		<official-title display="yes">To amend the Fair Credit Reporting Act to
		  provide for an exclusion from Red Flag Guidelines for certain
		  businesses.</official-title>

		<section id="H93A7B8C931B14B1EB0B72D03841F51FB" section-type="section-one"><enum>1.</enum><header>Exclusion for certain small
			 businesses</header>
			<subsection id="HB2FC37C6FD394FC8AE0309DE1E0F454E"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Section 615(e) of the
			 Fair Credit Reporting Act (15 U.S.C. 1681m(e)) is amended by adding at the end
			 the following new paragraphs:</text>
				<quoted-block display-inline="no-display-inline" id="HD8D3720F9818410792486C4C0CF47873" style="OLC">
					<paragraph id="H25DCECF828D74F9E893E60A4B78B6356"><enum>(4)</enum><header>Exclusion for
				certain businesses</header><text display-inline="yes-display-inline">For
				purposes of this subsection, the term <term>creditor</term> shall not
				include—</text>
						<subparagraph id="HA406A7DDC0564C179AB13CAE217FA603"><enum>(A)</enum><text>a health care
				practice with 20 or fewer employees;</text>
						</subparagraph><subparagraph id="H31E7619E2C044A408B42A41791AE9014"><enum>(B)</enum><text>an accounting
				practice with 20 or fewer employees;</text>
						</subparagraph><subparagraph id="H330651F733A345DCB47C2ABE63D5BFED"><enum>(C)</enum><text>a legal practice
				with 20 or fewer employees; or</text>
						</subparagraph><subparagraph id="HE47605717F1443DDA36665F828AD6A5C"><enum>(D)</enum><text display-inline="yes-display-inline">any other business, if the Commission
				determines, following an application for exclusion by such business, that such
				business—</text>
							<clause id="H0D8CD4E0B02C4642A020F0F5D832E76C"><enum>(i)</enum><text>knows all of its
				customers or clients individually;</text>
							</clause><clause id="H97D0BB4B9E734CC291CD4BF452E161BA"><enum>(ii)</enum><text>only performs
				services in or around the residences of its customers; or</text>
							</clause><clause id="H6DA8824E904E47B7ACD0BE80B0A5B4C9"><enum>(iii)</enum><text display-inline="yes-display-inline">has not experienced incidents of identity
				theft and identity theft is rare for businesses of that type.</text>
							</clause></subparagraph></paragraph><paragraph id="HDDD02CAEF3B74F8F8020586AE6B45EE8"><enum>(5)</enum><header>Limitation on
				exclusion for businesses no-longer eligible</header><text display-inline="yes-display-inline">To the extent that a business can no longer
				demonstrate that it meets the criteria under paragraph (4) that permitted its
				exclusion from the term <term>creditor</term>, such exclusion shall no longer
				apply.</text>
					</paragraph><paragraph id="H041E268EBDAB40609A8B201E9C046D1A"><enum>(6)</enum><header>Definitions</header><text display-inline="yes-display-inline">For purposes of this subsection:</text>
						<subparagraph id="H311D7A5FB78340629E069B6416F271D6"><enum>(A)</enum><header>Employee</header><text display-inline="yes-display-inline">With respect to a business, the term
				<term>employee</term> means any individual who works for such business and is
				paid either wages or a salary.</text>
						</subparagraph><subparagraph id="HABB5957233E5475AA26D8CC24F7D80AF"><enum>(B)</enum><header>Health care
				practice</header>
							<clause id="HE35D5E0DE2604A5ABFCFA12975B3B1A0"><enum>(i)</enum><header>In
				general</header><text>The term <term>health care practice</term> means a
				business that’s primary service is providing health care via health care
				professionals employed by the business.</text>
							</clause><clause id="HDE78E39A56304D60A27B0E69EC9B581A"><enum>(ii)</enum><header>Health care
				professional</header><text>For purposes of subparagraph (A), the term
				<term>health care professional</term> means an individual engaged in providing
				health care and licensed under State law, including physicians, dentists,
				podiatrists, chiropractors, physical therapists, occupational therapists,
				marriage and family therapists, optometrists, speech therapists, language
				therapists, hearing therapists, and
				veterinarians.</text>
							</clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H6CAA113BDE0443AF85A8547E6E32227E"><enum>(b)</enum><header>Process for
			 exclusion applications</header><text display-inline="yes-display-inline">Not
			 later than 180 days after the date of the enactment of this Act, the Federal
			 Trade Commission shall issue regulations, in accordance with section 553 of
			 title 5, United States Code, that set forth the process by which a business may
			 apply for an exclusion under section 615(e)(4)(D) of the Fair Credit Reporting
			 Act.</text>
