		<official-title>To authorize the Secretary of Education to make grants to
		  eligible schools to assist such schools to discontinue use of a derogatory or
		  discriminatory name or depiction as a team name, mascot, or nickname, and for
		  other purposes.</official-title>

		<section id="H1456DB1C2BA945908BAE9321067188CA" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Native Act to Transform Imagery in
			 Various Environments</short-title></quote>.</text>
		</section><section id="H1EBDDC3FEB134264AF2EF3445066992E"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">The Congress finds the following:</text>
			<paragraph id="H286811243D964A53B1A1371C6936119B"><enum>(1)</enum><text>Based on article
			 I, section 8 of the United States Constitution, treaties, Federal statutes, and
			 court decisions, the United States has a unique historical and legal
			 relationship with American Indian and Alaska Native people, which serves as the
			 basis for the Federal Government’s trust responsibility and obligations.</text>
			</paragraph><paragraph id="H04FA48FFD0EC465DB279C41A8F08E5F9"><enum>(2)</enum><text>There are 564
			 federally recognized Indian tribes in the United States, with some 40 percent
			 of Indian tribes located in the State of Alaska.</text>
			</paragraph><paragraph id="H4D798C88A1844549A3008C59EFCA2727"><enum>(3)</enum><text>Indian tribes have
			 principal responsibility for lands and people within their jurisdiction.</text>
			</paragraph><paragraph id="H6821A69E7CF148B384AE7CE20C182B7C"><enum>(4)</enum><text>This
			 responsibility extends to educating their students and providing adequate
			 educational facilities in which their students can learn.</text>
			</paragraph><paragraph id="HE016E842BBA1435D8E621EF2927F0740"><enum>(5)</enum><text>Because of this
			 responsibility, Indian schools should be eligible for the funding available
			 under this Act.</text>
			</paragraph><paragraph id="H3B290233F96A425490E45097FE992B7F"><enum>(6)</enum><text>Elementary and
			 secondary schools all over the Nation use words and symbols representing their
			 schools that are offensive to Native Americans.</text>
			</paragraph><paragraph id="HDF4D358FD59E43EE8FD208819F896DFA"><enum>(7)</enum><text>Nationally, more
			 than 1,200 schools inappropriately use such offensive names or nicknames.
			 Often, these names or symbols become mascots and are used at athletic games for
			 mascot characters, chants, and other antics.</text>
			</paragraph><paragraph id="H5B93036A101E42EEBE34F393FD1916BD"><enum>(8)</enum><text>Although these
			 school communities do not intend disrespect toward Native Americans, that is
			 the end result of allowing these offensive terms to continue in these
			 educational institutions. Therefore, Federal funding should be available to
			 schools to assist them to discontinue use of offensive names and symbols on
			 equipment and apparel, including team jerseys, signs, stationery, walls,
			 fields, and gymnasium floors.</text>
			</paragraph></section><section id="HFE85D1AAA9344FB7BB0D484CEBE5B488"><enum>3.</enum><header>Grants</header>
			<subsection id="H538DDB9A89744C8B9E6479FA284B8AAF"><enum>(a)</enum><header>Grants To
			 Discontinue Use of a Derogatory or Discriminatory Name or Depiction</header>
				<paragraph id="H26F144C3AFB341D0A114671E18690792"><enum>(1)</enum><header>In
			 general</header><text>During the 1-year period beginning at the end of the
			 period described in section 4(b)(2), the Secretary of Education, acting through
			 the Committee on Indian Relations, may make grants to eligible schools to
			 assist such schools to discontinue use of a name or depiction that is
			 derogatory or discriminatory (as provided under section 5) as a team name,
			 mascot, or nickname of the school or any entity sponsored by the school.</text>
				</paragraph><paragraph id="HF0DCA20906E348C892B91DDA8BD3E3AE"><enum>(2)</enum><header>Use of
			 funds</header><text>The Secretary may not make a grant to an applicant under
			 this subsection unless the applicant agrees to use the grant for the
			 following:</text>
					<subparagraph id="HA58CD336B17448AFA5593792A486F3DC"><enum>(A)</enum><text>Replacement of
			 uniforms or other materials that bear a discontinued derogatory or
			 discriminatory name or depiction.</text>
					</subparagraph><subparagraph id="H310916AAFF884F338AC671B477BD205C"><enum>(B)</enum><text>Alteration of
			 facilities, including walls, floors, and signs, to the extent necessary to
			 remove a discontinued derogatory or discriminatory name or depiction.</text>
					</subparagraph></paragraph><paragraph id="H7FB443C5C795465D93062C31FA41A579"><enum>(3)</enum><header>Eligible
			 schools</header><text>For purposes of this subsection, the term <term>eligible
			 school</term> means a school that has made a formal decision to discontinue use
			 of a name or depiction that is derogatory or discriminatory.</text>
				</paragraph></subsection><subsection id="H73C8ADD6EAB0485F9661D309E5A014BD"><enum>(b)</enum><header>Construction
			 Grants</header><text>Not sooner than the end of the 1-year period during which
			 grants may be made under subsection (a)(1), the Secretary may make grants to
			 Indian schools and to schools that received grants under subsection (a)(1) for
			 school construction or renovation.</text>
			</subsection><subsection id="HF9A80800B97D453FABF71358C05799A1"><enum>(c)</enum><header>Consultation</header><text>Before
			 making any grant under this section, the Secretary shall consult with Indian
			 tribes concerning the grant.</text>
			</subsection><subsection id="H370D4E4EFEC94CC09EB131A1DEAA7A53"><enum>(d)</enum><header>Application</header><text>To
			 seek a grant under this section, an applicant shall submit an application at
			 such time, in such manner, and containing such information as the Secretary
			 reasonably requires.</text>
			</subsection></section><section id="H57F722A50B4B47A28564B4DB372D18AF"><enum>4.</enum><header>Committee on
			 Indian Relations</header>
			<subsection id="HD330B1546C304ACC82981E1D2FE59C77"><enum>(a)</enum><header>Establishment</header><text>Not
			 later than 6 months after the date of the enactment of this Act, the Secretary
			 shall establish within the Department of Education a committee to be known as
			 the Committee on Indian Relations.</text>
			</subsection><subsection id="H55E461C114D44A84A0355CD728711542"><enum>(b)</enum><header>Duties</header><text>The
			 Committee shall—</text>
				<paragraph id="H1A6F1B59043D404DBAA6601F6B0755C3"><enum>(1)</enum><text>in accordance with
			 section 5(c), determine names and depictions that are derogatory or
			 discriminatory;</text>
				</paragraph><paragraph id="H293C63BAEF7D40279CD1C90CA0F6F2F0"><enum>(2)</enum><text>not later than 1
			 year after the date of the enactment of this Act—</text>
					<subparagraph id="HCCAE051D3739444F901EECF3DF22274F"><enum>(A)</enum><text>identify schools
			 that use a name or depiction that is derogatory or discriminatory as a team
			 name, mascot, or nickname of the school or any entity sponsored by the school;
			 and</text>
					</subparagraph><subparagraph id="H169003C18E0C41F886F1E6A5FB109BC9"><enum>(B)</enum><text>inform any school
			 so identified of the assistance available under this Act to discontinue use of
			 such name or depiction;</text>
					</subparagraph></paragraph><paragraph id="H6C699581D9154AE4B7DBBA69F8EF7D5E"><enum>(3)</enum><text>assist the
			 Secretary to make grants under section 3; and</text>
				</paragraph><paragraph id="HC2C4A57ECEC64574A0CA0805CC7E1E8A"><enum>(4)</enum><text>provide cultural
			 proficiency training at schools receiving assistance under section 3 to effect
			 positive and long-term change regarding any derogatory or discriminatory name
			 or depiction.</text>
				</paragraph></subsection><subsection id="HEE1AC4662BB94852BE485A119BDF0785"><enum>(c)</enum><header>Director</header><text>The
			 Committee shall have a Director, who shall be appointed by the Secretary in
			 consultation with tribal governments involved in Indian education program
			 activities. The Director shall be paid at the rate of basic pay for level V of
			 the Executive Schedule.</text>
			</subsection><subsection id="H431EF43BC172441FA5971D04C5156553"><enum>(d)</enum><header>Staff</header><text>The
			 Director may appoint such personnel as the Director considers appropriate to
			 carry out the purposes of the Committee.</text>
			</subsection><subsection id="H8EFCAF775C0844B0830BDF8740576ACB"><enum>(e)</enum><header>Termination</header><text>The
			 Committee shall terminate at the end of fiscal year 2015.</text>
			</subsection></section><section id="H806BB1C2EED448C4A54B9622CEC3FCBF"><enum>5.</enum><header>Derogatory or
			 discriminatory names and depictions</header>
			<subsection id="HCD5BE6B79F674CA793CC3019E06E3224"><enum>(a)</enum><header>In
			 General</header><text>For purposes of this Act, a name or depiction is
			 derogatory or discriminatory if listed in subsection (b) or designated under
			 subsection (c).</text>
			</subsection><subsection id="H598192D92EBA4601A1DAC9167C3AA8CA"><enum>(b)</enum><header>Listed
			 Names</header><text>The names listed in this subsection are the
			 following:</text>
				<paragraph id="H7F9C1AA1A9AB431985437E9BBAD781D9"><enum>(1)</enum><text>Indians.</text>
				</paragraph><paragraph id="H91E9E59339F647B58FB82E7317108D31"><enum>(2)</enum><text>Redskins.</text>
				</paragraph><paragraph id="H468EA444FC7A49A6B09D57C13DA5DFC7"><enum>(3)</enum><text>Braves.</text>
				</paragraph><paragraph id="H2B3ED27569CA466894CD1F3F634C52AB"><enum>(4)</enum><text>Chiefs.</text>
				</paragraph></subsection><subsection id="H2665BDBC26B841E495A58677DA10F24D"><enum>(c)</enum><header>Designated Names
			 and Depictions</header><text>A name or depiction is designated under this
			 subsection if the Committee determines, after notice and comment, that the name
			 or depiction is derogatory or discriminatory on the basis of race, ethnicity,
			 nationality, or Indian or Native Alaskan tribal affiliation.</text>
			</subsection></section><section id="HAE47F6DA8042442EAE3C78A6A02FAC7B"><enum>6.</enum><header>Reports</header>
			<subsection id="H46708C5795D3412A81D62944B8AAB5DD"><enum>(a)</enum><header>In
			 General</header><text>Not later than 1 year after the date of the enactment of
			 this Act, and annually for each of the 4 succeeding fiscal years, the
			 Secretary, in consultation with the Committee, shall submit a report to the
			 Committee on Resources of the House of Representatives and the Committee on
			 Indian Affairs of the Senate.</text>
			</subsection><subsection id="HECB932A02383485484FAC77704CF182E"><enum>(b)</enum><header>Contents</header><text>Each
			 report submitted under this section shall include the following:</text>
				<paragraph id="H8795350E46D1460698D8F90597FF1814"><enum>(1)</enum><text>A
			 summary of the activities conducted by the Secretary, including those conducted
			 by the Committee, to carry out this Act.</text>
				</paragraph><paragraph id="H9727497983F34627A7EA2FC62FAF1F76"><enum>(2)</enum><text>Any
			 recommendations for legislation that the Secretary, in consultation with the
			 Committee, determines to be necessary to carry out this Act.</text>
				</paragraph></subsection></section><section id="H21646AD4C16247BAB68F0D3DECCA09FF"><enum>7.</enum><header>Definitions</header><text display-inline="no-display-inline">For purposes of this Act:</text>
			<paragraph id="HABD45F4F53DF428E96A2318B129F2059"><enum>(1)</enum><text>The term
			 <term>Committee</term> means the Committee on Indian Relations established
			 under section 4.</text>
			</paragraph><paragraph id="HC2C723B2B7084568B58312D209C91E16"><enum>(2)</enum><text>The term
			 <term>school</term> means—</text>
				<subparagraph id="H722CA9532476417189864628DF029731"><enum>(A)</enum><text>an elementary
			 school or a secondary school (as such terms are defined in section 9101 of the
			 Elementary and Secondary Education Act of 1965 (20 U.S.C. 7801)); or</text>
				</subparagraph><subparagraph id="H024452B811FC43F3AC824458FC0C3434"><enum>(B)</enum><text>an institution of
			 higher education (as such term is defined in section 101(a) of the Higher
			 Education Act of 1965 (20 U.S.C. 1001(a))).</text>
				</subparagraph></paragraph><paragraph id="HD22C85F76CFC4AA8BE2F2BABFFE49240"><enum>(3)</enum><text>The term
			 <term>Indian school</term> means a school that is operated by—</text>
				<subparagraph id="H5E1963C0ADFB4DDCB255CD244F1F687E"><enum>(A)</enum><text>the Bureau of
			 Indian Affairs; or</text>
				</subparagraph><subparagraph id="H93CF3BF3A09C4E5CABA17BD11A6D77A2"><enum>(B)</enum><text>an Indian tribe,
			 or an organization controlled or sanctioned by an Indian tribal government, for
			 the children of that tribe under a contract with, or grant from, the Department
			 of the Interior under the Indian Self-Determination Act or the Tribally
			 Controlled Schools Act of 1988.</text>
				</subparagraph></paragraph><paragraph id="HF2005235E8D24B3893F27E31F534C07E"><enum>(4)</enum><text>The term
			 <term>Indian tribe</term> has the meaning given to that term in section 4(e) of
			 the Indian Self-Determination and Education Assistance Act (25 U.S.C.
			 450b(e)).</text>
			</paragraph><paragraph id="H8735ED08A5434BB2B7831FCA356E2D2A"><enum>(5)</enum><text>The term
			 <term>Secretary</term> means the Secretary of Education.</text>
			</paragraph></section><section id="HE01FDFBE540E4E4694665782B6C741B6"><enum>8.</enum><header>Authorization of
			 appropriations</header><text display-inline="no-display-inline">There are
			 authorized to be appropriated such sums as may be necessary to carry out this
			 Act, to remain available until expended, for each of fiscal years 2011 through
			 2015. Such authorization of appropriations shall be in addition to any other
			 authorization of appropriations for Indian education.</text>
