		<official-title>To amend the Real Estate Settlement Procedures Act of
		  1974 to ensure that borrowers under federally related mortgage loans have an
		  opportunity to inspect closing documents.</official-title>

		<section id="H135B569B72284473A0E916A123E7D2D8" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Borrowers' Right to Inspect Closing
			 Documents Act of 2009</short-title></quote>.</text>
		</section><section id="HE1D33B1F9FA947948BBBC492F7CCF0D4"><enum>2.</enum><header>Furnishing of
			 closing documents to borrower</header><text display-inline="no-display-inline">Section 4 of the Real Estate Settlement
			 Procedures Act of 1974 (12 U.S.C. 2603) is amended by striking subsection (b)
			 and inserting the following new subsection:</text>
			<quoted-block display-inline="no-display-inline" id="H1B50DC5D0DAD40E7AE0C4AD44D8F4B50" style="OLC">
				<subsection id="H607B12348158426096BACACB5FF75827"><enum>(b)</enum><header>Furnishing of
				closing documents to borrower three days before settlement</header>
					<paragraph id="HEC64EA2C04514288BEC4F064544C87A5"><enum>(1)</enum><header>Lender
				responsibilities</header><text display-inline="yes-display-inline">The lender
				shall furnish to the person conducting the settlement (in this subsection
				referred to as the <quote>settlement agent</quote>), at least four business
				days before the scheduled date of settlement, the completed promissory note,
				deed of trust or other mortgage instrument, as the case may be, all items that
				are needed to complete the uniform settlement statement, the final
				Truth-in-Lending Act disclosure, and the final closing instructions.</text>
					</paragraph><paragraph id="HD977BF2EA3794ABD8F175A2E361A68A4"><enum>(2)</enum><header>Furnishing of
				closing documents to borrowers</header>
						<subparagraph id="H5FF47BA521D5449C8A5E10A875F09A4F"><enum>(A)</enum><header>Requirement</header><text display-inline="yes-display-inline">Except as provided in paragraphs (3) and
				(4), the settlement agent shall furnish to the borrower, at least three
				business days preceding the scheduled date of settlement and using the method
				selected by the borrower pursuant to subparagraph (B) of this paragraph—</text>
							<clause id="HC63FA10141D648A8B48751863B2EFF27"><enum>(i)</enum><text>the completed
				documents set forth in paragraph (1), except for the final closing
				instructions, and</text>
							</clause><clause id="HB809D433D11947A7B546CADF24ECBDC9"><enum>(ii)</enum><text>the completed
				uniform settlement statement,</text>
							</clause><continuation-text continuation-text-level="subparagraph">as
				long as the lender has timely provided the requisite items and documents to the
				settlement agent. The settlement agent shall not be responsible for the
				lender’s failure to comply with paragraph (1).</continuation-text></subparagraph><subparagraph id="HD54DEA29EB51439E879961F1D3B4315F"><enum>(B)</enum><header>Methods of
				furnishing documents</header><text>The borrower may select to have the
				documents required under subparagraph (A) furnished by—</text>
							<clause id="H3816D2832E3B41A09A1273104149F967"><enum>(i)</enum><text display-inline="yes-display-inline">electronic mail, subject to the Electronic
				Signatures in Global and National Commerce Act (15 U.S.C. 7001 et seq.);</text>
							</clause><clause id="HC8EB1348428245048CFC459F8CFACD8C"><enum>(ii)</enum><text>telephone
				facsimile machine; or</text>
							</clause><clause id="H74AE7A5B511A4A5EA2373A3D50EB5CD5"><enum>(iii)</enum><text>making the
				documents available for personal inspection at the office of the settlement
				agent and providing a copy of the documents to the borrower to retain.</text>
							</clause></subparagraph></paragraph><paragraph id="H3A0A1773ED754D40961E431687769EB7"><enum>(3)</enum><header>Corrections</header>
						<subparagraph id="H0147890BEF744BEBA6FA1553A355AEC8"><enum>(A)</enum><header>In
				general</header><text display-inline="yes-display-inline">Notwithstanding any
				provision of paragraph (2) to the contrary, the settlement agent may make
				corrections to the uniform settlement statement and any related documents prior
				to the scheduled date of settlement, if—</text>
							<clause id="H048FF3D321E74511B625D6B1A5A4C1B3"><enum>(i)</enum><text>an
				update of the title search and examination of the prospective mortgaged
				property reveals any defects, liens, encumbrances, or other matters not
				discovered in previous searches;</text>
							</clause><clause id="HD38240EA20C645E79AE52DA896F239FD"><enum>(ii)</enum><text>subject to the
				lender’s approval, the borrower’s inspection of the prospective mortgaged
				property requires financial adjustments;</text>
							</clause><clause id="HB325D07F28A84194A7E1A98C403BBDAA"><enum>(iii)</enum><text>the borrower and
				lender agree to make material changes to the loan transaction; or</text>
							</clause><clause id="H36B0FA8FFF8D4B28A4452D20E4722305"><enum>(iv)</enum><text>any other
				permissible corrections, as identified by regulation by the Secretary, are
				made.</text>
							</clause></subparagraph><subparagraph id="HC400EB9CCF8348FCB8D69FF152F2AA43"><enum>(B)</enum><header>Timing</header><text display-inline="yes-display-inline">The requirement under paragraph (2) to
				provide completed documents and the completed settlement statement at least
				three business days before settlement shall not apply to any uniform settlement
				statement and related documents corrected pursuant to subparagraph (A) of this
				paragraph.</text>
						</subparagraph></paragraph><paragraph id="H1E81E948159342C28356A1E4A814E4B7"><enum>(4)</enum><header>Exemption by
				Secretary</header><text display-inline="yes-display-inline">The Secretary may
				exempt from the requirements of this subsection the following
				settlements:</text>
						<subparagraph id="H52C14568AA884C3BAA57B0FB2CEAE329"><enum>(A)</enum><text>Settlements
				occurring in localities where the final settlement statement is not customarily
				provided at or before the date of settlement.</text>
						</subparagraph><subparagraph id="HDC412C0155434E00A8971233A2E6B6B8"><enum>(B)</enum><text>Settlements under
				which compliance with the requirements of this subsection is
				impractical.</text>
						</subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
