		<section id="H090E415D29954C559AB310D0CDF20F46" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Lake Tahoe Restoration Act of
			 2009</short-title></quote>.</text>
		</section><section id="HB94550461C63439E8796126D41EF3643"><enum>2.</enum><header>Findings and
			 purposes</header><text display-inline="no-display-inline">The Lake Tahoe
			 Restoration Act (Public Law 106–506; 114 Stat. 2351) is amended by striking
			 section 2 and inserting the following:</text>

				<section id="H513BBDD74B5A41DFB8744D9B11230EB2"><enum>2.</enum><header>Findings and
				purposes</header>
					<subsection id="H5490C699C71342959D07B76EBDE0420F"><enum>(a)</enum><header>Findings</header><text>Congress
				finds that—</text>
						<paragraph id="H9C5274D3EBC34DA6A0EACD00304F3DE2"><enum>(1)</enum><text>Lake Tahoe—</text>
							<subparagraph id="H0672E2B858E04963B6EED2987DF3CF9F"><enum>(A)</enum><text>is 1 of the
				largest, deepest, and clearest lakes in the world;</text>
							</subparagraph><subparagraph id="HF692B6E5B72F4425A8C77F46814035F1"><enum>(B)</enum><text>has a cobalt blue
				color, a biologically diverse alpine setting, and remarkable water clarity;
				and</text>
							</subparagraph><subparagraph id="H4B3C22DE9FC6423ABFE4425051E7E8FD"><enum>(C)</enum><text>is recognized
				nationally and worldwide as a natural resource of special significance;</text>
							</subparagraph></paragraph><paragraph id="HE0ED231862B445F7A5FBC91570E10FCE"><enum>(2)</enum><text>in addition to
				being a scenic and ecological treasure, the Lake Tahoe Basin is 1 of the
				outstanding recreational resources of the United States, which—</text>
							<subparagraph id="H67137E96BB0543CFBB124A8461CC1C87"><enum>(A)</enum><text>offers skiing,
				water sports, biking, camping, and hiking to millions of visitors each year;
				and</text>
							</subparagraph><subparagraph id="HC45AEEED9F4A488DB1D752ED2557934F"><enum>(B)</enum><text>contributes
				significantly to the economies of California, Nevada, and the United
				States;</text>
							</subparagraph></paragraph><paragraph id="H3821127C1B9A4D89B61D9C824450F9A7"><enum>(3)</enum><text>the economy in the
				Lake Tahoe Basin is dependent on the protection and restoration of the natural
				beauty and recreation opportunities in the area;</text>
						</paragraph><paragraph id="HF9471797B96B4E7EA22BAD93F50C331D"><enum>(4)</enum><text>the Lake Tahoe
				Basin continues to be threatened by the impacts of land use and transportation
				patterns developed in the last century that damage the fragile watershed of the
				Basin;</text>
						</paragraph><paragraph id="HAC90F065D212448F8884066F84A2C62D"><enum>(5)</enum><text>the water clarity
				of Lake Tahoe declined from a visibility level of 105 feet in 1967 to only 70
				feet in 2008;</text>
						</paragraph><paragraph id="H4443B68587D34F31847FE44DE4210851"><enum>(6)</enum><text>the rate of
				decline in water clarity of Lake Tahoe has decreased in recent years;</text>
						</paragraph><paragraph id="H46DF15D8E0954A8EB31FE619040EC765"><enum>(7)</enum><text>a stable water
				clarity level for Lake Tahoe could be achieved through feasible control
				measures for very fine sediment particles and nutrients;</text>
						</paragraph><paragraph id="HC29A2CC40A2342B9839ECE29CAAC3287"><enum>(8)</enum><text>fine sediments
				that cloud Lake Tahoe, and key nutrients such as phosphorus and nitrogen that
				support the growth of algae and invasive plants, continue to flow into the lake
				from stormwater runoff from developed areas, roads, turf, other disturbed land,
				and streams;</text>
						</paragraph><paragraph id="H97C6E170092A41989E368D56C0F03A3B"><enum>(9)</enum><text>the destruction
				and alteration of wetland, wet meadows, and stream zone habitat have
				compromised the natural capacity of the watershed to filter sediment,
				nutrients, and pollutants before reaching Lake Tahoe;</text>
						</paragraph><paragraph id="HE1DF813FC3FD4784BFD9C8C8CDAAFF39"><enum>(10)</enum><text>approximately 25
				percent of the trees in the Lake Tahoe Basin are either dead or dying;</text>
						</paragraph><paragraph id="HA5A51D84ACFC4576953C7FE9DEBEA5CD"><enum>(11)</enum><text>forests in the
				Tahoe Basin suffer from over a century of fire suppression and periodic
				drought, which have resulted in—</text>
							<subparagraph id="HD2E50313A15443A691EABB221A9F207A"><enum>(A)</enum><text>high tree density
				and mortality;</text>
							</subparagraph><subparagraph id="HFED9ABFC164948C69DD9A9E7059F7004"><enum>(B)</enum><text>the loss of
				biological diversity; and</text>
							</subparagraph><subparagraph id="HD0A1159E0D5C48A29A2E2684EBD861B5"><enum>(C)</enum><text>a large quantity
				of combustible forest fuels, which significantly increases the threat of
				catastrophic fire and insect infestation;</text>
							</subparagraph></paragraph><paragraph id="H40016E8C88AD47C3AB3EE1C45EC4025F"><enum>(12)</enum><text>the establishment
				of several aquatic and terrestrial invasive species (including bass, milfoil,
				and Asian clam) threatens the ecosystem of the Lake Tahoe Basin;</text>
						</paragraph><paragraph id="H4310D6B30F2F4B93B64FB02103C70916"><enum>(13)</enum><text>there is an
				ongoing threat to the Lake Tahoe Basin of the introduction and establishment of
				other invasive species (such as the zebra mussel, New Zealand mud snail, and
				quagga mussel);</text>
						</paragraph><paragraph id="H158D2063A52841D4A5E89A7A6FF381DB"><enum>(14)</enum><text>the report
				prepared by the University of California, Davis, entitled the <quote>State of
				the Lake Report</quote>, found that conditions in the Lake Tahoe Basin had
				changed, including—</text>
							<subparagraph id="HB3E4A0BCB0DD411F98838FAA667506AF"><enum>(A)</enum><text>the average
				surface water temperature of Lake Tahoe has risen by more than 1.5 degrees
				Fahrenheit in the past 37 years; and</text>
							</subparagraph><subparagraph id="HBC31082FDB624DAA9EC0416B6C697380"><enum>(B)</enum><text>since 1910, the
				percent of precipitation that has fallen as snow in the Lake Tahoe Basin
				decreased from 52 percent to 34 percent;</text>
							</subparagraph></paragraph><paragraph id="H38375066BF444588B66D356BAB48CC58"><enum>(15)</enum><text>75 percent of the
				land in the Lake Tahoe Basin is owned by the Federal Government, which makes it
				a Federal responsibility to restore environmental health to the Basin;</text>
						</paragraph><paragraph id="H64BA8B0803FD406EA1492A230AA3BEEE"><enum>(16)</enum><text>the Federal
				Government has a long history of environmental preservation at Lake Tahoe,
				including—</text>
							<subparagraph id="H5C7426C673AD48CAB2387EA520F60BDF"><enum>(A)</enum><text>congressional
				consent to the establishment of the Tahoe Regional Planning Agency with—</text>
								<clause id="H37AC47742E554CD9934D8990110B982E"><enum>(i)</enum><text>the enactment in
				1969 of Public Law 91–148 (83 Stat. 360); and</text>
								</clause><clause id="H5B30E7A644584B80AFE041F7E0D5827B"><enum>(ii)</enum><text>the enactment in
				1980 of Public Law 96–551 (94 Stat. 3233);</text>
								</clause></subparagraph><subparagraph id="H3B5415B822EE4F07ABA549D989401741"><enum>(B)</enum><text>the establishment
				of the Lake Tahoe Basin Management Unit in 1973;</text>
							</subparagraph><subparagraph id="H889BE40FA1784EF0A2F725FB8FA896FF"><enum>(C)</enum><text>the enactment of
				Public Law 96–586 (94 Stat. 3381) in 1980 to provide for the acquisition of
				environmentally sensitive land and erosion control grants in the Lake Tahoe
				Basin;</text>
							</subparagraph><subparagraph id="HB78E5F9ED0B54395B15068FABD10E307"><enum>(D)</enum><text>the enactment of
				sections 341 and 342 of the Department of the Interior and Related Agencies
				Appropriations Act, 2004 (Public Law 108–108; 117 Stat. 1317), which amended
				the Southern Nevada Public Land Management Act of 1998 (Public Law 105–263; 112
				Stat. 2346) to provide payments for the environmental restoration projects
				under this Act; and</text>
							</subparagraph><subparagraph id="H59B9EF74433E49088194100BBBC9A728"><enum>(E)</enum><text>the enactment of
				section 382 of the Tax Relief and Health Care Act of 2006 (Public Law 109–432;
				120 Stat. 3045), which amended the Southern Nevada Public Land Management Act
				of 1998 (Public Law 105–263; 112 Stat. 2346) to authorize development and
				implementation of a comprehensive 10-year hazardous fuels and fire prevention
				plan for the Lake Tahoe Basin;</text>
							</subparagraph></paragraph><paragraph id="H995A04EC761E49F9A00753935059AEAF"><enum>(17)</enum><text>the Assistant
				Secretary of the Army for Civil Works was an original signatory in 1997 to the
				Agreement of Federal Departments on Protection of the Environment and Economic
				Health of the Lake Tahoe Basin;</text>
						</paragraph><paragraph id="H633F8570BAAD4EC89390A011ED691ED5"><enum>(18)</enum><text>the Chief of
				Engineers, under direction from the Assistant Secretary of the Army for Civil
				Works, has continued to be a significant contributor to Lake Tahoe Basin
				restoration, including—</text>
							<subparagraph id="HD55E56BE7AEB427889034532D3B3350D"><enum>(A)</enum><text>stream and wetland
				restoration;</text>
							</subparagraph><subparagraph id="H5C819EC37CE144979D827138FEA451DA"><enum>(B)</enum><text>urban stormwater
				conveyance and treatment; and</text>
							</subparagraph><subparagraph id="HD5321DF767FC404583DEADFD39D81E34"><enum>(C)</enum><text>programmatic
				technical assistance;</text>
							</subparagraph></paragraph><paragraph id="H2BCAF6C724CC41F5923878FA5EC21627"><enum>(19)</enum><text>at the Lake Tahoe
				Presidential Forum in 1997, the President renewed the commitment of the Federal
				Government to Lake Tahoe by—</text>
							<subparagraph id="H2D6FFED204104D909EB43C8BF081C8EE"><enum>(A)</enum><text>committing to
				increased Federal resources for environmental restoration at Lake Tahoe;
				and</text>
							</subparagraph><subparagraph id="H05CBFEB39CE24BA9906DAA60493F261D"><enum>(B)</enum><text>establishing the
				Federal Interagency Partnership and Federal Advisory Committee to consult on
				natural resources issues concerning the Lake Tahoe Basin;</text>
							</subparagraph></paragraph><paragraph id="H9B37EDC3C9C94B2DBA5AED998E14CDF5"><enum>(20)</enum><text>at the 2008 and
				2009 Lake Tahoe Forums, Senator Reid, Senator Feinstein, Senator Ensign, and
				Governor Gibbons—</text>
							<subparagraph id="H8E0918500BC34EE5A5A6EDBC4FF5EF5C"><enum>(A)</enum><text>renewed their
				commitment to Lake Tahoe; and</text>
							</subparagraph><subparagraph id="H4A0211AB91D24D4C8D06C4B6C9C86CC1"><enum>(B)</enum><text>expressed their
				desire to fund the Federal share of the Environmental Improvement Program
				through 2018;</text>
							</subparagraph></paragraph><paragraph id="HBA82A78819124C5287127DBA420CF83E"><enum>(21)</enum><text>since 1997, the
				Federal Government, the States of California and Nevada, units of local
				government, and the private sector have contributed more than $1,430,000,000 to
				the Lake Tahoe Basin, including—</text>
							<subparagraph id="H3AE61473898F4A1A80512ED236AF369A"><enum>(A)</enum><text>$424,000,000 from
				the Federal Government;</text>
							</subparagraph><subparagraph id="H80A1F1BDE5964B2BBBF27897F67B1412"><enum>(B)</enum><text>$612,000,000 from
				the State of California;</text>
							</subparagraph><subparagraph id="H6A6B718802C14A17B09ADF7B0EE6CF08"><enum>(C)</enum><text>$87,000,000 from
				the State of Nevada;</text>
							</subparagraph><subparagraph id="H7CD9F3EB8CE349529CE37735D1372CF1"><enum>(D)</enum><text>$59,000,000 from
				units of local government; and</text>
							</subparagraph><subparagraph id="H0E3EB4EB3C834768BFD60BDEB004107B"><enum>(E)</enum><text>$249,000,000 from
				private interests;</text>
							</subparagraph></paragraph><paragraph id="H04B2105D28A24A56A697629B831A734A"><enum>(22)</enum><text>significant
				additional investment from Federal, State, local, and private sources is
				necessary—</text>
							<subparagraph id="H6D2A4FD1CCB54007A76C8EFF3B7672CE"><enum>(A)</enum><text>to restore and
				sustain the environmental health of the Lake Tahoe Basin;</text>
							</subparagraph><subparagraph id="H35808A448ED844AB810005BCCC363756"><enum>(B)</enum><text>to adapt to the
				impacts of changing climatic conditions; and</text>
							</subparagraph><subparagraph id="H4CF01A6DB62845A39070B804D47E12E5"><enum>(C)</enum><text>to protect the
				Lake Tahoe Basin from the introduction and establishment of invasive species;
				and</text>
							</subparagraph></paragraph><paragraph id="H4A21F500346E4BDDA3416DEFFE774F38"><enum>(23)</enum><text>the Secretary has
				indicated that the Lake Tahoe Basin Management Unit has the capacity for at
				least $10,000,000 and up to $20,000,000 annually for the Fire Risk Reduction
				and Forest Management Program.</text>
						</paragraph></subsection><subsection id="HC3C3E7BF66924C6880D2105D609D8CAB"><enum>(b)</enum><header>Purposes</header><text display-inline="yes-display-inline">The purposes of this Act are—</text>
						<paragraph id="H242777A75599430690B42CE29396A346"><enum>(1)</enum><text>to enable the
				Chief of the Forest Service, the Director of the United States Fish and
				Wildlife Service, and the Administrator of the Environmental Protection Agency,
				in cooperation with the Planning Agency and the States of California and
				Nevada, to fund, plan, and implement significant new environmental restoration
				activities and forest management activities to address in the Lake Tahoe Basin
				the issues described in paragraphs (4) through (14) of subsection (a);</text>
						</paragraph><paragraph id="HC4FCC29EB6CA44E6AA6B6C9A981D852B"><enum>(2)</enum><text>to ensure that
				Federal, State, local, regional, tribal, and private entities continue to work
				together to manage land in the Lake Tahoe Basin and to coordinate on other
				activities in a manner that supports achievement and maintenance of—</text>
							<subparagraph id="H9CF59731C7D6476190117D94F160C6A2"><enum>(A)</enum><text>the environmental
				threshold carrying capacities for the region; and</text>
							</subparagraph><subparagraph id="H82ECD04004664D0589C3C201B0B007E1"><enum>(B)</enum><text>other applicable
				environmental standards and objectives;</text>
							</subparagraph></paragraph><paragraph id="H185AA39303774611AAA37F6A49BE8029"><enum>(3)</enum><text>to support local
				governments in efforts related to environmental restoration, stormwater
				pollution control, fire risk reduction, and forest management activities;
				and</text>
						</paragraph><paragraph id="H6A397D97A9E14B3FB304C1F844957F38"><enum>(4)</enum><text>to ensure that
				agency and science community representatives in the Lake Tahoe Basin work
				together—</text>
							<subparagraph id="H37F9E7C287BB4CB6B6C2A016C2202B2D"><enum>(A)</enum><text>to develop and
				implement a plan for integrated monitoring, assessment, and applied research to
				evaluate the effectiveness of the Environmental Improvement Program; and</text>
							</subparagraph><subparagraph id="HBFBA8F11088F44D29247936909170710"><enum>(B)</enum><text>to provide
				objective information as a basis for ongoing decisionmaking, with an emphasis
				on decisionmaking relating to public and private land use and resource
				management in the
				Basin.</text>
							</subparagraph></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section id="HEE76808EC1B245519F89BB10205916C9"><enum>3.</enum><header>Definitions</header><text display-inline="no-display-inline">The Lake Tahoe Restoration Act (Public Law
			 106–506; 114 Stat. 2351) is amended by striking section 3 and inserting the
			 following:</text>
			<quoted-block display-inline="no-display-inline" id="H065AFF8BA740493DB7CCE7FC77802D62" style="OLC">
				<section id="H5F0E5F1B9D19448298090D9EAA30F101"><enum>3.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text>
					<paragraph id="HE8D67AAA76F64212A144158F227C3E2B"><enum>(1)</enum><header>Administrator</header><text>The
				term <term>Administrator</term> means the Administrator of the Environmental
				Protection Agency.</text>
					</paragraph><paragraph id="H66E60E184204496EA9209340FAB48FE9"><enum>(2)</enum><header>Assistant
				secretary</header><text>The term <quote>Assistant Secretary</quote> means the
				Assistant Secretary of the Army for Civil Works.</text>
					</paragraph><paragraph id="HB6497C9CE9124747B53CCB48317AAAE8"><enum>(3)</enum><header>Chair</header><text>The
				term <term>Chair</term> means the Chair of the Federal Partnership.</text>
					</paragraph><paragraph id="H17F0149895524E5A8EA4A1EF1A39262F"><enum>(4)</enum><header>Compact</header><text>The
				term <quote>Compact</quote> means the Tahoe Regional Planning Compact included
				in the first section of Public Law 96–551 (94 Stat. 3233).</text>
					</paragraph><paragraph id="H846D587BFEC042DE815CA7137AA1EF9C"><enum>(5)</enum><header>Director</header><text>The
				term <term>Director</term> means the Director of the United States Fish and
				Wildlife Service.</text>
					</paragraph><paragraph id="H421E05A1528A44F9B1B6BFEF153B2AD4"><enum>(6)</enum><header>Environmental
				improvement program</header><text>The term <term>Environmental Improvement
				Program</term> means—</text>
						<subparagraph id="H5883969CEE3340D9844C7B338AF2D446"><enum>(A)</enum><text>the Environmental
				Improvement Program adopted by the Planning Agency; and</text>
						</subparagraph><subparagraph id="H6E3010E23D2D4F4293EA4ACB73D7A7D1"><enum>(B)</enum><text>any amendments to
				the Program.</text>
						</subparagraph></paragraph><paragraph id="HD4DD1A3E85A14852A0E494498D5731FC"><enum>(7)</enum><header>Environmental
				threshold carrying capacity</header><text>The term <term>environmental
				threshold carrying capacity</term> has the meaning given the term in article II
				of the compact.</text>
					</paragraph><paragraph id="H28EE09CB863543F79261E1BE0438583F"><enum>(8)</enum><header>Federal
				partnership</header><text>The term <term>Federal Partnership</term> means the
				Lake Tahoe Federal Interagency Partnership established by Executive Order 13957
				(62 Fed. Reg. 41249) (or a successor Executive order).</text>
					</paragraph><paragraph id="H5BD61DDEDD964088B79A53A2F4A5127D"><enum>(9)</enum><header>Forest
				management activity</header><text>The term <quote>forest management
				activity</quote> includes—</text>
						<subparagraph id="HED30DB16926B4A189BC21D20C8FE1A40"><enum>(A)</enum><text>prescribed burning
				for ecosystem health and hazardous fuels reduction;</text>
						</subparagraph><subparagraph id="HD8ED1C36BC234BD7A5F98FFD192A00E8"><enum>(B)</enum><text>mechanical and
				minimum tool treatment;</text>
						</subparagraph><subparagraph id="H505166CCFF534EE79472486011967ED8"><enum>(C)</enum><text>road
				decommissioning or reconstruction;</text>
						</subparagraph><subparagraph id="H2237D14C6DBB4D8DBCC306E04C08EB46"><enum>(D)</enum><text>stream environment
				zone restoration and other watershed and wildlife habitat enhancements;</text>
						</subparagraph><subparagraph id="H99E5763BDBC142859286D594C88B8E50"><enum>(E)</enum><text>nonnative invasive
				species management; and</text>
						</subparagraph><subparagraph id="H25F667538DE4466DA20924BCAF32BA8E"><enum>(F)</enum><text>other activities
				consistent with Forest Service practices, as the Secretary determines to be
				appropriate.</text>
						</subparagraph></paragraph><paragraph id="HC3CD4945DB994391BA5E8B6C260FD13F"><enum>(10)</enum><header>National
				wildland fire code</header><text>The term <term>national wildland fire
				code</term> means—</text>
						<subparagraph id="HCC54210C584E4613AF81F1465D203E42"><enum>(A)</enum><text>the most recent
				publication of the National Fire Protection Association code numbered 1141,
				1142, or 1144;</text>
						</subparagraph><subparagraph id="HE70CC2704F4C4EA68C20FBD98376B388"><enum>(B)</enum><text>the most recent
				publication of the International Wildland-Urban Interface Code of the
				International Code Council; or</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HF4D674ED415048AEB841F59DE3A075CB"><enum>(C)</enum><text>any other code
				that the Secretary determines provides the same, or better, standards for
				protection against wildland fire as a code described in subparagraph (A) or
				(B).</text>
						</subparagraph></paragraph><paragraph id="H3239F45CB79E4897A3756B1545DBFA79"><enum>(11)</enum><header>Planning
				agency</header><text>The term <term>Planning Agency</term> means the Tahoe
				Regional Planning Agency established under Public Law 91–148 (83 Stat. 360) and
				Public Law 96–551 (94 Stat. 3233).</text>
					</paragraph><paragraph id="H471767089A07450D8473230EE2DD1919"><enum>(12)</enum><header>Priority
				list</header><text>The term <term>Priority List</term> means the environmental
				restoration priority list developed under section 8.</text>
					</paragraph><paragraph id="H57AD5661E4B34CD0800CEF449B372C4F"><enum>(13)</enum><header>Secretary</header><text>The
				term <term>Secretary</term> means the Secretary of Agriculture, acting through
				the Chief of the Forest Service.</text>
					</paragraph><paragraph id="H6921F633209E401A966DCAC9BD8885FC"><enum>(14)</enum><header>Total maximum
				daily load</header><text>The term <term>total maximum daily load</term> means
				the total maximum daily load allocations adopted under section 303(d) of the
				Federal Water Pollution Control Act (33 U.S.C. 1313(d)).</text>
					</paragraph><paragraph id="HB45CA4F6832D434E8D15D3F5A648E1F9"><enum>(15)</enum><header>Stream
				Environment Zone</header><text>The term <term>Stream Environment Zone</term>
				means an area that generally owes the biological and physical characteristics
				of the area to the presence of surface water or groundwater.</text>
					</paragraph><paragraph id="H9A25DEC2E9F14B17BBCAFE3DBE133A1D"><enum>(16)</enum><header>Watercraft</header><text>The
				term <term>watercraft</term> means all motorized and non-motorized watercraft,
				including boats, personal watercraft, kayaks, and
				canoes.</text>
					</paragraph></section><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section id="H443A094D579447A5BE35589E1490446A"><enum>4.</enum><header>Administration of
			 the lake tahoe basin management unit</header><text display-inline="no-display-inline">Section 4 of the Lake Tahoe Restoration Act
			 (Public Law 106–506; 114 Stat. 2353) is amended—</text>
			<paragraph id="H65DE28BB01B14843804DE2A4828E78F8"><enum>(1)</enum><text display-inline="yes-display-inline">in subsection (b)(3), by striking
			 <quote>basin</quote> and inserting <quote>Basin</quote>; and</text>
			</paragraph><paragraph id="HAAC40A48506A4D0F9EB78B4A75B15B0F"><enum>(2)</enum><text display-inline="yes-display-inline">by adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="H1741E8C53AAB46B58105E49B69DA22AD" style="OLC">
					<subsection id="H2CC5DC22A02C46EB9B6B68FCB4581FDD"><enum>(c)</enum><header>Transit</header>
						<paragraph id="H8C8B09A286694EB09034B8AFCFB79E4F"><enum>(1)</enum><header>In
				general</header><text>The Lake Tahoe Basin Management Unit shall, consistent
				with the regional transportation plan adopted by the Planning Agency, manage
				vehicular parking and traffic in the Lake Tahoe Basin Management Unit, with
				priority given—</text>
							<subparagraph id="H1B446AE64707458EBA7C859F633C8B76"><enum>(A)</enum><text>to improving
				public access to the Lake Tahoe Basin, including the prioritization of
				alternatives to the private automobile, consistent with the requirements of the
				Compact;</text>
							</subparagraph><subparagraph id="HB9FD06C209504FB9930D10040F76CA11"><enum>(B)</enum><text>to coordinating
				with the Nevada Department of Transportation, Caltrans, State parks, and other
				entities along Nevada Highway 28 and California Highway 89; and</text>
							</subparagraph><subparagraph id="H8640A0E90962473396FA0E414A05E7F0"><enum>(C)</enum><text>to providing
				support and assistance to local public transit systems in the management and
				operations of activities under this subsection.</text>
							</subparagraph></paragraph><paragraph commented="no" id="H20C75B0911074BBD94D65AC02C37EBEC"><enum>(2)</enum><header>National forest
				transit program</header><text>Consistent with the support and assistance
				provided under paragraph (1)(C), the Secretary, in consultation with the
				Secretary of Transportation, may enter into a contract, cooperative agreement,
				interagency agreement, or other agreement with the Department of Transportation
				to secure operating and capital funds from the National Forest Transit
				Program.</text>
						</paragraph></subsection><subsection id="H0F13CA22E0B34645988948FE5BE8C0C7"><enum>(d)</enum><header>Forest
				management activities</header>
						<paragraph id="HE37480CAE5A148C0A28321692D3772CB"><enum>(1)</enum><header>Coordination</header>
							<subparagraph id="HE95047274A044DBD83114B7043136A6A"><enum>(A)</enum><header>In
				general</header><text>In conducting forest management activities in the Lake
				Tahoe Basin Management Unit, the Secretary shall, as appropriate, coordinate
				with the Administrator and State and local agencies and organizations,
				including local fire departments and volunteer groups.</text>
							</subparagraph><subparagraph id="H1287B585551344F4A37893CCC6098DD6"><enum>(B)</enum><header>Goals</header><text>The
				coordination of activities under subparagraph (A) should aim to increase
				efficiencies and maximize the compatibility of management practices across
				public property boundaries.</text>
							</subparagraph></paragraph><paragraph id="H526350DB5C4E43CBA37B296EEFE0F5B4"><enum>(2)</enum><header>Multiple
				benefits</header>
							<subparagraph id="HA6E513A05E0040FF965D3EA03F852EDD"><enum>(A)</enum><header>In
				general</header><text>In conducting forest management activities in the Lake
				Tahoe Basin Management Unit, the Secretary shall conduct the activities in a
				manner that—</text>
								<clause id="H233D8EA0953D41C68C8D1EC58C9A6569"><enum>(i)</enum><text>except as provided
				in subparagraph (B), attains multiple ecosystem benefits, including—</text>
									<subclause id="H10DEBB7E95D64D80A5126AD258AC3CC3"><enum>(I)</enum><text>reducing forest
				fuels;</text>
									</subclause><subclause id="H368C4CDD62FB438CAFADE8B4C6283C7B"><enum>(II)</enum><text>maintaining or
				restoring biological diversity;</text>
									</subclause><subclause id="H210DF487EFE342AB87C15B1B54CD51DE"><enum>(III)</enum><text>improving
				wetland and water quality, including in Stream Environment Zones; and</text>
									</subclause><subclause id="HBB27E7D589F54AE291AC199BA17C2FBE"><enum>(IV)</enum><text>increasing
				resilience to changing climatic conditions; and</text>
									</subclause></clause><clause id="HC4E9FE0DA7674CDC8E61E3430B5E207A"><enum>(ii)</enum><text>helps achieve and
				maintain the environmental threshold carrying capacities established by the
				Planning Agency.</text>
								</clause></subparagraph><subparagraph id="H1DBC6419D26A46F3902E394D0C5BC079"><enum>(B)</enum><header>Exception</header><text>Notwithstanding
				clause (A)(i), the attainment of multiple ecosystem benefits shall not be
				required if the Secretary determines that management for multiple ecosystem
				benefits would excessively increase the cost of a project in relation to the
				additional ecosystem benefits gained from the management activity.</text>
							</subparagraph></paragraph><paragraph id="HDC86B261F7544D75A4C78F093127F9EE"><enum>(3)</enum><header>Ground
				disturbance</header><text>Consistent with applicable Federal law and Lake Tahoe
				Basin Management Unit land and resource management plan direction, the
				Secretary shall—</text>
							<subparagraph id="H605A88F8E0F548ED9B6229610BBC880B"><enum>(A)</enum><text>establish
				post-project ground condition criteria for ground disturbance caused by forest
				management activities; and</text>
							</subparagraph><subparagraph id="H25A76F671AA34BEBB62BDFFDA4CB4283"><enum>(B)</enum><text>provide for
				monitoring to ascertain the attainment of the post-project conditions.</text>
							</subparagraph></paragraph></subsection><subsection id="HA4285DC0F2D34F7D8923EA7C6B17023A"><enum>(e)</enum><header>Withdrawal of
				Federal land</header>
						<paragraph id="HA54A1AC37EBE4EAD89AD3A3F496797E5"><enum>(1)</enum><header>In
				general</header><text>Subject to valid existing rights and paragraph (2), the
				Federal land located in the Lake Tahoe Basin Management Unit is withdrawn
				from—</text>
							<subparagraph id="H196FD5F6253C4249958D062386194B8A"><enum>(A)</enum><text>all forms of
				entry, appropriation, or disposal under the public land laws;</text>
							</subparagraph><subparagraph id="HCD2B05DE9EBE4C2E9DE2815807246175"><enum>(B)</enum><text>location, entry,
				and patent under the mining laws; and</text>
							</subparagraph><subparagraph id="H43583EA2EC6447B3A105C0EBE781DD46"><enum>(C)</enum><text>disposition under
				all laws relating to mineral and geothermal leasing.</text>
							</subparagraph></paragraph><paragraph id="H6B3D1905AA8447C3974EECA5BDD201E7"><enum>(2)</enum><header>Determination</header>
							<subparagraph id="H28D4B036713D4FFB97702AC1D3B4A094"><enum>(A)</enum><header>In
				general</header><text>The withdrawal under paragraph (1) shall be in effect
				until the date on which the Secretary, after conducting a review of all Federal
				land in the Lake Tahoe Basin Management Unit and receiving public input, has
				made a determination on which parcels of Federal land should remain
				withdrawn.</text>
							</subparagraph><subparagraph id="H960BAF0183954484AF5C911853708448"><enum>(B)</enum><header>Requirements</header><text>The
				determination of the Secretary under subparagraph (A)—</text>
								<clause id="H3997CF4862C7463292BA1E92C348CF81"><enum>(i)</enum><text>shall be effective
				beginning on the date on which the determination is issued;</text>
								</clause><clause id="HC7B0A94652344B9FA474843CE035D51F"><enum>(ii)</enum><text>may be altered by
				the Secretary as the Secretary determines to be necessary; and</text>
								</clause><clause id="H18C19B06C008469089A40DD58726D5DE"><enum>(iii)</enum><text>shall not be
				subject to administrative renewal.</text>
								</clause></subparagraph></paragraph></subsection><subsection id="HAD1144E654FD425CA3F6E828F150EFD7"><enum>(f)</enum><header>Environmental
				threshold carrying capacity</header><text display-inline="yes-display-inline">The Lake Tahoe Basin Management Unit shall
				support the attainment of the environmental threshold carrying
				capacities.</text>
					</subsection><subsection id="HB94760C5411C4F139E0DDDCC30675340"><enum>(g)</enum><header>Cooperative
				authorities</header>
						<paragraph id="HCC20EFD852204730A5B14CEEAE1AFC2F"><enum>(1)</enum><header>In
				general</header><text>During the 4 fiscal years following the date of enactment
				of the Lake Tahoe Restoration Act of 2009, the Secretary, in conjunction with
				land adjustment projects or programs, may enter into contracts and cooperative
				agreements with States, units of local government, and other public and private
				entities to provide for fuel reduction, erosion control, reforestation, Stream
				Environment Zone restoration, and similar management activities on Federal land
				and non-Federal land within the projects or programs.</text>
						</paragraph><paragraph id="H2866CC8E69A944F48B65BD878DB30C7D"><enum>(2)</enum><header>Report on Land
				Status</header>
							<subparagraph id="HE17D364CB0B740A0882E38F9C41E811E"><enum>(A)</enum><header>In
				general</header><text>Not later than 2 years after the date of enactment of the
				Lake Tahoe Restoration Act of 2009, the Secretary shall submit to Congress a
				report regarding the management of land in the Lake Tahoe Basin Management Unit
				Urban Lots Program, including—</text>
								<clause id="HA71A09F3889448ACA57C084BF5E7A283"><enum>(i)</enum><text>a
				description of future plans and recent actions for land consolidation and
				adjustment; and</text>
								</clause><clause id="H36EF2C3BFDC24D2B94C759C79B83EB44"><enum>(ii)</enum><text>the
				identification of any obstacles to desired conveyances or interchanges.</text>
								</clause></subparagraph><subparagraph id="HCCA393E6309548A685A4F0995A65DC1C"><enum>(B)</enum><header>Inclusions</header><text>The
				report submitted under subparagraph (A) may contain recommendations for
				additional legislative authority.</text>
							</subparagraph><subparagraph id="H4604FE63FE1144A3855C96B13351FD1B"><enum>(C)</enum><header>Effect</header><text>Nothing
				in this paragraph delays the conveyance of parcels under—</text>
								<clause id="H6BA81997C96C4D01ACA44935C5D64182"><enum>(i)</enum><text>the authority of
				this Act; or</text>
								</clause><clause id="HFC7D3943B25048A0B2BF0D13BDFC86C1"><enum>(ii)</enum><text>any other
				authority available to the Secretary.</text>
								</clause></subparagraph></paragraph><paragraph id="H259B6660FE0E42C6AE8A71DA354D6339"><enum>(3)</enum><header>Supplemental
				authority</header><text>The authority of this subsection is supplemental to all
				other cooperative authorities of the
				Secretary.</text>
						</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</paragraph></section><section id="HF74B14FD623C4EBEAA08F63476565229"><enum>5.</enum><header>Consultation</header><text display-inline="no-display-inline">The Lake Tahoe Restoration Act (Public Law
			 106–506; 114 Stat. 2351) is amended by striking section 5 and inserting the
			 following:</text>
			<quoted-block display-inline="no-display-inline" id="HAD9A6A125D4A4263992F185EF84412DB" style="OLC">
				<section id="H17FF73CC07C04554878A1A8E390AA135"><enum>5.</enum><header>Consultation</header><text display-inline="no-display-inline">In carrying out this Act, the Secretary, the
				Administrator, and the Director shall, as appropriate and in a timely manner,
				consult with the heads of the Washoe Tribe, applicable Federal, State,
				regional, and local governmental agencies, and the Lake Tahoe Federal Advisory
				Committee.</text>
				</section><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section id="H8F91D6B990F14E62843B7EC5BBF7CB19"><enum>6.</enum><header>Authorized
			 projects</header><text display-inline="no-display-inline">The Lake Tahoe
			 Restoration Act (Public Law 106–506; 114 Stat. 2351) is amended by striking
			 section 6 and inserting the following:</text>
			<quoted-block display-inline="no-display-inline" id="H0462136E79864A32A0E9BF9D3A4CF2D8" style="OLC">
				<section id="HC44961F5A9C245ECAAC7A97B1E0FC38E"><enum>6.</enum><header>Authorized
				projects</header>
					<subsection id="H36CF23D05F544DE5B0392447AE4B7B0E"><enum>(a)</enum><header>In
				general</header><text>The Secretary, the Director, and the Administrator, in
				coordination with the Planning Agency and the States of California and Nevada,
				may carry out any project described in subsection (c) or included in the
				Priority List under section 8 to further the purposes of the Environmental
				Improvement Program if the project has been subject to environmental review and
				approval, respectively, as required under Federal law, article 7 of the
				Compact, and State law, as applicable.</text>
					</subsection><subsection id="H42C23AFB730848B7B63310BC6FBEDE54"><enum>(b)</enum><header>Monitoring and
				assessment</header><text>All projects authorized under subsection (c) and
				section 8 shall—</text>
						<paragraph id="H9F058AD95D1B4BF0BE382576194B6823"><enum>(1)</enum><text>include funds for
				monitoring and assessment of the results and effectiveness at the project and
				program level consistent with the program developed under section 11;
				and</text>
						</paragraph><paragraph id="H951C04F401914C9AB52F9F2C555BA3E3"><enum>(2)</enum><text>use the integrated
				multiagency performance measures established in the science program developed
				under that section.</text>
						</paragraph></subsection><subsection id="HF299F8B8D3CF491B9F9E928D9F4E039B"><enum>(c)</enum><header>Description of
				activities</header>
						<paragraph id="HDBBCADF29F52484EA697BDA30DD5CFE4"><enum>(1)</enum><header>Stormwater
				management, erosion control, and total maximum daily load
				implementation</header><text>Of the amounts made available under section 18(a),
				$40,000,000 shall be used for the Federal share of the following

							<subparagraph id="HD62061FE393B4332AB0A3198D28CC912"><enum>(A)</enum><header>In
				general</header><text>Of the amounts made available under section 18(a),
				$136,000,000 shall be made available for the following projects:</text>
								<clause id="H0249D930D3BF4CDFA70C100DCF7BEA8B"><enum>(i)</enum><text>Projects
				identified as part of the Lake Tahoe Basin Multi-Jurisdictional Fuel Reduction
				and Wildfire Prevention Strategy 10-Year Plan.</text>
								</clause><clause id="H84121B313B0B49609C81359384F93C24"><enum>(ii)</enum><text>Competitive
				grants for fuels work to be awarded by the Secretary to communities that have
				adopted national wildland fire codes to implement the applicable portion of the
				10-year plan described in clause (i).</text>
								</clause><clause id="H29042FFA4F7B4342B578DB968A13F4FA"><enum>(iii)</enum><text>Biomass
				projects, including feasibility assessments and transportation of
				materials.</text>
								</clause><clause id="HD284D2CAFAE94DA0B4B4C456F7A63594"><enum>(iv)</enum><text>Angora Fire
				Restoration projects under the jurisdiction of the Secretary.</text>
								</clause></subparagraph><subparagraph id="H1CCF29A0C02D4FCB939DAC2B1E16692C"><enum>(B)</enum><header>Multiple benefit
				fuels projects</header><text>Consistent with the requirements of section
				4(d)(2), not more than $10,000,000 of the amounts made available to carry out
				subparagraph (A) shall be available to the Secretary for the planning and
				implementation of multiple benefit fuels projects with an emphasis on
				restoration projects in Stream Environment Zones.</text>
							</subparagraph><subparagraph id="HB62543D98A8E442ABC79E7FC28DD57AA"><enum>(C)</enum><header>Minimum
				allocation</header><text>Of the amounts made available to carry out
				subparagraph (A), at least $80,000,000 shall be made available to the Secretary
				for projects under subparagraph (A)(i).</text>
							</subparagraph><subparagraph id="H35AAE07C7CA44852BCEB6491F3058328"><enum>(D)</enum><header>Priority</header><text>Units
				of local government that have dedicated funding for inspections and enforcement
				of defensible space regulations shall be given priority for amounts provided
				under this paragraph.</text>
							</subparagraph><subparagraph id="H422B3F7590584F9AA9B7A76CB310CD64"><enum>(E)</enum><header>Cost-sharing
				requirements</header><text>As a condition on the receipt of funds, communities
				or local fire districts that receive funds under this paragraph shall provide a
				25 percent match.</text>
							</subparagraph></paragraph><paragraph id="H5C02EF45DE364F3D9F6BCE1136BEF042"><enum>(4)</enum><header>Invasive species
				management</header><text>Of the amounts to be made available under section
				18(a), $20,500,000 shall be made available for the Aquatic Invasive Species
				Program and the watercraft inspections described in section 9.</text>
						</paragraph><paragraph id="H7F7FC1954BB848799A95CD6280EA5D03"><enum>(5)</enum><header>Special status
				species management</header><text>Of the amounts to be made available under
				section 18(a), $20,000,000 shall be made available for the Lahontan Cutthroat
				Trout Recovery Program.</text>
						</paragraph><paragraph id="H0FA2E124575E4D938DF8F3315FFE043A"><enum>(6)</enum><header>Science</header><text>Of
				the amounts to be made available under section 18(a), $30,000,000 shall be used
				to develop and implement the science program developed under section 11.</text>
						</paragraph></subsection><subsection id="HD206807D2F454C0196C832173244D318"><enum>(d)</enum><header>Use of remaining
				funds</header><text>Any amounts made available under section 18(a) that remain
				available after projects described in subsection (c) have been funded shall be
				made available for projects included in the Priority List under section
				8.</text>
					</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section id="H1C2EA3328CDA4733B683A2AF6D6B2C29"><enum>7.</enum><header>Environmental
			 restoration priority list</header><text display-inline="no-display-inline">The
			 Lake Tahoe Restoration Act (Public Law 106–506; 114 Stat. 2351) is
			 amended—</text>
			<paragraph id="H2788AC9EF51A4DFB93841353131048BF"><enum>(1)</enum><text>by striking
			 sections 8 and 9;</text>
			</paragraph><paragraph id="HF51498E2EC124443895E0862AE7AD5DC"><enum>(2)</enum><text display-inline="yes-display-inline">by redesignating sections 10, 11, and 12 as
			 sections 16, 17, and 18, respectively; and</text>

				least $136,000,000 shall be made available for projects identified on the
				Priority List.</text>
						</subsection><subsection id="H119B9FC1707E4CA5B964D1772BAA1D4F"><enum>(b)</enum><header>Deadline</header><text>Not
				later than February 15 of the year after the date of enactment of the Lake
				Tahoe Restoration Act of 2009, the Chair, in consultation with the Secretary,
				the Administrator, the Director, the Planning Agency, the States of California
				and Nevada, the Federal Partnership, the Washoe Tribe, the Lake Tahoe Federal
				Advisory Committee, and the Tahoe Science Consortium shall submit to Congress a
				prioritized list of all Environmental Improvement Program projects for the Lake
				Tahoe Basin, regardless of program category.</text>
						</subsection><subsection id="H9CAF72E33D324C2E8ABA4A449CB432D4"><enum>(c)</enum><header>Criteria</header>
							<paragraph id="H2AE07ABC7FC44EA2831C24FA6452E1F2"><enum>(1)</enum><header>In
				general</header><text>The priority of projects included in the Priority List
				shall be based on the best available science and the following criteria:</text>
								<subparagraph id="H883A4BB9F47F4297A9BA4800DE9E74FB"><enum>(A)</enum><text>The 5-year
				threshold carrying capacity evaluation.</text>
								</subparagraph><subparagraph id="HC59D2BF6E2A44D3780DCE5D936DAD534"><enum>(B)</enum><text>The ability to
				measure progress or success of the project.</text>
								</subparagraph><subparagraph id="H463490373886478480824617C97E2A47"><enum>(C)</enum><text>The potential to
				significantly contribute to the achievement and maintenance of the
				environmental threshold carrying capacities identified in the Compact
				for—</text>
									<clause id="HBB0D7CF56B314953BDD4E1282C8F1992"><enum>(i)</enum><text>air
				quality;</text>
									</clause><clause id="HBD31448809434C43959BA1301F6EEF8D"><enum>(ii)</enum><text>fisheries;</text>
									</clause><clause id="H1491699433C34E838F947111D1223ECD"><enum>(iii)</enum><text>noise;</text>
									</clause><clause id="H43C997E0511742F2A95B73CCB4702048"><enum>(iv)</enum><text>recreation;</text>
									</clause><clause id="H2F8FAA8FC83D434084A90C9D4D427D54"><enum>(v)</enum><text>scenic
				resources;</text>
									</clause><clause id="HA08ACC1A903644AE9A90158083088D33"><enum>(vi)</enum><text>soil
				conservation;</text>
									</clause><clause id="H1E20C27E25DC4CC1AE30A32BCAF687C8"><enum>(vii)</enum><text>forest
				health;</text>
									</clause><clause id="HBD0589688CF34296BED5C6D0C0DA0AA4"><enum>(viii)</enum><text>water quality;
				and</text>
									</clause><clause id="H9A179F30D9FB4D2F83F3CF6E518C59CA"><enum>(ix)</enum><text>wildlife.</text>
									</clause></subparagraph><subparagraph id="HBFE16ED7B0024223B2D5288E652E7DF4"><enum>(D)</enum><text>The ability of a
				project to provide multiple benefits.</text>
								</subparagraph><subparagraph id="H5354CF20098947C58C6626A7123A135F"><enum>(E)</enum><text>The ability of a
				project to leverage non-Federal contributions.</text>
								</subparagraph><subparagraph id="HC64539BA7C9D423E85B62F8512F0E36D"><enum>(F)</enum><text>Stakeholder
				support for the project.</text>
								</subparagraph><subparagraph id="H91D6B0AF182E4F0A99041B85C89C6ACF"><enum>(G)</enum><text>The justification
				of Federal interest.</text>
								</subparagraph><subparagraph id="H7F291426A4B84B0B8897F383326D0DD4"><enum>(H)</enum><text>Agency

				history.</text>
								</subparagraph></paragraph><paragraph id="HCA632E575BCC41148F962C218B527D1B"><enum>(2)</enum><header>Secondary
				factors</header><text>In addition to the criteria under paragraph (1), the
				Chair shall, as the Chair determines to be appropriate, give preference to
				projects in the Priority List that benefit existing neighborhoods in the Basin
				that are at or below regional median income levels, based on the most recent
				census data available.</text>
							</paragraph><paragraph id="H4C6EADA3FC5846E483C1ADEA064FCFC7"><enum>(3)</enum><header>Erosion control
				projects</header><text>For purposes of the Priority List, erosion control
				projects shall be considered part of the stormwater management and total
				maximum daily load program of the Environmental Improvement Program.</text>
							</paragraph></subsection><subsection id="H71DD36904869414B9715FCC92FB74927"><enum>(d)</enum><header>Revisions</header>
							<paragraph id="H41FFD20BCDAE413493EE5CB1C08EA0D7"><enum>(1)</enum><header>In
				general</header><text>The Priority List submitted under subsection (b) shall be
				revised—</text>
								<subparagraph id="H7288AA06B80C41FE93FA1AD257805750"><enum>(A)</enum><text>every 4 years;
				or</text>
								</subparagraph><subparagraph id="H8FE748D85EA84EDFA629071ED9A43A35"><enum>(B)</enum><text>on a finding of
				compelling need under paragraph (2).</text>
								</subparagraph></paragraph><paragraph id="H25A6D1D2F28C4183ABA5DC204AEDD322"><enum>(2)</enum><header>Finding of
				compelling need</header>
								<subparagraph id="H8BE0931268C742A1895B005A9A8C18E3"><enum>(A)</enum><header>In
				general</header><text>If the Secretary, the Administrator, or the Director
				makes a finding of compelling need justifying a priority shift and the finding
				is approved by the Secretary, the Executive Director of the Planning Agency,
				the California Resources Secretary, and the Director of the Nevada Department
				of Conservation, the Priority List shall be revised in accordance with this
				subsection.</text>
								</subparagraph><subparagraph id="H3413B5F70813479E8D9548AE3CCBF83A"><enum>(B)</enum><header>Inclusions</header><text>A
				finding of compelling need includes—</text>
									<clause id="HD0FA82463B654E74B9350B8A20DD4AEE"><enum>(i)</enum><text>major scientific
				findings;</text>
									</clause><clause id="H99C3AFA4D5EA41A582030E0B4299DA6D"><enum>(ii)</enum><text>results from the
				threshold evaluation of the Planning Agency;</text>
									</clause><clause id="H14A236CCBAB24F7C85F1C1ED804642CD"><enum>(iii)</enum><text>emerging
				environmental threats; and</text>
									</clause><clause id="H67F2E780581941F196480152C975A43D"><enum>(iv)</enum><text>rare
				opportunities for land acquisition.</text>
									</clause></subparagraph></paragraph></subsection></section><section id="HD57351D460CD46D792CB8A0B002EE602"><enum>9.</enum><header>Aquatic invasive
				species prevention</header>
						<subsection id="H2A2CAF48F5254C5387A18ECC97C0EC3C"><enum>(a)</enum><header>In
				general</header><text>Not later than 60 days after the date of enactment of the
				Lake Tahoe Restoration Act of 2009, the Director, in coordination with the
				Planning Agency, the California Department of Fish and Game, and the Nevada
				Department of Wildlife, shall deploy strategies that meet or exceed the
				criteria described in subsection (b) for preventing the introduction of aquatic
				invasive species into the Lake Tahoe Basin.</text>
						</subsection><subsection id="H6670D5AA6E17482FAE059F09F5A94311"><enum>(b)</enum><header>Criteria</header><text>The
				strategies referred to in subsection (a) shall provide that—</text>
							<paragraph id="HBC84B8FB2F3B4D79A2D8779BC08840E4"><enum>(1)</enum><text>combined
				inspection and decontamination stations be established and operated at not less
				than 2 locations in the Lake Tahoe Basin;</text>
							</paragraph><paragraph id="H6714535939A444D6AAC48F18C26B4DFE"><enum>(2)</enum><text>watercraft not be
				allowed to launch in waters of the Lake Tahoe Basin if the watercraft—</text>
								<subparagraph id="HF5CA9D6EFDA14CCCB4DB2EF0D909169E"><enum>(A)</enum><text>has been in waters
				infested by quagga or zebra mussels;</text>
								</subparagraph><subparagraph id="H59FAA120BEB8478E9BD8AD4058B93C18"><enum>(B)</enum><text>shows evidence of
				invasive species that the Director has determined would be detrimental to the
				Lake Tahoe ecosystem; or</text>
								</subparagraph><subparagraph id="H36A42A76907047A58C6331BBEACF4BB6"><enum>(C)</enum><text>cannot be reliably
				decontaminated in accordance with paragraph (3);</text>
								</subparagraph></paragraph><paragraph id="HBCEAF4BAD11E4B63BBB2351802E66DEC"><enum>(3)</enum><text>subject to
				paragraph (4), all watercraft surfaces and appurtenance (such as anchors and
				fenders) that contact with water shall be reliably decontaminated, based on
				standards developed by the Director using the best available science;</text>
							</paragraph><paragraph id="HCFB73444B5B443D39D83EF6D4AAA6501"><enum>(4)</enum><text>watercraft bearing
				positive verification of having last launched within the Lake Tahoe Basin may
				be exempted from decontamination under paragraph (3); and</text>
							</paragraph><paragraph id="HA7712EDE1678419D85BC3550D1908FDA"><enum>(5)</enum><text>while in the Lake
				Tahoe Basin, all watercraft maintain documentation of compliance with the
				strategies deployed under this section.</text>
							</paragraph></subsection><subsection id="H4C127BFD25F14693A1D09D056B7A94E7"><enum>(c)</enum><header>Certification</header><text>The
				Director may certify State agencies to perform the decontamination activities
				described in subsection (b)(3) at locations outside the Lake Tahoe Basin if
				standards at the sites meet or exceed standards for similar sites in the Lake
				Tahoe Basin established under this section.</text>
						</subsection><subsection id="H3EDDF9F470D146E68555CF026D9ACA36"><enum>(d)</enum><header>Applicability</header><text>The
				strategies and criteria developed under this section shall apply to all
				watercraft to be launched on water within the Lake Tahoe Basin.</text>
						</subsection><subsection id="H5AD1B02F04F843F688A9EE2DCE5AA8F1"><enum>(e)</enum><header>Fees</header><text display-inline="yes-display-inline">The Director may collect and spend fees for
				decontamination only at a level sufficient to cover the costs of operation of
				inspection and decontamination stations under this section.</text>
						</subsection><subsection id="HA41E4476494F46898510190E0F464EE0"><enum>(f)</enum><header>Civil
				penalties</header>
							<paragraph id="H8C3CEFF62BA2453DB7516A704477EACA"><enum>(1)</enum><header>In
				general</header><text>Any person that launches, attempts to launch, or
				facilitates launching of watercraft not in compliance with strategies deployed
				under this section shall be liable for a civil penalty in an amount not to
				exceed $1,000 per violation.</text>
							</paragraph><paragraph id="H104B6CA6EA1E42DCBD34D2DA404A7A29"><enum>(2)</enum><header>Other
				authorities</header><text>Any penalties assessed under this subsection shall be
				separate from penalties assessed under any other authority.</text>
							</paragraph></subsection><subsection id="H1E6D1515917A48889FC5EA2371C5C89A"><enum>(g)</enum><header>Limitation</header><text display-inline="yes-display-inline">The strategies and criteria under
				subsections (a) and (b), respectively, may be modified if the Secretary of the
				Interior, in a nondelegable capacity and in consultation with the Planning
				Agency and State governments, issues a determination that alternative measures
				will be no less effective at preventing introduction of aquatic invasive
				species into Lake Tahoe than the strategies and criteria.</text>
						</subsection><subsection id="HA5BEEA04E2384ECBA6EE5837DB4193E0"><enum>(h)</enum><header>Funding</header><text display-inline="yes-display-inline">Of the amounts made available under section
				6(c)(4), not more than $500,000 shall be made available to the Director, in
				coordination with the Planning Agency and State governments—</text>
							<paragraph id="H8B97D887270E463FAD943DE53F266C4B"><enum>(1)</enum><text>to evaluate the
				feasibility, cost, and potential effectiveness of further efforts that could be
				undertaken by the Federal Government, State and local governments, or private
				entities to guard against introduction of aquatic invasive species into Lake
				Tahoe, including the potential establishment of inspection and decontamination
				stations on major transitways entering the Lake Tahoe Basin; and</text>
							</paragraph><paragraph id="HB6AECCF254BB46E3BAB55BF51EA77409"><enum>(2)</enum><text>to evaluate and
				identify options for ensuring that all waters connected to Lake Tahoe are
				protected from quagga and zebra mussels and other aquatic invasive
				species.</text>
							</paragraph></subsection><subsection id="HAED82F6E58DE4E70824AC738449C9827"><enum>(i)</enum><header>Supplemental
				authority</header><text>The authority under this section is supplemental to all
				actions taken by non-Federal regulatory authorities.</text>
						</subsection></section><section id="H4FC7753B65B644D68CD6F9F2B362A850"><enum>10.</enum><header>Army Corps of
				Engineers; interagency agreements</header>
						<subsection id="H5F8AFA14EC0948558DBF88308CF2EEBC"><enum>(a)</enum><header>In
				general</header><text display-inline="yes-display-inline">The Assistant
				Secretary may enter into interagency agreements with non-Federal interests in
				the Lake Tahoe Basin to use Lake Tahoe Partnership-Miscellaneous General
				Investigations funds to provide programmatic technical assistance for the
				Environmental Improvement Program.</text>
						</subsection><subsection id="H61ECC331E47E4632BCDCE5E96DF35927"><enum>(b)</enum><header>Local
				cooperation agreements</header>
							<paragraph id="HFC99371597B84757BF3E9CB649CF53A7"><enum>(1)</enum><header>In
				general</header><text>Before providing technical assistance under this section,
				the Assistant Secretary shall enter into a local cooperation agreement with a
				non-Federal interest to provide for the technical assistance.</text>
							</paragraph><paragraph id="H8D95A0F176F646FEA07D4DAD89FC202C"><enum>(2)</enum><header>Components</header><text>The
				agreement entered into under paragraph (1) shall—</text>
								<subparagraph id="HA6598D4C819C4038BAF0956361587AF5"><enum>(A)</enum><text>describe the
				nature of the technical assistance;</text>
								</subparagraph><subparagraph id="H6DF82966C5674D118B6CCE106C6C9A76"><enum>(B)</enum><text>describe any legal
				and institutional structures necessary to ensure the effective long-term
				viability of the end products by the non-Federal interest; and</text>
								</subparagraph><subparagraph id="H6F7EC0EA195F4ED788B03135D24A3DFB"><enum>(C)</enum><text>include
				cost-sharing provisions in accordance with paragraph (3).</text>
								</subparagraph></paragraph><paragraph id="HF30EF219C5D54E9BA20B45851C8B6700"><enum>(3)</enum><header>Federal
				share</header>
								<subparagraph id="H2F4A6AA3A398438292C47F1D81C83FBD"><enum>(A)</enum><header>In
				general</header><text>The Federal share of project costs under each local
				cooperation agreement under this subsection shall be 65 percent.</text>
								</subparagraph><subparagraph id="HE40D97F00ADF4640B5F1D9207E613974"><enum>(B)</enum><header>Form</header><text>The
				Federal share may be in the form of reimbursements of project costs.</text>
								</subparagraph><subparagraph id="HA0AB672E769E46AC9C2F930C24C3A47B"><enum>(C)</enum><header>Credit</header><text>The
				non-Federal interest may receive credit toward the non-Federal share for the
				reasonable costs of related technical activities completed by the non-Federal
				interest before entering into a local cooperation agreement with the Assistant
				Secretary under this subsection.</text>
								</subparagraph></paragraph></subsection></section><section id="H6E4A86AF60B04F599FBB76FFD21E5DB1"><enum>11.</enum><header>Science
				program</header><text display-inline="no-display-inline">The Administrator, in
				cooperation with the Secretary, the Planning Agency, the States of California
				and Nevada, and the Tahoe Science Consortium, shall develop and implement a
				Lake Tahoe Science Program that—</text>
						<paragraph id="H5264D29C712A4D999E04D6FDD27A1C3E"><enum>(1)</enum><text>develops and
				regularly updates an integrated multiagency programmatic assessment and
				monitoring plan—</text>
							<subparagraph id="H6D5157FE0F6344B589563872BAC123BC"><enum>(A)</enum><text>to evaluate the
				effectiveness of the Environmental Improvement Program;</text>
							</subparagraph><subparagraph id="HDBB15EED6ABC4E45884537D1CCB16ACB"><enum>(B)</enum><text>to evaluate the
				status and trends of indicators related to environmental threshold carrying
				capacities; and</text>
							</subparagraph><subparagraph id="HE93932E34EDE4F9E829DCB55B8FA4A7F"><enum>(C)</enum><text>to assess the
				impacts and risks of changing climatic conditions and invasive species;</text>
							</subparagraph></paragraph><paragraph id="H8E338AD2A8E6494BA67FC8B196530C1A"><enum>(2)</enum><text>develops a
				comprehensive set of performance measures for Environmental Improvement Program
				assessment;</text>
						</paragraph><paragraph id="H72583873393248998246138FFBACFC8E"><enum>(3)</enum><text>coordinates the
				development of the annual report described in section 13;</text>
						</paragraph><paragraph id="H048807FF7EA84EF79F6AB508AE049AFE"><enum>(4)</enum><text>produces and
				synthesizes scientific information necessary for—</text>
							<subparagraph id="HA0D72ECC83EE4919A7C33E230178FD01"><enum>(A)</enum><text>the identification
				and refinement of environmental indicators for the Lake Tahoe Basin; and</text>
							</subparagraph><subparagraph id="H018065F4CACA40968F3FC8C10694F4BA"><enum>(B)</enum><text>the evaluation of
				standards and benchmarks;</text>
							</subparagraph></paragraph><paragraph id="HA5C96C151CFF4733B3FD9FC4F6108883"><enum>(5)</enum><text>conducts applied
				research, programmatic technical assessments, scientific data management,
				analysis, and reporting related to key management questions;</text>
						</paragraph><paragraph id="H793CD75FF5BC41D3A9AF4063A56C97C2"><enum>(6)</enum><text>develops new tools
				and information to support objective assessments of land use and resource
				conditions;</text>
						</paragraph><paragraph id="H86388F7E0EE34CFDBB60A5EF9ED28BFA"><enum>(7)</enum><text>provides
				scientific and technical support to the Federal Government and State and local
				governments in—</text>
							<subparagraph id="H2515C5B32B02427FB5D9A8CAF8D25537"><enum>(A)</enum><text>reducing
				stormwater runoff, air deposition, and other pollutants that contribute to the
				loss of lake clarity; and</text>
							</subparagraph><subparagraph id="H86FC3943EDC04BEE9FCD6AEC35E68CF7"><enum>(B)</enum><text>the development
				and implementation of an integrated stormwater monitoring and assessment
				program;</text>
							</subparagraph></paragraph><paragraph id="H2C559858F2D449299C2C3105A6E6EEF8"><enum>(8)</enum><text>establishes and
				maintains independent peer review processes—</text>
							<subparagraph id="H421A22F4AE65495198CFA769AAABF1A1"><enum>(A)</enum><text>to evaluate the
				Environmental Improvement Program; and</text>
							</subparagraph><subparagraph id="H8163582776F640788EB65F7390911EFC"><enum>(B)</enum><text>to assess the
				technical adequacy and scientific consistency of central environmental
				documents, such as the 5-year threshold review; and</text>
							</subparagraph></paragraph><paragraph id="HCC0EF260464C426CB395737D71BF2D5B"><enum>(9)</enum><text>provides
				scientific and technical support for the development of appropriate management
				strategies to accommodate changing climatic conditions in the Lake Tahoe
				Basin.</text>
						</paragraph></section><section id="HDCFB6FAB036B4649BEE48900D9130C45"><enum>12.</enum><header>Public outreach
				and education</header>
						<subsection id="HEF5F8E93328441FCBEE228D85999FF15"><enum>(a)</enum><header>In
				general</header><text display-inline="yes-display-inline">The Secretary,
				Administrator, and Director will coordinate with the Planning Agency to conduct
				public education and outreach programs, including encouraging—</text>
							<paragraph id="H56A7ABB0B6474E5AAAF1EF08CB8E9643"><enum>(1)</enum><text display-inline="yes-display-inline">owners of land and residences in the Lake
				Tahoe Basin—</text>
								<subparagraph id="H1BCD33F7679E48B69CC94DC94A084B2E"><enum>(A)</enum><text display-inline="yes-display-inline">to implement defensible space; and</text>
								</subparagraph><subparagraph id="HDDCA9553FBE14CBBB15D2B0B138C357B"><enum>(B)</enum><text display-inline="yes-display-inline">to conduct best management practices for
				water quality; and</text>
								</subparagraph></paragraph><paragraph id="H56C6A02F4D5E4C95BC3130FBBC6CC97E"><enum>(2)</enum><text display-inline="yes-display-inline">owners of land and residences in the Lake
				Tahoe Basin and visitors to the Lake Tahoe Basin, to help prevent the
				introduction and proliferation of invasive species as part of the private share
				investment in the Environmental Improvement Program.</text>
							</paragraph></subsection><subsection id="H60FA299E734C487394B9BC819D86295D"><enum>(b)</enum><header>Required
				coordination</header><text display-inline="yes-display-inline">Public outreach
				and education programs for aquatic invasive species under this section
				shall—</text>
							<paragraph id="H9078C4EC0A564652822F57247F3C8942"><enum>(1)</enum><text display-inline="yes-display-inline">be coordinated with Lake Tahoe Basin
				tourism and business organizations; and</text>
							</paragraph><paragraph id="HA3823EF4A57749CEAEC68743F0963183"><enum>(2)</enum><text display-inline="yes-display-inline">include provisions for the programs to
				extend outside of the Lake Tahoe Basin.</text>
							</paragraph></subsection></section><section id="HC8FD130DC70D431E8466752D65F4891C"><enum>13.</enum><header>Reporting
				requirements</header><text display-inline="no-display-inline">Not later than
				February 15 of each year, the Chair, in cooperation with the Secretary, the
				Director, the Administrator, the Planning Agency, and the States of California
				and Nevada, shall submit to Congress a report that describes—</text>
						<paragraph id="H7FC2FFA800B34CF19C44D8E5C157150D"><enum>(1)</enum><text>the status of all
				Federal, State, local, and private projects authorized under this Act,
				including to the maximum extent practicable, for projects that will receive
				Federal funds under this Act during the current or subsequent fiscal
				year—</text>
							<subparagraph id="H09909AFEEA194EDA8303E2073F229ECD"><enum>(A)</enum><text>the project
				scope;</text>
							</subparagraph><subparagraph id="HAF81D11FD0A243C7B44943F5C1D453A8"><enum>(B)</enum><text>the budget for the
				project; and</text>
							</subparagraph><subparagraph id="HAB3DE94446734580B7BBDB8FDF60A369"><enum>(C)</enum><text>the justification
				for the project, consistent with the criteria established in section
				8(c)(1);</text>
							</subparagraph></paragraph><paragraph id="HA41CD4C9B9CA4822A03CC45FF52C1310"><enum>(2)</enum><text>Federal, State,
				local, and private expenditures in the preceding fiscal year to implement the
				Environmental Improvement Program and projects otherwise authorized under this
				Act;</text>
						</paragraph><paragraph id="H594E12F1B57A48458B3471C755B18126"><enum>(3)</enum><text>accomplishments in
				the preceding fiscal year in implementing this Act in accordance with the
				performance measures and other monitoring and assessment activities; and</text>
						</paragraph><paragraph id="H5AC7F032F14C48F089216A6E04960F58"><enum>(4)</enum><text>public education
				and outreach efforts undertaken to implement programs and projects authorized
				under this Act.</text>
						</paragraph></section><section id="HD3874F13F6CD480ABA668A29222ECD39"><enum>14.</enum><header>Annual budget
				plan</header><text display-inline="no-display-inline">As part of the annual
				budget of the President, the President shall submit information regarding each
				Federal agency involved in the Environmental Improvement Program (including the
				Forest Service, the Environmental Protection Agency, and the United States Fish
				and Wildlife Service), including—</text>
						<paragraph id="HEB57CAC4C2CA4DCD9BA9E144A22D26C7"><enum>(1)</enum><text>an interagency
				crosscut budget that displays the proposed budget for use by each Federal
				agency in carrying out restoration activities relating to the Environmental
				Improvement Program for the following fiscal year;</text>
						</paragraph><paragraph id="H83BCC84C4D684A56A8601EE205374716"><enum>(2)</enum><text>a detailed
				accounting of all amounts received and obligated by Federal agencies to achieve
				the goals of the Environmental Improvement Program during the preceding fiscal
				year; and</text>
						</paragraph><paragraph id="H572F5DE48B8A425895FA9C754C90A025"><enum>(3)</enum><text>a description of
				the Federal role in the Environmental Improvement Program, including the
				specific role of each agency involved in the restoration of the Lake Tahoe
				Basin.</text>
						</paragraph></section><section id="H2D972DE3BE504124AFE3CAFEAA07B7AA"><enum>15.</enum><header>Grant for
				watershed strategy</header>
						<subsection id="HF1398F1C19B34D5094CFB440A1159EB7"><enum>(a)</enum><header>In
				general</header><text display-inline="yes-display-inline">Of the amounts to be
				made available under section 18(a), the Administrator shall use not more than
				$500,000 to provide a grant, on a competitive basis, to States, federally
				recognized Indian tribes, interstate agencies, other public or nonprofit
				agencies and institutions, or institutions of higher education to develop a
				Lake Tahoe Basin watershed strategy in coordination with the Planning Agency,
				the States of California and Nevada, and the Secretary.</text>
						</subsection><subsection id="H73BD5DE7F30C435BBF5987CF398945A7"><enum>(b)</enum><header>Comment</header><text>In
				developing the watershed strategy under subsection (a), the grant recipients
				shall provide an opportunity for public review and comment.</text>
						</subsection><subsection id="HED56A92811C9412481739376414135FC"><enum>(c)</enum><header>Components</header><text display-inline="yes-display-inline">The watershed strategy developed under
				subsection (a) shall include—</text>
							<paragraph id="HCC6BACDEFE4B4CBD9D192DC10CCFCE93"><enum>(1)</enum><text>a classification
				system, inventory, and assessment of stream environment zones;</text>
							</paragraph><paragraph id="H9A00949AA42045668900B3AD34B70073"><enum>(2)</enum><text>comprehensive
				watershed characterization and restoration priorities consistent with—</text>
								<subparagraph id="HE8437C915D794653ABE0BC973E10B817"><enum>(A)</enum><text>the Lake Tahoe
				total maximum daily load; and</text>
								</subparagraph><subparagraph id="H0C37DEA93FA44F33B160FA7D3EB3AD9A"><enum>(B)</enum><text>the environmental
				threshold carrying capacities of Lake Tahoe;</text>
								</subparagraph></paragraph><paragraph id="H01F4BB2DA6D642DE8477F7426074A75A"><enum>(3)</enum><text>a monitoring and
				assessment program consistent with section 11; and</text>
							</paragraph><paragraph id="H598FAE19CB1E4F4D841BCFF6B697E799"><enum>(4)</enum><text>an adaptive
				management system—</text>
								<subparagraph id="HE5D64770EBA841B6BE86EC6315479E09"><enum>(A)</enum><text>to measure and
				evaluate progress; and</text>
								</subparagraph><subparagraph id="H19F1CDA329914250931DF5A91F9DC1A6"><enum>(B)</enum><text>to adjust the
				program.</text>
								</subparagraph></paragraph></subsection><subsection id="H4CE2E480067D437A9CCA9DBE2AE2E8D9"><enum>(d)</enum><header>Deadline</header><text>The
				watershed strategy developed under subsection (a) shall be completed by the
				date that is 2 years after the date on which funds are made available to carry
				out this
				section.</text>
						</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</paragraph></section><section id="H5D5DF23F17D24CC1B7BE1D785F8FC94E"><enum>8.</enum><header>Relationship to
			 other laws</header><text display-inline="no-display-inline">Section 17 of The
			 Lake Tahoe Restoration Act (Public Law 106–506; 114 Stat. 2358) (as
			 redesignated by section 7(2)) is amended by inserting <quote>, Director, or
			 Administrator</quote> after <quote>Secretary</quote>.</text>
		</section><section id="H410BC8F6AABE4ADE88275A3C1E3D7BA1"><enum>9.</enum><header>Authorization of
			 appropriations</header><text display-inline="no-display-inline">The Lake Tahoe
			 Restoration Act (Public Law 106–506; 114 Stat. 2351) is amended by striking
			 section 18 (as redesignated by section 7(2)) and inserting the
			 following:</text>
			<quoted-block display-inline="no-display-inline" id="HAB24C805EA174DDB9D73CA685DB8C54E" style="OLC">
				<section id="HBAA703126DB049F695DB6CD6BD8E6B19"><enum>18.</enum><header>Authorization of
				appropriations</header>
					<subsection id="H88F4079753154E128876106E730EE3EC"><enum>(a)</enum><header>In
				general</header><text display-inline="yes-display-inline">There is authorized
				to be appropriated to carry out this Act $415,000,000 for a period of 8 fiscal
				years beginning the first fiscal year after the date of enactment of the Lake
				Tahoe Restoration Act of 2009.</text>
					</subsection><subsection id="HC05209C2E2FB4820813EE7BB6F60007A"><enum>(b)</enum><header>Effect on other
				funds</header><text>Amounts authorized under this section and any amendments
				made by this Act—</text>
						<paragraph id="H72A55E70A25F440996E9CD8491B2900F"><enum>(1)</enum><text>shall be in
				addition to any other amounts made available to the Secretary, Administrator,
				or Director for expenditure in the Lake Tahoe Basin; and</text>
						</paragraph><paragraph id="H0EE2A2DEF30443C88033E7BC78C3367E"><enum>(2)</enum><text>shall not reduce
				allocations for other Regions of the Forest Service, Environmental Protection
				Agency, or United States Fish and Wildlife Service.</text>
						</paragraph></subsection><subsection id="H66295F0817A448B487B2C5C45E2CE741"><enum>(c)</enum><header>Cost-Sharing
				requirement</header><text>Except as provided in subsection (d) and section
				6(c)(3)(E), the States of California and Nevada shall pay 50 percent of the
				aggregate costs of restoration activities in the Lake Tahoe Basin funded under
				section 6 or 8.</text>
					</subsection><subsection commented="no" display-inline="no-display-inline" id="H5CC7CB50947F44E08642A599F8CC1F19"><enum>(d)</enum><header>Relocation
				costs</header><text>Notwithstanding subsection (c), the Secretary shall provide
				to local utility districts <fraction>2/3</fraction> the costs of relocating
				facilities in connection with—</text>
						<paragraph commented="no" display-inline="no-display-inline" id="H66DE031B28BB412AA48A61D9E327F56F"><enum>(1)</enum><text>environmental
				restoration projects under sections 6 and 8; and</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H3D791B8D7FA3445395F7227E44C42AE9"><enum>(2)</enum><text>erosion control
				projects under section 2 of Public Law 96–586 (94 Stat. 3381).</text>
						</paragraph></subsection><subsection id="H848937705D3E4D3BBFDA93E15A98EE28"><enum>(e)</enum><header>Signage</header><text>To
				the maximum extent practicable, a project provided assistance under this Act
				shall include appropriate signage at the project site that—</text>
						<paragraph id="H773721910A8D45CD98C98A420E037BC2"><enum>(1)</enum><text>provides
				information to the public on—</text>
							<subparagraph id="H592E385280984B5BB7E2C16B11A6CAB0"><enum>(A)</enum><text>the amount of
				Federal funds being provided to the project; and</text>
							</subparagraph><subparagraph id="HC8A8EEC7E9AA444E90791FB227EBED89"><enum>(B)</enum><text>this Act;
				and</text>
							</subparagraph></paragraph><paragraph id="H4252A3D604BA4287B9E707B8AE0ACA1D"><enum>(2)</enum><text>displays the
				visual identity mark of the Environmental Improvement
				Program.</text>
						</paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section id="H2B8777CFB56D4E6CBF4E49446D408D1B"><enum>10.</enum><header>Conforming
			 amendments</header>
			<subsection id="H940AA70928C742E9A524877A39C839EF"><enum>(a)</enum><header>Administration
			 of acquired land</header><text>Section 3(b) of Public Law 96–586 (94 Stat.
			 3384) is amended—</text>
				<paragraph id="H962D11042541497A8A37095FA97AAFB9"><enum>(1)</enum><text display-inline="yes-display-inline">by striking <quote>(b) Lands</quote> and
			 inserting the following:</text>
					<quoted-block display-inline="no-display-inline" id="H9B6B5484540844C2BC0CBA0D28D4207E" style="OLC">
						<subsection id="HEFE4B7A31F0E4893866E3A2394C1D89E"><enum>(b)</enum><header>Administration
				of acquired land</header>

				general</header><text>Land</text>
							</paragraph></subsection><after-quoted-block>;
				and</after-quoted-block></quoted-block>
				</paragraph><paragraph id="HE6A9B88521CD4C2C9A02288397D9279E"><enum>(2)</enum><text>by adding at the
			 end the following:</text>
					<quoted-block display-inline="no-display-inline" id="HC6FDB4DD1604473A827C87B0279900CA" style="OLC">
						<paragraph id="HB9DD8CBD6E82496FA6C941D1445D43D1"><enum>(2)</enum><header>Interchange</header>
							<subparagraph id="HC1CAF1C42FB1458DBD758B6CA83FC78D"><enum>(A)</enum><header>In
				general</header><text>Notwithstanding paragraph (1), the Secretary of
				Agriculture (acting through the Chief of the Forest Service) (referred to in
				this paragraph as the <quote>Secretary</quote>) may interchange (as defined in
				the first section of Public Law 97–465 (16 U.S.C. 521c)) any land or interest
				in land within the Lake Tahoe Basin Management Unit described in subparagraph
				(B) with appropriate units of State government.</text>
							</subparagraph><subparagraph id="H7EFD34EF1D8E4BE4A01870B33D710BBC"><enum>(B)</enum><header>Eligible
				land</header><text>The land or interest in land referred to in subparagraph (A)
				is land or an interest in land that the Secretary determines is not subject to
				efficient administration by the Secretary because of the location or size of
				the land.</text>
							</subparagraph><subparagraph id="HB348A667CBEC4607BD24C697252CE92B"><enum>(C)</enum><header>Requirements</header><text>In
				any interchange under this paragraph, the Secretary shall—</text>
								<clause id="H38AFE682DBD4473D8C9EBFEEBC8A8DF7"><enum>(i)</enum><text>insert in the
				applicable deed such terms, covenants, conditions, and reservations as the
				Secretary determines to be necessary to ensure—</text>
									<subclause id="H3606D1A651A8488588005B7D53212DE0"><enum>(I)</enum><text>protection of the
				public interest, including protection of the scenic, wildlife, and recreational
				values of the National Forest System; and</text>
									</subclause><subclause id="HC28A635058784882B4D0F52B0F61380E"><enum>(II)</enum><text>the provision for
				appropriate access to, and use of, land within the National Forest
				System;</text>
									</subclause></clause><clause id="HAECB6365C1404BC9BD7D564ECF85BDA5"><enum>(ii)</enum><text>receive land
				within the Lake Tahoe Basin of approximately equal value (as defined in
				accordance with section 6(2) of Public Law 97–465 (96 Stat. 2535)); and</text>
								</clause><clause id="H2F5E5C34435A4AD692506F852884C4C9"><enum>(iii)</enum><text>for the purposes
				of any environmental assessment—</text>
									<subclause id="H4D916868154A4FBCAC2DE285E9909EF6"><enum>(I)</enum><text>assume the
				maintenance of the environmental status quo; and</text>
									</subclause><subclause id="HBA094399C4814C06B0B70758F56A8186"><enum>(II)</enum><text>not be required
				to individually assess each parcel that is managed under the Lake Tahoe Basin
				Management Unit Urban Lots Program.</text>
									</subclause></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HC839356830B248E39F18771B64AAA029"><enum>(D)</enum><header>Use of land
				acquired by units of State government</header><text>Any unit of State
				government that receives National Forest System land through an exchange or
				transfer under this paragraph shall not convey the land to any person or entity
				other than the Federal Government or a State
				government.</text>
							</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection commented="no" id="H582CDFE0014D470B873641A199D01734"><enum>(b)</enum><header>Interagency
			 agreement funding</header><text>Section 108(g) of title I of division C of the
			 Consolidated Appropriations Act, 2005 (Public Law 108–447; 118 Stat. 2942) is
			 amended by striking <quote>$25,000,000</quote> and inserting
			 <quote>$75,000,000</quote>.</text>
