		<section id="H6B379DF673EF49EFBCB7E80183202433" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Counterterrorism Authorities
			 Improvements Act of 2009</short-title></quote>.</text>
		</section><section id="HD04DD03824804BCE856B0B2A38FABFD7"><enum>2.</enum><header>Extension of
			 sunset of certain provisions of USA PATRIOT Act</header>
			<subsection id="HE4020BF44D494D4CB8108EEC581CB344"><enum>(a)</enum><header>USA PATRIOT
			 Improvement and Reauthorization Act of
			 <enum-in-header>2005</enum-in-header></header><text display-inline="yes-display-inline">Section 102(b)(1) of the USA PATRIOT
			 Improvement and Reauthorization Act of 2005 (18 U.S.C. 2510 note; Public Law
			 109–177) is amended by striking <quote>December 31, 2009</quote> and inserting
			 <quote>December 31, 2013</quote>.</text>
			</subsection><subsection id="HE40C88C1A746472A85A403348D4E92A8"><enum>(b)</enum><header>Intelligence
			 Reform and Terrorism Prevention Act of
			 <enum-in-header>2004</enum-in-header></header><text>Section 6001(b)(1) of the
			 Intelligence Reform and Terrorism Prevention Act of 2004 (50 U.S.C. 1801 note;
			 Public Law 108–458) is amended by striking <quote>December 31, 2009</quote> and
			 inserting <quote>December 31, 2013</quote>.</text>
			</subsection></section><section id="H040649CA594C489A87BD193131E3A1AD"><enum>3.</enum><header>Access to certain
			 business records under section <enum-in-header>501</enum-in-header> of the
			 Foreign Intelligence Surveillance Act of
			 <enum-in-header>1978</enum-in-header></header>
			<subsection id="H97C885C150104FC696436DB5EF2C3AEE"><enum>(a)</enum><header>Factual basis
			 for and issuance of orders</header><text display-inline="yes-display-inline">Section 501 of the Foreign Intelligence
			 Surveillance Act of 1978 (50 U.S.C. 1861) is amended—</text>
				<paragraph id="HA4A9BC37C8EE4164877457C207FFA51D"><enum>(1)</enum><text display-inline="yes-display-inline">in subsection (b)(2)—</text>
					<subparagraph id="H492484F52C4F47648DE4E4E1E8F9CEB3"><enum>(A)</enum><text>in subparagraph
			 (A)—</text>
						<clause id="H79C5A2C54B6F4BA0845765499F739F82"><enum>(i)</enum><text>by
			 striking <quote>a statement of facts showing</quote> and inserting <quote>a
			 statement of the facts and circumstances relied upon by the applicant to
			 justify the belief of the applicant</quote>; and</text>
						</clause><clause id="H361EC7BA74A841F8AE2592AC62D7C001"><enum>(ii)</enum><text>by
			 striking <quote>clandestine intelligence activities,</quote> and all that
			 follows and inserting <quote>clandestine intelligence activities;</quote>;
			 and</text>
						</clause></subparagraph><subparagraph id="H94FE2F85D6A149588A23293507DE341A"><enum>(B)</enum><text>by striking
			 subparagraph (B) and inserting the following new subparagraph:</text>

				proposed minimization procedures.</text>

			 (c)—</text>

			 inserting <quote>and that the proposed minimization procedures meet the
			 definition of minimization procedures under subsection (g)</quote> after

			 striking the second sentence; and</text>

			 subparagraph (D), by striking <quote>and</quote> at the end;</text>

			 subparagraph (E), by striking the period at the end and inserting a semicolon;
			 and</text>

				the minimization procedures be followed;

						</clause></subparagraph></paragraph></subsection><subsection id="H6222A95FB77547D39CB12D78A5F59EF0"><enum>(b)</enum><header>Disclosure of
			 requests</header><text display-inline="yes-display-inline">Such section 501 is
			 further amended—</text>
				<paragraph id="H732200BE48044AC0B7649D18429D41F5"><enum>(1)</enum><text>in subsection
			 (b)—</text>
					<subparagraph id="HE2E00D331058468D80E883D38292AFEB"><enum>(A)</enum><text>in paragraph
			 (2)(B), by striking <quote>application.</quote> and inserting
			 <quote>application; and</quote>; and</text>
					</subparagraph><subparagraph id="H7AC6387E4B9E4FB2912ABA38217C3122"><enum>(B)</enum><text>by adding at the
			 end the following new paragraph:</text>
						<quoted-block display-inline="no-display-inline" id="H33CE9E46DA5A417ABAC6644F63663ED8" style="traditional">
							<paragraph id="H82B1C035E7F44D4F8D30485F4FABB2B6"><enum>(3)</enum><text>may include a
				request that such order prohibit any person from disclosing to any other person
				that the Federal Bureau of Investigation has sought or obtained tangible things
				pursuant to such order for a particular period of time, other than in
				accordance with subsection
				(d).</text>
							</paragraph><after-quoted-block>;</after-quoted-block></quoted-block>
					</subparagraph></paragraph><paragraph id="HE5D788D71DBF411894086CD77E4773CC"><enum>(2)</enum><text>in subsection
			 (c)(2), by adding at the end the following new subparagraph:</text>
					<quoted-block display-inline="no-display-inline" id="H1B710D569E8C44A584AB375F98C32606" style="traditional">
						<subparagraph commented="no" display-inline="no-display-inline" id="H98A2A0D5AE284F24A07D86A266DF35C8"><enum>(G)</enum><text>if—</text>
							<clause commented="no" id="HEDB5C93B9C7D4E7995337A13505072D8"><enum>(i)</enum><text>such application
				includes a request for a prohibition in accordance with subsection (b)(3),
				and</text>
							</clause><clause commented="no" id="H52BB6D0974D943CBBA3A1DFB5C15E5F8"><enum>(ii)</enum><text>the judge finds
				that there is reason to believe that the disclosure of the order will result
				in—</text>
								<subclause commented="no" id="H38C8419A287E43D7BDF41D55ADE40792"><enum>(I)</enum><text>a danger to the
				national security of the United States,</text>
								</subclause><subclause commented="no" id="H6CCDAE3A95884EDEB5B08DF9BCAFD010"><enum>(II)</enum><text>interference with
				a criminal, counterterrorism, or counterintelligence investigation,</text>
								</subclause><subclause commented="no" id="H724E06768D9D4225A361AD8CDEB56D36"><enum>(III)</enum><text>interference
				with diplomatic relations, or</text>
								</subclause><subclause commented="no" id="HA4EFE4A045544EFB82F741D375412145"><enum>(IV)</enum><text>danger to the
				life or physical safety of any person,</text>
								</subclause></clause><continuation-text commented="no" continuation-text-level="subparagraph">shall prohibit any person from
				disclosing to any other person that the Federal Bureau of Investigation has
				sought or obtained tangible things pursuant to such order for an appropriate
				period of time as determined by the judge, except in accordance with subsection
				(d).</continuation-text></subparagraph><after-quoted-block>;</after-quoted-block></quoted-block>
				</paragraph><paragraph id="HE63B34FA809F4120AA7E56953CADB7FB"><enum>(3)</enum><text>in subsection
			 (d)(1)—</text>
					<subparagraph id="HF94B7DFCB6104D4BB92DFD4C1B10F0C2"><enum>(A)</enum><text>by striking
			 <quote>No person</quote> and inserting <quote>If an order under this section
			 includes a prohibition referred to in subsection (c)(2)(G), no person</quote>;
			 and</text>
					</subparagraph><subparagraph id="HCAADB1749116466FAA8545B098228E17"><enum>(B)</enum><text>by striking
			 <quote>an order under this section</quote> and inserting <quote>such order
			 during the period of time such prohibition is effective under such
			 order</quote>; and</text>
					</subparagraph></paragraph><paragraph id="HB0439A75CA8244B68D6B44353E2F21AB"><enum>(4)</enum><text>in subsection
			 (f)(1)(B), by striking <quote>an order imposed under subsection (d)</quote> and
			 inserting <quote>a prohibition referred to in subsection (c)(2)(G) included in
			 an order under this section</quote>.</text>
				</paragraph></subsection><subsection commented="no" id="H015D2CC110A64C96B6D9FEEF5E4FE0EA"><enum>(c)</enum><header>Audit</header><text display-inline="yes-display-inline">Section 106A of the USA PATRIOT Improvement
			 and Reauthorization Act of 2005 (Public Law 109–177; 120 Stat. 200) is
			 amended—</text>
				<paragraph id="H32ECD5CECD0F4DF2AE0A106AEB8221A9"><enum>(1)</enum><text>in subsection
			 (b)(1), by striking <quote>2006</quote> and inserting
			 <quote>2013</quote>;</text>
				</paragraph><paragraph id="H71D8C09AA2C5429E876AFEFB9F392730"><enum>(2)</enum><text>in subsection (c),
			 by adding at the end the following new paragraphs:</text>
					<quoted-block display-inline="no-display-inline" id="H2D485671FCD044919FF7E0A260F31460" style="OLC">
						<paragraph id="HD2414E1A838640A185A4FD904448F7C4"><enum>(3)</enum><header>Calendar years
				2007, 2008, and 2009</header><text display-inline="yes-display-inline">Not
				later than December 31, 2010, the Inspector General of the Department of
				Justice shall submit to the Committee on the Judiciary and the Permanent Select
				Committee on Intelligence of the House of Representatives and the Committee on
				the Judiciary and the Select Committee on Intelligence of the Senate a report
				containing the results of the audit conducted under this section for calendar
				years 2007, 2008, and 2009.</text>
						</paragraph><paragraph id="HA92453BA4A404085913A7B13F663AFFC"><enum>(4)</enum><header>Calendar years
				2010 and 2011</header><text display-inline="yes-display-inline">Not later than
				December 31, 2012, the Inspector General of the Department of Justice shall
				submit to the Committee on the Judiciary and the Permanent Select Committee on
				Intelligence of the House of Representatives and the Committee on the Judiciary
				and the Select Committee on Intelligence of the Senate a report containing the
				results of the audit conducted under this section for calendar years 2010 and
				2011.</text>
						</paragraph><paragraph id="H3EA02CF8C0CA40A4A17F90D47E1E6340"><enum>(5)</enum><header>Calendar years
				2012 and 2013</header><text display-inline="yes-display-inline">Not later than
				December 31, 2014, the Inspector General of the Department of Justice shall
				submit to the Committee on the Judiciary and the Permanent Select Committee on
				Intelligence of the House of Representatives and the Committee on the Judiciary
				and the Select Committee on Intelligence of the Senate a report containing the
				results of the audit conducted under this section for calendar years 2012 and
				2013.</text>
						</paragraph><after-quoted-block>;</after-quoted-block></quoted-block>
				</paragraph><paragraph id="HA2D8CD4D49924C49B7FC684BD3B099F6"><enum>(3)</enum><text>in subsection
			 (d)—</text>
					<subparagraph id="HE41ED7123A1941CC99462B637B4CBE23"><enum>(A)</enum><text>in paragraph (1)
			 by striking <quote>subsection (c)(1) or (c)(2)</quote> and inserting
			 <quote>paragraph (1), (2), (3), (4), or (5) of subsection (c)</quote>;
			 and</text>
					</subparagraph><subparagraph id="HD1E9B65BA0CF45B3AC2B815E21EA4F5F"><enum>(B)</enum><text display-inline="yes-display-inline">in paragraph (2), by striking

				</paragraph></subsection></section><section display-inline="no-display-inline" id="H321D5700F1124111A0857AF9B0C062CF" section-type="subsequent-section"><enum>4.</enum><header>Judicial review of
			 FISA orders and national security letters</header>
			<subsection id="HD75FC5E06FBB448199CE92F11B850796"><enum>(a)</enum><header>FISA</header><text>Section
			 501(f)(2) of the Foreign Intelligence Surveillance Act of 1978 (50 U.S.C.
			 1861(f)(2)) is amended—</text>
				<paragraph id="H7EAF19EF726A4FA789482AEFC0C13053"><enum>(1)</enum><text>in subparagraph
			 (A)—</text>
					<subparagraph id="H64EFD9460819454695DCC6AE778F754A"><enum>(A)</enum><text>in clause
			 (i)—</text>
						<clause id="H057A955CBADA4CFE9F580CB740ED1E48"><enum>(i)</enum><text>in
			 the first sentence, by striking <quote>a production order</quote> and inserting
			 <quote>a production order or nondisclosure order</quote>; and</text>
						</clause><clause id="HBEF9B867DDFC431B80747D1C0F93E346"><enum>(ii)</enum><text>in
			 the second sentence, by striking <quote>Not less than 1 year</quote> and all
			 that follows; and</text>
						</clause></subparagraph><subparagraph id="H9AD9B82D6EA245FFA29D8C149158DACD"><enum>(B)</enum><text>in clause (ii) in
			 the third sentence, by striking <quote>production order or
			 nondisclosure</quote>; and</text>
					</subparagraph></paragraph><paragraph id="H006C7E1C259C4B39B3B3DE426A3C7191"><enum>(2)</enum><text>in subparagraph
			 (C)—</text>
					<subparagraph id="HD05D3765B336403599A76DC2B1882184"><enum>(A)</enum><text>by striking clause
			 (ii); and</text>
					</subparagraph><subparagraph id="HAF62FFA00A3F4E84ADA176B4BA52CC36"><enum>(B)</enum><text>by redesignating
			 clause (iii) as clause (ii).</text>
					</subparagraph></paragraph></subsection><subsection id="H648E64080A2E4C68B2F1C1192D85AD8B"><enum>(b)</enum><header>Judicial review
			 of national security letters</header><text>Section 3511(b) of title 18, United
			 States Code, is amended to read as follows:</text>
				<quoted-block display-inline="no-display-inline" id="H803B35B5DD3F4C9FACEBD07C39F7CB17" style="OLC">
					<subsection id="H3CBF7A0661584431B1CDEA7880691B5C"><enum>(b)</enum><header>Nondisclosure</header>
						<paragraph id="H95AA227D57BD4531813463C58C0F280E"><enum>(1)</enum><header>In
				general</header>
							<subparagraph id="H824276676DC24B20A4E081360551112B"><enum>(A)</enum><header>Notice</header><text>If
				a recipient of a request or order for a report, records, or other information
				under section 2709 of this title, section 626 or 627 of the Fair Credit
				Reporting Act (15 U.S.C. 1681u and 1681v), section 1114 of the Right to
				Financial Privacy Act of 1978 (12 U.S.C. 3414), or section 802 of the National
				Security Act of 1947 (50 U.S.C. 436), wishes to have a court review a
				nondisclosure requirement imposed in connection with the request or order, the
				recipient shall notify the Government.</text>
							</subparagraph><subparagraph id="H09CB967E077F4550858D9CD121844EB6"><enum>(B)</enum><header>Application</header><text>Not
				later than 30 days after the date of receipt of a notification under
				subparagraph (A), the Government shall apply for an order prohibiting the
				disclosure of the existence or contents of the relevant request or order. An
				application under this subparagraph may be filed in the district court of the
				United States for any district within which the authorized investigation that
				is the basis for the request or order is being conducted. The applicable
				nondisclosure requirement shall remain in effect during the pendency of
				proceedings relating to the requirement.</text>
							</subparagraph><subparagraph id="H2DB5069D92584550A295F0C7F78E39AA"><enum>(C)</enum><header>Consideration</header><text>A
				district court of the United States that receives an application under
				subparagraph (B) should rule expeditiously, and shall, subject to paragraph
				(3), issue a nondisclosure order that includes conditions appropriate to the
				circumstances.</text>
							</subparagraph></paragraph><paragraph id="H9445065FB92242F4AEBDB3EC55F715FA"><enum>(2)</enum><header>Application
				contents</header><text>An application for a nondisclosure order or extension
				thereof under this subsection shall include a certification from the Attorney
				General, Deputy Attorney General, an Assistant Attorney General, or the
				Director of the Federal Bureau of Investigation, or in the case of a request by
				a department, agency, or instrumentality of the Federal Government other than
				the Department of Justice, the head or deputy head of the department, agency,
				or instrumentality, containing a statement of specific and articulable facts
				indicating that, absent a prohibition of disclosure under this subsection,
				there may result—</text>
							<subparagraph id="H8B5658085CA744EEB3D4DB2F63291277"><enum>(A)</enum><text>a danger to the
				national security of the United States;</text>
							</subparagraph><subparagraph id="HC9B271D44BC446BC972F76D5EDF9079C"><enum>(B)</enum><text>interference with
				a criminal, counterterrorism, or counterintelligence investigation;</text>
							</subparagraph><subparagraph id="H06098C835DAB46A49BF054F67910C202"><enum>(C)</enum><text>interference with
				diplomatic relations; or</text>
							</subparagraph><subparagraph id="H390B8B0284C34CF18469960CCE094EEA"><enum>(D)</enum><text>danger to the life
				or physical safety of any person.</text>
							</subparagraph></paragraph><paragraph id="H332C128BD63145269FB08384E3DC0E7A"><enum>(3)</enum><header>Standard</header><text>A
				district court of the United States shall issue a nondisclosure requirement
				order or extension thereof under this subsection if the court determines,
				giving substantial weight to the certification under paragraph (2) that there
				is reason to believe that disclosure of the information subject to the
				nondisclosure requirement during the applicable time period will result
				in—</text>
							<subparagraph id="HEE420D5EF2CD4B6BB5ABD6641CF17EAB"><enum>(A)</enum><text>a danger to the
				national security of the United States;</text>
							</subparagraph><subparagraph id="H9513F6DAE2BF4845AFCD664651EF431F"><enum>(B)</enum><text>interference with
				a criminal, counterterrorism, or counterintelligence investigation;</text>
							</subparagraph><subparagraph id="H9175DBCFB38043499FE75036C71D774A"><enum>(C)</enum><text>interference with
				diplomatic relations; or</text>
							</subparagraph><subparagraph id="H6B070C335B114C58BBC3715A4C4E7A6D"><enum>(D)</enum><text>danger to the life
				or physical safety of any
				person.</text>
							</subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection commented="no" id="H1EB692C7F8734769876DC94B57E3834A"><enum>(c)</enum><header>Minimization</header><text>Section
			 501(g)(1) of the Foreign Intelligence Surveillance Act of 1978 (50 U.S.C.
			 1861(g)(1)) is amended by striking <quote>Not later than</quote> and all that
			 follows and inserting <quote>At or before the end of the period of time for the
			 production of tangible things under an order approved under this section or at
			 any time after the production of tangible things under an order approved under
			 this section, a judge may assess compliance with the minimization procedures by
			 reviewing the circumstances under which information concerning United States
			 persons was retained or disseminated.</quote>.</text>
			</subsection></section><section display-inline="no-display-inline" id="HD345F499866D497F9371E34321178C2B"><enum>5.</enum><header>Limitations on
			 disclosure of national security letters</header>
			<subsection id="HC2629EB5934942FAA56EAD4AB1C60D3F"><enum>(a)</enum><header>In
			 general</header><text>Section 2709 of title 18, United States Code, is amended
			 by striking subsection (c) and inserting the following:</text>
				<quoted-block display-inline="no-display-inline" id="HD0D4E5FC23E345AAA3C537C19DF086EA" style="OLC">
					<subsection id="HA1AA7CF92D614098987CB67688E80964"><enum>(c)</enum><header>Prohibition of
				certain disclosure</header>
						<paragraph id="H629B2A1BD3044E55BED2B751309C9C96"><enum>(1)</enum><header>Prohibition</header>
							<subparagraph id="HDB6BF17BB648412E95482F20EB23B255"><enum>(A)</enum><header>In
				general</header><text>If a certification is issued under subparagraph (B) and
				notice of the right to judicial review under paragraph (3) is provided, no wire
				or electronic communication service provider, or officer, employee, or agent
				thereof, that receives a request under subsection (a), shall disclose to any
				person that the Director of the Federal Bureau of Investigation has sought or
				obtained access to information or records under this section.</text>
							</subparagraph><subparagraph id="H6227121EE6D54A109F0381F521040D81"><enum>(B)</enum><header>Certification</header><text>The
				requirements of subparagraph (A) shall apply if the Director of the Federal
				Bureau of Investigation, or a designee of the Director whose rank shall be no
				lower than Deputy Assistant Director at Bureau headquarters or a Special Agent
				in Charge of a Bureau field office, certifies that, absent a prohibition of
				disclosure under this subsection, there may result—</text>
								<clause id="H11B9324CDF4348BBA0B5C0A7AC8226D3"><enum>(i)</enum><text>a
				danger to the national security of the United States;</text>
								</clause><clause id="H43684A623D4B48ED9A8D09DA55A89012"><enum>(ii)</enum><text>interference with
				a criminal, counterterrorism, or counterintelligence investigation;</text>
								</clause><clause id="HFDA2669C4C1940C0BFD4D3EEACBE9724"><enum>(iii)</enum><text>interference
				with diplomatic relations; or</text>
								</clause><clause id="H5ADAA067ADEA4504A79CF3A177D41BC2"><enum>(iv)</enum><text>danger to the
				life or physical safety of any person.</text>
								</clause></subparagraph></paragraph><paragraph id="H738448F9F4DD49DCB695BE4282B93F47"><enum>(2)</enum><header>Exception</header>
							<subparagraph id="HC35CE0073688413A9C95089A19FB87CB"><enum>(A)</enum><header>In
				general</header><text>A wire or electronic communication service provider, or
				officer, employee, or agent thereof, that receives a request under subsection
				(a) may disclose information otherwise subject to any applicable nondisclosure
				requirement to—</text>
								<clause id="H7D90BB4DAB294D91A80EF7580B343406"><enum>(i)</enum><text>those persons to
				whom disclosure is necessary in order to comply with the request;</text>
								</clause><clause id="HEEA2D95C8D674A208D732AF5288AAD3E"><enum>(ii)</enum><text>an attorney in
				order to obtain legal advice or assistance regarding the request; or</text>
								</clause><clause id="HCD0BBCA19CDA480C8031FF4535B23407"><enum>(iii)</enum><text>other persons as
				permitted by the Director of the Federal Bureau of Investigation or the
				designee of the Director.</text>
								</clause></subparagraph><subparagraph id="H98DED2EEB2314B1395E7016F3D25C81F"><enum>(B)</enum><header>Persons
				necessary for compliance</header><text>Upon a request by the Director of the
				Federal Bureau of Investigation or the designee of the Director, those persons
				to whom disclosure will be made under subparagraph (A)(i) or to whom such
				disclosure was made before the request shall be identified to the Director or
				the designee.</text>
							</subparagraph><subparagraph id="HC22D4BF660B7446B93FD04F2516B2D64"><enum>(C)</enum><header>Nondisclosure
				requirement</header><text>A person to whom disclosure is made under
				subparagraph (A) shall be subject to the nondisclosure requirements applicable
				to a person to whom a request is issued under subsection (a) in the same manner
				as the person to whom the request is issued.</text>
							</subparagraph><subparagraph id="H8C8F4FE454834E8BB3985815E7E1EB0D"><enum>(D)</enum><header>Notice</header><text>Any
				recipient that discloses to a person described in subparagraph (A) information
				otherwise subject to a nondisclosure requirement shall inform the person of the
				applicable nondisclosure requirement.</text>
							</subparagraph></paragraph><paragraph id="HFAA4C4997FFA46E2BD611F9D8EDC064F"><enum>(3)</enum><header>Right to
				judicial review</header>
							<subparagraph id="HBFB84A38B9104D2E885D5ED2AE06D2D0"><enum>(A)</enum><header>In
				general</header><text>A wire or electronic communications service provider that
				receives a request under subsection (a) shall have the right to judicial review
				of any applicable nondisclosure requirement.</text>
							</subparagraph><subparagraph id="H225E3E5ED7CF480BA249778F4AA51BA1"><enum>(B)</enum><header>Notification</header><text>A
				request under subsection (a) shall—</text>
								<clause id="H2F5E703C8B4247D0ADAE1751CD6EBBF3"><enum>(i)</enum><text>state that if the
				recipient wishes to have a court review a nondisclosure requirement, the
				recipient shall provide notice to the Government in accordance with section
				3511(b)(1)(A); and</text>
								</clause><clause id="H72D13CBE0416489E96C4255CD963F770"><enum>(ii)</enum><text>describe the
				procedures for providing such notice.</text>
								</clause></subparagraph><subparagraph id="H7B8D061B18A3462DA391739716D56E5C"><enum>(C)</enum><header>Initiation of
				proceedings</header><text>If a recipient of a request under subsection (a)
				makes a notification under subparagraph (B), the Government shall initiate
				judicial review under the procedures established in section 3511 of this title,
				unless an appropriate official of the Federal Bureau of the Investigation makes
				a notification under paragraph (4).</text>
							</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HB138974EA56040A9B47C0B3704BDA7B6"><enum>(4)</enum><header>Termination</header><text>In
				the case of any request for which a recipient has submitted a notification
				under paragraph (3)(B), if the facts supporting a nondisclosure requirement
				cease to exist, an appropriate official of the Federal Bureau of Investigation
				shall promptly notify the wire or electronic service provider, or officer,
				employee, or agent thereof, subject to the nondisclosure requirement that the
				nondisclosure requirement is no longer in
				effect.</text>
						</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="HAFFAC38E630D4F2B9E6F28600CC51B5C"><enum>(b)</enum><header>Identity of
			 financial institutions and credit reports</header><text>Section 626 of the Fair
			 Credit Reporting Act (15 U.S.C. 1681u) is amended by striking subsection (d)
			 and inserting the following:</text>
				<quoted-block display-inline="no-display-inline" id="H8E940061DE104DFA86D9FE7346CB210E" style="OLC">
					<subsection id="HDA2492FDF8604A6E9E47E55ECFE07BAA"><enum>(d)</enum><header>Prohibition of
				certain disclosure</header>
						<paragraph id="H680F9AF8DCAA4CAA823B362F09F15257"><enum>(1)</enum><header>Prohibition</header>
							<subparagraph id="HABFB2EC4AE8D4B9FB8EC6716981CF556"><enum>(A)</enum><header>In
				general</header><text>If a certification is issued under subparagraph (B) and
				notice of the right to judicial review under paragraph (3) is provided, no
				consumer reporting agency, or officer, employee, or agent thereof, that
				receives a request or order under subsection (a), (b), or (c), shall disclose
				or specify in any consumer report, that the Federal Bureau of Investigation has
				sought or obtained access to information or records under subsection (a), (b),
				or (c).</text>
							</subparagraph><subparagraph id="H1E459DE29D734633893535DBE7D81F92"><enum>(B)</enum><header>Certification</header><text>The
				requirements of subparagraph (A) shall apply if the Director of the Federal
				Bureau of Investigation, or a designee of the Director whose rank shall be no
				lower than Deputy Assistant Director at Bureau headquarters or a Special Agent
				in Charge of a Bureau field office, certifies that, absent a prohibition of
				disclosure under this subsection, there may result—</text>
								<clause id="HC997EFF5DC8B44A5BB83177A23110A56"><enum>(i)</enum><text>a
				danger to the national security of the United States;</text>
								</clause><clause id="HB26D550F070C4BB68A024B9D604D3F1A"><enum>(ii)</enum><text>interference with
				a criminal, counterterrorism, or counterintelligence investigation;</text>
								</clause><clause id="H22B85F94EB1947AC83D0B6DAD39ED9D9"><enum>(iii)</enum><text>interference
				with diplomatic relations; or</text>
								</clause><clause id="H5C3644CC31194E88BD59CA39CA3D5A21"><enum>(iv)</enum><text>danger to the
				life or physical safety of any person.</text>
								</clause></subparagraph></paragraph><paragraph id="H3DE5DAFBCD95490499C6D4C73AD6B28D"><enum>(2)</enum><header>Exception</header>
							<subparagraph id="H39DF49DE88EF47EE94F9A7FD74AB43DE"><enum>(A)</enum><header>In
				general</header><text>A consumer reporting agency, or officer, employee, or
				agent thereof, that receives a request or order under subsection (a), (b), or
				(c) may disclose information otherwise subject to any applicable nondisclosure
				requirement to—</text>
								<clause id="H0E38D3C752F74836A3F604399435AF34"><enum>(i)</enum><text>those persons to
				whom disclosure is necessary in order to comply with the request or
				order;</text>
								</clause><clause id="HD6D2737F6C0D425AAAE31E0B76A2EE76"><enum>(ii)</enum><text>an attorney in
				order to obtain legal advice or assistance regarding the request or order;
				or</text>
								</clause><clause id="H809E46F1D378412D85B9FAA884515CFE"><enum>(iii)</enum><text>other persons as
				permitted by the Director of the Federal Bureau of Investigation or the
				designee of the Director.</text>
								</clause></subparagraph><subparagraph id="H9E9369AD3D9D4E82838600D8F3BAD805"><enum>(B)</enum><header>Persons
				necessary for compliance</header><text>Upon a request by the Director of the
				Federal Bureau of Investigation or the designee of the Director, those persons
				to whom disclosure will be made under subparagraph (A)(i) or to whom such
				disclosure was made before the request shall be identified to the Director or
				the designee.</text>
							</subparagraph><subparagraph id="H7DE47E22A777432EB84D813D35FBF241"><enum>(C)</enum><header>Nondisclosure
				requirement</header><text>A person to whom disclosure is made under
				subparagraph (A) shall be subject to the nondisclosure requirements applicable
				to a person to whom a request or order is issued under subsection (a), (b), or
				(c) in the same manner as the person to whom the request or order is
				issued.</text>
							</subparagraph><subparagraph id="HF8FD4787A4E846C9B16E5358F92DAB4B"><enum>(D)</enum><header>Notice</header><text>Any
				recipient that discloses to a person described in subparagraph (A) information
				otherwise subject to a nondisclosure requirement shall inform the person of the
				applicable nondisclosure requirement.</text>
							</subparagraph></paragraph><paragraph id="HE4F37EA2B6A3453DA6B3F239F5C84CCD"><enum>(3)</enum><header>Right to
				judicial review</header>
							<subparagraph id="H6A4E1894372142B69E9B895C09D7E8CD"><enum>(A)</enum><header>In
				general</header><text>A consumer reporting agency that receives a request or
				order under subsection (a), (b), or (c) shall have the right to judicial review
				of any applicable nondisclosure requirement.</text>
							</subparagraph><subparagraph display-inline="no-display-inline" id="H27086702779F48D59E0DA76AEAB5EE0F"><enum>(B)</enum><header>Notification</header><text>A
				request under subsection (a), (b), or (c) shall—</text>
								<clause id="H8B5A783C4F8E453394CAAB3E1CC31C61"><enum>(i)</enum><text>state that if the
				recipient wishes to have a court review a nondisclosure requirement, the
				recipient shall provide notice to the Government in accordance with section
				3511(b)(1)(A) of title 18, United States Code; and</text>
								</clause><clause id="HE0EADF1ABA8D458E88832838A63EACC0"><enum>(ii)</enum><text>describe the
				procedures for providing such notice.</text>
								</clause></subparagraph><subparagraph id="HAA7DCC02B04B4B9398B4D2515444CE4C"><enum>(C)</enum><header>Initiation of
				proceedings</header><text>If a recipient of a request or order under subsection
				(a), (b), or (c) makes a notification under subparagraph (B), the Government
				shall initiate judicial review under the procedures established in section 3511
				of title 18, United States Code, unless an appropriate official of the Federal
				Bureau of Investigation makes a notification under paragraph (4).</text>
							</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H24AF17F27C584851B896604C4B5744CD"><enum>(4)</enum><header>Termination</header><text>In
				the case of any request or order for which a consumer reporting agency has
				submitted a notification under paragraph (3)(B), if the facts supporting a
				nondisclosure requirement cease to exist, an appropriate official of the
				Federal Bureau of Investigation shall promptly notify the consumer reporting
				agency, or officer, employee, or agent thereof, subject to the nondisclosure
				requirement that the nondisclosure requirement is no longer in
				effect.</text>
						</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H6B10FC1C457342AFAEB7303B0F666C5D"><enum>(c)</enum><header>Disclosures to
			 Governmental agencies for counterterrorism purposes</header><text>Section 627
			 of the Fair Credit Reporting Act (15 U.S.C. 1681v) is amended by striking
			 subsection (c) and inserting the following:</text>
				<quoted-block display-inline="no-display-inline" id="H2196E4AABB3D4AE78D2FB38AD2699376" style="OLC">
					<subsection id="HCA212A0CCE5F426B9AA67CCB36BCA759"><enum>(c)</enum><header>Prohibition of
				certain disclosure</header>
						<paragraph id="H5F05A4AE1362450FB6C87ED28A7DF708"><enum>(1)</enum><header>Prohibition</header>
							<subparagraph id="H519FDA7698AB461686C5CC998DE672FC"><enum>(A)</enum><header>In
				general</header><text>If a certification is issued under subparagraph (B) and
				notice of the right to judicial review under paragraph (3) is provided, no
				consumer reporting agency, or officer, employee, or agent thereof, that
				receives a request under subsection (a), shall disclose to any person or
				specify in any consumer report, that a government agency has sought or obtained
				access to information under subsection (a).</text>
							</subparagraph><subparagraph id="HAAAD0A28B0784B8AA4E782BBCCF1E33C"><enum>(B)</enum><header>Certification</header><text>The
				requirements of subparagraph (A) shall apply if the head of a government agency
				authorized to conduct investigations of, or intelligence or counterintelligence
				activities or analysis related to, international terrorism, or a designee,
				certifies that, absent a prohibition of disclosure under this subsection, there
				may result—</text>
								<clause id="HB01AFA180B36404C862B5E030D6BE45F"><enum>(i)</enum><text>a
				danger to the national security of the United States;</text>
								</clause><clause id="H28D222231C064A60929B4D191D18F3DD"><enum>(ii)</enum><text>interference with
				a criminal, counterterrorism, or counterintelligence investigation;</text>
								</clause><clause id="H482D4867906D428EA8259759CA9DAF52"><enum>(iii)</enum><text>interference
				with diplomatic relations; or</text>
								</clause><clause id="HEDBD30E2E96A44199F858CD7799E3D1F"><enum>(iv)</enum><text>danger to the
				life or physical safety of any person.</text>
								</clause></subparagraph></paragraph><paragraph id="H0FC9CCB0A1BF4620A732BC59A4AEC904"><enum>(2)</enum><header>Exception</header>
							<subparagraph id="H1AAB31086C9C4FE3ADE7EED824F27959"><enum>(A)</enum><header>In
				general</header><text>A consumer reporting agency, or officer, employee, or
				agent thereof, that receives a request under subsection (a) may disclose
				information otherwise subject to any applicable nondisclosure requirement
				to—</text>
								<clause id="H83CEC3779C324EFF8B3F921209CD05CE"><enum>(i)</enum><text>those persons to
				whom disclosure is necessary in order to comply with the request;</text>
								</clause><clause id="H147EDCFDF63E4A2281923DD0B9C0687E"><enum>(ii)</enum><text>an attorney in
				order to obtain legal advice or assistance regarding the request; or</text>
								</clause><clause id="H7DD1F7DBC5F143FDBE6F832D8C5A2F98"><enum>(iii)</enum><text>other persons as
				permitted by the head of the government agency authorized to conduct
				investigations of, or intelligence or counterintelligence activities or
				analysis related to, international terrorism, or a designee.</text>
								</clause></subparagraph><subparagraph id="HA8ADAB564BAC425296C9DDAFA5F4A686"><enum>(B)</enum><header>Persons
				necessary for compliance</header><text>Upon a request by the head of a
				government agency authorized to conduct investigations of, or intelligence or
				counterintelligence activities or analysis related to, international terrorism,
				or a designee, those persons to whom disclosure will be made under subparagraph
				(A)(i) or to whom such disclosure was made before the request shall be
				identified to the head of the government agency or the designee.</text>
							</subparagraph><subparagraph id="HAAE0C55284BF4331BD5D14E74F39DBBC"><enum>(C)</enum><header>Nondisclosure
				requirement</header><text>A person to whom disclosure is made under
				subparagraph (A) shall be subject to the nondisclosure requirements applicable
				to a person to whom a request is issued under subsection (a) in the same manner
				as the person to whom the request is issued.</text>
							</subparagraph><subparagraph id="H39DAA2C41BE14EAF902DBA870CAE984A"><enum>(D)</enum><header>Notice</header><text>Any
				recipient that discloses to a person described in subparagraph (A) information
				otherwise subject to a nondisclosure requirement shall inform the person of the
				applicable nondisclosure requirement.</text>
							</subparagraph></paragraph><paragraph id="H6605DC3A9D5B45888F218D757D574E4C"><enum>(3)</enum><header>Right to
				judicial review</header>
							<subparagraph id="H7814BAD4639C41E7BFD7BB6A8309AE11"><enum>(A)</enum><header>In
				general</header><text>A consumer reporting agency that receives a request under
				subsection (a) shall have the right to judicial review of any applicable
				nondisclosure requirement.</text>
							</subparagraph><subparagraph display-inline="no-display-inline" id="H8A449778BF6D4ECE9CC6EEAE3B8BC375"><enum>(B)</enum><header>Notification</header><text>A
				request under subsection (a) shall—</text>
								<clause id="H3D61E186E8134FE586FC678055247028"><enum>(i)</enum><text>state that if the
				recipient wishes to have a court review a nondisclosure requirement, the
				recipient shall provide notice to the Government in accordance with section
				3511(b)(1)(A) of title 18, United States Code; and</text>
								</clause><clause id="H9A239A2BD9B2493991C05595C263B915"><enum>(ii)</enum><text>describe the
				procedures for providing such notice.</text>
								</clause></subparagraph><subparagraph id="HED589937A2EA4CAF8D2BDA1DF5F29E1F"><enum>(C)</enum><header>Initiation of
				proceedings</header><text>If a recipient of a request under subsection (a)
				makes a notification under subparagraph (B), the government shall initiate
				judicial review under the procedures established in section 3511 of title 18,
				United States Code, unless an appropriate official of the government agency
				authorized to conduct investigations of, or intelligence or counterintelligence
				activities or analysis related to, international terrorism makes a notification
				under paragraph (4).</text>
							</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H7D405A190E6A4B7B8618668B8E497A09"><enum>(4)</enum><header>Termination</header><text>In
				the case of any request for which a consumer reporting agency has submitted a
				notification under paragraph (3)(B), if the facts supporting a nondisclosure
				requirement cease to exist, an appropriate official of the government agency
				authorized to conduct investigations of, or intelligence or counterintelligence
				activities or analysis related to, international terrorism shall promptly
				notify the consumer reporting agency, or officer, employee, or agent thereof,
				subject to the nondisclosure requirement that the nondisclosure requirement is
				no longer in
				effect.</text>
						</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="HC030505CB5124F12A5EDBE1D9BBED169"><enum>(d)</enum><header>Financial
			 records</header><text>Section 1114(a)(5) of the Right to Financial Privacy Act
			 of 1978 (12 U.S.C. 3414(a)(5)) is amended by striking subparagraph (D) and
			 inserting the following:</text>
				<quoted-block display-inline="no-display-inline" id="H1E5C43F3BAFD471587E77F06345C6480" style="OLC">
					<subparagraph id="H22078861868E4CF9B695BF20D07A7808" indent="up2"><enum>(D)</enum><header>Prohibition of certain
				disclosure</header>
						<clause id="H7EF091A266E54E65AA807B5EC8806B5E"><enum>(i)</enum><header>Prohibition</header>
							<subclause id="HD649EFE7DA914A3D845DA272C4FC46C5"><enum>(I)</enum><header>In general</header><text>If a
				certification is issued under subclause (II) and notice of the right to
				judicial review under clause (iii) is provided, no financial institution, or
				officer, employee, or agent thereof, that receives a request under subparagraph
				(A), shall disclose to any person that the Federal Bureau of Investigation has
				sought or obtained access to information or records under subparagraph
				(A).</text>
							</subclause><subclause id="HF5670161BAEC4D96888963BFB0119BBF"><enum>(II)</enum><header>Certification</header><text>The
				requirements of subclause (I) shall apply if the Director of the Federal Bureau
				of Investigation, or a designee of the Director whose rank shall be no lower
				than Deputy Assistant Director at Bureau headquarters or a Special Agent in
				Charge of a Bureau field office, certifies that, absent a prohibition of

								</item><item id="H4A12485A8190421991B86F29403CA0C2"><enum>(dd)</enum><text>danger to the life or physical safety of
				any person.</text>
								</item></subclause></clause><clause id="HECFA928DCF7B4A21A112A059E288D1EE"><enum>(ii)</enum><header>Exception</header>
							<subclause id="HFDCD2D9970F043E596201BB4B7644B14"><enum>(I)</enum><header>In general</header><text>A
				financial institution, or officer, employee, or agent thereof, that receives a
				request under subparagraph (A) may disclose information otherwise subject to
				any applicable nondisclosure requirement to—</text>
								<item id="H2D1D06B74560423799D5179D5DCD00BE"><enum>(aa)</enum><text>those persons to whom disclosure is
				necessary in order to comply with the request;</text>
								</item><item id="H83C9AA87C5EE419ABA5DAEED0F80D57D"><enum>(bb)</enum><text>an attorney in order to obtain legal
				advice or assistance regarding the request; or</text>
								</item><item id="H15AECA55729A42D3A259784B0E97CFB8"><enum>(cc)</enum><text>other persons as permitted by the
				Director of the Federal Bureau of Investigation or the designee of the
				Director.</text>
								</item></subclause><subclause id="HECE87538617442BCA30FBDBA7C77E6DA"><enum>(II)</enum><header>Persons necessary for
				compliance</header><text>Upon a request by the Director of the Federal Bureau
				of Investigation or the designee of the Director, those persons to whom
				disclosure will be made under subclause (I)(aa) or to whom such disclosure was
				made before the request shall be identified to the Director or the
				designee.</text>
							</subclause><subclause id="HDFE4A6DAE4FD4AB7BACF03DFA4187B9D"><enum>(III)</enum><header>Nondisclosure
				requirement</header><text>A person to whom disclosure is made under subclause
				(I) shall be subject to the nondisclosure requirements applicable to a person
				to whom a request is issued under subparagraph (A) in the same manner as the
				person to whom the request is issued.</text>
							</subclause><subclause id="H8482B8324AF5486F9E9144CE9A6C169D"><enum>(IV)</enum><header>Notice</header><text>Any
				recipient that discloses to a person described in subclause (I) information
				otherwise subject to a nondisclosure requirement shall inform the person of the
				applicable nondisclosure requirement.</text>
							</subclause></clause><clause id="HE16C3452A7E14429828CAE6E764FCAC9"><enum>(iii)</enum><header>Right to judicial review</header>
							<subclause id="H8AAF49ACD8E1458A810C988DBB53AF4B"><enum>(I)</enum><header>In general</header><text>A
				financial institution that receives a request under subparagraph (A) shall have
				the right to judicial review of any applicable nondisclosure
				requirement.</text>
							</subclause><subclause display-inline="no-display-inline" id="H1DA459B9FAD948FDA31A859A72927241"><enum>(II)</enum><header>Notification</header><text display-inline="yes-display-inline">A request under subparagraph (A)
				shall—</text>
								<item id="H80A453E14A224BA98654B320ED13AC7D"><enum>(aa)</enum><text>state that if the recipient wishes to
				have a court review a nondisclosure requirement, the recipient shall provide
				notice to the Government in accordance with section 3511(b)(1)(A) of title 18,
				United States Code; and</text>
								</item><item id="HAFA97E73A51E4B93867720CF9223602A"><enum>(bb)</enum><text>describe the procedures for providing
				such notice.</text>
								</item></subclause><subclause id="HFAE041BE4CB24574A56BC29442717833"><enum>(III)</enum><header>Initiation of
				proceedings</header><text>If a recipient of a request under subparagraph (A)
				makes a notification under subclause (II), the Government shall initiate
				judicial review under the procedures established in section 3511 of title 18,
				United States Code, unless an appropriate official of the Federal Bureau of
				Investigation makes a notification under clause (iv).</text>
							</subclause></clause><clause commented="no" display-inline="no-display-inline" id="H93DAF517D5444DA8840BD3433740A185"><enum>(iv)</enum><header>Termination</header><text>In the
				case of any request for which a financial institution has submitted a
				notification under clause (iii)(II), if the facts supporting a nondisclosure
				requirement cease to exist, an appropriate official of the Federal Bureau of
				Investigation shall promptly notify the financial institution, or officer,
				employee, or agent thereof, subject to the nondisclosure requirement that the
				nondisclosure requirement is no longer in
				effect.</text>
						</clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="HC31214F622CE4F02B41741A7C9FC0053"><enum>(e)</enum><header>Requests by
			 authorized investigative agencies</header><text>Section 802 of the National
			 Security Act of 1947 (50 U.S.C. 436), is amended by striking subsection (b) and
			 inserting the following:</text>
				<quoted-block display-inline="no-display-inline" id="H5E20E35866134000BFD04D7B5980E5EA" style="OLC">
					<subsection id="H805196720D4F4072A39C9B0373FC61BD"><enum>(b)</enum><header>Prohibition of
				certain disclosure</header>
						<paragraph id="H5F7E425504FD47A2837A34C9BADC208A"><enum>(1)</enum><header>Prohibition</header>
							<subparagraph id="H24C5E99D7C814A7CB33A727AB0D5DA52"><enum>(A)</enum><header>In
				general</header><text>If a certification is issued under subparagraph (B) and
				notice of the right to judicial review under paragraph (3) is provided, no
				governmental or private entity, or officer, employee, or agent thereof, that
				receives a request under subsection (a), shall disclose to any person that an
				authorized investigative agency described in subsection (a) has sought or
				obtained access to information under subsection (a).</text>
							</subparagraph><subparagraph id="HA8E8C5CD1A1240749DF291607CE4357D"><enum>(B)</enum><header>Certification</header><text>The
				requirements of subparagraph (A) shall apply if the head of an authorized
				investigative agency described in subsection (a), or a designee, certifies
				that, absent a prohibition of disclosure under this subsection, there may
				result—</text>
								<clause id="H310E34170420497693DD6BC718620E4B"><enum>(i)</enum><text>a
				danger to the national security of the United States;</text>
								</clause><clause id="HA01152D728BB4C67936E60B4018F7A78"><enum>(ii)</enum><text>interference with
				a criminal, counterterrorism, or counterintelligence investigation;</text>
								</clause><clause id="H59DB29FCFF874F5AA50CAB445FED2BDB"><enum>(iii)</enum><text>interference
				with diplomatic relations; or</text>
								</clause><clause id="HD30214DC0666401EA3D6D7735F459517"><enum>(iv)</enum><text>danger to the
				life or physical safety of any person.</text>
								</clause></subparagraph></paragraph><paragraph id="H89740097C205433C9CD58B670B1BDFAE"><enum>(2)</enum><header>Exception</header>
							<subparagraph id="H6B85D54C990F48CAB415B11D380ED666"><enum>(A)</enum><header>In
				general</header><text>A governmental or private entity, or officer, employee,
				or agent thereof, that receives a request under subsection (a) may disclose
				information otherwise subject to any applicable nondisclosure requirement
				to—</text>
								<clause id="H9974A0B1468F4E6F93420A6C569867DC"><enum>(i)</enum><text>those persons to
				whom disclosure is necessary in order to comply with the request;</text>
								</clause><clause id="H32650A21FD764558B79A686F45D86A6A"><enum>(ii)</enum><text>an attorney in
				order to obtain legal advice or assistance regarding the request; or</text>
								</clause><clause id="H742428CCE63949538275750B6FB04EC7"><enum>(iii)</enum><text>other persons as
				permitted by the head of the authorized investigative agency described in
				subsection (a).</text>
								</clause></subparagraph><subparagraph id="H73844A01A0DE475AA19B74AD86F158DE"><enum>(B)</enum><header>Persons
				necessary for compliance</header><text>Upon a request by the head of an
				authorized investigative agency described in subsection (a), or a designee,
				those persons to whom disclosure will be made under subparagraph (A)(i) or to
				whom such disclosure was made before the request shall be identified to the
				head of the authorized investigative agency or the designee.</text>
							</subparagraph><subparagraph id="H0D8F16692EBE4C8B9A2E232C423004AC"><enum>(C)</enum><header>Nondisclosure
				requirement</header><text>A person to whom disclosure is made under
				subparagraph (A) shall be subject to the nondisclosure requirements applicable
				to a person to whom a request is issued under subsection (a) in the same manner
				as the person to whom the request is issued.</text>
							</subparagraph><subparagraph id="H97D0A991058A489C966AA3AEC9970263"><enum>(D)</enum><header>Notice</header><text>Any
				recipient that discloses to a person described in subparagraph (A) information
				otherwise subject to a nondisclosure requirement shall inform the person of the
				applicable nondisclosure requirement.</text>
							</subparagraph></paragraph><paragraph id="HCFBF5D0517E74BEA96219CADE1B215AF"><enum>(3)</enum><header>Right to
				judicial review</header>
							<subparagraph id="H3F8492ECA3474CEFAE0859EA41AEF3E5"><enum>(A)</enum><header>In
				general</header><text>A governmental or private entity that receives a request
				under subsection (a) shall have the right to judicial review of any applicable
				nondisclosure requirement.</text>
							</subparagraph><subparagraph display-inline="no-display-inline" id="H2E8F242539154D469693D201D1EF9B2A"><enum>(B)</enum><header>Notification</header><text>A
				request under subsection (a) shall—</text>
								<clause id="HAAEE073097F448EEBC9853D32A5C4C6A"><enum>(i)</enum><text>state that if the
				recipient wishes to have a court review a nondisclosure requirement, the
				recipient shall provide notice to the Government in accordance with section
				3511(b)(1)(A) of title 18, United States Code; and</text>
								</clause><clause id="HCD9E11DA1DE94328865503D498D30C7B"><enum>(ii)</enum><text>describe the
				procedures for providing such notice.</text>
								</clause></subparagraph><subparagraph id="HBD5F71D954B444FE992562AF2C6395DB"><enum>(C)</enum><header>Initiation of
				proceedings</header><text>If a recipient of a request under subsection (a)
				makes a notification under subparagraph (B), the Government shall initiate
				judicial review under the procedures established in section 3511 of title 18,
				United States Code, unless an appropriate official of the authorized
				investigative agency described in subsection (a) makes a notification under
				paragraph (4).</text>
							</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H7D63C36645EE41A5AF611ED3F7F53F7C"><enum>(4)</enum><header>Termination</header><text>In
				the case of any request for which a governmental or private entity has
				submitted a notification under paragraph (3)(B), if the facts supporting a
				nondisclosure requirement cease to exist, an appropriate official of the
				authorized investigative agency described in subsection (a) shall promptly
				notify the governmental or private entity, or officer, employee, or agent
				thereof, subject to the nondisclosure requirement that the nondisclosure
				requirement is no longer in
				effect.</text>
						</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection></section><section commented="no" display-inline="no-display-inline" id="HF96AD825BE404FFA94B3451301884582" section-type="subsequent-section"><enum>6.</enum><header>Certification for
			 access to telephone toll and transactional records</header>
			<subsection commented="no" display-inline="no-display-inline" id="HF0D3357EADA54CFC96D4B40FDBAFAA20"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Section 2709 of title
			 18, United States Code, as amended by this Act, is amended—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="HC6FBB59F917F492FA68BEFF6F433EA1F"><enum>(1)</enum><text>by redesignating
			 subsections (c), (d), (e), and (f) as subsections (d), (e), (f), and (g),
			 respectively; and</text>

						</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="HA16A4A608A5E4DA1801C3B071BF95615"><enum>(b)</enum><header>Procedures
			 regarding information obtained through national security letters</header>
				<paragraph id="HD6D8D759267246ED8E059B6806983DEE"><enum>(1)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Not later than 90
			 days after the date of the enactment of this Act, the Attorney General
			 shall—</text>
					<subparagraph id="HCB1AFA97990C44A998FA26D77DC898D7"><enum>(A)</enum><text>establish
			 procedures for the collection, use, and storage of information obtained in
			 response to a national security letter; and</text>
					</subparagraph><subparagraph id="H755C85A061294F2BB3CAB4B7E2847899"><enum>(B)</enum><text>submit to the
			 appropriate congressional committees the procedures established under
			 subparagraph (A).</text>
					</subparagraph></paragraph><paragraph id="HA0F85FFE7E91431F92E8DD552583A0E3"><enum>(2)</enum><header>Revisions to
			 procedures</header><text>The Attorney General shall notify the appropriate
			 congressional committees of any significant changes to the procedures
			 established under paragraph (1)(A).</text>
				</paragraph><paragraph id="H4CE18451502448F7A08B37F9A63C7980"><enum>(3)</enum><header>Definitions</header><text>In
			 this subsection:</text>
					<subparagraph id="H3E9C3AC39D2348959E8DD7D9E893E289"><enum>(A)</enum><header>Appropriate
			 congressional committees</header><text>The term <quote>appropriate
			 congressional committees</quote> means—</text>
						<clause id="H1681DDBC74F54039BCB188E49CAE215E"><enum>(i)</enum><text>the
			 Permanent Select Committee on Intelligence and the Committee on the Judiciary
			 of the House of Representatives; and</text>

			 the Committee on the Judiciary of the Senate.</text>
						</clause></subparagraph><subparagraph display-inline="no-display-inline" id="H9B10956B165D4F7CB54BC666231DB05E"><enum>(B)</enum><header>National
			 security letter</header><text>the term <term>national security letter</term>
			 means a request for information issued under section 2709 of title 18, United
			 States Code, section 1114(a)(5) of the Right to Financial Privacy Act of 1978
			 (12 U.S.C. 3414(5)), subsection (a) or (b) of section 626 of the Fair Credit
			 Reporting Act (15 U.S.C. 1681u), or section 627 of the Fair Credit Reporting
			 Act (15 U.S.C. 1681v).</text>
					</subparagraph></paragraph></subsection></section><section id="H4E82317A1C97437D986798458BC2DB21"><enum>8.</enum><header>Lone wolf
			 terrorists as agents of foreign powers</header><text display-inline="no-display-inline">Section 104 of the Foreign Intelligence
			 Surveillance Act of 1978 (50 U.S.C. 1804) is amended by adding at the end the
			 following new subsection:</text>

				Attorney General may only delegate the authority to approve an application
				under subsection (a) for an order approving electronic surveillance of an agent

				General or the Assistant Attorney General for National Security.</text>
					</paragraph><paragraph id="HF94DEBB3BCE04D7A812FE1BE8A75FA12"><enum>(2)</enum><header>Notice to
				Congress</header><text>Not later than seven days after an application for an
				order approving electronic surveillance of an agent of a foreign power, as
				defined in section 101(b)(1)(C), is made under subsection (a), the Attorney
				General shall submit to the Permanent Select Committee on Intelligence and the
				Committee on the Judiciary of the House of Representatives and the Select
				Committee on Intelligence and the Committee on the Judiciary of the Senate
				notice of such
				application.</text>
					</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section display-inline="no-display-inline" id="HD3E2E620FDB64713971B9F0BA435D2B4" section-type="subsequent-section"><enum>9.</enum><header>Orders for pen
			 registers and trap and trace devices for foreign intelligence purposes</header>
			<subsection commented="no" display-inline="no-display-inline" id="HAC8B04D41F2044278DAB5C65CBB30454"><enum>(a)</enum><header display-inline="yes-display-inline">Application</header><text display-inline="yes-display-inline">Section 402(c) of the Foreign Intelligence
			 Surveillance Act of 1978 (50 U.S.C. 1842(c)) is amended—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="HCB80F3AFFA4D4F1DAB57DD4FC1F2E4C5"><enum>(1)</enum><text display-inline="yes-display-inline">in paragraph (1), by striking
			 <quote>and</quote> at the end;</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HD0BBBA9B1D674F0999AAB55A72F26886"><enum>(2)</enum><text display-inline="yes-display-inline">in paragraph (2)—</text>
					<subparagraph id="H1A9558004C1C425E92C286FDE713F304"><enum>(A)</enum><text>by striking
			 <quote>a certification by the applicant</quote> and inserting <quote>a
			 statement of the facts and circumstances relied upon by the applicant to
			 justify the belief of the applicant</quote>; and</text>
					</subparagraph><subparagraph id="HA51BD4C5936244338248626BC3F01FCF"><enum>(B)</enum><text>by striking the
			 period at the end and inserting <quote>; and</quote>; and</text>

				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H99916ACEDB3C4E278AC8B8E38DD27074"><enum>(b)</enum><header display-inline="yes-display-inline">Minimization</header>
				<paragraph commented="no" display-inline="no-display-inline" id="H120B10DB2751444989F7604C3112CC65"><enum>(1)</enum><header display-inline="yes-display-inline">Definition</header><text display-inline="yes-display-inline">Section 401 of the Foreign Intelligence
			 Surveillance Act of 1978 (50 U.S.C. 1841) is amended by adding at the end the
			 following:</text>
					<quoted-block display-inline="no-display-inline" id="HEF0181D14A20432082592F3C81D13041" style="OLC">
						<paragraph commented="no" display-inline="no-display-inline" id="H7C0300BAAA124B6C9FD414F60300591B"><enum>(4)</enum><text display-inline="yes-display-inline">The term <term>minimization
				procedures</term> means—</text>
							<subparagraph commented="no" display-inline="no-display-inline" id="H44052CF2990E4743BC90B5FE62E3D4F9"><enum>(A)</enum><text display-inline="yes-display-inline">specific procedures, that are reasonably
				designed in light of the purpose and technique of an order for the installation
				and use of a pen register or trap and trace device, to minimize the retention,
				and prohibit the dissemination, of nonpublicly available information known to
				concern unconsenting United States persons consistent with the need of the
				United States to obtain, produce, and disseminate foreign intelligence
				information;</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H5C561F16C1D84F14A520F4E2E05D6DAF"><enum>(B)</enum><text display-inline="yes-display-inline">procedures that require that nonpublicly
				available information, which is not foreign intelligence information, as
				defined in section 101(e)(1), shall not be disseminated in a manner that
				identifies any United States person, without such person’s consent, unless such
				person’s identity is necessary to understand foreign intelligence information
				or assess its importance; and</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HA79B63BBE3B745CCB8421B3173E26E35"><enum>(C)</enum><text display-inline="yes-display-inline">notwithstanding subparagraphs (A) and (B),
				procedures that allow for the retention and dissemination of information that
				is evidence of a crime which has been, is being, or is about to be committed
				and that is to be retained or disseminated for law enforcement
				purposes.</text>
							</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H349F32FBDAFF4368B8914462D602D1AF"><enum>(2)</enum><header display-inline="yes-display-inline">Pen registers and trap and trace
			 devices</header><text display-inline="yes-display-inline">Section 402 of the
			 Foreign Intelligence Surveillance Act of 1978 (50 U.S.C. 1842) is
			 amended—</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="HDC6690627AB4466FB3B9403D48F2ACB1"><enum>(A)</enum><text display-inline="yes-display-inline">in subsection (d)—</text>
						<clause commented="no" display-inline="no-display-inline" id="H38E024ADAAF74CA584FE50899BF4D54F"><enum>(i)</enum><text display-inline="yes-display-inline">in paragraph (1), by inserting <quote>, and
			 if, in exceptional circumstances, minimization procedures are ordered, that the
			 proposed minimization procedures meet the definition of minimization procedures
			 under this title</quote> before the period at the end; and</text>
						</clause><clause commented="no" display-inline="no-display-inline" id="H05F69A9BADD14C3DACFD7C7B04B7852C"><enum>(ii)</enum><text display-inline="yes-display-inline">in paragraph (2)(B)—</text>
							<subclause commented="no" display-inline="no-display-inline" id="HF6382C4289F9411A920FB481995C330B"><enum>(I)</enum><text display-inline="yes-display-inline">in clause (ii)(II), by striking
			 <quote>and</quote> after the semicolon; and</text>
							</subclause><subclause commented="no" display-inline="no-display-inline" id="H07BDFC847E6B45C4B3DBF7FCE4EBD2A6"><enum>(II)</enum><text display-inline="yes-display-inline">by adding at the end the following:</text>
								<quoted-block display-inline="no-display-inline" id="H4A8432A0C44544A1B693973BC0ED1207" style="OLC">
									<clause commented="no" display-inline="no-display-inline" id="HA583138716DA47A0B77D61DDE114793A"><enum>(iv)</enum><text display-inline="yes-display-inline">if applicable, the minimization procedures
				be followed; and</text>
									</clause><after-quoted-block>;
				and</after-quoted-block></quoted-block>
							</subclause></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HA444FF30669E492C87B44F6C279274E3"><enum>(B)</enum><text display-inline="yes-display-inline">by adding at the end the following:</text>
						<quoted-block display-inline="no-display-inline" id="H14668FD278CD4AF6A3DD1190F3C2C9AD" style="OLC">
							<subsection commented="no" display-inline="no-display-inline" id="H8F8F3A6FE1274969941B5073D8D5F72B"><enum>(h)</enum><text display-inline="yes-display-inline">At or before the end of the period of time
				for which the installation and use of a pen register or trap and trace device
				is approved under an order or an extension under this section, the judge may
				assess compliance with any applicable minimization procedures by reviewing the
				circumstances under which information concerning United States persons was
				retained or
				disseminated.</text>
							</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HCA2D4B5530644B828C72502163EE5BA6"><enum>(3)</enum><header display-inline="yes-display-inline">Emergencies</header><text display-inline="yes-display-inline">Section 403 of the Foreign Intelligence
			 Surveillance Act of 1978 (50 U.S.C. 1843) is amended—</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="HA3A2FF7EC4E347C1A4AB3E24B16CE1BF"><enum>(A)</enum><text display-inline="yes-display-inline">by redesignating subsection (c) as
			 subsection (d); and</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HF9F5200F613240DB9FAA8A319E51A276"><enum>(B)</enum><text display-inline="yes-display-inline">by inserting after subsection (b) the
			 following:</text>
						<quoted-block display-inline="no-display-inline" id="HAB8FA68A069F4F6289102E1A96F58538" style="OLC">
							<subsection commented="no" display-inline="no-display-inline" id="H8C1BAA9109564F2D99002BA713015225"><enum>(c)</enum><text display-inline="yes-display-inline">If the Attorney General authorizes the
				emergency installation and use of a pen register or trap and trace device under
				this section, the Attorney General shall require that minimization procedures
				be followed, if
				appropriate.</text>
							</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HC6F716A7879E4329BCA8E3E3903A4AFC"><enum>(4)</enum><header display-inline="yes-display-inline">Use of information</header><text display-inline="yes-display-inline">Section 405(a)(1) of the Foreign
			 Intelligence Surveillance Act of 1978 (50 U.S.C. 1845(a)(1)) is amended by
			 inserting <quote>or minimization procedures required under this title, if
			 ordered or determined appropriate by the Attorney General under section
			 403(c)</quote> after <quote>provisions of this section</quote> .</text>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H195B05C46D434FE59EAD1089F3E01101"><enum>(c)</enum><header>Audits</header>
				<paragraph id="H5DD38A141B17410B80AE9ECC7A8D03F8"><enum>(1)</enum><header>In
			 general</header><text>The Inspector General of the Department of Justice shall
			 perform comprehensive audits of the effectiveness and use, including any
			 improper or illegal use, of pen registers and trap and trace devices under
			 title IV of the Foreign Intelligence Surveillance Act of 1978 (50 U.S.C. 1841
			 et seq.) during the period beginning on January 1, 2007, and ending on December
			 31, 2013.</text>
				</paragraph><paragraph id="HA013CE78CA854E0CA0EA35CFF88D0518"><enum>(2)</enum><header>Requirements</header><text>The
			 audits required under paragraph (1) shall include—</text>
					<subparagraph id="H1F3480BA14D249B8B57EC4BE58CFDC1B"><enum>(A)</enum><text>an examination of
			 the use of pen registers and trap and trace devices under title IV of the
			 Foreign Intelligence Surveillance Act of 1978 for calendar years 2007 through
			 2013;</text>
					</subparagraph><subparagraph id="HE530D2AFB82449B382621CC0307E9440"><enum>(B)</enum><text>an examination of
			 the installation and use of a pen register or trap and trace device on
			 emergency bases under section 403 of the Foreign Intelligence Surveillance Act
			 of 1978 (50 U.S.C. 1843);</text>
					</subparagraph><subparagraph id="H46C7857955144A9CB45F1AD31102008B"><enum>(C)</enum><text>any noteworthy
			 facts or circumstances relating to the use of a pen register or trap and trace
			 device under title IV of the Foreign Intelligence Surveillance Act of 1978,
			 including any improper or illegal use of the authority provided under that
			 title; and</text>
					</subparagraph><subparagraph id="H9C3B53DAC223403D9944C39066C1EDFA"><enum>(D)</enum><text>an examination of
			 the effectiveness of the authority under title IV of the Foreign Intelligence
			 Surveillance Act of 1978 as an investigative tool, including—</text>
						<clause id="H9727B47DF0F94866BB54AF79F53D3357"><enum>(i)</enum><text>the
			 importance of the information acquired to the intelligence activities of the
			 Federal Bureau of Investigation or any other department or agency of the
			 Federal Government;</text>
						</clause><clause id="HC7C4A204E2E64DE4AA7F91B8B8B672EE"><enum>(ii)</enum><text>the
			 manner in which the information is collected, retained, analyzed, and
			 disseminated by the Federal Bureau of Investigation, including any direct
			 access to the information provided to any other department, agency, or
			 instrumentality of Federal, State, local, or tribal governments or any private
			 sector entity;</text>
						</clause><clause id="H8A1A8139AA0746538F84A6DF8CDDE853"><enum>(iii)</enum><text>with respect to
			 calendar years 2010 through 2013, an examination of the minimization procedures
			 used in relation to pen registers and trap and trace devices under title IV of
			 the Foreign Intelligence Surveillance Act of 1978 and whether the minimization
			 procedures protect the constitutional rights of United States persons (as
			 defined in section 101 of the Foreign Intelligence Surveillance Act of 1978 (50
			 U.S.C. 1801));</text>
						</clause><clause id="H5BD90C99B0FF444FA1AE5CE5626650A4"><enum>(iv)</enum><text>whether, and how
			 often, the Federal Bureau of Investigation used information acquired under a
			 pen register or trap and trace device under title IV of the Foreign
			 Intelligence Surveillance Act of 1978 to produce an analytical intelligence
			 product for distribution within the Federal Bureau of Investigation, to the
			 intelligence community (as defined in section 3(4) of the National Security Act
			 of 1947 (50 U.S.C. 401a(4))), or to other Federal, State, local, or tribal
			 government departments, agencies, or instrumentalities; and</text>
						</clause><clause id="H33E78B1E22354E4AA42DBCC5461E559E"><enum>(v)</enum><text>whether, and how
			 often, the Federal Bureau of Investigation provided information acquired under
			 a pen register or trap and trace device under title IV of the Foreign
			 Intelligence Surveillance Act of 1978 to law enforcement authorities for use in
			 criminal proceedings.</text>
						</clause></subparagraph></paragraph><paragraph id="H4B2C111A66C44ED88BE63F43A35815F0"><enum>(3)</enum><header>Submission
			 dates</header>
					<subparagraph id="H0C24CEBBB7BF47D9B2F50F5564D0BD51"><enum>(A)</enum><header>Prior
			 years</header><text>Not later than December 31, 2010, the Inspector General of
			 the Department of Justice shall submit to the Committee on the Judiciary and
			 the Select Committee on Intelligence of the Senate and the Committee on the
			 Judiciary and the Permanent Select Committee on Intelligence of the House of
			 Representatives a report containing the results of the audit conducted under
			 this section for calendar years 2007 through 2009.</text>
					</subparagraph><subparagraph id="H6A276BE048BE4FF090C8278DC7380C9F"><enum>(B)</enum><header>Calendar years
			 2010 and 2011</header><text>Not later than December 31, 2012, the Inspector
			 General of the Department of Justice shall submit to the Committee on the
			 Judiciary and the Select Committee on Intelligence of the Senate and the
			 Committee on the Judiciary and the Permanent Select Committee on Intelligence
			 of the House of Representatives a report containing the results of the audit
			 conducted under this section for calendar years 2010 and 2011.</text>
					</subparagraph><subparagraph id="H54F77D4D5EE34F5DBA9C014B17782C26"><enum>(C)</enum><header>Calendar years
			 2012 and 2013</header><text>Not later than December 31, 2014, the Inspector
			 General of the Department of Justice shall submit to the Committee on the
			 Judiciary and the Select Committee on Intelligence of the Senate and the
			 Committee on the Judiciary and the Permanent Select Committee on Intelligence
			 of the House of Representatives a report containing the results of the audit
			 conducted under this section for calendar years 2010 and 2011.</text>
					</subparagraph></paragraph><paragraph id="HBA6D3E02DBC2494E9D0B49164AE7B367"><enum>(4)</enum><header>Prior notice to
			 Attorney General and Director of National Intelligence; comments</header>
					<subparagraph id="HEE1F140434D2464AA81BA722B76AB07D"><enum>(A)</enum><header>Notice</header><text>Not
			 less than 30 days before the submission of a report under subparagraph (A),
			 (B), or (C) of paragraph (3), the Inspector General of the Department of
			 Justice shall provide the report to the Attorney General and the Director of
			 National Intelligence.</text>
					</subparagraph><subparagraph id="H04AFDD8B21CD4C099A13063B705DCD25"><enum>(B)</enum><header>Comments</header><text display-inline="yes-display-inline">The Attorney General or the Director of
			 National Intelligence may provide such comments to be included in a report
			 submitted under subparagraph (A), (B), or (C) of paragraph (3) as the Attorney
			 General or the Director of National Intelligence may consider necessary.</text>
					</subparagraph></paragraph><paragraph id="H9F04DDD19FAF4AD69AEDAF030FA447B1"><enum>(5)</enum><header>Unclassified
			 form</header><text display-inline="yes-display-inline">A report submitted under
			 subparagraph (A), (B), or (C) of paragraph (3) and any comments included under
			 paragraph (4)(B) shall be in unclassified form, but may include a classified
			 annex.</text>
