		<official-title>To prohibit insurers from canceling or refusing to renew
		  homeowners insurance policies because of the presence of certain types of
		  drywall in the home.</official-title>

		<section id="HA1C06778125E48B58C709D973301178C" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Drywall Victims Insurance Protection
			 Act of 2009</short-title></quote>.</text>
		</section><section id="H590E9BBCC6C740C1949104C1E04C291C"><enum>2.</enum><header>Prohibition of
			 canceling or declining to renew homeowners insurance because of presence of
			 certain drywall</header><text display-inline="no-display-inline">It shall be
			 unlawful for any insurer—</text>
			<paragraph id="H340F9F78779940EFA6A90B558A0000B9"><enum>(1)</enum><text>to cancel, or
			 decline to renew, any coverage for homeowners’ insurance for any single-family
			 housing based on the presence, or possibility of presence, in the housing of
			 any drywall that has a covered characteristic; or</text>
			</paragraph><paragraph commented="no" id="H47F5B986F5854CF99359F852611EEB70"><enum>(2)</enum><text display-inline="yes-display-inline">in any renewal of homeowners’ insurance for
			 such a structure, to discriminate in the amount, rates for coverage, or other
			 terms of such coverage based on the presence, or possibility of presence, in
			 the structure of any drywall that has a covered characteristic.</text>
			</paragraph></section><section commented="no" id="HBE0E72F4B78D45D8A1CCD669A2D6C754"><enum>3.</enum><header>Private cause of
			 action</header>
			<subsection commented="no" id="HD8E227AD825143918D12960E632C5323"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">An insured who has
			 been adversely affected by a violation of section 2 by an insurer may bring a
			 civil action against the insurer in an appropriate Federal or State court for
			 relief under subsection (b).</text>
			</subsection><subsection commented="no" id="H3605C27320FD4D8AB666B73A29820C89"><enum>(b)</enum><header>Relief</header><text>Upon
			 proof of a violation of section 2 by a preponderance of the evidence in an
			 action described in subsection (a), the court may award appropriate legal and
			 equitable relief, including temporary, preliminary, and permanent injunctive
			 relief and compensatory damages.</text>
			</subsection><subsection commented="no" id="H16914E34E955476AB9D6BED7DBBB04A4"><enum>(c)</enum><header>Attorneys’ fees
			 and other costs</header><text display-inline="yes-display-inline">In any action
			 or proceeding under this section, the court shall allow a prevailing plaintiff
			 reasonable attorneys’ fee as part of the costs, and shall include any expert
			 fees as part of the attorneys' fee.</text>
			</subsection></section><section id="H093ECA1C66E14A929660AF62CFD7620C"><enum>4.</enum><header>Definitions</header><text display-inline="no-display-inline">For purposes of this Act, the following
			 definitions shall apply:</text>
			<paragraph id="HF20F0D37E5FC4A39B127EDACD9CD020B"><enum>(1)</enum><header>Covered
			 characteristic</header><text display-inline="yes-display-inline">The term
			 <quote>covered characteristic</quote> means, with respect to any drywall, that
			 the drywall—</text>
				<subparagraph id="H34CF4DE418CF47C0822795CD75CF87DF"><enum>(A)</enum><text>was imported from,
			 or originated in, China at any time during the period consisting of calendar
			 years 2004 through 2007; or</text>
				</subparagraph><subparagraph id="HEA6E3F642E46434FA3086F300E3459E0"><enum>(B)</enum><text>contains elevated
			 levels of sulphur or strontium.</text>
				</subparagraph></paragraph><paragraph id="HC8CEC610FF1F44B0B12B590033AA77A6"><enum>(2)</enum><header>Insured</header><text>The
			 term <quote>insured</quote> means any natural person who has purchased coverage
			 for homeowners’ insurance.</text>
			</paragraph><paragraph id="H0B50D44B5F9341818D79188898CE9E77"><enum>(3)</enum><header>Insurer</header><text>The
			 term <quote>insurer</quote> means any entity, including any affiliate thereof,
			 that is licensed or admitted to engage in the business of providing homeowners’
			 insurance in any State.</text>
			</paragraph><paragraph id="HB17E4482D9B24EA5970B399D246A2C35"><enum>(4)</enum><header>Homeowners’
			 insurance</header><text>The term <quote>homeowners’ insurance</quote> means
			 property and casualty insurance coverage against losses to single-family
			 housing.</text>
			</paragraph><paragraph id="H9E24A9E4D0E64B769E366C178EB867D6"><enum>(5)</enum><header>Single-family
			 housing</header><text>The term <quote>single-family housing</quote> means a
			 residential real property (including individual units of condominium and
			 cooperative structures) designed principally for the occupancy of from one to
			 four families.</text>
