		<official-title>To amend the Internal Revenue Code of 1986 to encourage
		  businesses to purchase commercial and residential property in distressed
		  communities by providing an exclusion from tax on certain
		  gains.</official-title>

		<section id="H436DDCAC20DF48C898CEC135543E8366" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Distressed Communities Reinvestment
			 Act of 2009</short-title></quote>.</text>
		</section><section id="HCD10B1DDA1F04B75BE7CD35C5F4D1CF5"><enum>2.</enum><header>Exclusion of
			 certain capital gains on commercial and residential property</header>
			<subsection id="H1CD818EA612A4CEEA85D731B273459A"><enum>(a)</enum><header>In
			 General</header><text>Part III of subchapter B of chapter 1 of the Internal
			 Revenue Code of 1986 is amended by inserting after section 139C the following
			 new section:</text>
				<quoted-block id="HDF9C7FF392AE40C9B8845EF100D2DA45" style="OLC">
					<section id="HC46911DBAA154BE2BE397CA4A2CE783E"><enum>139D.</enum><header>Capital gains
				on certain commercial and residential property</header>
						<subsection id="HE2BFAA9636AD4EFA870384FD81B4A1B5"><enum>(a)</enum><header>In
				General</header><text>Gross income shall not include gain from the sale of real
				property consisting predominantly of commercial and residential property
				if—</text>
							<paragraph id="H8A8375DB02704C4AA6C68CB3BDF5D64"><enum>(1)</enum><text>such property is
				located in a distressed community,</text>
							</paragraph><paragraph id="H581431CDD5EE47C6BE51AEA929CC5600"><enum>(2)</enum><text>such property is
				acquired by the taxpayer by purchase (as defined in section 179(d)(2)) during
				the 24-month period beginning on the date of the enactment of this section,
				and</text>
							</paragraph><paragraph id="H46B3E08A900B4AEAA16C21A1E517577F"><enum>(3)</enum><text>such property is
				held by the taxpayer continuously during the 5-year period ending on the date
				of the sale of such property.</text>
							</paragraph></subsection><subsection id="H046C8AC58A944674B04B1502D2782ED9"><enum>(b)</enum><header>Distressed
				community</header><text>For purposes of this section—</text>
							<paragraph id="HBA68DF05257F474C9585570779D77BC5"><enum>(1)</enum><header>In
				general</header><text>The term <term>distressed community</term> means a county
				that the Secretary designates as—</text>
								<subparagraph id="H430F7832902E4B2EAD9BDD7920FEA1B"><enum>(A)</enum><text>having, for any
				month during the applicable period—</text>
									<clause id="HC2436BDA7D364BB082A411C568627C55"><enum>(i)</enum><text>a
				residential mortgage foreclosure rate of 110 percent or more of the national
				average,</text>
									</clause><clause id="H180B0F1088284CB28227EB4FFF3FFC21"><enum>(ii)</enum><text>a
				commercial mortgage foreclosure rate of 110 percent or more of the national
				average,</text>
									</clause><clause id="H940E5675FA9845B2971C8BF759B2D9D"><enum>(iii)</enum><text>a
				decline in the average fair market value of housing of at least 20 percent,
				or</text>
									</clause><clause id="HB71233A3F4A747C88FC7B5D012AFBF21"><enum>(iv)</enum><text>an unemployment
				rate of 110 percent or more of the national average,</text>
									</clause></subparagraph><subparagraph id="H4112F896460F4C9E948CE04CBBCD5B2E"><enum>(B)</enum><text>being a county in
				which, for a calendar year during the applicable period, more than 50 percent
				of loans secured by housing had a loan-to-value ratio of greater than 80
				percent, or</text>
								</subparagraph><subparagraph id="HC41B39ECF1804F5F9920CA4627563F4E"><enum>(C)</enum><text>being in a
				disaster area (as defined in section 165(h)(3)(C)) as a result of a federally
				declared disaster that occurred during the applicable period.</text>
								</subparagraph></paragraph><paragraph id="HC8D3BDAFD5C846599EFE98C5618DF73D"><enum>(2)</enum><header>Applicable
				period</header><text>The term <term>applicable period</term> means—</text>
								<subparagraph id="H819E5FAE342345DDBAC6ED2C8260C7BB"><enum>(A)</enum><text display-inline="yes-display-inline">in the case of subparagraphs (A) and (B) of
				paragraph (1), the period beginning on January 1, 2008, and ending on the date
				which is 2 years after the date of the enactment of the
				<short-title>Distressed Communities Reinvestment Act of
				2009</short-title>, and</text>
								</subparagraph><subparagraph id="H07A4D82DF9964F05AE93816602AEFBD1"><enum>(B)</enum><text>in the case of
				subparagraph (C) of paragraph (1), the 4-year period ending on the date which
				is 2 years after the date of the enactment of such
				Act.</text>
								</subparagraph></paragraph></subsection></section><after-quoted-block>. </after-quoted-block></quoted-block>
			</subsection><subsection id="H86020834F479489CBB00DB00A76C1F5C"><enum>(b)</enum><header>Conforming
			 amendment</header><text display-inline="yes-display-inline">The table of
			 sections for part III of subchapter B of chapter 1 of such Code is amended by
			 inserting after the item relating to section 139C the following new
			 item:</text>

					</toc>

			</subsection><subsection id="H165391ECF0024C2CA742737413CDA923"><enum>(c)</enum><header>Effective
			 Date</header><text>The amendments made by this section shall apply to property
			 purchased after the date of the enactment of this section.</text>
