		<legis-type>A BILL</legis-type>
		<official-title>To temporarily suspend the approval or certification of
		  any housing counseling agencies of ACORN or its affiliates and require the
		  Inspector General of the Department of Housing and Urban Development to conduct
		  an audit of any assistance provided by the Department to ACORN and its
		  affiliates, and for other purposes.</official-title>

		<section id="H1018BF879D1048719CBA23FF9AD096CA" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Suspend ACORN Certification Act of
			 2009</short-title></quote>.</text>
		</section><section id="H7179B4191DF842CAA703B2841B60F7CD"><enum>2.</enum><header>Audit and
			 suspension of housing counseling approval</header>
			<subsection id="H1B6782B2C1494CD483033AD9ECC6E3BE"><enum>(a)</enum><header>Audit</header><text display-inline="yes-display-inline">Not later than the expiration of the
			 6-month period beginning on the date of the enactment of this Act, the
			 Inspector General of the Department of Housing and Urban Development
			 shall—</text>
				<paragraph id="H15FFF077F7F14F53983EEF24C029A895"><enum>(1)</enum><text>with respect to
			 each covered organization, conduct an audit of all assistance within the
			 jurisdiction of the Department provided to such covered organization at any
			 time; and</text>
				</paragraph><paragraph id="H8CE6EF2277FD4C57AD38C76DB51B0B48"><enum>(2)</enum><text>make a
			 determination of whether each such covered organization has used such
			 assistance in accordance with all laws, regulations, and other terms and
			 conditions of such assistance and cause notice of such determination to be
			 published in the Federal Register.</text>
				</paragraph></subsection><subsection id="H72128A19758547C5BC48A80A82FB1D4C"><enum>(b)</enum><header>Suspension of
			 housing counseling certification and assistance</header><text>After the date of
			 the enactment of this Act—</text>
				<paragraph id="H498D0E6DF2724CBBA0ECDB7012336E4D"><enum>(1)</enum><text display-inline="yes-display-inline">no covered organization shall be considered
			 approved, certified, or authorized under section 106(e) of the Housing and
			 Urban Development Act of 1968 (12 U.S.C. 1701x(e)) or otherwise to provide
			 housing counseling in connection with any program of the Department or to
			 receive any assistance within the jurisdiction of the Department for any
			 housing counseling activities unless and until the Inspector General of the
			 Department of Housing and Urban Development has made a determination under
			 subsection (c) with respect to all such organizations; and</text>
				</paragraph><paragraph id="H4FD7FF41B8AF45B8AE8E1DB2D54CDE37"><enum>(2)</enum><text display-inline="yes-display-inline">the Secretary of Housing and Urban
			 Development shall not provide any assistance within the jurisdiction of the
			 Department for any housing counseling activities to a covered organization
			 unless and until the Inspector General has made a determination under
			 subsection (c) with respect to all such organizations.</text>
				</paragraph></subsection><subsection id="H43853481199649EA86C6F88FF5172204"><enum>(c)</enum><header>Determination</header><text display-inline="yes-display-inline">A determination under this subsection is a
			 determination, pursuant to the audit conducted under subsection (a), that all
			 covered organizations that, at any time, have received assistance within the
			 jurisdiction of the Department have used all such assistance received in
			 accordance with all laws, regulations, and other terms and conditions of such
			 assistance.</text>
			</subsection></section><section id="HB785BA9830C54AFC8F30966AF0B7C356"><enum>3.</enum><header>Definitions</header><text display-inline="no-display-inline">For purposes of this Act, the following
			 definitions shall apply:</text>
			<paragraph id="H9888A112113A433BA667909B49D1DC13"><enum>(1)</enum><header>Covered
			 organization</header><text display-inline="yes-display-inline">The term
			 <quote>covered organization</quote> means—</text>
				<subparagraph id="H072A7DF5EBD34C48A79B726BCAD48F4B"><enum>(A)</enum><text>the Association of
			 Community Organizations for Reform Now (in this section referred to as ACORN);
			 and</text>
				</subparagraph><subparagraph id="H5C6F396D814C4C85916472CEF85DE625"><enum>(B)</enum><text>any ACORN-related
			 affiliate.</text>
				</subparagraph></paragraph><paragraph id="H03178BDC1F6F41BD8BC6F44AB4B8AA73"><enum>(2)</enum><header>ACORN-related
			 affiliate</header><text>The term <term>ACORN-related affiliate</term> means any
			 of the following:</text>
				<subparagraph id="H7FA7DC3CD54B4203B08AD07082BDFA08"><enum>(A)</enum><text>Any State chapter
			 of ACORN registered with the Secretary of State’s office in that State.</text>
				</subparagraph><subparagraph id="H37159C52E0214450979E6AE857587EA7"><enum>(B)</enum><text>Any organization
			 that shares directors or employees with ACORN.</text>
				</subparagraph><subparagraph id="H7393AD8C5A4B4F908C7912978A5496A5"><enum>(C)</enum><text>Any organization
			 that has a financial stake, directly or indirectly, in ACORN.</text>
				</subparagraph><subparagraph id="HD45D7FFC7A944A0C956D44F197EC6BCB"><enum>(D)</enum><text>Any organization
			 whose finances, whether federally funded, donor-funded, or raised through
			 organizational goods and services, are shared or controlled, directly or
			 indirectly, by ACORN.</text>
				</subparagraph></paragraph><paragraph id="H8A3741553AB64FE3B01E8C2AEEA51B03"><enum>(3)</enum><header>Assistance
			 within the jurisdiction of the Department</header><text>The term
			 <quote>assistance within the jurisdiction of the Department</quote> has the
			 meaning given such term in section 102(m) of the Department of Housing and
			 Urban Development Reform Act of 1989 (42 U.S.C. 3545(m)).</text>
