		<official-title>To amend the Small Business Act to improve services for
		  small business concerns owned and controlled by service-disabled veterans, and
		  for other purposes.</official-title>

		<section id="H33591D53584445BB8EEC77E40399B132" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Service Disabled Veteran-Owned Small Business Procurement
			 Reform Act of 2009</short-title></quote>.</text>
		</section><section id="H73956B6E24FE4193B0EE9C9E5C860ADE"><enum>2.</enum><header>Procurement
			 reform relating to small business concerns owned and controlled by
			 service-disabled veterans</header><text display-inline="no-display-inline">The
			 Small Business Act (15 U.S.C. 631 et seq.) is amended—</text>
			<paragraph id="H3BC34010CFEE4DAF8E941D52131A247C"><enum>(1)</enum><text>by redesignating
			 section 44 as section 45; and</text>
			</paragraph><paragraph id="HC126B81982F745B79C69E97B049568DD"><enum>(2)</enum><text>by inserting after
			 section 43 the following:</text>
				<quoted-block display-inline="no-display-inline" id="H9204E4E893694A4687FD56663031D53B" style="OLC">
					<section id="H652C705E3842480A8329E6DE7F73CD06"><enum>44.</enum><header>Procurement
				reform relating to small business concerns owned and controlled by
				service-disabled veterans</header>
						<subsection id="H5C3B5FB933FC46059F8BC8CD7EDDF119"><enum>(a)</enum><header>Penalties for
				misrepresentation</header><text display-inline="yes-display-inline">Whoever
				misrepresents the status of any concern or person as a <quote>small business
				concern owned and controlled by service-disabled veterans</quote> in order to
				obtain for oneself or another any contract under section 36 shall be subject to
				the penalties specified in section 16(d).</text>
						</subsection><subsection id="H8EABCBDC2CCD42D8BC656ED73466306A"><enum>(b)</enum><header>Office of
				Service Disabled Veteran-Owned Small Business Procurement</header>
							<paragraph id="H6D1158F54C414DC28FA5386ADFD586AF"><enum>(1)</enum><header>Establishment</header><text>The
				Administrator shall establish within the Administration an Office of Service
				Disabled Veteran-Owned Small Business Procurement (in this subsection referred
				to as the <quote>office</quote>) to carry out the duties specified in paragraph
				(3).</text>
							</paragraph><paragraph id="H422EC4AA8ABB4F18B908DE43BB2BD70B"><enum>(2)</enum><header>Deputy Associate
				Administrator</header><text>The Administrator shall appoint a Deputy Associate
				Administrator to be the head of the office.</text>
							</paragraph><paragraph id="H923B15B02D32462DA20576F3AABE2829"><enum>(3)</enum><header>Duties</header><text>The
				duties of the office are the following:</text>
								<subparagraph id="HCDDDD5AE08F0402EAB773663AB48F7B2"><enum>(A)</enum><text>Provide oversight
				with respect to the procurement program for small business concerns owned and
				controlled by service-disabled veterans established under section 36.</text>
								</subparagraph><subparagraph id="HD5B233051E384AA5B1B1244AEADE594D"><enum>(B)</enum><text>Report to the
				Administrator on the performance of such program.</text>
								</subparagraph></paragraph></subsection><subsection id="H36D367CBD5F549E0B63A4A14216F844C"><enum>(c)</enum><header>Office of
				Service Disabled Veteran-Owned Small Business Development</header>
							<paragraph id="H14F6EFD1052A42529CED3320496CFBBD"><enum>(1)</enum><header>Establishment</header><text>The
				Administrator shall establish within the Administration an Office of Service
				Disabled Veteran-Owned Small Business Development (in this subsection referred
				to as the <quote>office</quote>) to carry out the duties specified in paragraph
				(3).</text>
							</paragraph><paragraph id="H3131BC3524864617A9D0088FE90AA802"><enum>(2)</enum><header>Deputy Associate
				Administrator</header><text>The Administrator shall appoint a Deputy Associate
				Administrator to be the head of the office. Such Deputy Associate Administrator
				shall report to the Associate Administrator for Veterans Business Development
				appointed under section 4(b)(1).</text>
							</paragraph><paragraph id="H382DB3CCD7F14252BBD8E72C43135A77"><enum>(3)</enum><header>Duties</header><text display-inline="yes-display-inline">The duties of the office are the
				following:</text>
								<subparagraph id="H6F4EEE2C4FCB42978EF26F7D7EF89EED"><enum>(A)</enum><text display-inline="yes-display-inline">Promote business opportunities for small
				business concerns owned and controlled by service-disabled veterans.</text>
								</subparagraph><subparagraph id="H75A430C8769C45A086FF48F40C3F6700"><enum>(B)</enum><text display-inline="yes-display-inline">Establish a database of small business
				concerns owned and controlled by service-disabled veterans.</text>
								</subparagraph><subparagraph id="H48496CD2783D438EAE96B7C6A11089AE"><enum>(C)</enum><text>Establish
				eligibility criteria for the inclusion of small business concerns in the
				database under subparagraph (B).</text>
								</subparagraph><subparagraph id="H77F6BB45FD2044548297B8E74E44D70F"><enum>(D)</enum><text>Update at least
				every 3 months the database under subparagraph (B).</text>
								</subparagraph></paragraph></subsection><subsection id="HD6145A3CECEB47E58541C912CB2FB2FB"><enum>(d)</enum><header>Veterans
				procurement specialists</header>
							<paragraph id="H359DEE2B7B8B488A9A6FF9D693FC9354"><enum>(1)</enum><header>Appointment</header><text>The
				Administrator shall appoint in each regional office of the Administration a
				veterans procurement specialist.</text>
							</paragraph><paragraph id="H9EBF7963340E4BB69FDB23CA2AAB6B43"><enum>(2)</enum><header>Duties</header><text>A
				veterans procurement specialist shall—</text>
								<subparagraph id="HA4C1B9B70F324D4BAFBCDF2769B92F7C"><enum>(A)</enum><text display-inline="yes-display-inline">assist the Deputy Associate Administrator
				appointed under subsection (a)(2) to provide oversight with respect to the
				procurement program for small business concerns owned and controlled by
				service-disabled veterans established under section 36; and</text>
								</subparagraph><subparagraph id="H4F67561B4BC548088388B2CD2BC99934"><enum>(B)</enum><text display-inline="yes-display-inline">assist the Deputy Associate Administrator
				appointed under subsection (b)(2) to promote business opportunities for small
				business concerns owned and controlled by service-disabled veterans.</text>
								</subparagraph></paragraph></subsection><subsection id="HC418F73D708849F0A71A279B3147DD18"><enum>(e)</enum><header>Protest of
				contracts</header><text display-inline="yes-display-inline">A small business
				concern owned and controlled by service-disabled veterans may protest to the
				Administrator the awarding of any contract pursuant to section
				36.</text>
