		<official-title>To amend the Internal Revenue Code of 1986 to remove cell
		  phones from the limitation on depreciation when used for personal purposes, and
		  for other purposes.</official-title>

		<section id="H4CA37B8AF68845C19F4A6257B4634FF4" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Wireless Freedom
			 Act</short-title></quote>.</text>
		</section><section id="H68644D25D9844D22BB960D8B9E7E2C61" section-type="subsequent-section"><enum>2.</enum><header>Statement of
			 Constitutional Authority</header><text display-inline="no-display-inline">Congress enacts this Act pursuant to its
			 authority under clause 1 of section 8 of article I of the Constitution.</text>
		</section><section id="HCD9AA74BE60D4F56BB4E89B108364BC0"><enum>3.</enum><header>Removal of cell
			 phones from the limitation on depreciation when used for personal
			 purposes</header>
			<subsection id="HA24060EEE96E42BCA093316FC890A869"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Subparagraph (A) of
			 section 280F(d)(4) of the Internal Revenue Code of 1986 is amended by inserting
			 <quote>and</quote> at the end of clause (iv), by striking clause (v), and by
			 redesignating clause (vi) as clause (v).</text>
			</subsection><subsection id="H9497E91C9EA64649B64A79D685E3C33C"><enum>(b)</enum><header>Effective
			 date</header><text>The amendments made by subsection (a) shall apply to
			 property placed in service after December 31, 2008.</text>
			</subsection></section><section id="HC9789F7D4AC748BE8A4FAF5CC9229FDF"><enum>4.</enum><header>Wireless devices
			 provided by employer</header>
			<subsection id="H774093E58867452283FD77409C292B67"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Subsection (e) of
			 section 132 of the Internal Revenue Code of 1986 is amended by adding at the
			 end the following new paragraph:</text>
				<quoted-block display-inline="no-display-inline" id="H3B3A5C6D7DE44C90A9612F9AB268B9CB" style="OLC">
					<paragraph id="H831E106C9688482CAD1042E0C95E76F1"><enum>(3)</enum><header>Treatment of
				wireless devices</header><text display-inline="yes-display-inline">The
				provision of any wireless device by an employer to enable an employee to access
				and use electronic mail, the Internet, or a commercial mobile service (as such
				term is defined in section 332(d) of the Communications Act of 1934 (47 U.S.C.
				332(d))) shall be treated as a de minimis
				fringe.</text>
					</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H293C9A09F80F4B6F8359D6971F48DDA3"><enum>(b)</enum><header>Effective
			 date</header><text>The amendment made by subsection (a) shall apply to property
			 provided after December 31, 2008.</text>
