			 driving incentive grants</header>
			<subsection id="H233494C298A34F28AE07FA32523D925F"><enum>(a)</enum><header>In
			 General</header><text>Chapter 4 of title 23, United States Code, is amended by
			 adding at the end the following:</text>

					<section id="HF406DADAA5754C8BA8349360FFFDDCA9"><enum>413.</enum><header>Distracted
				driving incentive grants</header>
						<subsection id="HF9F3BD7C145F4698AAE2264534ABE29B"><enum>(a)</enum><header>In
				General</header><text>The Secretary shall make a grant under this section to
				any State that enacts and implements a statute that meets the requirements of
				subsections (b) and (c) of this section.</text>
						</subsection><subsection id="H93CC72FFD16841D8BBE02D5FEA4D88B4"><enum>(b)</enum><header>Prohibition on
				Texting While Driving</header><text>A State statute meets the requirements of
				this subsection if the statute—</text>
							<paragraph id="H7C38BA72686F45B0B0B93FF63FD400C3"><enum>(1)</enum><text>prohibits the use
				of a personal wireless communications device by a driver for texting while
				driving;</text>
							</paragraph><paragraph id="H6B8FD84A35EE4442B762E2D6AFD45F78"><enum>(2)</enum><text>makes violation of
				the statute a primary offense;</text>
							</paragraph><paragraph id="H37BBBEF234CB49D1B276064CC36C03F4"><enum>(3)</enum><text>establishes—</text>
								<subparagraph id="HE6C3A1D89507464F94AAA072799E2E6A"><enum>(A)</enum><text>a minimum fine for
				a first violation of the statute; and</text>
								</subparagraph><subparagraph id="H3F8F11F4EDF9487D9BEF276E61E80558"><enum>(B)</enum><text>increased fines
				for repeat violations; and</text>
								</subparagraph></paragraph><paragraph id="H645217E1F1A74B7E84C3162991444EFB"><enum>(4)</enum><text>provides increased
				civil and criminal penalties than would otherwise apply if a vehicle accident
				is caused by a driver who is using such a device in violation of the
				statute.</text>
							</paragraph></subsection><subsection id="H8F801A3D2FA14717A196E5EED0D75B5E"><enum>(c)</enum><header>Prohibition on
				Handheld Cellphone Use While Driving</header><text>A State statute meets the
				requirements of this subsection if the statute—</text>
							<paragraph id="HDFF0CAFFA7984BB9BE3B909D8CDE7B9A"><enum>(1)</enum><text>prohibits a driver
				from holding a personal wireless communications device to conduct a telephone
				call while driving;</text>
							</paragraph><paragraph id="H45B2183818D145EF93C147B6105A0922"><enum>(2)</enum><text>allows the use of
				hands-free devices that enable a driver, other than a driver who has not
				attained the age of 18, to initiate, conduct, or receive a telephone call
				without holding the device;</text>
							</paragraph><paragraph id="H999D2829B4EA42F69BC9E8DFF40B3D1C"><enum>(3)</enum><text>makes violation of
				the statute a primary offense;</text>
							</paragraph><paragraph id="HC5C84473073F4C30A46352E95B762ABF"><enum>(4)</enum><text>requires
				distracted driving issues to be tested as part of the State driver’s license
				examination;</text>
							</paragraph><paragraph id="H55B00B89BF3E4BB9A278837363DA5498"><enum>(5)</enum><text>establishes—</text>
								<subparagraph id="H662540ADDA9540A2AA4D29659510F36D"><enum>(A)</enum><text>a minimum fine for
				a first violation of the statute; and</text>
								</subparagraph><subparagraph id="H9D9C7C520977449CA4956221BF627A51"><enum>(B)</enum><text>increased fines
				for repeat violations; and</text>
								</subparagraph></paragraph><paragraph id="H9EF96129F27B45939BF03385974AE449"><enum>(6)</enum><text>provides increased
				civil and criminal penalties than would otherwise apply if a vehicle accident
				is caused by a driver who is using such a device in violation of the
				statute.</text>
							</paragraph></subsection><subsection id="H38FD262DD6B746FA8EC8B3259B199F33"><enum>(d)</enum><header>Permitted
				Exceptions</header><text>A statute that meets the requirements of subsections
				(b) and (c) may provide exceptions for—</text>
							<paragraph id="HA4658908B99147E88FB294C938507084"><enum>(1)</enum><text>use of a personal
				wireless communications device by a driver to contact emergency
				services;</text>
							</paragraph><paragraph id="H583DB780B79B44068B926AC22724A201"><enum>(2)</enum><text>manipulation of
				such a device by a driver to activate, deactivate, or initialize the hands-free
				functionality of the device;</text>
							</paragraph><paragraph id="H5499100DA7104CDDAB1B547505F53FF7"><enum>(3)</enum><text>use of a personal
				wireless communications device by emergency services personnel while operating
				an emergency services vehicle and engaged in the performance of their duties as
				emergency services personnel; and</text>
							</paragraph><paragraph id="HD671006C2B0E4B399171CA816340FF3F"><enum>(4)</enum><text>use of a device by
				an individual employed as a commercial motor vehicle driver, or a school bus
				driver, within the scope of such individual’s employment if such use is
				permitted under the regulations promulgated pursuant to section 31152 of title
				49.</text>
							</paragraph></subsection><subsection id="H048CAFE986B3406C9E5F95EF4CDFB1EB"><enum>(e)</enum><header>Grant
				Year</header><text>The Secretary shall make a grant under this section to a
				State in any year in which the State—</text>
							<paragraph id="H6968F3E0807B4D63B7CFE3862533C19F"><enum>(1)</enum><text>enacts a law that
				meets the requirements of subsections (b) and (c) before July 1; or</text>
							</paragraph><paragraph id="HD14189F2683B4B4CBC0A697135BF0278"><enum>(2)</enum><text>maintains a
				statute, that meets the requirements of subsections (b) and (c), enacted in a
				previous year that is in effect through June 30th of the grant year.</text>
							</paragraph></subsection><subsection id="H936715EBFD8C4EF69A7B6B7D3D6C9023"><enum>(f)</enum><header>Disbursement and
				Apportionment</header><text>Grants to qualifying States shall be disbursed
				after July 1 each year according to the apportionment criteria of section
				402(c).</text>
						</subsection><subsection id="H9F4D475DDB794E89AA1468E25AE235D3"><enum>(g)</enum><header>Use of Grant
				Funds</header><text>A State that receives a grant under this section—</text>
							<paragraph id="H9A60289E2527428C8A6C98F7F0FAD306"><enum>(1)</enum><text>shall use at least
				50 percent of the grant—</text>
								<subparagraph id="HAB2F6EF082F2424E813690D91E2C6917"><enum>(A)</enum><text>to educate and
				advertise to the public information about the dangers of texting or using a
				cellphone while driving;</text>
								</subparagraph><subparagraph id="HBE8F5BD8B7B240A591CC5779BD43496D"><enum>(B)</enum><text>for traffic signs
				that notify drivers about the distracted driving law of the State;</text>
								</subparagraph><subparagraph id="H8D23B9AB632940DB89B8E642D5871AA2"><enum>(C)</enum><text>for law
				enforcement of the distracted driving law; or</text>
								</subparagraph><subparagraph id="H7F72DF05AB2A477398B6DF9F0A853CE4"><enum>(D)</enum><text>for a combination
				of such uses; and</text>
								</subparagraph></paragraph><paragraph id="H63261DF0134943BAAE9AACDA40BD08B8"><enum>(2)</enum><text>may use up to 50
				percent of the grant for other projects that improve traffic safety and that
				are consistent with the criteria in section 402(a).</text>
							</paragraph></subsection><subsection id="H452343EFE36D4074B938DAB275641EE7"><enum>(h)</enum><header>Definitions</header><text>In
				this section:</text>
							<paragraph id="H33C5C7F24FAE4B698C15C720E2D0F17E"><enum>(1)</enum><header>Driving</header><text>The
				term <term>driving</term> means operating a motor vehicle on a public road,
				including operation while temporarily stationary because of traffic, a traffic
				light or stop sign, or otherwise. It does not include operating a motor vehicle
				when the vehicle has pulled over to the side of, or off, an active roadway and
				has stopped in a location where it can safely remain stationary.</text>
							</paragraph><paragraph id="HABC206952CED4C17B0E732FA49F33FCC"><enum>(2)</enum><header>Hands-free
				device</header><text>The term <term>hands-free device</term> means a device
				that allows a driver to use a personal wireless communications device to
				initiate, conduct, or receive a telephone call without holding the personal
				wireless communications device.</text>
							</paragraph><paragraph id="H963174F3AC7A49D7B71332C84C2B23A2"><enum>(3)</enum><header>Personal
				wireless communications device</header><text>The term <term>personal wireless
				communications device</term> means a device through which personal wireless
				services (as defined in section 332(c)(7)(C)(i) of the
				<act-name parsable-cite="CA34">Communications Act of 1934</act-name> (47 U.S.C.
				332(c)(7)(C)(i))) are transmitted. It does not include a global navigation
				satellite system receiver used for positioning, emergency notification, or
				navigation purposes.</text>
							</paragraph><paragraph id="HD18148D82BC64DDE80FDC53011BE0DD6"><enum>(4)</enum><header>Primary
				offense</header><text>The term <term>primary offense</term> means an offense
				for which a law enforcement officer may stop a vehicle solely for the purpose
				of issuing a citation in the absence of evidence of another offense.</text>
							</paragraph><paragraph id="H3B8D3B918F4744AAB011497B468F6414"><enum>(5)</enum><header>Public
				road</header><text>The term <term>public road</term> has the meaning given that
				term in section 402(c).</text>
							</paragraph><paragraph id="H08A01320583C4A8E8B0EB493AB385300"><enum>(6)</enum><header>Texting</header><text>The
				term <term>texting</term> means reading from or manually entering data into a
				personal wireless communications device, including doing so for the purpose of
				SMS texting, e-mailing, instant messaging, or engaging in any other form of
				electronic data retrieval or electronic data
				communication.</text>
							</paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="HCE538DEBEA844E04AB87FBC07F121AAC"><enum>(b)</enum><header>Conforming
			 Amendment</header><text>The table of contents for chapter 4 of title 23, United
			 States Code, is amended by adding at the end the following:</text>

				grants.</toc-entry>
					</toc>
					<after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection></section><section id="H4DDB60CE3D844734996EFE588A9610B7"><enum>3.</enum><header>Distracted
			 driving national education program</header>
			<subsection id="H4340BB70E3FF4A289BCA32301005CCF3"><enum>(a)</enum><header>In
			 General</header><text>The Administrator of the National Highway Traffic Safety
			 Administration shall establish and administer a program under which at least 2
			 high-visibility education and advertising campaigns related to distracted
			 driving will be carried out for the purpose specified in subsection (b) for
			 fiscal years 2010 and 2011.</text>
			</subsection><subsection id="H5BCFE6108B2945C9BA8AB5415F8E2B66"><enum>(b)</enum><header>Purpose</header><text>The
			 purpose of an education and advertising campaign under this section shall be to
			 educate the public about the risks associated with distracted driving,
			 including those associated with—</text>
				<paragraph id="HA005E18EB40A493583A8DAEA8CBE15EA"><enum>(1)</enum><text>texting (as
			 defined in section 413(h)(6) of title 23, United States Code) while driving;
			 and</text>
				</paragraph><paragraph id="HB719401D709949F48F59F7B5EBF5C655"><enum>(2)</enum><text>the use of
			 personal wireless communications devices (as defined in section 413(h)(3) of
			 that title) while driving.</text>
				</paragraph></subsection><subsection id="H4E88255FDAE54F17A59218F01F06808C"><enum>(c)</enum><header>Advertising</header><text>The
			 Administrator may use, or authorize the use of, funds available to carry out
			 this section to pay for the development, production, publication, and broadcast
			 of electronic and print media advertising in carrying out traffic safety
			 education and advertising campaigns under this section. The
			 Administrator—</text>
				<paragraph id="HF6C26C205C8944F0BFB0AA973E7535AD"><enum>(1)</enum><text>shall give
			 consideration to advertising directed at non-English speaking populations,
			 including those who listen, read, or watch nontraditional media; and</text>
				</paragraph><paragraph id="H900CBD3D34AC4A98B748BE2094C2F339"><enum>(2)</enum><text>may use a portion
			 of the funds available for this program to target local jurisdictions that have
			 enacted laws prohibiting texting or the use of personal wireless communications
			 devices while driving.</text>
				</paragraph></subsection><subsection id="H7B399FD3F13E4B1E94475959A2BC31C8"><enum>(d)</enum><header>Coordination
			 With States</header><text>The Administrator may coordinate with the States to
			 carry out the education and advertising campaigns under this section to
			 coincide with high-visibility enforcement of State laws prohibiting texting
			 while driving or the use of personal wireless communications devices while
			 driving.</text>
			</subsection><subsection id="H217A74414DA946CC9F68E7DB32E91D07"><enum>(e)</enum><header>Annual
			 Evaluation</header><text>The Administrator shall conduct an annual evaluation
			 of the effectiveness of the education and advertising campaigns under this
			 section, and report the results to the Senate Committee on Commerce, Science,
			 and Transportation, and the House of Representatives Committee on Energy and
			 Commerce.</text>
			</subsection></section><section id="H0FF1798037034695B5BE0A8BACB4E8CE"><enum>4.</enum><header>Research and data
			 collection</header>
			<subsection id="HCA34F6B50A2444B1B1A0D673747CABC6"><enum>(a)</enum><header>In
			 General</header><text>Section 408(e)(2) of title 23, United States Code, is
			 amended to read as follows:</text>
				<quoted-block id="H87C45354FC234F05BDD5B1B7CD0DCA80" style="OLC">
					<paragraph id="H4C8E6028829D474AAB6667580680707F"><enum>(2)</enum><header>Data on use of
				electronic devices</header>
						<subparagraph id="H823EFFFA2B2F44D9A6CD3AF65ABA2D6A"><enum>(A)</enum><text>The model data
				elements required under paragraph (1) shall include data elements, as
				determined appropriate by the Secretary, in consultation with the States and
				appropriate elements of the law enforcement community, on the impact on traffic
				safety of the use of electronic devices while driving.</text>
						</subparagraph><subparagraph id="H70BE4D6F8E6B408FA060B6DC7D32F644"><enum>(B)</enum><text>In order to meet
				the requirements of subparagraph (A), State and local governments shall—</text>
							<clause id="HF4C5D86F465F40159E05A03782E7AA67"><enum>(i)</enum><text>require that
				official vehicle accident investigation reports include a designated space to
				record whether or not the use of a personal wireless communications device (as
				defined in section 413(h)(3)) was in use at the time of the accident by any
				driver involved in the accident;</text>
							</clause><clause id="H571E0566240D4B2299B53C8440D3CF2B"><enum>(ii)</enum><text>require that all
				law enforcement officers, as part of a vehicle accident investigation, inquire
				about and record the information required by clause (i); and</text>
							</clause><clause id="H600B9F473B7449EE8BB58460D9E291B3"><enum>(iii)</enum><text>incorporate the
				information collected under clause (i) into its traffic safety information
				system.</text>
							</clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H4D31CD7663E2486D99E88BAED0BAA5AE"><enum>(b)</enum><header>Effective
			 Date</header><text>The amendment made by subsection (a) shall apply with
			 respect to grants under section 408 of title 23, United States Code, for fiscal
			 years beginning after fiscal year 2010.</text>
			</subsection></section><section id="HFA997AF612AD453483195D126C1EBD38"><enum>5.</enum><header>Research
			 program</header>
			<subsection id="HC75B11EB99E54149916E893D099AF46A"><enum>(a)</enum><header>In
			 General</header><text>The Secretary of Transportation shall establish a
			 research program to study distracted driving by passenger and commercial
			 vehicle drivers.</text>
			</subsection><subsection id="H9CD4C819636947B5834EF3C770747E90"><enum>(b)</enum><header>Scope</header><text>The
			 program shall include studies of—</text>
				<paragraph id="H7AAD5F7DA50541F083AA6CC2DDED413B"><enum>(1)</enum><text>driver
			 behavior;</text>
				</paragraph><paragraph id="H89419AE3F6EC491ABCC8F715F1BE7DF2"><enum>(2)</enum><text>vehicle
			 technology; and</text>
				</paragraph><paragraph id="H851585D3A1F748C0A4EA25DE13E28811"><enum>(3)</enum><text>portable
			 electronic devices that are commonly brought into passenger or commercial
			 vehicles.</text>
				</paragraph></subsection><subsection id="HF04571C2128841AD9A9B35833A57304F"><enum>(c)</enum><header>Research
			 Agreements</header>
				<paragraph id="H3C40F148B8294892BD8CBE62F0FF08EF"><enum>(1)</enum><header>In
			 general</header><text>In carrying out this section the Secretary may grant
			 research contracts to non-governmental entities to study distracted
			 driving.</text>
				</paragraph><paragraph id="H1D3E6F6BB521485EBF474CA4978A7EB4"><enum>(2)</enum><header>Limitations</header><text>The
			 Secretary may not grant a research contract under this section to any person
			 that produces or sells—</text>
					<subparagraph id="H111B5140BE39443E89BE59945E1CC9F7"><enum>(A)</enum><text>electronic
			 equipment that is used in vehicles;</text>
					</subparagraph><subparagraph id="H338ED942AF5F4AFFAD32BAAB15351BCA"><enum>(B)</enum><text>portable
			 electronic equipment commonly brought into passenger or commercial vehicles;
			 or</text>
					</subparagraph><subparagraph id="H931A73D7541A4B1ABCB3E44FE06E4610"><enum>(C)</enum><text>passenger or
			 commercial vehicles.</text>
					</subparagraph></paragraph></subsection></section><section id="H6C2101BAA23C45CD9149F85E9ABAF743"><enum>6.</enum><header>FCC report on
			 distracted driving technology</header><text display-inline="no-display-inline">Within 180 days after the date of enactment
			 of this Act, the Federal Communications Commission shall submit a report to the
			 Senate Committee on Commerce, Science, and Transportation and the House of
			 Representatives Committee on Energy and Commerce that identifies—</text>
			<paragraph id="H9D829AAF53124317BC18D56E6EF6AB3A"><enum>(1)</enum><text>data the
			 Commission can collect and analyze that will assist in understanding and
			 reducing the problem of distracted driving involving the use of personal
			 communications devices;</text>
			</paragraph><paragraph id="HE480606A46544A2096E18119CC02803D"><enum>(2)</enum><text>existing and
			 developing wireless communications technology that may be used to reduce
			 problems associated with distracted driving; and</text>
			</paragraph><paragraph id="H2458D14B22314BD793297C91924F3E65"><enum>(3)</enum><text>existing authority
			 that the Commission may use to assist in reducing those problems.</text>
			</paragraph></section><section id="H491E7AB1E52B4B5896ABF6D67EC75F1C"><enum>7.</enum><header>Provision of
			 information to States</header><text display-inline="no-display-inline">Section
			 30105 of title 49, United States Code, shall not apply to providing
			 Government-sponsored research and highway safety data, or providing technical
			 assistance, relating to legislative proposals addressing the dangers or
			 potential dangers of—</text>
			<paragraph id="H1CE3CA58677F4592A5504464DC2C8163"><enum>(1)</enum><text>texting while
			 driving a passenger vehicle, school bus, or commercial vehicle; or</text>
			</paragraph><paragraph id="HDA736AF8CBDE4CD5A0DE2B95998AEC86"><enum>(2)</enum><text>the use of
			 personal wireless communications devices (as defined in section 413(h)(3) of
			 title 23, United States Code) while driving a passenger vehicle, school bus, or
			 commercial vehicle.</text>
			</paragraph></section><section id="H95E9864A3C1F4EFCBC2BBC0DF35B4E25"><enum>8.</enum><header>Commercial motor
			 vehicles and school buses</header>
			<subsection id="HC60E7AA8D54E49C4B0BCB3133366543F"><enum>(a)</enum><header>In
			 General</header><text>Subchapter III of chapter 311 of title 49, United States
			 Code, is amended by adding at the end the following:</text>

					<section id="HC4A93078C32245E996CA6CCEF4C6EF96"><enum>31152.</enum><header>Regulation of
				the use of distracting devices in commercial motor vehicles and school
				buses</header>
						<subsection id="HF3D12A307D8D41498B989B4AEB456B1E"><enum>(a)</enum><header>In
				General</header><text>No later than 1 year after the enactment of the
				Distracted Driving Prevention Act of 2009, the Secretary of Transportation
				shall prescribe regulations on the use of electronic or wireless devices,
				including cell phones and other distracting devices, by an individual employed
				as the operator of—</text>
							<paragraph id="HF6F313CF4E584DC285FEA82883B5F436"><enum>(1)</enum><text>a commercial motor
				vehicle while that individual is engaged in the performance of such
				individual’s duties as the operator of the commercial motor vehicle; or</text>
							</paragraph><paragraph id="H746EE15A7E8F4F4A9B1EB312B1BA0B87"><enum>(2)</enum><text>a school bus (as
				defined in section 30125(a)(1)) that is a commercial motor vehicle (as defined
				in section 31301(4)(A)) while that individual is engaged in the performance of
				such individual’s duties as the operator of the school bus.</text>
							</paragraph></subsection><subsection id="H52BD2983A5DF48A09A23D3B78F135DD3"><enum>(b)</enum><header>Basis for
				Regulations</header><text>The Secretary shall base the regulations required by
				subsection (a) on accident data analysis, the results of ongoing research, and
				other information, as appropriate.</text>
						</subsection><subsection id="H24E69D9EDD9941D49461DD41D387A940"><enum>(c)</enum><header>Prohibited
				Use</header><text>The Secretary shall prohibit the use of such devices in
				circumstances in which the Secretary determines that their use interferes with
				the driver’s safe operation of a school bus or commercial motor vehicle.</text>
						</subsection><subsection id="H01228D8A74B64179B46F0829182387DE"><enum>(d)</enum><header>Permitted
				Use</header><text>Under the regulations, the Secretary may permit the use of a
				device, the use of which is prohibited under subsection (c), if the Secretary
				determines that such use is necessary for the safety of the driver or the
				public in emergency
				circumstances.</text>
						</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="HD810E0C103064447B96C36BC6725008A"><enum>(b)</enum><header>Conforming
			 Amendment</header><text>The table of contents for chapter 311 of title 49,
			 United States Code, is amended by inserting after the item relating to section
			 31151 the following:</text>

			</subsection></section><section id="H7E9F2A4F8ECB4B0088D5AC424EFFB8FA"><enum>9.</enum><header>Funding</header><text display-inline="no-display-inline">Section 2001(a) of Public Law 109–59 is
			 amended—</text>
			<paragraph id="H76C1FE74B70049FB93C449D4CAD02DC1"><enum>(1)</enum><text>by striking
			 <quote>and</quote> in paragraph (4);</text>
			</paragraph><paragraph id="HB7486CF7BAE7413A8D1CEB6EE50C3ACB"><enum>(2)</enum><text>by striking
			 <quote>2009.</quote> in paragraph (4) and inserting <quote>2009, $94,500,000
			 for fiscal year 2010, and $94,500,000 for fiscal year 2011. If any amount of
			 the funds authorized by this paragraph has not been allocated to States meeting
			 the criteria of section 406 of title 23, United States Code, by July 1 of a
			 fiscal year beginning after fiscal year 2009, the unallocated amount shall be
			 allocated to States meeting the criteria of section 413 of that title.</quote>;
			 and</text>
			</paragraph><paragraph id="H45D35ECA93A84102A9270A78B7C99FF7"><enum>(3)</enum><text>by redesignating
			 paragraph (11) as paragraph (12) and inserting after paragraph (10) the
			 following:</text>

				driving program</header><text>For carrying out section 3 of the Distracted

				2011.</text>
