		<official-title>To establish a moratorium on credit card interest rate
		  increases, and for other purposes.</official-title>

		<section id="H65FD109F7DFF4FF5AEC0181F80FFF1DB" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Credit Card Rate Freeze Act of
			 2009</short-title></quote>.</text>
		</section><section id="HE0311CE6B4CE46D6B81E40A30F0E2AC5"><enum>2.</enum><header>Moratorium on
			 rate increases</header><text display-inline="no-display-inline">During the
			 period beginning on the date of enactment of this Act and ending 9 months after
			 the date of the enactment of the Credit Card Accountability Responsibility and
			 Disclosure Act of 2009, in the case of any credit card account under an open
			 end consumer credit plan—</text>
			<paragraph id="H6BA640806686477F924A4523B4040306"><enum>(1)</enum><text>no creditor may
			 increase any annual percentage rate, fee, or finance charge applicable to any
			 outstanding balance, except as permitted under subsection 171(b) of the Truth
			 in Lending Act (as added by Public Law 111–24); and</text>
			</paragraph><paragraph id="H9318E19C2A3F428982314DE2ED928A03"><enum>(2)</enum><text>no creditor may
			 change the terms governing the repayment of any outstanding balance, except as
			 set forth in section 171(c) of the Truth in Lending Act (as added by Public Law
			 111–24).</text>
			</paragraph></section><section id="H9C8464C925E94E8884728E11F46CFE3B"><enum>3.</enum><header>Defined
			 terms</header><text display-inline="no-display-inline">For purposes of this
			 Act, the following definitions shall apply:</text>
			<paragraph id="HBFE50B174A5D401CBD714E95D096DC32"><enum>(1)</enum><header>Annual
			 percentage rate</header><text>The term <term>annual percentage rate</term>
			 means an annual percentage rate, as determined under section 107 of the Truth
			 in Lending Act (15 U.S.C. 1606).</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H6D1AE488DE65466AA0964A45272A4FA4"><enum>(2)</enum><header>Finance
			 charge</header><text>The term <term>finance charge</term> means a finance
			 charge, as determined under section 106 of the Truth in Lending Act (15 U.S.C.
			 1605).</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H6866AEE4333A4EAD8CE57105C8CF8BE6"><enum>(3)</enum><header>Outstanding
			 balance</header><text>The term <term>outstanding balance</term> has the same
			 meaning as in section 171(d) of the Truth in Lending Act (as added by Public
			 Law 111–24).</text>
			</paragraph><paragraph id="H3C83B615BD1C4AEB8CCE37B33297EEA1"><enum>(4)</enum><header>Other
			 terms</header><text display-inline="yes-display-inline">Any term used in this
			 Act that is defined in section 103 of the Truth in Lending Act (15 U.S.C. 1602)
			 and is not otherwise defined in this Act shall have the same meaning in such
			 section.</text>
			</paragraph></section><section id="H7934CBC3C65B45568859516AD39CA007"><enum>4.</enum><header>Regulatory
			 authority</header>
			<subsection id="H405D8D84F1AE4CE7A0781AF60F789526"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">The Board of
			 Governors of the Federal Reserve System may prescribe such regulations as may
			 be necessary to carry out this Act.</text>
			</subsection><subsection id="H74BE418380C24940A38EF734A63B087B"><enum>(b)</enum><header>Date of
			 enactment</header><text>The provisions of this Act shall take effect upon the
			 date of the enactment of this Act, regardless of whether rules are issued under
			 subsection (a).</text>
