		<section id="H783D31843478447387A193C7DD0B7123" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Academic, Social, and Emotional
			 Learning Act of 2009</short-title></quote>.</text>
		</section><section id="HFBA6D406F4BF4659AAAB7E9F1F67532F"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">The Congress makes the following
			 findings:</text>
			<paragraph id="HB7A927AA107A47E781C76DD007A7FDB2"><enum>(1)</enum><text>To succeed in
			 school, students need to be engaged. They need to know how to maintain focus
			 and effort in the face of setbacks, work effectively with others, and be good
			 communicators and problem-solvers.</text>
			</paragraph><paragraph id="H67DB2211ADD64CAC9A07A6E6383022A1"><enum>(2)</enum><text>Social and
			 emotional skills form a foundation for young people’s success not just in
			 school, but as healthy and caring adults, productive workers, and engaged
			 citizens.</text>
			</paragraph><paragraph id="HC4E0F6D4568F4D40A51335430BCC3E27"><enum>(3)</enum><text>Not only can these
			 skills be taught, they can be taught by regular classroom teachers in schools
			 of every type to students of every background.</text>
			</paragraph><paragraph id="H959D965F8C984F2AB34D9F3968FFE485"><enum>(4)</enum><text display-inline="yes-display-inline">Academic outcomes resulting from social and
			 emotional learning include greater motivation to learn and commitment to
			 school, increased time devoted to schoolwork and mastery of subject matter,
			 improved attendance, graduation rates, grades, and test scores.</text>
			</paragraph><paragraph id="H596C37F2829B4A41A9A3105327D8A061"><enum>(5)</enum><text display-inline="yes-display-inline">These positive outcomes increase in
			 students who are involved in social and emotional learning programming by an
			 average of 11 percentile points over students who are not involved in such
			 programming.</text>
			</paragraph><paragraph id="HDFE8C61EEF8448DCB8387587C31067B5"><enum>(6)</enum><text>Social and
			 emotional learning programming also results in reduced problem behavior,
			 improved health outcomes, a lower rate of violent delinquency, and a lower rate
			 of heavy alcohol use.</text>
			</paragraph></section><title id="HC028A04CD5D640CCA84E679453F79367"><enum>I</enum><header>Grants to support
			 evidence-based social and emotional learning programming</header>
			<section id="H2915F8DCCBC343DEAD07005C62A2A2CC"><enum>101.</enum><header>Purpose</header><text display-inline="no-display-inline">The purpose of this title is to advance
			 student achievement, attainment, and social and emotional development by
			 establishing Federal grant programs to support social and emotional learning
			 programming in elementary and secondary schools.</text>
			</section><section id="H83E6387748974F2484C8C0C9ECD1D073"><enum>102.</enum><header>National
			 training and technical assistance center</header>
				<subsection id="H456CEDC707D943E3BE2B61BFDDC04F0E"><enum>(a)</enum><header>Grant
			 authorized</header><text>The Secretary is authorized to award a grant to
			 establish a National Technical Assistance and Training Center for Social and
			 Emotional Learning that provides training and technical assistance to States,
			 local educational agencies, and community-based organizations to identify,
			 promote, and support evidence-based social and emotional learning programming
			 in elementary and secondary schools.</text>
				</subsection><subsection id="H2E30316D94B34295B9BAEB2AD515B5AC"><enum>(b)</enum><header>Authorized
			 activities</header><text>Grant funds provided under this section shall be
			 used—</text>
					<paragraph id="H9B01FE58ACC64BE6ACCDFE7B4F99B517"><enum>(1)</enum><text>to provide
			 technical assistance to States, local educational agencies, and community-based
			 organizations on the effective implementation of social and emotional learning
			 standards and programming to States, including technical assistance on
			 coordinated classroom and school-wide programming as well as how to engage
			 families and communities in social and emotional learning efforts;</text>
					</paragraph><paragraph id="HEE251C09E24D45A78CDE1635F7495392"><enum>(2)</enum><text>to provide ongoing
			 high-quality professional development to support effective implementation of
			 social and emotional learning standards and programming;</text>
					</paragraph><paragraph id="H0BF701C03BC94BF2B7BA46138798DA4C"><enum>(3)</enum><text>to conduct
			 research and disseminate information on social and emotional learning standards
			 and programming;</text>
					</paragraph><paragraph id="H50D8751A61984C47BABD2DFD02BC46A6"><enum>(4)</enum><text>to develop and
			 disseminate reliable assessment tools to measure student progress in social and
			 emotional development; and</text>
					</paragraph><paragraph id="HAC237DFC63FE4CA0859FF9391740AD91"><enum>(5)</enum><text>to evaluate social
			 and emotional learning programming to determine the impact of such programming
			 on student achievement and behavior.</text>
					</paragraph></subsection><subsection id="H5FF666BA921E4A63898F7BCF05D67E72"><enum>(c)</enum><header>Eligible
			 grantee</header><text>The grant may be awarded to a nonprofit organization that
			 has extensive experience in—</text>
					<paragraph id="H64888F5A72674360B05068C10F19CF47"><enum>(1)</enum><text>developing
			 research based standards, instructional resources, and assessments of social
			 and emotional learning;</text>
					</paragraph><paragraph id="H8B4F2754D669401B8DF90D44F139D802"><enum>(2)</enum><text display-inline="yes-display-inline">providing technical assistance to States,
			 local educational agencies, and community-based organizations that are
			 developing and implementing social and emotional learning standards and
			 programming;</text>
					</paragraph><paragraph id="HDA967634DF574C138D57271B776A5D78"><enum>(3)</enum><text>providing
			 high-quality professional development to local educational agency and school
			 personnel in social and emotional learning standards and programming;</text>
					</paragraph><paragraph id="H7D55AF10C7AC4A68B96DB008A7D01688"><enum>(4)</enum><text>conducting,
			 analyzing, and disseminating research on social and emotional development and
			 learning; and</text>
					</paragraph><paragraph id="H53E9782E7C684903BE0A617D71A8AF5D"><enum>(5)</enum><text>evaluating social
			 and emotional learning standards and programming.</text>
					</paragraph></subsection><subsection id="H65C286A4EC6E49EB8B86787ED703E05F"><enum>(d)</enum><header>Application</header><text>Applications
			 shall be submitted at such time and in such manner as the Secretary determines.
			 Applications shall include a description of how the grantee—</text>
					<paragraph id="H42CAB5F2820F4B1C9171BF76D8E204CE"><enum>(1)</enum><text>will use funds
			 consistent with subsection (b); and</text>
					</paragraph><paragraph id="H80E922763ADB4FFD9633FC8AE7338AA5"><enum>(2)</enum><text>meets the
			 eligibility requirements described in subsection (c).</text>
					</paragraph></subsection><subsection id="HB7A3B1C3D21E42AFAAE5809330983726"><enum>(e)</enum><header>Duration of
			 grant</header><text>The grant under this section shall be awarded for 5
			 years.</text>
				</subsection><subsection id="H57400ABED71A48089A67187E63A5C91C"><enum>(f)</enum><header>Report to
			 Secretary</header><text>The grantee shall report any information the Secretary
			 deems appropriate at such a time and in such manner as the Secretary shall
			 require.</text>
				</subsection></section><section id="H4CB1E9CA7A6D439491F143EC965F335A"><enum>103.</enum><header>Grants to
			 States and local educational agencies</header>
				<subsection id="HF57453BB2C714CE49828D637A3DD9146"><enum>(a)</enum><header>Grants
			 authorized</header><text>The Secretary is authorized to award competitive
			 grants to States and local educational agencies to work with the National
			 Technical Assistance and Training Center for Social and Emotional Learning to
			 develop and implement evidence-based social and emotional learning standards
			 and programming in elementary schools and secondary schools.</text>
				</subsection><subsection id="H8B83B979C4244A4F979C9775013A2896"><enum>(b)</enum><header>Uses of funds
			 for States</header>
					<paragraph id="HD45C15B8E1A44C6AB7774750D340C5A2"><enum>(1)</enum><header>Required
			 activities</header><text>In the case of a State that receives a grant under
			 this section, the State shall carry out the following activities:</text>
						<subparagraph id="HF4437ABCD43547B99CAB4A0D9F5A6CFF"><enum>(A)</enum><text display-inline="yes-display-inline">Create a State social and emotional
			 learning leadership team consisting of, at a minimum, a representative from the
			 State education agency, a school administrator, an educator, a parent, a
			 representative from an institution of higher education in the State, and a
			 coordinator for mental health or pupil support services to guide the planning,
			 implementation, and monitoring of social and emotional learning
			 programming.</text>
						</subparagraph><subparagraph id="H2D60D9D116754D7D9A4058C5BDDA0554"><enum>(B)</enum><text>Develop a State
			 plan outlining policies, standards, or guidelines to support the implementation
			 of evidence-based social and emotional learning programming in local
			 educational agencies.</text>
						</subparagraph><subparagraph id="H19EDE4A1E92E41298C9F4A1BA99A21B9"><enum>(C)</enum><text>Develop a
			 statewide high-quality professional development framework and student
			 assessment system for State agency staff, school administrators, teachers, and
			 paraprofessionals to implement and assess social and emotional learning.</text>
						</subparagraph><subparagraph id="H13C8C8638FB34ECA8DE75E08ED05E564"><enum>(D)</enum><text>Disseminate
			 information to educators and the public about advances in research, practices,
			 and policies that foster the social, emotional, and academic growth of
			 students.</text>
						</subparagraph><subparagraph id="H65DBD6E699E44D02A22BC123FB58DADE"><enum>(E)</enum><text>Engage families
			 and communities in the social and emotional learning of students served.</text>
						</subparagraph></paragraph><paragraph id="HD5D1A8B54E474DAF92419AD17E61E78F"><enum>(2)</enum><header>Allowable
			 activities</header><text display-inline="yes-display-inline">In the case of a
			 State that receives a grant under this section, the State may carry out the
			 following activities:</text>
						<subparagraph id="HE495EA85D9D944298E253C008045A310"><enum>(A)</enum><text>Establish a plan
			 and provide competitive subgrants to local education agencies to plan,
			 implement, and evaluate sustainable social and emotional learning
			 programming.</text>
						</subparagraph><subparagraph id="HCA10924A7E764ECE82EC064F8C32013B"><enum>(B)</enum><text>Explore the
			 development of public-private partnerships to fund and support quality
			 implementation and assessment of evidence-based social and emotional
			 learning.</text>
						</subparagraph></paragraph></subsection><subsection id="HC0B3905C5F5646E382AAFBD1BE3A26D2"><enum>(c)</enum><header>Uses of funds
			 for local education agencies</header><text display-inline="yes-display-inline">In the case of a local educational agency
			 that receives a grant under this section, the local educational agency shall
			 carry out the following activities:</text>
					<paragraph id="H07864A456D954D3DAC81FEEFC4CDCF55"><enum>(1)</enum><text>Create district
			 and or school social and emotional learning coordinator(s) and coaches who work
			 with planning teams to plan, implement, evaluate, and monitor evidence-based
			 social and emotional learning programming.</text>
					</paragraph><paragraph id="H9598126D45BB4495A7D29B00417956C8"><enum>(2)</enum><text>Develop district-
			 and school-level policies and plans to support the implementation, and
			 evaluation of school-wide, evidence-based social and emotional learning
			 programming.</text>
					</paragraph><paragraph id="H63319ADDAAB4478F92DA61D3B991BBD7"><enum>(3)</enum><text>Provide ongoing
			 high-quality professional development and on-site coaching to school
			 administrators, teachers, and paraprofessionals who implement and assess
			 evidence-based social and emotional learning.</text>
					</paragraph><paragraph id="HA01852E444BA4CC38973F1B40663CCA4"><enum>(4)</enum><text>Engage families
			 and communities in the social and emotional development and learning of
			 students served.</text>
					</paragraph><paragraph id="HD224F966073547FF8862AEF14151D5D7"><enum>(5)</enum><text>Provide resources
			 and supports such as planning time, materials, and training sites for school
			 personnel that implement and assess evidence-based social and emotional
			 learning.</text>
					</paragraph><paragraph id="H39E129D0290F401C85DF7BF04F864084"><enum>(6)</enum><text>Monitor program
			 implementation and assess student progress in social and emotional learning
			 over time.</text>
					</paragraph><paragraph id="H924AB48862AA4BD2AC552277AFD48367"><enum>(7)</enum><text>Disseminate
			 relevant research and information on social and emotional development and
			 learning.</text>
					</paragraph></subsection><subsection id="HE4F2EE26ACA2469D9DA58A37A6F5B6C4"><enum>(d)</enum><header>Applications</header>
					<paragraph id="HF6138ACD41B94303B6CCF400EEF60C69"><enum>(1)</enum><header>In
			 general</header><text>Applications shall be submitted at such time and in such
			 manner as the Secretary determines.</text>
					</paragraph><paragraph id="H65D23771336240C383673F3789B88A91"><enum>(2)</enum><header>State
			 application contents</header><text>A State application shall—</text>
						<subparagraph id="H239B188520F245949AFF66ED935C1050"><enum>(A)</enum><text>describe how the
			 State will implement the required activities described in subsection
			 (b)(1);</text>
						</subparagraph><subparagraph id="HE6641DDB58404FF48E605474A48D2B37"><enum>(B)</enum><text>describe how the
			 State will work with the National Training and Technical Assistance Center;</text>
						</subparagraph><subparagraph id="HC6BF857EC4234637980479EF4B26B7CB"><enum>(C)</enum><text>describe how the
			 State will provide ongoing support to local education agencies to ensure
			 effective implementation of evidence-based social and emotional learning
			 standards and programming; and</text>
						</subparagraph><subparagraph id="H29D75DB1D1C641CF82F13BF9016C4FA9"><enum>(D)</enum><text display-inline="yes-display-inline">describe benchmarks of success for the
			 State initiative.</text>
						</subparagraph></paragraph><paragraph id="HF76996C0382342E4A88B3DE030250A8B"><enum>(3)</enum><header>Local
			 educational agency application contents</header><text>A local education agency
			 application shall—</text>
						<subparagraph id="H67102FEFA82A4367A4F55477554DD47D"><enum>(A)</enum><text>describe how the
			 local education agency will implement the activities described in subsection
			 (c);</text>
						</subparagraph><subparagraph id="HA2E1A36760E24CC78F558698639B9A65"><enum>(B)</enum><text>describe how the
			 local education agency will work with the National Training and Technical
			 Assistance Center;</text>
						</subparagraph><subparagraph id="H605DBC4EF6AC48C5A833FACCB98A9528"><enum>(C)</enum><text>describe how the
			 local education agency will work with the State to support evidence-based
			 social and emotional learning programming and ensure the ongoing support of the
			 local educational agency and school leader in schools where the grant is
			 implemented; and</text>
						</subparagraph><subparagraph id="H5B0E2DB0531D48F887FAD83B92B0962D"><enum>(D)</enum><text display-inline="yes-display-inline">describe benchmarks of success for the
			 local educational agency initiative.</text>
						</subparagraph></paragraph></subsection><subsection id="HD4BCC69640EA4100B9F124F5C35E7E19"><enum>(e)</enum><header>Priority</header><text>In
			 awarding grants, the Secretary shall give priority to applicants serving
			 schools—</text>
					<paragraph id="H6DF897880B9E4F2AB7D78C519E054225"><enum>(1)</enum><text>with high numbers
			 or high percentages of low-income students;</text>
					</paragraph><paragraph id="H7B76FFD46D974DCF800A538F51AA30E6"><enum>(2)</enum><text>with high numbers
			 or high percentages of students in schools identified as in need of
			 improvement, corrective action, or restructuring under section 1116 of the
			 Elementary and Secondary Education Act of 1965 (20 U.S.C. 6316); and</text>
					</paragraph><paragraph id="H574D16C37F154813ACC1CFB45C8724FA"><enum>(3)</enum><text>having a plan for
			 sustainability of the program beyond the duration of the grant.</text>
					</paragraph></subsection><subsection id="H9D0F13FE65764A958499E6397608EF27"><enum>(f)</enum><header>Duration of
			 grant</header><text>Grants under this section shall be awarded for 5
			 years.</text>
				</subsection><subsection id="H592F40844FE64DE7874D316238FCB4D5"><enum>(g)</enum><header>Report to
			 Secretary</header><text>Grantees shall report any information the Secretary
			 deems appropriate at such a time and in such manner as the Secretary shall
			 require.</text>
				</subsection></section><section id="H84E51C70D77849E28E77F52EB5907F4C"><enum>104.</enum><header>Evaluation</header><text display-inline="no-display-inline">The Secretary shall conduct an independent
			 evaluation of the activities funded under section 103. This evaluation shall
			 assess the following:</text>
				<paragraph id="HE856FD3FC1D947A79B5E1B0ED9FCB47C"><enum>(1)</enum><text>The impact of
			 evidence-based social and emotional learning programming on student achievement
			 and attainment.</text>
				</paragraph><paragraph id="HEB5C3A9595B7490E919267BAFFBD4668"><enum>(2)</enum><text>The impact of
			 evidence-based social and emotional learning on student behavioral
			 outcomes.</text>
				</paragraph><paragraph id="HC41E893127B645C08B25F21FAEC9ADCE"><enum>(3)</enum><text>The impact of
			 professional development in social and emotional learning programming on
			 program planning and implementation, teacher practice, and student
			 achievement.</text>
				</paragraph></section><section id="H9B9E69817FF048F7BDC4E16471B8B0D2"><enum>105.</enum><header>Definitions</header><text display-inline="no-display-inline">In this title:</text>
				<paragraph id="H9AD6F0FDFF0C42E395DEDF3A80CD385D"><enum>(1)</enum><header>Institution of
			 higher education</header><text>The term <quote>institution of higher
			 education</quote> has the meaning given such term in section 101 of the Higher
			 Education Act of 1965 (20 U.S.C. 1001).</text>
				</paragraph><paragraph id="HC6114817A6904369B0BAA24360F0D232"><enum>(2)</enum><header>Local
			 educational agency; State educational agency</header><text>The terms
			 <quote>local educational agency</quote> and <quote>State educational
			 agency</quote> have the meanings given the terms in section 9101 of the
			 Elementary and Secondary Education Act of 1965 (20 U.S.C. 7801).</text>
				</paragraph><paragraph id="HE6A8DA77D6CC4112BF9F80457E9CC05E"><enum>(3)</enum><header>Social and
			 emotional learning</header><text>The term <quote>social and emotional
			 learning</quote> is the process through which children and adults acquire the
			 knowledge, attitudes, and skills associated with the core areas of social and
			 emotional competency including—</text>
					<subparagraph id="H588BF64B77234A0D81267F2BB04B0C4C"><enum>(A)</enum><text display-inline="yes-display-inline">self-awareness and self management to
			 achieve school and life success, such as: identifying and recognizing
			 strengths, needs, emotions, values and self-efficacy, impulse control and
			 stress management, self-motivation and discipline, and goal setting and
			 organizational skills;</text>
					</subparagraph><subparagraph id="H4280B1AB5CEA472684F17B33C53A820F"><enum>(B)</enum><text>social awareness
			 and interpersonal skills to establish and maintain positive relationships, such
			 as: perspective taking and respect for others, communication, working
			 cooperatively, negotiation, conflict management, help seeking; and</text>
					</subparagraph><subparagraph id="H285FEAA445284A42AE85DD41A7394690"><enum>(C)</enum><text>decisionmaking
			 skills and responsible behaviors in personal, academic and community contexts,
			 such as: situational analysis, problem solving, reflection and personal, social
			 and ethical responsibility.</text>
					</subparagraph></paragraph><paragraph id="HCBC2205DD81048AFBB58AA03F5DF0072"><enum>(4)</enum><header>Social and
			 emotional learning programming</header><text>The term <quote>social and
			 emotional learning programming</quote> refers to classroom instruction and
			 schoolwide activities and initiatives that—</text>
					<subparagraph id="H51BD87D9FF244B67B5332EF22F6D1710"><enum>(A)</enum><text>integrate social
			 and emotional learning into school curriculum;</text>
					</subparagraph><subparagraph id="H48F15C3855194A9488B2979827A1C511"><enum>(B)</enum><text>provide systematic
			 instruction whereby social and emotional skills are taught, modeled, practiced,
			 and applied so that students use them as part of their daily behavior;</text>
					</subparagraph><subparagraph id="HEACB7DBB10794839BAC14D55D0DCF54F"><enum>(C)</enum><text>teach children to
			 apply social and emotional skills to prevent specific problem behaviors such as
			 substance use, violence, bullying, and school failure, and to promote positive
			 behaviors in class, school, and community activities; and</text>
					</subparagraph><subparagraph id="H7E27217D6AE746DE914A8D6F365105B9"><enum>(D)</enum><text>establish safe,
			 caring, learning environments that foster student participation, engagement,
			 and connection to learning and school.</text>
					</subparagraph></paragraph><paragraph id="H741E05B18370464A8E436335F322EB6E"><enum>(5)</enum><header>State</header><text>The
			 term <quote>State</quote> means each of the several States of the United
			 States, the District of Columbia, and the Commonwealth of Puerto Rico.</text>
				</paragraph></section><section id="HA8FD4E5AFFA84D08B35591FDE9C19E5C"><enum>106.</enum><header>Authorization
			 of appropriations</header><text display-inline="no-display-inline">There are
			 authorized to be appropriated to carry out this title—</text>
				<paragraph id="HF61A58349BD34F60894633D26158588C"><enum>(1)</enum><text>$5,000,000 for
			 fiscal year 2010 to carry out section 102;</text>
				</paragraph><paragraph id="H5B8F1821CA6D40008CDB96ECC4966C2E"><enum>(2)</enum><text>$30,000,000 for
			 fiscal year 2010 of which—</text>
					<subparagraph id="H745424352C344756883A47D2CC0E9C60"><enum>(A)</enum><text>5 percent shall be
			 reserved to carry out section 104;</text>
					</subparagraph><subparagraph id="HEC5F046AACF644D086FC71624D85DBAA"><enum>(B)</enum><text>25 percent shall
			 be reserved for grants to States under section 103; and</text>
					</subparagraph><subparagraph id="H705D7326C632496ABA8F9C775C73B798"><enum>(C)</enum><text>70 percent for
			 grants to local education agencies under section 103; and</text>
					</subparagraph></paragraph><paragraph id="HE199653FD7A347C69AF1B48A1D4982F4"><enum>(3)</enum><text>such sums as may
			 be necessary for fiscal years 2011 through 2014.</text>
				</paragraph></section></title><title id="H862DD16F048D4F85B2DF8BB39CA13CF8"><enum>II</enum><header>Elementary and
			 Secondary Education Act Amendments</header>
			<section id="HDBC38060F0E54640A401B5249D8BFF8B"><enum>201.</enum><header>Amendments to
			 the Elementary and Secondary Education Act</header>
				<subsection id="HA043F03C12B1495D873007C7196124CE"><enum>(a)</enum><header>School dropout
			 prevention initiative</header><text>Subpart 2 of part H of title I of the
			 Elementary and Secondary Education Act of 1965 (20 U.S.C. 6561 et seq.) is
			 amended—</text>
					<paragraph id="HA0E5D8866AA844CBBA720DE539445CFB"><enum>(1)</enum><text>in section
			 1822(b)(1), by redesignating subparagraphs (H) through (J) as subparagraphs (I)
			 through (K), respectively, and inserting after subparagraph (G) the following:</text>
