		<official-title>To expand the authority of the Secretary of Health and
		  Human Services to impose debarments in order to ensure the integrity of drug,
		  biological product, and device regulation, and for other
		  purposes.</official-title>

		<section id="HF024364B6CAD47B2AC2884C3E7B3E280" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Strengthening of FDA Integrity Act of
			 2009</short-title></quote>.</text>
		</section><section id="H70C864C8EFDC4EF7B506F9EA1CF11C47"><enum>2.</enum><header>Debarment</header>
			<subsection id="H8EEB4C2466A743C8971C1C49D5E480B6"><enum>(a)</enum><header>Application to
			 drugs, biological products, and devices</header><text display-inline="yes-display-inline">The Federal Food, Drug, and Cosmetic Act
			 (21 U.S.C. 301 et seq.) is amended—</text>
				<paragraph id="H08E6C962AE554FE8A956C95229E5048C"><enum>(1)</enum><text>in section 201, by
			 amending subsection (dd) to read as follows:</text>
					<quoted-block display-inline="no-display-inline" id="H886EFD7D2EE44B8F958D4299E0B77669" style="OLC">
						<subsection id="HCDE4C7E41FEF47BA90AAEBCBFB60086"><enum>(dd)</enum><text display-inline="yes-display-inline">The term <term>drug product</term>—</text>
							<paragraph id="HC575D99D710D411CB4C7801F782217D5"><enum>(1)</enum><text>for purposes of
				sections 306 and 307, means a drug subject to regulation under section 505,
				512, or 802 of this Act or under section 351 of the Public Health Service Act;
				and</text>
							</paragraph><paragraph id="H15CF11CF28D84C218CA92654B7763203"><enum>(2)</enum><text>for purposes of
				section 306, includes a device subject to regulation under section 513 of this
				Act.</text>
							</paragraph></subsection><after-quoted-block>;
				and</after-quoted-block></quoted-block>
				</paragraph><paragraph id="HE08597A4600C4D56A0B75DEE9030E8B6"><enum>(2)</enum><text>in section
			 306—</text>
					<subparagraph id="HDE3AED317CD9437E92C6923681BC5C"><enum>(A)</enum><text>by striking the term
			 <term>an abbreviated drug application</term> each place such term appears and
			 inserting <quote>a covered application</quote>;</text>
					</subparagraph><subparagraph id="H840BD9B8B1674090A900A875E2DDB793"><enum>(B)</enum><text>by striking the
			 terms <term>abbreviated drug application</term> and <term>abbreviated drug
			 applications</term> each place either such term appears and inserting
			 <quote>covered application</quote> and <quote>covered applications</quote>,
			 respectively;</text>
					</subparagraph><subparagraph id="H10B96548B8D54E819C13471567FD6067"><enum>(C)</enum><text>by striking the
			 term <term>drug product application</term> each place such term appears and
			 inserting <quote>covered application</quote>;</text>
					</subparagraph><subparagraph id="H40A482F4B69C439EA312106FEA3200BB"><enum>(D)</enum><text display-inline="yes-display-inline">in the heading of subsections (a) and (b),
			 by striking <quote><header-in-text level="subsection" style="OLC">Certain Drug
			 Applications</header-in-text></quote> and inserting <quote><header-in-text level="subsection" style="OLC">Certain Drug Product
			 Applications</header-in-text></quote>;</text>
					</subparagraph><subparagraph id="HB5ACB9F2EEED44B1BFC5C3667496101E"><enum>(E)</enum><text>in subsection
			 (b)(2)(B)(i), by striking <quote>the process for the regulation of
			 drugs</quote> and inserting <quote>the process for the regulation of drug
			 products</quote>;</text>
					</subparagraph><subparagraph id="H2DB2443252BE4BC882757D4DC497FD58"><enum>(F)</enum><text display-inline="yes-display-inline">in subsection (d)(4)(B)(ii), by striking
			 <quote>of any drug subject to sections 505</quote> and inserting <quote>of any
			 drug product</quote>;</text>
					</subparagraph><subparagraph id="HF5D65E11381840DE90FA3172D0BDFBF8"><enum>(G)</enum><text display-inline="yes-display-inline">in subsections (b)(2)(A), (b)(2)(B)(iv),
			 (c)(3)(C), (c)(3)(E), (d)(3)(A)(ii)(II), (d)(3)(B)(ii), (d)(4)(B)(iv),
			 (d)(4)(D)(ii), (f)(1)(B)(ii), (g), and (h), by striking the terms
			 <term>drug</term> and <term>drugs</term> each place either such term appears
			 and inserting <quote>drug product</quote> and <quote>drug products</quote>,
			 respectively; and</text>
					</subparagraph><subparagraph id="H15D76ACFD0FF45B193008225B049DE28"><enum>(H)</enum><text>by adding at the
			 end the following:</text>
						<quoted-block display-inline="no-display-inline" id="H317C1C86C10A4DE19624D2ECD8439CFA" style="OLC">
							<subsection id="H29F1A1F6985A4AAC937CE6D1D1E1CFA5"><enum>(n)</enum><header>Covered
				application defined</header><text display-inline="yes-display-inline">In this
				section, the term <term>covered application</term> means—</text>
								<paragraph id="HFEB50858157C4689AD119325CEDE1E34"><enum>(1)</enum><text>an application for
				approval or licensure of a drug under section 505 of this Act or section 351 of
				the Public Health Service Act, respectively; or</text>
								</paragraph><paragraph id="H74EFD632776F49DAAFA75176F960457"><enum>(2)</enum><text>an application for
				clearance or approval of a device under section 510(k) or 515 of this Act,
				respectively.</text>
								</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
					</subparagraph></paragraph></subsection><subsection id="HE3A45432DA9D4C92AA3B8407EB0AFF1"><enum>(b)</enum><header>Mandatory
			 debarment</header><text display-inline="yes-display-inline">Paragraph (1) of
			 section 306(a) of the Federal Food, Drug, and Cosmetic Act (21 U.S.C. 335a(a))
			 is amended to read as follows:</text>
				<quoted-block display-inline="no-display-inline" id="HA5B7342646C6494BB27380F702E2AFC5" style="OLC">
					<paragraph id="H828C1B0BBFD8415EB328A537AB89F33D"><enum>(1)</enum><header>Corporations,
				partnerships, and associations</header><text display-inline="yes-display-inline">If the Secretary finds that a person other
				than an individual has been convicted, after May 13, 1992, of a felony under
				Federal law for conduct—</text>
						<subparagraph id="HE75F27D8393240A7B936031CB2802DED"><enum>(A)</enum><text>relating to the
				development or approval, including the process for development or approval, of
				any drug product, or</text>
						</subparagraph><subparagraph id="HAF6173FE043740219653D55737542F8D"><enum>(B)</enum><text>otherwise relating
				to the regulation of any drug product under this Act or subpart 1 of part F of
				title III of the Public Health Service Act,</text>
						</subparagraph><continuation-text continuation-text-level="paragraph">the
				Secretary shall debar such person from submitting, or assisting in the
				submission of, any covered
				application.</continuation-text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H66633AD4DA114C9DB4E57347007BD5D7"><enum>(c)</enum><header>Permissive
			 debarment</header><text display-inline="yes-display-inline">Section 306(b)(2)
			 of the Federal Food, Drug, and Cosmetic Act (21 U.S.C. 335a(b)(2)) is
			 amended—</text>
				<paragraph id="H2B81A9637C7E4C1A992466BCADD0BC16"><enum>(1)</enum><text>in subparagraph
			 (A)(i), by amending subclause (I) to read as follows:</text>
					<quoted-block display-inline="no-display-inline" id="H8A554BA0BB2F40448606CE2DC9FA292" style="OLC">
						<subclause id="H2E8D1C12E7DF478FBE6397CDCC4D874B"><enum>(I)</enum><text display-inline="yes-display-inline">relates to the development or approval,
				including the process for development or approval, of any drug product or
				otherwise relates to the regulation of drug products under this Act or subpart
				1 of part F of title III of the Public Health Service Act,
				and</text>
						</subclause><after-quoted-block>;</after-quoted-block></quoted-block>
				</paragraph><paragraph id="H5D31CFEDD10E4A64B0D6173EA34726D8"><enum>(2)</enum><text>in subparagraph
			 (B)—</text>
					<subparagraph id="H8CF050209BBB4967A746BE7CA41266AF"><enum>(A)</enum><text>by striking
			 clauses (ii) and (iii); and</text>
					</subparagraph><subparagraph id="H155ACB9A6578443C85E58C8873D2F280"><enum>(B)</enum><text>by redesignating
			 clause (iv) as clause (ii); and</text>
					</subparagraph></paragraph><paragraph id="H213B6DE077C54A0A9EADFCED194B9919"><enum>(3)</enum><text>by adding at the
			 end the following:</text>
					<quoted-block display-inline="no-display-inline" id="HE727D12F453F43FF9BA148F7DF05C899" style="OLC">
						<subparagraph id="H482AC5E2B1F945DD91BB09E890B0B000"><enum>(C)</enum><header>Bribery, fraud,
				and other such crimes</header><text display-inline="yes-display-inline">Any
				person (including any individual) whom the Secretary finds has been convicted
				of—</text>
							<clause id="H1E8544F55D6144B791D956EE53362312"><enum>(i)</enum><text>a
				felony which is not described in paragraph (1) or (2) of subsection (a) or in
				subparagraph (A) or (B)(i) of this subsection and which involves bribery,
				payment of illegal gratuities, fraud, perjury, false statement, racketeering,
				blackmail, extortion, falsification or destruction of records, or interference
				with or obstruction of an investigation into, or prosecution of, any criminal
				offense, or</text>
							</clause><clause id="HD18F2B4982014790BFD8D902D20764EA"><enum>(ii)</enum><text>a
				conspiracy to commit, or aiding or abetting such felony,</text>
							</clause><continuation-text continuation-text-level="subparagraph">if the
				Secretary finds, on the basis of the conviction of such person and other
				information, that such person has demonstrated a pattern of conduct sufficient
				to find that there is reason to believe that such person may violate
				requirements under this Act or subpart 1 of part F of title III of the Public
				Health Service Act relating to drug products.</continuation-text></subparagraph><subparagraph id="H136D26C809E44410B99B13C644CA984"><enum>(D)</enum><header>Material
				participation</header><text display-inline="yes-display-inline">Any person
				(including any individual) whom the Secretary finds materially participated in
				acts that were the basis for a conviction for an offense described in paragraph
				(1) or (2) of subsection (a) or in subparagraph (A), (B)(i), or (C) of this
				subsection for which a conviction was obtained, if the Secretary finds, on the
				basis of such participation and other information, that such individual has
				demonstrated a pattern of conduct sufficient to find that there is reason to
				believe that such person may violate requirements under this Act or subpart 1
				of part F of title III of the Public Health Service Act relating to drug
				products.</text>
						</subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="H4DC5201D0F8D4596A21E0100BD79A44C"><enum>(d)</enum><header>Additional
			 Debarment consideration</header><text>Paragraph (3) of subsection (c) of
			 section 306 of the Federal Food, Drug, and Cosmetic Act (21 U.S.C. 335a(c)(3))
			 is amended—</text>
				<paragraph id="H07D88F22323F4320BEE784F2552CE69"><enum>(1)</enum><text>by
			 striking <quote>and</quote> at the end of subparagraph (E);</text>
				</paragraph><paragraph id="H299744C082F849B7A34090EFF874C979"><enum>(2)</enum><text>by striking the
			 period at the end of subparagraph (F) and inserting <quote>, and</quote>;
			 and</text>
				</paragraph><paragraph id="HE4D9F4FA0D3E46F5B275609DA1D2A0A5"><enum>(3)</enum><text>by adding at the
			 end the following new subparagraph:</text>
					<quoted-block display-inline="no-display-inline" id="HB82864958CB947248B8387A003E8467" style="OLC">
						<subparagraph id="H9AC21F54D181476E9CE8B8566EB1711B"><enum>(G)</enum><text display-inline="yes-display-inline">whether debarment of the person will affect
				the public health because sufficient quantities of the drug product would not
				be
				available.</text>
						</subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="H64A86C1B531D4AE4BF00E4484356B064"><enum>(e)</enum><header>Effective
			 dates</header><text>Paragraph (2) of section 306(l) of the Federal Food, Drug,
			 and Cosmetic Act (21 U.S.C. 335a(l)) is amended by striking the phrase
			 <quote>occurred more than 5 years before</quote> each place such phrase appears
			 and inserting <quote>occurred more than 1 year before</quote>.</text>
			</subsection><subsection id="HDBAD151102D44F93B9A215900F4BE5E"><enum>(f)</enum><header>Annual
			 report</header><text display-inline="yes-display-inline">Section 306 of the
			 Federal Food, Drug, and Cosmetic Act (21 U.S.C. 335a) is amended by adding at
			 the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="HEBE049B22277485DAD00698E101ED08E" style="OLC">
					<subsection id="HFCE0A0DE4BFA4DFFBAFBB401AA92668E"><enum>(o)</enum><header>Annual
				report</header><text>Each year, the Secretary shall submit a report to the
				Congress on implementation of this section. Each such report shall
				identify—</text>
						<paragraph id="H0515B53CD1CE47D6935517A9D5AC59B"><enum>(1)</enum><text>debarment
				proceedings mandated under subsection (a) or (m);</text>
						</paragraph><paragraph id="H0B0A68CDCFD34B2A9D148B626E992B28"><enum>(2)</enum><text>debarment
				proceedings initiated under subsection (a), (b), or (m);</text>
						</paragraph><paragraph id="HAACFDB9C981C44C6BF9FDF00E300645C"><enum>(3)</enum><text>the status of
				debarment proceedings so initiated or pending from a previous year;</text>
						</paragraph><paragraph id="H1257AD339FE9404AA44EE2F8126363E6"><enum>(4)</enum><text>debarments imposed
				under this section; and</text>
						</paragraph><paragraph id="HA8606702E7154C8F93625CADE6C02993"><enum>(5)</enum><text>debarments
				declined under this
				section.</text>
						</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H6E7EEDB7736B4D36BCA0F61D593D93F0"><enum>(g)</enum><header>Conforming
			 amendments</header><text display-inline="yes-display-inline">Section 306 of the
			 Federal Food, Drug, and Cosmetic Act (21 U.S.C. 335a) is amended—</text>
				<paragraph id="HF512F6B2999E41AE8F267625C3833D8C"><enum>(1)</enum><text>in subsections
			 (a)(2)(B) and (h)(1)(A), by striking <quote>this Act</quote> and inserting
			 <quote>this Act or subpart 1 of part F of title III of the Public Health
			 Service Act</quote>;</text>
				</paragraph><paragraph commented="no" id="HBCF2F70F7F8244B8865204D205349DC6"><enum>(2)</enum><text>in subsection
			 (b)(2)(A)(i)(II), by striking <quote>the date of the enactment of this
			 section</quote> and inserting <quote>May 13, 1992</quote>;</text>
				</paragraph><paragraph id="H82206A1B68B44284BB572C19195DD33F"><enum>(3)</enum><text>in subsection
			 (b)(4), by striking <quote>clause (iii) or (iv) of paragraph (2)(B)</quote> and
			 inserting <quote>subparagraph (B)(ii) or (D) of paragraph (2)</quote>;</text>
