		<official-title>To use amounts made available under the Troubled Assets
		  Relief Program of the Secretary of the Treasury for relief for homeowners and
		  affordable rental housing.</official-title>

		<section id="HF95A5BD36CB64C7E925FC4733D5497E9" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Main Street TARP Act of
			 2009</short-title></quote>.</text>
		</section><section id="H2DBA5F2621A846D4B41B836A115CEB66"><enum>2.</enum><header>Housing Trust
			 Fund</header>
			<subsection id="HEECF0A6956AE43D79957334FAD689F15"><enum>(a)</enum><header>Use of TARP
			 Funds</header><text display-inline="yes-display-inline">Using the authority
			 available under sections 101(a) and 115(a) of division A of the Emergency
			 Economic Stabilization Act of 2008 (12 U.S.C. 5211(a), 5225(a)), the Secretary
			 of the Treasury shall transfer to the Secretary of Housing and Urban
			 Development $1,000,000,000, and the Secretary of Housing and Urban Development
			 shall credit such amount to the Housing Trust Fund established under section
			 1338 of the Federal Housing Enterprises Financial Safety and Soundness Act of
			 1992 (12 U.S.C. 4568) for use in accordance with such section.</text>
			</subsection><subsection id="H8FBB5950EF73472C8A8C710ED437B86F"><enum>(b)</enum><header>Tenant rent
			 contribution</header><text display-inline="yes-display-inline">Subparagraph (A)
			 of section 1338(c)(7) of the Federal Housing Enterprises Financial Safety and
			 Soundness Act of 1992 (12 U.S.C. 4568(c)(7)(A)) is amended by inserting before
			 the semicolon the following: <quote>; and except that all rental housing
			 dwelling units shall be subject to legally binding commitments that ensure that
			 the contribution toward rent by a family residing in a dwelling unit shall not
			 exceed 30 percent of the adjusted income of such family</quote>.</text>
			</subsection></section><section id="H861E9CF5E97E457B9E3AD73F9EAE7CFF"><enum>3.</enum><header>Emergency
			 mortgage relief</header>
			<subsection id="H943BBDD7F7924C51AB5D1CC6EE096FAE"><enum>(a)</enum><header>Use of TARP
			 funds</header><text display-inline="yes-display-inline">Using the authority
			 available under sections 101(a) and 115(a) of division A of the Emergency
			 Economic Stabilization Act of 2008 (12 U.S.C. 5211(a), 5225(a)), the Secretary
			 of the Treasury shall transfer to the Secretary of Housing and Urban
			 Development $2,000,000,000, and the Secretary of Housing and Urban Development
			 shall credit such amount to the Emergency Homeowners’ Relief Fund, which such
			 Secretary shall establish pursuant to section 107 of the Emergency Housing Act
			 of 1975 (12 U.S.C. 2706), as such Act is amended by this section, for use for
			 emergency mortgage assistance in accordance with title I of such Act.</text>
			</subsection><subsection id="HD38C38F841334CD2A96506FB6409349D"><enum>(b)</enum><header>Reauthorization
			 of emergency mortgage relief program</header><text>Title I of the Emergency
			 Housing Act of 1975 is amended—</text>
				<paragraph id="H9F8A5DA3C1F042F785BAF36E34EBE5AB"><enum>(1)</enum><text>in section 103 (12
			 U.S.C. 2702)—</text>
					<subparagraph id="H5FE640455630416CA7FA8DCED2FE5179"><enum>(A)</enum><text>in paragraph
			 (2)—</text>
						<clause id="H7594CC173C0F44E9B5BFE09C0205B327"><enum>(i)</enum><text>by
			 striking <quote>have indicated</quote> and all that follows through
			 <quote>regulation of the holder</quote> and insert <quote>have
			 certified</quote>;</text>
						</clause><clause id="HD2F8F63F1C46416FA18CDD6662DB8BFD"><enum>(ii)</enum><text display-inline="yes-display-inline">by striking <quote>(such as the volume of
			 delinquent loans in its portfolio)</quote>; and</text>
						</clause><clause id="H71BC4C40E60143DE80495ED9F45E0BF5"><enum>(iii)</enum><text>by
			 striking <quote>, except that such statement</quote> and all that follows
			 through <quote>purposes of this title</quote>; and</text>
						</clause></subparagraph><subparagraph id="H6C48B630E50A457495E4E7B3289FD1F9"><enum>(B)</enum><text>in paragraph (4),
			 by inserting <quote>or medical conditions</quote> after <quote>adverse economic
			 conditions</quote>;</text>
					</subparagraph></paragraph><paragraph id="H661687FDE6D94651B73E23521FBA1201"><enum>(2)</enum><text>in section 104 (12
			 U.S.C. 2703)—</text>
					<subparagraph id="H1702F0DFCAF04C6AAA1F42C96D82C3E3"><enum>(A)</enum><text>in subsection (b),
			 by striking <quote>the lesser of $250 per month or</quote>; and</text>
					</subparagraph><subparagraph id="H67D159B0E06D43858ECD9FEC0259D6A8"><enum>(B)</enum><text>in subsection (d),
			 by inserting before the period at the end the following: <quote>, except that
			 such interest rate may exceed such maximum rate but only as necessary to comply
			 with rules under a program operated by a State that otherwise complies with
			 program rules under this title</quote>;</text>
					</subparagraph></paragraph><paragraph id="H0AD1628DEA3D45C68EF7EF73D185505A"><enum>(3)</enum><text display-inline="yes-display-inline">in section 105 (12 U.S.C. 2704)—</text>
					<subparagraph id="H96240677DA3140A78DA24492D7D1CA8F"><enum>(A)</enum><text>by striking
			 subsection (b);</text>
					</subparagraph><subparagraph commented="no" id="HB04BCCB858BC449FA60384905328769B"><enum>(B)</enum><text>in subsection
			 (e)—</text>
						<clause id="H0F20E9AD4AAB4D5597A58736330576C9"><enum>(i)</enum><text>by
			 inserting <quote>and emergency mortgage relief payments made under section
			 106</quote> after <quote>insured under this section</quote>; and</text>
						</clause><clause id="HBC8FBA7814C740D58EF66B9ECDDAC681"><enum>(ii)</enum><text>by
			 striking <quote>$1,500,000,000 at any one time</quote> and inserting
			 <quote>$2,000,000,000</quote>;</text>
						</clause></subparagraph><subparagraph id="H65C98D0D12994E15986E11C21B9C5DC0"><enum>(C)</enum><text>by redesignating
			 subsections (c), (d), and (e) as subsections (b), (c), and (d), respectively;
			 and</text>
					</subparagraph><subparagraph id="HBD1C5CA2CC234D37BA2A866E248F881D"><enum>(D)</enum><text>by adding at the
			 end the following new subsection:</text>
						<quoted-block display-inline="no-display-inline" id="H2E189B14552C4477B583ECB962B99A1F" style="OLC">
							<subsection id="HFED651B2AF70469AB957F39CECADA6E5"><enum>(e)</enum><text display-inline="yes-display-inline">The Secretary shall establish underwriting
				guidelines or procedures to allocate amounts made available for loans and
				advances insured under this section and for emergency relief payments made
				under section 106 based on the likelihood that a mortgagor will be able to
				resume mortgage payments, pursuant to the requirement under section
				103(5).</text>
							</subsection><after-quoted-block>;</after-quoted-block></quoted-block>
					</subparagraph></paragraph><paragraph commented="no" id="HFE4236203BA349D7AA6A743E0AB62BA2"><enum>(4)</enum><text>in section
			 107—</text>
					<subparagraph id="H33AC843B52D54F5CADE707ED08C9A329"><enum>(A)</enum><text>by striking
			 <quote>(a)</quote>; and</text>
					</subparagraph><subparagraph id="H9173E2D088804F78818F98D7978850CF"><enum>(B)</enum><text>by striking

			 U.S.C. 2707), by adding at the end the following new subsection:</text>

						<subsection id="H716DD690B1774BB8AFBD56ED3A1D4A58"><enum>(d)</enum><text display-inline="yes-display-inline">The Secretary may allow funds to be
				administered by a State through an existing program that complies with program
				rules under this
				title.</text>
						</subsection><after-quoted-block>;</after-quoted-block></quoted-block>
				</paragraph><paragraph id="H80107C6499884BBBBE90F05600680CD2"><enum>(6)</enum><text>in section 109 (12
			 U.S.C. 2708)—</text>

			 section 112 (12 U.S.C. 2711) as section 110.</text>
				</paragraph></subsection></section><section id="H0146A30C6F29412E9F7B194B9C2C09BE"><enum>4.</enum><header>Reducing TARP
			 authorization limit to offset costs</header><text display-inline="no-display-inline">Paragraph (3) of section 115(a) of the
			 Emergency Economic Stabilization Act of 2008 (12 U.S.C. 5225) is amended by
			 striking <quote>$1,259,000,000</quote> and inserting
			 <quote>2,259,000,000</quote>.</text>
