<official-title>To amend title 10, United States Code, to establish the Veterans to Work program providing for the employment of individuals, especially veterans, who participate in apprenticeship programs on designated military construction projects, and for other purposes.</official-title>

<section id="HE258FF7E90684BC8B65BC7AF7E869D1F" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Veterans to Work Pilot Program Act of 2009</short-title></quote>.</text></section> 
<section id="H6295290FA9504BB28209313B86F20144"><enum>2.</enum><header>Veterans to Work pilot program</header> 
<subsection id="HB3BFE99C24054FA39DD2F388B4879770"><enum>(a)</enum><header>Veterans to Work program</header><text display-inline="yes-display-inline">Subchapter III of chapter 169 of title 10, United States Code, is amended by inserting after section 2856 the following new section:</text>

<section id="H916C948D94E9418CBD4E56B8BAD61E26"><enum>2857.</enum><header>Veterans to Work Pilot Program </header> 
<subsection id="H33A8F27B9A8E43B0B303D678357452A8"><enum>(a)</enum><header>Pilot program; purposes</header><text>The Secretary of Defense shall establish the Veterans to Work pilot program to determine—</text> 
<paragraph id="HCEB67193600D4A98B4872ED3B79F9FE9"><enum>(1)</enum><text>the maximum feasible extent to which apprentices may be employed to work on military construction projects designated under subsection (b);</text></paragraph> 
<paragraph id="HAFD7C73609AD41DCBBA1BACD0CEB92D9"><enum>(2)</enum><text display-inline="yes-display-inline">the maximum feasible extent to which the apprentices so employed are veterans; and</text></paragraph> 
<paragraph id="H57B4F2A81B8D4F28B131250F53F97CC4"><enum>(3)</enum><text>the feasibility of expanding the employment of apprentices to military construction projects in addition to those projects designated under subsection (b).</text></paragraph></subsection> 
<subsection id="H84368D7DFB3C4B5782C4213FA0CEE320"><enum>(b)</enum><header>Designation of military construction projects for pilot program</header> 
<paragraph id="H52AC5850773E4DBC8E274CF157A482AA" display-inline="yes-display-inline"><enum>(1)</enum><text>For each of fiscal years 2011 through 2015, the Secretary of Defense shall designate for inclusion in the pilot program not less than 20 military construction projects (including unspecified minor military construction projects under section 2805(a) of this title) that will be conducted in that fiscal year.</text> </paragraph> 
<paragraph id="H3BD12E7474E24B57ACCAC1332380A13B" indent="up1"><enum>(2)</enum><text>In designating military construction projects under this subsection, the Secretary of Defense shall—</text> 
<subparagraph id="HA0ED949BCA66402891E46903179798FE"><enum>(A)</enum><text>to the greatest extent possible, designate military construction projects that are located where there are veterans enrolled in qualified apprenticeship programs or veterans who could be enrolled in qualified apprenticeship programs in a cost-effective, timely, and feasible manner; </text></subparagraph> 
<subparagraph id="HD1E528CAB7B446C9B87682056A309DD0"><enum>(B)</enum><text>ensure geographic diversity among the military construction projects designated; and</text></subparagraph> 
<subparagraph id="H1421F6F3F7C04508A84D4633B469963E"><enum>(C)</enum><text>select projects to be carried out in the continental United States, Alaska, Hawaii, Guam, Puerto Rico, the Northern Mariana Islands, and the United States Virgin Islands.</text> </subparagraph></paragraph> 
<paragraph id="HBDEFFA53FA464D35AF4FC396BCF12557" indent="up1"><enum>(3)</enum><text>Unspecified minor military construction projects may not exceed 40 percent of the military construction projects designated under this subsection for a fiscal year.</text></paragraph> </subsection> 
<subsection id="H9E8AD537E61D4DFEBF706B24BBCAB475"><enum>(c)</enum><header>Contract Provisions</header><text>Any agreement that the Secretary of Defense enters into for a military construction project that is designated for inclusion in the pilot program shall ensure that, to the maximum extent feasible, apprentices shall be employed on that military construction project and that, to the maximum extent feasible, such apprentices shall be veterans.</text> </subsection> 
<subsection id="HF1C23A88520244F1BFC5077E54173817"><enum>(d)</enum><header>Qualified apprenticeship and other training programs</header> 
<paragraph id="HC1C0704C363B49FFBF35C16949D06F22" display-inline="no-display-inline"><enum>(1)</enum><header>Participation by each contractor required</header><text>Each contractor and subcontractor that seeks to provide construction services on projects designated by the Secretary pursuant to subsection (b) shall submit adequate assurances with its bid or proposal that it participates in a qualified apprenticeship or other training program for each craft or trade classification of worker that it intends to employ to perform work on the project.</text></paragraph> 
<paragraph id="H57D3714F575B45F5B164DEA857A929A1"><enum>(2)</enum><header>Definition of qualified apprenticeship or other training programs</header> 
<subparagraph id="HD643F02963AB4B5082B13D3F0A161160"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">For purposes of this section, the term <quote>qualified apprenticeship or other training program</quote> means an apprenticeship or other training program that qualifies as an employee welfare benefit plan, as defined in section 3(1) of the Employee Retirement Income Security Act of 1974 (29 U.S.C. 1002(1)).</text></subparagraph> 
<subparagraph id="HB0C9A29CFDA74914ABB61C34F12D2237"><enum>(B)</enum><header>Certification of other programs in certain localities</header><text>In the event that the Secretary of Labor certifies that a qualified apprenticeship or other training program (as defined in subparagraph (A)) for a craft or trade classification of workers that a prospective contractor or subcontractor intends to employ, is not operated in the locality where the project will be performed, an apprenticeship or other training program that is not an employee welfare benefit plan (as defined in such section) may be certified by the Secretary as a qualified apprenticeship or other training program provided it is registered with the Office of Apprenticeship of the Department of Labor, or a State apprenticeship agency recognized by the Office of Apprenticeship for Federal purposes.</text></subparagraph></paragraph> </subsection> 
<subsection id="H8849AA96BEF54982B9D5645A0B553896"><enum>(e)</enum><header>Report</header> 
<paragraph id="HEDEF56DE789140A4B3840638FEA9EFBA" display-inline="yes-display-inline"><enum>(1)</enum><text>Not later than 150 days after the end of each fiscal year during which the pilot program is active, the Secretary of Defense shall submit to Congress a report that includes the following:</text> 
<subparagraph id="HCB4FB63CD59E415EBD0827109BD892FE" indent="up1"><enum>(A)</enum><text>The progress of designated military construction projects and the role of apprentices in achieving that progress.</text></subparagraph> 
<subparagraph id="HB50C4AB54B4341EDA42D81516540B4C1" indent="up1"><enum>(B)</enum><text>Any challenges, difficulties, or problems encountered in recruiting apprentices or in recruiting veterans to become apprentices.</text></subparagraph> 
<subparagraph id="HCA6E22BD129B41D380CF2CF028BE0ED7" commented="no" indent="up1"><enum>(C)</enum><text>Cost differentials in the designated military construction projects compared to similar projects completed contemporaneously, but not designated for the pilot program.</text></subparagraph> 
<subparagraph id="H2B64B4491F9E4879A9D32894E5940DE8" indent="up1"><enum>(D)</enum><text>Evaluation of benefits derived from employing apprentices, including the following:</text> 
<clause id="HB4B25179023D4A9185FD7FED73CF995A"><enum>(i)</enum><text>Workforce sustainability.</text></clause> 
<clause id="HAC32D6A851034998BA5D5370FA716C4D"><enum>(ii)</enum><text>Workforce skills enhancement.</text></clause> 
<clause id="HC33763A9FB914D5D80B6B378F09904D3"><enum>(iii)</enum><text>Increased short- and long-term cost-effectiveness.</text></clause> 
<clause id="H85B79B7549F3485B90FA6E2563D26F89"><enum>(iv)</enum><text>Improved veteran employment in sustainable wage fields.</text></clause></subparagraph> 
<subparagraph id="H3D795957F4BE4055B8923E21EE7612EC" indent="up1"><enum>(E)</enum><text display-inline="yes-display-inline">Any additional benefits derived from employing apprentices and veteran apprentices.</text></subparagraph> 
<subparagraph id="H224B1544B4F241E1A64E54C4B9517A7B" indent="up1"><enum>(F)</enum><text>Recommendations on how to more effectively employ apprentices in subsequent fiscal years.</text></subparagraph> 
<subparagraph id="HE21734A8BFA2490FAA8079C092708016" indent="up1"><enum>(G)</enum><text display-inline="yes-display-inline">Any other information the Secretary of Defense determines appropriate.</text></subparagraph></paragraph> 
<paragraph id="H48066A823C9D45328339A3F958711552" indent="up1"><enum>(2)</enum><text display-inline="yes-display-inline">Not later than March 1, 2016, the Secretary of Defense shall submit to Congress a report that—</text> 
<subparagraph id="HB0D723FD1BC949A488DB460E32ABA090"><enum>(A)</enum><text>analyzes the pilot program in terms of its effect on the sustainability of a workforce to meet the military construction needs of the Armed Forces;</text></subparagraph> 
<subparagraph id="HB6FD5BCFC24849D9858EA4509F13D08E"><enum>(B)</enum><text>studies overall improvements in veteran employment in sustainable wage fields or professions; and</text></subparagraph> 
<subparagraph id="H7227F4D83C5E4FE68547121F58ADBAAF"><enum>(C)</enum><text display-inline="yes-display-inline">makes recommendations on the continuation, modification, or expansion of the pilot program on the basis of such factors as the Secretary of Defense determines appropriate, including the following:</text> 
<clause id="H9A4811941DBF4AB59A1090D841780151"><enum>(i)</enum><text>Workforce sustainability.</text></clause> 
<clause id="H7DB793D5F5714E3F8BF2B6CFD417664C"><enum>(ii)</enum><text>Cost-effectiveness.</text></clause> 
<clause id="H069F683EB27E4CFEA9BF46A232ADFA1F"><enum>(iii)</enum><text>Community development.</text></clause></subparagraph></paragraph></subsection> 
<subsection id="H814A6D1FDAF142E88C56E14E5D551379"><enum>(f)</enum><header>Definitions</header><text>In this section:</text> 
<paragraph id="H9060CC7C8EF04940B11A984CB8E8EAB7"><enum>(1)</enum><text>The term <quote>apprentice</quote> means an individual who is employed pursuant to, and individually registered in, a <quote>qualified apprenticeship or other training program,</quote> as defined in subsection (d)(2)(A) or other apprenticeship or training programs recognized in accordance with subsection (d)(2)(B).</text></paragraph> 
<paragraph id="H462D7176E53E4BBDB010CDAC44F35D79"><enum>(2)</enum><text>The term <quote>pilot program</quote> means the Veterans to Work pilot program established under subsection (a).</text></paragraph> 
<paragraph id="HD9284B9EFB914A4F9D8FDDEAD2268734"><enum>(3)</enum><text>The term <quote>State</quote> means any of the States, the District of Columbia, or territories of Guam, Puerto Rico, the Northern Mariana Islands, and the United States Virgin Islands.</text></paragraph> 
<paragraph id="H7BEED90377F848F49A83444026BBEDED"><enum>(4)</enum><text>The term <quote>veteran</quote> has the meaning given such term under section 101(2) of title 38.</text></paragraph></subsection> </section><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="HF3DDE7F388664E839AB0AF624754350A"><enum>(b)</enum><header>Clerical amendment</header><text>The table of sections at the beginning of such subchapter is amended by inserting after the item relating to section 2856 the following new item: </text>
