<legis-type>AN ACT</legis-type> 
<official-title display="yes">To require any Federal or State court to recognize any notarization made by a notary public licensed by a State other than the State where the court is located when such notarization occurs in or affects interstate commerce.</official-title>

<section display-inline="no-display-inline" id="HD43369CEFF2147519FB5F546D6557164" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Interstate Recognition of Notarizations Act of 2010</short-title></quote>.</text> </section> 
<section id="id16B27E740B4049C4B1023C0DE0E94829"><enum>2.</enum><header>Recognition of notarizations in Federal courts</header><text display-inline="no-display-inline">Each Federal court shall recognize any lawful notarization made by a notary public licensed or commissioned under the laws of a State other than the State where the Federal court is located if—</text> 
<paragraph id="id72E9B331CA3843B2B7DAACA52CB53283"><enum>(1)</enum><text>such notarization occurs in or affects interstate commerce; and</text> </paragraph> 
<paragraph id="id8E150941205D4D2D97D4796A1B77D617"><enum>(2)</enum> 
<subparagraph commented="no" display-inline="yes-display-inline" id="id4B5EAD037CDC49E38CD179F25A0CA34C"><enum>(A)</enum><text>a seal of office, as symbol of the notary public’s authority, is used in the notarization; or</text> </subparagraph> 
<subparagraph id="id271B7754429D4121B45FE0E316A496C2" indent="up1"><enum>(B)</enum><text>in the case of an electronic record, the seal information is securely attached to, or logically associated with, the electronic record so as to render the record tamper-resistant.</text> </subparagraph></paragraph></section> 
<section id="idB81B30E19EC14264913C76E95B6CD311"><enum>3.</enum><header>Recognition of notarizations in State courts</header><text display-inline="no-display-inline">Each court that operates under the jurisdiction of a State shall recognize any lawful notarization made by a notary public licensed or commissioned under the laws of a State other than the State where the court is located if—</text> 
<paragraph id="id02E18A66104B4AA787036F13CAE65ABF"><enum>(1)</enum><text>such notarization occurs in or affects interstate commerce; and</text> </paragraph> 
<paragraph id="id876CE7BAD68C44FEB313DC165DE616F1"><enum>(2)</enum> 
<subparagraph commented="no" display-inline="yes-display-inline" id="id40D281D48E2942DA9B26D7E2E355457F"><enum>(A)</enum><text>a seal of office, as symbol of the notary public’s authority, is used in the notarization; or</text> </subparagraph> 
<subparagraph id="idDADC571F1D454CEAA4D5BC981FDEDC54" indent="up1"><enum>(B)</enum><text>in the case of an electronic record, the seal information is securely attached to, or logically associated with, the electronic record so as to render the record tamper-resistant.</text> </subparagraph></paragraph></section> 
<section id="id95A4865B3FD244B88E42A2D179A9D3B0"><enum>4.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text> 
<paragraph id="id5B2D247E2D664C3D84DDAB00C1C383BD"><enum>(1)</enum><header>Electronic record</header><text>The term <term>electronic record</term> has the meaning given that term in section 106 of the Electronic Signatures in Global and National Commerce Act (15 U.S.C. 7006).</text> </paragraph> 
<paragraph id="id8D611FF7538240F3935E69796BB70560"><enum>(2)</enum><header>Logically associated with</header><text>Seal information is <term>logically associated with</term> an electronic record if the seal information is securely bound to the electronic record in such a manner as to make it impracticable to falsify or alter, without detection, either the record or the seal information.</text> </paragraph></section>
