<section id="H30BCE903C00E44DDB4BB5076FD853184" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Target Practice and Marksmanship Training Support Act</short-title></quote>.</text></section> 
<section id="HBDFEC4C665AF4BD6A35D0CF1F0608EA5"><enum>2.</enum><header>Findings; purpose</header> 
<subsection id="H627885B0A0C94FF486557B6D49ABEA81"><enum>(a)</enum><header>Findings</header><text>Congress finds that—</text> 
<paragraph id="H607873E808734DA085DEB6095F454B06"><enum>(1)</enum><text>the use of firearms for target practice and marksmanship training activities on Federal land is allowed, except to the extent specific portions of that land have been closed to those activities;</text></paragraph> 
<paragraph id="H21BF74DE0F0C4FDC89F7FF58ED21FC46"><enum>(2)</enum><text>in recent years preceding the date of enactment of this Act, portions of Federal land have been closed to target practice and marksmanship training for many reasons;</text></paragraph> 
<paragraph id="H6E30988FD7FF4FF28DB13130C65E110D"><enum>(3)</enum><text>the availability of public target ranges on non-Federal land has been declining for a variety of reasons, including continued population growth and development near former ranges;</text></paragraph> 
<paragraph id="H025309DB494E4303B80CC6D98C3DACEC"><enum>(4)</enum><text>providing opportunities for target practice and marksmanship training at public target ranges on Federal and non-Federal land can help—</text> 
<subparagraph id="H23753A0F7A174AF6A28FAF0AE7E47478"><enum>(A)</enum><text>to promote enjoyment of shooting, recreational, and hunting activities; and</text></subparagraph> 
<subparagraph id="HA39F043F7CC247959FF17BBE399D2D72"><enum>(B)</enum><text>to ensure safe and convenient locations for those activities;</text></subparagraph></paragraph> 
<paragraph id="HDEA2376988A0483FB5DBF5AB9B2C728F"><enum>(5)</enum><text>Federal law in effect on the date of enactment of this Act, including the Pittman-Robertson Wildlife Restoration Act (16 U.S.C. 669 et seq.), provides Federal support for construction and expansion of public target ranges by making available to States funds that can be used for construction, operation, and maintenance of public target ranges; and</text></paragraph> 
<paragraph id="H1F6D1521D5084A0E99F71C8D464F7202"><enum>(6)</enum><text>it is in the public interest to provide increased Federal support to facilitate the construction or expansion of public target ranges.</text></paragraph></subsection> 
<subsection id="H6E163C6BD9FA4D7A803FED72D82E501B"><enum>(b)</enum><header>Purpose</header><text>The purpose of this Act is to facilitate the construction and expansion of public target ranges, including ranges on Federal land managed by the Forest Service and the Bureau of Land Management.</text></subsection></section> 
<section id="H85F67243F3AB4A8E9B26EB4241A0AD63"><enum>3.</enum><header>Definition of public target range</header><text display-inline="no-display-inline">In this Act, the term <term>public target range</term> means a specific location that—</text> 
<paragraph id="H5BB6615366F2489CB5EF3BB02271A307"><enum>(1)</enum><text display-inline="yes-display-inline">is designated by a land management agency for recreational shooting;</text></paragraph> 
<paragraph id="H15E46E7DB1DF422C951097D0D3AF9BAC"><enum>(2)</enum><text display-inline="yes-display-inline">is open to the public;</text></paragraph> 
<paragraph id="HD7AD80510DED486FA06E1C455D3817FF"><enum>(3)</enum><text display-inline="yes-display-inline">may be supervised; and</text></paragraph> 
<paragraph id="HDD57BDC6BBEE47469EC4AEDC18E766A1"><enum>(4)</enum><text display-inline="yes-display-inline">may accommodate rifle, pistol, or shotgun shooting.</text></paragraph></section> 
<section id="H4FB2AAB11E1A4D4CA3894D487A87A404"><enum>4.</enum><header>Amendments to Pittman-Robertson Wildlife Restoration Act</header> 
<subsection id="HD896D9EF3F4945BC9485C600864C971E"><enum>(a)</enum><header>Definitions</header><text>Section 2 of the Pittman-Robertson Wildlife Restoration Act (16 U.S.C. 669a) is amended—</text> 
<paragraph id="H8E472EBC8FC8483B95B075E43D6643C6"><enum>(1)</enum><text>by redesignating paragraphs (2) through (8) as paragraphs (3) through (9), respectively; and</text></paragraph> 
<paragraph id="HF55E03FCF5BE47B78B6F079FF30D9342"><enum>(2)</enum><text>by inserting after paragraph (1) the following:</text>

<paragraph id="HCD585BCBA43541ADBF30AB127C35B940"><enum>(2)</enum><text>the term <term>public target range</term> means a specific location that—</text> 
<subparagraph id="H614ED31A17AB441EADE67BB091103327"><enum>(A)</enum><text display-inline="yes-display-inline">is designated by a land management agency for recreational shooting;</text></subparagraph> 
<subparagraph id="HD93506C5915540408C31C8EA56C69778"><enum>(B)</enum><text display-inline="yes-display-inline">is open to the public;</text></subparagraph> 
<subparagraph id="H9145D117B82146BC83B329EAF4F9A573"><enum>(C)</enum><text display-inline="yes-display-inline">may be supervised; and</text></subparagraph> 
<subparagraph commented="no" display-inline="no-display-inline" id="H7040E60333DE485FA27C36A4D469813E"><enum>(D)</enum><text display-inline="yes-display-inline">may accommodate rifle, pistol, or shotgun shooting;</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="HF5931DE29AD44CB78B60D59693D52BBF"><enum>(b)</enum><header>Expenditures for management of wildlife areas and resources</header><text>Section 8(b) of the Pittman-Robertson Wildlife Restoration Act (16 U.S.C. 669g(b)) is amended—</text> 
<paragraph id="HA6137A481E0444BFAE108C3BAABCB2DC"><enum>(1)</enum><text>by striking <quote>(b) Each State</quote> and inserting the following:</text>

<paragraph id="H1F00F4A8283A49489E577671F992FFB4"><enum>(2)</enum><text>in paragraph (1) (as so designated), by striking <quote>construction, operation,</quote> and inserting <quote>operation</quote>;</text></paragraph> 
<paragraph id="H6B3557F750CF4D838D7298D9C2E7AE5C"><enum>(3)</enum><text>in the second sentence, by striking <quote>The non-Federal share</quote> and inserting the following:</text>

<paragraph id="H0AA39A2D03484EB0AE25508065EFE507"><enum>(2)</enum><header>Exception</header><text>Notwithstanding the limitation described in paragraph (1), a State may pay up to 90 percent of the cost of acquiring land for, expanding, or constructing a public target range.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="HA008159F1B4845D0B607F475CECF6249"><enum>(c)</enum><header>Firearm and bow hunter education and safety program grants</header><text>Section 10 of the Pittman-Robertson Wildlife Restoration Act (16 U.S.C. 669h–1) is amended—</text> 
<paragraph id="H7BDDB497A82245FDA51C42CE3264DFF3"><enum>(1)</enum><text>in subsection (a), by adding at the end the following:</text> 
<quoted-block display-inline="no-display-inline" id="H0D839BE167B14337B445860B95CA053F" style="OLC"> 
<paragraph id="H16272CF10997444FAEC82E27D20B8C0C"><enum>(3)</enum><header>Allocation of additional funds</header><text>Of the amount apportioned to a State for any fiscal year under section 4(b), the State may elect to allocate not more than 10 percent, to be combined with the amount apportioned to the State under paragraph (1) for that fiscal year, for acquiring land for, expanding, or constructing a public target range.</text></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></paragraph> 
<paragraph id="H2E7A14E0FEC442ED8AE30C5F27186869"><enum>(2)</enum><text>by striking subsection (b) and inserting the following:</text> 
<quoted-block display-inline="no-display-inline" id="H33E27FBF29BC4BC2B847C527BC3606BC" style="OLC"> 
<subsection id="HEDCB36AA171D40B498ADA4CACA8DE64F"><enum>(b)</enum><header>Cost sharing</header> 
<paragraph id="H90E02C0462164043AE76DDA6BE6CBD37"><enum>(1)</enum><header>In general</header><text>Except as provided by paragraph (2), the Federal share of the cost of any activity carried out using a grant under this section shall not exceed 75 percent of the total cost of the activity.</text></paragraph> 
<paragraph id="HF5124AC101F6401DA8332EF5D21AD9B5"><enum>(2)</enum><header>Public target range construction or expansion</header><text>The Federal share of the cost of acquiring land for, expanding, or constructing a public target range in a State on Federal or non-Federal land pursuant to this section or section 8(c) shall not exceed 90 percent of the cost of the activity.</text></paragraph></subsection><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph> 
<paragraph id="HEC252D086B734C82B6060BC034C69910"><enum>(3)</enum><text>in subsection (c)(1)—</text> 
<subparagraph id="H462E88D1DC1B45488F7A1A7879F7260B"><enum>(A)</enum><text>by striking <quote>Amounts made</quote> and inserting the following:</text> 
<quoted-block display-inline="no-display-inline" id="HCDC7D6D6815642B7B3AF93E4833BF48E" style="OLC"> 
<subparagraph id="HADE3766829B741BC8AAD027FF7822C10"><enum>(A)</enum><header>In general</header><text>Except as provided in subparagraph (B), amounts made</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph> 
<subparagraph id="H4AE034C7944E4484B831934C2A94ED9A"><enum>(B)</enum><text>by adding at the end the following:</text> 
<quoted-block display-inline="no-display-inline" id="H669DA7F458BF4182B1CDF02FCF616CF0" style="OLC"> 
<subparagraph id="HB06625847BB4425EACCBCC63AEEE695C"><enum>(B)</enum><header>Exception</header><text>Amounts provided for acquiring land for, constructing, or expanding a public target range shall remain available for expenditure and obligation during the 5-fiscal-year period beginning on October 1 of the first fiscal year for which the amounts are made available.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></subsection></section> 
<section id="H89C16344927F4582AB31D34F27E6CBE9"><enum>5.</enum><header>Limits on liability</header> 
<subsection id="H756FADBD9EBB46C186802D69F382406C"><enum>(a)</enum><header>Discretionary function</header><text>For purposes of chapter 171 of title 28, United States Code (commonly referred to as the <quote>Federal Tort Claims Act</quote>), any action by an agent or employee of the United States to authorize the use of Federal land for purposes of target practice or marksmanship training by a member of the public shall be considered to be the exercise or performance of a discretionary function.</text></subsection> 
<subsection id="HC487732FA14348CAA4AAFA0966DFDC30"><enum>(b)</enum><header>Civil action or claims</header><text>Except to the extent provided in chapter 171 of title 28, United States Code, the United States shall not be subject to any civil action or claim for money damages for injury to or loss of property, personal injury, or death caused by an activity occurring at a public target range that is—</text> 
<paragraph id="H7484BEF7398C4D0788B6EB38A3C4B890"><enum>(1)</enum><text>funded in whole or in part by the Federal Government pursuant to the Pittman-Robertson Wildlife Restoration Act (16 U.S.C. 669 et seq.); or</text></paragraph> 
<paragraph id="H67A73108FD5D4E138651BD9DF9BF0A20"><enum>(2)</enum><text>located on Federal land.</text></paragraph></subsection></section> 
<section id="HE1878F5C660D404C8201D88BB07D6275"><enum>6.</enum><header>Sense of Congress regarding cooperation</header><text display-inline="no-display-inline">It is the sense of Congress that, consistent with applicable laws and regulations, the Chief of the Forest Service and the Director of the Bureau of Land Management should cooperate with State and local authorities and other entities to carry out waste removal and other activities on any Federal land used as a public target range in order to encourage continued use of that land for target practice or marksmanship training.</text></section>
