		<section id="HA11EC96A4E66444BA5BFE102A982E37D" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Subcontractor Fairness Act of
			 2009</short-title></quote>.</text>
		</section><section id="HE31501836EC848108DA6308E5DA9E529" section-type="subsequent-section"><enum>2.</enum><header>Requirement for
			 subcontracting agreements to be included with offers for Government
			 contracts</header>
			<subsection id="H2D235BBDBF774A3B9888E8949AB8A015"><enum>(a)</enum><header>Civilian agency
			 contracts</header><text display-inline="yes-display-inline">Title III of the
			 Federal Property and Administrative Services Act of 1949 is amended by
			 inserting after section 303M the following new section:</text>
				<quoted-block display-inline="no-display-inline" id="HD9870F09075A4C598C1FFB944AC86467" style="OLC">
					<section id="H760BC56A19884AF7874D82D814834B04"><enum>303N.</enum><header>Requirement
				for subcontracting agreements</header>
						<subsection id="H0FC4FF5E4F0240FC828D925586CCC0D5"><enum>(a)</enum><header>In
				general</header><text display-inline="yes-display-inline">Each solicitation for
				competitive proposals for the procurement of property or services in an amount
				greater than $550,000, or for construction in an amount greater than
				$1,000,000, made by an executive agency shall provide that any offeror
				submitting a proposal in response to the solicitation shall enter into a
				subcontracting agreement that meets the requirements of subsection (b) for each
				subcontract expected to be awarded by the offeror in the performance of the
				contract.</text>
						</subsection><subsection id="HC1DF98CDE2F747BD9F21B8FFFF29472C"><enum>(b)</enum><header>Subcontracting
				agreement requirements</header><text>Each subcontracting agreement required by
				subsection (a) shall—</text>
							<paragraph id="HA7606460E60D45BBAE834FB92782AE5D"><enum>(1)</enum><text>provide that, if
				the offeror is awarded the prime contract by the executive agency, the
				subcontracting agreement will become a valid subcontract between the offeror
				and the subcontractor upon award of the prime contract; and</text>
							</paragraph><paragraph id="H5C76B901EC564086860253CFCBC1821B"><enum>(2)</enum><text>include the
				following with respect to the subcontract concerned:</text>
								<subparagraph id="H36CF937D88B54D0190C30CE13F0ED85A"><enum>(A)</enum><text>The identity of
				the subcontractor.</text>
								</subparagraph><subparagraph id="H31D468D0B39C4EA29BFD63F7112106B2"><enum>(B)</enum><text>The scope of work
				to be performed under the subcontract.</text>
								</subparagraph><subparagraph id="H435D2CA7F80240B0AB06A298614C3B59"><enum>(C)</enum><text>The dollar amount
				of the subcontract.</text>
								</subparagraph></paragraph></subsection><subsection id="H23EA88B60FA944DC905364C0B6142D8C"><enum>(c)</enum><header>Copy of
				agreement</header><text>A copy of each subcontracting agreement required by
				subsection (a) shall be included in any competitive proposal submitted in
				response to a solicitation described in that
				subsection.</text>
						</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H091AB62DF99F4EB3981CEBB5C152A595"><enum>(b)</enum><header>Defense
			 contracts</header>
				<paragraph display-inline="no-display-inline" id="HFACA9BB9BA284E7285E5D14C97C32892"><enum>(1)</enum><header>In
			 general</header><text>Chapter 137 of title 10, United States Code, is amended
			 by inserting after section 2305a the following new section:</text>
					<quoted-block display-inline="no-display-inline" id="H8D6C4515157F4D76AA01628F86C72628" style="USC">
						<section id="HB135AD0CA4494A729BD541EF27BCE2C6"><enum>2305b.</enum><header>Requirement
				for subcontracting agreements</header>
							<subsection id="H41216CCF8F9B4234A86B6E568B48959C"><enum>(a)</enum><header>In
				general</header><text display-inline="yes-display-inline">Each solicitation for
				competitive proposals for the procurement of property or services in an amount
				greater than $550,000, or for construction in an amount greater than
				$1,000,000, made by the head of an agency shall provide that any offeror
				submitting a proposal in response to the solicitation shall enter into a
				subcontracting agreement that meets the requirements of subsection (b) for each
				subcontract expected to be awarded by the offeror in the performance of the
				contract.</text>
							</subsection><subsection id="H7DE798A7EFF143FBB8D9FFD54B918984"><enum>(b)</enum><header>Subcontracting
				agreement requirements</header><text>Each subcontracting agreement required by
				subsection (a) shall—</text>
								<paragraph id="H12224374C90844309E4434D3970CF6B5"><enum>(1)</enum><text>provide that, if
				the offeror is awarded the prime contract by the agency, the subcontracting
				agreement will become a valid subcontract between the offeror and the
				subcontractor upon award of the prime contract; and</text>
								</paragraph><paragraph id="H134D289BA1B64684ABBBE9877B522109"><enum>(2)</enum><text>include the
				following with respect to the subcontract concerned:</text>
									<subparagraph id="H65149CA8D8DB4642B167504DAA49565E"><enum>(A)</enum><text>The identity of
				the subcontractor.</text>
									</subparagraph><subparagraph id="H11E8916B63134B4D839E7B2371CE57A5"><enum>(B)</enum><text>The scope of work
				to be performed under the subcontract.</text>
									</subparagraph><subparagraph id="H5471A6DA91994607906312AAD2E4B5F4"><enum>(C)</enum><text>The dollar amount
				of the subcontract.</text>
									</subparagraph></paragraph></subsection><subsection id="HCDEED976E50A432AAD2E556700CB04B8"><enum>(c)</enum><header>Copy of
				agreement</header><text>A copy of each subcontracting agreement required by
				subsection (a) shall be included in any competitive proposal submitted in
				response to a solicitation described in that
				subsection.</text>
							</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph><paragraph id="HE1D57A07D96E432BB1CFB1506F11D9D3"><enum>(2)</enum><header>Clerical
			 amendment</header><text>The table of sections at the beginning of such chapter
			 is amended by adding at the end the following new item:</text>

				</paragraph></subsection><subsection id="H61EDF10ABDCB4A5894F9C6021E028099"><enum>(c)</enum><header>Effective
			 date</header><text display-inline="yes-display-inline">Section 303N of the
			 Federal Property and Administrative Services Act of 1949 and section 2305b of
			 title 10, United States Code, as added by subsections (a) and (b),
			 respectively, shall apply with respect to contracts entered into after the date
			 occurring 60 days after the date of the enactment of this Act.</text>
			</subsection></section></legis-body>
