		<official-title>To amend title 23, United States Code, to reduce the
		  amount of Federal highway funding available to States that do not enact a law
		  prohibiting the use of certain communication devices while operating a motor
		  vehicle, and for other purposes.</official-title>

		<section id="HC7A3E234DB994E8D8DA5936807D32336" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Fighting Occupied Cell Use So Everyone Drives More Safely
			 Act of 2009</short-title></quote> or the <quote><short-title>FOCUS Act of
			 2009</short-title></quote>.</text>
		</section><section id="H9D3A36FDA4864B9FA1C6FC7C7A1E6BD9"><enum>2.</enum><header>Operation of
			 motor vehicles while using a communication device</header>
			<subsection id="HD53EAB24F6654EE1A0C11813BFAC8570"><enum>(a)</enum><header>In
			 general</header><text>Chapter 1 of title 23, United States Code, is amended by
			 adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="HD5B99E989D4B43438F1DD08316472D5D" style="USC">
					<section id="HA0F13F3E91C24CA08E2CDFEDD983E7AD"><enum>167.</enum><header>Operation of
				motor vehicles while using a communication device</header>
						<subsection id="H26220E2890EC46CCAC4E62458078EFD1"><enum>(a)</enum><header>Definitions</header><text>In
				this section, the following definitions apply:</text>
							<paragraph id="HF104911114D94FE8AF889BA85BC9EC83"><enum>(1)</enum><header>Communication
				device</header><text display-inline="yes-display-inline">The term
				<term>communication device</term> means any mobile telephone or other portable
				electronic communication device with which a user engages in a call or writes,
				sends, or reads a message.</text>
							</paragraph><paragraph id="HF7CB157B13B842809CC5A99D61F91283"><enum>(2)</enum><header>Motor
				vehicle</header><text>The term <term>motor vehicle</term> has the meaning given
				the term in section 154(a).</text>
							</paragraph></subsection><subsection id="HD8186A2A9D604F66A3457900506D59A3"><enum>(b)</enum><header>Withholding of
				apportionments for noncompliance</header>
							<paragraph id="H7A0CB69ADAA442E390B8B0743A188FC2"><enum>(1)</enum><header>In
				general</header><text>On October 1 of the second fiscal year beginning after
				the date of the issuance of the regulations under subsection (d), and annually
				thereafter, the Secretary shall withhold 25 percent of the amount required to
				be apportioned to any State under each of paragraphs (1), (3), and (4) of
				section 104(b) for the fiscal year if the Secretary determines that the State
				does not satisfy the requirement under paragraph (2) of this subsection as of
				that date.</text>
							</paragraph><paragraph id="H9B852A2E47974A7D993C422DBA06DF31"><enum>(2)</enum><header>Requirement</header><text>A
				State satisfies the requirement under this paragraph if the State has enacted
				and is enforcing a law that—</text>
								<subparagraph id="HCA4432EB0AB84F77A6AC3CD5C0ECA378"><enum>(A)</enum><text>except in the
				event of an emergency, prohibits an operator of a moving motor vehicle
				from—</text>
									<clause id="H2EEB25790AF043408B5A70C1BAF1541E"><enum>(i)</enum><text>utilizing any
				communication device if such operator is under the age of 21; and</text>
									</clause><clause id="HB6A3484357F140ECBD8370BDB7B45B6B"><enum>(ii)</enum><text>utilizing a
				hand-held communication device if such operator is 21 years of age or older;
				and</text>
									</clause></subparagraph><subparagraph id="HB76050C5429E48DBABA16B18E9331596"><enum>(B)</enum><text>requires, upon
				conviction of a violation of a prohibition under subparagraph (A), the
				imposition of penalties in accordance with the requirements for minimum
				penalties described in the regulations issued under subsection (d).</text>
								</subparagraph></paragraph></subsection><subsection id="HFBD59455DCA349C7B148F3FA8B14161D"><enum>(c)</enum><header>Recovery of
				funds withheld</header><text>All funds withheld under this section from
				apportionment to a State for 1 or more fiscal years shall be available for
				apportionment to the State immediately upon a determination by the Secretary
				that the State satisfies the requirement under subsection (b)(2).</text>
						</subsection><subsection id="H176E18E5CF7B4E97B4B74FC20C86C05D"><enum>(d)</enum><header>Regulations</header><text>Not
				later than 180 days after the date of enactment of this section, the Secretary
				shall issue regulations to carry out this section, including requirements for
				minimum penalties for violations of a prohibition under subsection (b)(2)(A)
				that—</text>
							<paragraph id="H44637968BC6048359CD6232C2B34C4D0"><enum>(1)</enum><text>specify a minimum
				penalty for a first offense; and</text>
							</paragraph><paragraph id="H9805D479C3FD4149A4D3BE574E4D9B43"><enum>(2)</enum><text>stipulate that
				penalties shall be graduated for repeated
				offenses.</text>
							</paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H3A43E0C425B044A2ABABD8DB4B1836B9"><enum>(b)</enum><header>Clerical
			 amendment</header><text>The analysis for such chapter is amended by adding at
			 the end the following:</text>
