		<official-title>To amend the Legal Services Corporation Act to meet
		  special needs of eligible clients, provide for technology grants, improve
		  corporate practices of the Legal Services Corporation, and for other
		  purposes.</official-title>

		<section id="HCA5139377D554DDEA74C144F19DBFB76" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Civil Access to Justice Act of
			 2009</short-title></quote>.</text>
		</section><section id="HECA8C259F2084028992CFD12B9DA22D"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds the following:</text>
			<paragraph id="HC593BC2AE7614F3F9369000250732034"><enum>(1)</enum><text>It is crucial to
			 provide equal access to the system of justice in the United States for all
			 individuals, regardless of economic status.</text>
			</paragraph><paragraph id="HA91E9C18D41448AA8C237EFD22928500"><enum>(2)</enum><text>The Legal Services
			 Corporation provides high quality civil legal assistance for persons who would
			 otherwise be unable to afford legal assistance, and there is a need to continue
			 the present vital legal services program.</text>
			</paragraph><paragraph id="H0DB8224929F24F50A11F45D4D05C9469"><enum>(3)</enum><text>The amount of
			 Federal resources made available to the Legal Services Corporation has been
			 inadequate to provide individuals with the legal assistance that they need.
			 Over half of all people who have applied for assistance from local programs
			 funded through the Legal Services Corporation have been turned away in recent
			 years. In many States, over 80 percent of individuals who need legal assistance
			 do not receive the help they need.</text>
			</paragraph><paragraph id="H49BD19BB2732449D8B94B5DE44E19CF7"><enum>(4)</enum><text>Congress must
			 adequately fund Legal Services Corporation programs to preserve the strength of
			 the programs.</text>
			</paragraph><paragraph id="HDFD375030E76400A93409CD98E300779"><enum>(5)</enum><text>Providing legal
			 assistance to those who face an economic barrier to adequate legal counsel
			 serves justice and assists in improving opportunities for low-income
			 persons.</text>
			</paragraph><paragraph id="H7CC5597BFE474E7CB9A6EAC5C1496D38"><enum>(6)</enum><text>The availability
			 of legal services has reaffirmed the faith of many people of the United States
			 in a government of laws.</text>
			</paragraph><paragraph id="H0D3171B8DAE145E69F9CC2177DC8FF46"><enum>(7)</enum><text>To preserve its
			 strength, the legal services program must be kept free from the influence of
			 political pressures.</text>
			</paragraph><paragraph id="H07543D0C74494807A9F3BFF8CD643679"><enum>(8)</enum><text>Attorneys
			 providing legal assistance must have full freedom to protect the best interests
			 of their clients in keeping with the applicable rules of professional
			 responsibility and the high standards of the legal profession.</text>
			</paragraph></section><section id="H52B0D2960F2649B3807969583BCDC572"><enum>3.</enum><header>Amendments to
			 statement of findings and declaration of purpose</header><text display-inline="no-display-inline">Section 1001 of the Legal Services
			 Corporation Act (42 U.S.C. 2996) is amended—</text>
			<paragraph id="H8B0DD1861A8F427800A39D71252C549B"><enum>(1)</enum><text display-inline="yes-display-inline">by striking <quote>1001.</quote> and
			 inserting <quote>1001.(a)</quote>;</text>
			</paragraph><paragraph id="HF866BCC56BEB42268729007B8D00E19F"><enum>(2)</enum><text display-inline="yes-display-inline">in paragraph (3), by striking
			 <quote>Act</quote> and inserting <quote>title</quote>;</text>
			</paragraph><paragraph id="HC617ED7B5FB1475CB6C763D21B133415"><enum>(3)</enum><text display-inline="yes-display-inline">in paragraph (6), by striking <quote>Code
			 of Professional Responsibility, the Canons of Ethics,</quote> and inserting
			 <quote>applicable rules of professional responsibility</quote>; and</text>
			</paragraph><paragraph id="HAEAA5C63B1944CB6B5F14600081666FD"><enum>(4)</enum><text>by inserting at
			 the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="HD914E055226845E49D7C00722003BDA8" style="OLC">
					<subsection id="H36B4BCCDED3F451E00EC86E103BE8569"><enum>(b)</enum><text>Congress finds the
				following:</text>
						<paragraph id="HA0A795CF178047649404B53E07008EDC"><enum>(1)</enum><text>Participation of
				private lawyers in providing legal assistance to those unable to afford such
				assistance significantly enhances the overall system for providing legal
				services to the poor, and the Legal Services Corporation should continue to
				promote and support pro bono services and other forms of private bar
				involvement through its policies and regulations.”.</text>
						</paragraph><paragraph id="H902B82A324CD4361B4425B6F96582825"><enum>(2)</enum><text>The highest court
				of each State should encourage pro bono service by lawyers by adopting
				aspirational guidelines, such as the American Bar Association Model Rule of
				Professional Conduct 6.1, <quote>Voluntary Pro Bono Publico Services</quote>,
				and by adopting mandatory reporting of voluntary pro bono
				service.</text>
						</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</paragraph></section><section id="HDB25D6445F0E4B5AB56257FBD274C7CA"><enum>4.</enum><header>Definitions</header><text display-inline="no-display-inline">Section 1002 of the Legal Services
			 Corporation Act (42 U.S.C. 2996a) is amended—</text>
			<paragraph id="HA3B631F7713C4CB0AE13CD23524EB7B9"><enum>(1)</enum><text>by striking
			 paragraph (7) and inserting the following:</text>
				<quoted-block display-inline="no-display-inline" id="H566184D123EA434BA89687E70593513F" style="OLC">
					<paragraph id="HF59F10FE9B73434DBC648288A8C9F57B"><enum>(7)</enum><text><term>staff
				attorney</term> means an attorney who—</text>
						<subparagraph id="HB65176B63B6E4475BA72AF51DD68B326"><enum>(A)</enum><text>is employed by a
				recipient organized in whole or in part for the provision of legal assistance
				to eligible clients under this title; or</text>
						</subparagraph><subparagraph id="H9DD10962A85444FCB629B7536FB6DD79"><enum>(B)</enum><text>receives more than
				one-half of the attorney's annual professional salary from the proceeds of a
				grant, contract, or other financial assistance from the Corporation to such
				recipient;</text>
						</subparagraph></paragraph><after-quoted-block>;</after-quoted-block></quoted-block>
			</paragraph><paragraph id="H4356540925C64D93A93D54E8FCCA582E"><enum>(2)</enum><text>in paragraph (8),
			 by striking <quote>the Trust Territory of the Pacific Islands, and any other
			 territory or possession of the United States</quote> and inserting <quote>the
			 Commonwealth of the Northern Mariana Islands, the Republic of the Marshall
			 Islands, the Federated States of Micronesia, and the Republic of
			 Palau;</quote>; and</text>
			</paragraph><paragraph id="H50C81FB234CC4CC200AF2480BDF0163"><enum>(3)</enum><text>by
			 adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="H36E75ECA265A455CBED00066CCFC0FF" style="OLC">
					<paragraph id="HA39BA33A88ED4C9781FFAF879D2732A6"><enum>(9)</enum><text><term>individual
				in poverty</term> means an individual who is a member of a family (of 1 or more
				members) with an income at or below the poverty line; and</text>
					</paragraph><paragraph id="H12D3399FE84A4BCE86156F8447D3E069"><enum>(10)</enum><text><term>poverty
				line</term> means the poverty line (as defined by the Office of Management and
				Budget, and revised annually in accordance with section 673(2) of the Community
				Services Block Grant Act (42 U.S.C. 9902(2)), applicable to a family of the
				size
				involved.</text>
					</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</paragraph></section><section id="H5129FF1F99BC4481B31C61DC8F62B4EF"><enum>5.</enum><header>Governing
			 body</header><text display-inline="no-display-inline">Section 1004 of the Legal
			 Services Corporation Act (42 U.S.C. 2996c) is amended—</text>
			<paragraph id="H7D6D6009D8B5430CA9BC7CCCDAC8B8EB"><enum>(1)</enum><text>in subsection (a),
			 in the third sentence—</text>
				<subparagraph id="HA3EF59D56F254FE1BC5E32709CBC20CA"><enum>(A)</enum><text>by striking
			 <quote>Effective with respect to appointments made after the date of enactment
			 of the Legal Services Corporation Act Amendments of 1977 but not later than
			 July 31, 1978, the</quote> and inserting <quote>The</quote>;</text>
				</subparagraph><subparagraph id="H2A68C953D0594B7BB8333D81EF540031"><enum>(B)</enum><text>by striking
			 <quote>and</quote> after <quote>shall be appointed so as to include eligible
			 clients,</quote>; and</text>
				</subparagraph><subparagraph id="HB56CD1A5DDF0436F9E6DD17B644CABF1"><enum>(C)</enum><text>by inserting
			 <quote>, and to include at least 1 individual with financial or audit
			 experience</quote> before the period; and</text>
				</subparagraph></paragraph><paragraph id="H82881A0572C04B48812778133DF4BEE8"><enum>(2)</enum><text>in subsection
			 (b)—</text>
				<subparagraph id="H383E51EB326445F8ABC8855049EB43F4"><enum>(A)</enum><text>by striking
			 <quote>, except that five of the members first appointed, as designated by the
			 President at the time of appointment, shall serve for a term of two
			 years</quote>; and</text>
				</subparagraph><subparagraph id="H85562B4C85254AC4B9AD41006244BCC7"><enum>(B)</enum><text>by striking the
			 third and fourth sentences;</text>
				</subparagraph></paragraph><paragraph id="H814367B17C3E4751B4F4AD41536C79B0"><enum>(3)</enum><text>in subsection (d),
			 by striking <quote>President shall select from among the voting members of the
			 board a chairman, who shall serve for a term of three years. Thereafter
			 the</quote>;</text>
			</paragraph><paragraph id="H650808390B294F45A08C4441D6542FD5"><enum>(4)</enum><text>by striking
			 subsection (f);</text>
			</paragraph><paragraph id="HCCA5115D4E1C4404AEFA1E05DC292256"><enum>(5)</enum><text>by redesignating
			 subsections (g) and (h) as (f) and (g), respectively; and</text>
			</paragraph><paragraph id="HB46994F9D9604A6A8D20B561923F8957"><enum>(6)</enum><text>in subsection (f),
			 as redesignated by this section, by striking <quote>, of any executive
			 committee of the Board, and of any advisory council established in connection
			 with this title</quote> and inserting <quote>or of any committee of the
			 Board</quote>.</text>
			</paragraph></section><section id="HBE117CF34AC9454082A500FB44EC3139"><enum>6.</enum><header>Officers and
			 employees</header>
			<subsection id="H2850FD3E99554F31910C76F70356F1E0"><enum>(a)</enum><header>Elimination of
			 personal pronoun</header><text display-inline="yes-display-inline">Section
			 1005(b)(1) of the Legal Services Corporation Act (42 U.S.C. 2996d(b)(1)) is
			 amended by striking <quote>as he</quote> and inserting <quote>as the president
			 of the Corporation</quote>.</text>
			</subsection><subsection id="H37ADE83B0C8D4358A1CA15C3EE6566BE"><enum>(b)</enum><header>Maximum
			 pay</header><text display-inline="yes-display-inline">Section 1005(d) of the
			 Legal Services Corporation Act (42 U.S.C. 2996d(d)) is amended—</text>
				<paragraph id="HF80D4005CEFA4930A2D50193B235542D"><enum>(1)</enum><text>by striking
			 <quote>level V</quote> and inserting <quote>level III</quote>; and</text>
				</paragraph><paragraph id="HA397E2A8342C4266BDBA426085585336"><enum>(2)</enum><text>by striking
			 <quote>5316</quote> and inserting <quote>5314</quote>.</text>
				</paragraph></subsection></section><section id="HBC7272AFD454463B955C3BA2AB9838D6"><enum>7.</enum><header>Improvements of
			 Legal Services Corporation corporate governance and internal
			 practices</header><text display-inline="no-display-inline">Section 1006 of the
			 Legal Services Corporation Act (42 U.S.C. 2996e) is amended—</text>
			<paragraph id="HEF77A4F633E04872005F5BF7306BFD7E"><enum>(1)</enum><text display-inline="yes-display-inline">in subsection (a)—</text>
				<subparagraph id="H7DB8EA5398E145E9BDF56612F7BEB5C9"><enum>(A)</enum><text display-inline="yes-display-inline">in paragraph (2), by inserting <quote>,
			 subject to subsection (g)</quote> before the semicolon; and</text>
				</subparagraph><subparagraph id="H172299A9A06B49C689B8B44EF7C95397"><enum>(B)</enum><text>in paragraph
			 (3)(A), by striking <quote>except that broad general legal or policy research
			 unrelated to representation of eligible clients may not be undertaken by grant
			 or contract,</quote>;</text>
				</subparagraph></paragraph><paragraph id="H4E961159224D486E8491899796EB9CCD"><enum>(2)</enum><text>in subsection
			 (b)—</text>
				<subparagraph id="HF7648B28AC414042A3EA91E08DEAED8"><enum>(A)</enum><text>in paragraph (3),
			 by striking <quote>as established in the Canons of Ethics and the Code of
			 Professional Responsibility of the American Bar Association</quote> and
			 inserting <quote>as established in the applicable rules of professional
			 responsibility or other laws of the State or other jurisdiction where the
			 attorney practices law</quote>; and</text>
				</subparagraph><subparagraph id="HE085CB7E303D4E21AF5E743CC9D19862"><enum>(B)</enum><text>in paragraph (5),
			 by striking the last sentence; and</text>
				</subparagraph></paragraph><paragraph id="H64F108185F7140FB00DA39F4D0E3A89"><enum>(3)</enum><text>by
			 adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="HA9481356D6C8447B9F7B499229E8D2D" style="OLC">
					<subsection id="H1033420DA7EC453EA23DE4A2D28C2300"><enum>(g)</enum><paragraph commented="no" display-inline="yes-display-inline" id="HB03A5DC67F63411A979F44D990D2C8FE"><enum>(1)</enum><text>The Corporation shall
				establish a protocol for the receipt of donations under subsection
				(a)(2).</text>
						</paragraph><paragraph id="H4247FF8151F04D32A73DFD05000000EC" indent="up1"><enum>(2)</enum><text>In order for the Corporation to use
				any Federal funds for representational activities of the Corporation, not
				including non-representational activities that primarily involve Corporation
				staff, the appropriations Act through which the funds are made available shall
				specifically permit the use of the funds for such activities. Any solicitation
				of a donation of funds for expenses for which Federal funds may not be used
				under this title shall be approved in advance by the Board. In addition, a
				budget for the use of such donated funds shall be approved by the Board, before
				the Corporation incurs such an expense.</text>
						</paragraph><paragraph id="H681543C2A2474AB3B95096008CAA25A0" indent="up1"><enum>(3)</enum><text>The Corporation may not advance
				Federal funds, in anticipation of receiving a donation under subsection (a)(2),
				to pay for an expense.</text>
						</paragraph></subsection><subsection id="HCBE661FA9CE7415483939DB313D409F1"><enum>(h)</enum><paragraph commented="no" display-inline="yes-display-inline" id="HDAA9B52686C4453490A6C05951E4B200"><enum>(1)</enum><text>The Board shall
				establish and maintain an audit committee, a finance committee, and a
				governance and performance review committee.</text>
						</paragraph><paragraph id="HF824E2DC7E7C4891B00067051D23A2CD" indent="up1"><enum>(2)</enum><text>The Corporation shall establish and
				implement a continuity of operations plan, to prepare for disasters and
				emergencies.</text>
						</paragraph><paragraph id="H871655F1FD404CD7886CB07CAF02FD9D" indent="up1"><enum>(3)</enum><text>The Corporation shall—</text>
							<subparagraph id="HC12D7F95F4B7451985FBBE433B3F8C21"><enum>(A)</enum><text>establish an adequate internal control
				structure and procedures for financial reporting; and</text>
							</subparagraph><subparagraph id="H85540709476848FEBB5E82C664CC01D6"><enum>(B)</enum><text>not later than 1 year after the date
				of enactment of the Civil Access to Justice Act of 2009, and annually
				thereafter, conduct an assessment of the effectiveness of the internal control
				structure and procedures.</text>
							</subparagraph></paragraph></subsection><subsection id="HED668319F6514208BEBCEEBF75E9B1B0"><enum>(i)</enum><paragraph commented="no" display-inline="yes-display-inline" id="H0385FE9CF0E945F1A0BBC19DF764B95E"><enum>(1)</enum><text>The Corporation shall
				adopt comprehensive training standards and develop appropriate training
				materials to ensure that recipients are able to provide comprehensive and
				appropriate training for executive directors, supervisors, and attorneys
				employed by recipients and board members of recipients. Such training standards
				and materials shall address training concerning—</text>
							<subparagraph id="H3182A6BEF6F844CB8E96BB0443B7C1C1" indent="up1"><enum>(A)</enum><text>restrictions applicable to the
				activities of attorneys employed by the recipient involved; and</text>
							</subparagraph><subparagraph id="H875D4838ED6D4B8A994750F214BA23FF" indent="up1"><enum>(B)</enum><text>appropriate use of Federal
				funds.</text>
							</subparagraph></paragraph><paragraph id="HDBA95AF3DE9C48810050271B004895D9" indent="up1"><enum>(2)</enum><text>In developing training standards and
				materials for the training described in paragraph (1), the Corporation—</text>
							<subparagraph id="H65D1F7F8D6004EBBA1FEA4C5F591FA2B"><enum>(A)</enum><text>is encouraged to address training
				concerning the representation of victims of domestic violence; and</text>
							</subparagraph><subparagraph id="H04CBEB10271A4C23AE6533374743A867"><enum>(B)</enum><text>may coordinate activities with the
				American Bar Association Commission on Domestic Violence.</text>
							</subparagraph></paragraph><paragraph id="H578DB96A7D524AC4B310D8004B4654ED" indent="up1"><enum>(3)</enum><text>The Corporation shall provide
				financial assistance, in such amounts as the Corporation may determine to be
				appropriate, to recipients, to enable the recipients to provide the training
				described in paragraph
				(1).</text>
						</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</paragraph></section><section id="HEB81804F2CEE465784E6FFDD5E008BC4"><enum>8.</enum><header>Pilot Loan
			 Repayment Assistance Program</header><text display-inline="no-display-inline">Section 1006 of the Legal Services
			 Corporation Act, as amended by section 7, is further amended by adding at the
			 end the following:</text>
			<quoted-block display-inline="no-display-inline" id="HF14728B8C6A9450F838CC1C7FDF48BAF" style="OLC">
				<subsection id="H2A8FDDBE4CA444B0B5D9F9FAE80077F8"><enum>(j)</enum><paragraph commented="no" display-inline="yes-display-inline" id="idB7F9508DC7664DFC8CAC9C1D59D8F80D"><enum>(1)</enum><text>The Corporation shall
				promote recruitment and retention of highly qualified staff members for all
				recipients, through the Pilot Loan Repayment Assistance Program established by
				the Corporation in 2005 or other programs, as the Corporation determines to be
				appropriate.</text>
					</paragraph><paragraph id="HBB6394CC644A4989B3E09714B1C6F912" indent="up1"><enum>(2)</enum><text>If funds are appropriated for any
				such staff recruitment and retention program for each of the 5 full fiscal
				years following the date of enactment of the Civil Access to Justice Act of
				2009, in the fifth year, the Corporation shall submit to Congress a report on
				the impact of such program on the recruitment and retention of highly qualified
				staff for recipients.</text>
					</paragraph><paragraph id="HA413E68F8D3342249B007512D42A12C" indent="up1"><enum>(3)</enum><text>Nothing in paragraph (2) prevents the
				Corporation from continuing such recruitment and retention programs for longer
				than 5 years, if such program is effective in the recruitment and retention of
				highly qualified staff and funds are appropriated for such
				program.</text>
					</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section id="HCF52F3617DC747F08717D304B010FD2B"><enum>9.</enum><header>Prohibited use of
			 funds</header><text display-inline="no-display-inline">Section 1006 of the
			 Legal Services Corporation Act, as amended by section 8, is further amended by
			 adding at the end the following:</text>
			<quoted-block display-inline="no-display-inline" id="HEE859FD5C15E4349B0D2AE555D610841" style="OLC">
				<subsection id="HE43FDD33B94F45E781E9620042437324"><enum>(k)</enum><paragraph commented="no" display-inline="yes-display-inline" id="H0A7B734CFBE744FEA43FD58F82623B22"><enum>(1)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="id6F9074D8CD9D4F56A37D32DD20382ACD"><enum>(A)</enum><text>No prohibited purposes
				provision shall be considered to cover recipient funds from any source other
				than the Corporation, except as provided in paragraph (3).</text>
						</subparagraph><subparagraph id="HF16E9493463B49DCB5D0D76FA677DB00" indent="up2"><enum>(B)</enum><text>No prohibited purposes provision
				shall be considered to cover Federal funds awarded under this title, except as
				provided in this title.</text>
						</subparagraph></paragraph><paragraph id="HFD1670AE89F54D629DE13B43D5466B06" indent="up1"><enum>(2)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="H7DA466E9561A4F74801143F737233042"><enum>(A)</enum><text>In this subsection, the
				term <quote>prohibited purposes provision</quote> means a provision of this
				title, or any other Federal law, that contains text stating that funds of a
				recipient may not be expended for a purpose prohibited by this title or another
				Federal law.</text>
						</subparagraph><subparagraph id="HEE88D0B806F7445D0055BFF3E2F6752B" indent="up1"><enum>(B)</enum><text>The term includes any Federal law
				that incorporates by reference a provision that contains text described in
				subparagraph (A) and is a provision of—</text>
							<clause id="H6B1A7B414C154B8E92463194A739CFEF"><enum>(i)</enum><text>the Departments of Commerce, Justice,
				and State, the Judiciary, and Related Agencies Appropriations Act, 1998;</text>
							</clause><clause id="HF81A3FBCC33646EC84D1B7EE10084E80"><enum>(ii)</enum><text>the Departments of Commerce, Justice,
				and State, the Judiciary, and Related Agencies Appropriations Act, 1996;
				or</text>
							</clause><clause id="H1B14417C26724BEDB4410067001C43A7"><enum>(iii)</enum><text>another Federal law.</text>
							</clause></subparagraph></paragraph><paragraph id="hhshsi99999999929" indent="up1"><enum>(3)</enum><text>No non-Federal funds may be used
				by a recipient to participate in any litigation with respect to

					</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section id="H9539F0D36B754699BC975DF5659316CC"><enum>10.</enum><header>Construction</header><text display-inline="no-display-inline">Section 1006 of the Legal Services
			 Corporation Act, as amended by section 9, is further amended by adding at the
			 end the following:</text>
			<quoted-block display-inline="no-display-inline" id="H59266982E66F4A85AD46F6FCFBFA1D03" style="OLC">
				<subsection id="HDF694896930B4D28005C6F37F0CF3F42"><enum>(l)</enum><text>No provision of
				law, other than an amendment to this title, shall be considered to supersede or
				modify this title unless the provision refers specifically to this
				subsection.</text>
				</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section id="HCB231E6715FC4E4A8DC2C8006744787D"><enum>11.</enum><header>Grants and
			 contracts</header><text display-inline="no-display-inline">Section 1007 of the
			 Legal Services Corporation Act (42 U.S.C. 2996f) is amended—</text>
			<paragraph id="HC3D5E0E59DA44DB5B7F5614C1BAB5E5C"><enum>(1)</enum><text>in subsection
			 (a)—</text>
				<subparagraph id="H5746601E92C14929A872002B0053F385"><enum>(A)</enum><text>in paragraph
			 (2)—</text>
					<clause id="HFDD72AB5308940C9A6CE8016BF9FEC6"><enum>(i)</enum><text>in
			 subparagraph (A), by striking <quote>and with the Governors of the several
			 States</quote>;</text>
					</clause><clause id="H933C67B60D0B4E368D3EAFF8DB0ADA"><enum>(ii)</enum><text>in
			 subparagraph (B)—</text>
						<subclause id="HBA2C00FEF46A460FB6BC6BD4EE75C023"><enum>(I)</enum><text>in clause (i), by

			 paragraph (7) the following:</text>

						<paragraph id="H83F16242746D4D9D91DEC3A93242FEA"><enum>(8)</enum><text>ensure that funds
				appropriated under this title for basic field programs shall be distributed on
				the basis of a system of competitive bidding, in accordance with Legal Services
				Corporation regulations, and shall be allocated so as to provide—</text>
							<subparagraph id="HEE7E921098B04735BE03DB44B483F71B"><enum>(A)</enum><text>except as provided
				in subparagraphs (B) and (C), an equal figure per individual in poverty for all
				geographic areas, as determined on the basis of the most recent decennial
				census of population conducted pursuant to section 141 of title 13, United
				States Code (or, in the case of the Republic of Palau, the Federated States of
				Micronesia, the Republic of the Marshall Islands, the Commonwealth of the
				Northern Mariana Islands, Alaska, Hawaii, and the United States Virgin Islands,
				on the basis of the adjusted population counts historically used as the basis
				for such determinations);</text>
							</subparagraph><subparagraph commented="no" id="HCFE932444010447681A871ADD93552E"><enum>(B)</enum><text>an additional
				amount for Native American communities that received assistance under the Legal
				Services Corporation Act for fiscal year 2009, so that the proportion of the
				funds appropriated to the Legal Services Corporation for basic field programs
				for fiscal year 2010 that is received by the Native American communities shall
				be not less than the proportion of such funds appropriated for fiscal year 2009
				that was received by the Native American communities; and</text>
							</subparagraph><subparagraph id="HD96A8C5C68B7471AA88D49BA92BFCE97"><enum>(C)</enum><text>an amount for
				representation of migrant and seasonal farm
				workers.</text>
							</subparagraph></paragraph><after-quoted-block>;
				and</after-quoted-block></quoted-block>
				</subparagraph><subparagraph id="H2E557AB25ADE4A5AB8D7011CD9987C41"><enum>(E)</enum><text>in paragraph (9),
			 as redesignated by this subsection, by striking <quote>the Canons of Ethics and
			 Code of Professional Responsibility of the American Bar Association</quote> and
			 inserting <quote>applicable rules of professional
			 responsibility</quote>;</text>
				</subparagraph></paragraph><paragraph id="HF1E30A5ABB9F47B1BDBFBAA450C2B26F"><enum>(2)</enum><text>in subsection
			 (b)—</text>
				<subparagraph id="H435C1546E1534645AEEB32C9D410D91B"><enum>(A)</enum><text>by striking
			 paragraph (8) and inserting the following:</text>

				assistance with respect to litigation relating to prison conditions on behalf
				of any individual who is incarcerated in a Federal, State, or local prison,
				except that nothing in this paragraph prohibits the use of funds made available
				by the Corporation for litigation related to an incarcerated individual's
				ability to reenter society successfully;</text>
						</paragraph><paragraph id="HAB49C28E693A4410B8BC905BADC300A5"><enum>(13)</enum><text>to provide legal
				assistance with respect to the defense of an individual in a proceeding to
				evict such individual from a public housing project if—</text>
							<subparagraph id="H2371CE2D003A4A7399FBF0A0DF941DC5"><enum>(A)</enum><text display-inline="yes-display-inline">the individual has been convicted in a
				criminal proceeding with the illegal sale or distribution of a controlled
				substance; and</text>
							</subparagraph><subparagraph id="HA1D33BBC4FFD4D5DB5C300CB05C8D65"><enum>(B)</enum><text>the eviction
				proceeding is brought by a public housing agency because the illegal drug
				activity of the individual threatens the health and safety of another tenant
				residing in the public housing project or an employee of the public housing
				agency; or</text>
							</subparagraph></paragraph><paragraph id="H630C60FAF3CB48FCB771F942EA63CD64"><enum>(14)</enum><text>to provide legal
				assistance for, or on behalf of an alien, unless the alien—</text>
							<subparagraph id="HF485F7CC1CE34F8A9DD589178964F173"><enum>(A)</enum><text>is present in the
				United States and the alien—</text>
								<clause id="H74CA21BD7AA7454490981BC0D1ACE6EC"><enum>(i)</enum><text>is
				described in subparagraph (A), (B), (C), (D), (E), or (F) of section 504(a)(11)
				of the Departments of Commerce, Justice, and State, the Judiciary, and Related
				Agencies Appropriations Act, 1996, as enacted by section 101 of the Omnibus
				Consolidated Rescissions and Appropriations Act of 1996 (Public Law 104–134;
				110 Stat. 1321–54);</text>
								</clause><clause id="H36CCBC831A834EC79E25276DB6461AE7"><enum>(ii)</enum><text display-inline="yes-display-inline">is lawfully present as a result of
				withholding of deportation pursuant to former section 243(h) of the Immigration
				and Nationality Act, withholding or restriction of removal pursuant to section
				241(b)(3) of the Immigration and Nationality Act (8 U.S.C. 1231(b)(3)), or
				withholding of removal under the Convention Against Torture pursuant to the
				regulation of the Secretary of Homeland Security codified on the date of the
				enactment of the Civil Access to Justice Act of 2009 at 8 C.F.R. 208.16(c) and
				the regulation of the Attorney General codified on such date at 8 C.F.R.
				1208.16(c);</text>
								</clause><clause id="H2AD9A1C1ACD74E80B12185ACF155CD3B"><enum>(iii)</enum><subclause commented="no" display-inline="yes-display-inline" id="HCFCA146BBF75494FA44900D630423343"><enum>(I)</enum><text>has been battered or
				subjected to extreme cruelty or was a victim of sexual assault or trafficking
				in the United States; or</text>
									</subclause><subclause id="HFEE65DBC392B4A10A22058B5D979C655" indent="up1"><enum>(II)</enum><text>qualifies for nonimmigrant status
				described in section 101(a)(15)(U) of the Immigration and Nationality Act (8
				U.S.C. 1101(a)(15)(U));</text>
									</subclause></clause><clause id="H834AE74CE7134F23856FB3131353B456"><enum>(iv)</enum><text>has a child
				present in the United States who, without the active participation of the
				alien—</text>
									<subclause id="HD0F973E5D60F4A0C90CF0074D0A939AB"><enum>(I)</enum><text>has been battered
				or subjected to extreme cruelty or was a victim of sexual assault or
				trafficking in the United States; or</text>
									</subclause><subclause id="HE4068CC9B3D94C02A2DD348E93003CD1"><enum>(II)</enum><text>qualifies for
				nonimmigrant status described in section 101(a)(15)(U) of the Immigration and
				Nationality Act;</text>
									</subclause></clause><clause id="H9732B4ABB58D4F1CAA51401100A63C44"><enum>(v)</enum><text>has been a victim
				of trafficking or is a family member of such a victim and is eligible for
				protection and assistance under section 107 of the Trafficking Victims
				Protection Act of 2000 (22 U.S.C. 7105);</text>
								</clause><clause id="H50ED776AD9684433BCD9366ECAB5FA20"><enum>(vi)</enum><text>is an evacuee
				from, or victim of, a major disaster or an emergency designated by the
				President pursuant to the Robert T. Stafford Disaster Relief and Emergency
				Assistance Act (42 U.S.C. 5121 et seq.) or by an appropriate State or local
				official, and the alien's need for legal assistance from the Corporation is
				related to the alien's status as such an evacuee or victim;</text>
								</clause><clause id="HDA16F8F828B0486998E39FF97F000039"><enum>(vii)</enum><subclause commented="no" display-inline="yes-display-inline" id="H949275F0D4E8487C9B896768758DCA6C"><enum>(I)</enum><text>has been declared
				dependent on a juvenile court located in a State or has been legally committed
				to, or placed under the custody of, an agency or department of a State by such
				a court; and</text>
									</subclause><subclause id="H8526B946F8F9477EBB1BE5C60030FF55" indent="up1"><enum>(II)</enum><text>has been deemed eligible by such a court
				for long-term foster care due to abuse, neglect, or abandonment;</text>
									</subclause></clause><clause id="H44FF91F90D7B490C85751F2E1BB284C9"><enum>(viii)</enum><text>is under 18
				years of age, is unaccompanied by a parent or legal guardian, and is in the
				custody of the Secretary of Homeland Security or Health and Human Services;
				or</text>
								</clause><clause id="HBB4A31A02ADA467483231BAD0203CA31"><enum>(ix)</enum><text>is authorized to
				work in the United States or is otherwise lawfully present in the United
				States;</text>
								</clause></subparagraph><subparagraph id="HA484FBDB337A4FAA8DE6E4444B9E86CD"><enum>(B)</enum><text>is a member of a
				cross-border Indian Tribe who is—</text>
								<clause id="H7D57B6FF4FDD4CA2AADD35FAFD2009C"><enum>(i)</enum><text>an
				American Indian born in Canada referred to in section 289 of the Immigration
				and Nationality Act (8 U.S.C. 1359); or</text>
								</clause><clause id="H18404824EEF44401A22099A7E744691F"><enum>(ii)</enum><text>a
				member of the Texas Band of Kickapoo Indians referred to in the Texas Band of
				Kickapoo Act (25 U.S.C. 1300b–11 et seq.);</text>
								</clause></subparagraph><subparagraph id="HA031F292F9F44C0882A400F9D13EC631"><enum>(C)</enum><text>is—</text>
								<clause id="HC62ABBF7CA46494EAEE623A8BB2EC2E8"><enum>(i)</enum><text>indigent;
				and</text>
								</clause><clause id="H2655658E133A465497835E8D3067D5DA"><enum>(ii)</enum><text>seeking relief
				under the Convention on the Civil Aspects of International Child Abduction,
				done at The Hague on October 25, 1980, pursuant to the International Child
				Abduction Remedies Act (42 U.S.C. 11601 et seq.); or</text>
								</clause></subparagraph><subparagraph id="H294AAE3310F4428EBBBB80ADF205ACED"><enum>(D)</enum><text>is a citizen
				of—</text>
								<clause id="H0DB6FA3E6CF148FEA227BBC8AE05A399"><enum>(i)</enum><text>the Commonwealth
				of the Northern Mariana Islands;</text>
								</clause><clause id="H2D21690F4FEB428BB1BACC3949EACA95"><enum>(ii)</enum><text>the Federated
				States of Micronesia;</text>
								</clause><clause id="HD1254334111E4D7600EB12D33DD131CE"><enum>(iii)</enum><text>the Republic of
				the Marshall Islands; or</text>
								</clause><clause id="H17B998083E4049B98F890884FBA43833"><enum>(iv)</enum><text>the Republic of
				Palau.</text>
								</clause></subparagraph></paragraph><after-quoted-block>;</after-quoted-block></quoted-block>
				</subparagraph></paragraph><paragraph id="HA62F6DA8F1EF49038E0643B4960889C7"><enum>(3)</enum><text>by striking
			 subsection (c) and inserting the following:</text>
				<quoted-block display-inline="no-display-inline" id="HC3222CE0D3CF4A04990048E60008C97" style="OLC">
					<subsection id="H7E60D0D949BD45FFA2B88DE527591E25"><enum>(c)</enum><text>In making grants
				or entering into contracts for legal assistance, the Corporation—</text>
						<paragraph id="H83D9E75A6C874FADA76E3EA6C2D67030"><enum>(1)</enum><text>shall ensure that
				any recipient organized solely for the purpose of providing legal assistance to
				eligible clients is governed by a body (referred to in this subsection as a
				<quote>board</quote>) at least 50 percent of which consists of attorneys who
				are members of the bar of a State in which the legal assistance is to be
				provided (except that the Corporation may grant, pursuant to regulations issued
				by the Corporation, a waiver of such requirement for recipients which, because
				of the population the recipients serve, are unable to comply with such
				requirement);</text>
						</paragraph><paragraph id="H95AF01EA1F614A8CA30019A2B3142B9F"><enum>(2)</enum><text>shall ensure that
				any attorney, while serving on such board, shall not receive compensation from
				a recipient for such service;</text>
						</paragraph><paragraph id="HEB5044AC346D473597CEF3F3556F2FAE"><enum>(3)</enum><text>shall ensure that
				at least one-third of a recipient's governing body consists of individuals who
				are, when selected, eligible clients who also may be representatives of
				associations or organizations of eligible clients; and</text>
						</paragraph><paragraph id="H6C96721BBC424235856558399ECC28B7"><enum>(4)</enum><text>shall ensure that
				at least 1 board member is designated as a liaison to the bar association of
				the State described in paragraph (1) for pro bono promotion and
				coordination.</text>
						</paragraph></subsection><after-quoted-block>;</after-quoted-block></quoted-block>
			</paragraph><paragraph id="H69B5C992ADF94E67002241C5B2F9BAA"><enum>(4)</enum><text>in
			 subsection (d), by adding at the end the following: <quote>The Corporation
			 shall ensure that the monitoring and evaluation activities described in this
			 subsection are carried out in a manner that is consistent with the applicable
			 rules of professional responsibility for the jurisdiction in which the
			 recipient is being monitored, and shall take reasonable steps to avoid imposing
			 undue burden or expense on the recipient.</quote>;</text>
			</paragraph><paragraph id="H10E90CC92A8B4045A0E01266A2FDEF57"><enum>(5)</enum><text>by striking
			 subsections (g) and (h); and</text>
			</paragraph><paragraph id="H0A4B640A460F4F8395DA9B1C6334E75"><enum>(6)</enum><text>by
			 adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="H57B982B6BB344AE2B81D97FE706C0FF" style="OLC">
					<subsection id="H66AABCE4C40E4340929C35D5B02D49C"><enum>(h)</enum><text>The Corporation
				shall require all attorneys and paralegals employed by a recipient to maintain
				records of time spent on each case or matter supported in whole or in part with
				funds provided under this
				title.</text>
					</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</paragraph></section><section id="H0988B4256A9D4668913587D773536411"><enum>12.</enum><header>Technology
			 grants</header><text display-inline="no-display-inline">Section 1007 of the
			 Legal Services Corporation Act (42 U.S.C. 2996f), as amended by section 12, is
			 further amended—</text>
			<paragraph id="H3206CA1EE87D404FA0E3F4328C14FBD9"><enum>(1)</enum><text display-inline="yes-display-inline">by redesignating subsections (c) through
			 (f) as subsections (d) through (g), respectively; and</text>
			</paragraph><paragraph id="HE48428F9F0F84D759FA184571D6FFFDA"><enum>(2)</enum><text>by inserting after
			 subsection (b) the following:</text>
				<quoted-block display-inline="no-display-inline" id="HD960BFBEC9E54F67007790CD584FA608" style="OLC">
					<subsection id="H36FE483FB973433682DB10A93CB6DF9D"><enum>(c)</enum><text>In making a grant
				or entering into a contract under this section, the Corporation may provide
				that a portion of the funds provided under the grant or contract may be used to
				acquire and develop information technology to promote full access to
				high-quality, efficient legal representation and materials for
				self-representation.</text>
					</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</paragraph></section><section id="H07EE5EE427044D0586EF00E200970046"><enum>13.</enum><header>Audits</header><text display-inline="no-display-inline">Section 1009 of the Legal Services
			 Corporation Act (42 U.S.C. 2996h) is amended—</text>
			<paragraph id="H8F6D852590204769B600219FC38E6BFF"><enum>(1)</enum><text display-inline="yes-display-inline">by striking subsection (c) and inserting
			 the following:</text>
				<quoted-block display-inline="no-display-inline" id="HC2ABA85222614A9D81076BEEA2BCB112" style="OLC">
					<subsection id="HBDD6D639AE7B47768B45B0AA11CEB648"><enum>(c)</enum><text>The Corporation
				shall require an audit of each recipient in accordance with generally accepted
				auditing standards and shall require that the recipient prepare a report that
				includes—</text>
						<paragraph id="HABC190ADE46A446D856CDFC5E12CB52"><enum>(1)</enum><text>the financial
				statements of the recipient, including an unbiased presentation of the
				recipient's financial position and the results of the recipient's financial
				operations, in accordance with generally accepted accounting principles;
				and</text>
						</paragraph><paragraph id="H6868BB54E5FF4210A56EB46D08566041"><enum>(2)</enum><text>a description of
				internal control systems of the recipient that provide reasonable assurance
				that the recipient is managing funds, from all sources, in compliance with
				Federal law.</text>
						</paragraph></subsection><after-quoted-block>;
				and</after-quoted-block></quoted-block>
			</paragraph><paragraph id="HFB9F571DECF2411492102136460359E9"><enum>(2)</enum><text>in subsection (d),
			 by striking all that follows the comma and adding <quote>the Corporation, the
			 Comptroller General of the United States, and the Corporation's Inspector
			 General shall not have access to any information in documents, reports, or
			 records that is confidential under the applicable rules of professional
			 responsibility or that is subject to the attorney-client
			 privilege.</quote>.</text>
			</paragraph></section><section id="HDA4F36AB705F4DFE99B949333BA52246"><enum>14.</enum><header>Financing</header><text display-inline="no-display-inline">Section 1010 of the Legal Services
			 Corporation Act (42 U.S.C. 2996i) is amended—</text>
			<paragraph id="HCAB02C19EF5C440F9D968792709232F5"><enum>(1)</enum><text display-inline="yes-display-inline">in subsection (a), by striking the first 3
			 sentences and inserting the following: <quote>There are authorized to be
			 appropriated for the purpose of carrying out the activities of the Corporation
			 $750,000,000 for each of fiscal years 2010 through 2015.</quote>;</text>
			</paragraph><paragraph id="HC08EDFB9CDFF42E7B82C102D012327AE"><enum>(2)</enum><text>in subsection
			 (c)—</text>
				<subparagraph id="H12D4142A51174316916DA5AB6D300E"><enum>(A)</enum><text>by striking the
			 semicolon after <quote>distinct from Federal funds</quote> and inserting a
			 period;</text>
				</subparagraph><subparagraph id="H74604D67F2E54EDFBA8CF7721B7FE3E4"><enum>(B)</enum><text>by striking
			 <quote>but any funds so received for the provision of legal assistance shall
			 not be expended by recipients for any purpose prohibited by this title, except
			 that this</quote> and inserting <quote>This</quote>;</text>
				</subparagraph><subparagraph id="HD21A59F6E90C4F1A876EF2C6349A4AE"><enum>(C)</enum><text>by striking
			 <quote>or</quote> after <quote>to prevent recipients from receiving other
			 public funds</quote> and inserting <quote>, private funds,</quote>; and</text>
				</subparagraph><subparagraph id="H0BFCCA41CC1140AE9207C57D07E89E77"><enum>(D)</enum><text>by inserting after
			 <quote>(including foundation funds benefitting Indians or Indian
			 tribes)</quote> the following: <quote>, or any other funds received from a
			 source other than the Corporation</quote>; and</text>
				</subparagraph></paragraph><paragraph id="H4609FF5D5E7E4DA3A4D5F171DF92B102"><enum>(3)</enum><text>by adding at the
			 end the following:</text>
				<quoted-block display-inline="no-display-inline" id="HDFC28C8825504EAE99F8A78E7B00E088" style="OLC">
					<subsection commented="no" id="HFE924CCD88BE475E9B12E5309CF5F2BD"><enum>(e)</enum><text>For purposes of
				other programs that have Federal funds matching requirements, funds received by
				a recipient from the Corporation shall not be considered to be Federal funds
				for the purpose of determining whether those funds may be used as non-Federal
				matching funds.</text>
					</subsection><after-quoted-block></after-quoted-block></quoted-block>
