<paragraph id="H9116EFC3A91D4CAFBF6B5DD2BF45986F"><enum>(2)</enum><header>Compliance assessment</header><text display-inline="yes-display-inline">At or before the end of the period of time for the production of tangible things under an order approved under this section or at any time after the production of tangible things under such order, a judge may assess compliance with the minimization procedures required to be followed under such order by reviewing the circumstances under which information concerning United States persons was retained or disseminated.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="H420074182EE74558B0DC450C31552BAF"><enum>(d)</enum><header>Requirements for orders for certain records from libraries</header><text display-inline="yes-display-inline">Section 501 of the Foreign Intelligence Surveillance Act of 1978 (50 U.S.C. 1861) is amended—</text> 
<paragraph id="H72B1C9C0D89E456188D959C8A22A3A47"><enum>(1)</enum><text>in subsection (b)(2)—</text> 
<subparagraph id="H89AFAB4F39694742AA565A1F191D75D3"><enum>(A)</enum><text>by redesignating subparagraph (B) as subparagraph (C); and</text></subparagraph> 
<subparagraph id="HCFF15089E8614BA2B0501A7BBCD225BF"><enum>(B)</enum><text>by inserting after subparagraph (A) the following new subparagraph:</text> 
<quoted-block display-inline="no-display-inline" id="H6C8DFE2B30BB48B88206AB6C5B278C86" style="OLC"> 
<subparagraph id="H41C5D24656EA43A4BB9A8B67848A756D"><enum>(B)</enum><text>if the records sought contain bookseller information, or are from a library (as defined in section 213(1) of the Library Services and Technology Act (20 U.S.C. 9122(1))) and contain personally identifiable information about a patron of such library, a statement of specific and articulable facts showing that there are reasonable grounds to believe that the records sought—</text> 
<clause id="HE6332C0620B64B4E90D9F192A4A7A876"><enum>(i)</enum><text>are relevant to an authorized investigation (other than a threat assessment) conducted in accordance with subsection (a)(2) to obtain foreign intelligence information not concerning a United States person or to protect against international terrorism or clandestine intelligence activities; and</text></clause> 
<clause id="H55302D4AECA74DFEA8D655F1F611F832"><enum>(ii)</enum> 
<subclause commented="no" display-inline="yes-display-inline" id="H1FD1F8ED153F4DAB8AE001CB3442962C"><enum>(I)</enum><text>pertain to a foreign power or an agent of a foreign power;</text></subclause> 
<subclause id="H73CE1921C348480C8B6A3AB67C7ED679" indent="up1"><enum>(II)</enum><text>are relevant to the activities of a suspected agent of a foreign power who is the subject of such authorized investigation; or</text></subclause> 
<subclause id="HCCB26054D949495F85ECD9FBE1BDD26A" indent="up1"><enum>(III)</enum><text>pertain to an individual in contact with, or known to, a suspected agent of a foreign power who is the subject of such authorized investigation; and</text></subclause></clause></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph> 
<paragraph id="H1CFC137FDD6A41108DE6C84C6B7F7ECF"><enum>(2)</enum><text>by adding at the end the following new subsection:</text>

<subsection id="HC3D32C4EEE3F4B8F857D1CC35B7E2DE2"><enum>(i)</enum><header>Bookseller information defined</header><text display-inline="yes-display-inline">In this section, the term <quote>bookseller information</quote> means personally identifiable information concerning the purchase (including subscription purchases) or rental of books, journals, or magazines, whether in print or digitally.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section> 
<section id="HED3672DCE6984CB5A1AE23A4F1A18C68"><enum>104.</enum><header>Sunset relating to individual terrorists as agents of foreign powers</header><text display-inline="no-display-inline">Section 6001(b) of the Intelligence Reform and Terrorism Prevention Act of 2004 (50 U.S.C. 1801 note; Public Law 108–458) is amended—</text> 
<paragraph id="H807B21F75A09400D992ADCBBCCCDA89D"><enum>(1)</enum><text>in paragraph (1)—</text> 
<subparagraph id="HD5F553DD6CCC471D981EBDE605BF5982"><enum>(A)</enum><text>by striking <quote>the amendment made by subsection (a) shall cease to have effect</quote> and inserting <quote>effective</quote>; and</text></subparagraph> 
<subparagraph id="H7B4083C0216A404982228BE172D06541"><enum>(B)</enum><text>by striking the period and inserting</text>

<paragraph id="H51855044B1164357BFC9D97A00BAF82A"><enum>(1)</enum><header>Audits</header><text>The Inspector General of the Department of Justice shall perform comprehensive audits of the effectiveness and use by the Federal Government, including any improper or illegal use, of pen registers and trap and trace devices under title IV of the Foreign Intelligence Surveillance Act of 1978 (50 U.S.C. 1841 et seq.) and section 3122 of title 18, United States Code, during the period beginning on January 1, 2007 and ending on December 31, 2012.</text></paragraph> 
<paragraph id="HEE9A591363424EA3A1BA1D7406524646"><enum>(2)</enum><header>Requirements</header><text>The audits required under paragraph (1) shall include—</text> 
<subparagraph id="H524BA04D63114841A1CCB47A97D32855"><enum>(A)</enum><text>an examination of each instance in which the Attorney General or any other attorney for the Government submitted an application for an order or extension of an order under title IV of the Foreign Intelligence Surveillance Act of 1978, including whether the court granted, modified, or denied the application (including an examination of the basis for any modification or denial);</text></subparagraph> 
<subparagraph id="H3F89229C594E45E1B8E5BFB5F1CE5620"><enum>(B)</enum><text>an examination of each instance in which the Attorney General authorized the installation and use of a pen register or trap and trace device on an emergency basis under section 403 of the Foreign Intelligence Surveillance Act of 1978 (50 U.S.C. 1843);</text></subparagraph> 
<subparagraph id="HB763FBCBB04840278844637AE84AF3DE"><enum>(C)</enum><text>whether the Federal Bureau of Investigation requested that the Department of Justice submit an application for an order or extension of an order under title IV of the Foreign Intelligence Surveillance Act of 1978 and the request was not submitted to the court (including an examination of the basis for not submitting the application);</text></subparagraph> 
<subparagraph id="H40BE402CE6C44304920E8BA7A80DB400"><enum>(D)</enum><text>whether bureaucratic or procedural impediments to the use of pen registers and trap and trace devices under title IV of the Foreign Intelligence Surveillance Act of 1978 prevent the Federal Bureau of Investigation from taking full advantage of the authorities provided under that title;</text></subparagraph> 
<subparagraph id="H30F7A0BF58814CD69E3F97A956DD9050"><enum>(E)</enum><text>any noteworthy facts or circumstances relating to the use of a pen register or trap and trace device under title IV of the Foreign Intelligence Surveillance Act of 1978, including any improper or illegal use of the authority provided under that title; and</text></subparagraph> 
<subparagraph id="H6FC1FB7D4C244ADE9B6C96120AF33614"><enum>(F)</enum><text>an examination of the effectiveness of the authority under title IV of the Foreign Intelligence Surveillance Act of 1978 as an investigative tool, including—</text> 
<clause id="H06E12951CD0A4F0E8BBC543E3762DE47"><enum>(i)</enum><text>the importance of the information acquired to the intelligence activities of the Federal Bureau of Investigation or any other department or agency of the Federal Government;</text></clause> 
<clause id="H54A688C41C6141659416EFAF399C745A"><enum>(ii)</enum><text>the manner in which the information is collected, retained, analyzed, and disseminated by the Federal Bureau of Investigation, including any direct access to the information provided to any other department, agency, or instrumentality of Federal, State, local, or tribal governments or any private sector entity;</text></clause> 
<clause id="H0A27B174785D4BC48FB4CE2ADCE8EDDC"><enum>(iii)</enum><text>with respect to calendar years 2010 through 2012, an examination of the minimization procedures used in relation to pen registers and trap and trace devices under title IV of the Foreign Intelligence Surveillance Act of 1978 and whether the minimization procedures protect the constitutional rights of United States persons;</text></clause> 
<clause id="H1A10174F0B9D429CAD471FBA8BA827AA"><enum>(iv)</enum><text>whether, and how often, the Federal Bureau of Investigation used information acquired under a pen register or trap and trace device under title IV of the Foreign Intelligence Surveillance Act of 1978 to produce an analytical intelligence product for distribution within the Federal Bureau of Investigation, to the intelligence community (as defined in section 3(4) of the National Security Act of 1947 (50 U.S.C. 401a(4))), or to other Federal, State, local, or tribal government departments, agencies, or instrumentalities; and</text></clause> 
<clause id="H0C9B0F201FFC477EBF9B3ABD00EB70EF"><enum>(v)</enum><text>whether, and how often, the Federal Bureau of Investigation provided information acquired under a pen register or trap and trace device under title IV of the Foreign Intelligence Surveillance Act of 1978 to law enforcement authorities for use in criminal proceedings.</text></clause></subparagraph></paragraph> 
<paragraph id="H3E1FD145080D4CFF8F45928D233A9334"><enum>(3)</enum><header>Submission dates</header>

<subparagraph commented="no" display-inline="no-display-inline" id="HEAC7771FF2674E56A828628790003912"><enum>(B)</enum><text display-inline="yes-display-inline">by inserting after subsection (b) the following:</text>

<subsection id="HEC7EA2966FBC4DDC9883A18D520E8CA9"><enum>(h)</enum><header>Judicial review</header><text>A provider of electronic communication service or remote computing service may challenge a subpoena, order, or warrant requiring disclosure of customer communications or records under this section in—</text> 
<paragraph id="H9BD46D64AAEF4A87BA3A1DEBEB058E86"><enum>(1)</enum><text>the United States district court for the district in which the order was issued; or</text></paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="HB8A6C75145824D809253B39B28E06B8A"><enum>(2)</enum><text>the United States district court for the district in which the order was served.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section> 
<section id="HD4C84E4592544D0F91E7E67590B2E9D3"><enum>110.</enum><header>Report on civil liberties and privacy protections</header><text display-inline="no-display-inline">Not later than 180 days after the date of the enactment of this Act, the President shall submit to the Committee on the Judiciary and the Permanent Select Committee on Intelligence of the House of Representatives and the Committee on the Judiciary and the Select Committee on Intelligence of the Senate a report describing—</text> 
<paragraph id="H828364CC9489428784A41708F0509CBB"><enum>(1)</enum><text>whether operations conducted pursuant to orders issued under section 501 of the Foreign Intelligence Surveillance Act of 1978 (50 U.S.C. 1861) could be modified in a manner that enhances protections for civil liberties; and</text></paragraph> 
<paragraph id="HE48C090FE42A4C3E8213D4BDC6F02624"><enum>(2)</enum><text display-inline="yes-display-inline">the nature of any potential modifications, the likely costs of such modifications, any technical challenges, and any potential impact on such operations.</text></paragraph></section></title> 
<title id="H9578ADD6CE21406BBED3531F7AE83904"><enum>II</enum><header>NATIONAL SECURITY LETTER REFORM</header> 
<section id="H3C1D0C0CF8A040A5BAAEAEFB40FC61EC"><enum>201.</enum><header>Short title</header><text display-inline="no-display-inline">This title may be referred to as the <quote><short-title>National Security Letter Reform Act of 2009</short-title></quote>.</text></section> 
<section commented="no" display-inline="no-display-inline" id="H49B4B0AEF4B345328DA4287979090742"><enum>202.</enum><header>Sunset</header> 
<subsection commented="no" display-inline="no-display-inline" id="HC264C7DC75184A689D1AE6B1FA641C8A"><enum>(a)</enum><header>In general</header><text>Effective on December 31, 2013, the following provisions of law are amended to read as such provisions read on October 25, 2001:</text>

<subsection commented="no" display-inline="no-display-inline" id="H586240CC98F843AE8651731C99BB00D4"><enum>(b)</enum><header display-inline="yes-display-inline">Transition provision</header><text display-inline="yes-display-inline">Notwithstanding subsection (a), the provisions of law referred to in subsection (a), as in effect on December 30, 2013, shall continue to apply after December 31, 2013, with respect to any particular foreign intelligence investigation or with respect to any particular offense or potential offense that began or occurred before December 31, 2013.</text></subsection></section>

<paragraph id="HBAF094663EC04436ABFE55B33DDB4FA6"><enum>(1)</enum><text>Section 2709(a) of title 18, United States Code (to access certain communication service provider records).</text></paragraph> 
<paragraph id="HD7A5DC3DA5FB4696AF89D1FFC58500C1"><enum>(2)</enum><text>Section 1114(a)(5)(A) of the Right to Financial Privacy Act (12 U.S.C. 3414(a)(5)(A)) (to obtain financial institution customer records).</text></paragraph> 
<paragraph id="HD24517233B6543B2B8BE374736523609"><enum>(3)</enum><text>Section 626 of the Fair Credit Reporting Act (15 U.S.C. 1681u) (to obtain certain financial information and consumer reports).</text></paragraph> 
<paragraph id="HE2630A6E53634814A5E1301C728760AC"><enum>(4)</enum><text>Section 627 of the Fair Credit Reporting Act (15 U.S.C. 1681v) (to obtain credit agency consumer records for counterterrorism investigations).</text></paragraph> 
<paragraph id="H77B8AC0107D6425BA939BE0229D834ED"><enum>(5)</enum><text>Section 802 of the National Security Act of 1947 (50 U.S.C. 436).</text></paragraph></section> 
<section id="H4CD52A8AAEC34AF5B4DE91715FF3BDA0"><enum>204.</enum><header>Modification of standard</header> 
<subsection id="H576362F27BC24B1AAAC49913E7716C7C"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">A national security letter may not be issued unless the official having authority under law to issue that letter documents in a separate writing specific and articulable facts showing that there are reasonable grounds to believe that the information sought—</text> 
<paragraph id="H227D71C7904D4D8D8BF91F7862EE587E"><enum>(1)</enum><text>pertains to a foreign power or an agent of a foreign power;</text></paragraph> 
<paragraph id="H55626DC5B7CE4DB3AC61BACA2F084994" display-inline="no-display-inline"><enum>(2)</enum><text>is relevant to the activities of a suspected agent of a foreign power that is the subject of such authorized investigation; or</text></paragraph> 
<paragraph id="H003DB33630734723ABB3F5149AF2515B" display-inline="no-display-inline"><enum>(3)</enum><text>pertains to an individual in contact with, or personally known to, a suspected agent of a foreign power that is the subject of such authorized investigation.</text></paragraph></subsection> 
<subsection id="HDDB32213BC484BE389DF9E73CE5FCFA6"><enum>(b)</enum><header>Maintenance</header><text>The agency under whose authority a national security letter is issued shall maintain a copy of a separate writing required under subsection (a).</text></subsection> 
<subsection id="HAB26C003BE0F4E8EA7A272B4B5380FF4"><enum>(c)</enum><header>Definitions</header><text>In this section, the terms <quote>foreign power</quote> and <quote>agent of a foreign power</quote> have the meaning given such terms in section 101 of the Foreign Intelligence Surveillance Act of 1978 (50 U.S.C. 1801). </text></subsection></section> 
<section id="H455F60F17FD648DDBE2A7CC22732CDA9"><enum>205.</enum><header>Notification of right to judicial review of nondisclosure order</header><text display-inline="no-display-inline">If a recipient of a national security letter is subject to a nondisclosure requirement imposed in connection with that national security letter, the official issuing that letter shall, simultaneously with its issuance, inform the recipient of the right of the recipient to judicial review of that requirement and that the requirement will remain in effect during the pendency of any judicial review proceedings.</text></section> 
<section id="H856BA570F8FC4F9C8B6A0566141A6A0D"><enum>206.</enum><header>Disclosure for law enforcement purposes</header><text display-inline="no-display-inline">No information acquired by a national security letter shall be disclosed for law enforcement purposes unless such disclosure is accompanied by a statement that such information may only be used in a criminal proceeding with the advance authorization of the Attorney General, or a designee of the Attorney General at a level not lower than Section Chief of a division of the Department of Justice.</text></section> 
<section id="HE12F620F8B314957859F8367BFD9D75A"><enum>207.</enum><header>Judicial review of national security letter nondisclosure order</header><text display-inline="no-display-inline">Section 3511(b) of title 18, United States Code, is amended to read as follows:</text> 
<quoted-block display-inline="no-display-inline" id="H83FFB0E6A75F4623A60D3AD70A0A5D5F" style="OLC"> 
<subsection id="HBB1707D862EB454C88D7136697223396"><enum>(b)</enum><header>Nondisclosure</header> 
<paragraph id="H759FBD1DA5CF4277B702333E8BA3D73B"><enum>(1)</enum><header>In general</header> 
<subparagraph id="HC86BC1A26BDC4B6B967E461D16B73383"><enum>(A)</enum><header>Notice</header><text>If a recipient of a request or order for a report, records, or other information under section 2709 of this title, section 626 or 627 of the Fair Credit Reporting Act (15 U.S.C. 1681u and 1681v), section 1114 of the Right to Financial Privacy Act (12 U.S.C. 3414), or section 802 of the National Security Act of 1947 (50 U.S.C. 436), wishes to have a court review a nondisclosure requirement imposed in connection with the request, the recipient shall notify the Government.</text></subparagraph> 
<subparagraph id="HE3221A4130FE4B79B15302EA657BFC22"><enum>(B)</enum><header>Application</header><text>Not later than 30 days after the date of receipt of a notification under subparagraph (A), the Government shall apply for an order prohibiting the disclosure of particular information about the existence or contents of the relevant request or order. An application under this subparagraph may be filed in the district court of the United States for any district within which the authorized investigation that is the basis for the request or order is being conducted. The applicable nondisclosure requirement shall remain in effect during the pendency of proceedings relating to the requirement.</text></subparagraph> 
<subparagraph id="H74AA09F169DE4A55B335240093596C62"><enum>(C)</enum><header>Consideration</header><text>A district court of the United States that receives an application under subparagraph (B) should rule expeditiously, and may issue a nondisclosure order for a period of not longer than 180 days.</text></subparagraph> 
<subparagraph id="HB6D0EF86936144B2A1E57DAC43EA7B70"><enum>(D)</enum><header>Denial</header><text>If a district court of the United States rejects an application for a nondisclosure order or extension thereof, the nondisclosure requirement shall no longer be in effect.</text></subparagraph></paragraph> 
<paragraph id="H14C488E8917B4C5AA664F5717BE0C3F8"><enum>(2)</enum><header>Application contents</header><text display-inline="yes-display-inline">An application for a nondisclosure order or extension thereof under this subsection shall include a certification from the Attorney General, Deputy Attorney General, an Assistant Attorney General, or the Director of the Federal Bureau of Investigation, or in the case of a request by a department, agency, or instrumentality of the Federal Government other than the Department of Justice, the head or deputy head of the department, agency, or instrumentality, of the existence of a result described in subparagraphs (A) through (D) and a statement of specific and articulable facts indicating that, absent a prohibition of disclosure under this subsection, there may result—</text> 
<subparagraph id="HE75B11B2DAE840F89E37BB52AF92C656"><enum>(A)</enum><text>a danger to the national security of the United States;</text></subparagraph> 
<subparagraph id="H40C4A84ABFBB492591DBDEFDC4D561C9"><enum>(B)</enum><text>interference with a criminal, counterterrorism, or counterintelligence investigation;</text></subparagraph> 
<subparagraph id="HF9807023345541F7B7F21EEC9D71D2F2"><enum>(C)</enum><text>interference with diplomatic relations; or</text></subparagraph> 
<subparagraph id="HC9B6C3E2C39749E9848FF4EFFDD2FB06"><enum>(D)</enum><text>danger to the life or physical safety of any person.</text></subparagraph></paragraph> 
<paragraph id="H91CA98C027C44E28A6DA4DD6EB623220"><enum>(3)</enum><header>Standard</header><text>A district court of the United States may issue a nondisclosure requirement order or extension thereof under this subsection if the court determines that there is reason to believe that disclosure of the information subject to the nondisclosure requirement during the applicable time period will have a result described in paragraph (2).</text></paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="HAB34C3BCC8184E929CBA09C6D21640AF"><enum>(4)</enum><header>Renewal</header><text>A nondisclosure order under this subsection may be renewed for additional periods of not longer than 180 days each, upon a determination by the court that a result described in paragraph (2) justifies the renewal.</text></paragraph> 
<paragraph id="H063833AB65D3457792F41093C586C7A7"><enum>(5)</enum><header>Early termination of nondisclosure order</header><text>A nondisclosure order the Government applied for under paragraph (1)(B) ceases to have effect when the Government discovers that the factual basis for that order has ceased to exist and the Government so informs the order’s recipient. The Government upon making such a discovery shall promptly so informs the recipient.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section> 
<section id="H978CD46621D44147934C682A95F341CB"><enum>208.</enum><header>Minimization</header> 
<subsection id="H28F880EA31C04E1BA24BFD2A5BA54B87"><enum>(a)</enum><header>In general</header><text>Not later than 180 days after the date of enactment of this Act, the Attorney General shall—</text> 
<paragraph id="H76A0435465A842C98F872696BEB1A9D3"><enum>(1)</enum><text>establish minimization procedures governing the acquisition, retention, and dissemination by the Federal Bureau of Investigation of any records received by the Federal Bureau of Investigation in response to a national security letter; and</text></paragraph> 
<paragraph id="HC33D1F8F343B49E2B98693C5AE0F092E"><enum>(2)</enum><text>submit to the Committee on the Judiciary and the Select Committee on Intelligence of the Senate and the Committee on the Judiciary and the Permanent Select Committee on Intelligence of the House of Representatives a copy of the minimization procedures established under paragraph (1).</text></paragraph></subsection> 
<subsection id="H89B193707E6C49619DBC38803F27B36B"><enum>(b)</enum><header>Definitions</header><text>In this section—</text> 
<paragraph id="H9E188A9DBF5B4B5180EF211AC5EEE7A8"><enum>(1)</enum><text>the term <term>minimization procedures</term> means—</text> 
<subparagraph id="HA08C9C349DB4407785078C4466C1D8B9"><enum>(A)</enum><text>specific procedures that are reasonably designed in light of the purpose and technique of a national security letter, to minimize the acquisition and retention, and prohibit the dissemination, of nonpublicly available information concerning unconsenting United States persons (as defined in section 101 of the Foreign Intelligence Surveillance Act of 1978 (50 U.S.C. 1801)) consistent with the need of the United States to obtain, produce, and disseminate foreign intelligence information;</text></subparagraph> 
<subparagraph id="HA5BA049C73F840DA9590104FD76BD2E3"><enum>(B)</enum><text>procedures that require that nonpublicly available information, which is not foreign intelligence information (as defined in section 101(e)(1) of the Foreign Intelligence Surveillance Act of 1978 (50 U.S.C. 1801(e)(1))) shall not be disseminated in a manner that identifies any United States person, without the consent of the United States person, unless the identity of the United States person is necessary to understand foreign intelligence information or assess its importance; and</text></subparagraph> 
<subparagraph id="H8E25F5349AE2484C9DC9D3154962D18B"><enum>(C)</enum><text>notwithstanding subparagraphs (A) and (B), procedures that allow for the retention and dissemination of information that is evidence of a crime which has been, is being, or is about to be committed and that is to be retained or disseminated for law enforcement purposes; and</text></subparagraph></paragraph> 
<paragraph id="HEA92DA463EFC4F78BBAE116932B0C2EE"><enum>(2)</enum><text>the term <term>national security letter</term> means a request for information issued under section 2709 of title 18, United States Code, section 1114(a)(5) of the Right to Financial Privacy Act of 1978 (12 U.S.C. 3414(5)), subsection (a) or (b) of section 626 of the Fair Credit Reporting Act (15 U.S.C. 1681u), or section 627 of the Fair Credit Reporting Act (15 U.S.C. 1681v).</text></paragraph></subsection></section> 
<section commented="no" id="H2CF2DD0787B242A6A4E161FD295366E1" display-inline="no-display-inline" section-type="subsequent-section"><enum>209.</enum><header>Public reporting on National Security Letters</header><text display-inline="no-display-inline">Section 118(c) of the USA PATRIOT Improvement and Reauthorization Act of 2005 (18 U.S.C. 3511 note) is amended—</text> 
<paragraph commented="no" id="H8DA050CAF97544F9A1A04774B13E4C3A"><enum>(1)</enum><text display-inline="yes-display-inline">in paragraph (1)—</text> 
<subparagraph commented="no" id="H73874880B35045C89F17F00A78FBA8B1"><enum>(A)</enum><text display-inline="yes-display-inline">in the matter preceding subparagraph (A), by striking <quote>concerning different United States persons</quote>; and</text></subparagraph> 
<subparagraph commented="no" id="H12A1055958F44E8D9B78C47336693B48"><enum>(B)</enum><text>in subparagraph (A), by striking <quote>, excluding the number of requests for subscriber information</quote>;</text></subparagraph></paragraph> 
<paragraph commented="no" id="H6D7A63ADF8AD40949C04D8FD26EF2A79"><enum>(2)</enum><text>by redesignating paragraph (2) as paragraph (3); and</text></paragraph>

<subparagraph commented="no" display-inline="no-display-inline" id="H6BE12A0BA24E40908088CD4C2E0A9A68"><enum>(B)</enum><header>Exception</header><text>With respect to the number of requests for subscriber information under section 2709 of title 18, United States Code, a report required under this subsection need not provide information separated into each of the categories described in subparagraph (A).</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section></title> 
<title id="H0537C60A4E994DB7880CE69B4188DF35"><enum>III</enum><header>GENERAL PROVISIONS</header> 
<section id="H26FE1F90ACE24D0B86EAF050E2FFB8E5"><enum>301.</enum><header>Sense of Congress on level of classification of certain programs</header><text display-inline="no-display-inline">It is the sense of Congress that the President should periodically review the level of classification of programs that make use of national security letters (as defined in section 203 of this Act) or the authorities under the Foreign Intelligence Surveillance Act of 1978 (50 U.S.C. 1801 et seq.) to determine if such programs can be declassified, in whole or in part, without interfering with an ongoing investigation or otherwise threatening national security.</text></section></title>
