		<section id="H4042CE0A6FCE447A9A5A6666EE94A77B" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Hunger Free Schools
			 Act</short-title></quote>.</text>
		</section><section id="H4C4DDA91ECB545F1A8072904D191BE6C"><enum>2.</enum><header>Improving direct
			 certification</header>
			<subsection id="H9D37DFE84E874A6882B2EA5134200640"><enum>(a)</enum><header>Performance
			 awards</header><text>Section 9(b)(4) of the Richard B. Russell National School
			 Lunch Act (42 U.S.C. 1758(b)(4)) is amended—</text>
				<paragraph id="HE7C23093FFC94DDA9A85D451CB628B6B"><enum>(1)</enum><text>in the paragraph
			 heading, by striking <quote><header-in-text level="paragraph" style="OLC">food
			 stamp</header-in-text></quote> and inserting <quote><header-in-text level="paragraph" style="OLC">supplemental nutrition assistance
			 program</header-in-text></quote>; and</text>
				</paragraph><paragraph id="HAE9C798963AF443398863F196D9327CD"><enum>(2)</enum><text>by adding at the
			 end the following:</text>
					<quoted-block display-inline="no-display-inline" id="H77A4FC51410A41C1B738AE46BFC33518" style="OLC">
						<subparagraph id="HA441D29126B44CCF81A6424204BE37AC"><enum>(E)</enum><header>Performance
				awards</header>
							<clause id="HC9B410A594D84A9D9F2A9D9753350313"><enum>(i)</enum><header>In
				general</header><text>Effective for each of the schools years beginning July 1,
				2010, July 1, 2011, and July 1, 2012, the Secretary shall offer performance
				awards to States to encourage the States to ensure that all children eligible
				for direct certification under this paragraph are certified in accordance with
				this paragraph.</text>
							</clause><clause id="H57C55E05A2C64E95BC52607393DFACF9"><enum>(ii)</enum><header>Requirements</header><text>For
				each school year described in clause (i), the Secretary shall—</text>
								<subclause id="H29B22D6C703B48418943D3AF6D588D31"><enum>(I)</enum><text>consider State
				data from the prior school year, including estimates contained in the report
				required under section 4301 of the Food, Conservation, and Energy Act of 2008
				(42 U.S.C. 1758a); and</text>
								</subclause><subclause id="HC7875C151CB54B10A731DDD6B38085CD"><enum>(II)</enum><text>make performance
				awards to, as determined by the Secretary—</text>
									<item id="H132FE42FB2814646AEC37E2639735689"><enum>(aa)</enum><text>5
				States that demonstrate outstanding performance; and</text>
									</item><item id="H832954C0A1504C81BE2FC648664B14FC"><enum>(bb)</enum><text>5
				States that demonstrate substantial improvement.</text>
									</item></subclause></clause><clause id="HC58947415C974CD5ADC81F15FF7E47C7"><enum>(iii)</enum><header>Funding</header>
								<subclause id="HAD013226752B4310803C04732A84385F"><enum>(I)</enum><header>In
				general</header><text>On October 1, 2010, and on each October 1 thereafter
				through October 1, 2012, out of any funds in the Treasury not otherwise
				appropriated, the Secretary of the Treasury shall transfer to the Secretary, to
				remain available until expended—</text>
									<item id="H177FF5B775B04E26BDAA166A52258E49"><enum>(aa)</enum><text>$2,000,000 to
				carry out clause (ii)(II)(aa); and</text>
									</item><item id="H9F4158D81E5D486399FB8BD66710AA34"><enum>(bb)</enum><text>$2,000,000 to
				carry out clause (ii)(II)(bb).</text>
									</item></subclause><subclause id="HDD5C80307F8542E0B5A37EA053D5C6DE"><enum>(II)</enum><header>Receipt and
				acceptance</header><text>The Secretary shall be entitled to receive, shall
				accept, and shall use to carry out this clause the funds transferred under
				subclause (I), without further
				appropriation.</text>
								</subclause></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="HE3B8119714734440890D2649541A11BD"><enum>(b)</enum><header>Continuous
			 improvement plans</header><text>Section 9(b)(4) of the Richard B. Russell
			 National School Lunch Act (42 U.S.C. 1758(b)(4)) (as amended by subsection (a))
			 is amended by adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="H29745C0440984BE486BB7C329427F04E" style="OLC">
					<subparagraph id="HF2008EA6B88A4538987F020B642597EB"><enum>(F)</enum><header>Continuous
				improvement plans</header>
						<clause id="H0D87D225CA934C98B64B0C928877AE32"><enum>(i)</enum><header>In
				general</header><text>Each school year, the Secretary shall—</text>
							<subclause id="H92D76EA655F34CEF9D92D72D90182C34"><enum>(I)</enum><text>identify, using
				estimates contained in the report required under section 4301 of the Food,
				Conservation, and Energy Act of 2008 (42 U.S.C. 1758a), States that directly
				certify less than 95 percent of the total number of children in the State who
				are eligible for direct certification under this paragraph; and</text>
							</subclause><subclause id="HC1C33DCF1D7646228CACF06FAE1D1B14"><enum>(II)</enum><text>require the
				States identified under subclause (I) to implement a corrective action plan to
				fully meet the requirements of this paragraph.</text>
							</subclause></clause><clause id="H8891F84282EB4EB396DA5C1C61AB4B2A"><enum>(ii)</enum><header>Improving
				performance</header><text>A State may include in a corrective action plan under
				clause (i)(II) methods to improve direct certification required under this
				paragraph or paragraph (15) and discretionary certification under paragraph
				(5).</text>
						</clause><clause id="H33A80595365C474281AD48053BFC86DF"><enum>(iii)</enum><header>Failure to
				meet performance standard</header>
							<subclause id="H56FB7059C25548009638B59C52B1D175"><enum>(I)</enum><header>In
				general</header><text>A State that is required to implement a corrective action
				plan under clause (i)(II) shall be required to submit to the Secretary, for the
				approval of the Secretary, a direct certification improvement plan for the
				following school year.</text>
							</subclause><subclause id="H71DE3A2C03814471AD3BBD7DC75DFF82"><enum>(II)</enum><header>Requirements</header><text>A
				direct certification improvement plan under subclause (I) shall include—</text>
								<item id="H73227209FBD74DBD837F5776405B6BFD"><enum>(aa)</enum><text>specific measures
				that the State will use to identify more children who are eligible for direct
				certification;</text>
								</item><item id="H7101A52816E948A986A9B99927FE4A9B"><enum>(bb)</enum><text>a
				timeline for the State to implement those measures; and</text>
								</item><item id="HDE067A7F463A4997BF2ADBF4813D4AB7"><enum>(cc)</enum><text>goals for the
				State to improve direct certification
				results.</text>
								</item></subclause></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H5FF446706E004FFDBCCB7B3E603A8445"><enum>(c)</enum><header>Without further
			 application</header><text>Section 9(b)(4) of the Richard B. Russell National
			 School Lunch Act (42 U.S.C. 1758(b)(4)) (as amended by subsection (b)) is
			 amended by adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="H208E372E75CA4648AC97B2267F2D67C2" style="OLC">
					<subparagraph id="H5C6AD7DE79714CC9A2A0B32E81C53554"><enum>(G)</enum><header>Without further
				application</header>
						<clause id="HD3A34B14D1A942C6BCB179C97CD571F5"><enum>(i)</enum><header>In
				general</header><text>In this paragraph, the term <term>without further
				application</term> means that no action is required by the household of the
				child.</text>
						</clause><clause id="H4A9BEA7A031042C6956861825BB179D6"><enum>(ii)</enum><header>Clarification</header><text>A
				requirement that a household return a letter notifying the household of
				eligibility for direct certification or eligibility for free school meals does
				not meet the requirements of clause
				(i).</text>
						</clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection></section><section id="HB4D007FFFDD24C5DA8A7B3B15F0A96D8"><enum>3.</enum><header>Report on using
			 statewide education databases for direct certification</header>
			<subsection id="H890DA3F363A9406886413A1ECE6089A8"><enum>(a)</enum><header>Report</header><text>Not
			 later than 2 years after the date of enactment of this Act, the Secretary of
			 Education shall prepare and submit to Congress a report regarding how statewide
			 databases developed by States to track compliance with the requirements of part
			 A of title I of the Elementary and Secondary Education Act of 1965 (20 U.S.C.
			 6311 et seq.) can be used for purposes of direct certification under section
			 9(b) of the Richard B. Russell National School Lunch Act (42 U.S.C.
			 1758(b)).</text>
			</subsection><subsection id="H533F9C998ABC407A92F31DC24323BAD2"><enum>(b)</enum><header>Contents</header><text>The
			 report described in subsection (a) shall—</text>
				<paragraph id="H18FFACCCA6C24AF1B0114E3794BE0CBB"><enum>(1)</enum><text>identify the
			 States that have, as of the time of the report, developed statewide databases
			 to track compliance with the requirements of part A of title I of the
			 Elementary and Secondary Education Act of 1965 (20 U.S.C. 6311 et seq.);</text>
				</paragraph><paragraph id="H15F0252D76534650A8E5FCED937272CC"><enum>(2)</enum><text>describe best
			 practices regarding how such statewide databases can be used for purposes of
			 direct certification under section 9(b) of the Richard B. Russell National
			 School Lunch Act (42 U.S.C. 1758(b));</text>
				</paragraph><paragraph id="HAE196F3150054F2CB92CEDE04D411BD9"><enum>(3)</enum><text>include case
			 studies of States that have expanded such statewide databases so that such
			 statewide databases can be used for direct certification purposes; and</text>
				</paragraph><paragraph id="H8752A2E0E2B44087813BCD1B4CAB8E4E"><enum>(4)</enum><text>identify States
			 with such statewide databases that would be appropriate for expansion for
			 direct certification purposes.</text>
				</paragraph></subsection><subsection id="H2849FEF628DC4935BE88184B2F4E715C"><enum>(c)</enum><header>Funding</header>
				<paragraph id="H1EF5DA6646C04A38BF6824EF7310C824"><enum>(1)</enum><header>In
			 general</header><text>On October 1, 2010, out of any funds in the Treasury not
			 otherwise appropriated, the Secretary of the Treasury shall transfer to the
			 Secretary to carry out this section $500,000, to remain available through
			 September 30, 2013.</text>
				</paragraph><paragraph id="HB9FBBC32F0A74FAD8E176500DD5D40DD"><enum>(2)</enum><header>Receipt and
			 acceptance</header><text>The Secretary shall be entitled to receive, shall
			 accept, and shall use to carry out this section the funds transferred under
			 paragraph (1), without further appropriation.</text>
				</paragraph></subsection></section><section id="H0E3F6307488D460CA587C55977C463A4"><enum>4.</enum><header>Expanding direct
			 certification</header>
			<subsection id="H09A84287697045DBA9EC6A23DD733AF5"><enum>(a)</enum><header>Direct
			 Certification for Children Receiving Medicaid or SCHIP</header><text>Section
			 9(b) of the Richard B. Russell National School Lunch Act (42 U.S.C. 1758(b)) is
			 amended by adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="HECCAF59005F146679A41986D74E38959" style="OLC">
					<paragraph id="HF29DB6F3520D44D48E31F89209F11C15"><enum>(14)</enum><header>Direct
				certification for children receiving medicaid or schip</header>
						<subparagraph id="HC917C29520734ABB87397C5A7087D7D6"><enum>(A)</enum><header>Definition of
				eligible child</header><text>In this paragraph, the term <term>eligible
				child</term> means a child—</text>
							<clause id="H70E25AE09049408382812CB894FBE559"><enum>(i)</enum><subclause commented="no" display-inline="yes-display-inline" id="H8576E35F4D204A449548EF437B2A1EB3"><enum>(I)</enum><text>who is eligible for and
				receiving medical assistance under the State Medicaid program under title XIX
				of the Social Security Act (42 U.S.C. 1396 et seq.) or child health assistance
				under the State children’s health insurance program under title XXI of that Act
				(42 U.S.C. 1397aa et seq.); and</text>
								</subclause><subclause id="HB469F33E33304C89A23A5AC1732ED1A9" indent="up1"><enum>(II)</enum><text>whose family income, as used for
				purposes of determining eligibility for the relevant program in subclause (I),
				does not exceed 133 percent of the poverty line (as defined in section 673(2)
				of the Community Services Block Grant Act (42 U.S.C. 9902(2), including any
				revision required by such section)) applicable to a family of the size used for
				purposes of determining that eligibility; or</text>
								</subclause></clause><clause id="H6E4276E2E91348FA84A036DFDE63C4C1"><enum>(ii)</enum><text>a
				child who is a member of a household (as that term is defined in section 245.2
				of title 7, Code of Federal Regulations (or successor provisions)) with a child
				described in clause (i).</text>
							</clause></subparagraph><subparagraph id="H95899A8185584E0686F0098827A27ABB"><enum>(B)</enum><header>Agreement</header><text>Subject
				to subparagraph (D), each State agency shall enter into an agreement with the
				State agency conducting eligibility determinations for the programs described
				in subparagraph (A)(i).</text>
						</subparagraph><subparagraph id="H0051F9C7A4EA4F459642388E5340850A"><enum>(C)</enum><header>Procedures</header><text>Subject
				to subparagraph (D) and paragraph (6), the agreement shall establish procedures
				under which an eligible child shall be certified for free lunches under this
				Act and free breakfasts under section 4 of the Child Nutrition Act of 1966 (42
				U.S.C. 1773), without further application (as defined in paragraph
				(4)(G)).</text>
						</subparagraph><subparagraph id="HA5EA210AFA994E639B8CFF9FD5D65EBC"><enum>(D)</enum><header>Certification</header><text>Subject
				to subparagraph (D) and paragraph (6), under the agreement, the local
				educational agency conducting eligibility determinations for a school lunch
				program under this Act and a school breakfast program under the Child Nutrition
				Act of 1966 (42 U.S.C. 1771 et seq.) shall certify an eligible child as
				eligible for free lunches under this Act and free breakfasts under the Child
				Nutrition Act of 1966 (42 U.S.C. 1771 et seq.), without further application (as
				defined in paragraph (4)(G)).</text>
						</subparagraph><subparagraph id="H87E837F2CC7044609BB17182A18E740C"><enum>(E)</enum><header>Applicability</header><text>This
				paragraph applies to—</text>
							<clause id="HAFF3439FE49E4860ADF623B3A392EB10"><enum>(i)</enum><text>in
				the case of the school year beginning July 1, 2010, any State or local
				educational agency that elects to participate in direct certification under
				this paragraph;</text>
							</clause><clause id="HA076F0ABC0D249C7AD5E29D2A14F13E5"><enum>(ii)</enum><text>in the case of
				the school year beginning July 1, 2011, a local educational agency that had an
				enrollment of 25,000 students or more in the preceding school year;</text>
							</clause><clause id="H10755C779D93482593C812EF5F1F8B73"><enum>(iii)</enum><text>in the case of
				the school year beginning July 1, 2012, a local educational agency that had an
				enrollment of 10,000 students or more in the preceding school year; and</text>
							</clause><clause id="HCB813E40B51C463D9504D4E5C178FA31"><enum>(iv)</enum><text>in the case of
				the school year beginning July 1, 2013, and each subsequent school year, each
				local educational agency.</text>
							</clause></subparagraph><subparagraph id="HFE34DEBD035C4581A044CD9BB615FE10"><enum>(F)</enum><header>Grants</header>
							<clause id="H944866A1A1004A70A2E4217B497D5B1E"><enum>(i)</enum><header>In
				general</header><text>The Secretary shall provide grants to State agencies that
				carry out child nutrition programs (as defined in section 25(b)) or conduct
				eligibility determinations for the programs described in subparagraph (A)(i)
				for activities associated with implementing this paragraph, including—</text>
								<subclause id="H4EEE7D31A2CE4FDF8EA0AE67F94FCB7A"><enum>(I)</enum><text>computer system
				upgrades;</text>
								</subclause><subclause id="H72346AC2E3D84BC88F12B24C5F0D4B99"><enum>(II)</enum><text>reprogramming to
				allow for data matches; and</text>
								</subclause><subclause id="HD3FD3882A4E645EBADBFEEDF0804FD01"><enum>(III)</enum><text>training local
				educational agency staff.</text>
								</subclause></clause><clause id="H88BE9EF455544B888D61D7496D7237C4"><enum>(ii)</enum><header>Requirement</header><text>The
				Secretary shall use funds made available under this subparagraph to
				provide—</text>
								<subclause id="HE209220CAB104B81B4A5FDACE488E986"><enum>(I)</enum><text>initial grants of
				$50,000 to each State agency; and</text>
								</subclause><subclause id="HA70EB551F42F492FB21F8D1469784E77"><enum>(II)</enum><text>the remainder of
				the funds through competitive grants based on criteria established by the
				Secretary.</text>
								</subclause></clause><clause id="H528E67F7A8FB4FF8B5D59ED01ABCCE60"><enum>(iii)</enum><header>Funding</header>
								<subclause id="H7B2266E496B94ED39C46646023ED91B8"><enum>(I)</enum><header>In
				general</header><text>On October 1, 2010, out of any funds in the Treasury not
				otherwise appropriated, the Secretary of the Treasury shall transfer to the
				Secretary to carry out this subparagraph $15,000,000, to remain available until
				expended.</text>
								</subclause><subclause id="H901F0C65484946D99750B19956DA6850"><enum>(II)</enum><header>Receipt and
				acceptance</header><text>The Secretary shall be entitled to receive, shall
				accept, and shall use to carry out this subparagraph the funds transferred
				under subclause (I), without further
				appropriation.</text>
								</subclause></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H4E4FF49DB781412E967CE39285788F15"><enum>(b)</enum><header>Direct
			 certification pilot program</header><text>Section 9(b) of the Richard B.
			 Russell National School Lunch Act (42 U.S.C. 1758(b)) (as amended by subsection
			 (a)) is amended by adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="H93B33EFFBE5B4997BFEDFA200F3436C4" style="OLC">
					<paragraph id="H555AE12E74E64F1AA6400C51F52B236E"><enum>(15)</enum><header>Direct
				certification pilot program</header>
						<subparagraph id="H6CDADF000CBD4FA79C536D0EEFDFE601"><enum>(A)</enum><header>In
				general</header><text>For the school year beginning July 1, 2010, the Secretary
				shall carry out a pilot program to evaluate the use of program data, including
				data relating to medical assistance under the State Medicaid program under
				title XIX of the Social Security Act (42 U.S.C. 1396 et seq.) or child health
				assistance under the State children’s health insurance program under title XXI
				of that Act (42 U.S.C. 1397aa et seq.), for direct certification of children
				for reduced price school meals.</text>
						</subparagraph><subparagraph id="HC1972E70FD8E41359918F6F8CB4335A6"><enum>(B)</enum><header>Requirements</header><text>The
				evaluation shall include—</text>
							<clause id="H4E57F91B2F054B2FB7AA64F76B7E660E"><enum>(i)</enum><text>an
				analysis of the number of children directly certified for reduced price
				meals;</text>
							</clause><clause id="H03B3DEE6014A43BEB3F2327ED149B480"><enum>(ii)</enum><text>an assessment
				of—</text>
								<subclause id="H1EAEA5FB2DAE43A6AAF5705F479662E2"><enum>(I)</enum><text>the workload
				reduction for school districts associated with processing fewer paper
				applications and having a smaller verification sample; and</text>
								</subclause><subclause id="H6FC409F5A8AE4F6CBF0E3E0347E063D5"><enum>(II)</enum><text>the workload
				associated with directly certifying children for reduced price meals;</text>
								</subclause></clause><clause id="H0F7C37D035D0465086C14C1C64B0FEBA"><enum>(iii)</enum><text>an analysis of
				the number of children made eligible for reduced price meals who would have
				been eligible for paid meals or free meals if a paper application had been
				submitted on behalf of the child; and</text>
							</clause><clause id="HE530BF4C05654624A487F5DFDA5219C5"><enum>(iv)</enum><text>testing of
				various mechanisms to ensure that no child receives a lower level of benefits
				as a result of the pilot than the child would have received had a paper
				application been submitted and approved.</text>
							</clause></subparagraph><subparagraph id="H0C53A0A7CC50484FB4A8E6F17036B7FE"><enum>(C)</enum><header>Report</header><text>Not
				later than December 31, 2011, the Secretary shall submit to the Committee on
				Agriculture, Nutrition, and Forestry of the Senate and the Committee on
				Education and Labor of the House of Representatives a report describing the
				results of the pilot program under this paragraph.</text>
						</subparagraph><subparagraph id="HBB025B164A5B474C94A7F2BAB9BCCA03"><enum>(D)</enum><header>Funding</header>
							<clause id="H3CAC615CEFDF4EA8BF2A5DABF2EB74A5"><enum>(i)</enum><header>In
				general</header><text>On October 1, 2010, out of any funds in the Treasury not
				otherwise appropriated, the Secretary of the Treasury shall transfer to the
				Secretary to carry out this paragraph $4,000,000, to remain available until
				expended.</text>
							</clause><clause id="H6A86967CC11C4FECAB3D8C3B7AE0470E"><enum>(ii)</enum><header>Receipt and
				acceptance</header><text>The Secretary shall be entitled to receive, shall
				accept, and shall use to carry out this paragraph the funds transferred under
				clause (i), without further
				appropriation.</text>
							</clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H04AF77F0BF4B4579A0CE59D1EF7F05A6"><enum>(c)</enum><header>Direct
			 certification of children of military personnel</header><text>Section 9(b) of
			 the Richard B. Russell National School Lunch Act (42 U.S.C. 1758(b)) (as
			 amended by subsection (b)) is amended by adding at the end the
			 following:</text>
				<quoted-block display-inline="no-display-inline" id="H370B91BD8F794DA897211DFB09092555" style="OLC">
					<paragraph id="HF3817635AB3A4C028BFD4DD67AFB772E"><enum>(16)</enum><header>Direct
				certification of children of military personnel</header><text>Subject to
				paragraph (6), any local educational agency may certify any child as eligible
				for free lunches or breakfasts, without further application (as defined in
				paragraph (4)(G)), by directly communicating with the appropriate commander at
				the military installation or facility concerned to obtain documentation of the
				status of the child as a member of a household that is eligible for a
				supplemental subsistence allowance for low-income members with dependents under
				section 402a of title 37, United States
				Code.</text>
					</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="HBA527FF2FB2341A7A4B7E72BC66AD4E9"><enum>(d)</enum><header>Agreement for
			 direct certification and cooperation by State medicaid and CHIP
			 agencies</header>
				<paragraph id="HD96F8593FE2C499CB4D571DD9C3C726D"><enum>(1)</enum><header>In
			 general</header><text>Section 1902(a)(7) of the Social Security Act (42 U.S.C.
			 1396a(a)(7)) is amended—</text>
					<subparagraph id="H5DDB1FF4E1314E8A98A911F9DD4490CE"><enum>(A)</enum><text>by redesignating
			 subparagraphs (A) and (B) as clauses (i) and (ii), respectively, and realigning
			 the left margins accordingly;</text>
					</subparagraph><subparagraph id="H4B845164B5A24D25B61F5C52D430C04C"><enum>(B)</enum><text>in clause (ii) (as
			 so redesignated)—</text>
						<clause id="HF44757F7B11B4836A2605007FF8ECFAE"><enum>(i)</enum><text>by
			 striking <quote>at State option,</quote>;</text>
						</clause><clause id="HEC74B7E1474847FB96C3355CC09A3F21"><enum>(ii)</enum><text>by
			 inserting <quote>certify or</quote> before <quote>verify the certification of
			 eligibility</quote>; and</text>
						</clause><clause id="H7861A247DE48498ABF5DBE3062976ECF"><enum>(iii)</enum><text>by
			 adding <quote>and</quote> after the semicolon;</text>
						</clause></subparagraph><subparagraph id="H783C5BAC6FA046069409ABA7ECBA7A22"><enum>(C)</enum><text>by striking
			 <quote>provide safeguards</quote> and inserting “provide—</text>
						<quoted-block display-inline="no-display-inline" id="HF4706BA2913A4B398E51C590A6AF0850" style="OLC">
							<subparagraph id="H00635F24642C44319B3B35EA3AEB831F"><enum>(A)</enum><text>safeguards</text>
							</subparagraph><after-quoted-block>;
				and</after-quoted-block></quoted-block>
					</subparagraph><subparagraph id="HE18D00143BA44A99B2D874A0E5B7FE2C"><enum>(D)</enum><text>by adding at the
			 end the following:</text>
						<quoted-block display-inline="no-display-inline" id="H3654F388995F4B73998E3969F0EC1F9E" style="OLC">
							<subparagraph id="HA0346198506B4EF7BD3EC86D8C97366E"><enum>(B)</enum><text>that,
				notwithstanding the option under subsection (e)(13) (relating to Express Lane
				eligibility), not later than July 1, 2010, the State shall enter into an
				agreement with the State agency administering the school lunch program
				established under the Richard B. Russell National School Lunch Act under which
				the State shall establish procedures to ensure that—</text>
								<clause id="H7FF9F02B8BD94E248C720DF2D2A1EE5D"><enum>(i)</enum><text>any child
				receiving medical assistance under the State plan under this title or child
				health assistance under a State child health plan under title XXI whose family
				income does not exceed 133 percent of the poverty line (as defined in section
				673(2) of the Community Services Block Grant Act, including any revision
				required by such section) applicable to a family of the size involved, shall be
				certified as eligible for free lunches under the Richard B. Russell National
				School Lunch Act and free breakfasts under the Child Nutrition Act of 1966
				without further application; and</text>
								</clause><clause id="H3B4A9F07C66D4699B6A63E8E6023752F"><enum>(ii)</enum><text>the State
				agencies responsible for administering the State plan under this title, the
				State child health plan under title XXI, and for carrying out child nutrition
				programs (as defined in section 25(b) of the Richard B. Russell National School
				Lunch Act) cooperate in carrying out paragraphs (3)(F) and (14) of section 9(b)
				of that
				Act;</text>
								</clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
					</subparagraph></paragraph><paragraph id="HDCA0613397244AA7B804EBA8C6B32CFE"><enum>(2)</enum><header>Effective
			 date</header>
					<subparagraph id="H191049D7FB584C769A234F29A99CE1E9"><enum>(A)</enum><header>In
			 general</header><text>Except as provided in paragraph (2), the amendments made
			 by this subsection take effect on the date of enactment of this Act.</text>
					</subparagraph><subparagraph id="HD0823D1C0DDA41469E523C5053B42F13"><enum>(B)</enum><header>Extension of
			 effective date for State law amendment</header><text>In the case of a State
			 plan under title XIX of the Social Security Act (42 U.S.C. 1396 et seq.) which
			 the Secretary of Health and Human Services determines requires State
			 legislation in order for the plan to meet the additional requirements imposed
			 by the amendments made by this section, the State plan shall not be regarded as
			 failing to comply with the requirements of the amendments made by this section
			 solely on the basis of its failure to meet such additional requirements before
			 the first day of the first calendar quarter beginning after the close of the
			 first regular session of the State legislature that begins after the date of
			 the enactment of this Act. For purposes of the previous sentence, in the case
			 of a State that has a 2-year legislative session, each year of the session is
			 considered to be a separate regular session of the State legislature.</text>
					</subparagraph></paragraph></subsection></section><section id="H353CA3B8F0FE4745A961379B3D86C0D0"><enum>5.</enum><header>Hunger free
			 schools</header>
			<subsection id="H93124030C3554DD38D038831187214BB"><enum>(a)</enum><header>Eligibility</header><text>Section
			 11(a)(1) of the Richard B. Russell National School Lunch Act (42 U.S.C.
			 1759a(a)(1)) is amended by adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="H658F69AAF23244209D3D7A8161A6A6E3" style="OLC">
					<subparagraph id="HA9666BEE15594E2A855EA50FBA879407"><enum>(F)</enum><header>Data-based
				eligibility</header>
						<clause id="H1CDF3DC50DFD4E7B909B1304FD8C1484"><enum>(i)</enum><header>In
				general</header><text>A school or local educational agency may elect to receive
				special assistance payments under clause (ii) in lieu of special assistance
				payments otherwise made available under this paragraph based on applications
				for free and reduced price lunches if the school or local educational
				agency—</text>
							<subclause id="H3F6CB54848DD447DAA35D14E88178EAC"><enum>(I)</enum><text>elects to serve
				all children in the school or local educational agency free lunches and
				breakfasts under the school lunch program and school breakfast program
				established under section 4 of the <act-name parsable-cite="CNA66">Child
				Nutrition Act of 1966</act-name> (42 U.S.C. 1773), during a period of 5
				successive school years; and</text>
							</subclause><subclause id="HF20D6FDD402B40389EB5076624FED309"><enum>(II)</enum><text>pays, from
				sources other than Federal funds, the costs of serving the lunches or
				breakfasts that are in excess of the value of assistance received under this
				Act and the Child Nutrition Act of 1966 (42 U.S.C. 1771 et seq.).</text>
							</subclause></clause><clause id="HBD0FFC82B4664E54B62FF9B0EAAFBC6F"><enum>(ii)</enum><header>Alternative
				data sources</header><text>Subject to criteria established by the Secretary not
				later than December 31, 2010, special assistance payments under clause (i) may
				be based on an estimate of the number of children eligible for free and reduced
				price lunches under section 9(b)(1)(A) derived from recent data other than
				applications, including—</text>
							<subclause id="H57F16E18EB474B3B898EFAA243C2816E"><enum>(I)</enum><text>a socioeconomic
				survey of a representative sample of households of students, which may exclude
				students who have been directly certified under paragraphs (4), (5), (14),
				(15), and (16) of section 9(b);</text>
							</subclause><subclause id="H62B795B8BE5E4A8BBA1FA03F55385A4B"><enum>(II)</enum><text>data from the
				American Community Survey of the Bureau of the Census;</text>
							</subclause><subclause id="H77536DA90D5D4844BBED3242DC68C22C"><enum>(III)</enum><text>data on receipt
				of income-tested public benefits by students or the households of students or
				income data collected by public benefit programs, including—</text>
								<item id="HEBD318C0851C4DD389B4F0780CD0FB0C"><enum>(aa)</enum><text>the
				supplemental nutrition assistance program established under the
				<act-name parsable-cite="FSA77">Food and Nutrition Act of 2008</act-name> (7
				U.S.C. 2011 et seq.);</text>
								</item><item id="H4F8AFEF9B895490D87844128705DB477"><enum>(bb)</enum><text>the
				medical assistance program under the State Medicaid program under title XIX of
				the Social Security Act (42 U.S.C. 1396 et seq.);</text>
								</item><item id="H82D414E4017842FE919F9B05714F3818"><enum>(cc)</enum><text>the
				supplemental security income program established under title XVI of that Act
				(42 U.S.C. 1381 et seq.); and</text>
								</item><item id="HA8DBC4D45307439F8C9BF5DD3E3BD63D"><enum>(dd)</enum><text>the
				program of block grants to States for temporary assistance for needy families
				established under part A of title IV of that Act (42 U.S.C. 601 et seq.);
				or</text>
								</item></subclause><subclause id="HA52C4B68D514418DB6E4ED61B836DC00"><enum>(IV)</enum><text>other data,
				including State or local survey data and State or local tax records.</text>
							</subclause></clause><clause id="H7C027AE589EF482C887E79CF363460DC"><enum>(iii)</enum><header>Review and
				approval</header><text>The Secretary shall—</text>
							<subclause id="H7D5EA72131814AFFB1EE66EFD8FD5DCD"><enum>(I)</enum><text>review any
				proposal submitted by a school or local educational agency that relies on the
				alternative data sources described in clause (ii) to develop an estimate of the
				number of children eligible for free and reduced price lunches under section
				9(b)(1)(A); and</text>
							</subclause><subclause id="H5893E4B4FF8A471EA3070D63D9607396"><enum>(II)</enum><text>approve the
				proposals that meet the criteria established under clause (ii).</text>
							</subclause></clause><clause id="H5780FD362A8A45FBB6E9719CAD197125"><enum>(iv)</enum><header>Payments</header>
							<subclause id="H38740472CD394B208EA1CB42B68746A1"><enum>(I)</enum><header>Free
				meals</header><text>For each month of the period during which a school or local
				educational agency described in clause (i) serves free lunches or breakfasts to
				all enrolled children, special assistance payments at the rate for free meals
				shall be made for a percentage of all reimbursable meals served that is equal
				to the percentage of students estimated to be eligible for free meals.</text>
							</subclause><subclause id="HF8E993E1F9484060BB05185B9AEF7AF7"><enum>(II)</enum><header>Reduced price
				meals</header><text>For each month of the period during which the school or
				local educational agency serves free lunches or breakfasts to all enrolled
				children, special assistance payments at the rate for reduced price meals shall
				be made for a percentage of all reimbursable meals served that is equal to the
				percentage of students estimated to be eligible for reduced price meals.</text>
							</subclause><subclause id="H889EB18C152745D69A03DF620CDD2782"><enum>(III)</enum><header>Other
				meals</header><text>For each month of the period during which the school or
				local educational agency serves free lunches or breakfasts to all enrolled
				children, special assistance payments at the rate provided under section 4
				shall be made for the remainder of the reimbursable meals served.</text>
							</subclause></clause><clause id="HFA1044DC7CD347F197F434F7DA94EAE7"><enum>(v)</enum><header>Renewals</header>
							<subclause id="HF0897B8503C64376989092203B633D11"><enum>(I)</enum><header>In
				general</header><text>A school or local educational agency described in clause
				(i) may reapply to the Secretary at the end of the period described in clause
				(i), and at the end of each period thereafter for which the school or local
				educational agency receives special assistance payments under this
				subparagraph, for the purpose of continuing to receive the reimbursements and
				assistance for a subsequent 5-school-year period.</text>
							</subclause><subclause id="HC049285CDAF84C858921068F88E54534"><enum>(II)</enum><header>Approval</header><text>The
				Secretary shall approve an application under this clause if available
				socioeconomic data demonstrate that the income level of the population of the
				school or local educational agency has remained consistent with or below the
				income level of the population of the school or local educational agency in the
				last year in which reimbursement rates were determined under clause
				(ii).</text>
							</subclause><subclause id="HFA73CF0EE02E4B42B81D23267D75410F"><enum>(III)</enum><header>Data</header><text>Not
				later than December 31, 2010, the Secretary shall establish criteria regarding
				the socioeconomic data that may be used by a school or local educational agency
				when applying for a renewal of the special assistance payments for a subsequent
				5-school-year period.</text>
							</subclause></clause></subparagraph><subparagraph id="H6191E7AD7D4A4D13B66D3CA2614019E7"><enum>(G)</enum><header>High-poverty
				areas</header>
						<clause id="HF14F3A8E08A74EDD937EE76995CA17EE"><enum>(i)</enum><header>In
				general</header><text>A school or local educational agency may elect to receive
				special assistance payments under clause (ii) in lieu of special assistance
				payments otherwise made available under this paragraph based on applications
				for free and reduced price lunches if the school or local educational
				agency—</text>
							<subclause id="HBE7993CC5EFE4B8B990CA3273A5DCD44"><enum>(I)</enum><text>during a period of
				2 successive school years, selects to serve all children in the school or local
				educational agency free lunches and breakfasts under the school lunch program
				under this Act and the school breakfast program established under section 4 of
				the <act-name parsable-cite="CNA66">Child Nutrition Act of 1966</act-name> (42
				U.S.C. 1773);</text>
							</subclause><subclause id="HC477F8710E9D4435AC1BC09B8D35687C"><enum>(II)</enum><text>pays, from
				sources other than Federal funds, the costs of serving the lunches or
				breakfasts that are in excess of the value of assistance received under this
				Act and the Child Nutrition Act of 1966 (42 U.S.C. 1771 et seq.) and during the
				prior school year, directly certified under paragraphs (4), (5), (14), (15),
				and (16) of section 9(b) at least 40 percent of the enrolled students;
				or</text>
							</subclause><subclause commented="no" id="H95BDA19E35B84D3A84917BB4B60B7673"><enum>(III)</enum><text>that received
				payments under this subparagraph for the prior school year, directly certifies
				under paragraphs (4), (5), (14), (15), and (16) of section 9(b) at least 30
				percent of the enrolled students.</text>
							</subclause></clause><clause id="H0C66A1E472AA45A1A4815C1A0C9DF4CE"><enum>(ii)</enum><header>Payments</header>
							<subclause id="H241DF27132784E42AA195B5C75B2F736"><enum>(I)</enum><header>In
				general</header><text>For each month of the school year, special assistance
				payments at the rate for free meals shall be made under this subparagraph for a
				percentage of all reimbursable meals served in an amount equal the product
				obtained by multiplying—</text>
								<item id="H8B7A08814EF548A48679D708B6065BCE"><enum>(aa)</enum><text>1.5; by</text>
								</item><item id="H5C78DC2D62A7460095028FA5B5AC558B"><enum>(bb)</enum><text>the
				percentage of students directly certified under paragraphs (4), (5), (14),
				(15), and (16) of section 9(b), up to a maximum of 100 percent.</text>
								</item></subclause><subclause id="H1362BCA349F64C3F87978F526E17C045"><enum>(II)</enum><header>Other
				meals</header><text>The percentage of meals served that is not described in
				subclause (I) shall be reimbursed at the rate provided under section 4.</text>
							</subclause></clause><clause id="H83F3E7E5CAAE4DE9BA66E959C20DAE09"><enum>(iii)</enum><header>Election of
				option</header>
							<subclause id="HE1407540A02E4389BB80169D9B453EAA"><enum>(I)</enum><header>In
				general</header><text>Any school or local educational agency eligible for the
				option under clause (i) may elect to receive special assistance payments under
				clause (ii) for the next school year if the school or local educational agency
				provides to the State agency evidence of the percentage of students directly
				certified not later than June 30 of the current school year.</text>
							</subclause><subclause id="HA26A6361D5DA444CAE3980DA4808AF8E"><enum>(II)</enum><header>State agency
				notification</header><text>Not later than May 1 of each school year, each State
				agency shall notify—</text>
								<item id="H82B1EF19EF92444FB698719912564D23"><enum>(aa)</enum><text>any
				local educational agency that appears, based on reported verification summary
				data, to have directly certified at least 40 percent of the enrolled students
				for the current school year, that the local educational agency may be eligible
				to elect to receive special assistance payments under clause (ii) for the next
				school year and explain the procedures for the local educational agency to make
				such an election; and</text>
								</item><item id="H7AE22FAA7C274E739613552D8C3D609A"><enum>(bb)</enum><text>any
				local educational agency that appears, based on reported verification summary
				data, to have directly certified at least 30 percent of the enrolled students
				for the current school year, that the local educational agency may become
				eligible to elect to receive special assistance payments under clause (ii) for
				a future school year if the local educational agency directly certifies at
				least 40 percent of the enrolled students.</text>
								</item></subclause><subclause id="H745699BCCF95450FB4BB9E8D0909FFC9"><enum>(III)</enum><header>Local
				education agency notification</header><text>Not later than May 1 of each school
				year, each local educational agency shall notify—</text>
								<item id="HD076EB9C674B4D97A0177EE74D486605"><enum>(aa)</enum><text>any
				school that directly certified at least 40 percent of the enrolled students for
				the current school year, that the school is eligible to elect to receive
				special assistance payments under clause (ii) for the next school year and
				explain the procedures for the school to make such an election; and</text>
								</item><item id="H75D0E35CF7AB4D969878B07C2FDFE662"><enum>(bb)</enum><text>any
				school that directly certified at least 30 percent of the enrolled students for
				the current school year, that the school may become eligible to elect to
				receive special assistance payments under clause (ii) for a future school year
				if the school directly certifies at least 40 percent of the enrolled
				students.</text>
								</item></subclause><subclause id="HD6103F5671B54AB899523DE0EA12AADA"><enum>(IV)</enum><header>Procedures</header><text>Not
				later than December 31, 2010, the Secretary shall establish procedures for
				State agencies, local educational agencies, and schools to meet the
				requirements of this subparagraph and exercise the options provided under this
				subparagraph.</text>
							</subclause></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="H674DB7B0C0954C31889A46698709689F"><enum>(b)</enum><header>Conforming
			 amendments</header><text>Section 11(a)(1)(B) of the Richard B. Russell National
			 School Lunch Act (42 U.S.C. 1759a(a)(1)(B)) is amended by striking <quote>or
			 (E)</quote> and inserting <quote>(E), (F), or (G)</quote>.</text>
