		<official-title display="yes">To authorize the Secretary of the Interior
		  to grant market-related contract extensions of certain timber contracts between
		  the Secretary of the Interior and timber purchasers, and for other
		  purposes.</official-title>

	<legis-body display-enacting-clause="yes-display-enacting-clause" id="HEB97FF10A0D144DA8445B5AD623A9EF2" style="OLC">
		<section commented="no" display-inline="no-display-inline" id="H3CB1E7BDBFA842CF888DCFDA01A011B5" section-type="section-one"><enum>1.</enum><header display-inline="yes-display-inline">Qualifying timber contract options</header>
			<subsection commented="no" display-inline="no-display-inline" id="HCF59996F6D1043CAA57AB3C6E0056C06"><enum>(a)</enum><header display-inline="yes-display-inline">Definitions</header><text display-inline="yes-display-inline">In this section:</text>
				<paragraph commented="no" display-inline="no-display-inline" id="HFBDBD5CB920041E499DF9258B6FE2702"><enum>(1)</enum><header display-inline="yes-display-inline">Qualifying contract</header><text display-inline="yes-display-inline">The term <term>qualifying contract</term>
			 means a contract that has not been terminated by the Bureau of Land Management
			 for the sale of timber on lands administered by the Bureau of Land Management
			 that meets all of the following criteria:</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="H9BD72C8E251E437B82FA38B5B62C5042"><enum>(A)</enum><text display-inline="yes-display-inline">The contract was awarded during the period
			 beginning on January 1, 2005, and ending on December 31, 2008.</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H0B2DEF1DCD0A4840BAB40B2834470383"><enum>(B)</enum><text display-inline="yes-display-inline">There is unharvested volume remaining for
			 the contract.</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H9828117C759347B3BBB7CF8D6488A980"><enum>(C)</enum><text display-inline="yes-display-inline">The contract is not a salvage sale.</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H9B4FE3E253764116B41D1F523482BFED"><enum>(D)</enum><text display-inline="yes-display-inline">The Secretary determined there is not an
			 urgent need to harvest under the contract due to deteriorating timber
			 conditions that developed after the award of the contract.</text>
					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H5B834A2CA24D45E2BBD4AA386BCA7EBD"><enum>(2)</enum><header display-inline="yes-display-inline">Secretary</header><text display-inline="yes-display-inline">The term <term>Secretary</term> means the
			 Secretary of the Interior, acting through the Director of Bureau of Land
			 Management.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HA86B63B5992C46CC8878FF4A1C9AD450"><enum>(3)</enum><header display-inline="yes-display-inline">Timber purchaser</header><text display-inline="yes-display-inline">The term <term>timber purchaser</term>
			 means the party to the qualifying contract for the sale of timber from lands
			 administered by the Bureau of Land Management.</text>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="HD4CCE8110914447A99A442B8A5B84E02"><enum>(b)</enum><header display-inline="yes-display-inline">Market-related contract extension
			 option</header><text display-inline="yes-display-inline">Upon a timber
			 purchaser’s written request, the Secretary may make a one-time modification to
			 the qualifying contract to add 3 years to the contract expiration date if the
			 written request—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="HF2467C13313E4115942337DA23B6BE6D"><enum>(1)</enum><text display-inline="yes-display-inline">is received by the Secretary not later than
			 90 days after the date of enactment of this Act; and</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HACE2A5D08ABF4F408AD8C613AB93A124"><enum>(2)</enum><text display-inline="yes-display-inline">contains a provision releasing the United
			 States from all liability, including further consideration or compensation,
			 resulting from the modification under this subsection of the term of a
			 qualifying contract.</text>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H4A98DB5D777B4D7D9809DDCCCCA6B95C"><enum>(c)</enum><header display-inline="yes-display-inline">Reporting</header><text display-inline="yes-display-inline">Not later than 6 months after the date of
			 the enactment of this Act, the Secretary shall submit to Congress a report
			 detailing a plan and timeline to promulgate new regulations authorizing the
			 Bureau of Land Management to extend and renegotiate timber contracts due to
			 changes in market conditions.</text>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="H8510FAB40C1147B1BC3D1246504E7FA4"><enum>(d)</enum><header display-inline="yes-display-inline">Regulations</header><text display-inline="yes-display-inline">Not later than 2 years after the date of
			 the enactment of this Act, the Secretary shall promulgate new regulations
			 authorizing the Bureau of Land Management to extend and renegotiate timber
			 contracts due to changes in market conditions.</text>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="HCBA8B07D208A486895DADCF0B8102BEA"><enum>(e)</enum><header display-inline="yes-display-inline">No surrender of claims</header><text display-inline="yes-display-inline">This section shall not have the effect of
			 surrendering any claim by the United States against any timber purchaser that
			 arose under a timber sale contract, including a qualifying contract, before the
			 date on which the Secretary adjusts the contract term under subsection
			 (b).</text>
