		<official-title>To extend for 6 months the maximum COBRA continuation
		  coverage period for individuals who were involuntarily terminated between April
		  1, 2009, and December 31, 2009, and to amend the American Reinvestment and
		  Recovery Act of 2009 to extend the eligibility period and maximum assistance
		  period for COBRA premium assistance under such Act.</official-title>

		<section id="HB0A93E31F87E4229BF27082F7D2DD15D" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Extended COBRA Continuation Protection
			 Act of 2009</short-title></quote>.</text>
		</section><section id="H18347067A5EC44D4885480425F5B1937"><enum>2.</enum><header>6-month extension
			 of COBRA continuation coverage for individuals involuntarily terminated between
			 April 1, 2008, and December 31, 2008.</header>
			<subsection id="HC723632B50A7464ABDAF63337BBD40CE"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">In applying a COBRA
			 continuation provision (as defined in section 2791(d)(4) of the Public Health
			 Service Act (42 U.S.C. 300gg–91(d)(4))) to an individual whose COBRA
			 continuation coverage was a consequence of a termination (or reduction of
			 hours) of employment occurring on or after April 1, 2008, and before January 1,
			 2010, if the maximum required period of COBRA continuation coverage is 18
			 months, such period is extended to 24 months.</text>
			</subsection><subsection commented="no" id="HB5C6444F7F6B43AB940BC482EC6E0113"><enum>(b)</enum><header>Transitional
			 rule</header>
				<paragraph commented="no" id="HA8306381CF54451A9200362148211CFA"><enum>(1)</enum><header>In
			 general</header><text display-inline="yes-display-inline">In the case of an
			 individual described in paragraph (2), under rules established jointly by the
			 Secretaries of Health and Human Services, Treasury, and Labor, the individual
			 may elect to continue and extend such coverage under the provisions of
			 subsection (a) through an election similar to the election permitted under
			 section 3001(a)(4)(A) of division B of the American Reinvestment and Recovery
			 Act of 2009. In no case shall the extended period of continuation under this
			 paragraph exceed 6 months.</text>
				</paragraph><paragraph commented="no" id="HB39A0E340930408D8A245DF2357BE0A9"><enum>(2)</enum><header>Individual
			 described</header><text display-inline="yes-display-inline">An individual
			 described in this paragraph is an individual whose COBRA continuation coverage
			 —</text>
					<subparagraph commented="no" id="H21527C0486C145AD82485AFA6DAA31BD"><enum>(A)</enum><text>is described in
			 subsection (a);</text>
					</subparagraph><subparagraph commented="no" id="H1A8043245E76498E8B4AAC9AE07C5B67"><enum>(B)</enum><text>expired by virtue
			 of reaching the maximum required period of continuation coverage before the
			 date of the enactment of this Act; and</text>
					</subparagraph><subparagraph commented="no" id="H4FFFEDC8A64B4A3E93EF3C1AC2917380"><enum>(C)</enum><text>would, but for the
			 application of such maximum required period of such continuation coverage, had
			 continued after such date.</text>
					</subparagraph></paragraph></subsection></section><section id="H74708261459047B591BE94008FD21DFA"><enum>3.</enum><header>Extension of
			 COBRA premium assistance under ARRA</header>
			<subsection id="H83CA2969365A4FB191C545008D0FDDC5"><enum>(a)</enum><header>Extension of
			 period for individuals To qualify as assistance eligible
			 individuals</header><text display-inline="yes-display-inline">Subsection
			 (a)(3)(A) of section 3001 of division B of the American Recovery and
			 Reinvestment Act of 2009 (Public Law 111–5) is amended by striking
			 <quote>December 31, 2009</quote> and inserting <quote>June 30,
			 2010</quote>.</text>
			</subsection><subsection id="HB4C490DA5B9747AF8B13A6A3744DBFBD"><enum>(b)</enum><header>Extension of
			 maximum period of COBRA premium assistance</header><text>Subsection
			 (a)(2)(A)(ii) of such section is amended—</text>
				<paragraph id="H8CD48CD3585549F0A13E4EF001B34B9E"><enum>(1)</enum><text>in subclause (I),
			 by striking <quote>9 months</quote> and inserting <quote>15
			 months</quote>;</text>
				</paragraph><paragraph id="H94A0B3E45ED146B382B50BEC72916E18"><enum>(2)</enum><text>by striking
			 <quote>or</quote> at the end of subclause (II);</text>
				</paragraph><paragraph id="H22565FDEE7C1432580C9533582A8B193"><enum>(3)</enum><text>by striking the
			 period at the end of subclause (III) and inserting <quote>, or</quote>;
			 and</text>
				</paragraph><paragraph id="HFE919DC08DF44F3A95375E139D94780B"><enum>(4)</enum><text>by adding at the
			 end the following new subclause:</text>
					<quoted-block display-inline="no-display-inline" id="HBC81931C22B04DEA982B98C9AA848FC7" style="OLC">
						<subclause id="H24D1BDB1E0054C3488CA87AEECFDEA63"><enum>(IV)</enum><text display-inline="yes-display-inline">December 31,
				2010.</text>
						</subclause><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="H38864EA666F04760B27C37B337BB4DF4"><enum>(c)</enum><header>Effective
			 date</header><text display-inline="yes-display-inline">The amendments made by
			 this section shall be effective as if included in the enactment of the American
			 Recovery and Reinvestment Act of 2009 (Public Law 111–5).</text>
