		<official-title>To amend the Federal Water Pollution Control Act to
		  improve and reauthorize the Chesapeake Bay Program.</official-title>

		<section id="HB6E39D5C28544EC0ABC90BCB50795B16" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Chesapeake Clean Water and Ecosystem
			 Restoration Act of 2009</short-title></quote>.</text>
		</section><section id="H7DF56CA096E04404BCD743348D3B884C"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds that—</text>
			<paragraph id="H4B6AF0D7ADB64F2C8BD8CA95802D6427"><enum>(1)</enum><text>the Chesapeake Bay
			 and the tributary waters of the Chesapeake Bay are natural resources of
			 outstanding ecological, economic, and cultural importance to the United
			 States;</text>
			</paragraph><paragraph id="H39B601A3FD3943C99A402121B4855F25"><enum>(2)</enum><text>for more than 20
			 years, the Federal Government and the States of the Chesapeake Bay Watershed,
			 the Chesapeake Bay Commission, and various local government, scientific, and
			 citizen advisory boards have worked through the Chesapeake Bay Program of the
			 Environmental Protection Agency to develop an unparalleled body of scientific
			 information and cooperative partnerships to advance the Chesapeake Bay
			 restoration effort;</text>
			</paragraph><paragraph id="H1BA7985438704F03B02DAFC8277C6741"><enum>(3)</enum><text>despite
			 significant efforts by Federal, State, and local governments and other
			 interested parties, water pollution in the Chesapeake Bay prevents the
			 attainment of existing State water quality standards and the ecological goals
			 of the <act-name parsable-cite="FWPCA">Federal Water Pollution Control
			 Act</act-name> (33 U.S.C. 1251 et seq.);</text>
			</paragraph><paragraph id="H4B7D7BD94A67439AB3C4A316B5E8E082"><enum>(4)</enum><text>the Chesapeake Bay
			 Program partnership has developed a rich body of environmental data based on an
			 extensive network of monitors, which provide a critical measure of success in
			 attainment of the goals of the restoration effort;</text>
			</paragraph><paragraph id="HAA08302F6A064B5882FF10639264E0A0"><enum>(5)</enum><text>the Chesapeake Bay
			 Program partnership has also developed some of the world’s foremost water
			 quality and ecosystem computer models, which are invaluable planning tools for
			 resource managers;</text>
			</paragraph><paragraph id="HA7F9FBA9E21E4551B07CFFEB9362C030"><enum>(6)</enum><text>the major
			 pollutants affecting the water quality of the Chesapeake Bay and related tidal
			 waters are nitrogen, phosphorus, and sediment;</text>
			</paragraph><paragraph id="H9CE513811F914DF6A0A6DF5C255E24AD"><enum>(7)</enum><text>the largest
			 developed land use in the Chesapeake Bay watershed, and the largest
			 single-sector source of nitrogen, phosphorus, and sediment pollution, is
			 agriculture;</text>
			</paragraph><paragraph id="HF33E56B2BD704D3AAD89B41CC317D813"><enum>(8)</enum><text>successful
			 implementation of conservation practices have resulted in significant
			 reductions in pollutant loads from the agricultural sector;</text>
			</paragraph><paragraph id="H3748ED269A8D4DE082B389B8E5004299"><enum>(9)</enum><text>to speed continued
			 progress in the agricultural sector, the Federal Government and State
			 governments have initiated a number of agricultural conservation programs,
			 including the Chesapeake Bay watershed initiative under section 1240Q of the
			 Food Security Act of 1985 (16 U.S.C. 3839bb–4);</text>
			</paragraph><paragraph id="H1D978FEFBB764CEFA4A0271125296AF8"><enum>(10)</enum><text>atmospheric
			 deposition of nitrogen oxides and ammonia on the Chesapeake Bay watershed
			 contributes as much as <fraction>1/3</fraction> of the nitrogen pollution in
			 the Chesapeake Bay;</text>
			</paragraph><paragraph id="H155DCD1E9A484062951609F3A7EF9C8B"><enum>(11)</enum><text>for years, a
			 steady stream of technology development and increasingly stringent permit
			 requirements have resulted in a steady decline in the nitrogen and phosphorus
			 pollution derived from wastewater treatment plants in the Chesapeake Bay
			 watershed;</text>
			</paragraph><paragraph id="HADAA92AED9DF4222A70E4203EF81BD31"><enum>(12)</enum><text>suburban and
			 urban development is the fastest growing land use sector in the Chesapeake Bay
			 watershed, and stormwater runoff from that sector is the only major source of
			 pollution in the watershed that is increasing;</text>
			</paragraph><paragraph id="HE4C084992AF049E09ECA7136B5559B7D"><enum>(13)</enum><text>during the period
			 beginning in 1990 and ending in 2000, impervious cover, the hardened surfaces
			 through which water cannot penetrate, increased by nearly 250,000 acres, about
			 41 percent, or the size of 5 Districts of Columbia;</text>
			</paragraph><paragraph id="HDD3E92F11A1B4AE3A9E58247B66888BD"><enum>(14)</enum><text>during that
			 period, the population of the Chesapeake Bay watershed grew by just 8
			 percent;</text>
			</paragraph><paragraph id="H84D3BEDFDD0E4A74B7C0A7D4782A2AAD"><enum>(15)</enum><text>the population of
			 the watershed is estimated to be growing by about 157,000 people per
			 year;</text>
			</paragraph><paragraph id="H01072952944B4760B62B85A73768DB4A"><enum>(16)</enum><text>continuing at
			 that rate, the population will increase to nearly 20,000,000 by 2030;</text>
			</paragraph><paragraph id="HA9360413D1274157AE3460523AF008BF"><enum>(17)</enum><text>about 58 percent
			 of the watershed of the Chesapeake Bay is undeveloped and mostly forested, but
			 as many as 100 hundred acres of forest are lost to development each day;</text>
			</paragraph><paragraph id="HC8B7E0B44A324E9DB70952DED230DE17"><enum>(18)</enum><text>States, local
			 governments, developers, and nonprofit organizations have developed numerous
			 low-impact development techniques since the late 1990s, which use natural area
			 protection, en­vi­ro­tran­spi­ra­tion, infiltration, and pervious surfaces to
			 reduce stormwater runoff and associated sediment and nutrient pollution;</text>
			</paragraph><paragraph id="HB9639C40D3114125BD3CC33E1300A847"><enum>(19)</enum><text>many of those
			 techniques are less expensive than traditional stormwater management
			 techniques, yet can achieve equivalent reduction in nutrients and sediment or
			 can reduce the need for construction of traditional stormwater management
			 techniques;</text>
			</paragraph><paragraph id="H52E4F09B77064F8F8BC480F632859D7E"><enum>(20)</enum><text>the decline of
			 key aquatic habitats and species has resulted in a loss of the important water
			 quality benefits that the habitats and species traditionally provided;</text>
			</paragraph><paragraph id="H5F2FF87D171548A0B192646FAFD98977"><enum>(21)</enum><text>native oysters,
			 the numbers of which have declined precipitously in the Chesapeake Bay in
			 significant part because of diseases brought into the watershed by nonnative
			 oysters, are natural filters that once effectively filtered a volume of water
			 equivalent to that of the entire Chesapeake Bay in a matter of days;</text>
			</paragraph><paragraph id="H3526DC7397C84EB59E89ABFE6207F909"><enum>(22)</enum><text>although less
			 well-understood, menhaden, a species of fish found in the Chesapeake Bay, also
			 provide important filtering capacity as well as a number of other key ecosystem
			 functions;</text>
			</paragraph><paragraph id="HFFCCBB506A524B4BBAE63BFF31DFA15E"><enum>(23)</enum><text>wetlands are a
			 vital part of any major ecosystem;</text>
			</paragraph><paragraph id="H504B7F4690E944B9B67B00A80519E44F"><enum>(24)</enum><text>studies have
			 demonstrated that nontidal wetlands near the Chesapeake Bay removed as much as
			 89 percent of the nitrogen and 80 percent of the phosphorus that entered the
			 wetlands through upland runoff and precipitation;</text>
			</paragraph><paragraph id="HFCD185A362504CF783A834A3E0AEC603"><enum>(25)</enum><text>riparian forests
			 remove as much as 90 percent of nitrogen and phosphorus that would otherwise
			 enter the water;</text>
			</paragraph><paragraph id="H37549298113E452D8B0AD7F2EF5B530F"><enum>(26)</enum><text>the loss of
			 riparian forests and wetlands in the Chesapeake Bay has resulted in diminished
			 water quality, among other effects;</text>
			</paragraph><paragraph id="H7E2EE9A7EE004DE1BA956F5669C1D3D6"><enum>(27)</enum><text>in certain
			 locations in the Chesapeake Bay, nutria, a nonnative species, has caused
			 extensive destruction of key wetlands; and</text>
			</paragraph><paragraph id="H0604136BE7CB49F4A47C23800C5C8F2B"><enum>(28)</enum><text>in spite of the
			 achievements of the Chesapeake Bay Program partnership and increasing knowledge
			 about ecosystem functions, the restoration of the Chesapeake Bay will require
			 increased accountability and equity in reducing pollutant levels and other
			 impediments to water quality.</text>
			</paragraph></section><section commented="no" id="HC011CF3C5991493FAAF4F467E1661216"><enum>3.</enum><header>Chesapeake Bay
			 Program</header><text display-inline="no-display-inline">Section 117 of the
			 Federal Water Pollution Control Act (33 U.S.C. 1267) is amended to read as
			 follows:</text>

				<section id="H98293ED52B8D40D49955E977B91AB53A"><enum>117.</enum><header>Chesapeake Bay
				Program</header>
					<subsection id="H0E8B93A1273A4FF3A609D3AEE50B846A"><enum>(a)</enum><header>Definitions</header><text>In
				this section:</text>
						<paragraph id="H1CDC5A2CFE9246B79A822E6D47A9F2CB"><enum>(1)</enum><header>Administrative
				cost</header><text>The term <term>administrative cost</term> means the cost of
				salaries and fringe benefits incurred in administering a grant under this
				section.</text>
						</paragraph><paragraph id="HF10B66976005482B873658478D3FE8FC"><enum>(2)</enum><header>Asian
				oyster</header><text>The term <term>Asian oyster</term> means the species
				Crassostrea ariakensis.</text>
						</paragraph><paragraph id="HFBA325D5B243425C8B5E0AE3F83A00E9"><enum>(3)</enum><header>Baseline</header><text>The
				term <term>baseline</term> means the basic standard or level used for measuring
				(as applicable)—</text>
							<subparagraph id="HD0C056AC57674EB0B38B12DEDD65F0CC"><enum>(A)</enum><text>the nutrient
				control requirements credit sellers must achieve before becoming eligible to
				generate saleable nutrient credits; or</text>
							</subparagraph><subparagraph id="H3B177D44F3FE4D3284DCC54F6F076FDC"><enum>(B)</enum><text>the nutrient load
				reductions required of individual dischargers to meet water quality standards
				or goals under a TMDL or watershed implementation plan.</text>
							</subparagraph></paragraph><paragraph id="H276B5E6CFEFB4AF19DE752633991D22F"><enum>(4)</enum><header>Basin
				commissions</header><text>The term <term>basin commissions</term> means—</text>
							<subparagraph id="H19643ECA433D4AA8AD9CFDF32A906DC2"><enum>(A)</enum><text>the Interstate
				Commission on the Potomac River Basin established under the interstate compact
				consented to and approved by Congress under the Joint Resolution of July 11,
				1940 (54 Stat. 748, chapter 579), and Public Law 91–407 (84 Stat. 856);
				and</text>
							</subparagraph><subparagraph id="HAE9745B4383B44E6AE3CEE8425B28C5C"><enum>(B)</enum><text>the Susquehanna
				River Basin Commission established under the interstate compact consented to
				and approved by Congress under Public Law 91–575 (84 Stat. 1509), and Public
				Law 99–468 (100 Stat. 1193).</text>
							</subparagraph></paragraph><paragraph id="H4525FDB22018481B8FEE6037AE4BCF6D"><enum>(5)</enum><header>Chesapeake Bay
				Agreement</header><text>The term <term>Chesapeake Bay Agreement</term> means
				the formal, voluntary agreements executed to achieve the goal of restoring and
				protecting the Chesapeake Bay ecosystem and the living resources of the
				Chesapeake Bay ecosystem and signed by the Chesapeake Executive Council.</text>
						</paragraph><paragraph id="H0A9EA8471A5F4BA098A6BA635DD3C9C5"><enum>(6)</enum><header>Chesapeake Bay
				ecosystem</header><text>The term <term>Chesapeake Bay ecosystem</term> means
				the ecosystem of the Chesapeake Bay watershed.</text>
						</paragraph><paragraph id="HA2F20902FA224369A35EAAF707697E8D"><enum>(7)</enum><header>Chesapeake Bay
				Program</header><text>The term <term>Chesapeake Bay Program</term> means the
				program directed by the Chesapeake Executive Council in accordance with the
				Chesapeake Bay Agreement.</text>
						</paragraph><paragraph id="HBE2ACD43E3BB420CB8854510CD43E6ED"><enum>(8)</enum><header>Chesapeake Bay
				State</header><text>The term <term>Chesapeake Bay State</term> means any
				of—</text>
							<subparagraph id="H09B614B14A86483DA311145F0CFB31A5"><enum>(A)</enum><text>the States of
				Delaware, Maryland, New York, or West Virginia;</text>
							</subparagraph><subparagraph id="HC9338D8A17044D939B1522BD1D0F0386"><enum>(B)</enum><text>the Commonwealths
				of Pennsylvania or Virginia; or</text>
							</subparagraph><subparagraph id="H16AF9712C6F44C6092847C130BF1E0DC"><enum>(C)</enum><text>the District of
				Columbia.</text>
							</subparagraph></paragraph><paragraph id="HDD20D255FAA44AA2A0C1845BEFFCFCD6"><enum>(9)</enum><header>Chesapeake Bay
				watershed</header><text>The term <term>Chesapeake Bay watershed</term> means
				the Chesapeake Bay and the area consisting of 19 tributary basins within the
				Chesapeake Bay States through which precipitation drains into the Chesapeake
				Bay.</text>
						</paragraph><paragraph id="H72616A07456543ACBBA3DE862C55B8D7"><enum>(10)</enum><header>Chesapeake
				Executive Council</header><text>The term <term>Chesapeake Executive
				Council</term> means the signatories to the Chesapeake Bay Agreement.</text>
						</paragraph><paragraph id="H56C0F54B6FAC495F81F0DAE7ECE2EBCF"><enum>(11)</enum><header>Cleaning
				agent</header><text>The term <term>cleaning agent</term> means a laundry
				detergent, dishwashing compound, household cleaner, metal cleaner, degreasing
				compound, commercial cleaner, industrial cleaner, phosphate compound, or other
				substance that is intended to be used for cleaning purposes.</text>
						</paragraph><paragraph id="H7569993F8D724A0FA7DA6223AA982E91"><enum>(12)</enum><header>Director</header><text>The
				term <term>Director</term> means the Director of the Chesapeake Bay Program
				Office of the Environmental Protection Agency.</text>
						</paragraph><paragraph id="H3E65DBCFB2D64AA4B0819196CA4F34A8"><enum>(13)</enum><header>Local
				government</header><text>The term <term>local government</term> means any
				county, city, or other general purpose political subdivision of a State with
				jurisdiction over land use.</text>
						</paragraph><paragraph id="H170F8B230ADE4FCB9CC3D5BF3B354B33"><enum>(14)</enum><header>95th percentile
				precipitation event</header><text>The term <term>95th percentile precipitation
				event</term> means a precipitation event whose precipitation total is greater
				than or equal to 95 percent of all 24-hour storm events on an annual
				basis.</text>
						</paragraph><paragraph id="HEAB6E7E75A114318A525F3531B652D7B"><enum>(15)</enum><header>Point-of-regulation</header><text>The
				term <term>point-of-regulation</term> means any entity that—</text>
							<subparagraph id="HB2E49001933E482FAB4A3ACA9BD00A0F"><enum>(A)</enum><text>is subject to a
				limitation on pollution or other regulation under this Act; and</text>
							</subparagraph><subparagraph id="HD93AD0352607483F855D855657F3AC19"><enum>(B)</enum><text>has sufficient
				technical capacity and legal authority to meet the obligations of the entity
				under this Act.</text>
							</subparagraph></paragraph><paragraph id="HFEF8129D967244B9926A0C29D10A90D9"><enum>(16)</enum><header>TMDL</header>
							<subparagraph id="HE8A15D9F9FF24DA29B6DD1BA26554016"><enum>(A)</enum><header>In
				general</header><text>The term <term>TMDL</term> means the total maximum daily
				load that the Administrator establishes or approves for nitrogen, phosphorus,
				and sediment loading to the waters in the Chesapeake Bay and tidal tributaries
				identified on the list of a Chesapeake Bay State under section 303(d).</text>
							</subparagraph><subparagraph id="HB0A90DD5A4624BCAAFEB539C3C3C9542"><enum>(B)</enum><header>Inclusions</header><text>The
				term <term>TMDL</term> may include nitrogen, phosphorus, and sediment
				allocations in temporal units of greater than daily duration if applicable
				allocations—</text>
								<clause id="H70E55D4EA4B8423C8A9BE674A96CE661"><enum>(i)</enum><text>are demonstrated
				to achieve water quality standards; and</text>
								</clause><clause id="H0B9C7DB7A01D4B0895763416AB049CC7"><enum>(ii)</enum><text>do not lead to
				exceedances of other applicable water quality standards for local receiving
				waters.</text>
								</clause></subparagraph></paragraph><paragraph id="HCE90C5868A884D71B28B4B21B5579B67"><enum>(17)</enum><header>Tributary
				basin</header><text>The term <term>tributary basin</term> means an area of land
				or body of water that—</text>
							<subparagraph id="H50D6E57A109D4EB4A35A4B23EC4850A6"><enum>(A)</enum><text>drains into any of
				the 19 Chesapeake Bay tributaries or tributary segments; and</text>
							</subparagraph><subparagraph id="H60FB9F58179E44CE82A250C37D71E2DA"><enum>(B)</enum><text>is managed through
				watershed implementation plans under this Act.</text>
							</subparagraph></paragraph></subsection><subsection id="H05818EC81F064D4FA4CA7B30BD2754C0"><enum>(b)</enum><header>Continuation of
				Chesapeake Bay program</header>
						<paragraph id="H68CE5159578347ADB47A31A2D2E981A3"><enum>(1)</enum><header>In
				general</header><text>In cooperation with the Chesapeake Executive Council (and
				as a member of the Council), the Administrator shall continue the Chesapeake
				Bay Program.</text>
						</paragraph><paragraph id="HEBB812A8740343E6AA98BF2403D11A68"><enum>(2)</enum><header>Program
				office</header>
							<subparagraph id="H7571B6FFF5CD4990A14DFC4538D70531"><enum>(A)</enum><header>In
				general</header><text>The Administrator shall maintain in the Environmental
				Protection Agency a Chesapeake Bay Program Office.</text>
							</subparagraph><subparagraph id="H39A2E9CA20DE4984A197401B8305B500"><enum>(B)</enum><header>Function</header><text>The
				Chesapeake Bay Program Office shall provide support to the Chesapeake Executive
				Council by—</text>
								<clause id="HD13B0A17AA084EDB98FE6B2A998EAEF7"><enum>(i)</enum><text>implementing and
				coordinating science, research, modeling, support services, monitoring, data
				collection, and other activities that support the Chesapeake Bay
				Program;</text>
								</clause><clause id="H14E4C7AC84BD4A4C86CDC03FB477FD37"><enum>(ii)</enum><text>developing and
				making available, through publications, technical assistance, and other
				appropriate means, information pertaining to the environmental quality and
				living resources of the Chesapeake Bay ecosystem;</text>
								</clause><clause id="H33D5D030CC4D4016B723BECD45C315F9"><enum>(iii)</enum><text>in cooperation
				with appropriate Federal, State, and local authorities, assisting the
				signatories to the Chesapeake Bay Agreement in developing and implementing
				specific action plans to carry out the responsibilities of the signatories to
				the Chesapeake Bay Agreement;</text>
								</clause><clause id="HB7B598D2B9EE4110AD3A7BAF440424BC"><enum>(iv)</enum><text>coordinating the
				actions of the Environmental Protection Agency with the actions of the
				appropriate officials of other Federal agencies and State and local authorities
				in developing strategies to—</text>
									<subclause id="HEB7F4232108340E2BBF3872FD6272F8B"><enum>(I)</enum><text>improve the water
				quality and living resources in the Chesapeake Bay ecosystem; and</text>
									</subclause><subclause id="H6E8119024DF64AA0801DA84C5444BF27"><enum>(II)</enum><text>obtain the
				support of the appropriate officials of the agencies and authorities in
				achieving the objectives of the Chesapeake Bay Agreement; and</text>
									</subclause></clause><clause id="H47E6C714041E4F1197A6104189CDC35B"><enum>(v)</enum><text>implementing
				outreach programs for public information, education, and participation to
				foster stewardship of the resources of the Chesapeake Bay.</text>
								</clause></subparagraph></paragraph></subsection><subsection id="HEB1803CEF9EB44F78C93F9892C34E0E9"><enum>(c)</enum><header>Interagency
				agreements</header><text>The Administrator may enter into an interagency
				agreement with a Federal agency to carry out this section.</text>
					</subsection><subsection id="HEF28A71B48B14948AC2937EF9A7BBD88"><enum>(d)</enum><header>Technical
				assistance and assistance grants</header>
						<paragraph id="HC2DBBF3E5B284ACD9B0F9A90A09D21BF"><enum>(1)</enum><header>In
				general</header><text>In cooperation with the Chesapeake Executive Council, the
				Administrator may provide technical assistance, and assistance grants, to
				nonprofit organizations, State and local governments, institutions of higher
				education, basin commissions, and interstate agencies to carry out this
				section, subject to such terms and conditions as the Administrator considers
				appropriate.</text>
						</paragraph><paragraph id="H2539902A503845AA82BF08D478E2864C"><enum>(2)</enum><header>Federal
				share</header>
							<subparagraph id="H40C3D32413DB4106BB22A4804B7828A2"><enum>(A)</enum><header>In
				general</header><text>Except as provided in subparagraph (B), the Federal share
				of an assistance grant provided under paragraph (1) shall be determined by the
				Administrator in accordance with guidance issued by the Administrator.</text>
							</subparagraph><subparagraph id="HF9317D1E7E924750AA11A2BB7887A993"><enum>(B)</enum><header>Chesapeake bay
				stewardship grants program</header><text>The Federal share of an assistance
				grant provided under paragraph (1) to carry out an implementing activity under
				subsection (g)(2) shall not exceed 75 percent of eligible project costs, as
				determined by the Administrator.</text>
							</subparagraph></paragraph><paragraph id="H8C7C51CB4620456EA86B68167DB79254"><enum>(3)</enum><header>Non-Federal
				share</header><text>An assistance grant under paragraph (1) shall be provided
				on the condition that non-Federal sources provide the remainder of eligible
				project costs, as determined by the Administrator.</text>
						</paragraph><paragraph id="H413F21455EAF4213AF6193D87C2CF648"><enum>(4)</enum><header>Administrative
				costs</header><text>Administrative costs shall not exceed 10 percent of the
				annual grant award.</text>
						</paragraph></subsection><subsection id="H2D6479F8CDC94156AE8784CA3818A069"><enum>(e)</enum><header>Implementation
				and monitoring grants</header>
						<paragraph id="HE85A1DF629614C3D8ACD3C695D05C311"><enum>(1)</enum><header>In
				general</header><text>On the request of the chief executive of a Chesapeake Bay
				State, the Administrator—</text>
							<subparagraph id="H66B39F5B9C7D4D649B2C17A4FF4B2C0E"><enum>(A)</enum><text display-inline="yes-display-inline">shall make an implementation grant to the
				Chesapeake Bay State, or a designee of the Chesapeake Bay State (such as a soil
				conservation district, nonprofit organization, local government, institution of
				higher education, basin commission, or interstate agency) for the purpose of
				implementing an approved watershed implementation plan under subsection (j) and
				achieving the goals established under the Chesapeake Bay Agreement, subject to
				such terms and conditions as the Administrator considers to be appropriate;
				and</text>
							</subparagraph><subparagraph id="H56678429AF944B19AC0EFE186F92D963"><enum>(B)</enum><text>may make a
				monitoring grant to—</text>
								<clause id="H959958C2DFB5419CA8242A1A4E76046A"><enum>(i)</enum><text>a
				Chesapeake Bay State, or a designee of a Chesapeake Bay State (such as a soil
				conservation district, nonprofit organization, local government, institution of
				higher education, basin commission, or interstate agency), for the purpose of
				monitoring the ecosystem of freshwater tributaries to the Chesapeake Bay;
				or</text>
								</clause><clause id="H4B5C48038F1E4640AEF579D93BD8B3B2"><enum>(ii)</enum><text>the States of
				Delaware or Maryland, the Commonwealth of Virginia, the District of Columbia,
				or a designee (such as a soil conservation district, nonprofit organization,
				local government, institution of higher education, basin commission, or
				interstate agency) for the purpose of monitoring the Chesapeake Bay, including
				the tidal waters of the Chesapeake Bay.</text>
								</clause></subparagraph></paragraph><paragraph id="H04D03F99AB0745E5BE6695E4D159627A"><enum>(2)</enum><header>Administration</header><text>In
				making implementation grants to each of the Chesapeake Bay States for a fiscal
				year under this subsection, the Administrator shall ensure that not less
				than—</text>
							<subparagraph id="H88A820606D0E4AB1A94E32B1E904945A"><enum>(A)</enum><text>10 percent of the
				funds available to make such grants are made to the States of Delaware, New
				York, and West Virginia; and</text>
							</subparagraph><subparagraph id="HB547BE98FE5F481794FDF511F0B64C36"><enum>(B)</enum><text>20 percent of the
				funds available to make such grants are made to Chesapeake Bay States for the
				sole purpose of providing technical assistance to agricultural producers and
				foresters to access conservation programs and other resources devoted to
				improvements in water quality in the Chesapeake Bay and the tributaries of the
				Chesapeake Bay.</text>
							</subparagraph></paragraph><paragraph id="H4F6C5383F6DE4733B1D9EC84D040DC46"><enum>(3)</enum><header>Proposals</header>
							<subparagraph id="HD37A7E3B0D8D40E4B424DC4FE24432D0"><enum>(A)</enum><header>Implementation
				grants</header>
								<clause id="H22F5AEF2D1454198A806436365400D2E"><enum>(i)</enum><header>In
				general</header><text>A Chesapeake Bay State may apply for a grant under this
				subsection for a fiscal year by submitting to the Administrator a comprehensive
				proposal to implement programs and achieve the goals established under the
				Chesapeake Bay Agreement.</text>
								</clause><clause id="H992A35F00C154CC2971ECBF31F784AEC"><enum>(ii)</enum><header>Implementation
				grant contents</header><text>A proposal under clause (i) shall include—</text>
									<subclause id="HDD7B69CD719E4328B0D2B7A5A67F4F5D"><enum>(I)</enum><text>a description of
				proposed actions that the Chesapeake Bay State commits to take within a
				specified time period that are designed—</text>
										<item id="HF678A30D0CDA468492FCE4ECD24FD587"><enum>(aa)</enum><text>to
				achieve and maintain all applicable water quality standards, including
				standards necessary to support the aquatic living resources of the Chesapeake
				Bay and related tributaries and to protect human health;</text>
										</item><item id="H88BB8DDA8832428BAB3DC31903F366E2"><enum>(bb)</enum><text>to
				restore, enhance, and protect the fish, shellfish, wildlife, and other living
				resources of the Chesapeake Bay and related tributaries, habitats of those
				species and resources, and ecological relationships to sustain all fisheries
				and provide for a balanced ecosystem;</text>
										</item><item id="HF0CBBE6D18EC49FDBEE59DCCDC443725"><enum>(cc)</enum><text>to
				restore, enhance, and protect those habitats and natural areas that are vital
				to the survival and diversity of the living resources of the Chesapeake Bay and
				related tributaries;</text>
										</item><item id="H21137D795557466797058864598734D4"><enum>(dd)</enum><text>to
				develop, promote, and achieve sound land use practices that protect and restore
				watershed resources and water quality, reduce or maintain reduced pollutant
				loadings for the Chesapeake Bay and related tributaries, and restore and
				preserve aquatic living resources;</text>
										</item><item id="H265FCBD2B3054A00B6ABFABE25DA36BC"><enum>(ee)</enum><text>to
				promote individual stewardship and assist individuals, community-based
				organizations, businesses, local governments, and schools to undertake
				initiatives to achieve the goals and commitments of the Chesapeake Bay
				Agreement; or</text>
										</item><item id="H3EDD2266BC5E40C486C46FFF2C0AC762"><enum>(ff)</enum><text>to
				provide technical assistance to agricultural producers, foresters, and other
				eligible entities through technical infrastructure, including activities,
				processes, tools, and agency functions needed to support delivery of technical
				services, such as technical standards, resource inventories, training, data,
				technology, monitoring, and effects analyses;</text>
										</item></subclause><subclause id="H165C749DC8A346EFADAA9014E237A011"><enum>(II)</enum><text>a commitment to
				dedicate not less than 20 percent of a grant to a Chesapeake Bay State under
				this subsection to support technical assistance for agricultural and forestry
				land or nutrient management practices that protect and restore watershed
				resources and water quality, reduce or maintain reduced pollutant loadings for
				the Chesapeake Bay and related tributaries, and restore and preserve aquatic
				living resources; and</text>
									</subclause><subclause id="H4AD7A31B8CE24596B972BC2B80869FAD"><enum>(III)</enum><text>the estimated
				cost of the actions proposed to be taken during the fiscal year.</text>
									</subclause></clause></subparagraph><subparagraph id="HF4FB17C3BD254F93A72802936B0B8FA2"><enum>(B)</enum><header>Monitoring
				grants</header>
								<clause id="HC00BF4934E074B70941A0DBF8BE3C111"><enum>(i)</enum><header>In
				general</header><text>A Chesapeake Bay State may apply for a grant under this
				subsection for a fiscal year by submitting to the Administrator a comprehensive
				proposal to monitor freshwater or estuarine ecosystems, including water
				quality.</text>
								</clause><clause id="H9EB027F2C700466F839E3E852D90E2F0"><enum>(ii)</enum><header>Monitoring
				grant contents</header><text>A proposal under this subparagraph shall
				include—</text>
									<subclause id="HFAF0B0484B424EBE962685A131C8EF58"><enum>(I)</enum><text>a description of
				the proposed monitoring system;</text>
									</subclause><subclause id="HD44B777F0C0B4D5EB9CD0017CC5850C0"><enum>(II)</enum><text>certification by
				the Director that such a monitoring system includes such parameters as the
				Director determines necessary to assess progress toward achieving the goals of
				this section; and</text>
									</subclause><subclause id="H8E819C72B6854A11A6A3D03AB8E41816"><enum>(III)</enum><text>the estimated
				cost of the monitoring proposed to be conducted during the fiscal year.</text>
									</subclause></clause><clause id="HFC3D68CCA177493296129A914CABF440"><enum>(iii)</enum><header>Concurrences</header><text>The
				Administrator shall—</text>
									<subclause id="H2D63607B8F854430B5823B7618608D33"><enum>(I)</enum><text>obtain the
				concurrence of the Director of the United States Geological Survey regarding
				the design and implementation of the freshwater monitoring systems established
				under this subsection; and</text>
									</subclause><subclause id="HBA7A4808E42345B5820296910A012984"><enum>(II)</enum><text>obtain the
				concurrence of the Director of the Chesapeake Bay Office of the National
				Oceanic and Atmospheric Administration regarding the design and implementation
				of the estuarine monitoring systems established under this subsection.</text>
									</subclause></clause><clause id="H9D83BAE7C5104126B262FBF722C55858"><enum>(iv)</enum><header>Consultation</header><text>The
				Administrator shall consult with—</text>
									<subclause id="H8362B5294E574293A8235BF7178106E4"><enum>(I)</enum><text>the basin
				commissions and the Chesapeake Bay States regarding the design and
				implementation of the freshwater monitoring systems established under this
				subsection, giving particular attention to the measurement of the water quality
				effectiveness of agricultural conservation program implementation (including
				geospatial agricultural conservation program data), including activities
				carried out pursuant to the Chesapeake Bay Watershed Initiative under section
				1240Q of the Food Security Act of 1985 (16 U.S.C. 3839bb–4);</text>
									</subclause><subclause id="H5A23B732B6FA4D589BBB77A6671ED69C"><enum>(II)</enum><text>Old Dominion
				University, the Virginia Institute of Marine Science, the University of
				Maryland Center for Environmental Science, and the Chesapeake Bay States
				regarding the estuarine monitoring systems established under this
				subsection;</text>
									</subclause><subclause id="H8F7FE733D3914CBEAA37C16F6407F4A2"><enum>(III)</enum><text>the Chesapeake
				Bay Program Scientific and Technical Advisory Committee regarding independent
				review of monitoring designs giving particular attention to integrated
				freshwater and estuarine monitoring strategies; and</text>
									</subclause><subclause id="H5A249C30E05F4E9890D96BF57E9E1D28"><enum>(IV)</enum><text>Federal
				departments and agencies regarding cooperation in implementing monitoring
				programs.</text>
									</subclause></clause></subparagraph></paragraph></subsection><subsection id="H519A02D958A94C52A808D779EF89F28B"><enum>(f)</enum><header>Federal
				Facilities and Action Plan</header>
						<paragraph id="HD6A7E374F2AD4F5B8258642AD86653A9"><enum>(1)</enum><header>Subwatershed
				planning and restoration</header><text>A Federal agency that owns or operates a
				facility (as defined by the Administrator) or carries our activities within the
				Chesapeake Bay watershed shall participate in regional and subwatershed
				planning and restoration programs.</text>
						</paragraph><paragraph id="HDC19A895126F4447A12B005ABD2B28F7"><enum>(2)</enum><header>Compliance with
				agreement</header><text>The head of each Federal agency that owns or occupies
				real property or carries out activities in the Chesapeake Bay watershed shall
				ensure that the property, actions taken by the agency with respect to the
				property, and the activities of the agency comply with the Chesapeake Bay
				Agreement, the Federal Agencies Chesapeake Ecosystem Unified Plan, and any
				subsequent agreements and plans.</text>
						</paragraph><paragraph id="H27137E31F95E4A6DA3FE0280CA8B20CF"><enum>(3)</enum><header>Forest cover at
				federal facilities</header><text>Not later than January 1, 2012, the
				Administrator shall coordinate with the heads of each Federal agency that owns
				or operates a facility (as defined by the Administrator) within the Chesapeake
				Bay watershed to develop plans to maximize forest cover at the facility through
				the preservation of existing forest cover and the development of reforestation
				plans with respect to a facility that has been disturbed or developed in the
				past.</text>
						</paragraph><paragraph id="HD3FCE930D38D4ED995D5454A4C921585"><enum>(4)</enum><header>Federal annual
				action plan and progress report</header><text>The Administrator, in accordance
				with Executive Order 12508 entitled <quote>Chesapeake Bay Protection and
				Restoration</quote> and signed on May 12, 2009 (74 Fed. Reg. 23099),
				shall—</text>
							<subparagraph id="H13CF4CFC7959447AB20F51E74C3C0D54"><enum>(A)</enum><text>make available to
				the public, not later than March 31 of each year—</text>
								<clause id="HCFC2E46DCE084EB9A41F916ACA349025"><enum>(i)</enum><text>a
				Chesapeake Bay action plan describing, in the greatest practicable degree of
				detail, how Federal funding proposed in the annual budget of the United States
				submitted by the President to Congress will be used to protect and restore the
				Chesapeake Bay during the upcoming fiscal year; and</text>
								</clause><clause id="HC55F494192A146CD83C9D75CF30DFDF9"><enum>(ii)</enum><text>an annual
				progress report that—</text>
									<subclause id="HB895E869294741599CA3F618905B96A3"><enum>(I)</enum><text>assesses the key
				ecological attributes that reflect the health of the Chesapeake Bay
				ecosystem;</text>
									</subclause><subclause id="H3CE7E16F85264BC1A77C7E2F8F3D13AB"><enum>(II)</enum><text>reviews
				indicators of environmental conditions in the Chesapeake Bay;</text>
									</subclause><subclause id="H62621EB98F7A41AC8783B8513B3ED43C"><enum>(III)</enum><text>distinguishes
				between the health of the Chesapeake Bay ecosystem and the results of
				management measures;</text>
									</subclause><subclause id="H07CD44F1D800445998C7C2B90C68FC08"><enum>(IV)</enum><text>assesses
				implementation of the action plan during the preceding fiscal year;</text>
									</subclause><subclause id="HD7509E9F3E8A42F08F6AA75410EB1EB8"><enum>(V)</enum><text>recommends steps
				to improve progress in restoring and protecting the Chesapeake Bay; and</text>
									</subclause><subclause id="HFAB1E90B8BF2414D9563FABB3A78E5F9"><enum>(VI)</enum><text>describes how
				Federal funding and actions will be coordinated with the actions of States,
				basin commissions, and others;</text>
									</subclause></clause></subparagraph><subparagraph id="H13C2E76EEEB74E6CAE5C69DD33FAFC9C"><enum>(B)</enum><text>create and
				maintain, with the concurrence of the Secretary of Agriculture, a Chesapeake
				Bay-wide database containing comprehensive data on implementation of
				conservation management practices in the Chesapeake Bay watershed that—</text>
								<clause id="H3A4448763E2543C296114DD0A9E23396"><enum>(i)</enum><text>includes baseline
				conservation management practice implementation data as of the effective date
				of the <short-title>Chesapeake Clean Water and Ecosystem
				Restoration Act of 2009</short-title>;</text>
								</clause><clause id="H453A7932650D424C98426DAF03512249"><enum>(ii)</enum><text>includes data on
				subsequent conservation management practice implementation projects funded by
				or reported to the Administrator or the Secretary;</text>
								</clause><clause id="H844876419B34424E9683835A93A819B0"><enum>(iii)</enum><text>presents the
				required data in statistical or aggregate form without identifying any—</text>
									<subclause id="H58EFC94385174766B294CC5E462BDABB"><enum>(I)</enum><text>individual owner,
				operator, or producer; or</text>
									</subclause><subclause id="H5F99F9B5F66D4413BD3EE9B79B0D3AF5"><enum>(II)</enum><text>specific data
				gathering site; and</text>
									</subclause></clause><clause id="H31F2694C6B064FE39A7520AC8A7A5563"><enum>(iv)</enum><text>is made available
				to the public not later than December 31, 2010.</text>
								</clause></subparagraph></paragraph></subsection><subsection id="H14312D2C62D4447F9B782855914E4BE7"><enum>(g)</enum><header>Chesapeake Bay
				program</header>
						<paragraph id="H917C6A09C7DA49F5984E4806681C3A53"><enum>(1)</enum><header>Management
				strategies</header><text>The Administrator, in coordination with other members
				of the Chesapeake Executive Council, shall ensure that management plans are
				developed and implemented by Chesapeake Bay States to achieve and
				maintain—</text>
							<subparagraph id="H6A69253E1E9B4571B0C99154A502DB13"><enum>(A)</enum><text>the nutrient goals
				of the Chesapeake Bay Agreement for the quantity of nitrogen and phosphorus
				entering the Chesapeake Bay and the watershed of the Chesapeake Bay;</text>
							</subparagraph><subparagraph id="H92F795C8FB034990956821671111CFD5"><enum>(B)</enum><text>the water quality
				requirements necessary to restore living resources in the Chesapeake Bay
				ecosystem;</text>
							</subparagraph><subparagraph id="H81CBA4F324A64312A04E9F435FFC9615"><enum>(C)</enum><text>the Chesapeake Bay
				Basinwide Toxins Reduction and Prevention Strategy goal of reducing or
				eliminating the input of chemical contaminants from all controllable sources to
				levels that result in no toxic or bioaccumulative impact on the living
				resources of the Chesapeake Bay ecosystem or on human health;</text>
							</subparagraph><subparagraph id="H244987A7D74349C7867FC897AC6C044C"><enum>(D)</enum><text>habitat
				restoration, protection, creation, and enhancement goals established by
				Chesapeake Bay States for wetlands, riparian forests, and other types of
				habitat associated with the Chesapeake Bay ecosystem; and</text>
							</subparagraph><subparagraph id="HE4D9562E3E78486AAA832F388F5A8F11"><enum>(E)</enum><text>the restoration,
				protection, creation, and enhancement goals established by the Chesapeake Bay
				States for living resources associated with the Chesapeake Bay
				ecosystem.</text>
							</subparagraph></paragraph><paragraph id="H1F67E3BC5F9D441FAB610A8AB3DB11CA"><enum>(2)</enum><header>Chesapeake Bay
				Stewardship Grants Program</header><text>The Administrator, in cooperation with
				the Chesapeake Executive Council, shall—</text>
							<subparagraph id="HF75586809CE442448063CF38BB8B1C05"><enum>(A)</enum><text>establish a
				Chesapeake Bay Stewardship Grants Program; and</text>
							</subparagraph><subparagraph id="H49AC94E620E942B3A8595E7F8A4E40FA"><enum>(B)</enum><text>in carrying out
				that program—</text>
								<clause id="HF2670A46DC4F4215810DA597DAE5271F"><enum>(i)</enum><text>offer technical
				assistance and assistance grants under subsection (d) to implement—</text>
									<subclause id="H6D65EBE6285B4E34ABBC90A6A576D24C"><enum>(I)</enum><text>cooperative
				watershed strategies that address the water quality, habitat, and living
				resource needs in the Chesapeake Bay ecosystem;</text>
									</subclause><subclause id="H6D88E32029904A908092203B8406EFFE"><enum>(II)</enum><text>locally based
				protection and restoration programs or projects within a watershed that
				complement the State watershed implementation plans, including the creation,
				restoration, or enhancement of habitat associated with the Chesapeake Bay
				ecosystem; and</text>
									</subclause><subclause id="H2501A9DBF0564925B56449136DC97A78"><enum>(III)</enum><text>innovative
				nitrogen, phosphorus, or sediment reduction efforts; and</text>
									</subclause></clause><clause id="HD6231C1A22044A7E82E4BAE5C8C65B74"><enum>(ii)</enum><text>give preference
				to cooperative projects that involve local governments.</text>
								</clause></subparagraph></paragraph></subsection><subsection id="H19C69807DAA44B7198E10AE42B5154C2"><enum>(h)</enum><header>Total maximum
				daily load</header>
						<paragraph id="HFB640017E797465592BF1FF6EED3543A"><enum>(1)</enum><header>TMDL</header>
							<subparagraph id="H4C076A8F60764A4E9C6C47EC7A822E2D"><enum>(A)</enum><header>Establishment</header><text>Not
				later than December 31, 2010, the Administrator shall establish a Chesapeake
				Bay-wide TMDL.</text>
							</subparagraph><subparagraph id="H6B403DE882AD44C19A338839004DD59D"><enum>(B)</enum><header>Requirements</header><text>The
				Administrator shall not establish or approve a TMDL described in subparagraph
				(A) unless the TMDL is developed in accordance with the requirements of section
				303(d)(1)(C) of this Act, and includes—</text>
								<clause id="H5266FDCEB946461DBBF511E95858CC7F"><enum>(i)</enum><text>wasteload
				allocations for nitrogen, phosphorus, and sediment necessary to implement the
				applicable water quality standards in the Chesapeake Bay watershed and achieve
				those standards in the Chesapeake Bay and tidal tributaries;</text>
								</clause><clause id="HD5E16DF6AFBE4223A765A515E51D8C96"><enum>(ii)</enum><text>enforceable or
				otherwise binding load allocations for all nonpoint sources, including
				atmospheric deposition, agricultural runoff, and stormwater sources for which a
				permit under section 402 is not required; and</text>
								</clause><clause id="HC9CDE6AD57264CE2ADE775B73CE938EA"><enum>(iii)</enum><text>a requirement
				for no net increase of nitrogen, phosphorus, and sediment loads above the
				pollutant limitations necessary to meet water quality standards for the
				Chesapeake Bay and tidal tributaries, including no net projected increased
				pollutant levels from—</text>
									<subclause id="HC09B54342AA548D8A2DAC58F6C70CD3B"><enum>(I)</enum><text>new or increased
				impervious surfaces;</text>
									</subclause><subclause id="H679F0BE7445F4897852E8C08D1F87E3A"><enum>(II)</enum><text>concentrated
				animal feeding operations;</text>
									</subclause><subclause id="H9E104853EF774390B467BCF2FB7E69E5"><enum>(III)</enum><text>transportation
				systems; and</text>
									</subclause><subclause id="HB5B80BEB4E7F49829EBE5B707E90DFD0"><enum>(IV)</enum><text>septic
				systems.</text>
									</subclause></clause></subparagraph></paragraph><paragraph id="H4901C1D37C4A4D9FB24BB63575302EB4"><enum>(2)</enum><header>Permits</header>
							<subparagraph id="H0572B5C147C44EFA8498B57D43B464F0"><enum>(A)</enum><header>In
				general</header><text>Effective beginning on January 1, 2011, a new or reissued
				permit issued by the Administrator under section 402(a) or a State authorized
				to administer a permit program under section 402(b) shall include limits
				consistent with all applicable wasteload allocations in the Chesapeake Bay
				TMDL.</text>
							</subparagraph><subparagraph id="H36FD9FAA803C404597EE5A1F52CD28CD"><enum>(B)</enum><header>Permits</header>
								<clause id="H14988E6C102E4E62A9E33B932E6DA26E"><enum>(i)</enum><header>In
				general</header><text>Effective beginning on January 1, 2011, each Chesapeake
				Bay State shall submit to the Administrator copies of any permit for discharges
				of nitrogen, phosphorus, or sediment into the Chesapeake Bay watershed that is
				allowed to continue beyond 5 years pursuant to a State law analogous to section
				558(c) of title 5, United States Code, not later than 60 days after the
				expiration date of the permit.</text>
								</clause><clause id="H631206ED2C254AB6B78FF50817F8F450"><enum>(ii)</enum><header>Review</header><text>The
				Administrator shall have the opportunity to review and object to the
				continuance of the permit in accordance with the process described in section
				402(d) for permits proposed to be issued by a State.</text>
								</clause></subparagraph></paragraph></subsection><subsection id="H3832A2CEE4B9418B8C57C6865C4A4A09"><enum>(i)</enum><header>Actions by
				States</header>
						<paragraph id="HC4E6BA73956441B181E304B4122F185E"><enum>(1)</enum><header>Watershed
				implementation plans</header>
							<subparagraph id="H2EC8DE6F9E9E4327B218B13DBAA73248"><enum>(A)</enum><header>Plans</header>
								<clause id="H5B5870E62267408F82816AD78972CD65"><enum>(i)</enum><header>In
				general</header><text>Not later than May 12, 2011, each Chesapeake Bay State
				shall, after providing for notice and 1 or more public hearings, adopt and
				submit to the Administrator for approval a watershed implementation plan for
				the portion of each of the 92 tidal water segments that is subject to the
				jurisdiction of the Chesapeake Bay State that together comprise the Chesapeake
				Bay.</text>
								</clause><clause id="H5D3691FA57EB41079A508D2DAEC80D2D"><enum>(ii)</enum><header>Targets</header><text>The
				watershed implementation plan shall establish reduction targets, key actions,
				and schedules for reducing, to levels that will attain water quality standards,
				the loads of nitrogen, phosphorus, and sediment, including pollution
				from—</text>
									<subclause id="HC37D35042B2D416CAB686C6A3814D118"><enum>(I)</enum><text>agricultural
				runoff;</text>
									</subclause><subclause id="HC2FA2AD2A6D94DF9A9101E668AB1840B"><enum>(II)</enum><text>point sources,
				including point source stormwater discharges;</text>
									</subclause><subclause id="HED3C8A223C0D4041976A313BEFB00709"><enum>(III)</enum><text>nonpoint source
				storm­wa­ter runoff; and</text>
									</subclause><subclause id="H3FF91B831D7B4AF58A669CEC63ECC55A"><enum>(IV)</enum><text>septic systems
				and other onsite sewage disposal systems.</text>
									</subclause></clause><clause id="H9E8890E27F824B4F89A26E29C4F82A5F"><enum>(iii)</enum><header>Pollution
				limitations</header>
									<subclause id="H205396C8E80F44108A4DDC7C1F6C2C1A"><enum>(I)</enum><header>In
				general</header><text>The tributary pollution limitations shall be the
				nitrogen, phosphorous, and sediment cap loads identified in the tributary cap
				load agreement numbered EPA 903–R–03–007, dated December 2003, and entitled
				<quote>Setting and Allocating the Chesapeake Bay Basin Nutrient and Sediment
				Loads: The Collaborative Process, Technical Tools and Innovative
				Approaches</quote>, or a Chesapeake Bay TMDL established by the
				Administrator.</text>
									</subclause><subclause id="HBB47A3BB44114D00B3521B41790E7148"><enum>(II)</enum><header>Stringency</header><text>A
				watershed implementation plan shall be designed to attain, at a minimum, the
				pollution limitations described in subclause (I).</text>
									</subclause></clause><clause id="H2B9C468752A146ADB8B4D9560136DE8C"><enum>(iv)</enum><header>Plan
				requirements</header><text>Each watershed implementation plan shall—</text>
									<subclause id="H3B2E6380268248F3A68A0275A13CCA92"><enum>(I)</enum><text>include
				State-adopted management measures, including rules or regulations, permits,
				consent decrees, and other enforceable or otherwise binding measures, to
				require and achieve reductions from pollution sources;</text>
									</subclause><subclause id="HD09993226E044CCAA4331E7AF004C63D"><enum>(II)</enum><text>include programs
				to achieve voluntary reductions from pollution sources, including funding
				commitments necessary to implement those programs;</text>
									</subclause><subclause id="H5754D6A331E948148141F0436D53ECA8"><enum>(III)</enum><text>include any
				additional requirements or actions that the Chesapeake Bay State determines to
				be necessary to attain the pollution limitations by the deadline established in
				this paragraph;</text>
									</subclause><subclause id="HB0202B817C8B4CB9B3508F9027A81784"><enum>(IV)</enum><text>provide for
				enforcement mechanisms, including a penalty structure for failures, such as
				fees or forfeiture of State funds, including Federal funds distributed or
				otherwise awarded by the State to the extent the State is authorized to
				exercise independent discretion in amounts of such distributions or awards, for
				use if a permittee, local government, or any other party fails to adhere to
				assigned pollutant limitations, implementation schedules, or permit
				terms;</text>
									</subclause><subclause id="H35D462020DB64310896C8A657CFBCD2C"><enum>(V)</enum><text>include a schedule
				for implementation divided into 2-year periods, along with computer modeling to
				demonstrate the projected reductions in nitrogen, phosphorus, and sediment
				loads associated with each 2-year period;</text>
									</subclause><subclause id="H6D167CD8F8E04B189B80C17AC5BD64C2"><enum>(VI)</enum><text>include the
				stipulation of alternate actions as contingencies;</text>
									</subclause><subclause id="H4497C7195A294E3D93AAA46A68D67C01"><enum>(VII)</enum><text>account for how
				the Chesapeake Bay State will address additional loadings from growth through
				offsets or other actions; and</text>
									</subclause><subclause id="H2E0443143A77485B984AEB518AFC73E9"><enum>(VIII)</enum><text>provide
				assurances that—</text>
										<item id="H9976B33A398B498EA213EEC94ADADEFA"><enum>(aa)</enum><text>if
				compared to an estimated 2008 baseline, the initial plan shall be designed to
				achieve, not later than May 31, 2017, at least 60 percent of the nitrogen,
				phosphorous, and sediment limitations described in clause (iii)(I);</text>
										</item><item id="HEC018602A7EB4F78B700E6A34B8BF82F"><enum>(bb)</enum><text>the
				management measures required to achieve a 50-percent reduction of nitrogen,
				phosphorous, and sediment limitations shall be in effect upon submission of the
				plan;</text>
										</item><item id="H8FAEA07B2AC840CBA4180D4D66A0EF07"><enum>(cc)</enum><text>the
				Chesapeake Bay State will have adequate personnel, funding, and authority under
				State (and, as appropriate, local) law to carry out the implementation plan and
				is not prohibited by any provision of Federal or State law from carrying out
				the implementation plan; and</text>
										</item><item id="H450338E49DD1444A81E652A51B89E2D8"><enum>(dd)</enum><text>in
				a case in which a Chesapeake Bay State has relied on a local government for the
				implementation of any plan provision, the Chesapeake Bay State has the
				responsibility for ensuring adequate implementation of the provision.</text>
										</item></subclause></clause></subparagraph><subparagraph id="H71A97D9D272543278463BE8D818B8958"><enum>(B)</enum><header>Implementation</header>
								<clause id="HA0524A2441344EBE9AA59D67B0860940"><enum>(i)</enum><header>In
				general</header><text>In implementing a watershed implementation plan, each
				Chesapeake Bay State shall follow a strategy developed by the Administrator for
				the implementation of adaptive management principles to ensure full
				implementation of all plan elements by not later than May 12, 2025,
				including—</text>
									<subclause id="HF698D97317804821B386196EE89D7A7C"><enum>(I)</enum><text>biennial
				evaluations of State actions;</text>
									</subclause><subclause id="HF56E29A3AD994B70A06DC76DDD74D2DF"><enum>(II)</enum><text>progress made
				toward implementation;</text>
									</subclause><subclause id="H6DE02A6F478E45B6912E98B598D5E493"><enum>(III)</enum><text>determinations
				of necessary modifications to future actions in order to achieve objectives;
				and</text>
									</subclause><subclause id="HC84B4708F9CC4943A203E9049C1013EF"><enum>(IV)</enum><text>appropriate
				provisions to adapt to climate changes.</text>
									</subclause></clause><clause id="H7341844A915E44DB8036B8349A5D1CB4"><enum>(ii)</enum><header>Deadline</header><text>Not
				later than May 12, 2025, each Chesapeake Bay State shall—</text>
									<subclause id="H7FEEC7AF2A424AE4998CFB5EB4F156E2"><enum>(I)</enum><text>fully implement
				the watershed implementation plan of the State; and</text>
									</subclause><subclause id="HB75F822D9F304F3B876436DCBB091A98"><enum>(II)</enum><text>have in place all
				the mechanisms outlined in the plan that are necessary to attain the applicable
				pollutant limitations for nitrogen, phosphorus, and sediment.</text>
									</subclause></clause></subparagraph><subparagraph id="HFABDCE14BC074F02BA9FF31EF2D2DACD"><enum>(C)</enum><header>Progress
				reports</header><text>Not later than May 12, 2014, and biennially thereafter,
				each Chesapeake Bay State shall submit to the Administrator a progress report
				that, with respect to the 2-year period covered by the report—</text>
								<clause id="H6D903B06CCDC40D7A36B28C469384C8C"><enum>(i)</enum><text>includes a listing
				of all management measures that were to be implemented in accordance with the
				approved watershed implementation plan of the Chesapeake Bay State, including a
				description of the extent to which those measures have been fully
				implemented;</text>
								</clause><clause id="H5EAD0DC64BEF4780BF2A3928832FD85E"><enum>(ii)</enum><text>includes a
				listing of all the management measures described in clause (i) that the
				Chesapeake Bay State has failed to fully implement in accordance with the
				approved watershed implementation plan of the Chesapeake Bay State;</text>
								</clause><clause id="H9E9044C5FC9D4FFB9AC9FA3FE3EC4D11"><enum>(iii)</enum><text>includes
				monitored and collected water quality data;</text>
								</clause><clause id="H32E4355E202B4DDBB9CF6B22B51B5D8B"><enum>(iv)</enum><text>includes
				Chesapeake Bay Program computer modeling data that detail the nitrogen,
				phosphorus, and sediment load reductions projected to be achieved as a result
				of the implementation of the management measures and mechanisms carried out by
				the Chesapeake Bay State;</text>
								</clause><clause id="HFB190F265A434C8086FAB481744032A5"><enum>(v)</enum><text>includes, for the
				subsequent 2-year period, implementation goals and Chesapeake Bay Program
				computer modeling data detailing the projected pollution reductions to be
				achieved if the Chesapeake Bay State fully implements the subsequent round of
				management measures;</text>
								</clause><clause id="H1D41E09AD24245B38D8EE15C85DA0BC7"><enum>(vi)</enum><text>identifies
				compliance information, including violations, actions taken by the Chesapeake
				Bay State to address the violations, and dates, if any, on which compliance was
				achieved; and</text>
								</clause><clause id="H481A24F29A0842C7B445D77C883BF27D"><enum>(vii)</enum><text>specifies any
				revisions to the watershed implementation plan submitted under this paragraph
				that the Chesapeake Bay State determines are necessary to attain the applicable
				pollutant limitations for nitrogen, phosphorus, and sediment.</text>
								</clause></subparagraph></paragraph><paragraph id="H9CBD0587037D41CA8EE142BF787DC31D"><enum>(2)</enum><header>Issuance of
				permits</header>
							<subparagraph id="H58CFFA19C24E4857999CF2A4F91CAE8A"><enum>(A)</enum><header>In
				general</header><text>Notwithstanding any other provision of this Act
				(including any exclusion or exception contained in a definition under section
				502), for the purpose of achieving the nitrogen, phosphorus, and sediment
				reductions required under a watershed implementation plan, a Chesapeake Bay
				State may issue a permit in accordance with section 402 for any pollution
				source the Chesapeake Bay State determines to be necessary.</text>
							</subparagraph><subparagraph id="HC9B011B6D8D040A088692AF2B5BF9C77"><enum>(B)</enum><header>Enforcement</header><text>The
				Administrator shall enforce any permits issued in accordance with the watershed
				implementation plan in the same manner as other permits issued under section
				402 are enforced.</text>
							</subparagraph></paragraph><paragraph id="HC9C7FC93725B4021BF69554BD34D75B7"><enum>(3)</enum><header>Reduction of
				pollution from impervious surfaces</header>
							<subparagraph id="HAF03DFF9846F457B83F4B36B635D91F7"><enum>(A)</enum><header>In
				general</header><text>Not later than January 1, 2013, each unit of local
				government within the Chesapeake Bay watershed that discharges stormwater
				through a storm sewer system, regardless of storm sewer system ownership and
				without regard to the size of the population, shall obtain and comply with a
				permit under section 402(p).</text>
							</subparagraph><subparagraph id="H63A2162AC44A402883CCC14393032789"><enum>(B)</enum><header>Requirements</header><text>A
				permit under section 402(p) for a unit of local government within the
				Chesapeake Bay watershed shall include requirements to ensure that a project to
				develop land within the jurisdiction of such unit of local government that
				affects land that is more than 1 acre in size and that is less than 5 percent
				covered by impervious surfaces prior to the project is carried out in a manner
				that not less than the volume of the 95th percentile precipitation event shall
				infiltrate, e­va­po­tran­spi­rate from, or be harvested and used on such site
				after the project is completed.</text>
							</subparagraph></paragraph><paragraph id="H5A5D9D495CC9403EAFFCF51C4F840A0A"><enum>(4)</enum><header>Phosphate
				ban</header>
							<subparagraph id="HAB4265925AF5421B9AAA687516929A91"><enum>(A)</enum><header>Phosphorus in
				cleaning agents</header><text>Each Chesapeake Bay State shall provide to the
				Administrator, not later than 3 years after the date of enactment of the
				<short-title>Chesapeake Clean Water and Ecosystem
				Restoration Act of 2009</short-title>, assurances that within the jurisdiction,
				except as provided in subparagraph (B), a person may not use, sell,
				manufacture, or distribute for use or sale any cleaning agent that contains
				more than 0.0 percent phosphorus by weight, expressed as elemental phosphorus,
				except for a quantity not exceeding 0.5 percent phosphorus that is incidental
				to the manufacture of the cleaning agent.</text>
							</subparagraph><subparagraph id="H1A425D0F36374CD6AB57D9F562DE1F58"><enum>(B)</enum><header>Prohibited
				quantities of phosphorus</header><text>Each Chesapeake Bay State shall provide
				to the Administrator, not later than 3 years after the date of enactment of the
				<short-title>Chesapeake Clean Water and Ecosystem
				Restoration Act of 2009</short-title>, assurances that within the jurisdiction
				a person may use, sell, manufacture, or distribute for use or sale a cleaning
				agent that contains greater than 0.0 percent phosphorus by weight, but does not
				exceed 8.7 percent phosphorus by weight, if the cleaning agent is a substance
				that the Administrator, by regulation, excludes from the limitation under
				subparagraph (A), based on a finding that compliance with that subparagraph
				would—</text>
								<clause id="HED04DE7610F444CDB9C1CDAA1A5D7C69"><enum>(i)</enum><text>create a
				significant hardship on the users of the cleaning agent; or</text>
								</clause><clause id="HFC0C5702A3054D5898E4025E7EE4D1A2"><enum>(ii)</enum><text>be unreasonable
				because of the lack of an adequate substitute cleaning agent.</text>
								</clause></subparagraph></paragraph></subsection><subsection id="HE54BB852317C49278BDCC1806161F4B7"><enum>(j)</enum><header>Action by
				Administrator</header>
						<paragraph id="HE5B7E5BEF5DB42BC8CCF4338B86946F7"><enum>(1)</enum><header>In
				general</header><text>Not later than 60 days after the date of enactment of the
				<short-title>Chesapeake Clean Water and Ecosystem
				Restoration Act of 2009</short-title>, the Administrator shall establish
				minimum criteria that any proposed watershed implementation plan must meet
				before the Administrator may approve such a plan.</text>
						</paragraph><paragraph commented="no" id="H8AC382AFF504468A87295A8AC5CD0EB8"><enum>(2)</enum><header>Completeness
				finding</header>
							<subparagraph commented="no" id="HCD775C960D6A495985DAA7878A806767"><enum>(A)</enum><header>In
				general</header><text>Not later than 60 days after the date on which the
				Administrator receives a new or revised proposed watershed implementation plan
				from a Chesapeake Bay State, the Administrator shall determine whether the
				minimum criteria for the plan established under paragraph (1) have been
				met.</text>
							</subparagraph><subparagraph commented="no" id="H285DCADD27214521BD89F26D67F8CC7A"><enum>(B)</enum><header>Effect of
				finding of incompleteness</header><text>If the Administrator determines under
				subparagraph (A) that all or any portion of a submitted watershed
				implementation plan does not meet the minimum criteria established under
				paragraph (1), the Chesapeake Bay State submitting the plan shall be treated as
				not having made the submission.</text>
							</subparagraph></paragraph><paragraph id="HCFF25BF23E8E4547A2EFB25528D0D0B2"><enum>(3)</enum><header>Approval and
				disapproval</header>
							<subparagraph id="H76EC6241D3F04EEB856CE25C5663673A"><enum>(A)</enum><header>Deadline</header><text>Not
				later than 90 days after determining that a watershed implementation plan meets
				minimum criteria in accordance with paragraph (2)(A), the Administrator shall
				approve or disapprove the plan.</text>
							</subparagraph><subparagraph id="HCBF48E6B8F1B4582A7D9476275C53C9E"><enum>(B)</enum><header>Full and partial
				approval and disapproval</header><text>In carrying out this paragraph, the
				Administrator—</text>
								<clause id="H3AA98825948A45E192435EB870E886B1"><enum>(i)</enum><text>shall approve a
				watershed implementation plan if the plan meets all applicable requirements
				under this section; and</text>
								</clause><clause id="H088A5C7FDA994CD2AE1C07F212FA8062"><enum>(ii)</enum><text>may approve the
				plan in part and disapprove the plan in part if only a portion of the plan
				meets those requirements.</text>
								</clause></subparagraph><subparagraph id="HBF150549F919401D86EC40CCCCBA478F"><enum>(C)</enum><header>Conditional
				approval</header><text>The Administrator—</text>
								<clause id="H8C0418CA68EC4C8A98B8D789BA2FFFDF"><enum>(i)</enum><text>may conditionally
				approve a revised watershed implementation plan based on a commitment of the
				Chesapeake Bay State submitting the plan to adopt specific enforceable
				management measures by not later than 1 year after the date of approval of the
				plan revision; but</text>
								</clause><clause id="HC7DC9751AED04A0BBFBDB76E593C1804"><enum>(ii)</enum><text>shall treat a
				conditional approval as a disapproval under this paragraph if the Chesapeake
				Bay State fails to comply with the commitment of the Chesapeake Bay
				State.</text>
								</clause></subparagraph><subparagraph id="H9889EE676613496080C6B17B29A26636"><enum>(D)</enum><header>Full approval
				required</header><text>A new or revised watershed implementation plan shall not
				be treated as meeting the requirements of this section until the Administrator
				approves the entire new or revised plan.</text>
							</subparagraph><subparagraph id="H7E203F1EEB7C424C809C7FA54B5263C6"><enum>(E)</enum><header>Corrections</header><text>In
				any case in which the Administrator determines that the action of the
				Administrator approving, disapproving, conditionally approving, or promulgating
				any new or revised watershed implementation plan was in error, the
				Administrator—</text>
								<clause id="H55D851350FDC45C38E46F8C363003856"><enum>(i)</enum><text>may, in the same
				manner as the approval, disapproval, conditional approval, or promulgation,
				revise the action of the Administrator, as appropriate, without requiring any
				further submission from the Chesapeake Bay State; and</text>
								</clause><clause id="H1825C3BAE764432D88788979F310F2ED"><enum>(ii)</enum><text>shall make the
				determination of the Administrator, and the basis for that determination,
				available to the public.</text>
								</clause></subparagraph><subparagraph id="H99692652C450461AADA72639131EA976"><enum>(F)</enum><header>Effective
				date</header><text>The provisions of a State watershed implementation plan
				shall take effect upon the date of approval of the plan.</text>
							</subparagraph></paragraph><paragraph id="HD0E29E37D1824814A8BBA6BF3D7F2515"><enum>(4)</enum><header>Calls for plan
				revision</header><text>In any case in which the Administrator determines that
				the watershed implementation plan for any area is inadequate to attain or
				maintain applicable pollution limitations, the Administrator—</text>
							<subparagraph id="HEB1CB300785B43299DA6321472933F4D"><enum>(A)</enum><text>shall notify the
				Chesapeake Bay State of, and require the Chesapeake Bay State to revise the
				plan to correct, the inadequacies;</text>
							</subparagraph><subparagraph id="H93419B92E5C3406899FE44D64EA9EC32"><enum>(B)</enum><text>may establish
				reasonable deadlines (not to exceed 180 days after the date on which the
				Administrator provides the notification) for the submission of a revised
				watershed implementation plan;</text>
							</subparagraph><subparagraph id="H0244D076BAE849078342B344250F2774"><enum>(C)</enum><text>shall make the
				findings of the Administrator under paragraph (3) and notice provided under
				subparagraph (A) public; and</text>
							</subparagraph><subparagraph id="H44B342E461F742D8B502CCEF28905355"><enum>(D)</enum><text>shall require the
				Chesapeake Bay State to comply with the requirements applicable under the
				initial watershed implementation plan, except that the Administrator may adjust
				any dates (other than attainment dates) applicable under those requirements, as
				appropriate.</text>
							</subparagraph></paragraph><paragraph id="H51A3DD2BC08149908563A4D63B17CFA4"><enum>(5)</enum><header>Federal
				implementation</header><text>If a Chesapeake Bay State fails to submit a
				watershed implementation plan, to submit a biennial report, or to correct a
				previously missed 2-year commitment made in a watershed implementation plan,
				the Administrator shall, after issuing a notice to the State and providing a
				90-day period in which the failure may be corrected—</text>
							<subparagraph id="HBD9CFF47DCF44728B12EE61006E7ACAD"><enum>(A)</enum><text display-inline="yes-display-inline">notwithstanding the requirements of
				sections 601(a) and 603(g) of this Act, reserve up to 75 percent of a
				Chesapeake Bay State’s capitalization grant for a State water pollution control
				revolving fund to be available for projects and activities authorized under
				section 603(c) of this Act that are selected by the Administrator, after a
				notice to the State, to be carried out within such State;</text>
							</subparagraph><subparagraph commented="no" id="H885F34C8E4884DA19D1230B71C45E8E4"><enum>(B)</enum><text>withhold all funds
				otherwise available to the Chesapeake Bay State under this Act other than those
				funds authorized under title VI of this Act;</text>
							</subparagraph><subparagraph id="H88697CA48128467C9A4A5971898EC9C1"><enum>(C)</enum><text>develop and
				administer a watershed implementation plan for that Chesapeake Bay State until
				such time as the Chesapeake Bay State has remedied the plan, reports, or
				achievements to the satisfaction of the Administrator;</text>
							</subparagraph><subparagraph id="H690FA977309F4FABAF8FDEA707E41AFF"><enum>(D)</enum><text>require that all
				permits issued under section 402 for new or expanding discharges of nitrogen,
				phosphorus, or sediment acquire offsets that exceed by 100 percent an amount
				that would otherwise be required, taking into account attenuation, equivalency,
				and uncertainty; and</text>
							</subparagraph><subparagraph id="H907AF8C48B7B48A5A3265FAA88E7315C"><enum>(E)</enum><text>for the purposes
				of developing and implementing a watershed implementation plan under
				subparagraph (C)—</text>
								<clause id="HDDB620C1586E4FF6A93FBA9A25E64268"><enum>(i)</enum><text>notwithstanding
				any other provision of this Act (including any exclusion or exception contained
				in a definition under section 502), promulgate such regulations or issue such
				permits as the Administrator determines to be necessary to control pollution
				sufficient to meet the water quality goals defined in the watershed
				implementation plan; and</text>
								</clause><clause id="H43F22D147D4B4100A7EA3F281DB734D6"><enum>(ii)</enum><text>enforce any
				permits issued in accordance with the watershed implementation plan in the same
				manner as other permits issued under section 402 are enforced.</text>
								</clause></subparagraph></paragraph><paragraph id="H68394345CEAB4AB7B0BA58CCAC4EE463"><enum>(6)</enum><header>Nitrogen and
				phosphorus trading program</header>
							<subparagraph id="HB50E40F3702443EB86547FE81F297D92"><enum>(A)</enum><header>Establishment</header><text>Not
				later than May 12, 2012, the Administrator, in cooperation with each Chesapeake
				Bay State, shall establish an interstate nitrogen and phosphorus trading
				program for the Chesapeake Bay for the generation, trading, and use of nitrogen
				and phosphorus credits to facilitate the attainment and maintenance of the
				Chesapeake Bay-wide TMDL for nitrogen and phosphorus.</text>
							</subparagraph><subparagraph id="H827472A74B3C4BEBAC6C63F10BE9AA35"><enum>(B)</enum><header>Trading
				system</header><text>The trading program established under this subsection
				shall, at a minimum—</text>
								<clause id="H3322C8AFAAAD4E6A87617F3813B8D7AB"><enum>(i)</enum><text>define and
				standardize nitrogen and phosphorus credits and establish procedures or
				standards for ensuring equivalent water quality benefits for all
				credits;</text>
								</clause><clause id="HF73103AA90474BF5816C433F5F29D80B"><enum>(ii)</enum><text>establish
				procedures or standards for certifying, verifying, and enforcing nitrogen and
				phosphorus credits to ensure that credit-generating practices from both point
				sources and nonpoint sources are achieving actual reductions in nitrogen and
				phosphorus;</text>
								</clause><clause id="HFCE038C99DF44198A53AB32B89D25F3F"><enum>(iii)</enum><text>establish
				procedures or standards for generating, quantifying, trading, and applying
				credits to meet regulatory requirements and allow for trading to occur between
				and across point source or nonpoint dischargers;</text>
								</clause><clause id="HD99C8A9DEBAB45FDB0840E828CD3ADC1"><enum>(iv)</enum><text>establish
				baseline requirements that a credit seller must meet before becoming eligible
				to generate saleable credits;</text>
								</clause><clause id="H63C47AA201004930A43B6CBFD68C1DC6"><enum>(v)</enum><text>establish
				points-of-regulation at the sub-State level to facilitate trading and promote
				water quality goals under which—</text>
									<subclause id="HAB0B51935EA642FF9560486E554E736F"><enum>(I)</enum><text>States may
				designate point sources as points-of-regulation, but not nonpoint
				dischargers;</text>
									</subclause><subclause id="H2FFA3843301643ABAF6A6F3DBB2979F9"><enum>(II)</enum><text>States shall
				aggregate multiple nonpoint dischargers to serve as points-of-regulation;
				and</text>
									</subclause><subclause id="HD110E7D3DEDD444298CBDFA2C3AB8324"><enum>(III)</enum><text>the
				Administrator shall establish guidelines or standards to ensure that
				points-of-regulation shall be generally consistent across States;</text>
									</subclause></clause><clause id="H2007EC696FC843D3ABC948C9972D86D3"><enum>(vi)</enum><text>ensure that
				credits are used in accordance with permit requirements under the national
				pollutant discharge elimination system established under section 402 and trade
				requirements have been adequately incorporated into the permits;</text>
								</clause><clause id="H8D6BB0AB7E114A1E8382ABC6A987627F"><enum>(vii)</enum><text>ensure that
				private contracts between credit buyers and credit sellers contain adequate
				provisions to ensure enforceability under applicable law;</text>
								</clause><clause id="H68594EF6FFA2486F87D7E9C0B806625E"><enum>(viii)</enum><text>establish
				procedures or standards for providing public transparency on nutrient trading
				activity;</text>
								</clause><clause id="H79FF849831A947388591F1D35C54C299"><enum>(ix)</enum><text>ensure that, if
				the local receiving water is impaired for the nutrient being traded but a TMDL
				has not yet been implemented for the impairment—</text>
									<subclause id="HD94014462E7E431F9F6408DF0E0F4E4D"><enum>(I)</enum><text>trades are
				required to result in progress toward or the attainment of water quality
				standards in the local receiving water; and</text>
									</subclause><subclause id="H411122D0CBA9410E8E79692EFEEE2333"><enum>(II)</enum><text>dischargers in
				the watershed may not rely on credits produced outside of the watershed;</text>
									</subclause></clause><clause id="H0A53DDD260E44127B8BF863A8017D208"><enum>(x)</enum><text>require that the
				application of credits to meet regulatory requirements under this section not
				cause or contribute to exceedances of water quality standards, total maximum
				daily loads, or wasteload or load allocations for affected receiving waters,
				including avoidance of localized impacts;</text>
								</clause><clause id="H92477A148CA24E74B594481F3111B338"><enum>(xi)</enum><text>except as part of
				a consent agreement, prohibit the purchase of credits from any entity that is
				in significant noncompliance with an enforceable permit issued under section
				402;</text>
								</clause><clause id="H6536A68136274E4D855C0D6E79FC5CBB"><enum>(xii)</enum><text>consider and
				incorporate, to the maximum extent practicable, elements of State trading
				programs in existence as of the date of enactment of the
				<short-title>Chesapeake Clean Water and Ecosystem
				Restoration Act of 2009</short-title>; and</text>
								</clause><clause id="H589416BB98374E74860762D740F8CC0A"><enum>(xiii)</enum><text>allow for, as
				appropriate, the aggregation and banking of credits by third parties.</text>
								</clause></subparagraph><subparagraph id="H6EB2E9487B7D40ACBF941A41323B488B"><enum>(C)</enum><header>Facilitation of
				trading</header><text>In order to attract market participants and facilitate
				the cost-effective achievement of water quality goals, the Administrator shall
				ensure that the trading program established under this paragraph—</text>
								<clause id="H9865877E126F4A9693E0D515908771C3"><enum>(i)</enum><text>includes measures
				to mitigate credit buyer risk;</text>
								</clause><clause id="HEFA158BE08D44CC688E6A182FC825CA6"><enum>(ii)</enum><text>makes use of the
				best available science in order to minimize uncertainty and related transaction
				costs to traders, including the Administrator, in consultation with the
				Secretary of Agriculture, supporting research and other activities that
				increase the scientific understanding of nonpoint nutrient pollutant loading
				and the ability of various structural and nonstructural alternatives to reduce
				the loads;</text>
								</clause><clause id="H390EF87A3D5F4B7590FC254F5DB7E48B"><enum>(iii)</enum><text>eliminates
				unnecessary or duplicative administrative processes; and</text>
								</clause><clause id="H9405AA664DF54F7F9FDCD6AE79331E11"><enum>(iv)</enum><text>incorporates a
				permitting approach under the national pollutant discharge elimination system
				established under section 402 that creates a general approval for trading
				avoiding the need to reopen or reissue permits to incorporate individual
				trades.</text>
								</clause></subparagraph></paragraph><paragraph id="H34A77E67DD264ED786B34AC06EDCDBA6"><enum>(7)</enum><header>Authority
				relating to development</header><text>The Administrator shall—</text>
							<subparagraph id="H572174B0573A4F0894A6F413B6120684"><enum>(A)</enum><text display-inline="yes-display-inline">establish and issue, for any project
				affecting land that is more than 1 acre in size and that is less than 5 percent
				covered by impervious surfaces prior to such project that proposes to increase
				the overall percentage of impervious surfaces, guidance relating to site
				planning, design, construction, and maintenance strategies to ensure that not
				less than the volume of the 95th percentile precipitation event shall
				infiltrate, evapotranspirate from, or be harvested and used on such site after
				the project is completed; and</text>
							</subparagraph><subparagraph id="HCD9BD4FED290469896BDFE61EA1849ED"><enum>(B)</enum><text>establish and
				issue model ordinances and guidelines with respect to the construction of
				low-impact development infrastructure and nonstructural low-impact development
				techniques for use by States, local governments, and private entities.</text>
							</subparagraph></paragraph><paragraph id="H1C06586C984B43298F7DC343FBDF976B"><enum>(8)</enum><header>Assistance with
				respect to stormwater discharges</header>
							<subparagraph id="HDBC148ECBE8948E1B9339C9B7E80B2D3"><enum>(A)</enum><header>Grant
				program</header><text>The Administrator may provide grants to any local
				government within the Chesapeake Bay watershed that adopts the guidance,
				ordinances, and guidelines issued under paragraph (7).</text>
							</subparagraph><subparagraph id="H00FB0B8D8FFF48BEAED2C1298BD3054D"><enum>(B)</enum><header>Use of
				funds</header><text>A grant provided under subparagraph (A) may be used by a
				local government to pay costs associated with—</text>
								<clause id="H790864EDA65A4C6484DE66C6E4CACE7C"><enum>(i)</enum><text>developing,
				implementing, and enforcing the guidance, ordinances, and guidelines issued
				under paragraph (7); and</text>
								</clause><clause id="H368C0C2B7DA843959C0C9D071B2AD799"><enum>(ii)</enum><text>implementing a
				project that is designed, constructed, and maintained to meet the relative
				performance standard described in subsection (i)(3)(B).</text>
								</clause></subparagraph></paragraph><paragraph id="HC06664AB8E2A435A83E5203E152A659F"><enum>(9)</enum><header>Consumer and
				commercial product report</header><text>Not later than 3 years after the date
				of enactment of the <short-title>Chesapeake Clean Water
				and Ecosystem Restoration Act of 2009</short-title>, the Administrator, in
				consultation with the Chesapeake Executive Council, shall—</text>
							<subparagraph id="H952EE6FC58674074B3E2AE21EDE5ED5C"><enum>(A)</enum><text>review consumer
				and commercial products, the use of which may affect the water quality of the
				Chesapeake Bay watershed or associated tributaries, to determine whether
				further product nutrient content restrictions are necessary to restore or
				maintain water quality in the Chesapeake Bay watershed and those tributaries;
				and</text>
							</subparagraph><subparagraph id="HACE64AE8C0E6437C8C15DEE6742264A5"><enum>(B)</enum><text>submit to the
				Committees on Appropriations, Environment and Public Works, and Commerce,
				Science, and Transportation of the Senate and the Committees on Appropriations,
				Natural Resources, Energy and Commerce, and Transportation and Infrastructure
				of the House of Representatives a report detailing the findings of the review
				under subparagraph (A).</text>
							</subparagraph></paragraph></subsection><subsection id="H61ACAB845E684A9783F4C15D1BDF993D"><enum>(k)</enum><header>Prohibition on
				introduction of Asian oysters</header><text>Not later than 2 years after the
				date of enactment of the <short-title>Chesapeake Clean
				Water and Ecosystem Restoration Act of 2009</short-title>, the Administrator
				shall promulgate regulations—</text>
						<paragraph id="HC26273FD060A4684B4729452A90A6316"><enum>(1)</enum><text>to designate the
				Asian oyster as a <term>biological pollutant</term> in the Chesapeake Bay and
				tidal waters pursuant to section 502;</text>
						</paragraph><paragraph id="H33056AE8311B456AB83817423D112F05"><enum>(2)</enum><text>to prohibit the
				issuance of permits under sections 402 and 404 for the discharge of the Asian
				oyster into the Chesapeake Bay and tidal waters; and</text>
						</paragraph><paragraph id="H446F3213CC9B463593174DA63335D8B8"><enum>(3)</enum><text>to specify
				conditions under which scientific research on Asian oysters may be conducted
				within the Chesapeake Bay and tidal waters.</text>
						</paragraph></subsection><subsection id="HB468615E59DB4B3EB753E1CE222B9372"><enum>(l)</enum><header>Effect on other
				requirements</header>
						<paragraph id="HA897E4F8BDA644128EC7AA648D768FEE"><enum>(1)</enum><header>In
				general</header><text>Nothing in this section removes or otherwise affects any
				other obligation for a point source to comply with other applicable
				requirements under this Act.</text>
						</paragraph><paragraph id="HC2F2AA94D9D840B0A2988FD016D62B9C"><enum>(2)</enum><header>Violations by
				States</header><text>The failure of a State to submit a watershed
				implementation plan or biennial report, or to correct a previously missed
				2-year commitment made in a watershed implementation plan, by the applicable
				deadline established under this section shall—</text>
							<subparagraph id="H5512F4AAEAC84540A5A002D8331BF174"><enum>(A)</enum><text>constitute a
				violation of this Act; and</text>
							</subparagraph><subparagraph id="H3BCE9227DE634543A90C38C5001B74D0"><enum>(B)</enum><text>subject the State
				to—</text>
								<clause id="H0B1E0BFC75494887B785807D520EDDED"><enum>(i)</enum><text>enforcement action
				by the Administrator; and</text>
								</clause><clause id="H078EF3EE2A8B4763B92A099351A1E7FC"><enum>(ii)</enum><text>civil actions
				commenced pursuant to section 505.</text>
								</clause></subparagraph></paragraph><paragraph id="H3E215025B12D42448AD91CC35F4BF178"><enum>(3)</enum><header>Failure of
				Administrator to act</header><text>The failure of the Administrator to act
				under this section shall subject the Administrator to civil actions commenced
				pursuant to section 505.</text>
						</paragraph></subsection><subsection id="HEE90FA624229458DBF473F2D90E5CA85"><enum>(m)</enum><header>Evaluation by
				the Inspector General</header><text>The Inspector General of the Environmental
				Protection Agency shall evaluate the implementation of this section on a
				periodic basis of not less than once every 3 years.</text>
					</subsection><subsection id="H1F0BFBC25737483486A68745D8438559"><enum>(n)</enum><header>Authorization of
				appropriations</header>
						<paragraph id="H7CF451690F3E41E2A415C4AF62F54FCD"><enum>(1)</enum><header>Implementation
				and monitoring grants</header>
							<subparagraph id="H353139FF61064534A750EEE01A12E8A0"><enum>(A)</enum><header>Authorization of
				appropriations</header><text>In addition to amounts authorized to be
				appropriated or otherwise made available to carry out this section, there are
				authorized to be appropriated to the Administrator—</text>
								<clause id="H6F2F0E3637354A75B4505B8BFD6773DF"><enum>(i)</enum><text>to
				provide implementation grants under subsection (e)(3)(A), $80,000,000 for each
				of fiscal years 2010 through 2015, to remain available until expended;</text>
								</clause><clause id="H3C6E7DF9C14B492781F2078ADE21496A"><enum>(ii)</enum><text>to carry out a
				freshwater monitoring program under subsection (e)(3)(B), $5,000,000 for each
				of fiscal years 2010 through 2015; and</text>
								</clause><clause id="H0D88F3BE46484A018BD384851BB6825E"><enum>(iii)</enum><text>to carry out a
				Chesapeake Bay and tidal water monitoring program under subsection (e)(3)(B),
				$5,000,000 for each of fiscal years 2010 through 2015.</text>
								</clause></subparagraph><subparagraph id="HBE850E3F375648CCA838446AE8EA30D0"><enum>(B)</enum><header>Cost
				sharing</header><text>The Federal share of the cost of a program carried out
				using funds from a grant provided—</text>
								<clause id="H52B49A3AB7384BB7AF3AF848F25971AA"><enum>(i)</enum><text>under subparagraph
				(A)(i) shall not exceed 50 percent; and</text>
								</clause><clause id="H4BF6C05DD9D442BBA95D1CDC3910A481"><enum>(ii)</enum><text>under clause (ii)
				or (iii) of subparagraph (A) shall not exceed 80 percent.</text>
								</clause></subparagraph></paragraph><paragraph id="H3185C53A33AE4AF1A4AAF328D8220E15"><enum>(2)</enum><header>Chesapeake
				stewardship grants</header><text>There is authorized to be appropriated to
				carry out subsection (g)(2) $15,000,000 for each of fiscal years 2010 through
				2014.</text>
						</paragraph><paragraph id="H36B8BD45BA6945838E24CC4A82E753E0"><enum>(3)</enum><header>Stormwater
				pollution planning and implementation grants</header>
							<subparagraph id="HBE73E9E5D1F04E62AC9FA965E3B37E0F"><enum>(A)</enum><header>Authorization of
				appropriations</header><text>In addition to amounts authorized or otherwise
				made available to carry out this section, there are authorized to be
				appropriated to the Administrator—</text>
								<clause id="HB98FC8B6F0DF462C843EF0F02E1F4FF4"><enum>(i)</enum><text>to
				carry out subsection (j)(8)(B)(i), $10,000,000; and</text>
								</clause><clause id="H6CC7A7C19DDB4BEE9BBD3B2A8BA3346A"><enum>(ii)</enum><text>to carry out
				subsection (j)(8)(B)(ii), $1,500,000,000.</text>
								</clause></subparagraph><subparagraph id="H7F931DDD4EE34138B2DB72E8564FB95C"><enum>(B)</enum><header>Cost-sharing</header><text>A
				grant provided for a project under—</text>
								<clause id="H6A485D66C49045CC872A87B1D8674AB5"><enum>(i)</enum><text>subsection
				(j)(8)(B)(i) may not be used to cover more than 80 percent of the cost of the
				project; and</text>
								</clause><clause id="HA5854CA654AA4335A8D56EDF87935E31"><enum>(ii)</enum><text>subsection
				(j)(8)(B)(ii) may not be used to cover more than 75 percent of the cost of the
				project.</text>
								</clause></subparagraph></paragraph><paragraph id="HE61D0C1385924B7781175A307B7B3756"><enum>(4)</enum><header>Limitation on
				administrative expenses</header><text>Not more than 10 percent of the annual
				amount of any grant provided by the Administrator or Secretary under any
				program described in paragraphs (1), (2), or (3) may be used for administrative
				expenses.</text>
						</paragraph><paragraph id="HB6BC333A4E7549E08CE2C68EC8FC4CB2"><enum>(5)</enum><header>Availability</header><text>Amounts
				authorized to be appropriated under this subsection shall remain available
				until
				expended.</text>
						</paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section id="H7EA1925E97A441739841B0EB12B76BDE"><enum>4.</enum><header>Nonpoint source
			 management programs</header><text display-inline="no-display-inline">Section
			 319(j) of the Federal Water Pollution Control Act (33 U.S.C. 1329) is amended
			 by striking <quote>not to exceed $70,000,000</quote> and all that follows
			 through the period and inserting <quote>$500,000,000 for each of the fiscal
			 years 2010 through 2015.</quote>.</text>
