		<official-title>To amend title 23, United States Code, to establish
		  national standards to prevent distracted driving, and for other

		<section id="H4825FFCBAC404C04A1D33CF983A193E3" section-type="section-one"><enum>1.</enum><header>National standards to prevent
			 distracted driving</header>
			<subsection id="H0E04A1FB9A7847D98D09FAA8F8FBBB4A"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Chapter 1 of title
			 23, United States Code, is amended by adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="HD707A2E9F6D2473C98566F75763B9766" style="USC">
					<section id="H1B6830112C7E4445BDA9518D9BEC5C91"><enum>167.</enum><header>National
				standards to prevent distracted driving</header>
						<subsection id="H0B815BA747D44BE7A245DD8FBBD555C2"><enum>(a)</enum><header>Penalty</header><text>On
				October 1, 2011, and October 1 of each fiscal year thereafter, if a State does
				not meet the requirement of subsection (b), the Secretary shall withhold from
				amounts apportioned to the State on that date under each of sections 104(b)(1),
				104(b)(3), and 104(b)(4) an amount equal to the amount specified in subsection
				(c).</text>
						</subsection><subsection id="H2E4F75991DF2447691BA4298D3F758B0"><enum>(b)</enum><header>Requirement</header>
							<paragraph id="H2D467DF7D4F343AD8CCD9BF4D604D277"><enum>(1)</enum><header>In
				general</header><text>A State meets the requirement of this subsection if the
				State has enacted and is enforcing a law that prohibits a person from operating
				a motor vehicle in the State while the person is using a wireless
				communications device to compose, read, or send an electronic message, when the
				vehicle is in motion or part of traffic.</text>
							</paragraph><paragraph id="H6F23B3C8BBCC4F198A1DC33FC8E2B65A"><enum>(2)</enum><header>Exceptions</header><text display-inline="yes-display-inline">Paragraph (1) does not apply if a wireless
				communications device is used—</text>
								<subparagraph id="H03F34611DCF344D4829CB00B307CD28E"><enum>(A)</enum><text display-inline="yes-display-inline">solely in a voice-activated or other
				hands-free mode;</text>
								</subparagraph><subparagraph id="HE1DEA815755249D8962B617B66D01822"><enum>(B)</enum><text display-inline="yes-display-inline">for making a cellular phone call;</text>
								</subparagraph><subparagraph id="HB9BB2406A99D4B96BDB0038149202000"><enum>(C)</enum><text display-inline="yes-display-inline">for obtaining emergency assistance
				to—</text>
									<clause id="H42BD69C2F33C4FA682CC06B81B33F2A2"><enum>(i)</enum><text>report a traffic
				accident, medical emergency, or serious traffic hazard; or</text>
									</clause><clause id="H6ED73EDDC3294A769E54DF667BE4ED16"><enum>(ii)</enum><text>prevent a crime
				about to be committed;</text>
									</clause></subparagraph><subparagraph id="H0B1272D9D43947BDBDFF4D2070642489"><enum>(D)</enum><text>in the reasonable
				belief that a person's life or safety is in immediate danger;</text>
								</subparagraph><subparagraph id="H573BFE11A87447119C6C31751546D2EC"><enum>(E)</enum><text display-inline="yes-display-inline">in an authorized emergency vehicle while in
				the performance of official duties;</text>
								</subparagraph><subparagraph id="H6730E252C64C4BB3B331C20374E6D4D6"><enum>(F)</enum><text>when a motor
				vehicle is stopped and the driver has the motor vehicle transmission in neutral
				or park; and</text>
								</subparagraph><subparagraph id="H7E5B3A4995C548F1AF66026697FD97A0"><enum>(G)</enum><text>in other
				circumstances, as identified by the Secretary by regulation, in which use of a
				wireless communications device does not adversely affect safety.</text>
								</subparagraph></paragraph></subsection><subsection id="H354AB8A7B3BD4A8980E6E8B8A973B146"><enum>(c)</enum><header>Amount To be
				withheld</header><text display-inline="yes-display-inline">If a State is
				subject to a penalty under subsection (a), the Secretary shall withhold for a
				fiscal year from the apportionments of the State described in subsection (a) an
				amount equal to a percentage of the funds apportioned to the State under each
				of sections 104(b)(1), 104(b)(3), and 104(b)(4) for fiscal year 2009. The
				percentage shall be as follows:</text>
							<paragraph id="HB5D396D3F5E548F7AD1071B457571CAB"><enum>(1)</enum><text>For fiscal year
				2012, 2 percent.</text>
							</paragraph><paragraph id="H6972F9A51CE143748F0F1338777350A0"><enum>(2)</enum><text>For fiscal year
				2013, 4 percent.</text>
							</paragraph><paragraph id="H929CFAE662474D77BC15F84F0CA92F9D"><enum>(3)</enum><text>For fiscal year
				2014, 6 percent.</text>
							</paragraph><paragraph id="HCBEA2E7D8B6F4A3B9D95745D812116F3"><enum>(4)</enum><text>For fiscal year
				2015, and each fiscal year thereafter, 8 percent.</text>
							</paragraph></subsection><subsection id="HDD5FCC9C3DC942399DD184FA97D30DFB"><enum>(d)</enum><header>Effect of
				compliance and noncompliance</header><text>If, within 4 years from the date
				that an apportionment for a State is withheld in accordance with this section,
				the Secretary determines that the State meets the requirement of subsection
				(b), the apportionment of the State shall be increased by an amount equal to
				the amount withheld. If, at the end of such 4-year period, a State does not
				meet the requirement of subsection (b) any amounts so withheld from the State
				shall lapse.</text>
						</subsection><subsection id="HD01C502EA7954031A4C226A9F5573B83"><enum>(e)</enum><header>Definitions</header><text>In
				this section, the following definitions apply:</text>
							<paragraph id="HFBDE0BD8BAE04A5F8B7FD0722405E6DA"><enum>(1)</enum><header>Electronic
				message</header>
								<subparagraph id="HF59A0BCE040B4E45B6F3E3F733896CC7"><enum>(A)</enum><header>In
				general</header><text>The term <term>electronic message</term> means a
				self-contained piece of digital communication that is designed or intended to
				be transmitted between physical devices.</text>
								</subparagraph><subparagraph id="H417C38EEB92E496392E249FEF8756E6E"><enum>(B)</enum><header>Inclusions</header><text>The
				term includes e-mail, a text message, an instant message, a command or request
				to access a World Wide Web page, or other data that uses a commonly recognized
				electronic communications protocol. An electronic message does not include
				voice or other data transmitted as a result of making a phone call, or data
				transmitted automatically by a wireless communications device without direct
				initiation by a person.</text>
								</subparagraph></paragraph><paragraph id="H46504CD24DA94F73A34FC73670C96BD4"><enum>(2)</enum><header>Wireless
				communications device</header>
								<subparagraph id="HD5B6CCB4B9B946EE979DFCEFE5289178"><enum>(A)</enum><header>In
				general</header><text>The term <term>wireless communications device</term>
				means—</text>
									<clause id="HFE968448B87443558308EBCB21C696F7"><enum>(i)</enum><text>a
				cellular phone; or</text>
									</clause><clause id="H615491B69BCC413FBEEA6134702728FC"><enum>(ii)</enum><text>a
				portable electronic device that is capable of receiving and transmitting data,
				including to text messages and e-mail, without an access line for
				service.</text>
									</clause></subparagraph><subparagraph id="H1D44BEE7356C4C668D0A293347410272"><enum>(B)</enum><header>Exclusion</header><text>The
				term does not include a device that is permanently affixed to the vehicle,
				including a global positioning system or navigation
				system.</text>
								</subparagraph></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H556104F92E1E4F4EAD463F53BABC8DC1"><enum>(b)</enum><header>Clerical
			 amendment</header><text>The analysis for such chapter is amended by adding at
			 the end the following:</text>
