E692F8915E2AD7"><enum>(C)</enum><header>VA</header><text>The
			 Department of Veterans Affairs.</text>
					</subparagraph><subparagraph id="HF352BC93F95441E295ABEC4D7AC126CC"><enum>(D)</enum><header>OAP</header><text>The
			 Office of the Attending Physician in the United States Capitol.</text>
					</subparagraph><subparagraph id="H85C4047F8ACC4D2FA8FEFCC52062F2A7"><enum>(E)</enum><header>FSA</header><text>Payment
			 through a flexible spending account program.</text>
					</subparagraph></paragraph><paragraph id="HE43B7A53FFDB484EB9A94F8434C81794"><enum>(2)</enum><header>Comprehensive
			 health reform legislation</header><text display-inline="yes-display-inline">The
			 term <term>comprehensive health reform legislation</term> means an Act of
			 Congress that includes at least all of the following:</text>
					<subparagraph id="H8226D1ADDEF64B6ABD1488AC8734BDC1"><enum>(A)</enum><text>Establishment of
			 an inclusive and accessible health insurance marketplace which includes a
			 public health insurance option.</text>
					</subparagraph><subparagraph id="H34A198DCE80B4FCBA2FC045A98FA3EF0"><enum>(B)</enum><text>A prohibition of
			 discrimination in health benefits coverage based on pre-existing conditions and
			 a prohibition on the imposition of lifetime limits on coverage.</text>
					</subparagraph><subparagraph id="HF2AED1D03E1142C38F64B5D7C1391042"><enum>(C)</enum><text>A limit on the
			 ability of health insurance issuers to charge higher premiums due to health
			 status, age, or gender.</text>
					</subparagraph><subparagraph id="HC7C7F8BC83E74DFA851221EF775BF25C"><enum>(D)</enum><text>A requirement that
			 health insurance issuers expend a minimum medical loss ratio of at least 85
			 percent of premium dollars on medical care, rather than on administration,
			 marketing, and profit, and refund to consumers or subsequently adjust premiums
			 insofar as it fails to meet such loss ratio.</text>
					</subparagraph><subparagraph id="H7ACE24BE8F6042F5B3C1BD18B6774996"><enum>(E)</enum><text>Establishment of
			 an essential health benefits requirement for all health insurance coverage that
			 includes coverage of hospitalization, physician services, prescription drugs,
			 preventive services with no cost-sharing, mental health services, and oral
			 health and vision for children.</text>
					</subparagraph><subparagraph id="H66530EF7166A4D9E903E59D70516D965"><enum>(F)</enum><text>Preserving
			 individual choice of doctors and health providers.</text>
					</subparagraph><subparagraph id="H530D7FBA6D1647F1A06E0356C4B75243"><enum>(G)</enum><text>Providing a
			 sliding scale of affordability credit to low- and moderate- income individuals
			 and families and limiting annual out-of-pocket spending for all income levels
			 to prevent bankruptcies from medical expenses.</text>
					</subparagraph><subparagraph id="H9EF649823A304001BFD7FB9109AD7B84"><enum>(H)</enum><text>Creating shared
			 responsibility among individuals, employers, and government to ensure that all
			 Americans have affordable coverage of essential health benefits.</text>
					</subparagraph></paragraph></subsection></section></legis-body>
