		<official-title display="yes">To amend the Internal Revenue Code of 1986
		  to repeal the new carryover basis rules in order to prevent tax increases and
		  the imposition of compliance burdens on many more estates than would benefit
		  from repeal, to retain the estate tax with a $3,500,000 exemption, to
		  reinstitute and update the Pay-As-You-Go requirement of budget neutrality on
		  new tax and mandatory spending legislation, enforced by the threat of annual,
		  automatic sequestration, and for other purposes. </official-title>

				<subsection id="H53770D9C03024585AD7E1CECA91C9C19"><enum>(a)</enum><header>In
			 general</header><text>Subtitles A and E of title V of the Economic Growth and
			 Tax Relief Reconciliation Act of 2001, and the amendments made by such
			 subtitles, are hereby repealed; and the Internal Revenue Code of 1986 shall be
			 applied as if such subtitles, and amendments, had never been enacted.</text>
				</subsection><subsection id="H0C5365DC1F4B4FA2896A72C67F254706"><enum>(b)</enum><header>Sunset not To
			 apply</header><text display-inline="yes-display-inline">Section 901 of the
			 Economic Growth and Tax Relief Reconciliation Act of 2001 shall not apply to
			 title V of such Act.</text>
				</subsection><subsection id="H006BC01A11374A3BBA0976108581656B"><enum>(c)</enum><header>Conforming
			 amendments</header>
					<paragraph id="H48171A105B264BFAABD6F7149B8879AD"><enum>(1)</enum><text>Sections 511(d)
			 and 521(b)(2) of the Economic Growth and Tax Relief Reconciliation Act of 2001,
			 and the amendments made by such sections, are hereby repealed; and the Internal
			 Revenue Code of 1986 shall be applied as if such sections, and amendments, had
			 never been enacted.</text>
					</paragraph><paragraph id="HDD1012C00EBC48C0A067F37B7951B48A"><enum>(2)</enum><text>Subsection (c) of
			 <external-xref legal-doc="usc" parsable-cite="usc/26/2511">section
			 2511</external-xref> of the Internal Revenue Code of 1986 is hereby
			 repealed.</text>
					</paragraph></subsection></section><section id="HAEE58267F3C8431A9C4B8A2AF5668AF8"><enum>3.</enum><header>Modifications to
			 estate and gift taxes</header>
				<subsection id="HDCB35837DA6F446596D95B5A5F9FEB53"><enum>(a)</enum><header>$3,500,000
			 applicable exclusion amount</header><text>Subsection (c) of section 2010 of the
			 Internal Revenue Code of 1986 (relating to applicable credit amount) is amended
			 by striking all that follows <quote>the applicable exclusion amount</quote> and
			 inserting <quote>. For purposes of the preceding sentence, the applicable
			 exclusion amount is $3,500,000.</quote>.</text>
				</subsection><subsection id="H32C6848C77BA4575B640F21F2A8B7F7B"><enum>(b)</enum><header>Freeze maximum
			 estate and gift tax rates at 45 percent</header><text>Subsection (c) of section
			 2001 of such Code is amended—</text>
					<paragraph id="H3631E51B10854B439380E2B33582379F"><enum>(1)</enum><text>by striking
			 paragraph (2);</text>
					</paragraph><paragraph id="HC82535E7AA184A58B1EC484000ACF3FA"><enum>(2)</enum><text display-inline="yes-display-inline">by striking so much of paragraph (1) as
			 precedes the table contained therein; and</text>
					</paragraph><paragraph id="H0C6A7C2E1BBD45E597D14EADCF095051"><enum>(3)</enum><text>by striking the
			 last 2 items in the table and inserting the following new item:</text>

			 of decedents dying, and gifts made, after December 31, 2009.</text>
				</subsection></section></division><division id="H86FBD05F877F4CC9AD2CBA5531C52A6A"><enum>B</enum><header>Statutory
			 Pay-As-You-Go Act of 2009</header>
			<section id="H9F21479B916241EE9CED200595888450"><enum>101.</enum><header>Short
			 Title</header><text display-inline="no-display-inline">This division may be
			 cited as the <quote><short-title>Statutory Pay-As-You-Go
			 Act of 2009</short-title></quote>.</text>
			</section><section id="H31B2ECACB70043BD89E5A93E1797448B"><enum>102.</enum><header>Purpose</header><text display-inline="no-display-inline">The purpose of this division is to
			 reestablish a statutory procedure to enforce a rule of budget neutrality on new
			 revenue and direct spending legislation.</text>
			</section><section id="H70799BB0F65247449F0F18012E114B72"><enum>103.</enum><header>Definitions</header><text display-inline="no-display-inline">As used in this division—</text>
				<paragraph id="H4DD1AD87EE074BEDBA0235E62A9D088F"><enum>(1)</enum><text>The term
			 <quote>BBEDCA</quote> means the Balanced Budget and Emergency Deficit Control
			 Act of 1985.</text>
				</paragraph><paragraph id="HF281F0FA295E459D985010102B4C03E1"><enum>(2)</enum><text>The definitions
			 set forth in section 3 of the Congressional Budget and Impoundment Control Act
			 of 1974 and in section 250 of BBEDCA shall apply to this division, except to
			 the extent that they are specifically modified as follows:</text>
					<subparagraph display-inline="no-display-inline" id="H6875ADFD8D6643CD94C08221B1A21CFC"><enum>(A)</enum><text>The term
			 <quote>outyear</quote> means a fiscal year that occurs one or more years after
			 the budget year.</text>
					</subparagraph><subparagraph id="H132E21DE13FE4F569A0FF2A98AC4F9EA"><enum>(B)</enum><text display-inline="yes-display-inline">In section 250(c)(8)(C), the reference to
			 the food stamp program shall be deemed to be a reference to the Supplemental
			 Nutrition Assistance Program.</text>
					</subparagraph></paragraph><paragraph id="HA9E6879733894FEC98D7AD944D2AB333"><enum>(3)</enum><text>The term
			 <quote>AMT</quote> means the Alternative Minimum Tax for individuals under
			 sections 55–59 of the Internal Revenue Code of 1986, the term
			 <quote>EGTRRA</quote> means the Economic Growth and Tax Relief Reconciliation
			 Act of 2001 (<external-xref legal-doc="public-law" parsable-cite="pl/107/16">Public Law 107–16</external-xref>), and the term
			 <quote>JGTRRA</quote> means the Jobs and Growth Tax Relief and Reconciliation
			 Act of 2003 (Public Law 108–27).</text>
				</paragraph><paragraph id="H9739DF72BFCB42C2A16127E7B15B2B76"><enum>(4)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="H6E51C7FD5B24461CBE57F2E933F841C4"><enum>(A)</enum><text>The term
			 <quote>budgetary effects</quote> means the amounts by which PAYGO legislation
			 changes direct spending or revenues relative to the baseline and shall be
			 determined on the basis of estimates included by reference in the PAYGO Act or
			 prepared under section 104(d)(3), as applicable. Budgetary effects that
			 increase direct spending or decrease revenues are termed <quote>costs</quote>
			 and budgetary effects that increase revenues or decrease direct spending are
			 termed <quote>savings</quote>.</text>
					</subparagraph><subparagraph id="H9C61E3CA2B5244D09B55A8C2F8024968" indent="up1"><enum>(B)</enum><text>For purposes of these definitions,
			 off-budget effects shall be counted as budgetary effects unless such changes
			 flow directly from amendments to title II of the Social Security Act and
			 related provisions of the Internal Revenue Code of 1986 and debt service
			 effects shall not be counted as budgetary effects.</text>
					</subparagraph><subparagraph id="H65A77C6D24784AC180515D8CC4C0B22D" indent="up1"><enum>(C)</enum><text display-inline="yes-display-inline">Solely for purposes of recording entries on
			 a PAYGO scorecard, provisions in appropriations Acts are also considered to be
			 budgetary effects for purposes of this division if such provisions make outyear
			 modifications to substantive law, except that provisions for which the outlay
			 effects net to zero over a period consisting of the current year, the budget
			 year, and the 4 subsequent years shall not be considered budgetary effects. For
			 purposes of this paragraph, the term, <quote>modifications to substantive
			 law</quote> refers to changes to or restrictions on entitlement law or other
			 mandatory spending contained in appropriations Acts, notwithstanding section
			 250(c)(8) of BBEDCA. Provisions in appropriations Acts that are neither outyear
			 modifications to substantive law nor changes in revenues have no budgetary
			 effects for purposes of this division.</text>
					</subparagraph><subparagraph id="H255F3C4A69634D65976373816163CAAF" indent="up1"><enum>(D)</enum><text>If a provision is designated as an
			 emergency requirement under this division and is also designated as an
			 emergency requirement under the applicable rules of the House of
			 Representatives, CBO shall not include the cost of such a provision in its
			 estimate of the PAYGO legislation’s budgetary effects.</text>
					</subparagraph></paragraph><paragraph id="H1DC3E19D85BB4D30BA5B5136476BCC65"><enum>(5)</enum><text>The term
			 <quote>debit</quote> refers to the net total amount, when positive, by which
			 costs recorded on the PAYGO scorecards for a fiscal year exceed savings
			 recorded on those scorecards for that year.</text>
				</paragraph><paragraph id="HD795CB36218E48F3A31755C14B76D8EC"><enum>(6)</enum><text>The term
			 <quote>entitlement law</quote> refers to a section of law which provides
			 entitlement authority.</text>
				</paragraph><paragraph id="H85260AA9006D486B9F925E939AF336D7"><enum>(7)</enum><text display-inline="yes-display-inline">The term <quote>PAYGO legislation</quote>
			 or a <quote>PAYGO Act</quote> refers to a bill or joint resolution that affects
			 direct spending or revenue relative to the baseline. The budgetary effects of
			 changes in revenues and outyear modifications to substantive law included in
			 appropriation Acts as defined in paragraph (4) shall be treated as if they were
			 contained in PAYGO legislation.</text>
				</paragraph><paragraph commented="no" id="H294E083E7CF245E3948C564BADCB2C79"><enum>(8)</enum><text>The term
			 <quote>timing shift</quote> refers to a delay of the date on which direct
			 spending would otherwise occur from the ninth outyear to the tenth outyear or
			 an acceleration of the date on which revenues would otherwise occur from the
			 tenth outyear to the ninth outyear.</text>
				</paragraph></section><section commented="no" id="H30FE6C4EC30941A184DDF11551C122B9"><enum>104.</enum><header>PAYGO estimates
			 and PAYGO scorecards</header>
				<subsection id="H6DB36CD102704F01A62FB594780EBA9B"><enum>(a)</enum><header>Paygo
			 estimates</header><paragraph commented="no" display-inline="yes-display-inline" id="HFE8D7E6C66CB42F8BF8AB75AE32CC610"><enum>(1)</enum><text display-inline="yes-display-inline">A PAYGO Act shall include by reference an
			 estimate of its budgetary effects as determined under section 308(a)(3) of the
			 Congressional Budget Act of 1974, if timely submitted for printing in the
			 Congressional Record by the chairs of the Committees on the Budget of the House
			 of Representatives and the Senate, as applicable, before the vote on the PAYGO
			 legislation. The Clerk of the House or the Secretary of the Senate, as
			 applicable, shall also incorporate by reference such estimate printed in the
			 relevant portion of the Congressional Record under section 308(a)(3) of the
			 Congressional Budget Act of 1974 into the enrollment of a PAYGO Act. Budgetary
			 effects that are not so included shall be determined under section
			 104(d)(3).</text>
					</paragraph><paragraph id="HC678B25968C14D8D8CD70CEA4933ACC5" indent="up1"><enum>(2)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="H5DE5A07C315D4FDAB25F13C73C1DCA70"><enum>(A)</enum><text>Section 308(a) of the
			 Congressional Budget Act of 1974 is amended by adding at the end the following
			 new paragraph:</text>
							<quoted-block display-inline="no-display-inline" id="H4DAAAD1EE1494669A8DCBB7F9C12F48F" style="OLC">
								<paragraph id="HD63B9879FC5D4B53885B098334271511"><enum>(3)</enum><header>CBO paygo
				estimates</header><text display-inline="yes-display-inline">Before a vote in
				either House on a PAYGO Act that, if determined in the affirmative, would clear
				such Act for enrollment, the chairs of the Committees on the Budget of the
				House and Senate, as applicable, shall request from the Director of the
				Congressional Budget Office an estimate of the budgetary effects of such Act
				under the Statutory Pay-As-You-Go Act of 2009. If such an estimate is timely
				provided, the chairs of the Committees on the Budget of the House of
				Representatives and the Senate shall post such estimate on their respective
				committee websites and cause it to be printed in the Congressional Record under
				the heading <quote>PAYGO ESTIMATE</quote>. For purposes of this section, the
				Director of the Congressional Budget Office shall not count timing shifts in
				his estimates of the budgetary effects of PAYGO legislation (as defined in
				section 103 of the Statutory Pay-As-You-Go Act of
				2009).</text>
								</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
						</subparagraph><subparagraph id="HA374440CFBDA4875B3325ED3FCCAD93E" indent="up1"><enum>(B)</enum><text>The side heading of section 308(a) of
			 the Congressional Budget Act of 1974 is amended by striking
			 <quote><header-in-text level="subsection" style="OLC">Reports
			 on</header-in-text></quote>.</text>
						</subparagraph></paragraph></subsection><subsection id="id138C4129D89546C7865F31BAD6B3ADE3"><enum>(b)</enum><text display-inline="yes-display-inline">Section 308 of the Congressional Budget Act
			 of 1974 is amended by adding at the end the following new subsection:</text>
					<quoted-block display-inline="no-display-inline" id="H7EEB393521B44E67AA2E4FE112F7E85D" style="OLC">
						<subsection id="H388EB9E98BC943BA84257B066040A53F"><enum>(d)</enum><header>Scorekeeping
				guidelines</header><text display-inline="yes-display-inline">The Director of
				the Congressional Budget Office shall provide estimates under this section in
				accordance with the scorekeeping guidelines determined under section 252(d)(5)
				of the Balanced Budget and Emergency Deficit Control Act of 1985. Upon
				agreement, the chairs of the Committees on the Budget of the House of
				Representatives and the Senate shall submit updates to such guidelines for
				printing in the Congressional
				Record.</text>
						</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</subsection><subsection commented="no" id="HA6183414B68642068AF4E8B8496FD8C0"><enum>(c)</enum><header>Current policy
			 adjustments for certain legislation</header><text display-inline="yes-display-inline">For purposes of calculating budgetary
			 effects under this division, CBO shall adjust its estimates as described below
			 for any provision of legislation designated as meeting the criteria in
			 subsection (b), (c), or (d) of section 107 and which the chairman of the
			 Committee on the Budget of the House of Representatives or the Senate, as
			 applicable, designates as meeting those criteria. A single piece of legislation
			 may contain provisions designated as meeting criteria in more than one of the
			 subsections listed above. For appropriately designated provisions, CBO shall
			 exclude from its estimates for purposes of this division any costs of a
			 provision to the extent that those costs, when combined with all other excluded
			 costs of any other previously designated provisions of enacted legislation
			 under the same subsection of section 107, do not exceed the maximum applicable
			 current policy adjustment defined under the applicable subsection of section
			 107 for the applicable 10-year period, using the most recent baseline estimates
			 supplied by the Congressional Budget Office consistent with section 257 of the
			 Balanced Budget and Emergency Deficit Control Act of 1985 used in considering a
			 concurrent resolution on the budget; or, after the beginning of a new calendar
			 year and before consideration of a concurrent resolution on the budget, using
			 the most recent baseline estimates supplied by the Congressional Budget Office
			 consistent with section 257 of the Balanced Budget and Emergency Deficit
			 Control Act of 1985. CBO estimates of legislation containing a current policy
			 designation under this subsection shall include a separate presentation of
			 costs excluded from the calculation of budgetary effects for the legislation,
			 as well as an updated total of all excluded costs of provisions within the same
			 subsection of section 107.</text>
				</subsection><subsection commented="no" id="H1F80CE01ECD74DA1A54205487F1E9876"><enum>(d)</enum><header>OMB Paygo
			 scorecards</header>
					<paragraph commented="no" id="HD79F3D1D459444118A1D836123637827"><enum>(1)</enum><header>In
			 general</header><text display-inline="yes-display-inline">OMB shall maintain
			 and make publicly available a continuously updated document containing two
			 PAYGO scorecards displaying the budgetary effects of PAYGO legislation as
			 determined under section 308 of the Congressional Budget Act of 1974, applying
			 the look-back requirement in subsection (e) and the averaging requirement in
			 subsection (f), and a separate addendum displaying the estimates of the costs
			 of provisions designated in statute as emergency requirements.</text>
					</paragraph><paragraph display-inline="no-display-inline" id="HC85A0406052F4E4E85229E6BE7E74DDE"><enum>(2)</enum><header>Estimates in
			 legislation</header><text display-inline="yes-display-inline">Except as
			 provided in paragraph (3), in making the calculations for the PAYGO scorecards,
			 OMB shall use the budgetary effects included by reference in the applicable
			 legislation.</text>
					</paragraph><paragraph commented="no" id="H2AF0105DF80145348F6172C70C6718F4"><enum>(3)</enum><header>OMB
			 estimates</header><text display-inline="yes-display-inline">If legislation does
			 not contain the estimate of budgetary effects under paragraph (2), then OMB
			 shall score the budgetary effects of that legislation upon its enactment, based
			 on the approaches to scorekeeping set forth in this division.</text>
					</paragraph><paragraph commented="no" id="H0825D93AD6AC44E3BD1215D922C92D52"><enum>(4)</enum><header>5-year
			 scorecard</header><text>The first scorecard shall display the budgetary effects
			 of PAYGO legislation in each year over the 5-year period beginning in the
			 budget year.</text>
					</paragraph><paragraph commented="no" id="H2A6E9F428DD6431480BB9F1298CF234D"><enum>(5)</enum><header>10-year
			 scorecard</header><text>The second scorecard shall display the budgetary
			 effects of PAYGO legislation in each year over the 10-year period beginning in
			 the budget year.</text>
					</paragraph></subsection><subsection commented="no" id="HD5F79E5A39F94CF98B9B9FE615EF45CE"><enum>(e)</enum><header>Look-back to
			 capture current-year effects</header><text>For purposes of this section, OMB
			 shall treat the budgetary effects of PAYGO legislation enacted during a session
			 of Congress that occur during the current year as though they occurred in the
			 budget year.</text>
				</subsection><subsection commented="no" id="H5D87B39375614902ACA9E1E76E9CCBC5"><enum>(f)</enum><header>Averaging used
			 to measure compliance over 5-year and 10-year periods</header><text>OMB shall
			 cumulate the budgetary effects of a PAYGO Act over the budget year (which
			 includes any look-back effects under subsection (e)) and—</text>
					<paragraph commented="no" id="H6A5560A9BA024A1EBECA8055AB55C81F"><enum>(1)</enum><text>for purposes of
			 the 5-year scorecard referred to in subsection (d)(4), the four subsequent
			 outyears, divide that cumulative total by five, and enter the quotient in the
			 budget-year column and in each subsequent column of the 5-year PAYGO scorecard;
			 and</text>
					</paragraph><paragraph commented="no" id="H7C4979795EBA47AAB06F841D95062760"><enum>(2)</enum><text display-inline="yes-display-inline">for purposes of the 10-year scorecard
			 referred to in subsection (d)(5), the nine subsequent outyears, divide that
			 cumulative total by ten, and enter the quotient in the budget-year column and
			 in each subsequent column of the 10-year PAYGO scorecard.</text>
					</paragraph></subsection></section><section id="H85AD0CBB719C45249EA85D0B58F0A7B5"><enum>105.</enum><header>Annual report
			 and sequestration order</header>
				<subsection id="HB7DBD69DEC5D43DBBD1B68ECB08A2B78"><enum>(a)</enum><header>Annual
			 report</header><text display-inline="yes-display-inline">Not later than 14 days
			 (excluding weekends and holidays) after Congress adjourns to end a session, OMB
			 shall make publicly available and cause to be printed in the Federal Register
			 an annual PAYGO report. The report shall include an up-to-date document
			 containing the PAYGO scorecards, a description of any current policy
			 adjustments made under section 104(c), information about emergency legislation
			 (if any) designated under section 103(4)(D), information about any
			 sequestration if required by subsection (b), and other data and explanations
			 that enhance public understanding of this division and actions taken under
			 it.</text>
				</subsection><subsection id="H1B6CAD8FBDBC4A3EBE7520C1E0848641"><enum>(b)</enum><header>Sequestration
			 order</header><text display-inline="yes-display-inline">If the annual report
			 issued at the end of a session of Congress under subsection (a) shows a debit
			 on either PAYGO scorecard for the budget year, OMB shall prepare and the
			 President shall issue and include in that report a sequestration order that,
			 upon issuance, shall reduce budgetary resources of direct spending programs by
			 enough to offset that debit as prescribed in section 106. If there is a debit
			 on both scorecards, the order shall fully offset the larger of the two debits.
			 OMB shall include that order in the annual report and transmit it to the House
			 of Representatives and the Senate. If the President issues a sequestration
			 order, the annual report shall contain, for each budget account to be
			 sequestered, estimates of the baseline level of budgetary resources subject to
			 sequestration, the amount of budgetary resources to be sequestered, and the
			 outlay reductions that will occur in the budget year and the subsequent fiscal
			 year because of that sequestration.</text>
				</subsection></section><section id="HE7DF7E614B584C15B3791CF2664FC00D"><enum>106.</enum><header>Calculating a
			 sequestration</header>
				<subsection id="H761066C340864E57AED9CBF3D3C50BDE"><enum>(a)</enum><header>Reducing
			 nonexempt budgetary resources by a uniform percentage</header><text>OMB shall
			 calculate the uniform percentage by which the budgetary resources of nonexempt
			 direct spending programs are to be sequestered such that the outlay savings
			 resulting from that sequestration, as calculated under subsection (b), shall
			 offset the budget-year debit, if any on the applicable PAYGO scorecard. If the
			 uniform percentage calculated under the prior sentence exceeds 4 percent, the
			 Medicare programs described in section 256(d) of BBEDCA shall be reduced by 4
			 percent and the uniform percentage by which the budgetary resources of all
			 other nonexempt direct spending programs are to be sequestered shall be
			 increased, as necessary, so that the sequestration of Medicare and of all other
			 nonexempt direct spending programs together produce the required outlay
			 savings.</text>
				</subsection><subsection id="HDC20B2C95BA34673BB162D58D09094D1"><enum>(b)</enum><header>Outlay
			 savings</header><text>In determining the amount by which a sequestration
			 offsets a budget-year debit, OMB shall count—</text>
					<paragraph id="H45CFA007B78A4DAD8E2CD69A254042EC"><enum>(1)</enum><text>the amount by
			 which the sequestration in a crop year of crop support payments, pursuant to
			 section 256(j) of BBEDCA, reduces outlays in the budget year and the subsequent
			 fiscal year;</text>
					</paragraph><paragraph id="H99DAC114649342D9B3F2906AE26C77CF"><enum>(2)</enum><text>the amount by
			 which the sequestration of Medicare payments in the 12-month period following
			 the sequestration order, pursuant to section 256(d) of BBEDCA, reduces outlays
			 in the budget year and the subsequent fiscal year; and</text>
					</paragraph><paragraph id="H0B707C08F76744A2A133F3883C7B5018"><enum>(3)</enum><text>the amount by
			 which the sequestration in the budget year of the budgetary resources of other
			 nonexempt mandatory programs reduces outlays in the budget year and in the
			 subsequent fiscal year.</text>
					</paragraph></subsection></section><section id="H60D52789C8554E65B8335253374E17E1"><enum>107.</enum><header>Current policy
			 adjustment to the CBO estimates</header>
				<subsection id="HFB2B401FF8824727938FB0604D2D34D2"><enum>(a)</enum><header>Purpose</header><text display-inline="yes-display-inline">The purpose of this section is to provide
			 for adjustments of estimates of budgetary effects of PAYGO legislation for
			 legislation affecting four areas of the budget—</text>
					<paragraph id="HCF3A7DAE6E004E68BD07415A9D14DE76"><enum>(1)</enum><text>payments made
			 under section 1848 of the Social Security Act (titled Payment for Physicians’
			 Services);</text>
					</paragraph><paragraph id="H18177F572C894E4889DBF71CDA32F197"><enum>(2)</enum><text>the Estate and
			 Gift Tax under subtitle B of the Internal Revenue Code of 1986;</text>
					</paragraph><paragraph id="H5B4A2896989E424696BE410936F579C7"><enum>(3)</enum><text>the AMT;
			 and</text>
					</paragraph><paragraph id="HF11A2FB1CEC24FCEB5CB5EF66EF0F5FC"><enum>(4)</enum><text>provisions of
			 EGTRRA or JGTRRA that amended the Internal Revenue Code of 1986 (or provisions
			 in later statutes further amending the amendments made by EGTRRA or JGTRRA),
			 other than—</text>
						<subparagraph id="H85098602BC854015805C9E722ED71FB6"><enum>(A)</enum><text>the provisions of
			 those two Acts that were made permanent by the Pension Protection Act of 2006
			 (<external-xref legal-doc="public-law" parsable-cite="pl/109/280">Public Law
			 109–280</external-xref>);</text>
						</subparagraph><subparagraph id="H8C0F4139D5A24EECA886AFE6B4ECDDFF"><enum>(B)</enum><text>amendments to the
			 estate and gift tax referred to in paragraph (2);</text>
						</subparagraph><subparagraph id="H0757D75A816E4B4FBD0B382B2BA250CA"><enum>(C)</enum><text>the AMT referred
			 to in paragraph (3);</text>
						</subparagraph><subparagraph id="H6BF99950DAA6467081FF7C0F2936D9FC"><enum>(D)</enum><text>the 35 percent
			 bracket and that portion of the 33 percent bracket that applies to taxable
			 income greater than $200,000 for an individual and $250,000 for a couple;
			 and</text>
						</subparagraph><subparagraph id="H1D45792380504B219BB5C2BE357CDBB6"><enum>(E)</enum><text>provisions in
			 those two Acts relating to taxes rates on capital gains and dividends.</text>
						</subparagraph></paragraph></subsection><subsection id="H89C3E494781F4871A106C765BD57BD60"><enum>(b)</enum><header>Medicare
			 Payments to Physicians</header>
					<paragraph id="H2006176FA179412C8881DED218C4E6CC"><enum>(1)</enum><header>Criteria</header><text>Legislation
			 that includes provisions amending or superseding the system of payments under
			 section 1848 of the Social Security Act shall trigger the current policy
			 adjustment required by this division.</text>
					</paragraph><paragraph id="H0CA75FB69F9F46B88AFBF0B284D551B2"><enum>(2)</enum><header>Adjustment</header><text>The
			 amount of the maximum current policy adjustment shall be the difference
			 between—</text>
						<subparagraph id="H8E855577B0FC40B4AF946413C805C424"><enum>(A)</enum><text display-inline="yes-display-inline">estimated net outlays attributable to the
			 payments made to physicians under that section of the Social Security Act (as
			 scheduled on July 15, 2009, to be in effect); and</text>
						</subparagraph><subparagraph id="H1B6B735EA62A45CA940625BB1C5E1585"><enum>(B)</enum><text>what those net
			 outlays would have been if the nominal payment rates and related parameters in
			 effect for 2009 had been in effect thereafter without change.</text>
						</subparagraph></paragraph></subsection><subsection id="H63DC7208647848688784398D5F388239"><enum>(c)</enum><header>Estate and Gift
			 Tax</header>
					<paragraph id="H08575614489443A18154303167C9A86C"><enum>(1)</enum><header>Criteria</header><text>Legislation
			 that includes provisions amending the Estate and Gift Tax under subtitle B of
			 the Internal Revenue Code of 1986 shall trigger the current policy adjustment
			 required by this division.</text>
					</paragraph><paragraph id="H3F5516D0CD5A4A758F7B762734CDA068"><enum>(2)</enum><header>Adjustment</header><text>The
			 amount of the maximum current policy adjustment shall be the difference
			 between—</text>
						<subparagraph id="H55EC2D65296F422B876B47E709FAE6B2"><enum>(A)</enum><text>total revenues
			 projected to be collected under the Internal Revenue Code of 1986 (as scheduled
			 on July 15, 2009, to be in effect); and</text>
						</subparagraph><subparagraph id="HEA37F2E700BF43278CBA1BFD31BAE169"><enum>(B)</enum><text>what those revenue
			 collections would have been if, on the date of enactment of the legislation
			 meeting the criteria in paragraph (1), estate and gift tax law had instead been
			 amended so that the tax rates, nominal exemption amounts, and related
			 parameters in effect for tax year 2009 had remained in effect thereafter
			 without change.</text>
						</subparagraph></paragraph></subsection><subsection id="H6EBD93847A3A4F6C9AC897B98C44D3D9"><enum>(d)</enum><header>Permanent
			 Extension of Middle-Class Tax Cuts and AMT Relief</header>
					<paragraph id="HC311006AC22A40038AB82742ECFEE45E"><enum>(1)</enum><header>Criteria</header><text>Legislation
			 that includes provisions extending middle-class tax cuts or AMT relief shall
			 trigger the current policy adjustment required by this division if those
			 provisions extend one or more of the following provisions—</text>
						<subparagraph display-inline="no-display-inline" id="H8A431796513A4093B1B3C6B71FFF515F"><enum>(A)</enum><text>AMT relief for
			 calendar year 2010 and subsequent years in such a manner that the number of AMT
			 taxpayers is not estimated to exceed the number of AMT taxpayers in tax year
			 2008 in any year through the tenth year after enactment;</text>
						</subparagraph><subparagraph id="HEE79AFC84A5A427FAB9643DBE6CEF35B"><enum>(B)</enum><text>the 10 percent
			 bracket as in effect for tax year 2010, as provided for under section 101(a) of
			 the Economic Growth and Tax Relief Reconciliation Act of 2001 and any later
			 amendments through July 15, 2009;</text>
						</subparagraph><subparagraph id="H2CE3EC4E445348868651D06B27D2BF97"><enum>(C)</enum><text display-inline="yes-display-inline">the child tax credit as in effect for tax
			 year 2010, as provided for under section 201 of the Economic Growth and Tax
			 Relief Reconciliation Act and any later amendments through July 15,
			 2009;</text>
						</subparagraph><subparagraph id="H60DEA474A3FE422EAEFDF954884E6ABA"><enum>(D)</enum><text display-inline="yes-display-inline">tax benefits for married couples as in
			 effect for tax year 2010, as provided for under title III of the Economic
			 Growth and Tax Relief Reconciliation Act and any later amendments through July
			 15, 2009;</text>
						</subparagraph><subparagraph id="HA843B4614DC84A1E9857ED6ADE3899AB"><enum>(E)</enum><text>the adoption
			 credit as in effect in tax year 2010, as provided for under section 202 of the
			 Economic Growth and Tax Relief Reconciliation Act of 2001 and any later
			 amendments through July 15, 2009;</text>
						</subparagraph><subparagraph id="H0C4F13689CA3488799987C040C89EF5E"><enum>(F)</enum><text>the dependent care
			 credit as in effect in tax year 2010, as provided for under section 204 of the
			 Economic Growth and Tax Relief Reconciliation Act of 2001 and any later
			 amendments through July 15, 2009;</text>
						</subparagraph><subparagraph id="H60D77DB4E9B64A59827E3D3773CC6B96"><enum>(G)</enum><text>the
			 employer-provided child care credit as in effect in tax year 2010, as provided
			 for under section 205 of the Economic Growth and Tax Relief Reconciliation Act
			 of 2001 and any later amendments through July 15, 2009;</text>
						</subparagraph><subparagraph id="H585E5E5C964D4F1293E977B2053F196E"><enum>(H)</enum><text>the education tax
			 benefits as in effect in tax year 2010, as provided for under title IV of the
			 Economic Growth and Tax Relief Reconciliation Act of 2001 and any later
			 amendments through July 15, 2009;</text>
						</subparagraph><subparagraph id="H3DA24377379846EBBB3196EC34F5A144"><enum>(I)</enum><text display-inline="yes-display-inline">the 25 and 28 percent brackets as in effect
			 for tax year 2010, as provided for under section 101(a) of the Economic Growth
			 and Tax Relief Reconciliation Act of 2001 and any later amendments through July
			 15, 2009; and</text>
						</subparagraph><subparagraph id="H1BA81A1F4262429BA0EC4792F3AF6FAC"><enum>(J)</enum><text display-inline="yes-display-inline">the 33 percent brackets as in effect for
			 tax year 2010, as provided for under section 101(a) of the Economic Growth and
			 Tax Relief Reconciliation Act of 2001 and any later amendment affecting
			 taxpayers with taxable income of $200,000 or less for individuals and $250,000
			 or less for couples in calendar year 2010 and increased in each subsequent year
			 by an amount equal to the cost of living adjustment determined under section
			 1(f)(3) of the Internal Revenue Code of 1986 for the calendar year in which the
			 taxable year begins, determined by substituting <quote>calendar year
			 2008</quote> for <quote>calendar year 1992</quote> in subparagraph (B)
			 thereof.</text>
						</subparagraph></paragraph><paragraph id="HB28984DECEF848F48F1D46B54244BD7C"><enum>(2)</enum><header>Adjustment</header><text>The
			 amount of the maximum current policy adjustment shall be the difference between
			 what total revenues would have been under the Internal Revenue Code of 1986 (as
			 scheduled on July 15, 2009, to be in effect) and what revenues would be if
			 legislation—</text>
						<subparagraph id="HE07EFC7DA4CA496A85469BCE5AD00A24"><enum>(A)</enum><text>permanently
			 extending the AMT exemption and brackets in effect in tax year 2009 but
			 increased in tax year 2010 and each subsequent tax year as indicated under
			 subsection (d)(2)(B), along with any additional amount necessary to prevent the
			 number of taxpayers who must pay AMT from increasing; and</text>
						</subparagraph><subparagraph id="H808E86E51A4C4690A547A262ADE4136F"><enum>(B)</enum><text display-inline="yes-display-inline">permanently extending the provisions
			 identified in paragraph (1),</text>
						</subparagraph><continuation-text continuation-text-level="paragraph">were enacted
			 on the same day as the legislation referred to in paragraph (1).</continuation-text></paragraph></subsection></section><section id="H69F167AEE0FA4FEC8C38467933BFB596"><enum>108.</enum><header>Application of
			 BBEDCA</header><text display-inline="no-display-inline">For purposes of this
			 division—</text>
				<paragraph id="HA12179982D474BFA889585B0F2E31743"><enum>(1)</enum><text>notwithstanding
			 section 275 of BBEDCA, the provisions of sections 255, 256, 257, and 274 of
			 BBEDCA, as amended by this division, shall apply to the provisions of this
			 division;</text>
				</paragraph><paragraph id="H96F020DA40E14FC7A43EF9B3DA1FEFB8"><enum>(2)</enum><text>references in
			 sections 255, 256, 257, and 274 to <quote>this part</quote> or <quote>this
			 title</quote> shall be interpreted as applying to this division;</text>
				</paragraph><paragraph id="HB9E4FCB3E0664EC48B1320011A757C12"><enum>(3)</enum><text>references in
			 sections 255, 256, 257, and 274 of BBEDCA to <quote>section 254</quote> shall
			 be interpreted as referencing section 105 of this division;</text>
				</paragraph><paragraph id="H0F44394581734A35A2546C5F9731F5C4"><enum>(4)</enum><text>the reference in
			 section 256(b) of BBEDCA to <quote>section 252 or 253</quote> shall be
			 interpreted as referencing section 105 of this division;</text>
				</paragraph><paragraph id="H9D52EEFCDAF940AC8C74BF88F487C5D5"><enum>(5)</enum><text>the reference in
			 section 256(d)(1) of BBEDCA to <quote>section 252 or 253</quote> shall be
			 interpreted as referencing section 106 of this division;</text>
				</paragraph><paragraph id="HF863FC09044C4C2C87EF209865850B8F"><enum>(6)</enum><text>the reference in
			 section 256(d)(4) of BBEDCA to <quote>section 252 or 253</quote> shall be
			 interpreted as referencing section 105 of this division;</text>

			 BBEDCA shall apply to a sequestration, if any, under this division; and</text>

			 <quote>section 251, 252, or 253</quote> shall be interpreted as referencing

				</paragraph></section><section id="H3FD9A39B1B6E48C0AC1AE19EEAC0F291"><enum>109.</enum><header>Technical
			 corrections</header>
				<subsection id="H5A7DE89B3B96457080E932E2E73A3550"><enum>(a)</enum><text>Section 250(c)(18)
			 of BBEDCA is amended by striking <quote>the expenses the Federal deposit
			 insurance agencies</quote> and inserting <quote>the expenses of the Federal
			 deposit insurance agencies</quote>.</text>
				</subsection><subsection id="H8379DC25075840348A145F5B68B1F3B0"><enum>(b)</enum><text>Section 256(k)(1)
			 of BBEDCA is amended by striking <quote>in paragraph (5)</quote> and inserting
			 <quote>in paragraph (6)</quote>.</text>
				</subsection></section><section id="H9F675F0F8DB94B258F8667A384AEAEFA"><enum>110.</enum><header>Conforming
			 amendments</header>
				<subsection id="HDDD504E74DB4413780CFA204FCFB66A8"><enum>(a)</enum><text>Section 256(a) of
			 BBEDCA is repealed.</text>
				</subsection><subsection id="H66D5EA0E458444949F90E99399D6126E"><enum>(b)</enum><text>Section 256(b) of
			 BBEDCA is amended by striking <quote>origination fees under sections 438(c)(2)
			 and 455(c) of that Act shall each be increased by 0.50 percentage
			 point.</quote> and inserting in lieu thereof <quote>origination fees under
			 sections 438(c)(2) and (6) and 455(c) and loan processing and issuance fees
			 under section 428(f)(1)(A)(ii) of that Act shall each be increased by the
			 uniform percentage specified in that sequestration order, and, for student
			 loans originated during the period of the sequestration, special allowance
			 payments under section 438(b) of that Act accruing during the period of the
			 sequestration shall be reduced by the uniform percentage specified in that
			 sequestration order.</quote>.</text>
				</subsection><subsection id="H2A47A125EB0D414A90969890D46D52DE"><enum>(c)</enum><text>Section 256(c) of
			 BBEDCA is repealed.</text>
				</subsection><subsection id="H75455B42349B44C1B937C646CFD20EB3"><enum>(d)</enum><text>Section 256(d) of
			 BBEDCA is amended—</text>
					<paragraph id="H2AE0C98A805C4EA5863FBF0F48F67CCE"><enum>(1)</enum><text>by redesignating
			 paragraphs (2), (3), and (4) as paragraphs (3), (5), and (6);</text>
					</paragraph><paragraph id="H0D86BF256AFE49568E729A000BE431A9"><enum>(2)</enum><text>by amending
			 paragraph (1) to read as follows:</text>
						<quoted-block id="H358A58BBC05B40C5915C14A452EBEDAD" style="OLC">
							<paragraph id="HCA9B4DDFBAF440A0968A1451B264116A"><enum>(1)</enum><header>Calculation of
				reduction in payment amounts</header><text>To achieve the total percentage
				reduction in those programs required by section 252 or 253, subject to
				paragraph (2), and notwithstanding section 710 of the Social Security Act, OMB
				shall determine, and the applicable Presidential order under section 254 shall
				implement, the percentage reduction that shall apply, with respect to the
				health insurance programs under title XVIII of the Social Security Act—</text>
								<subparagraph id="HF7BAF828AAF54DCFBDF4038871A95F08"><enum>(A)</enum><text>in the case of
				parts A and B of such title, to individual payments for services furnished
				during the one-year period beginning on the first day of the first month
				beginning after the date the order is issued (or, if later, the date specified
				in paragraph (4)); and</text>
								</subparagraph><subparagraph id="HB0B48DB2003C476EB39232BC18573BEF"><enum>(B)</enum><text>in the case of
				parts C and D, to monthly payments under contracts under such parts for the
				same one-year period;</text>
								</subparagraph><continuation-text continuation-text-level="paragraph">such that
				the reduction made in payments under that order shall achieve the required
				total percentage reduction in those payments for that
				period.</continuation-text></paragraph><after-quoted-block>;</after-quoted-block></quoted-block>
					</paragraph><paragraph id="H638A5DA23C064CE3816C5807369F008E"><enum>(3)</enum><text>by inserting after
			 paragraph (1) the following:</text>
						<quoted-block id="H9F5A08627FCF4F698136E6C524174FB7" style="OLC">
							<paragraph id="HBA663E44F420470ABFFB4015E7C2CBA4"><enum>(2)</enum><header>Uniform
				reduction rate; maximum permissible reduction</header><text>Reductions in
				payments for programs and activities under such title XVIII pursuant to a
				sequestration order under section 254 shall be at a uniform rate, which shall
				not exceed 4 percent, across all such programs and activities subject to such
				order.</text>
							</paragraph><after-quoted-block>;</after-quoted-block></quoted-block>
					</paragraph><paragraph id="HE31C0E4B68554C74A6C51BE63E1D8869"><enum>(4)</enum><text>by inserting after
			 paragraph (3), as redesignated, the following:</text>

							</paragraph><after-quoted-block>;</after-quoted-block></quoted-block>
					</paragraph><paragraph id="H650D66AA0F764BCDBBA69F3832B732A2"><enum>(5)</enum><text>in paragraph (6),
			 as redesignated, to read as follows:</text>

				disregarded in computing payment amounts</header><text>The Secretary of Health
				and Human Services shall not take into account any reductions in payment
				amounts which have been or may be effected under this part, for purposes of
				computing any adjustments to payment rates under such title XVIII, specifically
				including—</text>
								<subparagraph id="H6F104484029A4EF3B1B601D50F145F66"><enum>(A)</enum><text>the part C growth
