		<legis-type>A BILL</legis-type>
		<official-title>To amend title XVIII of the Social Security Act to repeal
		  the Medicare competitive acquisition program for durable medical equipment and
		  prosthetics, orthotics, and supplies (DMEPOS) in a budget neutral
		  manner.</official-title>

		<section id="H0173B5267F49403EA9A89C57DE187BFA" section-type="section-one"><enum>1.</enum><header>Repeal of Medicare DMEPOS
			 competitive acquisition program</header>
			<subsection id="HDFBDC87D52954AC8AC2C2BBC60B75601"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Section 1847 of the
			 Social Security Act (42 U.S.C. 1395w–3) is repealed.</text>
			</subsection><subsection id="H9331DF170F414116B2A676DF917B8D07"><enum>(b)</enum><header>Effective
			 date</header>
				<paragraph id="H52FDD912F606441A8EC08E03C9EB53F"><enum>(1)</enum><header>In
			 general</header><text>The repeal made by subsection (a) shall take effect on
			 the date of the enactment of this Act.</text>
				</paragraph><paragraph id="HBC1FCA2E60714861BC4D87E7BB8EFEDB"><enum>(2)</enum><header>Impact on
			 current contracts</header><text>In the case of any contract awarded under
			 section 1847 of the Social Security Act before the date of the repeal of such
			 section—</text>
					<subparagraph id="H144DD0C5ADB84C849131B2ECCF3C032B"><enum>(A)</enum><text>the contract is
			 terminated;</text>
					</subparagraph><subparagraph id="HA81D290DDA1B489BB8BC395F61B4A996"><enum>(B)</enum><text>no payment shall
			 be made under title XVIII of such Act on or after the date of the enactment of
			 this Act based on such a contract; and</text>
					</subparagraph><subparagraph id="H48A2F6859B164C7D9696189FD326FC97"><enum>(C)</enum><text>to the extent that
			 any damages may be applicable as a result of the termination of such contracts,
			 such damages shall be payable from the Federal Supplementary Medical Insurance
			 Trust Fund under section 1841 of such Act.</text>
					</subparagraph></paragraph><paragraph id="H041A1EF93CA8438893EC5E7C7F195896"><enum>(3)</enum><header>Construction</header><text>Nothing
			 in this subsection shall be construed to provide an independent cause of action
			 or right to administrative or judicial review with regard to the termination
			 provided under this subsection.</text>
				</paragraph></subsection><subsection id="H21875D8A6FC14B49B52630A30CCD14C5"><enum>(c)</enum><header>Pay-For through
			 change in covered item update</header><text>Section 1834(a)(14) of the Social
			 Security Act (42 U.S.C. 1395m(a)(14)) is amended by redesignating subparagraph
			 (M) as subparagraph (O) and by striking subparagraphs (K) and (L) and inserting
			 the following:</text>
				<quoted-block display-inline="no-display-inline" id="H28A2753178494E5F95E2FC4BC6C17EE8" style="OLC">
					<subparagraph id="HDE77FFBF51BF4922935C25FA76DF510C"><enum>(K)</enum><text display-inline="yes-display-inline">for 2010, 2011, and 2012—</text>
						<clause id="H7A12127DB087408CB1B42380CFA9B674"><enum>(i)</enum><text>in
				the case of complex rehabilitative power wheelchairs recognized by the
				Secretary as classified within group 3 or higher, the percentage increase in
				the consumer price index for all urban consumers (U.S. urban average) for the
				12-month period ending with June of the previous year; and</text>
						</clause><clause id="H9F7E2B790B8344529FABB038214F97AD"><enum>(ii)</enum><text>in the case of
				other items and services, −0.25 percentage points;</text>
						</clause></subparagraph><subparagraph id="H485EB606F2214C84B3664FCE7D7C026D"><enum>(L)</enum><text>for 2013, the
				percentage increase in the consumer price index for all urban consumers (U.S.
				urban average) for the 12-month period ending with June 2012;</text>
					</subparagraph><subparagraph id="HEC3E98EEE35F43FFA2C59FF1B5F6FC7A"><enum>(M)</enum><text>for 2014—</text>
						<clause id="H3E04136DC7F743C8977A86BC883F5CF8"><enum>(i)</enum><text>in
				the case of complex rehabilitative power wheelchairs recognized by the
				Secretary as classified within group 3 or higher, the percentage increase in
				the consumer price index for all urban consumers (U.S. urban average) for the
				12-month period ending with June 2013 plus 2.0 percentage points; and</text>
						</clause><clause id="HA5014CD2652F47108DC393A6A900AC13"><enum>(ii)</enum><text>in the case of
				other items and services, the percentage increase in the consumer price index
				for all urban consumers (U.S. urban average) for the 12-month period ending
				with June 2013;</text>
						</clause></subparagraph><subparagraph id="HD85DA5B5927D4F758DE262DB55294B5C"><enum>(N)</enum><text>for 2015—</text>
						<clause id="H29782A6FE801492A9B2AD5C70D361931"><enum>(i)</enum><text>in
				the case of complex rehabilitative power wheelchairs recognized by the
				Secretary as classified within group 3 or higher, the percentage increase in
				the consumer price index for all urban consumers (U.S. urban average) for the
				12-month period ending with June of the previous year; and</text>
						</clause><clause id="H18D39190309244AF881837A13FE25196"><enum>(ii)</enum><text>in the case of
				other items and services, −0.5 percentage points;
				and</text>
						</clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
