<section id="H80DD54456C1F490996BC146C81BDC29F" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote>Strengthening and Updating Resources and Equipment Act</quote> or the <quote>SURE Act</quote>.</text> </section>
<section id="HBCC725DAEC42422A88074F1FFD96F105"><enum>2.</enum><header>Clarification on use of funds relating to certain homeland security grants</header> 
<subsection id="H7E5429D564424C82B7CFEF78B7778553"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 2008 of the Homeland Security Act of 2002 (6 U.S.C. 609) is amended—</text> 
<paragraph id="H636EB61E85C8432590D2C8407918F8A1"><enum>(1)</enum><text>in subsection (a)(4), by inserting before the semicolon at the end the following: <quote>, and any related maintenance agreements, user fees, or sustainment costs</quote>;</text> </paragraph>
<paragraph id="H4C456B7A61E34308BE61D3A9BC0DC7E3"><enum>(2)</enum><text>in subsection (b)(3), by adding at the end the following new subparagraph:</text>

<subparagraph id="H64983975E6BA4081B0A1CAFB0169C337"><enum>(C)</enum><header>Equipment maintenance</header><text display-inline="yes-display-inline">With respect to the use of amounts awarded to a grant recipient under section 2003 or 2004 for equipment purchase and maintenance costs, the Administrator may not—</text> 
<clause id="H8D29CD36C81B45EEBFEB827389BE2140"><enum>(i)</enum><text>impose a limit on the amount of any such award that may be used to pay for such purchase and maintenance costs, including any costs referred to in subsection (a)(4); or</text> </clause>
<clause id="H397533F8DB1F44F595816CE1F168AA83"><enum>(ii)</enum><text>impose any additional limitation, including any fiscal year limitation, beyond the limitations described in the matter preceding paragraph (1) and in paragraph (4) of subsection (a), on the amount of any such award that may be used for a specific type, purpose, or category of equipment purchase or maintenance cost.</text> </clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block> </paragraph></subsection>
<subsection id="H9F07282F0EBB452CA0AC4A36DBBBCC74"><enum>(b)</enum><header>Effective date</header><text>The amendments made by subsection (a) shall take effect on the date of the enactment of this section and shall apply to grants made under section 2003 or 2004 of the Homeland Security Act of 2002 (6 U.S.C. 604 and 605), in accordance with the provisions specified in section 2008 of such Act (6 U.S.C. 609), as amended by subsection (a) of this section, on or after October 1, 2008.</text> </subsection></section>

<section id="H40BD6B85C6B944C39F1E9FF28436DDB5" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote>Strengthening and Updating Resources and Equipment Act</quote> or the <quote>SURE Act</quote>.</text></section>
<section id="HBB907DA3D3B844E0A7B1ACA373A06AD7"><enum>2.</enum><header>Clarification on use of funds relating to certain homeland security grants</header>
<subsection id="HC1255AD189A247B59ECE55F1BDC35076"><enum>(a)</enum><header>Equipment maintenance</header>
<paragraph id="HC2A84D2E365F4B42A367201E9E633B27"><enum>(1)</enum><header>Amendments</header><text>Section 2008 of the Homeland Security Act of 2002 (6 U.S.C. 609) is amended—</text>
<subparagraph id="H65F9EC893B8746D8AF7D44FB5A4BDA21"><enum>(A)</enum><text>in subsection (a)(4), by inserting before the semicolon at the end the following: <quote>, and any related maintenance agreements, user fees, or sustainment costs</quote>; and</text></subparagraph>
<subparagraph id="H222964053272499988C1411980DE8511"><enum>(B)</enum><text>in subsection (b)(3), by adding at the end the following new subparagraph:</text>

<subparagraph id="H0E859396F8594D95B3DAEA71EDA77282"><enum>(C)</enum><header>Equipment maintenance</header>
<clause id="H63E1E4D67D364E51B1AE3B1BC4C0C8DE"><enum>(i)</enum><header>In general</header><text display-inline="yes-display-inline">The Administrator may not impose any time limitation, including any fiscal year limitation, on the use for covered maintenance costs of amounts awarded as a grant under section 2003 or 2004, that is in addition to the limitations described in this subsection</text></clause>
<clause id="H159A1F0CE837496AABD2F04EF0DE9F9F"><enum>(ii)</enum><header>Covered maintenance costs defined</header><text display-inline="yes-display-inline">In this subparagraph the term <quote>covered maintenance costs</quote> means costs of maintenance and sustainment costs described in subsection (a)(4) associated with equipment purchased with grant funds provided under section 2003 or 2004 for a prior fiscal year.</text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph>
<paragraph id="H6EC96492A80D4B65A5D4E392C8100536"><enum>(2)</enum><header>Application</header><text>The amendments made by this subsection shall apply to grants made under section 2003 or 2004 of the Homeland Security Act of 2002 (6 U.S.C. 604 and 605) on or after October 1, 2008.</text></paragraph></subsection>
<subsection id="HB5E21FE149DD4C39AAC728B71CA8424F"><enum>(b)</enum><header>Specification of intended use in grant applications</header>
<paragraph id="H66C7E12679C24D6FA3F55C6D846FBE63"><enum>(1)</enum><header>Urban Area Security Initiative grants</header><text display-inline="yes-display-inline">Section 2003(c)(2) of the Homeland Security Act of 2002 (6 U.S.C. 604(c)(2)) is amended by striking <quote>and</quote> after the semicolon at the end of subparagraph (B), by striking the period at the end of subparagraph (C) and inserting <quote>; and</quote>, and by adding at the end the following new subparagraph:</text>

<subparagraph id="H85C24A679DB44703948BF7BD4AE52230"><enum>(D)</enum><text display-inline="yes-display-inline">specification of the amount of grant funds the high-risk urban area plans to allocate to maintain and sustain target capabilities, including equipment, that have been supported with prior fiscal year funds awarded under this section or section 2004.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph>
<paragraph id="H3F9BF78D66074204864F7AC8B0DDAD17"><enum>(2)</enum><header>State Homeland Security grants</header><text>Section 2004(b)(2) of the Homeland Security Act of 2002 (6 U.S.C. 605(b)(2)) is amended by striking <quote>and</quote> after the semicolon at the end of subparagraph (B), by striking the period at the end of subparagraph (C) and inserting <quote>; and</quote>, and by adding at the end the following new subparagraph:</text>

<subparagraph id="H5214D10EB9AE420F81D02A4E1A62ACC6"><enum>(D)</enum><text display-inline="yes-display-inline">specification of the amount of grant funds the State plans to allocate to maintain and sustain target capabilities, including equipment, that have been supported with prior fiscal year funds awarded under this section or section 2003.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection>
<subsection id="H25322F7E2DBE431B8FD51B3F320C6E76"><enum>(c)</enum><header>Grant guidance</header><text>Section 2002 of the Homeland Security Act of 2002 (6 U.S.C. 603) is amended by adding at the end the following new subsection:</text>

<subsection id="H16D2640D245845049C407DAD064F4282"><enum>(d)</enum><header>Grant guidance</header>
<paragraph id="HB98DC3B4465C4214B6A2F58C82A0CEE5"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Administrator shall—</text>
<subparagraph id="H70900AD0850A4D308FC320ADA1C933CE"><enum>(A)</enum><text>not later than three months after the date of enactment of the Strengthening and Updating Resources and Equipment Act of 2009, issue guidance defining costs eligible to be paid with grants under sections 2003 and 2004 for equipment maintenance agreements, user fees, sustainment costs, and any other equipment-related costs, as the Administrator determines is appropriate; and</text></subparagraph>
<subparagraph id="HF62A69DA70564E92B7BF4E87420DFA4B"><enum>(B)</enum><text>review and update such guidance as necessary.</text></subparagraph></paragraph>
<paragraph id="H327EA136A14448B8A81390E14A32BDC3"><enum>(2)</enum><header>Congressional briefing</header><text display-inline="yes-display-inline">The Administrator shall brief the Committee on Homeland Security of the House of Representatives and the Committee on Homeland Security and Governmental Affairs of the Senate not less than five days before issuing any guidance, or announcing the award of any grant, under section 2003 or 2004. </text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section>
