		<official-title>To amend title 28, United States Code, to clarify the
		  availability of Federal habeas corpus relief for a person who is sentenced to
		  death though actually innocent.</official-title>

		<section id="H7B22840ACB854E2E88DEF2AAA0D8CA4A" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Effective Death Penalty Appeals
			 Act</short-title></quote>.</text>
		</section><section id="HC9DC9716F4304B44A4F77A387E05B6B1"><enum>2.</enum><header>Clarification of
			 the availability of Federal habeas corpus relief for a person who is sentenced
			 to death though actually innocent</header><text display-inline="no-display-inline">Section 2254(d) of title 28, United States
			 Code, is amended—</text>
			<paragraph id="HE60B249E228A4F009831BEF8460C50D6"><enum>(1)</enum><text>in paragraph (1),
			 by striking <quote>; or</quote> and inserting a semicolon;</text>
			</paragraph><paragraph id="H5AA376167A2B41269DFDBF30F80EA0F1"><enum>(2)</enum><text>in paragraph (2),
			 by striking the period and inserting <quote>; or</quote>; and</text>
			</paragraph><paragraph id="H804127F49B754AD09918960A82FCA7B2"><enum>(3)</enum><text>by adding at the
			 end the following:</text>
				<quoted-block display-inline="no-display-inline" id="H17D9EE3B3CAC40ED8B2F76D82C596724" style="OLC">
					<paragraph id="HFC0C66D3AE8643F79E29ADB33C56AB6B"><enum>(3)</enum><text display-inline="yes-display-inline">resulted in, or left in force, a sentence
				of death that was imposed without consideration of newly discovered evidence
				which, in combination with the evidence presented at trial, demonstrates that
				the applicant is probably not guilty of the underlying
				offense.</text>
					</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</paragraph></section><section id="H87D7BAE237134DD586BFB46B59E57A6B"><enum>3.</enum><header>Conforming
			 amendments relating to second and successive petitions</header>
			<subsection id="H6126D4431B6E43F19350FFF76AF8F4F1"><enum>(a)</enum><header>State
			 convictions</header><text display-inline="yes-display-inline">Section 2244(b)
			 of title 28, United States Code, is amended—</text>
				<paragraph id="HBA5FE25442BA4824853E5B9243A397BF"><enum>(1)</enum><text>in paragraph (1),
			 by striking <quote>A</quote> and inserting <quote>Except as provided in
			 paragraph (5), a</quote>;</text>
				</paragraph><paragraph id="HD522337C223447E6B9C14D13C5F8D1D2"><enum>(2)</enum><text>by adding at the
			 end the following:</text>
					<quoted-block display-inline="no-display-inline" id="H8F03EA13867E4065B57FE7DCD3ADBF87" style="USC">
						<paragraph id="HD08293448E6C4947855CCBE5E5D71A53"><enum>(5)</enum><text display-inline="yes-display-inline">A claim that an applicant was sentenced to
				death without consideration of newly discovered evidence which, in combination
				with the evidence presented at trial, could reasonably be expected to
				demonstrate that the applicant is probably not guilty of the underlying offense
				may be presented in a second or successive habeas corpus
				application.</text>
						</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="HEC45C1932D4C495ABABE6650556FDC71"><enum>(b)</enum><header>Federal
			 convictions</header><text display-inline="yes-display-inline">Section 2255(h)
			 of title 28, United States Code, is amended—</text>
				<paragraph id="H4D043EF3B43B4F66AFD84BC1BF4879CE"><enum>(1)</enum><text>in paragraph (1),
			 by striking <quote>or</quote>;</text>
				</paragraph><paragraph id="H51451A10A3BA4F3B94E4AAA0ADE78070"><enum>(2)</enum><text>by striking the
			 period at the end of paragraph (2) and inserting <quote>; or</quote>;
			 and</text>
				</paragraph><paragraph id="H16CAD972252048E28A5E08B7898E6F1C"><enum>(3)</enum><text>by adding at the
			 end the following:</text>
					<quoted-block display-inline="no-display-inline" id="HD9D38D2D01B6406FA6BCFAA8B3E1D227" style="USC">
						<paragraph id="HCA4F5225708349439E0B0114DC62EF96"><enum>(3)</enum><text display-inline="yes-display-inline">a claim that an applicant was sentenced to
				death without consideration of newly discovered evidence which, in combination
				with the evidence presented at trial, could reasonably be expected to
				demonstrate that the applicant is probably not guilty of the underlying
				offense.</text>
