		<official-title>To amend the Securities Exchange Act of 1934 to provide
		  the Securities and Exchange Commission with the authority to contract for the
		  collection of delinquent claims resulting from judgments or orders obtained by
		  the Commission.</official-title>

		<section id="HB486FB160E1B44058D8FF5F6DFE38E02" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote>SEC
			 Delinquent Judgment Collection Act</quote>.</text>
		</section><section id="H9661DD6F8B004274B7EC55178FF266B9"><enum>2.</enum><header>Authority to
			 contract for collection of delinquent judgments and orders</header><text display-inline="no-display-inline">Subsection (b) of section 4 of the
			 Securities Exchange Act of 1934 (15 U.S.C. 78d(b)) is amended—</text>
			<paragraph id="H3285EBA6C0A04D2D80ADD462C2112639"><enum>(1)</enum><text>in the heading of
			 such subsection, by striking <quote><header-in-text level="subsection" style="OLC">and leasing authority</header-in-text></quote> and inserting
			 <quote><header-in-text level="subsection" style="OLC">, leasing authority, and
			 contracting authority</header-in-text></quote>; and</text>
			</paragraph><paragraph id="H041F666955354F048F7355870CD7F241"><enum>(2)</enum><text>by adding at the
			 end the following new paragraph:</text>
				<quoted-block display-inline="no-display-inline" id="H2E1E6826812F4377A9015CD3BC770F18" style="OLC">
					<paragraph id="H0ABA316F962E42D4911AAE4F8C3AB6D3"><enum>(4)</enum><header>Contracting
				authority</header>
						<subparagraph id="HE53BCF2DF7E44C91A3E85E7F8217C87F"><enum>(A)</enum><header>In
				general</header><text display-inline="yes-display-inline">Notwithstanding any
				other provision of law, the Commission is authorized to enter into contracts to
				assist in the collection of any claim of indebtedness resulting from any
				judgment or order (either by litigation or settlement) obtained by the
				Commission in any judicial action or administrative proceeding brought by or on
				behalf of the Commission. This authority includes, but is not limited to, the
				retention of private legal counsel to furnish legal services, including
				representation in litigation, negotiation, compromise, and settlement. Private
				counsel retained under this paragraph may represent the Commission in such debt
				collection matters to the same extent as the Commission may represent
				itself.</text>
						</subparagraph><subparagraph id="HB1ED476C03C745ECA0440C7372BC8368"><enum>(B)</enum><header>Terms and
				conditions of contract</header><text display-inline="yes-display-inline">Each
				such contract shall include such terms and conditions as the Commission
				considers necessary and appropriate, and shall include provisions
				specifying—</text>
							<clause id="H7BAB6A8738204B179F7B0557A56310E5"><enum>(i)</enum><text display-inline="yes-display-inline">the amount of the fee to be paid under such
				contract or the method for calculating that fee;</text>
							</clause><clause id="HA27B1824B6604BD680413362C697E9FE"><enum>(ii)</enum><text>that the
				Commission retains the authority to represent itself, resolve a dispute,
				compromise a claim, end collection efforts, and refer a matter to other counsel
				or to the Attorney General; and</text>
							</clause><clause id="H2B1003EB1FE84CF09992DF1F8189D444"><enum>(iii)</enum><text>that the
				Commission may terminate either the contract or the private counsel's
				representation of the Commission in particular cases for any reason, including
				for the convenience of the Commission.</text>
							</clause></subparagraph><subparagraph id="HDD0BD3F83619427DBABD6519BCF28349"><enum>(C)</enum><header>Payment of
				fees</header><text display-inline="yes-display-inline">Notwithstanding section
				3302(b) of title 31, United States Code, a contract under this paragraph may
				provide that fees and costs incurred by private counsel under such contracts
				are payable from the amounts recovered.</text>
						</subparagraph><subparagraph id="H14BEC94690F04D8D81CD2E26A84E3E98"><enum>(D)</enum><header>Competition
				required</header><text display-inline="yes-display-inline">Nothing in this
				paragraph shall relieve the Commission of the competition requirements set
				forth in title III of the Federal Property and Administrative Services Act of
				1949 (41 U.S.C. 251 et seq.).</text>
						</subparagraph><subparagraph id="HDD1BD6BB4C034089ADC074E010039070"><enum>(E)</enum><header>Counterclaims</header><text display-inline="yes-display-inline">In any action to recover indebtedness which
				is brought on behalf of the Commission by private counsel retained under this
				paragraph, no counterclaim may be asserted against the Commission unless the
				counterclaim is served directly on the Commission. Such service shall be made
				in accordance with the rules of procedure of the court in which the action is
				brought.</text>
						</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
