		<official-title>To authorize drought assistance adjustments to provide
		  immediate funding for projects and activities that will help alleviate record
		  unemployment and diminished agricultural production related to the drought in
		  California.</official-title>

		<section id="HF2B492E48E584CF2BB66CEDBAF9332DC" section-type="section-one"><enum>1.</enum><header>Drought assistance
			 authority</header>
			<subsection id="H846408A555834EEDB0DA2F3120B43DD1"><enum>(a)</enum><header>Authorization</header><text>The
			 Secretary of the Interior may use funds provided by the American Recovery and
			 Reinvestment Act of 2009 or appropriation measures through fiscal year 2012 for
			 any required non-Federal share of the cost of projects that—</text>
				<paragraph id="H5CE63FBD22AF44D5820722068C0859EF"><enum>(1)</enum><text display-inline="yes-display-inline">are funded by the Federal Government for
			 the same purpose;</text>
				</paragraph><paragraph id="HCFABFD075E6D453C993438DA36B5AA6D"><enum>(2)</enum><text>are located in an
			 area described in paragraph (1) or (2) of subsection (b); and</text>
				</paragraph><paragraph id="HACA7827D03BF49D7AC2C71CFF8C0C9D4"><enum>(3)</enum><text>have—</text>
					<subparagraph id="H564330B33B12422AB434442D72461327"><enum>(A)</enum><text>been identified as
			 a project that will—</text>
						<clause id="HA552B4F72EF74636B0D1105E206730D7"><enum>(i)</enum><text>make
			 progress towards achieving the co-equal goals of providing a more reliable
			 water supply for California and protecting, restoring, and enhancing the
			 Sacramento-San Joaquin Delta ecosystem;</text>
						</clause><clause id="HAC29541EA1574CF596249A5DB9BB53F7"><enum>(ii)</enum><text>increase water
			 management flexibility; or</text>
						</clause><clause id="HE827332F5DD24215B419F869CBA0A58D"><enum>(iii)</enum><text>reduce impacts
			 on environmental resources from projects operated by the California State
			 Department of Water Resources, the California State Department of Fish and
			 Game, the Bureau of Reclamation, the United States Fish and Wildlife Service,
			 or other relevant State and Federal agencies;</text>
						</clause></subparagraph><subparagraph id="H8A5E4BE868F64D2FB3E61D5ABE0A2D81"><enum>(B)</enum><text>show potential, as
			 determined by relevant Federal and State agencies, to restore agriculture
			 production or agricultural employment for an area described in paragraph (1) or
			 (2) of subsection (b); and</text>
					</subparagraph><subparagraph id="HB73489680CB94EBBB9449E92D4B1AA3C"><enum>(C)</enum><text>made significant
			 progress in the completion of any necessary environmental or public review if
			 applicable.</text>
					</subparagraph></paragraph></subsection><subsection id="HE93EA795F8F14CC1A3E1977A6401FEA0"><enum>(b)</enum><header>Eligible
			 areas</header><text>An area referred to in subsection (a)(2) is any area
			 that—</text>
				<paragraph id="HC29CA4C7E6D2407793490061FE0D20C6"><enum>(1)</enum><text>has been
			 identified by the U.S. Drought Monitor as experiencing Severe, Extreme, or
			 Exceptional Drought within the 24 months prior to the date of the enactment of
			 this Act; or</text>
				</paragraph><paragraph id="H379CC34A78CE4474A0D9A42BB8B4C42F"><enum>(2)</enum><text>has been
			 designated as a disaster area by the State of California during calendar year
			 2009.</text>
				</paragraph></subsection><subsection id="HDCB3C5332104494A8577D4B0880BD667"><enum>(c)</enum><header>Drought
			 Assistance Adjustment</header>
				<paragraph id="HBEE8BF52642146F9AFFA2564B6C63FE1"><enum>(1)</enum><header>In
			 general</header><text>The use of funds for the non-Federal share of projects as
			 authorized in this section shall be considered a Drought Assistance
			 Adjustment.</text>
				</paragraph><paragraph id="HE6A284D9287B427498C045797075BD95"><enum>(2)</enum><header>Criteria for
			 calculating drought assistance adjustments</header><text>The Secretary shall,
			 within 60 days after the date of the enactment of this Act, establish criteria
			 for calculating drought assistance adjustments utilizing existing practices for
			 adjustments in water service and repayment rates.</text>
				</paragraph></subsection></section></legis-body>
