		<section commented="no" display-inline="no-display-inline" id="H3E34CA13BDFA4BA2946A4198D81BD4EE" section-type="section-one"><enum>1.</enum><header display-inline="yes-display-inline">Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Nutria Eradication and Control Act of
			 2009</short-title></quote>.</text>
		</section><section commented="no" display-inline="no-display-inline" id="HF086D3BA7B78456A931296034ABD2910" section-type="subsequent-section"><enum>2.</enum><header display-inline="yes-display-inline">Findings; purpose</header>
			<subsection commented="no" display-inline="no-display-inline" id="H2BE80A26CB7A4C75A95169893C34792A"><enum>(a)</enum><header display-inline="yes-display-inline">Findings</header><text display-inline="yes-display-inline">Congress finds that—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="HA482C6AE2E014632B750702E1EA64E08"><enum>(1)</enum><text display-inline="yes-display-inline">wetland and tidal marshes in the Chesapeake
			 Bay, the State of Louisiana, and other coastal States provide significant
			 cultural, economic, and ecological benefits to the United States;</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H0628DD44012C45B8B4111BBE708FFCE1"><enum>(2)</enum><text display-inline="yes-display-inline">the South American nutria (Myocastor
			 coypus) is directly contributing to substantial marsh loss on Federal, State,
			 and private land in the States of Maryland and Louisiana and other coastal
			 States;</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H0A90E69037514FA99F99AC5E424CF1C6"><enum>(3)</enum><text display-inline="yes-display-inline">the Nutria Eradication and Control Act of
			 2003 (Public Law 108–16; 117 Stat. 621) authorized the Maryland Nutria Project,
			 which has successfully eradicated nutria from more than 130,000 acres of
			 Chesapeake Bay wetland in the State of Maryland;</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HF96CDDDC6476497E9F5DF740F939FC84"><enum>(4)</enum><text display-inline="yes-display-inline">the Nutria Eradication and Control Act of
			 2003 (Public Law 108–16; 117 Stat. 621) and the Coastal Wetlands Planning,
			 Protection, and Restoration Act (16 U.S.C. 3951 et seq.) authorized the
			 Coastwide Nutria Control Program, which has reduced nutria-impacted wetland
			 acres in the State of Louisiana from 80,000 acres to 23,141 acres; and</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H07B2DAFE16884AE88CDFCA31BB728C89"><enum>(5)</enum><text display-inline="yes-display-inline">proven techniques developed under the
			 Nutria Eradication and Control Act of 2003 (Public Law 108–16; 117 Stat. 621)
			 that are eradicating nutria from the State of Maryland and are reducing the
			 acres of nutria-impacted wetland in Louisiana, should be applied to nutria
			 eradication or control programs in other nutria-infested coastal States.</text>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H362EC1603C05457AA9EEC72AE96ACD7E"><enum>(b)</enum><header display-inline="yes-display-inline">Purpose</header><text display-inline="yes-display-inline">The purpose of this Act is to authorize the
			 Secretary of the Interior to provide financial assistance to the States of
			 Maryland, Louisiana, Delaware, Oregon, Virginia, and Washington to carry out
			 activities—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="H7A758EF4EAFB4CBBA6CE1B709773D04D"><enum>(1)</enum><text display-inline="yes-display-inline">to eradicate or control nutria; and</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HCE290CC37295423498EB823EB480871D"><enum>(2)</enum><text display-inline="yes-display-inline">to restore nutria damaged wetland.</text>
				</paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="H74E74CBCB5E84CDF93474D95B181B59D" section-type="subsequent-section"><enum>3.</enum><header display-inline="yes-display-inline">Definitions</header><text display-inline="no-display-inline">In this Act:</text>
			<paragraph commented="no" display-inline="no-display-inline" id="H530C1D3A098D41B7981C4B6152CF311F"><enum>(1)</enum><header display-inline="yes-display-inline">Coastal state</header><text display-inline="yes-display-inline">The term <quote>coastal State</quote> means
			 each of the States of Delaware, Oregon, Virginia, and Washington.</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HB1FDB916B719405994F370565BA1A415"><enum>(2)</enum><header display-inline="yes-display-inline">Program</header><text display-inline="yes-display-inline">The term <quote>program</quote> means the
			 nutria eradication program established by section 4(a).</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HD3D4CDC354E2421B9E2E627EF9B3E780"><enum>(3)</enum><header display-inline="yes-display-inline">Secretary</header><text display-inline="yes-display-inline">The term <quote>Secretary</quote> means the
			 Secretary of the Interior.</text>
			</paragraph></section><section commented="no" display-inline="no-display-inline" id="H48D45EB6F79D4138B5277193E1B8A2CF" section-type="subsequent-section"><enum>4.</enum><header display-inline="yes-display-inline">Nutria eradication program</header>
			<subsection commented="no" display-inline="no-display-inline" id="H543D5BA622CD4978B11EA40666122DF5"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">There is established a nutria eradication
			 program under which the Secretary may, subject to the availability of
			 appropriations, provide financial assistance to the States of Maryland and
			 Louisiana and the coastal States to implement measures—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="H4BC08623D0AA4E86B81C1B8C11411ABE"><enum>(1)</enum><text display-inline="yes-display-inline">to eradicate or control nutria; and</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H9908FFFA75234A7AB13F067499AEA727"><enum>(2)</enum><text display-inline="yes-display-inline">to restore wetland damaged by
			 nutria.</text>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="HAE9829C1061B48DA864661E6847B8281"><enum>(b)</enum><header display-inline="yes-display-inline">Goals</header><text display-inline="yes-display-inline">The goals of the program shall be—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="HD1684D1DCF994919A7DBEC66A6401A21"><enum>(1)</enum><text display-inline="yes-display-inline">to eradicate nutria in the State of
			 Maryland;</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HF1B96ED02BCD4927966158DF9B630EB5"><enum>(2)</enum><text display-inline="yes-display-inline">to eradicate or control nutria in the State
			 of Louisiana and the coastal States; and</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HC0AFDEE0A3B64481900990B7AAA63F32"><enum>(3)</enum><text display-inline="yes-display-inline">to restore wetland damaged by
			 nutria.</text>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H3A5A2F93712A48B1BB759705D9A05B29"><enum>(c)</enum><header display-inline="yes-display-inline">Activities in the State of
			 Maryland</header><text display-inline="yes-display-inline">The Secretary shall
			 require that the program carried out in the State of Maryland consist of
			 management, research, and public education activities carried out in accordance
			 with the document published by the United States Fish and Wildlife Service
			 entitled <quote>Eradication Strategies for Nutria in the Chesapeake and
			 Delaware Bay Watersheds</quote>, dated March 2002, and updated March
			 2009.</text>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="H132E21DC9E214F96AE24950C38002435"><enum>(d)</enum><header display-inline="yes-display-inline">Cost-Sharing requirement</header>
				<paragraph commented="no" display-inline="no-display-inline" id="H4B9A5DC0231E4539A4200C25EC23EAB4"><enum>(1)</enum><header display-inline="yes-display-inline">Federal share</header><text display-inline="yes-display-inline">The Federal share of the total cost of the
			 program may not exceed 75 percent.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HF11DFACE6CCB49A8B3E60BE681B540AA"><enum>(2)</enum><header display-inline="yes-display-inline">In-kind contributions</header><text display-inline="yes-display-inline">The non-Federal share of the total cost of
			 the program may be provided in the form of in-kind contributions of materials
			 or services.</text>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H6294BF7AD0E04D959458295E2C69602C"><enum>(e)</enum><header display-inline="yes-display-inline">Limitation on administrative
			 expenses</header><text display-inline="yes-display-inline">Not more that 5
			 percent of the financial assistance provided by the Secretary under the program
			 may be used for administrative expenses.</text>
			</subsection></section><section commented="no" display-inline="no-display-inline" id="H84C9294FF48C4E92A729C50C60942B60" section-type="subsequent-section"><enum>5.</enum><header display-inline="yes-display-inline">Report</header><text display-inline="no-display-inline">Not later than 180 days after the date of
			 enactment of this Act, the Secretary and the National Invasive Species Council
			 shall—</text>
			<paragraph commented="no" display-inline="no-display-inline" id="HEDC2F9C0FFEF49E184CE1521BB135DDA"><enum>(1)</enum><text display-inline="yes-display-inline">for purposes of the program, give
			 consideration to—</text>
				<subparagraph commented="no" display-inline="no-display-inline" id="HD8D8B394B9FB45F0929FF7141CBF35A2"><enum>(A)</enum><text display-inline="yes-display-inline">the 2002 report for the Louisiana
			 Department of Wildlife and Fisheries entitled <quote>Nutria in
			 Louisiana</quote>; and</text>
				</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HF42CD1F119D04446AD12372A6304D4DE"><enum>(B)</enum><text display-inline="yes-display-inline">the March 2009 update of the document
			 entitled <quote>Eradication Strategies for the Nutria in the Chesapeake and
			 Delaware Bay Watersheds</quote> and dated March 2002;</text>
				</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HAA7A1BEC3FAB454DB82B22F08943CAEA"><enum>(2)</enum><text display-inline="yes-display-inline">continue, in cooperation with the State of
			 Louisiana Department of Wildlife and Fisheries and the State of Maryland
			 Department of Natural Resources, a long-term nutria control or eradication
			 program, as appropriate, with the objective to significantly reduce and restore
			 the damage nutria cause to coastal wetland in the States of Louisiana and
			 Maryland; and</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H1D16BC93EF724C0699C74433D2949DDB"><enum>(3)</enum><text display-inline="yes-display-inline">develop, in cooperation with the State of
			 Delaware Department of Natural Resources and Environmental Control, the State
			 of Virginia Department of Game and Inland Fisheries, the State of Oregon
			 Department of Fish and Wildlife, and the State of Washington Department of Fish
			 and Wildlife, long-term nutria control or eradication programs, as appropriate,
			 with the objective to significantly reduce and restore the damage nutria cause
			 to coastal wetland in the coastal States.</text>
			</paragraph></section><section commented="no" display-inline="no-display-inline" id="H3D327505699E4851BD3B31B65B2E7154" section-type="subsequent-section"><enum>6.</enum><header display-inline="yes-display-inline">Authorization of
			 appropriations</header><text display-inline="no-display-inline">There are
			 authorized to be appropriated to the Secretary for each of fiscal years 2010
			 through 2014—</text>
			<paragraph commented="no" display-inline="no-display-inline" id="HFDC9F94DE7A84E7A8D2667DF83732075"><enum>(1)</enum><text display-inline="yes-display-inline">$4,000,000 to provide financial assistance
			 under the program to each of the States of Maryland and Louisiana; and</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HEE128573051F4DF4B075EA74312F6D93"><enum>(2)</enum><text display-inline="yes-display-inline">$1,000,000 to provide financial assistance
			 under the program to each of the coastal States.</text>
