			 title 49, United States Code</header><text display-inline="no-display-inline">Except as otherwise expressly provided,
			 whenever in this Act an amendment or repeal is expressed in terms of an
			 amendment to, or a repeal of, a section or other provision, the reference shall
			 be considered to be made to a section or other provision of title 49, United
			 States Code.</text>
		</section><section commented="no" id="H9F70F850656B4B988A9A1D6CD8A53636"><enum>3.</enum><header>General
			 definitions</header><text display-inline="no-display-inline">In this Act, the
			 following definitions apply:</text>
			<paragraph commented="no" id="H5C8951E815FC403F84187FC96A7FE708"><enum>(1)</enum><header>Department</header><text>The
			 term <term>Department</term> means the Department of Transportation.</text>
			</paragraph><paragraph commented="no" id="H59C3DD7F19AF490A9754F14A14BA4425"><enum>(2)</enum><header>Secretary</header><text>The
			 term <term>Secretary</term> means the Secretary of Transportation.</text>
			</paragraph></section><title id="H88586D43FB5E405C825ABD526F371383"><enum>I</enum><header>Strengthening
			 Emergency Response Capabilities and Information</header>
			<section id="H014F4C5459964792BAAE9CF812E41BE8"><enum>101.</enum><header>Minimum
			 standards for emergency response information services</header>
				<subsection id="H5FD05EEFB5A84A419F0686D69FF96419"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Not later than 24
			 months after the date of enactment of this Act, the Secretary shall prescribe,
			 by regulation, minimum standards for persons who provide hazardous material
			 transportation emergency response information services required or governed by
			 regulations prescribed under chapter 51 of title 49, United States Code.</text>
				</subsection><subsection id="HE6FDA2FF6C54440D95FC0F445A563E0E"><enum>(b)</enum><header>Authority</header><text>Section
			 5103(b)(1)(A) is amended—</text>
					<paragraph id="H4B593DA1ABA84885B907B6BA53A16716"><enum>(1)</enum><text>in clause (vi) by
			 striking <quote>or</quote> after the semicolon;</text>
					</paragraph><paragraph id="HFAC7B049949B45D58D4EC9FECE4E2C6F"><enum>(2)</enum><text>by redesignating
			 clause (vii) as clause (viii);</text>
					</paragraph><paragraph id="HCCAC4931F13545AC8EFEB3464B3BA0F7"><enum>(3)</enum><text>in clause (viii),
			 as so redesignated, by striking <quote>through (vi)</quote> and inserting
			 <quote>through (vii)</quote>; and</text>
					</paragraph><paragraph id="H857589AFF5BD424B8C256574FECC64A9"><enum>(4)</enum><text>by inserting after
			 clause (vi) the following:</text>
						<quoted-block display-inline="no-display-inline" id="HC2832A8F83CE4E1DA01DAB85594095FB" style="OLC">
							<clause id="HA9B52E4A77E24BA99B3AA1FAA0CFFACE"><enum>(vii)</enum><text display-inline="yes-display-inline">provides hazardous material transportation
				emergency response information services required or governed by regulations
				prescribed under this chapter;
				or</text>
							</clause><after-quoted-block>.</after-quoted-block></quoted-block>
					</paragraph></subsection></section><section id="H1CCD960A00724341A735932AAB960F3D"><enum>102.</enum><header>Training for
			 emergency responders</header>
				<subsection id="H75EA04E654BB435DB81F390ECE789519"><enum>(a)</enum><header>Operations level
			 training</header><text display-inline="yes-display-inline">Section 5116 is
			 amended—</text>
					<paragraph id="H9C6CD8480A034C06A7734958D0C7D95A"><enum>(1)</enum><text>in subsection
			 (b)(1) by adding at the end the following: <quote>To the extent that a grant is
			 used to train emergency responders, the State or Indian tribe shall certify, in
			 writing, to the Secretary that the emergency responders who receive training
			 under the grant, at a minimum, will have the ability to protect nearby persons,
			 property, and the environment from the effects of accidents or incidents
			 involving the transportation of hazardous material in accordance with existing
			 regulations or National Fire Protection Association Standard
			 472.</quote>;</text>
					</paragraph><paragraph id="HFE0B4E178E2B444E8552605641BACC49"><enum>(2)</enum><text>in subsection
			 (i)(4) by striking <quote>2 percent</quote> and inserting <quote>4
			 percent</quote>;</text>
					</paragraph><paragraph id="HF47E8C9343704A69861832C4DDA58456"><enum>(3)</enum><text>in subsection
			 (j)—</text>
						<subparagraph id="H8C08FEF771A545FA86D455BC3D14D6C2"><enum>(A)</enum><text>by redesignating
			 paragraph (5) as paragraph (7); and</text>
						</subparagraph><subparagraph id="HF340F432B1894FBC8CB58BEA16C1B089"><enum>(B)</enum><text>by inserting after
			 paragraph (4) the following:</text>
							<quoted-block display-inline="no-display-inline" id="H614D94309D4E4606A907E2B07050F76F" style="USC">
								<paragraph id="HAA96B316C9604824A1076D90B1BB841D"><enum>(5)</enum><text display-inline="yes-display-inline">The Secretary may make a grant to an
				organization under this subsection only if the organization ensures that
				emergency responders who receive training under the grant, at a minimum, will
				have the ability to protect nearby persons, property, and the environment from
				the effects of accidents or incidents involving the transportation of hazardous
				material in accordance with existing regulations or National Fire Protection
				Association Standard 472.</text>
								</paragraph><paragraph id="HD3AB5F3DF3724066926DA733BACAF0DC"><enum>(6)</enum><text>Notwithstanding
				paragraphs (1) and (3), to the extent determined appropriate by the Secretary,
				a grant made by the Secretary to an organization under this subsection to
				conduct hazardous material response training programs may be used to train
				individuals with statutory responsibility to respond to accidents and incidents
				involving hazardous material.</text>
								</paragraph><after-quoted-block>;
				and</after-quoted-block></quoted-block>
						</subparagraph></paragraph><paragraph id="H3FB4E81588F440B39A33F2D08A86515E"><enum>(4)</enum><text>in subsection
			 (k)—</text>
						<subparagraph id="HE0185793FFEE49AF83E9A1E5B5E8CC81"><enum>(A)</enum><text>by striking
			 <quote>The Secretary shall submit annually</quote> and inserting <quote>Not
			 later than March 1, 2010, and every 2 years thereafter, the Secretary shall
			 submit</quote>; and</text>
						</subparagraph><subparagraph id="H54B4879CCF4F43D8AB29233BAED8B409"><enum>(B)</enum><text>by striking the
			 second sentence and inserting the
			 following:</text>
							<quoted-block display-inline="yes-display-inline" id="H5421E5B789274B838E0BC8A758855229" style="USC">
								<text>The report shall identify the
			 ultimate recipients of such grants and include—</text><paragraph id="H9DF71F9B67564609912B80D7CE009AE8"><enum>(1)</enum><text>a detailed
				accounting and description of each grant expenditure by each grant recipient,
				including the amount of and purpose for each expenditure;</text>
								</paragraph><paragraph id="H54C28E2D7A5B49458E9D200A5AC12C44"><enum>(2)</enum><text display-inline="yes-display-inline">the number of persons trained under the
				grant program by training level;</text>
								</paragraph><paragraph id="H80007DBAE8E542F39F062B5B9A084368"><enum>(3)</enum><text>an evaluation of
				the efficacy of such training; and</text>
								</paragraph><paragraph id="HE63EA5DFC6004566A754B21BA2C80B6B"><enum>(4)</enum><text>any
				recommendations the Secretary may have for improving such grant
				programs.</text>
								</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
						</subparagraph></paragraph></subsection><subsection id="HCC0AC851923C4C72B159D1EAF3D141F1"><enum>(b)</enum><header>Training
			 curriculum</header><text>Section 5115 is amended in each of subsections
			 (b)(1)(B), (b)(2), and (c) by striking <quote>basic</quote>.</text>
				</subsection></section><section id="H73FA0B2642704FD1B40B900454E618D6"><enum>103.</enum><header>Assessment of
			 volunteer firefighter training capabilities</header>
				<subsection id="HD30163E7328D44D69347F079EF512BB1"><enum>(a)</enum><header>Assessment</header>
					<paragraph id="H8A11207F811D4C4BA315A29080701DBE"><enum>(1)</enum><header>In
			 general</header><text>The Secretary may conduct an assessment of the existing
			 training capabilities of, and delivery methods available for the preparedness
			 and training of, volunteer fire services personnel to safely respond to
			 accidents and incidents involving the transportation of hazardous
			 material.</text>
					</paragraph><paragraph id="H4AB75B9E7DFE44AA8B4DDB9AA8F9551B"><enum>(2)</enum><header>Consultation</header><text>In
			 carrying out the assessment, the Secretary may collaborate with the national
			 hazardous materials fusion center established under section 5128 of title 49,
			 United States Code, (as added by
			 <internal-xref idref="H9E3614D56B4E4785A2093931C68466D8" legis-path="104.">section 104</internal-xref> of this Act) and organizations
			 representing volunteer fire services personnel.</text>
					</paragraph></subsection><subsection id="H3A99D0EECDB741E3BCDE9DA19406C28D"><enum>(b)</enum><header>Pilot
			 program</header>
					<paragraph id="HE04E44BC13D74544BE804AB250211A3D"><enum>(1)</enum><header>In
			 general</header><text>Upon completion of the assessment, the Secretary may
			 carry out a volunteer firefighter hazardous material training pilot program
			 based on the results of the assessment.</text>
					</paragraph><paragraph id="H88968ABFB50B46AEAE2B3F2B88B8E60C"><enum>(2)</enum><header>Activities</header><text>Under
			 the pilot program, the Secretary, in order to assist volunteer fire services
			 personnel in safely responding to accidents and incidents involving the
			 transportation of hazardous material, may—</text>
						<subparagraph id="HFDDAC1AF71654DE783B246BE73EEB9C8"><enum>(A)</enum><text>develop innovative
			 measures for delivering training;</text>
						</subparagraph><subparagraph id="H41E46B1BC1AD4F90A14B4453DE47904A"><enum>(B)</enum><text>determine
			 authorized training programs that are eligible for reimbursement from the
			 Secretary;</text>
						</subparagraph><subparagraph id="HE70EFAC740E4405B896892F648513A7A"><enum>(C)</enum><text>provide assistance
			 to volunteer fire services personnel to enable the acquisition of training
			 materials and supplies and to support preparedness training and exercises;
			 and</text>
						</subparagraph><subparagraph id="H85C514A8C83440EEA887CCFACCAA5546"><enum>(D)</enum><text>coordinate with
			 Federal, State, and local agencies to foster the exchange of fire-related
			 training information and resources.</text>
						</subparagraph></paragraph></subsection><subsection id="HEC60BBE6E8E94F48BE9A8CACE4352E56"><enum>(c)</enum><header>Report</header><text display-inline="yes-display-inline">Upon completion of the assessment and, if
			 applicable, the pilot program, the Secretary shall transmit to the Committee on
			 Transportation and Infrastructure of the House of Representatives and the
			 Committee on Commerce, Science, and Transportation of the Senate a report on
			 the results of the assessment and pilot program, including any recommendations
			 for strengthening training for volunteer firefighters to safely respond to
			 accidents and incidents involving the transportation of hazardous
			 material.</text>
				</subsection></section><section id="H9E3614D56B4E4785A2093931C68466D8"><enum>104.</enum><header>National
			 hazardous materials fusion center</header>
				<subsection id="H86B6E731902C4A2E8D49C02CE5F02D6C"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Chapter 51 is amended
			 by redesignating section 5128 as section 5129 and by inserting after section
			 5127 the following:</text>
					<quoted-block display-inline="no-display-inline" id="HF89092C1E3A94F9C984850F124E59A18" style="USC">
						<section id="H6F853930390F4F5492924A442AFA2E72"><enum>5128.</enum><header>National
				hazardous materials fusion center</header>
							<subsection id="H68DF764A731B43469CFE925C8806DBDD"><enum>(a)</enum><header>In
				general</header><text display-inline="yes-display-inline">The Secretary shall
				establish and maintain a national hazardous materials fusion center to serve as
				a data and information network for emergency response providers, Federal,
				State, and local government agencies, and for-profit and nonprofit
				organizations that are engaged in hazardous material response.</text>
							</subsection><subsection id="HDB3D636C575C4C328825BAA25788DA60"><enum>(b)</enum><header>Duties</header><text>The
				center shall—</text>
								<paragraph id="H576702E660A44C4C9272978EA4C6EA8E"><enum>(1)</enum><text display-inline="yes-display-inline">enhance emergency response provider
				communication and safety with respect to accidents and incidents involving the
				transportation of hazardous material;</text>
								</paragraph><paragraph id="HCA5CEC0B343940778DE31FC54C3E508B"><enum>(2)</enum><text>improve
				decisionmaking for the prevention and mitigation of such accidents and
				incidents;</text>
								</paragraph><paragraph commented="no" id="H2091AC5C87DA40D5993207F6A0006456"><enum>(3)</enum><text>establish and
				operate regional incident survey teams to—</text>
									<subparagraph commented="no" id="H3FFECCDC39234BB788C8F3742DFCCDB8"><enum>(A)</enum><text display-inline="yes-display-inline">determine lessons learned from emergency
				response providers involved in such accidents or incidents;</text>
									</subparagraph><subparagraph commented="no" id="HCABB3F35CB4D4828A2755440C5055449"><enum>(B)</enum><text>develop best
				practices for responding to such accidents or incidents; and</text>
									</subparagraph><subparagraph commented="no" id="HA43A3A215A1F43429867F28FA03C6350"><enum>(C)</enum><text display-inline="yes-display-inline">improve curricula and training materials
				for emergency response providers in responding to such accidents and incidents;
				and</text>
									</subparagraph></paragraph><paragraph id="H2E8CFEB5E5814CE39617268EDFFDCB2F"><enum>(4)</enum><text display-inline="yes-display-inline">collect and analyze data from the responses
				to accidents and incidents involving the transportation of hazardous material
				in order to understand accident and incident trends and patterns and develop
				recommendations for performance measures for the safe response to hazardous
				material accidents and incidents, including the safety of emergency response
				providers and the public.</text>
								</paragraph></subsection><subsection id="HA0D23FAB91BC49388E8A639D8238D0C8"><enum>(c)</enum><header>Definitions</header><text>In
				this section, the following definitions apply:</text>
								<paragraph id="HD442815DBDCD4A38B3F5B839C11F7C3F"><enum>(1)</enum><header>Emergency
				response provider</header><text display-inline="yes-display-inline">The term
				<term>emergency response provider</term> includes Federal, State, and local
				governmental and nongovernmental emergency public safety, fire, law
				enforcement, emergency response, emergency medical (including hospital
				emergency facilities), and related personnel, agencies, and authorities.</text>
								</paragraph><paragraph commented="no" id="HDAB70D6B956D46A3BDA2D863DA16E883"><enum>(2)</enum><header>Regional
				incident survey team</header><text>The term <term>regional incident survey
				team</term> means a team that is established by the national hazardous
				materials fusion center and that is composed of persons who are skilled by
				reason of education, training, or experience in responding to hazardous
				material accidents and incidents.</text>
								</paragraph></subsection><subsection id="H525A3FEAE4384E25A20C7EB0C3DC9BE8"><enum>(d)</enum><header>Authorization of
				appropriations</header><text>There is authorized to be appropriated to carry
				out this section $1,000,000 for each of fiscal years 2011, 2012, 2013, and
				2014.</text>
							</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
				</subsection><subsection id="H08C5DA00B2F54AFABA1DA4AFB7759EC0"><enum>(b)</enum><header>Clerical
			 amendment</header><text>The analysis for such chapter is amended by striking
			 the item relating to section 5128 and inserting after the item relating to
			 section 5127 the following:</text>

				</subsection></section><section commented="no" id="HFF099E0107724EAFA2C998E1B9F5EE38"><enum>105.</enum><header>Paperless
			 hazard communications pilot program</header>
				<subsection commented="no" id="H9EE1E8C4C1F34E45985A189F3ACCDA0E"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">The Secretary may
			 conduct 3 pilot projects, at least 1 of which shall be in a rural area, to
			 evaluate the feasibility and effectiveness of using paperless hazard
			 communications systems.</text>
				</subsection><subsection commented="no" id="HC0EB3D1C147C43D6820A2C1EECB64F03"><enum>(b)</enum><header>Requirements</header><text>In
			 conducting the pilot projects, the Secretary—</text>
					<paragraph commented="no" id="H93C546DD137C418DA25706AE8C117CA8"><enum>(1)</enum><text>may not waive the
			 requirements of section 5110 of title 49, United States Code; and</text>
					</paragraph><paragraph commented="no" id="H75DBA87F76B148F09B231A87E8DAF20F"><enum>(2)</enum><text display-inline="yes-display-inline">shall consult with organizations
			 representing—</text>
						<subparagraph commented="no" id="H7F9A3A10A74F4E728BF620D1B7F48393"><enum>(A)</enum><text>fire services
			 personnel;</text>
						</subparagraph><subparagraph commented="no" id="H90868452793F419D87CE8547CAFADB1C"><enum>(B)</enum><text>law enforcement
			 and other appropriate enforcement personnel;</text>
						</subparagraph><subparagraph commented="no" id="H018964B974274BE6956E96A27759EB57"><enum>(C)</enum><text>other emergency
			 response providers;</text>
						</subparagraph><subparagraph commented="no" id="HC1D3955C18E54F45AECAF181C4ABBC8D"><enum>(D)</enum><text>persons who offer
			 hazardous material for transportation;</text>
						</subparagraph><subparagraph commented="no" id="H53D3CC8065554179B9909E0A5E66DAB4"><enum>(E)</enum><text display-inline="yes-display-inline">persons who transport hazardous material by
			 air, highway, rail, and water; and</text>
						</subparagraph><subparagraph commented="no" id="H7C5F19438BA94673866D3CC037CBD7B2"><enum>(F)</enum><text>employees of
			 persons who transport or offer for transportation hazardous material by air,
			 highway, rail, and water.</text>
						</subparagraph></paragraph></subsection><subsection commented="no" id="HB0952920FA5C41AEBE1FD3D9D2852AD7"><enum>(c)</enum><header>Reports</header>
					<paragraph commented="no" id="H6B83E0D1A21A4F068950C9124E4333D9"><enum>(1)</enum><header>Interim
			 report</header><text display-inline="yes-display-inline">Not later than 3 years
			 after the date of enactment of this Act, the Secretary shall—</text>
						<subparagraph commented="no" id="H608E58FA9303428C9968273ED30083BB"><enum>(A)</enum><text>prepare an interim
			 report on the results of the pilot projects carried out under this section,
			 including—</text>
							<clause commented="no" id="H780C66F14F584EE1B8297BA95D8AF187"><enum>(i)</enum><text>a detailed
			 description of the pilot projects;</text>
							</clause><clause commented="no" id="H1C9FAEB812CD4C8A81D4ACB635097CDE"><enum>(ii)</enum><text>an evaluation of
			 each pilot project, including an evaluation of the performance of each
			 paperless hazard communications system in such project;</text>
							</clause><clause commented="no" id="H8CE1A4A9817F4AA78083CD3E2195ED91"><enum>(iii)</enum><text display-inline="yes-display-inline">an assessment of the safety and security
			 impact of using paperless hazard communications systems, including any impact
			 on the public, emergency response, law enforcement, and the conduct of
			 inspections and investigations; and</text>
							</clause><clause commented="no" id="H7CC94116D6B04FC9B64EFE4D3E4F72A0"><enum>(iv)</enum><text>a recommendation
			 on whether paperless hazard communications systems should be incorporated into
			 the Federal hazardous material transportation safety program under chapter 51
			 of title 49, United States Code, on a permanent basis; and</text>
							</clause></subparagraph><subparagraph commented="no" id="HF7DED48A18434CDDBE69FE262C796B20"><enum>(B)</enum><text display-inline="yes-display-inline">transmit such interim report to the
			 organizations consulted under
			 <internal-xref idref="H75DBA87F76B148F09B231A87E8DAF20F" legis-path="105.(b)(2)">subsection (b)(2)</internal-xref> and request that such
			 organizations provide written comments in response to the interim report within
			 60 days.</text>
						</subparagraph></paragraph><paragraph commented="no" id="HB4540CD0B051431BAF2CF01D16E967D5"><enum>(2)</enum><header>Final
			 report</header><text display-inline="yes-display-inline">Not later than 120
			 days after transmitting the interim report to the organizations consulted under
			 <internal-xref idref="H75DBA87F76B148F09B231A87E8DAF20F" legis-path="105.(b)(2)">subsection (b)(2)</internal-xref>, the Secretary shall
			 transmit to the Committee on Transportation and Infrastructure of the House of
			 Representatives and the Committee on Commerce, Science, and Transportation of
			 the Senate a final report on the results of the pilot projects carried out
			 under this section, including the matter described in
			 <internal-xref idref="H608E58FA9303428C9968273ED30083BB" legis-path="105.(c)(1)(A)">paragraph (1)(A)</internal-xref> and any written
			 comments received pursuant to
			 <internal-xref idref="HF7DED48A18434CDDBE69FE262C796B20" legis-path="105.(c)(1)(B)">paragraph (1)(B)</internal-xref>.</text>
					</paragraph></subsection><subsection commented="no" id="HB9055CA9A5F54028AD70BCC93B8CCED9"><enum>(d)</enum><header>Paperless hazard
			 communications system defined</header><text display-inline="yes-display-inline">In this section, the term “paperless hazard
			 communications system” means the use of advanced communications methods, such
			 as wireless communications devices, to convey hazard information between all
			 parties in the transportation chain, including emergency responders and law
			 enforcement personnel.</text>
				</subsection></section></title><title id="H296F8E5498B2447394FE2F1B74D74E77"><enum>II</enum><header>Strengthening
			 Hazardous Material Safety</header>
			<section id="H513A6D23939F4AD6B924E75F4C993FA2"><enum>201.</enum><header>Transportation
			 of lithium cells and batteries on board aircraft</header>
				<subsection id="H8ACA691EC9A54AC09C3D5FB006D5C174"><enum>(a)</enum><header>In
			 general</header><text>Chapter 51 is amended by inserting after section 5110 the
			 following:</text>
					<quoted-block display-inline="no-display-inline" id="H195306BCBC23432C83CA54E06CD4D180" style="USC">
						<section id="H48D98ED2E9604C559065EEA2FC81342F"><enum>5111.</enum><header>Transportation
				of lithium cells and batteries on board aircraft</header>
							<subsection id="HCE396BC2AF08404D9DBEDBFD89635A98"><enum>(a)</enum><header>Revisions to
				current regulations</header><text>Not later than 24 months after the date of
				enactment of the <short-title>Hazardous Material
				Transportation Safety Act of 2009</short-title>, the Administrator of the
				Pipeline and Hazardous Materials Safety Administration, in coordination with
				the Administrator of the Federal Aviation Administration, shall issue
				regulations in accordance with this section to provide for the safe
				transportation of lithium cells and batteries on board aircraft.</text>
							</subsection><subsection id="H2721ED9F0BAE468289B878DB1B884AC9"><enum>(b)</enum><header>Requirements</header><text display-inline="yes-display-inline">In carrying out subsection (a), the
				Administrator of the Pipeline and Hazardous Materials Safety Administration, at
				a minimum, shall—</text>
								<paragraph id="HDB04A4697E2A427790EEE1B85B795C23"><enum>(1)</enum><text>require packages
				containing lithium cells and batteries to be identified as hazardous material
				in a manner that clearly conveys the properties, hazards, and dangers of such
				cells and batteries on such packages and in shipping documents;</text>
								</paragraph><paragraph id="H1F8ED54A42F849A18FAE851653A57814"><enum>(2)</enum><text>establish
				requirements for testing and re-testing lithium cells and batteries that, at a
				minimum, are equivalent to the United Nations testing regime;</text>
								</paragraph><paragraph id="H70FAFA5AA63F4897B8BFCF7055438C98"><enum>(3)</enum><text>provide for an
				appropriate marking or other measure that indicates that lithium cells and
				batteries are in compliance with the requirements established under paragraph
				(2);</text>
								</paragraph><paragraph id="H3B0AFE0667004D85822783DC2CF8FA68"><enum>(4)</enum><text>adopt a watt-hours
				requirement in lieu of equivalent lithium content to provide a more easily
				understood measure of the hazard posed by lithium-ion cells and
				batteries;</text>
								</paragraph><paragraph id="HFAD9AB589F284A45821178042038B0FC"><enum>(5)</enum><text>establish
				appropriate packaging performance requirements, including outer packaging
				performance requirements, for lithium cells and batteries to minimize risk
				during transportation on board aircraft, including the prevention of
				short-circuiting, overheating, initiation of fires, and fire
				propagation;</text>
								</paragraph><paragraph id="H4AC57205EC2943B29BEA9A3CF734AFCB"><enum>(6)</enum><text>establish limits
				on the number of packages containing lithium cells and batteries that may be
				transported in a unit load device, pallet, or container on board an aircraft
				based on the watt-hour rating of the total number of lithium cells and
				batteries in a package;</text>
								</paragraph><paragraph id="HE7C47E8FBFE64135BC7DD220D5BB174C"><enum>(7)</enum><text>limit the stowage
				of lithium cells and batteries to crew accessible locations on aircraft, unless
				such cells and batteries are transported in a fire-resistant container or the
				aircraft contains a fire suppression system capable of extinguishing or
				controlling a fire involving a lithium cell or battery; and</text>
								</paragraph><paragraph id="HD1A7E42A6529454489E1AA7E8A60B8C3"><enum>(8)</enum><text>require reporting
				of all accidents and incidents involving lithium cells and batteries that occur
				on board an aircraft or during loading or unloading operations or storage
				incidental to movement and require retention of the failed cells and batteries
				for evaluation purposes.</text>
								</paragraph></subsection><subsection id="HA0109C0D488048A3B04D7CF22834905E"><enum>(c)</enum><header>Batteries
				shipped for personal use</header><text>The Administrator, in coordination with
				the Administrator of the Federal Aviation Administration, shall except from the
				regulations established under subsection (a) small quantities of lithium cells
				or batteries that are shipped on board aircraft for the personal use of the
				receiver of the shipment.</text>
							</subsection><subsection id="HC107C53B2A2D4DBA9F6BEBFCFEFDCF9B"><enum>(d)</enum><header>Review of
				exemptions</header><text display-inline="yes-display-inline">The Administrator
				of the Pipeline and Hazardous Materials Safety Administration, in coordination
				with the Administrator of the Federal Aviation Administration, shall review all
				special permits and approvals issued by the Administrator that allow holders of
				and parties to such special permits and approvals to deviate from requirements
				for the transportation of lithium cells or batteries on board aircraft to
				determine if such special permits and approvals should be terminated or
				modified to reflect regulations established pursuant to this section.</text>
							</subsection><subsection id="H505140C5E1004DCBBB8BCE51C94AC404"><enum>(e)</enum><header>Transportation
				of defective or damaged batteries</header>
								<paragraph display-inline="no-display-inline" id="H06DB8A76D10A4C4387F5E5A3B764D7FF"><enum>(1)</enum><header>In
				general</header><text display-inline="yes-display-inline">The Administrator of
				the Pipeline and Hazardous Materials Safety Administration, in coordination
				with the Administrator of the Federal Aviation Administration, shall prohibit
				the transportation on board aircraft of lithium cells and batteries identified
				by the manufacturer or a Federal Government entity as being defective for
				safety reasons or damaged and that have the potential of producing heat or fire
				or short-circuiting on board aircraft. The Administrator of the Pipeline and
				Hazardous Materials Safety Administration shall establish appropriate safety
				measures for transporting (other than on board aircraft) such defective or
				damaged lithium cells and batteries.</text>
								</paragraph><paragraph id="HDDFD85CD74B24C928E1D780A365C9451"><enum>(2)</enum><header>Recalls</header><text display-inline="yes-display-inline">When such lithium cells or batteries are
				recalled for safety reasons, the Administrator of the Pipeline and Hazardous
				Materials Safety Administration, in consultation with the Consumer Product
				Safety Commission, shall establish a mechanism for appropriate notification to
				the manufacturer and consumers that these items are prohibited from being
				transported on board aircraft.</text>
								</paragraph></subsection><subsection id="H391A2D94C79844F3A1F273C02A433890"><enum>(f)</enum><header>Simplification
				and consolidation of requirements</header>
								<paragraph id="H75B541FB27874E3B891587C2201D5EE2"><enum>(1)</enum><header>In
				general</header><text display-inline="yes-display-inline">The Administrator of
				the Pipeline and Hazardous Materials Safety Administration, in coordination
				with the Administrator of the Federal Aviation Administration, shall
				consolidate and simplify for clarity, ease of understanding, and use the
				regulations of the Department of Transportation governing requirements for the
				transportation of lithium cells and batteries on board aircraft.</text>
								</paragraph><paragraph id="HFDE208351171479BB315573FAA974D21"><enum>(2)</enum><header>Education</header><text display-inline="yes-display-inline">The Administrator of the Pipeline and
				Hazardous Materials Safety Administration, in coordination with the
				Administrator of the Federal Aviation Administration, shall review and modify,
				as necessary, the existing program to educate and provide guidance to the air
				traveling public, including flight crews, about how to safely carry authorized
				lithium cells or batteries or electronic devices containing such cells or
				batteries on board an aircraft and shall establish a process to periodically
				measure the effectiveness of efforts to educate the air traveling public,
				including flight crews.</text>
								</paragraph></subsection><subsection id="H263C4FE981584692B64434543A6991FB"><enum>(g)</enum><header>Nonpreemption of
				certain regulations</header>
								<paragraph commented="no" id="H9C8DB313F75048E5B999146C2057CF96"><enum>(1)</enum><header>Primary lithium
				batteries</header><text display-inline="yes-display-inline">The Secretary shall
				continue in effect the prohibition on the transportation of primary lithium
				batteries and cells on board passenger-carrying aircraft, unless the Secretary
				issues, through publication in the Federal Register, a determination that such
				prohibition must be modified or withdrawn.</text>
								</paragraph><paragraph commented="no" id="H182106AF5EE745C9AA4253A03FD8C0DE"><enum>(2)</enum><header>Passenger
				exception</header><text>Notwithstanding paragraph (1), the exceptions provided
				for passengers, crew members, and air operators in section 175.10 of title 49,
				Code of Federal Regulations, shall remain in effect unless the Secretary
				issues, through publication in the Federal Register, a determination that the
				regulation in such section must be modified or withdrawn for safety
				reasons.</text>
								</paragraph></subsection><subsection id="HF97C248AA74942719DB0E3B903F05887"><enum>(h)</enum><header>Definitions</header><text>In
				this section:</text>
								<paragraph id="H19A8213FC169454DAD56978CAE625885"><enum>(1)</enum><header>Battery</header><text display-inline="yes-display-inline">The term <term>battery</term> means 1 or
				more cells that are electrically connected by permanent means and includes the
				case, terminals, and markings.</text>
								</paragraph><paragraph id="H2EFF1CF264B84410A4D00098662CDF64"><enum>(2)</enum><header>Cell</header><text display-inline="yes-display-inline">The term <term>cell</term> means a single
				encased electrochemical unit (1 positive and 1 negative electrode) that
				exhibits a voltage differential across its 2 terminals.</text>
								</paragraph><paragraph id="H5F5203A3212C4288A83E252FC04EB4D0"><enum>(3)</enum><header>Lithium cell or
				battery</header><text display-inline="yes-display-inline">The term
				<term>lithium cell or battery</term> means a primary lithium cell or battery or
				a lithium-ion cell or battery.</text>
								</paragraph><paragraph id="H0144F51CD4334CF889AB098E40B7C5C7"><enum>(4)</enum><header>Lithium-ion cell
				or battery</header><text display-inline="yes-display-inline">The term
				<term>lithium-ion cell or battery</term> means a rechargeable electrochemical
				cell or battery in which the positive and negative electrodes are both
				intercalation compounds constructed with no metallic lithium in either
				electrode. A lithium polymer cell or battery that uses lithium-ion chemistries
				shall be considered to be a lithium-ion cell or battery.</text>
								</paragraph><paragraph id="HB75BC2956D2B41A0A879453538B93F65"><enum>(5)</enum><header>Primary lithium
				cell or battery</header><text>The term <term>primary lithium cell or
				battery</term> means a lithium metal cell or battery that is not designed to be
				electrically charged or
				recharged.</text>
								</paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
				</subsection><subsection id="H62F72996AA974EB6B0FF6E3DFEA4AF49"><enum>(b)</enum><header>Clerical
			 amendment</header><text display-inline="yes-display-inline">The analysis for
			 chapter 51 is amended by inserting after the item relating to section 5110 the
			 following:</text>

			 by inserting after section 5117 the following:</text>

				general</header>
								<paragraph id="H17D612A11F824872BBE3CDBF906BE81D"><enum>(1)</enum><header>Prohibition for
				new cargo tank motor vehicles</header><text display-inline="yes-display-inline">Subject to subsection (b), the Secretary
				shall prohibit the transportation of a Class 3 flammable liquid in the external
				product piping of a cargo tank motor vehicle manufactured on or after the
				2-year period beginning on the date of enactment of the
				<short-title>Hazardous Material Transportation Safety Act
				of 2009</short-title>.</text>
								</paragraph><paragraph id="H003387ED6E2F49B78135ED4B94C424A8"><enum>(2)</enum><header>Prohibition for
				existing cargo tank motor vehicles</header><text display-inline="yes-display-inline">Subject to subsection (b), no person may
				offer for transportation or transport a Class 3 flammable liquid in the
				external product piping of a cargo tank motor vehicle on or after December 31,
				2020.</text>
								</paragraph></subsection><subsection id="H6F787DF2D02E4B319A771FB2DCFAD13A"><enum>(b)</enum><header>Limitation on
				applicability</header><text>Subsection (a) does not apply—</text>
								<paragraph id="HD76AE99EE2904EC48AC725B088C8B5BA"><enum>(1)</enum><text>to a cargo tank
				motor vehicle designed and constructed with engine, body, and cargo tank
				permanently mounted on the same chassis with product piping protected from
				impact by another motor vehicle by the structural components of the cargo tank
				motor vehicle, such as damage protection guards, framing members, or wheel
				assemblies; or</text>
								</paragraph><paragraph id="H347D3C4DF51540E782296753D47E824E"><enum>(2)</enum><text>to a minimal
				amount, as determined by the Secretary by regulation, of hazardous material
				residue that remains in the external product piping after the piping is
				drained.</text>
								</paragraph></subsection><subsection id="HD9712B9C31764417B490720A431AF73E"><enum>(c)</enum><header>Enforcement
				personnel</header>
								<paragraph id="HCA59098596A24CEAA1D9DB0BA1A056C8"><enum>(1)</enum><header>In
				general</header><text>The Secretary shall issue guidance to motor carrier
				safety enforcement personnel on how to conduct inspections of cargo tank motor
				vehicles in a manner that ensures safety. The guidance shall prohibit such
				enforcement personnel from opening valves of external product piping during
				inspections or conducting any other activity that could cause the release of
				hazardous material at the inspection site.</text>
								</paragraph><paragraph commented="no" id="H4D36123122AE4FBCBAFC9F99584702DE"><enum>(2)</enum><header>Consultation</header><text>In
				developing the guidance under paragraph (1), the Secretary shall consult with a
				nonprofit organization comprised of Federal, State, and local motor carrier
				safety enforcement personnel.</text>
								</paragraph></subsection><subsection id="H83B1C8D5E43A4FB1A7881C2B306A0E09"><enum>(d)</enum><header>Worker
				Safety</header>
								<paragraph id="H9AD7AB4F992B4A61B30A99A81A2C2D2F"><enum>(1)</enum><header>In
				general</header><text display-inline="yes-display-inline">The Secretary and the
				Secretary of Labor shall each review and update, as appropriate, existing
				standards of the Secretary to ensure that personnel who conduct any activities
				pursuant to this section, including welding, are adequately protected.</text>
								</paragraph><paragraph commented="no" id="H8D3F40BDB59E4DE385B9D0D1E2E6FECB"><enum>(2)</enum><header>Consultation</header><text>In
				conducting the review and update under paragraph (1), the Secretary and the
				Secretary of Labor shall each consult, as appropriate, with a nonprofit
				organization representing employees of cargo tank motor vehicle operators and a
				nonprofit organization representing cargo tank motor vehicle owners and
				operators.</text>
								</paragraph></subsection><subsection id="H8B2A2E4D2D0B4F088B8D2694B4451411"><enum>(e)</enum><header>Definitions</header><text>In
				this section:</text>
								<paragraph id="HD32B9847341B4DB3AD25ACEB5FCE9272"><enum>(1)</enum><header>Cargo tank motor
				vehicle</header><text>The term <term>cargo tank motor vehicle</term> has the
				meaning given such term in part 171 of title 49, Code of Federal Regulations,
				as in effect on the date of enactment of the <short-title>Hazardous Material Transportation Safety Act of
				2009</short-title>.</text>
								</paragraph><paragraph id="HDB77CC59DD6644DAA9FC8DD221CC532E"><enum>(2)</enum><header>Class 3
				flammable liquid</header><text display-inline="yes-display-inline">The term
				<term>Class 3 flammable liquid</term> has the meaning given such term in
				section 173.120(a) of title 49, Code of Federal Regulations, as in effect on
				the date of enactment of the <short-title>Hazardous
				Material Transportation Safety Act of
				2009</short-title>.</text>
								</paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
				</subsection><subsection id="H0B0B9DC3B0BB454F8D92947DB2DC1B5F"><enum>(b)</enum><header>Clerical
			 amendment</header><text>The analysis for chapter 51 is amended by inserting

			 collection, analysis, and reporting</header>
				<subsection id="H8AC02D0F114046E78C0184B4C9E6B569"><enum>(a)</enum><header>Establishment of
			 working group</header><text>Not later than 60 days after the date of enactment
			 of this Act, the Secretary shall establish a working group for the purpose of
			 improving the collection, analysis, reporting, and use of data related to
			 accidents and incidents involving the transportation of hazardous
			 material.</text>
				</subsection><subsection id="H4CFB93C548EA4146A7740B2A55C8FE78"><enum>(b)</enum><header>Membership</header><text>The
			 working group shall consist of the following:</text>
					<paragraph id="H9ACCED1BDCFB4B899F51243ADB191611"><enum>(1)</enum><text>At least 1
			 representative of each of the following agencies, to be appointed by the head
			 of the agency:</text>
						<subparagraph id="H3A99F03F18A244DF96CE7BCD274F1DBF"><enum>(A)</enum><text>The Federal
			 Aviation Administration.</text>
						</subparagraph><subparagraph id="HBC23C906711943D7BF2DE533C34069E7"><enum>(B)</enum><text>The Federal Motor
			 Carrier Safety Administration.</text>
						</subparagraph><subparagraph id="HAC2A44803A2F4417A30F7AEE8C28F913"><enum>(C)</enum><text>The Federal
			 Railroad Administration.</text>
						</subparagraph><subparagraph id="H2255D9FBC5B44E45B6F5CD7D14DF59A8"><enum>(D)</enum><text>The Coast
			 Guard.</text>
						</subparagraph><subparagraph id="H8E4E0A9930D34B6A87C7115EFFF73FE7"><enum>(E)</enum><text>The Pipeline and
			 Hazardous Materials Safety Administration.</text>
						</subparagraph></paragraph><paragraph id="HA74E4801F5CF47E1B345FD823272E647"><enum>(2)</enum><text>Such other
			 officers or employees of the Department as the Secretary may appoint.</text>
					</paragraph></subsection><subsection id="H16C5AF34A2C64654AA20714CFE2D9C88"><enum>(c)</enum><header>Duties</header><text>The
			 working group shall—</text>
					<paragraph id="HEB7D1C2F0E524769BD3054092ACC42E7"><enum>(1)</enum><text>review the
			 Pipeline and Hazardous Materials Safety Administration’s methods for
			 collecting, analyzing, and reporting accidents and incidents involving the
			 transportation of hazardous material, including the adequacy of—</text>
						<subparagraph id="HAC1171D149614E86A4151D170A181EB7"><enum>(A)</enum><text>information
			 requested on the accident and incident reporting forms required to be submitted
			 to the Administration;</text>
						</subparagraph><subparagraph id="HA1D36AE90C5F47CA91684DB22F4A1217"><enum>(B)</enum><text>methods used by
			 the Administration to verify that the information provided on such forms is
			 accurate and complete;</text>
						</subparagraph><subparagraph id="H2CC3A70909754EFA9A17F09E567BAA6D"><enum>(C)</enum><text>resources of the
			 Administration related to data collection, analysis, and reporting, including
			 staff and information technology; and</text>
						</subparagraph><subparagraph id="H0EEDD035AE224B76BCAB6CB7256AED2D"><enum>(D)</enum><text>the database used
			 by the Administration for recording and reporting such accidents and incidents,
			 including the ability of users to adequately search the database and find
			 information;</text>
						</subparagraph></paragraph><paragraph id="HD576ABB9713C4B0D8B4649930E474B77"><enum>(2)</enum><text>make
			 recommendations to the Administration for improving the collection, analysis,
			 reporting, and use of such data; and</text>
					</paragraph><paragraph commented="no" id="H6F2F4BFC93A74A6484CB8B19F7E2B341"><enum>(3)</enum><text>such other duties
			 as the Secretary determines are appropriate.</text>
					</paragraph></subsection><subsection id="H973359E868AA466DBA148CE5F1AECA37"><enum>(d)</enum><header>Development of
			 action plan</header><text>Not later than 90 days after the date of enactment of
			 this Act, taking into consideration the recommendations made by the working
			 group, the Secretary shall develop an action plan and timeline for improving
			 the collection, analysis, reporting, and use of data by the Administration,
			 including revising the database of the Administration, as appropriate.</text>
				</subsection><subsection id="H7C300B32A4D5410799557A12D3509010"><enum>(e)</enum><header>Submission to
			 Congress</header><text>Not later than 15 days after the date of development of
			 the action plan and timeline under subsection (d), the Secretary shall submit
			 the action plan and timeline to the Committee on Transportation and
			 Infrastructure of the House of Representatives and the Committee on Commerce,
			 Science, and Transportation of the Senate.</text>
				</subsection></section></title><title id="HA5562E2A499C4CCAAFCBB3DD64F00456"><enum>III</enum><header>Strengthening
			 Enforcement</header>
			<section id="HA741A57F0A7846BA8468F0CD0D934874"><enum>301.</enum><header>Hazardous
			 material enforcement training program</header>
				<subsection id="H0A5F36BFD38C4F13857BF218ECE915D7"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">The Secretary shall
			 carry out a hazardous material enforcement training program—</text>
					<paragraph id="H131F87D58EC84224B39C4DDB434E3411"><enum>(1)</enum><text>to develop uniform
			 performance standards for training hazardous material inspectors and
			 investigators;</text>
					</paragraph><paragraph id="H8CCD849C00784B1CB4D9E3D2B286E635"><enum>(2)</enum><text>to train hazardous
			 material inspectors and investigators on how to collect, analyze, and publish
			 findings from inspections and investigations of accidents or incidents
			 involving the transportation of hazardous material; and</text>
					</paragraph><paragraph id="H416228ABF65D490B9F23E93881C63B5B"><enum>(3)</enum><text>to train hazardous
			 material inspectors and investigators on how to identify noncompliance with
			 regulations issued under chapter 51 of title 49, United States Code, and take
			 appropriate enforcement action.</text>
					</paragraph></subsection><subsection id="HD71CEA8F583A42E3A8AB1A2414B5490D"><enum>(b)</enum><header>Standards and
			 guidelines</header><text display-inline="yes-display-inline">Under the program,
			 the Secretary may develop—</text>
					<paragraph id="HD18BD9ED670F409DB20A421771890163"><enum>(1)</enum><text>guidelines for
			 hazardous material inspector and investigator qualifications;</text>
					</paragraph><paragraph id="HCFECD20562B0480D94785B2D9C67CFED"><enum>(2)</enum><text>best practices and
			 standards for hazardous material inspector and investigator training programs;
			 and</text>
					</paragraph><paragraph id="H9AEE35C999AE45D2AA3D9BC4DFF70BF1"><enum>(3)</enum><text>standard protocols
			 to coordinate investigation efforts among Federal, State, and local
			 jurisdictions on accidents or incidents involving the transportation of
			 hazardous material.</text>
					</paragraph></subsection><subsection id="HD121CE23D81B462D9C4305496E2AD93F"><enum>(c)</enum><header>Availability</header><text display-inline="yes-display-inline">The Secretary may make the standards,
			 protocols, and findings of the program described in this section available to
			 Federal, State, and local hazardous material safety enforcement
			 personnel.</text>
				</subsection></section><section id="H57C3F31761884E32AF516B14317E2A34"><enum>302.</enum><header>Inspections and
			 investigations</header>
				<subsection id="H1F2B356E1C45411F8A06DCEC91F94C52"><enum>(a)</enum><header>Notice of
			 enforcement measures</header><text display-inline="yes-display-inline">Section
			 5121(c)(1) is amended—</text>
					<paragraph id="H87E4B7D8E4E74302B5419EAF86A6D00B"><enum>(1)</enum><text>in subparagraph
			 (E) by striking <quote>and</quote> at the end;</text>
					</paragraph><paragraph id="H361A50FA62FE412BB6EA4B819DCED5C1"><enum>(2)</enum><text>in subparagraph
			 (F) by striking the period at the end and inserting <quote>; and</quote>;
			 and</text>
					</paragraph><paragraph id="HF9A32F9CEF4A473794B5A14163F211D8"><enum>(3)</enum><text>by adding at the
			 end the following:</text>
						<quoted-block id="H87D5BE131DEC4451A23126DE48039DD8" style="OLC">
							<subparagraph id="H8C7B685330924C99A3520236FE678DF3"><enum>(G)</enum><text>shall provide to
				the affected offeror, carrier, packaging manufacturer or tester, or other
				person responsible for the package reasonable notice of any findings made and
				actions being taken as a result of a finding of
				noncompliance.</text>
							</subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
					</paragraph></subsection><subsection commented="no" id="H1E3CF71643C244C59BBCABC909DBDB1D"><enum>(b)</enum><header>Regulations</header><text>Section
			 5121(e) is amended by adding at the end the following:</text>
					<quoted-block display-inline="no-display-inline" id="HEB1535C5CE724587830294F213E48F8C" style="OLC">
						<paragraph commented="no" id="H52EE4773F5584D76978D6B753262CCE0"><enum>(3)</enum><header>Matters to be
				addressed</header><text>In issuing the regulations to carry out subsections (c)
				and (d), the Secretary shall address, at a minimum, the following:</text>
							<subparagraph commented="no" id="H1C9A99A9CC2B453FA326ABEEC7271EA0"><enum>(A)</enum><text>Safe and
				expeditious resumption of transportation of perishable hazardous material,
				including radiopharmaceuticals and other medical products, that may require
				timely delivery due to life-threatening situations.</text>
							</subparagraph><subparagraph commented="no" id="H9087C29868D24B07BA54AD81A0D6BED2"><enum>(B)</enum><text>Appropriate
				training and equipment for inspectors.</text>
							</subparagraph><subparagraph commented="no" id="H24B397FEBBF042F3B588A96EAF286D7A"><enum>(C)</enum><text>The proper closure
				of packaging in accordance with the hazardous material
				regulations.</text>
							</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</subsection><subsection id="H3388E61BF6C54E9890DA6C2233DBFCE1"><enum>(c)</enum><header>Grants and
			 cooperative agreements</header><text>Section 5121(g)(1) is amended by striking
			 <quote>security</quote> and inserting <quote>safety and
			 security</quote>.</text>
				</subsection><subsection id="H72A451F9EA3B4B98805648248610AD4F"><enum>(d)</enum><header>Authority To
			 conduct investigations</header><text display-inline="yes-display-inline">Section 5121 is amended by adding at the
			 end the following:</text>
					<quoted-block display-inline="no-display-inline" id="H7FA17DD8425C4C92A45419D230699F73" style="OLC">
						<subsection id="H39256F86283540C88D30C08926C9F4DB"><enum>(i)</enum><header>Accident or
				Incident Investigations</header>
							<paragraph id="H2CE81DE2E369403C8B6BA70AF4F4DEEC"><enum>(1)</enum><header>In
				general</header><text display-inline="yes-display-inline">A designated officer,
				employee, or agent of the Secretary may investigate an accident or incident
				involving the transportation of hazardous material.</text>
							</paragraph><paragraph id="HC23A3C71410544E282C5B315A8A81744"><enum>(2)</enum><header>Authorities in
				conducting investigations</header><text display-inline="yes-display-inline">In
				conducting an investigation of an accident or incident involving the
				transportation of hazardous material, a designated officer, employee, or agent
				of the Secretary may—</text>
								<subparagraph id="H08B6836B17E049B2A1D8E4B85704B7B5"><enum>(A)</enum><text>enter
				property;</text>
								</subparagraph><subparagraph id="HDF0AB99C612E42FFA7CB0AFB69F3D114"><enum>(B)</enum><text>subpoena
				witnesses;</text>
								</subparagraph><subparagraph id="HB4EAA0D827F04582B3A5AE79A00F3D20"><enum>(C)</enum><text>require the
				production of records, exhibits, and other evidence;</text>
								</subparagraph><subparagraph id="H9235AD92E7364B23A0992E30921ACDA7"><enum>(D)</enum><text>administer oaths;
				and</text>
								</subparagraph><subparagraph id="H97EC334FA3DB4B03B79C5E02ECE40BCD"><enum>(E)</enum><text>take
				testimony.</text>
								</subparagraph></paragraph><paragraph id="H2ED0EB6D4F584346A05B84A3AC1C8F48"><enum>(3)</enum><header>Coordination
				with State investigations</header><text display-inline="yes-display-inline">If
				an accident or incident involving the transportation of hazardous material is
				investigated by the State in which such accident or incident occurred, the
				Secretary, to the extent practicable, shall coordinate any investigation
				conducted by the Secretary with respect to such accident or incident with the
				State’s investigation.</text>
							</paragraph><paragraph id="H8DAFBE68AD7D45FA953BE1122B89855A"><enum>(4)</enum><header>Authority of
				National Transportation Safety Board</header><text>Pursuant to chapter 11, the
				National Transportation Safety Board retains authority to lead the
				investigation into an accident or incident involving the transportation of
				hazardous material. The Secretary shall use the Secretary’s authority under
				this paragraph to support any investigation the Board undertakes.</text>
							</paragraph><paragraph id="HC159F9382387446A9B05D7F47BAEBBEF"><enum>(5)</enum><header>Reports</header><text>When
				the Secretary determines it to be in the public interest, the Secretary shall
				make available to the public the results of an investigation conducted by the
				Secretary with respect to an accident or incident involving the transportation
				of hazardous material, including a statement of the cause of the accident or
				incident and such recommendations as the Secretary considers
				appropriate.</text>
							</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</subsection></section><section id="H024E641E23DA45119A01270D69A55502"><enum>303.</enum><header>Civil
			 penalties</header><text display-inline="no-display-inline">Section 5123 is
			 amended by adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="H207B332A723A464CBBB31E0857209309" style="USC">
					<subsection id="H9F9B678BC0614273AC0E808E986A4AF0"><enum>(h)</enum><header>Penalty for
				obstruction of inspections and investigations</header><text display-inline="yes-display-inline">The Secretary may impose a penalty on a
				person who obstructs or prevents the Secretary from carrying out inspections or
				investigations under section 5121(c) or 5121(i).</text>
					</subsection><subsection id="H97416F54FFE045D3B897B299687D561E"><enum>(i)</enum><header>Prohibition on
				hazardous material operations after nonpayment of penalties</header>
						<paragraph id="HB574AB7B86AD4C939773481F043607A3"><enum>(1)</enum><header>In
				general</header><text>A person subject to the jurisdiction of the Secretary
				under this chapter for whom a civil penalty is assessed under this chapter and
				who does not pay such penalty or fails to arrange and abide by an acceptable
				payment plan for such civil penalty may not conduct any activity regulated
				under this chapter beginning on the 91st day after the date specified by order
				of the Secretary for payment of such penalty.</text>
						</paragraph><paragraph id="H026A5A4FEC924F4AA1C01CDBE34334B8"><enum>(2)</enum><header>Exception</header><text>Paragraph
				(1) shall not apply to any person who is unable to pay a civil penalty because
				such person is a debtor in a case under chapter 11 of title 11, United States
				Code.</text>
						</paragraph><paragraph id="H9732993577A8436EBE02948CC35FB62D"><enum>(3)</enum><header>Rulemaking
				required</header><text>Not later than 24 months after the date of the enactment
				of this subsection, the Secretary, after providing notice and an opportunity
				for public comment, shall issue regulations setting forth procedures to require
				a person who is delinquent in paying civil penalties to cease any activity
				regulated under this chapter until payment has been made or an acceptable
				payment plan has been arranged. The regulation shall ensure that the person is
				notified in writing and given an opportunity to respond before the person is
				required to cease the
				activity.</text>
						</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</section><section commented="no" id="H568F67329B184966B2FE1723B3CF83F2"><enum>304.</enum><header>Additional
			 resources</header>
				<subsection id="H8C6570572E67493DAF88EDAA8BD1B3C4"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">The Secretary shall
			 increase the personnel of the Pipeline and Hazardous Materials Safety
			 Administration by a total of 84 full-time employees to carry out the hazardous
			 material safety program and the administration of that program, of
			 which—</text>
					<paragraph id="H6DF331CEFE9E440788A15A7F3A2883EF"><enum>(1)</enum><text>24 employees shall
			 be added in fiscal year 2010;</text>
					</paragraph><paragraph id="HC7C77F8459CF4F2C98AAE4675CEC8C1F"><enum>(2)</enum><text display-inline="yes-display-inline">40 employees shall be added in fiscal year
			 2011; and</text>
					</paragraph><paragraph id="HBAE4860485104D44B1451C2BEC3511D2"><enum>(3)</enum><text display-inline="yes-display-inline">20 employees shall be added in fiscal year
			 2012.</text>
					</paragraph></subsection><subsection id="H33039073EDAA4479A97CCEF30B20850D"><enum>(b)</enum><header>Functions</header><text>In
			 increasing the number of employees pursuant to subsection (a), the Secretary
			 shall focus on hiring employees to—</text>
					<paragraph id="H3F42BA1EA8B44BD6BDD21A53A9E9E489"><enum>(1)</enum><text>conduct data
			 collection, analysis, and reporting;</text>
					</paragraph><paragraph id="HA3C4FA978644446B896C7A4C93C854A2"><enum>(2)</enum><text>develop,
			 implement, and update information technology utilized by the Pipeline and
			 Hazardous Materials Safety Administration;</text>
					</paragraph><paragraph id="H50D8E36EDBD3496B878557EC774F25B8"><enum>(3)</enum><text>implement the
			 requirements of section 5117 of title 49, United States Code;</text>
					</paragraph><paragraph id="HD0E6D0955D1D4FA6AEB41E744B8A2877"><enum>(4)</enum><text>conduct routine
			 inspections and audits of persons who transport, cause to be transported, or
			 offer for transportation hazardous material;</text>
					</paragraph><paragraph id="H1566123965124FA6907F36D00906C711"><enum>(5)</enum><text>support hazardous
			 material enforcement activities of the Pipeline and Hazardous Materials Safety
			 Administration, including training of hazardous material enforcement personnel;
			 and</text>
					</paragraph><paragraph id="HA27B8871F12E45EFB3ABCDE019FC1288"><enum>(6)</enum><text>support the
			 overall hazardous material safety mission of the Pipeline and Hazardous
			 Materials Safety Administration.</text>
					</paragraph></subsection><subsection id="HF1F626BDEF9A415393F280B9F6A6996A"><enum>(c)</enum><header>Specific
			 duties</header><text>Of the number of additional full-time employees added each
			 fiscal year by subsection (a), not less than 10 of such employees each fiscal
			 year shall be assigned to perform the function described in subsection
			 (b)(4).</text>
				</subsection></section></title><title id="HB8FB1F91B7D746E4A5573DC717827D48"><enum>IV</enum><header>Miscellaneous</header>
			<section id="HDB91A2EBEE6B47919F29CD079190BA58"><enum>401.</enum><header>Special
			 permits, approvals, and exclusions</header>
				<subsection id="H8AA80FA959BC435D8F416B3D50BEEAE9"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Section 5117 is
			 amended to read as follows:</text>
					<quoted-block display-inline="no-display-inline" id="H5914E38553CE4A99AE74573A3EF739A5" style="USC">
						<section id="H43BC1A0E386141739C2F76875124A75F"><enum>5117.</enum><header>Special
				permits, approvals, and exclusions</header>
							<subsection id="H23675E7B5FB04FC0A409D4CAC715E1CE"><enum>(a)</enum><header>Authority To
				Issue Special Permits</header>
								<paragraph id="HC19250ED8F564C328D7085BA954DDB52"><enum>(1)</enum><header>Conditions</header><text display-inline="yes-display-inline">As provided under procedures prescribed by
				regulation, the Secretary may issue, modify, or terminate a special permit
				authorizing a variance from this chapter or a regulation prescribed under
				section 5103(b), 5104, 5110, or 5112 to a person performing a function
				regulated by the Secretary under section 5103(b)(1) in a way that achieves a
				safety level—</text>
									<subparagraph id="H62F321FA37AC4FCF885300E8189BDDD4"><enum>(A)</enum><text>at least equal to
				the safety level required under this chapter; or</text>
									</subparagraph><subparagraph id="HD5CAF21062DB42B6863902213A5CF734"><enum>(B)</enum><text>consistent with
				the public interest and this chapter, if a required safety level does not
				exist.</text>
									</subparagraph></paragraph><paragraph id="H7C82E3325A894F0792B44D0CCC9E91D8"><enum>(2)</enum><header>Findings
				required</header>
									<subparagraph id="H635A2A4A1DAE48E7B2BA5C4EBE50826F"><enum>(A)</enum><header>In
				general</header><text display-inline="yes-display-inline">Prior to issuing,
				renewing, or modifying a special permit or granting party status to a special
				permit, the Secretary shall determine that the person is fit, willing, and able
				to conduct the activity authorized by such permit in a manner that achieves the
				level of safety required under paragraph (1).</text>
									</subparagraph><subparagraph id="H1997467997A547F4AED0CC1376D596EC"><enum>(B)</enum><header>Considerations</header><text display-inline="yes-display-inline">In making the determination under
				subparagraph (A), the Secretary shall consider the person’s safety history
				(including prior compliance history), accident and incident history, and any
				other information the Secretary considers appropriate to make such a
				determination.</text>
									</subparagraph></paragraph><paragraph id="H2FBFD3F232494ABABE0D86C8783041B9"><enum>(3)</enum><header>Effective
				period</header><text display-inline="yes-display-inline">A special permit
				issued under this section shall be effective for an initial period of not more
				than 2 years and may be renewed by the Secretary upon application for
				successive periods of not more than 4 years each or, in the case of a special
				permit relating to section 5112, for an additional period of not more than 2
				years.</text>
								</paragraph></subsection><subsection id="HDD32AE38F23C4137A5CBD23D0A6098D1"><enum>(b)</enum><header>Applications</header>
								<paragraph id="H22F60DE75A6D435A81B7D7EA6A97AE33"><enum>(1)</enum><header>Required
				documentation</header><text display-inline="yes-display-inline">When applying
				for a special permit or renewal or modification of a special permit or
				requesting party status to a special permit under this section, the Secretary
				shall require the person to submit an application that contains, at a minimum,
				a detailed description of the person’s request, a listing of the person’s
				facilities and addresses where the special permit will be utilized, a safety
				analysis prescribed by the Secretary that justifies the special permit,
				documentation to support the safety analysis, and, if applicable, verification
				of registration as required by section 5108.</text>
								</paragraph><paragraph id="H56136768C54F4AFF800AA64E869911D9"><enum>(2)</enum><header>Public
				notice</header><text display-inline="yes-display-inline">The Secretary shall
				publish in the Federal Register notice that an application for a special permit
				has been filed and shall provide the public an opportunity to inspect and
				comment on the application.</text>
								</paragraph><paragraph id="HBA7D34D490154315831906C4055DF64B"><enum>(3)</enum><header>Savings
				clause</header><text>This subsection does not require the release of
				information protected by law from public disclosure.</text>
								</paragraph></subsection><subsection id="HC846D841B5BD4E9196EEC88035FDD07B"><enum>(c)</enum><header>Coordination
				with Modal Contact Officials</header>
								<paragraph id="H77C67A73E26E46A5BA0F5186076C8CAA"><enum>(1)</enum><header>In
				general</header><text>In evaluating applications under subsection (b) and
				making the findings and determinations under subsections (a), (e), and (h), the
				Administrator of the Pipeline and Hazardous Materials Safety Administration
				shall consult and coordinate with the modal contact official responsible for
				the mode of transportation that will be utilized under a special permit or
				approval prior to issuing, modifying, or renewing the special permit, granting
				party status to the special permit, or issuing or renewing the approval.</text>
								</paragraph><paragraph id="H920333FE83E740489FED8337559F9E35"><enum>(2)</enum><header>Dispute
				resolution</header><text display-inline="yes-display-inline">The Secretary
				shall develop a procedure for resolving a dispute between the Administrator and
				a modal contact official to ensure that any concern raised by such official is
				appropriately addressed and resolved.</text>
								</paragraph><paragraph id="H3C287827C56E46F8927F20382CA0D109"><enum>(3)</enum><header>Modal contact
				official defined</header><text>In this section, the term <term>modal contact
				official</term> means—</text>
									<subparagraph id="H02E157465D0A4954BECC4258644D2123"><enum>(A)</enum><text display-inline="yes-display-inline">the Administrator of the Federal Aviation
				Administration;</text>
									</subparagraph><subparagraph id="H284DE2C110894960B94427244522830F"><enum>(B)</enum><text display-inline="yes-display-inline">the Administrator of the Federal Motor
				Carrier Safety Administration;</text>
									</subparagraph><subparagraph id="H3F11C226B1F648ADB3891AE99458F9E1"><enum>(C)</enum><text display-inline="yes-display-inline">the Administrator of the Federal Railroad
				Administration; or</text>
									</subparagraph><subparagraph id="H74E3AEB876C94F6BB4DD7A306AB09769"><enum>(D)</enum><text>the Commandant of
				the Coast Guard.</text>
									</subparagraph></paragraph></subsection><subsection id="HC622AD68D54E4A24BD55309E9C7178FD"><enum>(d)</enum><header>Applications To
				be dealt with promptly</header><text display-inline="yes-display-inline">The
				Secretary shall issue, modify, renew, or grant party status to a special permit
				for which a request was filed in accordance with this section, or deny such
				issuance, modification, renewal, or grant, on or before the last day of the
				180-day period beginning on the first day of the month following the date of
				the filing of such request, or the Secretary shall publish a statement in the
				Federal Register of the reason why the Secretary’s decision on the special
				permit is delayed, along with an estimate of the additional time necessary
				before the decision is made.</text>
							</subsection><subsection id="H77644E5F12CA45A1B3C9E219E2C15B54"><enum>(e)</enum><header>Emergency
				processing of special permits</header>
								<paragraph id="H4AFCEFEBFC4746E7B2EBD7CD2A714456"><enum>(1)</enum><header>Findings
				required</header><text>The Secretary may grant a request for emergency
				processing of a special permit only if the Secretary finds—</text>
									<subparagraph id="HC971DA40C9A64677BC196DF1586D6886"><enum>(A)</enum><text>it is necessary
				for immediate national security purposes;</text>
									</subparagraph><subparagraph id="H2E79C7DE922C48FF97E31D50C5C6E1F9"><enum>(B)</enum><text>that processing on
				a routine basis under this section would result in significant injury to
				persons or property; or</text>
									</subparagraph><subparagraph id="HF6E15C56918448CC84A5772E65AD9C55"><enum>(C)</enum><text>it is necessary to
				prevent significant economic loss that could not be prevented if the
				application were processed on a routine basis.</text>
									</subparagraph></paragraph><paragraph id="HA3717B359F2E46F4886A8BCE3D1BA418"><enum>(2)</enum><header>Waiver of
				fitness test</header><text display-inline="yes-display-inline">The Secretary
				may waive the requirement under subsection (a)(2) for a request for which the
				Secretary makes a finding under paragraph (1)(A) or (1)(B).</text>
								</paragraph><paragraph id="HCC499E1517924501964308178FAE3A85"><enum>(3)</enum><header>Notification</header><text display-inline="yes-display-inline">Not later than 90 days after the date of
				issuance of a special permit under this subsection, the Secretary shall publish
				in the Federal Register a notice of issuance with a statement of the basis for
				the finding of emergency and the scope and duration of the special
				permit.</text>
								</paragraph><paragraph id="HF7670DA385C64345A85816120D8BE44F"><enum>(4)</enum><header>Effective
				period</header><text>A special permit issued under this subsection shall be
				effective for a period of not to exceed 30 days.</text>
								</paragraph></subsection><subsection id="HBA596892185A4B4F8162C4DB40F4881C"><enum>(f)</enum><header>Exclusions</header>
								<paragraph id="H5BC47AD18BE1426AB12FCD66060EB3A9"><enum>(1)</enum><header>In
				general</header><text display-inline="yes-display-inline">The Secretary shall
				exclude, in any part, from this chapter and regulations prescribed under this
				chapter—</text>
									<subparagraph id="H55C1A8DFE98B493681C43CE444BC485B"><enum>(A)</enum><text>a public vessel
				(as defined in section 2101 of title 46);</text>
									</subparagraph><subparagraph id="H6E2E9B739A9F49CFB667140F12F5642C"><enum>(B)</enum><text>a vessel exempted
				under section 3702 of title 46 or from chapter 37 of title 46; and</text>
									</subparagraph><subparagraph id="H37D451C7864F48698807F78F88055599"><enum>(C)</enum><text>a vessel to the
				extent it is regulated under the Ports and Waterways Safety Act of 1972 (33
				U.S.C. 1221 et seq.).</text>
									</subparagraph></paragraph><paragraph id="H37EDEE68542543788E72680303DFEC3C"><enum>(2)</enum><header>Firearms</header><text>This
				chapter and regulations prescribed under this chapter do not prohibit—</text>
									<subparagraph id="H134A50825A054FBEA7BBC40F6F2AB92B"><enum>(A)</enum><text>or regulate
				transportation of a firearm (as defined in section 232 of title 18), or
				ammunition for a firearm, by an individual for personal use; or</text>
									</subparagraph><subparagraph id="HBF6679447EDB4A0894ABBABC1990F722"><enum>(B)</enum><text>transportation of
				a firearm or ammunition in commerce.</text>
									</subparagraph></paragraph></subsection><subsection id="H21117949574C4ADBBC3889CED92DDDA8"><enum>(g)</enum><header>Limitation on
				Authority</header><text display-inline="yes-display-inline">Unless the
				Secretary decides that an emergency exists, a special permit or renewal granted
				under this section is the only way a person subject to this chapter may be
				granted a variance from this chapter.</text>
							</subsection><subsection id="H402ECD9049D347968048D8B6C82E2110"><enum>(h)</enum><header>Approvals</header>
								<paragraph id="HC551A68E62A247E39C146EBD8B7B9948"><enum>(1)</enum><header>Findings
				required</header>
									<subparagraph id="H9CA82C74434B4B6FBD35C9BF6AAD4D7C"><enum>(A)</enum><header>In
				general</header><text>Prior to issuing an approval or granting renewal of an
				approval pursuant to part 107 of title 49, Code of Federal Regulations, the
				Secretary shall determine that the person is fit, willing, and able to conduct
				the activity authorized by the approval in a manner that achieves the level of
				safety required under subsection (a)(1).</text>
									</subparagraph><subparagraph id="H134D4695BAAB4EBE8CEC0DE6E3FF0730"><enum>(B)</enum><header>Considerations</header><text>In
				making the determination under subparagraph (A), the Secretary shall consider
				the person’s safety history (including prior compliance history), accident and
				incident history, and any other information the Secretary considers appropriate
				to make such a determination.</text>
									</subparagraph></paragraph><paragraph id="HB69AF90411EF46979D7A2867619E1466"><enum>(2)</enum><header>Public
				notice</header><text display-inline="yes-display-inline">The Secretary shall
				publish in the Federal Register notice that an application for an approval or
				renewal of an approval has been filed and shall give the public an opportunity
				to inspect and comment on the application prior to issuance.</text>
								</paragraph><paragraph id="H82557FA504B843E0A6917C5693B5FDAF"><enum>(3)</enum><header>Savings
				clause</header><text>This subsection does not require the release of
				information protected by law from public disclosure.</text>
								</paragraph></subsection><subsection id="HAF68E0944096499D9663AE1E36F88523"><enum>(i)</enum><header>Noncompliance</header><text>The
				Secretary shall immediately modify, suspend, or terminate a special permit or
				approval if the Secretary finds that the person who was granted such special
				permit or approval has violated such special permit or approval or the
				regulations issued under this chapter in a manner demonstrating that the person
				is not fit to conduct the activity authorized by the special permit or
				approval.</text>
							</subsection><subsection id="H5CDA7D89265E4696AECA7FAB8EDE3B6F"><enum>(j)</enum><header>Procedures</header><text>Not
				later than 120 days after the date of enactment of this subsection, the
				Secretary shall—</text>
								<paragraph id="H8FC09256D8EE4EB4B6E91F292A26689F"><enum>(1)</enum><text>develop and
				implement written standard operating procedures to support administration of
				the special permit and approval programs;</text>
								</paragraph><paragraph id="HEB31668C8EB947D593F58863E3C3A1FA"><enum>(2)</enum><text>update such
				procedures periodically; and</text>
								</paragraph><paragraph id="H8385490B47104602874AED8B0B6464DD"><enum>(3)</enum><text>make such
				procedures available to the public on the Department of Transportation’s
				Internet Web site.</text>
								</paragraph></subsection><subsection id="H3CF1B79470BD46369977A3384F211F3F"><enum>(k)</enum><header>Fees</header>
								<paragraph id="H8ECA9B15EDC947689516AD1EFA50A2BA"><enum>(1)</enum><header>Authorization</header><text>The
				Secretary shall establish a reasonable fee for processing applications for, and
				ensuring compliance with the terms of, special permits and approvals.</text>
								</paragraph><paragraph id="H60AEEC462B25459B9C08853D3CA80867"><enum>(2)</enum><header>Limitation on
				collection</header><text>No fee may be collected under this subsection unless
				the expenditure of the fee to pay the costs of activities and services for
				which the fee is imposed is provided for in advance in an appropriations
				Act.</text>
								</paragraph><paragraph id="H4BEC1C77F629497C8E822FEC40FCF4A8"><enum>(3)</enum><header>Fees credited as
				offsetting collections</header>
									<subparagraph id="H04EED6B734FD4E0B9AEDAC0170C10FE9"><enum>(A)</enum><header>In
				general</header><text display-inline="yes-display-inline">Notwithstanding
				section 3302 of title 31, any fee authorized to be collected under this
				subsection shall—</text>
										<clause id="H7B2FB103300748E19AD0CB413CF5ED13"><enum>(i)</enum><text>be
				credited as offsetting collections to the account that finances the activities
				and services for which the fee is imposed;</text>
										</clause><clause id="H47D241C45B084D00B66C9D71C317F20D"><enum>(ii)</enum><text>be available for
				expenditure only to pay the costs of activities and services for which the fee
				is imposed; and</text>
										</clause><clause id="H0A97AA9287D745449897B9A7EA0668BB"><enum>(iii)</enum><text>remain available
				until expended.</text>
										</clause></subparagraph></paragraph><paragraph id="H0F9F630D97FF44E4B8C8123ED5F7BD03"><enum>(4)</enum><header>Regulations</header><text>Not
				later than 12 months after the date of enactment of this subsection, the
				Secretary, after providing notice and an opportunity for public comment, shall
				issue regulations to implement this
				subsection.</text>
								</paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
				</subsection><subsection id="H1FEDC1C6FFB74B4CBCB8651BD6AE5DB4"><enum>(b)</enum><header>Rulemaking
			 required</header><text>Not later than 6 months after the date of enactment of
			 this Act, the Secretary shall complete all actions necessary to adopt a
			 regulation to define the term <term>public interest</term> for the purposes of
			 section 5117(a)(1)(B) of title 49, United States Code.</text>
				</subsection><subsection id="H5218906658914682B799D1A67ECF8408"><enum>(c)</enum><header>Clerical
			 amendment</header><text>The analysis for chapter 51 is amended by striking the
			 item relating to section 5117 and inserting the following:</text>

			 and procedures</header><text>Section 5119 is amended to read as follows:</text>

						<section id="H58EB161613504F02A002406DCB5FEC1D"><enum>5119.</enum><header>Uniform
				hazardous material State registration and permit program</header>
							<subsection id="H18E4C543FF3845FF86CDAC23C9445FFF"><enum>(a)</enum><header>Establishment
				and conduct</header>
								<paragraph id="HC2E07967D46D483382B649D7AE848493"><enum>(1)</enum><header>In
				general</header><text display-inline="yes-display-inline">The Secretary shall
				establish and carry out a program to develop uniform forms and procedures for
				States to register, and issue permits to, persons who transport, or cause to be
				transported, hazardous material by motor vehicle in accordance with this
				chapter and the regulations issued to carry out this chapter.</text>
								</paragraph><paragraph id="H330631445805450C8CD3DE1E327AE7E3"><enum>(2)</enum><header>Consideration of
				existing state alliance program</header><text display-inline="yes-display-inline">In establishing the program under this
				subsection, the Secretary shall consider the program of uniform forms and
				procedures for registering and issuing permits to persons who transport, or
				cause to be transported, hazardous material by motor vehicle developed by the
				alliance of States known as the <quote>Alliance for Uniform Hazmat
				Transportation Procedures</quote>.</text>
								</paragraph></subsection><subsection id="HA0676719534740D1B5C5CACE495015E3"><enum>(b)</enum><header>Regulations</header><text display-inline="yes-display-inline">Not later than 6 years after the date of
				enactment of the Hazardous Material Transportation Safety Act of 2009, the
				Secretary shall issue regulations to carry out this section.</text>
							</subsection><subsection display-inline="no-display-inline" id="H7F3803D3943F4FB8B1F014A0CE79A314"><enum>(c)</enum><header>Financial and
				technical assistance and support</header>
								<paragraph id="H984DFDC3CAA547C18A649D466A28B3BD"><enum>(1)</enum><header>In
				general</header><text>The Secretary may provide planning and transition
				assistance to States in order to encourage State adoption of the program
				established by the Secretary under this section.</text>
								</paragraph><paragraph id="HE94BABA2D8F84256B57D8DF6A820C2A2"><enum>(2)</enum><header>Use of
				funds</header><text>Assistance awarded to a State under this subsection may be
				used only to assist the State in transitioning the existing registration and
				permitting programs of the State to the program established under this
				section.</text>
								</paragraph></subsection><subsection id="HEEF85ECABE4C4CB8B6EA56F4EC4776DA"><enum>(d)</enum><header>Related
				expenses</header><text>For purposes of section 5125(f)(1), expenses related to
				transporting hazardous material may include costs incurred in implementing and
				administering the program established by the Secretary under this section,
				including costs of establishing or modifying forms, procedures, and
				systems.</text>
							</subsection><subsection commented="no" id="H673C478603FC4C03A6E46FB35B51503F"><enum>(e)</enum><header>Transition of
				state programs</header><text>Beginning on the effective date of the regulations
				issued to carry out this section, a State may enforce registration and
				permitting requirements for motor carriers that transport hazardous material in
				commerce only in accordance with the program established by the Secretary under
				this section.</text>
							</subsection><subsection id="HC99B24834A934E938349A903805047E0"><enum>(f)</enum><header>Limitation</header><text>Nothing
				in this section or the regulations issued by the Secretary to carry out this
				section shall limit the amount of a fee a State may impose or collect for
				registering and issuing permits to persons who transport, or cause to be
				transported, hazardous material by motor vehicle.</text>
							</subsection><subsection id="H6420513BD37C4A89A66CE054930DED89"><enum>(g)</enum><header>Authorization of
				appropriations</header><text display-inline="yes-display-inline">Of the amounts
				made available by section 31104(i) of title 49, United States Code, a total of
				$1,000,000 shall be available to carry out subsection
				(b).</text>
							</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
				</subsection><subsection id="H6FE7DC44928E420EB4B9EE21AAB36096"><enum>(b)</enum><header>Clerical
			 amendment</header><text>The analysis for chapter 51 is amended by striking the

			</section><section id="H588238CE831046FDAFA53760254FE49E"><enum>404.</enum><header>Implementation
			 of the hazardous material safety permit program</header>
				<subsection id="HDE808ADF299E4F28B8B93EFF9379C7F2"><enum>(a)</enum><header>Report</header><text>Not
			 later than 1 year after the date of enactment of this Act, the Comptroller
			 General shall conduct a study, and transmit to the Committee on Transportation
			 and Infrastructure of the House of Representatives and the Committee on
			 Commerce, Science, and Transportation of the Senate a report, on the
			 implementation of the hazardous material safety permit program under section
			 5109 of title 49, United States Code.</text>
				</subsection><subsection id="H6B4F0828BA5B4517A465D7291140467E"><enum>(b)</enum><header>Matters To be
			 reviewed</header><text>In conducting the study, the Comptroller General shall
			 review, at a minimum—</text>
					<paragraph id="H7B04CAB5BA4548F4891BD3F88304D35F"><enum>(1)</enum><text>the list of
			 hazardous materials requiring a safety permit;</text>
					</paragraph><paragraph id="H829D7E32E27D4DE1843E8E14032EC8A8"><enum>(2)</enum><text>the number of
			 permits that have been issued, denied, revoked, or suspended since inception of
			 the program and the number of commercial motor carriers that have never had a
			 permit denied, revoked, or suspended since inception of the program;</text>
					</paragraph><paragraph id="H52796BF6E37F4E41A5999AA46E9C2F03"><enum>(3)</enum><text>the reasons for
			 such denials, revocations, or suspensions;</text>
					</paragraph><paragraph id="HEB396D00E19645E29683DFACB93AD26A"><enum>(4)</enum><text>the criteria used
			 by the Federal Motor Carrier Safety Administration to determine whether a
			 hazardous material safety permit issued by a State is equivalent to the Federal
			 permit; and</text>
					</paragraph><paragraph id="H7DC58A93662C4F01842ED760839A6B99"><enum>(5)</enum><text>the Secretary’s
			 actions to improve the permit application process.</text>
					</paragraph></subsection><subsection id="H500CB53ECA444974B1CCD210FFF50A46"><enum>(c)</enum><header>Recommendations</header><text>The
			 Comptroller General shall include in the report any recommendations the
			 Comptroller General has for improving the hazardous material safety permit
			 program.</text>
				</subsection><subsection id="H846649DD41454D368696814E7E9D2841"><enum>(d)</enum><header>Technical
			 correction</header><text>Section 5109(b)(1) is amended by striking <quote>a
			 class A or B explosive</quote> and inserting <quote>a Division 1.1, 1.2, or 1.3
			 explosive</quote>.</text>
				</subsection></section><section id="H653128E42A9841A1A931E0EEB970BAF3"><enum>405.</enum><header>Authorization
			 of appropriations</header><text display-inline="no-display-inline">Section 5129
			 (as redesignated by section 104 of this Act) is amended to read as
			 follows:</text>

							</paragraph><paragraph id="HBEC2FFFCCEBC445CB5071EE3A3D1A4D2"><enum>(4)</enum><text display-inline="yes-display-inline">For fiscal year 2013, $61,414,758.</text>
							</paragraph><paragraph id="H2396BE4E54024E5CB5572F692D87789C"><enum>(5)</enum><text display-inline="yes-display-inline">For fiscal year 2014, $62,643,054.</text>
							</paragraph></subsection><subsection id="H3CA71B874E954E539E040CAAA608BCEF"><enum>(b)</enum><header>Hazardous
				Materials Emergency Preparedness Fund</header><text display-inline="yes-display-inline">There shall be available to the Secretary,
				from the account established pursuant to section 5116(i), for each of fiscal
				years 2010 through 2014 the following:</text>
							<paragraph id="HC66B14499428405C9A596FAB42BE57EE"><enum>(1)</enum><text>To carry out
				section 5115, $198,000.</text>
							</paragraph><paragraph id="H1A0D0EC44AD448B49475BE7C4E3C905B"><enum>(2)</enum><text>To carry out
				sections 5116(a) and 5116(b), $21,800,000, except that no less than $13,650,000
				shall be available to carry out section 5116(b).</text>
							</paragraph><paragraph id="HA6CA04BD584E4A098F13277D920C6832"><enum>(3)</enum><text>To carry out
				section 5116(f), $150,000.</text>
							</paragraph><paragraph id="H81438C15049942FDA4E25CE3FF668716"><enum>(4)</enum><text>To publish and
				distribute the Emergency Response Guidebook under section 5116(i)(3),
				$625,000.</text>
							</paragraph><paragraph id="HE06E5425972F49E7882D9B718C88E9D3"><enum>(5)</enum><text>To carry out
				section 5116(j), $1,000,000.</text>
							</paragraph></subsection><subsection id="H61B50260FF8E4A98A2D3C3917DE61366"><enum>(c)</enum><header>Hazmat Training
				Grants</header><text display-inline="yes-display-inline">There shall be
				available to the Secretary, from the account established pursuant to section
				5116(i), to carry out section 5107(e) $4,000,000 for each of fiscal years 2010
				through 2014.</text>
						</subsection><subsection id="H7A74200DC0594FA2BE71E5E1389F7AD2"><enum>(d)</enum><header>Credits to
				appropriations</header><text display-inline="yes-display-inline">The Secretary
				may credit to any appropriation to carry out this chapter an amount received
				from a State, Indian tribe, or other public authority or private entity for
				expenses the Secretary incurs in providing training to the State, authority, or
				entity.</text>
						</subsection><subsection id="H734644667B5A4E949455208A81415A88"><enum>(e)</enum><header>Availability of
				amounts</header><text display-inline="yes-display-inline">Amounts made
				available by or under this section shall remain available until
				expended.</text>
						</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
