			 <quote><short-title>Department of Veterans Affairs Acquisition Improvement Act
			 of 2009</short-title></quote>.</text>
		</section><section id="H0FADB32C3B504CF99BA9FCFACE5D336A"><enum>2.</enum><header>Assistant
			 Secretary of Veterans Affairs for Acquisition, Construction, and Asset
			 Management; additional Deputy Assistant Secretaries</header>
			<subsection id="H906204E7423344078B436B02EA01DE34"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Section 308 of title
			 38, United States Code, is amended—</text>
				<paragraph id="H75BBB6FE11F2450A9EB9FE58ACA68720"><enum>(1)</enum><text>in subsection (b),
			 by adding at the end the following new paragraph:</text>
					<quoted-block display-inline="no-display-inline" id="H71495B15265B47A4AD5E48C8FBAA96BE" style="USC">
						<paragraph id="H11C55C0313E24604BCF02EA3E5C74FB1"><enum>(12)</enum><text>Acquisition,
				Construction, and Asset Management.</text>

				and</after-quoted-block></quoted-block>
				</paragraph><paragraph id="H24B30CF17D004327AE30EC4B18D1809F"><enum>(2)</enum><text>in subsection
			 (d)—</text>
					<subparagraph id="H3E8F20EE8D594412B884A1C2467E156D"><enum>(A)</enum><text>in paragraph (1),
			 by striking <quote>19</quote> and inserting <quote>26</quote>; and</text>
					</subparagraph><subparagraph id="H3BA3E0E8BD574261BE3962C816B9433E"><enum>(B)</enum><text>by inserting at
			 the end the following new paragraph:</text>

				Assistant Secretary to each of the following areas of responsibility:</text>
								<subparagraph id="H42E7E863DAA345D3A976611F04E6EE7A"><enum>(A)</enum><text>Information technology
				acquisition.</text>
								</subparagraph><subparagraph id="H95DBB3C96F0D4A20AB9ECBCFE48C61A9"><enum>(B)</enum><text>Acquisition services for the Veterans
				Benefits Administration, the National Cemetery Administration, and the
				Department headquarters.</text>
								</subparagraph><subparagraph id="H075A95D8D65E466980F52DEEE2A64D98"><enum>(C)</enum><text>Construction acquisitions and
				leasing.</text>
								</subparagraph><subparagraph id="HDF98E2DF98224B1A82DCCE0021355C94"><enum>(D)</enum><text>Acquisition services for the Veterans
				Health Administration.</text>
								</subparagraph><subparagraph id="H11777490B63145B192C5D44202079599"><enum>(E)</enum><text>National contracts, including
				contracts for health care products and services awarded by the National
				Acquisition Center (other than contracts for information technology).</text>
								</subparagraph><subparagraph id="HDD354890D4D44998B3F4EFD16A989124"><enum>(F)</enum><text>Policy.</text>
								</subparagraph><subparagraph id="H7F839390E9224C059FABBAA05AA8949A"><enum>(G)</enum><text>Asset Enterprise Management and
				Logistics.</text>
								</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
					</subparagraph></paragraph></subsection><subsection id="H637B3D115E93434D84BC7A8183448B4D"><enum>(b)</enum><header>Deadline for
			 appointments</header><text display-inline="yes-display-inline">By not later
			 than one year after the date of the enactment of this Act, the Secretary of
			 Veterans Affairs shall assign an individual to carry out the responsibilities
			 of the Assistant Secretary for Acquisition, Construction, and Asset Management,
			 pursuant to paragraph (12) of section 308(b) of title 38, United States Code,
			 as added by subsection (a), and individuals to carry out the responsibilities
			 of the Deputy Assistant Secretaries pursuant to section 308(d) of such title,
			 as amended by subsection (a).</text>
			</subsection></section><section id="H371A8E0F432F4ADBACEA8B70988723F9"><enum>3.</enum><header>Chief Acquisition
			 Officer</header>
			<subsection id="HAF1AF3B68B0E42808E0F3AECF9AA9680"><enum>(a)</enum><header>Establishment</header><text display-inline="yes-display-inline">Chapter 3 of title 38, United States Code,
			 is amended by inserting after section 310 the following new section:</text>
				<quoted-block display-inline="no-display-inline" id="H59B9946712AE471C969AB8C786E34D7A" style="USC">
					<section id="H6723FD78EE154B84A48F1F81684AE1DF"><enum>310A.</enum><header>Chief
				Acquisition Officer; other acquisition officers</header>
						<subsection id="H430B53FE67704161AE6C85DF6CCDD29D"><enum>(a)</enum><header>Establishment</header><text display-inline="yes-display-inline">There is in the Department a Chief
				Acquisition Officer. The Assistant Secretary for Acquisition, Construction, and
				Asset Management shall serve as the Chief Acquisition Officer.</text>
						</subsection><subsection id="HDE460BE349C24FD5857522A6C6C19EFA"><enum>(b)</enum><header>Responsibilities</header><text>In
				addition to the responsibilities of the Chief Acquisition Officer under section
				16 of the Office of Federal Procurement Policy Act (41 U.S.C. 414), the Chief
				Acquisition Officer shall carry out the following additional
				responsibilities:</text>
							<paragraph id="H19F48FD5BBAA4408B186AEEE69364E86"><enum>(1)</enum><text>Managing and
				monitoring the performance of Department acquisition activities.</text>
							</paragraph><paragraph id="HF6C75F7746C0467490069791E903A909"><enum>(2)</enum><text>Advising the
				Secretary on appropriate business strategies to meet the missions of the
				Department.</text>
							</paragraph><paragraph id="H80BE81276F644EDEA0F1B2B74C957918"><enum>(3)</enum><text>Awarding and
				administering contracts and purchases.</text>
							</paragraph><paragraph id="HF8978C4F5EC649A09FD9EA65714D35ED"><enum>(4)</enum><text>Increasing the use
				of full and open competition in the acquisitions processes of the
				Department.</text>
							</paragraph><paragraph id="H50D2C89C9840470597C538A19EF232B5"><enum>(5)</enum><text>Increasing the
				appropriate use of performance-based contracting and performance specifications
				in such processes.</text>
							</paragraph><paragraph id="H873B624870ED43EF92FAD6111CE5D7CC"><enum>(6)</enum><text>Ensuring that
				acquisitions decisions are consistent with applicable laws.</text>
							</paragraph><paragraph id="H2833C1A719844FF3926AC2654129C51B"><enum>(7)</enum><text>Managing the
				direction of acquisition policy for the Department.</text>
							</paragraph><paragraph id="H6177E5A11B3C4D4AADCD3733D2633AF9"><enum>(8)</enum><text display-inline="yes-display-inline">Establishing clear lines of authority,
				accountability, and responsibility for decision making within the Department
				with respect to acquisitions.</text>
							</paragraph><paragraph id="HC681B84C8E6F40F6B0A6589CF9985D9C"><enum>(9)</enum><text>Developing and
				maintaining an acquisition career management program.</text>
							</paragraph></subsection><subsection id="HF4D6BDBE74964BC8ADBA856B4DA1C131"><enum>(c)</enum><header>Qualifications</header><text>The
				individual appointed as Chief Acquisition Officer shall have the following
				qualifications:</text>
							<paragraph id="H84617385B9B74FB1B2F2BD3F0436208E"><enum>(1)</enum><text>Executive
				experience in acquisition in the Federal Government—</text>
								<subparagraph id="HCEDEAA4C0CEC437EB98C8E29C31FECEC"><enum>(A)</enum><text>managing large
				projects or having responsibility for managing a corporate-type supply chain
				function;</text>
								</subparagraph><subparagraph id="HC815F807A69D4C34869D5E9E99A99AB2"><enum>(B)</enum><text>defining and
				achieving performance results;</text>
								</subparagraph><subparagraph id="H7344123A544C439687695C2522E0B6A6"><enum>(C)</enum><text>developing,
				negotiating, delivering, and managing successful and complex business
				arrangements across large organizations with competing interests;</text>
								</subparagraph><subparagraph id="HB61BA75247D64B0D84EA59B15C2A21E4"><enum>(D)</enum><text>building and
				managing executive relationships across organizational and functional
				boundaries; and</text>
								</subparagraph><subparagraph id="H9254878C23D94AFB90940CF2B2867CEE"><enum>(E)</enum><text>successfully using
				strategic resource management to achieve organizational goals.</text>
								</subparagraph></paragraph><paragraph id="H7FA6E77870AD4ECE8572C8221C0F5F9A"><enum>(2)</enum><text>Knowledge of the
				Federal Acquisition Regulation.</text>
							</paragraph><paragraph id="HB1744036C169453A98529ED4745D3A2F"><enum>(3)</enum><text>Knowledge of the
				Federal budget, appropriations, and legislative processes.</text>
							</paragraph></subsection><subsection id="H7B73F0AFC25946E49648A1B3DCFD65DC"><enum>(d)</enum><header>Acquisition
				workforce</header><text>All employees of the Department whose responsibilities
				relate to acquisition shall report directly to the Chief Acquisition Officer.
				Beginning on the date of the enactment of this section, no new employee may be
				hired as a Head of Contracting Authority or Chief Logistics Officer unless the
				Principal Deputy Assistant Secretary for Acquisition, Construction, and Asset
				Management approves the hire.</text>
						</subsection><subsection id="H1BA0666506EA465B960562B4253E5187"><enum>(e)</enum><header>Principal Deputy
				Assistant Secretary for Acquisition, Construction, and Asset
				Management</header><paragraph commented="no" display-inline="yes-display-inline" id="H406256787C884EC0B482C535375039BC"><enum>(1)</enum><text display-inline="yes-display-inline">There is in the Department a Principal
				Deputy Assistant Secretary for Acquisition, Construction, and Asset Management.
				The Principal Deputy Assistance Secretary for Acquisition, Construction, and
				Asset Management shall be the senior procurement executive for the Department
				and shall report directly to the Chief Acquisition Officer.</text>
							</paragraph><paragraph id="H47E02EEBBADD441FBD710769F547D136" indent="up1"><enum>(2)</enum><text display-inline="yes-display-inline">The position of Principal Deputy Assistant
				Secretary for Acquisition, Construction, and Asset Management shall for all
				purposes be considered to be a career reserve position within the meaning of
				section 3132(a)(8) of title 5.</text>
							</paragraph><paragraph id="H88EAE2E8D3F54BBC919A77813E6A40D6" indent="up1"><enum>(3)</enum><text display-inline="yes-display-inline">The Principal Deputy Assistant Secretary
				for Acquisition, Construction, and Asset Management shall have primary
				responsibility for the following:</text>
								<subparagraph id="H7CE931DCECE047158CAE4AAB292F7759"><enum>(A)</enum><text>Acquisition policy and
				oversight.</text>
								</subparagraph><subparagraph id="H77B2DE8B96C54D9A9530DC65CF74A0BB"><enum>(B)</enum><text>Oversight of the Office of the
				Business Ombudsman, including the Competition Advocate and the Office of
				Business Oversight.</text>
								</subparagraph><subparagraph id="HFA685505353149CF9D8FCCE6A7F12302"><enum>(C)</enum><text>Training, management, and oversight of
				the acquisition workforce, including the Acquisition Academy of the
				Department.</text>
								</subparagraph><subparagraph id="H557A038E12C7488F85F88A1303E6B552"><enum>(D)</enum><text>Management and oversight of the Deputy
				Assistant Secretary responsible for awarding and administering contracts and
				purchases.</text>
								</subparagraph></paragraph></subsection><subsection id="H622AD8DC38DA4507934BB91447798B1F"><enum>(f)</enum><header>Deputy Assistant
				Secretaries for Acquisition</header><text>There are in the Department seven
				Deputy Assistant Secretaries for Acquisition who shall report directly to the
				Principal Deputy Assistant for Acquisition, Construction, and Asset Management.
				The Secretary or the Secretary’s designee shall assign to each Deputy Assistant
				Secretary one of the following functions:</text>
							<paragraph id="HEF0CF646DEEA4FCAA2C5CD4DF3E76E40"><enum>(1)</enum><text>Information
				technology acquisition.</text>
							</paragraph><paragraph id="H7B8BA1D719994F9488EA687440942B1E"><enum>(2)</enum><text display-inline="yes-display-inline">Acquisition services for the Veterans
				Benefits Administration, the National Cemetery Administration and the
				Department headquarters.</text>
							</paragraph><paragraph id="H60533824CEBF4757B926F63A6936F54B"><enum>(3)</enum><text>Construction
				acquisition and leasing.</text>
							</paragraph><paragraph id="HE616DEF254394878945CB7A957B84BDD"><enum>(4)</enum><text>Veterans Health
				Administration acquisition.</text>
							</paragraph><paragraph id="H93B48F0F40A446C1AA7E3A3381F0C859"><enum>(5)</enum><text>National
				contracts, including contracts for health care products and services awarded by
				the National Acquisition Center.</text>
							</paragraph><paragraph id="HF8875BEB89E44ABCA370850B6E17E783"><enum>(6)</enum><text>Policy.</text>
							</paragraph><paragraph id="HFF8354F277214AE0AF3E068266963D9F"><enum>(7)</enum><text>Asset enterprise
				management and
				logistics.</text>
							</paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="HE36631E4DE5B43BFBF5A93489BEE0E1A"><enum>(b)</enum><header>Clerical
			 amendment</header><text>The table of sections at the beginning of such chapter
			 is amended by inserting after the item relating to section 310 the following
			 new item:</text>

			</subsection><subsection id="HCC1E15B650724AE2B2042832D9E4E0EC"><enum>(c)</enum><header>Deadline for
			 designations</header>
				<paragraph id="HB8F0EB39EC4F4577A74A9FB18B7B8D5B"><enum>(1)</enum><header>Deadline for
			 plan</header><text>Not later than 180 days after the date of the enactment of
			 this Act, the Secretary of Veterans Affairs shall submit to Congress a plan for
			 implementing section 310A of title 38, United States Code, as added by
			 subsection (a).</text>
				</paragraph><paragraph id="H32B66BA6AFCC4585BBBC80FD07B392D8"><enum>(2)</enum><header>Deadline for
			 implementation</header><text>Not later than 18 months after the date of the
			 enactment of this Act, the Secretary of Veterans Affairs shall fully implement
			 the plan submitted under paragraph (1).</text>
				</paragraph></subsection></section><section id="H4D0B6D01C99F41B3A8AD3F5AD0CBB212"><enum>4.</enum><header>Acquisition
			 policy of Department of Veterans Affairs</header>
			<subsection id="H2D2BE2C11FD042D39C8E9E1E596DE64B"><enum>(a)</enum><header>Department-Wide
			 policy required</header>
				<paragraph id="HFB5A5452A7E24C8EA98FD0C891016D20"><enum>(1)</enum><header>Requirement</header><text>Subchapter
			 II of chapter 81 of title 38, United States Code, is amended by adding at the
			 end the following new section:</text>
					<quoted-block id="H432D6E1C0B87412594C6705D586E4F8D" style="USC">
						<section id="HE2F86571608A440EACC7C0C747FDFEB3"><enum>8129.</enum><header>Department-wide
				acquisition policy</header>
							<subsection id="HD946D5B07C474BE18677092C0F4559FB"><enum>(a)</enum><header>Policy
				required</header><text>The Secretary shall establish and maintain a
				comprehensive Department-wide acquisition program under which the Secretary
				shall develop, implement, and enforce a streamlined approach to entering into
				contracts and purchasing goods and services. Such program shall include the
				elements described in subsection (b).</text>
							</subsection><subsection id="HA31F88BB2A1A48CAB1E8C4E02230308E"><enum>(b)</enum><header>Elements</header><text>The
				Secretary shall ensure that the Department-wide acquisition program includes
				the following elements:</text>
								<paragraph id="H99E9C8087018419A98D1A428FC56240A"><enum>(1)</enum><text>The centralization
				under the Chief Acquisition Officer of all contracting activities of the
				Department, including purchasing, and including all contracting activities
				carried out by each Administration and staff office of the Department as of the
				date of the enactment of this section.</text>
								</paragraph><paragraph id="H96AC06D9F72942679E996965B39FED4A"><enum>(2)</enum><text>The establishment
				of acquisition goals to meet the mission needs of the Department.</text>
								</paragraph><paragraph id="HEC6E27232A0441B9A53FC956995B6F9E"><enum>(3)</enum><text>The development of
				Department requirements with respect to acquisition.</text>
								</paragraph><paragraph id="HE6F0D3DFC71642A4A5E3892B58889C14"><enum>(4)</enum><text>The establishment
				of an overall acquisition strategy for the Department.</text>
								</paragraph><paragraph id="H960D8268047440BB8525D265E217A67D"><enum>(5)</enum><text>Soliciting and
				awarding contracts.</text>
								</paragraph><paragraph id="H81C736E6700243E3ABE211D9FAD07302"><enum>(6)</enum><text>The management of
				acquisition system and contract performance.</text>
								</paragraph></subsection><subsection id="H3BC8BCD4000041F488C681AE2442E6E4"><enum>(c)</enum><header>Acquisition
				requirements</header><paragraph commented="no" display-inline="yes-display-inline" id="H0754224CF9B64562AA05A07A72534F11"><enum>(1)</enum><text>Except as provided in
				paragraph (2), an acquisition of any health care item by the Department shall
				be made through the use of a Federal supply schedule 65 or 66 contract awarded
				by the Department or a national contract that is awarded by or approved by the
				Department.</text>
								</paragraph><paragraph id="HE60C793903DD4E0DB5A3EDEA675CB2D6" indent="up1"><enum>(2)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="H4A8C0ABBA12945EEB36B7C3E3599DF7F"><enum>(A)</enum><text>Paragraph (1) does not
				apply to an acquisition of a health care item in any of the following
				cases:</text>
										<clause id="HC907F614860C48A8A8D31F52A481D208" indent="up1"><enum>(i)</enum><text>An acquisition necessary to meet a
				current or near-term medical emergency at a medical center.</text>
										</clause><clause id="H8E456D87CC9B4F7D9A2A89E96384C670" indent="up1"><enum>(ii)</enum><text>An acquisition for an item not listed
				in the Federal supply schedule or as part of a national contract and for which
				there is a valid clinical need.</text>
										</clause><clause id="H66871EA8FD404526BF85F6C43406C5FF" indent="up1"><enum>(iii)</enum><text>An acquisition for a specialized
				health care item not listed in the Federal supply schedule or as part of a
				national contract for the special needs of an individual patient who has one of
				the special needs identified in section 1706(b) of this title and who has a
				valid clinical need for the item.</text>
										</clause><clause id="H4D03BC50752C421D88001F088452EB0B" indent="up1"><enum>(iv)</enum><text>An acquisition that is part of an
				approved sharing agreement between the Department of Defense and the Department
				of Veterans Affairs with demonstrable cost-per-item savings for an item listed
				on the Federal supply schedule or a national contract.</text>
										</clause></subparagraph><subparagraph id="HF1D103C41A684E5AAC7795F9F71A8EB4" indent="up1"><enum>(B)</enum><text>An acquisition referred to in any of
				clauses (i) through (v) of subparagraph (A) may be made only if the acquisition
				is specifically authorized in advance in writing by the Secretary. The
				authority of the Secretary under the preceding sentence with respect to
				contracts awarded by the Department may be delegated only to the Assistant
				Secretary for Acquisition, Construction, and Asset Management.</text>
									</subparagraph></paragraph><paragraph id="H2A9DF3F3359A42AAAAC7261F9EB0DFD0" indent="up1"><enum>(3)</enum><text>Before entering into either a new
				Federal supply schedule contract or a new national contract, the Chief
				Acquisition Officer may amend any clause of the Federal Acquisition Regulation
				otherwise required to be included in the contract in such manner as the Chief
				Acquisition Officer determines necessary to protect the interests of the
				Government.</text>
								</paragraph><paragraph id="HCD36042CAB314734ACE180824DFE320B" indent="up1"><enum>(4)</enum><text>In the case of an emergency
				acquisition of a health care item under paragraph (2)(B), the quantity of the
				item procured may not exceed the quantity of that item that meets the
				reasonably foreseeable need for the item at the medical facility concerned
				until resupply can be achieved through an acquisition action other than an
				emergency acquisition.</text>
								</paragraph></subsection><subsection id="H4BBF7222091341F388E54E2625C1A7D1"><enum>(d)</enum><header>Procedures To
				assure compliance</header><paragraph commented="no" display-inline="yes-display-inline" id="H0E7FD28D01274B5A95A6BCB7AF121DA1"><enum>(1)</enum><text>The Secretary shall
				establish procedures to assure compliance by each Department medical facility
				with the provisions of this section and with applicable Federal and Department
				acquisition regulations.</text>
								</paragraph><paragraph id="HD6013033149A4821A91E0EC8DED630D3" indent="up1"><enum>(2)</enum><text>The procedures established by the
				Secretary under paragraph (1) shall be designed to maximize the availability of
				health care items and the use of the Federal supply schedule by the
				Department.</text>
								</paragraph><paragraph id="H4B69F7D41D1643D18BC507A43AB5B563" indent="up1"><enum>(3)</enum><text>The procedures established by the
				Secretary under paragraph (1) shall include procedures designed to standardize
				items at the local, regional, or national level to provide special patient
				populations (as identified in section 1706(b) of this title) with the range and
				types of health care items required to meet their clinical and quality-of-life
				needs.</text>
								</paragraph><paragraph id="HE94F64A7C3594918BBCCA6DA8E149F07" indent="up1"><enum>(4)</enum><text>The Advisory Committee on Prosthetics
				and Special-Disabilities Programs established under section 543 of this title
				shall review the procedures referred to in paragraph (3), including the
				implementation of those procedures.</text>
								</paragraph></subsection><subsection id="H2A85DE5DC13A4E94AC382093693DCA5A"><enum>(e)</enum><header>Annual
				goals</header><paragraph commented="no" display-inline="yes-display-inline" id="H7EB64A11F3CF4D4F8ACA53DF14F9A2A1"><enum>(1)</enum><text>The
				Secretary shall establish annual goals for Department medical facilities for
				the purchase of health care items from Federal supply schedule contracts and
				national contracts meeting the requirements of subsection (d). Such goals shall
				be designed to maximize the percentage of such purchases that are made through
				such contracts.</text>
								</paragraph><paragraph id="H000D83C037874726886E3B1EAFD0544F" indent="up1"><enum>(2)</enum><text>Achievement of the goals established
				under this subsection shall be an element in the performance standards for
				employees of the Department who have the authority and responsibility for
				achieving those goals.</text>
								</paragraph></subsection><subsection display-inline="no-display-inline" id="H8CCA3C8649854A68B3245570D7010E84"><enum>(f)</enum><header>Relationship to
				other provisions of law</header><text>A provision of law that is inconsistent
				with any provision of this section shall not apply, to the extent of the
				inconsistency, to the acquisition of a health care item for the
				Department.</text>
							</subsection><subsection id="HA4867F9B1BF648A69C74512AFBF632CB"><enum>(g)</enum><header>Report</header><paragraph commented="no" display-inline="yes-display-inline" id="HD7B3A57B30B84AB0BB455AC8E702F4E6"><enum>(1)</enum><text>Not later than December
				31 each year, the Secretary shall submit to the Committees on Veterans’ Affairs
				of the Senate and House of Representatives a report on the acquisition of
				health care items during the preceding fiscal year. Each such report shall
				include, for the year covered by the report, the following:</text>
									<subparagraph id="HFC25B944896D46E48CF30120207CC932" indent="up1"><enum>(A)</enum><text>The total dollar amount of all items
				listed in Federal supply schedule 65 or 66 and the total dollar value of the
				exceptions to subsection (c)(1) under each of clauses (i), (ii), (ii), (iv),
				and (v) of subsection (c)(2)(A), shown by medical facility.</text>
									</subparagraph><subparagraph id="HC13B3E074DC74A77A47F77BE385E7C8A" indent="up1"><enum>(B)</enum><text>A detailed explanation for such
				exceptions, including—</text>
										<clause id="HDD9D3F05E51742C7B49CCDFF6F061C4A"><enum>(i)</enum><text>any uses of emergency acquisition
				authority at Department medical facilities;</text>
										</clause><clause id="H6A8B62BDA9EB4AAABF8E20A25F3A2DAE"><enum>(ii)</enum><text>any authorizations under
				subsection (c)(2)(A) for acquisition of items not listed on the Federal supply
				schedules or on national contracts; and</text>
										</clause><clause id="H3AD10E01502749ABA8B492444AD9BACA"><enum>(iii)</enum><text>any exceptions granted for
				special health care needs of veterans with disabilities described in section
				1706(b) of this title.</text>
										</clause></subparagraph><subparagraph id="H20BC65ABE39E410BAB14385CE538FA04" indent="up1"><enum>(C)</enum><text>An analysis of sharing agreements
				between the Department and the Department of Defense, including the basic
				sharing initiative and the division of financial responsibility between the two
				Departments.</text>
									</subparagraph><subparagraph id="HE8BB267D5C914C99814093440432E7F0" indent="up1"><enum>(D)</enum><text>The stated Department goal under each
				acquisition preference program, together with an assessment of the performance
				of the Department toward achievement of such goals, including any goals for
				contracting with businesses that are owned and controlled by veterans or
				veterans with service-connected disabilities.</text>
									</subparagraph></paragraph><paragraph id="H5488F092DC54484D820EF7ED4F3A7440" indent="up1"><enum>(2)</enum><text>The Advisory Committee on Prosthetics
				and Special-Disabilities Programs of the Department shall submit comments on
				each report under paragraph (1) before the report is submitted under that
				paragraph, and the Secretary shall include those comments in the report as
				submitted.</text>
								</paragraph><paragraph display-inline="no-display-inline" id="H48D8512547224B2F9AD6C4BDB2C33AF6" indent="up1"><enum>(3)</enum><text>For the purposes of this
				subsection:</text>
									<subparagraph id="HE3B589E2670B40F1BB12115588EA11C8"><enum>(A)</enum><text>The term <term>health care item</term>
				includes any item other than services listed in any Federal Supply
				Classification other than Federal supply schedule 65 or 66 over which the
				Department has been delegated authority.</text>
									</subparagraph><subparagraph id="H8FA9935DA1BC4E63A3B4C5BB48F5295A"><enum>(B)</enum><text>The term <term>national
				contract</term> means a contract for the acquisition of an item that is entered
				into by the National Acquisition Center of the Department or another Department
				acquisition activity, as authorized by the Secretary, that is available for use
				by all Department medical facilities.</text>
									</subparagraph><subparagraph id="H03C487A0C28F43F59A052DEB702772B5"><enum>(C)</enum><text>The term <term>valid clinical
				need</term> means a clinical need that is valid in the professional judgment of
				an appropriate clinician. Such term applies to health care items, prosthetic
				appliances, sensory or mobility aids and supplies that are prescribed by a
				physician for special patient populations such as veterans with spinal cord
				dysfunction, blindness, amputations, and other veterans included in section
				1706(b) of this title.</text>
									</subparagraph><subparagraph id="HDC8A1F0AE87A40EE8583352BEA487FA8"><enum>(D)</enum><text>The term <term>Federal supply schedule
				contract</term> means a contract that is awarded and administered by the
				National Acquisition Center of the Department, under a delegation of authority
				as of the date of the enactment of this section or a contract that is awarded
				and administered by the Department under regulations prescribed under section
				8130 of this title.</text>
									</subparagraph><subparagraph id="H4DF53D18C6CD4BF5A6D0D62F672A5854"><enum>(E)</enum><text>The term <term>emergency
				acquisition</term> means an acquisition necessary to meet an emergency need
				affecting the health or safety of a person being furnished health care services
				by the
				Department.</text>
									</subparagraph></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph><paragraph id="HE65FABD729EE4A6CA654E9902D122D9F"><enum>(2)</enum><header>Clerical
			 amendment</header><text>The table of sections at the beginning of such chapter
			 is amended by inserting after the item relating to section 8128 the following
			 new item:</text>

				</paragraph></subsection><subsection id="H4DE20BE4F6F545F1AAA1749B8D24AA36"><enum>(b)</enum><header>Deadline for
			 implementation</header><text>The acquisition policy required by section 8129 of
			 title 38, United States Code, as added by subsection (a), shall be fully
			 implemented by the date that is 18 months after the date of the enactment of
			 this Act.</text>
			</subsection></section><section id="HBBC4BBA98D3E44B8A42FFF6778D097D7"><enum>5.</enum><header>Authority for
			 Secretary of Veterans Affairs to enter into certain personal services
			 contracts</header>
			<subsection id="HAE8ECA9AF29A4794A527F0DDFB22E74E"><enum>(a)</enum><header>Contracts for
			 scarce medical specialist services</header><text>Section 7409(a) of title 38,
			 United States Code, is amended, in the first sentence, by inserting <quote>,
			 including personal services contracts,</quote> after
			 <quote>contracts</quote>.</text>
			</subsection><subsection id="HE5D1DBA98BCD442881197BDED32C634D"><enum>(b)</enum><header>Sharing of
			 health care resources with Department of Defense</header><text>Section 8111(a)
			 of such title is amended by inserting <quote>, including personal services
			 contracts,</quote> after <quote>contracts</quote>.</text>
			</subsection><subsection id="H537F7F5F74314C89A1F17FE23F994C18"><enum>(c)</enum><header>Sharing of
			 health care resources</header><text>Section 8153(a) of such title is amended by
			 inserting <quote>, including a personal services contract,</quote> after
			 <quote>contract</quote>.</text>
			</subsection><subsection id="HF6EAC7A26A274590B0A8348905989802"><enum>(d)</enum><header>Deadline for
			 regulations</header><text>Not later than 180 days after the date of the
			 enactment of this Act, the Secretary of Veterans Affairs shall prescribe
			 regulations to carry out the amendments made by this section.</text>
			</subsection></section><section id="H1A646DADEBD14DAA9C689423664199C9"><enum>6.</enum><header>Award and
			 administration of certain Federal supply schedules by Secretary of Veterans
			 Affairs</header>
			<subsection id="HBB94A55E0D9643BAA76AB6089D618816"><enum>(a)</enum><header>Expansion of
			 definition of competitive procedures</header><text display-inline="yes-display-inline">Section 309(b) of the Federal Property and
			 Administrative Services Act of 1949 (41 U.S.C. 259) is amended—</text>
				<paragraph id="H59597ED978E547028FA041285B22CE55"><enum>(1)</enum><text>in paragraph (4),
			 by striking <quote>and</quote> at the end;</text>
				</paragraph><paragraph id="HEDBB1ECFF23D4D349325089E33D98035"><enum>(2)</enum><text>in paragraph (5),
			 by striking the period and inserting <quote>; and</quote>; and</text>
				</paragraph><paragraph id="H523EBE9985AD41E68AE10EAB8BA5DC19"><enum>(3)</enum><text>by adding at the
			 end the following new paragraph:</text>
					<quoted-block display-inline="no-display-inline" id="HB35A33E196064F4AB7F3C5C48A0F1A4F" style="OLC">
						<paragraph id="H5CCA7E0BB7C24793B1D9005E038B3120"><enum>(6)</enum><text display-inline="yes-display-inline">the procedures established by the Secretary
				of Veterans Affairs for the use of certain Federal supply schedules, pursuant
				to regulations prescribed under section 8130 of title 38, United States Code,
				if—</text>
							<subparagraph id="HED05D8F98CD74F6489168B368979EEFE"><enum>(A)</enum><text>the procedures
				provide that the use of any such supply schedule has been open to all
				responsible sources; and</text>
							</subparagraph><subparagraph id="H4B5CE67D55A7405D985522B43513A217"><enum>(B)</enum><text display-inline="yes-display-inline">orders and contracts under such procedures
				result in the lowest cost alternative to meet the needs of the
				Government.</text>
							</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="H6491A798780B4F4E86BCB07BB0FC12FD"><enum>(b)</enum><header>Authority of
			 Secretary of Veterans Affairs</header>
				<paragraph id="H307944A3FBAC42C3BFF8036E5FF3A4C3"><enum>(1)</enum><header>In
			 general</header><text>Subchapter II of chapter 81 of title 38, United States
			 Code, as amended by section 3, is further amended by adding at the end the
			 following new section:</text>
					<quoted-block display-inline="no-display-inline" id="HA76E1264447345E2B57BA2AA2DF8CF31" style="USC">
						<section id="HD01D0202C11A42A2B5A6F4F7FE79B1F1"><enum>8130.</enum><header>Award and
				administration of certain Federal supply schedules</header>
							<subsection id="H86178208EB99477186F4D995EAB2B0E5"><enum>(a)</enum><header>Regulations</header><text display-inline="yes-display-inline">The Secretary shall prescribe regulations
				to provide procedures for soliciting, negotiating, awarding, and administering
				the Federal supply schedules described in subsection (c).</text>
							</subsection><subsection id="H60F6642000C54545974A1A88C71147F8"><enum>(b)</enum><header>Contract clause
				requirements</header><text>The regulations prescribed under subsection (a)
				shall require that a contract entered into by the Secretary under a Federal
				supply schedule shall include pre- and post-award audit clauses, an economic
				price adjustment clause, a price reductions clause, and a price adjustment for
				failure to provide accurate information clause.</text>
							</subsection><subsection id="H615806BFB3B94554A2B02D1FA9590129"><enum>(c)</enum><header>Applicability</header><text>This
				section shall apply with respect to any Federal supply schedule for which the
				authority to administer such schedule is transferred from the Administrator of
				General Services to the Secretary of Veterans Affairs, whether such authority
				is transferred before, on, or after the date of the enactment of this
				section.</text>
							</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph><paragraph id="HD2A47C5C20D9450085EA3AF8C6277222"><enum>(2)</enum><header>General Services
			 Administration rules and regulations</header><text>Until the Secretary of
			 Veterans Affairs prescribes regulations under section 8130(a) of title 38,
			 United States Code (as added by paragraph (1)), the Secretary shall comply with
			 the rules and regulations relating to the Federal supply schedules prescribed
			 by the Administrator of General Services that were in effect on the date of the
			 enactment of this Act.</text>
				</paragraph><paragraph id="H5D02CC3ADC4E4E50B003BB78BE70677F"><enum>(3)</enum><header>Clerical
			 amendment</header><text display-inline="yes-display-inline">The table of
			 sections at the beginning of such chapter is amended by inserting after the
			 item relating to section 8130, as added by section 3, the following new
			 item:</text>

				</paragraph></subsection></section><section id="HE0402EE81C054345AF555936E70A60BA"><enum>7.</enum><header>Improvement of
			 Department of Veterans Affairs small business contracting goals</header>
			<subsection id="H3A646E879AB04F11817729BB57E9D151"><enum>(a)</enum><header>Additional
			 requirement</header><text display-inline="yes-display-inline">Section 8127(c)
			 of title 38, United States Code, is amended—</text>
				<paragraph display-inline="no-display-inline" id="H332F4F8E425B45FB9DABA813AC281C44"><enum>(1)</enum><text>in paragraph (2),
			 by striking <quote>and</quote> at the end;</text>
				</paragraph><paragraph id="H4A65DA5D838543D3AEADBC630D69BB31"><enum>(2)</enum><text>in paragraph (3),
			 by striking the period and inserting the following: <quote>; and</quote>;
			 and</text>
				</paragraph><paragraph id="H1616D5F016AD4B4D8578A2014CB9F4CB"><enum>(3)</enum><text>by adding at the
			 end the following new paragraph:</text>
					<quoted-block display-inline="no-display-inline" id="H941A3193DE614716B4B2849D914C9F17" style="USC">
						<paragraph id="HF291D9D8A8B048E387C2638D335481A0"><enum>(4)</enum><text display-inline="yes-display-inline">in the case of a contract for the purchase
				of a commercial item, the vendor of the item is a manufacturer or a regular
				dealer.</text>
						</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="HD23A2DF23A6B417CA5EC53935B1815F9"><enum>(b)</enum><header>Complaint
			 process for use of restricted competition</header><text>Subsection (d) of such
			 section is amended—</text>
				<paragraph id="H7FFDD62E4856449697EA7C05448AA0E7"><enum>(1)</enum><text>by striking
			 <quote>Except as provided</quote> and inserting <quote>(1) Except as
			 provided</quote>; and</text>
				</paragraph><paragraph id="H47D1F4A9B1AC4B8FA59FA23E363672EF"><enum>(2)</enum><text>by adding at the
			 end the following new paragraph:</text>
					<quoted-block display-inline="no-display-inline" id="H96D10A24CA2149CDA88CD39F841EF79C" style="USC">
						<paragraph id="H15D4EEF232634C2B8CCB79B8D1BB84DE" indent="up1"><enum>(2)</enum><text display-inline="yes-display-inline">Any complaint regarding the noncompliance
				of a contracting officer with this subsection shall be submitted to the
				Secretary.</text>
						</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="HB45C487EC7AD47C9A0AB62A2AEAA7A3A"><enum>(c)</enum><header>Eligibility</header><text display-inline="yes-display-inline">Subsection (e) of such section is
			 amended—</text>
				<paragraph id="HC3A2B5213E0045A9BDDCCC139659A76E"><enum>(1)</enum><text>by striking
			 <quote>only if the small business concern and the veteran</quote> and all that
			 follows and inserting <quote>only if—</quote>; and</text>
				</paragraph><paragraph id="HC8BA5B1CEB584ADAA7B24CD4826493B8"><enum>(2)</enum><text>by adding at the
			 end the following new paragraphs:</text>
					<quoted-block display-inline="no-display-inline" id="H3FE1CCDF8694445494CB6CCA908399A9" style="USC">
						<paragraph id="H1C6F67F86F64412682B8C40DA48E3D91"><enum>(1)</enum><text display-inline="yes-display-inline">the small business concern and the veteran
				owner of the small business concern are listed in the database of veteran-owned
				businesses maintained by the Secretary under subsection (f);</text>
						</paragraph><paragraph id="HC0309B1EF77F4D1DBDBC1915D91699CC"><enum>(2)</enum><text>the Secretary has
				performed the verification functions of the Secretary under paragraph (4) of
				such subsection with respect to the small business concern; and</text>
						</paragraph><paragraph id="HF570CA20E4BA43818AF9CB6E6C67BA47"><enum>(3)</enum><text>the contract is
				only for the procurement of a good or service with an North American Industry
				Classification System code specified by the Secretary under paragraph (9) of
				that subsection for the small business
				concern.</text>
						</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="H8E6FF90B6B3647D8BAF3D2C5777BD6DC"><enum>(d)</enum><header>Database</header><text>Subsection
			 (f) of such section is amended by adding at the end the following new
			 paragraphs:</text>
				<quoted-block display-inline="no-display-inline" id="H9A5FE4AA36054862ADDF02CA7105E9F8" style="USC">
					<paragraph id="HAD7A7ECF99AB4C72AF0A2356105D45FB" indent="up1"><enum>(7)</enum><text display-inline="yes-display-inline">The Secretary may not include in the
				database a small business concern that is the vendor of a commercial item
				unless the concern is the manufacturer or regular dealer of the item, unless
				the Secretary specifically provides for a waiver of such requirement for such
				concern.</text>
					</paragraph><paragraph id="H8EA6D25CA39C419DB95A80E4015C276A" indent="up1"><enum>(8)</enum><text>The Secretary shall establish
				specific criteria to be used in carrying out the verification functions under
				paragraph (4), including criteria requiring specific documentation and
				certifications from each small business concern proposed to be included in the
				database.</text>
					</paragraph><paragraph id="HD6E15B2F3A1C4FA4A0D883301E55DDF8" indent="up1"><enum>(9)</enum><text>For each small business concern
				included in the database, the Secretary shall specify the North American
				Industry Classification System code or codes of the goods and services that may
				be procured by the Department from such
				concern.</text>
					</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H19049E0744024D68BC384473BED0FB37"><enum>(e)</enum><header>Definitions</header><text>Subsection
			 (l) of such section is amended by adding at the end the following new
			 items:</text>
				<quoted-block display-inline="no-display-inline" id="H71DD3B64687E489DA4C481C5A47F0271" style="USC">
					<paragraph id="HBE14E2AAEF8E49059FD6906F23975237"><enum>(3)</enum><text display-inline="yes-display-inline">The term <quote>commercial item</quote> has
				the meaning given that term in section 4(12) of the Office of Federal
				Procurement Policy Act (41 U.S.C. 203(12)) as long as items and services
				directly relating to the sale of such a commercial item are offered to
				commercial customers.</text>
					</paragraph><paragraph id="HF8DF3CDFC4AB48E6B0237DAD4AB3A0C0"><enum>(4)</enum><text>The term
				<quote>management and daily business operations</quote> includes—</text>
						<subparagraph id="H06E1634BC2B1434FA9848CF1DA566F25"><enum>(A)</enum><text>with respect to a
				contract for the provision of services, the services to be performed by a
				contract awarded under this section; and</text>
						</subparagraph><subparagraph id="HED499AC281004578AE146EB38DB1C6CD"><enum>(B)</enum><text>with respect to a
				contract for the provision of goods that are not manufactured by the small
				business concern in question, the provision of services relating directly to
				the sale of such goods.</text>
						</subparagraph></paragraph><paragraph id="H0E93A17D98E442C5A1AF074821FE0AF9"><enum>(5)</enum><text>The term
				<quote>regular dealer</quote> with respect to any contract means a person who
				owns, operates, or maintains a store, warehouse, or other establishment in
				which the commodities or goods of the general character described by the
				specifications and required under the contract are bought, kept in stock, and
				sold to the public in the usual course of
				business.</text>
					</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H2ADB8EFF3417408499477DB4A0547239"><enum>(f)</enum><header>Deadline for
			 establishment of criteria</header><text>Not later than 180 days after the date
			 of the enactment of this Act, the Secretary of Veterans Affairs shall establish
			 criteria for the use of sole source contracts for Department of Veterans
			 Affairs contracts above the simplified acquisition threshold.</text>
