		<official-title>To amend title 38, United States Code, to temporarily
		  remove the requirement for employers to increase wages for veterans enrolled in
		  on-the-job training programs.</official-title>

		<section id="H8F54322390424281B052D55EB839D113" section-type="section-one"><enum>1.</enum><header>Removing requirement for
			 employers to increase wages for veterans enrolled in on-the-job training
			 programs</header>
			<subsection id="HC420689BC0524259A51E3C8CC73DF92E"><enum>(a)</enum><header>In
			 general</header>
				<paragraph id="H2604EA6839D6486192C7879953890D6A"><enum>(1)</enum><header>Removing
			 requirement</header><text display-inline="yes-display-inline">Subsection (b) of
			 section 3677 of title 38, United States Code, is amended to read as
			 follows:</text>
					<quoted-block display-inline="no-display-inline" id="H03225F85B5734484A72C2793D71207EB" style="USC">
						<subsection id="HA4C67D5573EF4322A1595B54E9AC6C3C"><enum>(b)</enum><paragraph commented="no" display-inline="yes-display-inline" id="H4D54A70BEFE445E08BB5411E78D278E0"><enum>(1)</enum><text>The training
				establishment offering training which is desired to be approved for the
				purposes of this chapter must submit to the appropriate State approving agency
				a written application for approval which, in addition to furnishing such
				information as is required by the State approving agency, contains a
				certification that—</text>
								<subparagraph id="H0C26D317673F4BA4BF49FA0294554959" indent="up1"><enum>(A)</enum><text display-inline="yes-display-inline">the wages to be paid the eligible veteran or person upon entrance into
				training, are not less than wages paid nonveterans in the same training
				position and are at least 50 per centum of the wages paid for the job for which
				the veteran or person is to be trained; and</text>
								</subparagraph><subparagraph id="H95663F074C06475A992F0E416F5A458C" indent="up1"><enum>(B)</enum><text display-inline="yes-display-inline">there is reasonable certainty that the job
				for which the eligible veteran or person is to be trained will be available to
				the veteran or person at the end of the training period.</text>
								</subparagraph></paragraph><paragraph id="H9E26D9238DE442AC9EB8079F4F9E8CBB" indent="up1"><enum>(2)</enum><text display-inline="yes-display-inline">The requirement for certification under
				paragraph (1) shall not apply to training described in section 3452(e)(2) of
				this
				title.</text>
							</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph><paragraph id="HFDA1826215B04C5191DDE4C32BAD928E"><enum>(2)</enum><header>Effective
			 date</header><text display-inline="yes-display-inline">The amendment made by
			 paragraph (1) shall take effect on October 1, 2010, and shall apply to a
			 veteran who enrolls in a program of training on the job approved under section
			 3677 of title 38, United States Code, on or after such date.</text>
				</paragraph><paragraph id="H62769F5C93024D3C846F590C92AF030B"><enum>(3)</enum><header>Sunset</header><text display-inline="yes-display-inline">Effective October 1, 2015, subsection (b)
			 of such section, as amended by paragraph (1) of this section, is amended to
			 read as follows:</text>
					<quoted-block display-inline="no-display-inline" id="HE90B30F0EE4A4217A70AA022D90AD103" style="USC">
						<subsection id="H1DA175D9EFB34A8380749EB089FFA7C4"><enum>(b)</enum><paragraph commented="no" display-inline="yes-display-inline" id="H5B9ED5D568CC477B8CF0D09F8A3077D9"><enum>(1)</enum><text>The training
				establishment offering training which is desired to be approved for the
				purposes of this chapter must submit to the appropriate State approving agency
				a written application for approval which, in addition to furnishing such
				information as is required by the State approving agency, contains a
				certification that—</text>
								<subparagraph id="HF5967A27245041C6975906F7A84E0E92" indent="up1"><enum>(A)</enum><text display-inline="yes-display-inline">the wages to be paid the eligible veteran or person (i) upon entrance into
				training, are not less than wages paid nonveterans in the same training
				position and are at least 50 per centum of the wages paid for the job for which
				the veteran or person is to be trained, and (ii) such wages will be increased
				in regular periodic increments until, not later than the last full month of the
				training period, they will be at least 85 per centum of the wages paid for the
				job for which such eligible veteran or person is being trained; and</text>
								</subparagraph><subparagraph id="H711DDDAE6D414B34A7FA4FA91DEA05E2" indent="up1"><enum>(B)</enum><text display-inline="yes-display-inline">there is reasonable certainty that the job
				for which the eligible veteran or person is to be trained will be available to
				the veteran or person at the end of the training period.</text>
								</subparagraph></paragraph><paragraph id="H69F4A092EE0F4D1AA7160C1AC767F3CE" indent="up1"><enum>(2)</enum><text display-inline="yes-display-inline">The requirement under paragraph (1)(A)(ii)
				shall not apply with respect to a training establishment operated by the United
				States or by a State or local government.</text>
							</paragraph><paragraph id="HC855E65296C14D32ACB7231E679AB937" indent="up1"><enum>(3)</enum><text>The requirement for certification
				under paragraph (1) shall not apply to training described in section 3452(e)(2)
				of this
				title.</text>
							</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="HD35123B627E44A8ABA27348673DB90BF"><enum>(b)</enum><header>Report</header><text display-inline="yes-display-inline">Not later than June 1, 2015, the Secretary
			 of Veterans Affairs shall submit to the Committee on Veterans’ Affairs of the
			 House of Representatives and the Committee on Veterans’ Affairs of the Senate a
			 report on the effects of removing the requirement for a private employer to
			 provide wage increases to veterans enrolled in a program of training on the job
			 approved under section 3677 of title 38, United States Code.</text>
