		  contractors, and employees of contractors for testimony, and for other

		<section id="H0EE7A924FD9247BF8EEAC63C95592F09" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Inspector General Authority
			 Improvement Act of 2009</short-title></quote>.</text>
		</section><section id="HF6C56F8D55B04C71B8DA66B4540F82B9" section-type="subsequent-section"><enum>2.</enum><header>Subpoena authority for
			 Inspectors General to require testimony of certain persons</header><text display-inline="no-display-inline">Section 6 of the Inspector General Act of
			 1978 (5 U.S.C. App.) is amended—</text>
			<paragraph id="HEF811ECC5C934464A7821DEDE43F3E9B"><enum>(1)</enum><text>in subsection
			 (a)—</text>
				<subparagraph id="H16514AEE876542CFB2DBA080E6A13F40"><enum>(A)</enum><text>at the end of
			 paragraph (8), by striking <quote>and</quote>;</text>
				</subparagraph><subparagraph id="HF39EB3B0B03340C09E839DF7DE5C64A7"><enum>(B)</enum><text>at the end of
			 paragraph (9), by striking the period and inserting <quote>;
			 and</quote>;</text>
				</subparagraph><subparagraph id="HFB9E4E80165F44DCA2D2268020DCB529"><enum>(C)</enum><text>by adding at the
			 end the following new paragraph:</text>
					<quoted-block display-inline="no-display-inline" id="H55D32458779543299532ACA4D97B9295" style="traditional">
						<paragraph id="H141ADB283A6D4974BFF9311F430ED19C"><enum>(10)</enum><text>to require by
				subpoena the testimony of certain persons, as provided in subsection
				(g).</text>
						</paragraph><after-quoted-block>;
				and</after-quoted-block></quoted-block>
				</subparagraph></paragraph><paragraph id="H20693582D8D54A0485F5801B7F1DFD30"><enum>(2)</enum><text>by adding at the
			 end the following new subsection:</text>
				<quoted-block display-inline="no-display-inline" id="H45411ECCB35A450AA545A965B24711DC" style="traditional">
					<subsection id="H65A8E1F8D33E46EBBA8934914CD771F4"><enum>(g)</enum><paragraph commented="no" display-inline="yes-display-inline" id="HBE66557B36004EFEB2DD0528634EDA8A"><enum>(1)</enum><text>Subject to paragraph
				(2), each Inspector General of an establishment, in carrying out the provisions
				of this Act, is authorized to issue a subpoena to require any individual who
				is—</text>
							<subparagraph id="H063B25F518CB484E94C8221FEF8597CF" indent="up1"><enum>(A)</enum><text>a former employee of the
				establishment;</text>
							</subparagraph><subparagraph id="H36FB56759311482DB2E8969944924CA4" indent="up1"><enum>(B)</enum><text>a former employee of a contractor (or
				subcontractor at any tier under the contractor) of the establishment; or</text>
							</subparagraph><subparagraph id="H3BA5C178B6D3403FB89631059AC96CD3" indent="up1"><enum>(C)</enum><text>a former contractor (or subcontractor
				at any tier under the contractor) of the establishment;</text>
							</subparagraph></paragraph><continuation-text continuation-text-level="subsection">to
				provide testimony by deposition that relates to matters occurring in connection
				with that individual’s employment with the establishment or status as a
				contractor or employee of a contractor (or subcontractor) of the
				establishment.</continuation-text><paragraph id="H44624050F1DC410BBF5687E64877452A" indent="up1"><enum>(2)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="HDFD08593FD2947538FAB48DF7EDC9B2E"><enum>(A)</enum><text>A subpoena issued under
				paragraph (1) shall provide reasonable notice to the individual whose testimony
				is sought and shall state the name of that individual and the place of taking
				the testimony.</text>
							</subparagraph><subparagraph id="H893FC97040F143BA883ED7AC6570BFA7" indent="up1"><enum>(B)</enum><text>The testimony sought through a
				subpoena issued under paragraph (1) shall be taken under oath. The Inspector
				General shall prepare, or cause to be prepared, a transcript of the testimony
				taken.</text>
							</subparagraph><subparagraph id="HDD2DD0E808C74FC695F97615F5124BEA" indent="up1"><enum>(C)</enum><text>An individual whose testimony is
				taken pursuant to a subpoena issued under paragraph (1) is entitled to the same
				fees and mileage paid for those services in the courts of the United States.</text>
							</subparagraph></paragraph><paragraph id="H515BFD3D6B324FD587AF7E9142F59967" indent="up1"><enum>(3)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="HA66432743A9745DD8C44F193EA609682"><enum>(A)</enum><text>At least 7 days before
				issuing a subpoena under this subsection, an Inspector General shall notify the
				Attorney General of the subpoena and the nature of the testimony sought.</text>
							</subparagraph><subparagraph id="H07E39A5FC2BE453C8A5CE5932E8F34F4" indent="up1"><enum>(B)</enum><text>The Inspector General may not issue
				the subpoena if the Attorney General informs the Inspector General, within 7
				days after receipt of the notification under subparagraph (A), that the
				Attorney General objects to the issuance of the subpoena on one or more of the
				grounds listed in clauses (i) through (iv) of subparagraph (C).</text>
							</subparagraph><subparagraph id="HCE60C7F683BF4D9C97CEDB3F708F3ED6" indent="up1"><enum>(C)</enum><text>If the Attorney General objects to
				the issuance of the subpoena and informs the Inspector General as described in
				subparagraph (B), the Attorney General shall, within 30 days after receipt of
				the notification under subparagraph (A), find in writing that the taking of the
				testimony—</text>
								<clause id="H7F40D1CE4D4E4B4C91536A9355709977"><enum>(i)</enum><text>is likely to endanger the national
				security of the United States;</text>
								</clause><clause id="HBBBE105E038641E78B0B7DF7DC1F95AE"><enum>(ii)</enum><text display-inline="yes-display-inline">is likely to interfere with any Federal or
				State criminal investigation or prosecution;</text>
								</clause><clause id="HCC42929887F440E5AC53BCEB674E2D4D"><enum>(iii)</enum><text>is likely to interfere with any
				civil litigation to which the United States or any of its agencies is or is
				likely to be a party; or</text>
								</clause><clause id="H933F6960ECAA470D893087B30DE7FF10"><enum>(iv)</enum><text>otherwise is not authorized by this
				Act.</text>
								</clause></subparagraph></paragraph><paragraph id="H58F474A315DD48F4AD61F5D8CFFFB0DF" indent="up1"><enum>(4)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="HC5B9FDADDEC64A12A5C57478AA37CE29"><enum>(A)</enum><text display-inline="yes-display-inline">Except as provided in subparagraph (B), any
				subpoena issued under this subsection may be enforceable in the district where
				the individual whose testimony is sought by subpoena resides, or, upon consent
				of the individual and the Inspector General, in the District of Columbia or in
				the district of the individual’s place of employment when working for the
				establishment, contractor, or subcontractor.</text>
							</subparagraph><subparagraph id="HF7E095047BF24DA5AF8BEB5EAD8DC667" indent="up1"><enum>(B)</enum><text display-inline="yes-display-inline">A
				proceeding to enforce a subpoena may be brought in the United States District
				Court for the District of Columbia if the individual whose testimony is sought
				by the subpoena resides within 25 miles of the District of Columbia and if the
				complaint seeking enforcement alleges that a significant portion of the matters
				that are expected to be the subject of the investigation occurred in the
				District of Columbia.</text>
							</subparagraph><subparagraph id="H11E172CECB864F73989DF38A199700C8" indent="up1"><enum>(C)</enum><text>The Attorney General shall represent
				an Office of Inspector General in the enforcement of a subpoena under this
				subsection.</text>
							</subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
